CWAG OVERVIEW

➔ CWAG and NAAG (National Association of Attorneys General) are independent, complimentary organizations that work closely together on behalf of the AG Offices

The Conference of Western Attorneys General (CWAG) is a bipartisan group, originally of Western 

states, now including a majority of U.S. states and several other countries.  Initially organized 

around legal areas of interest such as water rights, Indian law, public lands, minerals and energy, 

CWAG has expanded to provide bipartisan discussions focusing on legal developments in 

emerging issues facing Attorneys General, as well as international Rule of Law programing.

MISSIONCWAG’s primary focus in the United States is to provide a forum for chief legal officers of member 

states and jurisdictions to cultivate knowledge, cooperate on concerns and coordinate actions 

which improve the quality of legal services available to members.  CWAG meetings and 

conferences vary in focus, but always include important public policy discussions.  These 

conferences are attended by Attorneys General and their staff from across the country and often 

include an international component.  CWAG’s communication and coordination of litigation and 

policy information is a vital voice in the interplay among federal, state and foreign officials.

CWAG PROGRAMS

ANNUAL MEETINGSCWAG collaborates with AGO’s, academics and private sector interests to provide panels which present a variety of views on topics at each annual meeting. This gathering garners attendance from across the country, with hundreds of attendees from AGO’s, private sector attendees representing corporations and law firms, and academics and other state and federal officials. The Annual Meetings traditionally host over 25 Attorneys General from across the country and up to 850 attendees. 

TOPICAL MEETINGSCWAG leadership strategically selects relevant subjects to be the focus of multiple topical meetings per year. Similar to CWAG’sannual meeting, topical meetings bring together AGs, AGO senior staff, representatives from the private sector, academics andother state and federal officials to discuss the most pertinent topics that are of concern to the AGs. Recent topical meetings have focused on Cyber Security and Privacy, Marijuana Legalization, Educational Debt, and Prescription Drug Abuse among others.

WESTERN ATTORNEYS GENERAL LITIGATION ACTION COMMITTEE (WAGLAC)CWAG oversees and coordinates the Western Attorneys General Litigation Action Committee (WAGLAC), which consists ofassistant attorneys general involved in litigation related to the environment, natural resources, public lands and Indian law.WAGLAC was formed over 30 years ago and meets three times per year to discuss the latest developments in these areas andlaw. AGO staff gain important contacts throughout the country in these important areas of the law.

CYBER SECURITY WORKING GROUPWith an ever‐increasing focus on cyber security, state attorneys general are turning their attention from discussions and dialogue, to action.  This form of electronic crime is perceived as an ever‐increasing threat to not only consumers and businesses, but toward national security.

This select, invitation‐only group is comprised of attorneys general, senior staff, and internal cyber security experts, who have come to the realization that together, states can more effectively address this criminal activity.  Having the ability to coordinate actions across multistate jurisdictions and in collaboration with private sector experts would lay the foundation for a national cyber crime initiative with teeth.

ROUNDUPCWAG publishes the Roundup, which is sent to more than 1,400members of the CWAG community, including state staff, SAGEmembers and other public and private sector supporters ofCWAG. It serves as a valuable tool to keep members and theinterested public informed about the important work ourattorneys general do and the activities of CWAG. The Roundupand accompanying articles are posted on CWAG’s website.

INQUIRIES AND AMICUS REQUESTSCWAG acts as a clearinghouse for questions from memberstates and for the distribution of amicus requests for memberstates. Whenever a question or amicus request is received,CWAG distributes the information to our member contact listfor responses. This provides a valuable resource to AGO staffwhen a unique legal issue is encountered and staff is looking forsomeone who has worked on such issues.

AMERICAN INDIAN LAW DESKBOOKCWAG has published the American Indian Law Deskbook since 1992, through ourpartnership with Thomson Reuters. Updated annually, the 2018 Edition is nowavailable. Indian law is a dynamic, ever‐evolving field of law. The treatise reflects thecurrent status of Indian law and creates a framework adaptable to new developments,both decisional or statutory. The continuing updates makes it unique among theprincipal Indian law treatises available over the past 26 years.

The chief legal officers of the States offer a unique insight into Indian law. The Stateshave been parties to many of the cases that have shaped Indian law over the years. Itis not unusual for governments, be they federal, state, local or tribal, that sharecommon territories and boundaries to have legal disputes where jurisdiction andauthority are the central questions. The purpose of this book is to present a concise,direct and respectful discussion of Indian law, using the most current sources.

In addition to publishing this Indian law treatise, CWAG hosts webinars each year inIndian law. We have presented on the U.S. Supreme Court decision in Michigan v. BayMills Indian Community and the recent USDOJ policy statement regarding marijuana inIndian country. An upcoming webinar will focus on the Indian Child Welfare Act(ICWA).

CWAG Alliance Partnership

The CWAG Alliance Partnership (www.cwagweb.org/ap) is an international rule of law program supported by the state Attorneys General’s Offices (AGOs) of 42 US states and jurisdictions. The CWAG Alliance Partnership promotes collaboration among state Attorneys General from participating countries; supports greater efficiency and transparency in criminal, civil and commercial judicial systems; and provides training programs that promote the effective investigation and prosecution of transnational criminal activity.

During the past decade of fostering institutional relationships with state AGOs in Mexico, the CWAG Alliance Partnership has generated robust support from every state‐level jurisdiction in Mexico, as well as the federal AGO. This collaborative partnership, funded by the State Department’s Bureau of International Narcotics and Law Enforcement Affairs (INL), encourages successful prosecutions of trans‐border crime and enhanced communication and collaboration with our counterparts in Mexico. Activities include programs to combat transnational crime at the state level, regular communications to strengthen information exchanges among involved AGOs, and training and consulting programs to support Mexican AGOs in their transition to an oral, adversarial criminal justice system. CWAG Alliance Partnership activities in Mexico have reached more than 35,000 members of the legal community.

CWAG RULE OF LAW PROGRAMS

CWAG Africa Alliance Partnership

The Conference of Western Attorneys General (CWAG) Africa Alliance Partnership (www.cwagaap.org) is the latest addition to our renowned international rule‐of‐law efforts.

The CWAG Africa Alliance Partnership seeks to establish andfoster robust relationships with justice and law enforcementagencies and officials in Africa to support the rule of law andcombat transnational criminal activity. CWAG collaborateswith African Ministries of Justice, Attorneys General,Solicitors General and Public Prosecution agencies to shareknowledge and experiences in the fight against crimes likehuman trafficking, corruption, money laundering, cybercrimeand other cross border crimes.
