FollowingtheChamber’sfirstboardmeetingoftheyear,we’reallfeelingmoreenergizedandoptimisticthanever.OurstellarnewBoardbreezedthroughtheyear’sfirstmeetingandestablishedour2013prioritiesfortheChamberandourmembership.OurViceChairshaveformedtheissue-specificcommitteesthatwillmovetheseprioritiesforward. InFebruary,PaulFarmer,ourCEOandPresident,AngelGaribaldo,ourMarketing&MembershipDirector,andIattendedtheWesternAssociationofChamberExecutives(WACE)conference.ThisconferencewasheldinSanFranciscoandbroughttogetherChamberprofessionalsfrom
theWesternU.S.foraninspiringthree-daytrainingandnetworkingevent.ItwasincrediblymotivatingtobeimmersedwiththeotherCEO’sandstaffmembers-allweresowillingtosharetheirformulasforsuccessandtolearnfromeachother! Thisyear’sWACEhadmanydifferentfocusesandprovidedattendeeswithmyriadoptionsforgrowingandstrengtheningChambers.Oneoftheconference’scentralthemesstruckmeasparticularlyrelevantduringthisgrowth-orientederaforourChamber–whatchamberscandotosupporteconomicprosperity,innovation,andtransformation. SeveralspeakersatWACErecommendedabookcalledTheComingJobsWarbyJimClifton.Itooktheiradviceandstartedreadingit.Inthebook,Jimsuggeststhatjobswillbecomethenewinternationalcurrency.Thecentralfocusofhisbook
isthatjobcreationmustbegeneratedfromthebusinessleadersofourcities,towns,countiesandcountries–inotherwords,byourChambermembership!Hebelievesthatnewbusinessesarecreatedthroughinnovation,entrepreneurs,cityandcountyleadership,highereducationatouruniversitiesandjuniorcolleges,andviastrategicallianceswithcommunitypartners,innovationgroups,andbetweencities,countiesandcountries. WhatiscrystalcleartomeisthatChamberswillneedtoembraceandunderstandtoday’sentrepreneursiftheywanttoberelevant10yearson(andwellintothefuture).WhileIjuststartedreadingJim’sbook,Iwouldhighlyrecommenditifyouhaveaninterestineconomicdevelopment.Learningfromeachother,fromexperts,andfromotherChambers,weallhavetheopportunitytogrow
andstrengthenoursharedwork.Ourregionisundoubtedlyunique,butwesharechallengeswithmanyotherregions.Weshouldbuildupontheirexperiencestostreamlineourownpathtoever-greaterprosperityandsuccess. TheWACEconferencewaseducationalandinspiring.Perhapsmostimportantly,thethreeofuswhoattendedwereremindedthatwerepresentatrulyincrediblecommunityofbusinesses,andthatwehavetheopportunitythisyeartoworkwithanamazingChamberteam.InSteinbeckCountry,wehavevastresourcesandcontactsatourfingertips.Withtheunwaveringdedicationofourboardandstaff,thereislittlestandinginthewayofourbuildingtheviable,successfulchamberofcommercethatwillcontinuetosupportourcommunityandourmembersforyearstocome.

Bills Reflect California Democrats' ambitious agenda

SACRAMENTO,Calif.-EmboldenedbytheirsupermajoritiesintheLegislature,Democratshavebeguntochartanambitiousagendaoutlinedinthehundredsofbillstheyintroducedbeforelastweek'sdeadline.Fromguncontroltorevenueincreases,votingrightstoenvironmentalprotections,theirproposalswouldmakesignificantchangestoCalifornialawiftheypassandwinsupportfromDemocraticGov.JerryBrown. OutnumberedRepublicanssaidtheycanonlyhopetohaveasayinshapingthatagendaastheyintroducedtheirownbills,manyofwhichareintendedtomodifyorrepealmeasuresadoptedbymajorityDemocratsinrecentyears. Thetwo-thirdsmajoritiesintheAssemblyandSenatewonbyDemocratsduringNovember'selectiongivethemthepowertounilaterallyincreasetaxes,passemergencylegislation,overridegubernatorialvetoesandputconstitutionalamendmentsbeforevoters.Whiletheirsupermajoritiesarebeingunderminedtemporarilyassomelawmakersresigntotakenewofficesorjobsoutsidegovernment,Democraticleadersareconfidenttheyultimatelywillmaintainthetwo-thirdsthresholdinbothhouses. AFieldPollreleasedlastweekfoundthat55percentofvotersthinktheDemocrats'supermajoritiesaregoodforCalifornia. ByFriday'sdeadline,lawmakershadintroduced2,189billsforthisyear'ssession-1,376intheAssemblyand
813intheSenate.Thatisactually8percentlessthanin2011,thestartoftheprevioustwo-yearsession,whenlawmakersintroduced2,381bills. Democraticleadershavepledgedtotreadcarefullyontaxissuesandinotherareasforfearofalienatingvoters,yetthemajoritypartyismovingaggressivelyonseveralfronts. IntheSenate,DemocratsdeclaredthattheywantedtoenacteventoughergunandammunitionlawsthanthosesignedintolawlastmonthinNewYork,announcingtheirintentionsjust10daysafterpromisingacautiousapproachonguncontrollegislation. SenatePresidentProTemDarrellSteinbergofSacramentosaidhewasconfidentDemocratscouldusetheirsupermajoritiesto"onceagainmakeCalifornia'sgunlawstheverytoughestinthenation." HealsoissupportingproposalsthatwouldtinkerwithProposition13,thelandmark1978voterinitiativethatrolledbackpropertytaxesandstrictlylimitedhowmuchtheycouldriseeachyear.Italsoincreasedthepercentageofvotesrequiredtopasslocaltaxhikes. DemocraticSens.MarkLenoofSanFranciscoandLoisWolkofDavisareproposingconstitutionalamendmentstolowerthevotethresholdtoraisetaxesforschooldistrictsandsomeotherlocalgovernmentsfromthecurrenttwo-thirdsto55percent. AssemblymanTomAmmianoofSanFranciscoisseekingachangethatwouldeliminateProposition13provisionsthat
letcorporationsavoidreassessmentsafterpropertysales.Nochangesareproposedfortherulesgoverningresidentialpropertytaxassessments. Sen.NoreenEvans,D-SantaRosa,hasintroducedabillwithLenothatwouldimposeanewtaxonoilproducedinCalifornia,whichRepublicanssaywouldinevitablybepassedontomotorists.Themeasurewouldraiseaprojected$2billionannuallytohelpfundthestate'shighereducationandstateparkssystems. Californiaisamongthenation'stopoil-producingstatesbutdoesnottaxoilextractionasotherstatesdo,includingTexas.In2011,Californiawellsproduced196.8millionbarrelsofoil. DemocratsalsoarechampioningissuesthattraditionallyhavebeenpromotedbyRepublicanlawmakers,includingchangestoenvironmentregulationsandpromotingjobcreation. SteinberghasintroducedabillthatwouldaltertheCaliforniaEnvironmentalQualityAct,amongthestrictestland-uselawsinthenation.HeandBrownsaythelawhasbeenimproperlyusedtodelaybeneficialprojects. Meanwhile,AssemblySpeakerProTemNoraCampos,D-SanJose,proposestoletlocalgovernmentscreate"jobsandinfrastructuredistricts."Theywouldusetax-incrementfinancingtoprovideincentivestobusinessesasawaytohireandtrainmoreemployees. ThemeasurefitsintowhatSpeakerJohnPerez,D-LosAngeles,saidwillbehistoppriority:puttingCaliforniansbacktowork. Changestotheballotwillbeanothertopicofdebatethisyear,withDemocratsproposinglegislationthat,ifpassed,couldworktotheiradvantageinthefuture. Steinbergispromotinglimitsonthestate'sinitiativeprocess,whichcriticssaidhasbeenhijackedbywealthyspecialinterests.Hewantstorequireinitiativeproponentstoworkwithlegislatorstofine-tunetheirproposals,letinitiativesexpireaftera
certainnumberofyearsunlesstheyarerenewedandrequireproponentstoshowgrassrootssupportbycollectingsmalldonationsandusingunpaidsignature-gatherers. Republicansfearsuchchangeswouldbenefitlaborunionsandhurtbusinessinterestsandwealthyindividuals,whohavefundedsomemajorrecentballotcampaigns. Democratsalsohaveintroducedatleastthreebillstoextendtheirreachtoyoungvoters. Sen.Hannah-BethJackson,D-SantaBarbara,wantstolet15-year-oldspre-registertovoteastheysignupfortheirinstructionalpermitsordriver'slicenses.AssemblymanKevinMullin,D-SanMateo,isproposingaconstitutionalamendmentpermitting17-year-oldstovoteinprimariesiftheywillbe18bythenextgeneralelection.AndSen.LelandYee,D-SanFrancisco,wouldrequirepollingplacesoneachUniversityofCaliforniaandCaliforniaStateUniversitycampus. Republicans,meanwhile,arefightingagainstseveralDemocraticpriorities,includingafeeimposedonruralpropertyownerstofundwildfire-preventionefforts. BillsbySen.AnthonyCannella,R-Ceres,andAssemblymanJeffGorell,R-Camarillo,wouldfreezecollegetuitionaslongasthegovernor'staxincreasesremaininplace-fouryearsforthestatesalestaxandsevenyearsforthehigherincometaxesonthosemaking$250,000ayearormore. AssemblyRepublicansarefocusingonareaswheretheycanagreewithmajorityDemocrats.WhiletheyobjecttomostofmostoftheDemocrats'guncontrolproposals,forexample,theyarejoiningineffortstotakegunsawayfrommentallyillpeople,felonsandotherswhoownweaponsinviolationofexistinglaws. "IthinkCalifornianswantandexpectustofindareasofimportancewherewecanworktogether,"saidAssemblyMinorityLeaderConnieConway,R-Tulare.

HisprofessionalcareerineconomicdevelopmenthasseenDavidservemorethan20citiesinthreecounties;includingtheCityofSacramento,PlacerCounty,FresnoCounty,andSanLuisObispoCounty.TherecipientofmanyindustryAwardsofExcellenceforhiswork,SpaurcomestoMontereyCountyfromhislastpositionasPresident&CEOoftheMercedCountyEconomicDevelopmentCorporation. From2006through2009,DavidservedastheEconomicDevelopmentDirectorfortheCityofSacramento,wherehisaccomplishmentsweremany.Hedirectedaturn-aroundplanfortheEconomicDevelopmentandRedevelopmentDivisions,completedtheCity’sfirstEconomicDevelopmentStrategy,integratedamodelDowntownRedevelopmentPlanintotheupdatedGeneralPlan,andcreatedthefirstStimulusPlan. AparticularvaluethatSpaurbringstoMontereyCountyishisextensiveexperienceworkingwithcorporatesiteselectors.Whencompaniesarelookingtoexpand,citiesandcountiesmustknowhowtomarketthemselves.David’s“scorecard”ismuchtoolongtoprinthere,butincludesdozensof
marqueecompanieswhichhaveinvestedwelloverabilliondollars. Say What? Copyisthenameforwrittenmaterialinbrochures,websites,salescollateral,booksandperiodicals. Well-writtencopyisrare.It’ssuchadelightfulsurprisewhenIstumbleuponawebsite,brochureorpieceofdirectmailthat’swrittenlikearealhumanbeingpennedthewords,withthesmartstorealizeanotherrealhumanbeingwouldbereadingthem. Mostmarketingcopy,saleslettersincluded,istooformal,toolengthy,andfullofoverusedbuzzwords,legalese,andjargon.Why?Nobodywantstoreadthatstuff—it’sboring.And,ithastheoppositeeffectthandesired.Ratherthanmakingagoodimpressionandenticingthereadertotakeaction,mostcopystopspeopleintheirtracks. Copyshouldn’tbeachoretoread.Itshouldbeshort,directandclear.Evenbetterifit’scleverorfunny,butthat’snotalwaysappropriate.Itshouldfloweasily,beinformative,andsaysomethingcompelling. Daretoputsomepersonalityinyourcopy,andwriteitjustlikeyouwouldsayit. Toillustratemypoint,here’sarealexampleofcopythatsaysnothingrelevant,informativeorcompelling(I’vehiddenthecompanynametoprotecttheiridentity): XYZ Company was formed on the principle of providing exceptionally high quality products and services for our clients. Our staff members are carefully-selected professionals who hold exceptional standards of excellence. Our mission statement is that XYZ will provide “Innovative and Focused Solutions for Enterprise Excellence.” Whywouldanyonehirethiscompany?“Highquality,”“InnovativeandFocusedSolutions,”“EnterpriseExcellence?”Thiscouldbeaboutanycompany,anywhere,providinganyservicewhatsoever.Yawn. Here’sanother:As leaders in the industry, ABC Firm has the knowledge to provide you with the highest level of service. Our years of experience, coupled with a team approach, cutting-edge technology and personalized service, assure you of expert, cost-effective and comprehensive legal counsel. Our mission is to provide unsurpassed quality legal service for all aspects of our client needs. expectedmylawfirmtohave“highideals”and“thehighestlevelofprofessionalism.”There’sreallynoneedtotouttherudiments.Andwhilemissionandvisionstatementsarefinefornonprofitsandthebusinessplansofstartupcompanies,theydon’tbelonginmarketingcopy. AnyonewhograduatedcollegelikelypassedtheirEnglishclass,andmostbusinessprofessionalsrelyonwrittencommunicationtodotheirjobs,buttheseaccomplishmentsdonotmakeaqualifiedcopywriter. Aprofessionalcopywritercanmakeabigdifferenceintheeffectivenessofyourmarketing.Ifyoucan’taffordtohireaprofessionalcopywriter,followthesebasictips:1. Write the copy in your usual style then leave it. Go back and read it the next day and begin editing.2. Challenge yourself to cut it by 50%. Remove redundancies and transitions like “therefore,” “with this in mind,” and anything that sounds like the legal department wrote it. “Heretofore,” and “in summary,” don’t belong.3. Remember who you’re writing for and write specifically for them, as if you were having a conversation.4. Remove buzzwords and define acronyms, or just spell out the words. No one is impressed when they don’t understand what you’re saying—you appear arrogant.5. If you’re worried about sounding undignified or unprofessional, change your perspective and worry instead about sounding stuffy and dull—you’re more likely to err by being too conservative.6. Focus on the high points. Cut descriptions you could give during a sales call. Ioncehadaclientcomplainthatthebrochurewecreatedwasgeneratingtoomanyphonecalls.Theywantedtoaddmoredetailsopeopledidn’thavetocalltoaskquestions.Marketingmaterialsareworkingiftheygenerateinquiries.It’sagreatopportunitytotakeaphonecallfromsomeonewithquestionsaboutyourbrochure—that’swhatyouwant—toengageyourtargetaudienceindialoguesoyoucanwinacustomer.

ItwasMarch1874whentheCommonCouncilelectedthefirstmayorofSalinas.Asthe33rdmayortakingofficesome139yearslater,itisapparentthatourcityhasbeenwellservedbythosewhosefootstepsIfollowintoday.Frommustardfieldstoasprawlingurbancityofover150,000,Salinashasshownresiliencyandwhiletherehavebeen,andcontinuetobe,recurringthemesofcityissuesthathaverepeatedthemselvesovertheyears,progresshasbeenmade.
WhennearlyallthebuildingsindowntownSalinasweredestroyedinthegreatearthquakeof1906,MayorRenisonactedquickly.Withinthreedays,allthedebrishadbeencleared,businesseswereabletoresumeoperationsandrebuildingwasunderway.Hesawwhathadtobedoneandhemadeithappen.Everyonecooperated. In1970MayorGadsbyandthecitycounciladdressedtheserecurringproblems:1)Housing;2)UrbanRenewal;and3)AdequatePublicSafety.TheMayorhadattendedtheU.S.ConferenceofMayorsandhadthistosayaboutthefiscalissuesthecityfaced: “Financingcityservicesandfederalandstategovernmentinterventioninlocalaffairsarethetwoprimaryproblemswesharewithallothercities.Revenuesharinghastoexistsocitiescanexist.
But,I’msayingIthinkweknowhowtospendthefundsbetterthanthenationalgovernmentbecauseweknowourownproblemsbetter.”SalinasCalifornian,June29,1970 In1991MayorStylesspokeabouttheneedtoattractnewbusinessestoOldTown,inadequatepoliceresourcesandagrowinggangproblem.Thesearesomeofthesameissuesthecurrentcitycouncildiscussesonaregularbasis22yearslater. Weallknowweneedincreasedpublicsafetyresources,bothpersonnelandamodernpolicestation.Thepreservationofourpreciouswater,vitaltoouragriculturaleconomy,andsufficientfundingandpersonneltorepairandrebuildourstreets,sewers,streetlights,parksandourinfrastructureisnotanewissueforthecity,butonethateveryone
agreesisnecessaryforSalinasaswemoveforward. TheAlisalMarketplace,amodernpolicedepartment,additionalnewbusinesses,andathrivingOldTownarenotreally“new”ideas.Wehavebeendancingaroundthesesubjectsformanyyears.Wehavetheopportunitytoworktogethertomakethesehappeninourlifetime.Wemaynotalwaysagreeonhowtodothat,butIchallengeeachofyoutojoinme,thecitycouncilandtheChambermembersaswediligentlyworkandcollaboratetogetthesethingsdone. MayorRenisondidnotpickupallthepiecesleftfromtheearthquakebyhimself.Hehadacityfullofpeoplewillingtostepinandhelp.Theyworkedtogetherforthegoodofthecity.LetusallfollowinthefootstepsofthosewhochosetomakeadifferenceforSalinas.

With the new year, it is important for employers to be aware of changes in the law. PregnancyDisabilityLeave:UnderCalifornialaw,employeeswhoaredisabledbypregnancyareentitledtouptofourmonthsofunpaidleaveiftheyworkforanemployerwithatleastfiveemployees. What’sNew:EffectiveDecember30,2012,regulationsinterpretingthislawwereamended.Oneofthemajorchangesisinthecalculationof“fourmonths,”whichisnowdefinedasthenumberofdaysorhoursanemployeewouldnormallyworkin17⅓weeks(athirdofayear).Forexample,anemployeewhoworks40hoursperweekwouldhave693hoursofleaveavailable(40x17-1/3).The
newregulationsalsogiveemployersmoreguidanceoninformationthatmustbegiventoemployees,andonhowtohandleaccommodatingpregnantemployees.ThefulltextoftheregulationscanbefoundatthefollowingURL:http://tinyurl.com/affdo77 PersonnelRecordsInspection:Previously,ifanemployeeaskedforacopyofhisorherpersonnelfile,theemployerwasobligatedtoprovidecopiesofdocumentstheemployeesigned. What’sNew:EffectiveJanuary1,2013,currentorformeremployeesmayinspectorreceivecopiesoftheirpersonnelrecordsrelatingtoperformanceoranygrievanceconcerningtheemployee,regardlessofwhethertheemployeesignedthosedocuments.Theemployerhas30calendardaystoallowtheinspectionorprovidethecopies,unlessthereisanagreementtoanextensionofnomorethanfiveadditionaldays.Failuretocomplywiththerequestcanresultina$750penalty.
ExpandedProtectedClasses:A“protectedclass”referstocharacteristicsthatareprotectedunderthelawandcannotbethebasisfordiscriminationorharassmentintheworkplace.UnderCalifornialaw,theprotectedclassesincludesex,race,color,religion,nationalorigin,citizenshipstatus,gender,genderidentity,genderexpression,geneticcharacteristics,sexualorientation,maritalstatus,pregnancy,childbirthorarelatedmedicalcondition,age,disability,mentalorphysicaldisability,ancestry,medicalcondition,andveteranstatus.“Sex”includesgender,pregnancy,childbirth,andmedicalconditionsrelatedtopregnancyorchildbirth.Specificto“religion,”anemployerisrequiredtoreasonablyaccommodatebonafidereligiousbeliefs,observances,andpracticesofemployees,unlessitwouldpresentanunduehardshiptodoso. What’sNew:EffectiveJanuary1,2013,discriminationbasedonsexnow
includesdiscriminationagainstafemaleemployeewhoisbreastfeedingorhasamedicalconditionrelatedtobreastfeeding.Additionally,thedefinitionofareligiousbelief,observanceorpracticeincludes“religiousdresspractices”and“religiousgroomingstandards,”whichcanincludethewearingorcarryingofreligiousclothing,headorfacecoverings,jewelry,andthewearingofallformsofhead,facial,andbodyhairinobservanceoftheemployee’sreligion.Thenewlawspecifiesthatsegregatingtheemployeefromthepublicorotheremployeeswouldnotbeanappropriateaccommodation. OfDutchheritage,LuAnnwasborninMilwaukee,Wisconsin.Whenshewasatoddler,herparentstraveledtoSantaClaraforherfather’sjob.ShegrewupinCapitolaastheeldestchildwithfourbrothersandasister.SheattendedSoquelHighandCabrilloCollege,thenwasacceptedtoSanJoseState’snursingprogram.Shedecidedthiswasnotthepathforherandwentintobusinessand
salesdevelopment,instead. In1973LuAnnstartedherbankingcareerwithWellsFargoBank.SheworkedherwaythroughmanylevelsasaVicePresident,runningDistrictBranchOperationsfor3branchesinMonterey.ShewasappointedtotheWellsFargoconversionteamsforacquiringnewbanksandbusinessdevelopmentinSantaCruzCountyandMontereyCounty.HerlastassignmentwasVicePresidentandBranchManageroftheDowntownCarmelBranchofWellsFargo.SheleftWellsFargoin1990tostarthercareerinthewineindustry. LuAnnwasco-ownerofVentanaVineyards.Sheappliedherskillsandtalentstogrowthatbusinessfor28years,beforedecidingtosellthecompanyin2006soshecouldenjoyhergrandchildrenandcontinueservingthecommunity.From1994to2002,whileworkingwithVentanaVineyards,shestartedastatewideWineDistributionCompanythatrepresentedover35importsandCaliforniawinebrandsandemployedover20salespeople. LuAnn’sphilanthropicandcommunityeffortshavebenefitedtourismandthelocaleconomy,amongothers.Alwaysenthusiasticabouttellingtheworldaboutthequalityof“MagnificentMontereyWineCountry,”shehasbroughtnational
recognitiontotheaccomplishmentsofMontereyCounty’sWineIndustryforover28years.ShehasservedasPresidentoftheMontereyCountyVintnersandGrowersAssociationwhereshestartedthe“GreatWineEscape”weekend.ShewasalsoPresidentoftheCapitolaChamberofCommercein1985,whereshewasoneoftheFoundersoftheCapitolaArtandWineFestival(whichisstillgoingstrong).Closertohome,shechairedandfoundedthemajorfundraisingeventfortheCarmelBusinessAssociation;“ATasteofCarmel”justcelebratedits21stanniversary.Inadditiontopromotingtourismandthewineindustry,LuAnnhashelpedwithlocaleconomicdevelopmentandplanningforourCounty’sfuturegrowth.ShehasbeenveryactiveinMontereyCounty’sGeneralplanprocess,ensuringthataWineryCorridor(“RouteduVin”)isincluded. In2009,LuAnnwaselectedtotheBoardofDirectorsfortheSalinasLeadershipGroup,anon-profitfocusedonidentifyingnewbusinessleadersinourcommunity.ShewasrecentlyappointedtotheBoardfortheSteinbeckInnovationCluster,whichwasfoundedinNovemberof2012.Thisnon-profitfollowsherlovefordevelopingyoungprofessionals,theentrepreneurialspiritandoureconomy.
LuAnnhashelpedraisedmillionsofdollarsthroughherpoliticaleffortsandhernon-profitfundraisingandevents. Onapersonallevel,LuAnn’sfamilyincludestwosons,astepdaughterand4grandchildren.Shelovestotravel(havingjustreturnedfromtouringItaly,France,SpainandCroatia),snowski,dogsled,andassistwithco-pilotingsmallplanes(althoughofcourseshewantstogetherownpilot’slicensein2013).LuAnnshowedherdaredevilsidebyskydivingwithher21yearoldson.Sheloveskidsandhelpingyoungtroubledadults,withRanchoCielobeingoneofherfavoritecharitiestosupport.LikeImentionedatthestartofthisarticle,we’reprobablyallexhaustedjustreadingaboutLuAnn’smanyactivities.Onething’sforsure:theChamberandthecommunityarefortunatetohaveher!

TheGovernorlaidouthisproposedbudgetandpresentedtheStateoftheState.IhavebeguntointroducenewlegislationandamworkingwithmyAssemblyandSenateonideasforbillstheyhavethatIcanalsosupport. Myprioritiesthisyearareveryclear.Iwanttostrengthenpublicsafetyandeducationandhelptheeconomyrecoverasquicklyaspossible.Sofarthisyear,Ihavepresentedtwobillsthatreflectthosegoals:SB58,whichfreezespublichigher-educationtuition,andSB144,theRealignmentReinvestmentAct. InNovember,votersresoundinglyapprovedProp30,whichwastitled“Temporarytaxestofundeducation.”However,thetextoftheinitiativedidnotcompletelymatchwhatwasbeingsoldtothevoters.Whilethereisanexistingformulathatensures
aportiongoestoK-14education,thereisnothingtoprovidefundsfortheCSUsorUCs.Toaddressthis,IintroducedSB58,whichwouldfreezetuitionacrosshighereducationwhilethetaxesareinplace.WeoweittoCaliforniavoterstoensurethatthenewtaxesaregoingtotheprogramstheyvotedtosupport.Thisbilldoesexactlythat.Thenon–partisanLAOhasshownthatthesenewtaxeswillbringinbillionsofdollarsthatwillfallintoasurplus.Thosefundsshouldbeusedtobackfilltheuniversityandcommunitycollegebudgetssowearenotplacingthatfinancialburdenonthebacksofstudents. IalsointroducedSB144,theRealignmentReinvestmentAct,tostrengthenthestate’sprisonrealignmentprogram.Itensuresthefullsavingsthestateisrealizingfrom
housingfewerprisonersisinvestedinlocalcriminaljusticeagencies.SincerealignmentwasimplementedinOctober2011,ithasoverburdenedcounties,suchasMontereyCounty,bygivingthemresponsibilityforhardenedcriminalsbutfarlessresourcesthantheyneedtoadequatelysuperviseandrehabilitatethoseoffenders.IhaveworkedcloselywithSheriffScottMillertodevelopthebill,whichIhopewillmakethecommunitysafer. Monterey County Women Lawyers association: Cooperation and philanthropy

MontereyCountyWomenLawyersAssociationisagroupoflawyersmadeupthesedaysofbothmenandwomen.Theorganizationraisesfundsthroughvariouseventsandcontributesthosefundsbacktothecommunityintheformsofscholarshipsanddonationstolocalcharitablegroups. Theorganization,whichevolvedintowhatisnowknownastheMCWLA,wasfoundedbyagroupoftrail-blazingwomenattorneysin1981.Notonlydotheypromotethecommoninterestsofwomeninthelegalprofessionandthejudiciary,buttheyalsosupporteachotherthroughcooperationandservicetothecommunity.Atthetimethegroupwasformed,fewerthan25womenpracticedlawinMontereyCountyandtherewerenowomenjudgesintheCounty.Manywomenfoundthatbreakingthetraditionalbarriersintowhathadbeenanall-maleprofessioncamewithuniquechallenges. Timeshavechanged.Nowmorethanonethirdofthe500+membersoftheMontereyCountyBarAssociationarewomenand10ofthe20judicialofficersarewomen.TheAssociationhasseenpositivedevelopmentsinthelocallegalcommunitythroughoutitsexistence. “Weseeknotonlytosupportwomeninthelegalprofession,butalsotohelpcommunityorganizationsthat
focusonwomenandthefamily,”saidSarahCavassa,thecurrentpresidentoftheAssociation. Lastyear,theAssociation’sfundraisingeffortsresultedinscholarshipstotheMontereyCollegeofLawandtoHartnellCollege’sWomen’sEducationLeadershipInitiative.AlloftheAssociation’sphilanthropiceffortshaveonethingincommon:providingfundstoprogramsthatmateriallyassistwiththehealth,educationandwelfareoflocalpeopleandtheirfamilies.“Ithasbeenrewardingtoseeoureffortsbenefitlocalprograms,suchasGirlsInc.oftheCentralCoast,ShelterOutreachPlus,InterimandtheYWCA,inadditiontothescholarshipswegrant.Weunderstandthatimprovingwomen’slivesalsoimprovesthelivesoftheirfamilies,sowhenourphilanthropiceffortshelpwomen,wearealsohelpingtheentirefamily,”commentedCavassa. TheAssociationsponsorslivelycontinuingeducationalopportunitiesforlocallawyersbetween6and8timesayear.Speakersincludelocallawyerstalkingaboutspecificlegaltopics,aswellasspecializedpractitionersfromtheSanJoseandSanFranciscoBayArea.“WehavetheabilitytobringinspeakersfromoutsidetheareabecausemostpeoplelovetovisitMontereyCounty,”saidClaireBorges,oneoftheAssociation’sprogramchairs. TheAssociationisuniqueamongprofessionalorganizationsinMontereyCounty.WhentheAssociationpolledotherprofessionssuchasmedicineandaccountinglastyear,therewerenosimilargroupsinthoseprofessionsthatfocusedonbothprofessionalsupportandphilanthropy.“Itisanhonortobepartofsuchauniqueandgreatorganization,”saidCavassa. Identifying properties in a 1031 exchange

InternalRevenueCodesection1031isanexcellentwayforapersontodefertaxoncapitalgainswhentheysellappreciatedproperty.Section1031canbeappliedtodifferenttypesofpropertiesbutthisarticlewilladdresssection1031inthesaleofrealproperty.Therearetwokeyrequirementsinconductinga1031exchange.Thefirstrequirementisthatthesellermustidentifythepotentialreplacementpropertieswithin45daysofthecloseofescrowonsellingtheseller’sproperty(whichisknownasthe“relinquishedproperty”).Thesecondrequirementisthatthesellermustcloseescrowonthereplacementpropertynolaterthan180daysafterthecloseofescrowonthesaleoftherelinquishedproperty.Thisarticleaddressestheseller’salternativestomeetthe45dayidentificationrequirement. Therearethreeseparatewaysthatasellercanmeetthe45dayrequirement.ThefirstisknownastheThreePropertyRule,whichallowsasellertoidentifynomorethanthreealternativereplacementpropertiesaspartofthesametaxdeferredexchange.ThesellerdoesnotneedtostatethefairmarketvaluesoftheintendedreplacementpropertiesundertheThreePropertyRule.TheThreePropertyRulelimitstheidentificationofalternativereplacementpropertiestoonlythree,regardlessofthenumberofrelinquishedpropertiestransferredaspartofthesamedeferredexchange.Although
theprimarydrawbacktothisoptionisthatthesellercanonlyidentifythreeproperties,thebenefitsarethatthesellerdoesnotneedtoidentifythefairmarketvaluesofthereplacementpropertiesandthisisaverysimplyruleforasellertofollow. Asecondalternativeisforanindividualtocomplywiththe200%Rule.Underthisrule,asellercanidentifymorethanthreealternativereplacementpropertiessolongastheaggregatefairmarketvalueofallreplacementpropertiesidentifieddoesnotexceed200%ofthefairmarketvalueoftherelinquishedproperty.Forexample,ifasellersellstherelinquishedpropertyfor$500,000,thenthefairmarketvalueofallduly-identifiedreplacementpropertiescannotexceed$1,000,000underthe200%Rule.Inaddition,thesellermuststatethefairmarketvalueofeachidentifiedreplacementpropertyunderthisrulewhenthesellerprovidesthe45dayidentificationnoticetotheexchangeaccommodator.The200%Rulegivesthesellermoreflexibilityinidentifyingreplacementproperties,butthereisnoguidanceastohowthesellerestablishesthefairmarketvalueoftheintendedreplacementpropertiesunderthisrule.Whentryingtocomplywiththe200%Rule,mostsellerseitherstatethelistingpriceoftheintendedreplacementpropertiesor,iftheyareundercontracttobuytheproperties,thentheystatethecontractualpurchaseprice.However,itispossiblethatneitherthelistingprice

Thethirdalternativeforaselleristofollowthe95%Rule.The95%Ruleallowsthetaxpayertoidentifyasmanyintendedreplacementpropertiesasitchoosesalongwithstatingtheirvalues(evenifthevaluesexceedthe200%Rule)solongasthetaxpayerreceives(meaningpurchases)atleast95%oftheaggregatefairmarketvalueofallidentifiedreplacementpropertiesbeforetheendofthe180dayperiod.Forexample,ifapersonsoldapropertyworth$1,000,000andthenidentifiedfiveintendedreplacementpropertiesthattotaled$4,000,000,thepersonwouldhavetocloseescrowonthosereplacementpropertiesworthatleast$3,800,000ofvalue(whichis95%of$4,000,000)inordertocomplywiththe95%Rule(and,ofcourse,allescrowsmustclosewithinthe180daydeadline).The95%Rulegivesthesellersignificantflexibilityinindentifyingintendedreplacementpropertiessolongasthesellerintendstoactuallycloseescrowonbasicallyall
ofthereplacementproperties.However,ifthesellerclosesescrowonmostofthereplacementpropertiesbutdoesnotmeetthe95%test,thenthesellerwillnothavemetthe95%Ruleandwillnothaveavalidtaxdeferredexchange. Onefinalpointisthatregardlessofwhichoftheserulesthesellerfollows,thesellermustnotifytheexchangeaccommodatorattheendofthe45dayperiodofitsintendedreplacementproperties.Thismeansthattheexchangeaccommodatormustreceivetheseller’swrittenidentificationnotificationattheendofthe45dayperiod.Thesellerwillbedeemedtohavemetthisrequirementifitmailsitsidentificationnoticetotheexchangeaccommodatorsolongastheenvelopecontainingtheidentificationnoticeispostmarkednolaterthanthe45thdayafterthecloseofescrowoftherelinquishedproperty.However,nosellershouldrelyonthepostmarkascomplyingwiththe45dayruleand,outofanabundanceofcaution,thesellerreallyshoulddeliver(eitherpersonallyorviafaxorviaemail)thecompletedwrittenandsigned45dayidentificationnoticetotheexchangeaccommodatornolaterthanthe45thday.Failuretomeetthis45dayrequirementwillresultinaninvalidtaxdeferredexchange.
