What has been changed in version 1.00

The following explanatory note is added: For the common domain messages (IE301, IE303 and IE319), the information received in the IE315 will be re-used. The receiving MS may not reject those three messages if it includes both the EORI/TCUIN and the NAD. The MS receiving the IE301, IE303 or IE39 is supposed to retrieve the NAD data from EOS if only the EORI/TCUIN is received.

Typo on CONSIGNEE is fixed.

What has been changed in version 1.01

Confirmation that the KEL Proposal is implemented in DDNIA v11.00. Two very minor and purely documentary errors detected in the KEL Proposal v1.00 and fixed:

o (REPRESENTATIVE) TRADER TR0099 was left by mistake in v1.00, replaced by R501. o Impact on CC351A.xsd in Appendix X was incorrectly mentioned in v1.00.

Explanatory notes requested by some MS to avoid different interpretations in EU: 1. The amendment mentions that where an EORI number or a TCUIN is provided, the name and

address shall not be provided. Each NICA must verify the external domain messages and must reject those with both EORI/TCUIN and address. DG TAXUD invites all MS to strictly apply this new specification, and to inform the Commission in case the deadline of 01/12/2014 cannot be met strictly.

2. The Rule501 says that ‘only corresponding values which are carried over from a previous message may be used’. R501 must be considered as a filling rule, explaining how the sending NICA must work: an IE303 sent on the Common Domain will only include the EORI/TCUIN information received from traders, and will not include the address.

3. Considering that the alignment of all 28 NICAs will not be possible the same day at the same minute; and considering that the priority is to have the risk data exchanged over the Common Domain as quickly and as smoothly as possible; the NICA receiving an IE303 with TIN/TCUIN and with address, will have to simply ignore the address, without impacting the whole risk management & supply-chain (i.e. no rejection with IE906).

4. In a later RFC (once we have a better view on the effective quality of operations), we can further define more strictly if the messages must also be rejected on the Common Domain.

5. After 01/12/2014, National Project Teams are invited to report to ITSM Support ([email protected]) about any application which keeps sending IE303 with both TIN/TCUIN and address, meaning that the C501 would not be correctly applied.

Analysis

AEO mutual recognition with 3rd countries (already signed with Japan, Canada and USA) was partially

implemented with KEL 0.24a by applying the relevant changes to the (CONSIGNOR) TRADER.TIN data

element. The amendment of Regulation (EEC) No 2454/93 decided on 21/11/2013 by CCC-DIH sector

committee changes the legislation (CCIP Annex 30A, Annex 37 and Annex 38) with regard to the

usage of the 'Third Country unique identification number' (TCUIN) for the (CONSIGNEE)

TRADER.TIN, NOTIFY PARTY.TIN and (ENTRY CARRIER) TRADER.TIN.

Based on the voted legal change it is proposed the replacement of Rule 835 by the properly modified

Rule 840 to the (CONSIGNEE) TRADER.TIN, NOTIFY PARTY.TIN and (ENTRY CARRIER) TRADER.TIN

data elements in IE303 and IE315.

The amendment also mentions that where an EORI number or a TCUIN is provided, the name and

address shall not be provided. In order to fulfil this new requirement, Cond 501 will be reworded as

shown further below.

The proposed changes are aiming to align the current specifications to the latest amendment of

Regulation (EEC) No 2454/93.

The verification and rejection will be strictly applied on the external domain messages only, not on

the common domain messages which are expected to be correctly constructed, by re-using the correct

input from the traders. This approach will enable a smooth transition in operations.

Proposed Changes (FSS) for information only

1. Rule 840 will be changed as follows:

If the Trader has a valid EORI Trader Identification number (EORI-TIN) or a Third Country Unique Identification or authorisation Number (TCUIN) which has been made available to the Union by the third country concerned (EORI-alike-TIN), then the EORI-TIN or EORI-alike-TIN TCUIN shall be declared. Other than EORI-TIN or EORI-alike-TIN TCUIN shall not be used, otherwise the ENS declaration will be rejected.

2. Cond 501 will be changed as follows:
