43.1 Confirmation of minutes of 420d Meeting:

As no comments/observations on the draft minutes of the 42nd meeting of theApproval Committee of the Dahej SEZ held on 04/09/2012, were received from anymember, the same were confirmed.

43.2 Report on actions taken on decision of the 420d Meeting of the Committee.

Following actions were taken:

Letters were issued to:

1. Mls.Babaji Shivram Clearing & Carriers Pvt. Ltd. -Letter of Approval.2. Mls.Meghmani Industries Ltd. - Letter send to MoCIIBoA for further action.3. Mls.Firmenich Aromatics Production (I) Pvt. Ltd. - Letters issued as per approvals

given in the last UAC.4. Mis.Torrent Energy Ltd.- Letter reg. approval of additional list of goods.5. Mis.Torrent Pharmaceuticals (Dahej) -Letter reg. change of name.

43.5 OTHER CASES:

43.5.1 M/S.OIL AND NATURAL GAS CORPORATION LTD.(ONGC):

Shri R.K. Gupta, CGM-Plant Manager of Mis. ONGC appeared before the ApprovalCommittee for interview and put forth following points:

(i) Presently Mis. DGVCL is supplying power at 220 kV to ONGC C2-C3 Plant,through single feeder, tapping from 220 kV Dahej-PLL GETCO power line since21.04.2009.

(ii) The plant is scheduled for commissioning in Feb-Mar, 2013.

(iii) The plant will be operation on 24*7 basis and for processing of cryogenic LNGdouble feeder power supply is must. Delay in double feeder will lead to nonutilization of allocated scarce Natural Gas & production of LPG.

(iv) DGVCL is presently supplying power to ONGC. GERC has approved DGVCLas a licensee for power distribution in Dahej.

(v) Construction work does not require any land in Dahej SEZ.

Observations/Clarifications of the Committee:

(i) ONGC is getting power supply from DGVCL from 21.04.2009 i.e. beforeissuance of co-developer status to MIs. Torrent Energy Ltd. for supplying powerto Dahej SEZ units.

(ii) ONGC will take all the responsibilities in respect of material ,services etc andlegal formalities regarding supply of power by DGVCL to ONGC in Dahej SEZ.

(iii) ONGC will not be eligible for any tax exemptions for any activity of DGVCLfor supplying power to in Dahej SEZ.

(iv) ONGC will maintain detailed record and books of accounts in respect of material, services or any other thing related for getting power from DGVCL.

(v) MIs. Dahej SEZ Ltd.(The Developer) has agreed in this regard for supply ofpower from DGVCL to MIs ONGC

(vi) The committee approved the request of ONGC for getting power from DGVCLsubject to fulfillment ofthe above mentioned conditions.

43.5.2 MIS. ROCKWOOD LITHIUM INDIA PVT. LTD.:

Shri Harshal Joshi, Plant Manager of MIs. Rockwood Lithium India Pvt. Ltd.appeared before the Approval Committee for interview and put forth following points:

• The company will act as sales and marketing organization for those products,which are not be produced locally by Rockwood Lithium India Pvt. Ltd. Theyplan to start TRADING of the Rockwood Lithium Products which aremanufactured on Rockwood Lithium's other manufacturing sites around theglobe. The local company will stock the products at the Dahej site and will carryout the distribution from there.

• There are 13 items (as per annexure) shortlisted for trading activity with projectcost of (' 35 lacs. This cost would be managed by external commercialborrowing from group company.

• NFE would be increased by (' 426.09 lacs for the period for five years.

• They submitted the list of services for approval.

Observations/Clarifications of the Committee:

It was observed by the Approval Committee that the unit has to apply for GPCBlicense if required for these new products. Further, trading activity is approved forexport purpose or sale to SEZ UnitslEOUs only. Trading Activity is approved by theApproval Committee. Further, regarding approval of services, the ApprovalCommittee approves the list of services subject to the same would be used in SEZ.

43.5.3 MIS. TORRENT ENERGY LTD.:

Shri Nilesh Khatri and Shri Neel Mehta of Mis. Torrent Energy Ltd.(TEL) appearedbefore the Approval Committee for interview and put forth following points:

Mis. Torrent Energy Ltd. submitted two additional lists of goods vide letter dated21.09.2012 and 22.10.2012. The list contains various goods to be procured by thecompany for the purpose of (i) Construction of all type of building in processing area,(ii) Landscaping and water bodies, (iii) Telecom and other communication facilitiesincluding internet connectivity, (iv) Electrical, Gas and Petroleum Natural Gasdistribution network including necessary sub-stations of appropriate capacity, pipelinenetwork etc. and (v) Roads with Street lighting, signals and signage for them.

Observations/Clarifications of the Committee:

The Approval Committee observed that the goods mentioned in the list were certifiedby the Chartered Engineer and are required for the authorized operations of Mis.Torrent Energy Ltd. Hence the list is approved by the Approval Committee.

43.5.4 MlS.SABERO ORGANICS GUJARAT LTD.:

Shri Surendra Mishra, AVP-Manufacturing of Mls.Sabero Organics Gujarat Ltd.appeared before the Approval Committee for interview and put forth following points:

• The board of directors of the unit were changed but the constitution of thecompany was not changed and the company still running as Mis. SaberoOrganics Gujarat Ltd.

• There was a change in Share Holding pattern ofthe company.• As per condition No.14 of Bond cum Legal Undertaking they have to intimate

the above changes to DC office but they failed to do so. They apologized for thatand requested to condone for the same and approve the change in board ofdirectors.

Observations/Clarifications of the Committee:

The Approval Committee observed that there is a delay in filing the documents but asthe unit admitted their mistake for that and the delay was un-intentional, thecommittee approved the request for change of board of directors by the Unit.

43.5.5 MIS. SAPTHAGIRI HOSPITALITY PVT. LTD.

Mis. Sapthagiri Hospitality Pvt. Ltd. submitted the following reports:

(i) Half Yearly Material Procurement, Utilization and Balance Report vide letter No.SHPLISEZIMURI2012-13/57 dated 29.10.2012 for the period from April-20l2 toSeptember-20l2.

(ii) Half Yearly Progress Report vide letter No. SHPLlSEZIHPRl2012-13/56 dated29.10.2012 for the period from April-20l2 to September-20l2.

(iii)Revised Quarterly Progress Report vide letter No. SHPLlSEZlRev.QPRl2012-13/55 dated 29.10.2012 for the period from April-20l2 to June-2012.

(iv)Quarterly Progress Report vide letter No. SHPLlSEZ/QPRl2012-13/58 dated29.10.2012 for the period from July-2012 to September-20l2.

Mls.Sapthagiri submitted that during the above period Ground Floor slab is almostcompleted and Service floor slab work is in progress.

The Approval Committee took a note of the same.

43.5.6 MIS. DAREJ SEZ LTD.

MIs. Dahej SEZ Ltd. submitted the following reports:

(i) Half Yearly Material Procurement, Utilization and Balance Report vide letter No.DSLl2012-1311464 dated 18.10.2012 for the period from April-20l2 toSeptember-20l2.

(ii) Half Yearly Progress Report vide letter No.DSLl20 12-13/1463 dated 18.10.2012for the period from April-20l2 to September-20l2.

(iii) Quarterly Progress Report vide letter No.DSLl2012-13/1462 dated 18.10.2012for the period from July-20l2 to September-2012.

Mls.Dahej SEZ Ltd. submitted that during the above period:

In the Processing Area-Road network completed;

SWD completed;Street Lights on roads completed and energized;Water supply network completed;Effluent disposal pipeline network completed;Co-developer completed power distribution infrastructure and provided powersupply; Gas distribution network under progress and 3 units have been given gasconnections.

In the Non-Processing Area-Infrastructure work is completed;Two hospitality projects allotted plots.

(iv) DSL vide letter No.DSLIDC/Trading-Activity/1641 dated 22.11.2012 requestedfor approval of various services/trading activities in Dahej SEZ. DSL hasworked out 17 services/trading activities which are of immediate need in DahejSEZ.

Observations/Clarifications of the Committee:

The APpro~al Committee took a note for above mentioned reports mentioned fromSr.No.(i) tO

ISr.No.(iii). Regarding request mentioned at Sr.No.(iv) above, the

Approval C~mmittee approved 16 services/trading activities in Dahej SEZ out of 17.The ServiceYTradingActivity of "Fuel Storage and Distribution" was not approved bythe Approvdl Committee. .

43.5.7 MIS. GUJ~T STATE PETRONET LTD.(GSPL)

M/s.Gujarat State Petronet Ltd. submitted the following reports:

(i) HalfY~arly Progress Report vide letter No.GSPLIF&AI dated 12.10.2012 for theperiod from April-2012 to September-Zul Z.

(ii) Quarte~~yProgress Report vide letter No. GSPLIF&AI dated 12.10.2012 for theperiod from July-2012 to September-2012.

M/s.GSPL Lbmitted that during the above period station work is in under progressand in Phasd-I, gas connection have been provided to three units.
