Cunningham, Kutcher, Braud, Chabert nominated for LSBA, YLD leadership positions

Mark A. Cunningham of New Orleans and Robert A. Kutcher of Metairie have been nominated for the

positions of 2014-15 Louisiana State Bar Association (LSBA) president-elect and 2014-16 LSBA treasurer, respectively. The LSBA’s Nominating Committee formulated these recommendations on Aug. 23 and presented its report to the Board of Governors on Aug. 24.

The Young Lawyers Division (YLD) Council finalized its nominations for 2014-15 chair-elect and 2014-15 secretary. Erin O. Braud of Metairie has been nominated for chair-elect. Scotty E. Chabert, Jr. of Baton Rouge has been nominated for secretary.

Cunningham is a partner in the New Orleans office of Jones Walker, L.L.P.

Kutcher is a partner in the firm of Chopin, Wagar, Richard & Kutcher, L.L.P., in Metairie.

Braud is an attorney with the Law Offices of Robert E. Birtel, staff counsel for Liberty Mutual Insurance Co., in Metairie.

Chabert is an assistant district attorney for the 18th Judicial District and a partner in the firm of Saunders & Chabert in Baton Rouge.

be provided to the membership on Monday, Sept. 30. Deadline for return of nominations by petition and qualification forms is Monday, Oct. 28. First election ballots will be available to members on Monday, Nov. 25. Deadline for electronically casting votes is Monday, Dec. 16.

The LSBA president-elect will automatically assume the presidency in 2015-16.

According to the president-elect rotation, the candidate must have his/her preferred mailing address in Nominating Committee District 1 (parishes of Orleans, Plaquemines, St. Bernard and St. Tammany).

According to the treasurer rotation, the candidate must have his/her preferred mailing address in Nominating Committee District 2 (parishes of Ascension, Assumption, East Baton Rouge, East Feliciana, Iberville, Jefferson, Lafourche, Livingston, Pointe Coupee, St. Charles, St. Helena, St. James, St. John the Baptist, Tangipahoa, Terrebonne, Washington, West Baton Rouge and West Feliciana).

For the 2013-14 election cycle, balloting will be conducted electronically only, as approved by the LSBA Board of Governors. No paper ballots will be provided.

Other positions open for the 2013-14 elections are:

Board of Governors (three-year terms beginning at the adjournment of the 2014 LSBA Annual Meeting and ending at the adjournment of the 2017 LSBA Annual Meeting): one member each from the First, Second, Third and Fifth Board districts.

LSBA House of Delegates (two-year terms beginning at the commencement of the 2014 LSBA Annual Meeting and ending at the commencement of the 2016 LSBA Annual Meeting): one delegate from each of the 1st through 19th Judicial Districts, plus one additional delegate for every additional district judge in each district.

Young Lawyers Division: Chair-elect (2014-15 term), nominee shall be a resident of or actively practicing law in the parishes of Orleans, Jefferson,

St. Bernard or Plaquemines, based on preferred mailing address. Secretary (2014-15 term), nominee shall not be a resident of or actively practicing law in the parishes of Orleans, Jefferson, St. Bernard or Plaquemines, based on preferred mailing address. Petitions for nomination must be signed by 15 members of the Young Lawyers Division. Also to be elected, one representative each from the First, Second, Third, Fifth and Seventh districts (two-year terms).

ABA House of Delegates (must be a member of the American Bar Association): two delegates from the membership at large and one delegate from that portion of the membership not having reached their 35th birthday by Aug. 12, 2014, that delegate being the “Young Lawyer Delegate,” all as required by the rules of the American Bar Association. All LSBA members may vote for both sets of candidates. The delegates will serve two-year terms, beginning with the adjournment of the 2014 ABA Annual Meeting and expiring at the adjournment of the 2016 ABA Annual Meeting.

LSBA executive director to serve on NABE board Louisiana delegates attend 2013 ABA Annual Meeting

Delegates from Louisiana attended the American Bar Association Annual Meet-ing and House of Delegates meeting in San Francisco, Calif., in August. The Louisiana delegation joined more than 500 lawyers to discuss several issues affecting the legal profession.

Louisiana State Bar Association (LSBA) Executive Director Loretta Larsen, CAE, was installed Aug. 8 as a State Bar Director on the National Asso-ciation of Bar Execu-tives (NABE) Board of Directors during the NABE Annual Meet-ing in San Francisco, Calif. She will serve a two-year term.

An association executive for nearly 30 years, Larsen became the LSBA’s first woman and first non-lawyer executive di-rector in 1991. Under her leadership, the LSBA has expanded to include initiatives such as disciplinary diversion, a statewide access to justice program, law office man-agement, professionalism and diversity.

In addition to her membership in NABE, she is a member of the American Society of Association Executives (ASAE) and the Louisiana Society of Associa-tion Executives (LSAE). She chaired the NABE Administration and Finance Sec-

tion in 2011-12 and served on the NABE Program Committee for the 2012 Midyear Meeting in New Orleans. She has previ-ously chaired the NABE Chief Staff Ex-ecutives (1997-98) and Surveys (1993-95) committees, and has been a member of the Bylaws Committee (2003-04) and Program Committee (2006-08).

Larsen served as LSAE president in 2002, after having served as vice president and as a member of its board of directors. She was the 2011 chair of the board of di-rectors of AIDSLaw of Louisiana, Inc. and has served since 2007 as secretary of the board of the Louisiana Center for Law and Civic Education. She recently joined the board of the Louisiana Civil Justice Center.

She has presented programs for NABE, the National Conference of Bar Presidents and the Louisiana Society of Association Executives on topics including leadership, disaster response, finances, communica-tions, human resources and event planning. She received the CAE (Certified Associa-tion Executive) designation in 2005.

Red Mass scheduled for Oct. 7 in New Orleans; LSBA’s Memorial Exercises to follow

The Catholic Bish-ops of Louisiana and the St. Thomas More Catholic Lawyers As-sociation are coordi-nating the 61st annual Red Mass, beginning at 9:30 a.m. Monday, Oct. 7, at St. Louis Cathedral in New Or-leans.

Homilist for the Red Mass will be Father James A. Wehner, rector-president of Notre Dame Seminary in New Orleans. The Loyola University

Choir will perform.Assembly for the Red Mass begins

at 9 a.m. Judges are to assemble at the Supreme Court Building. St. Thomas More Catholic Lawyers Association members and guests are to assemble at the St. Louis Cathedral for the ecclesiastical, judicial and legal procession.

The Louisiana State Bar Association (LSBA) has scheduled its annual Memorial Exercises to honor deceased members of the Bench and Bar following the Red Mass, beginning about 11:45 a.m. at the Louisiana Supreme Court, 400 Royal St., New Orleans.

Save the date: 2014 Solo and Small Firm ConferenceThe Louisiana State Bar Association’s

(LSBA) seventh annual Solo and Small Firm Conference will be Thursday and Friday, March 6-7, 2014, at the New Orleans Marriott. The conference will have more than 50 national and regional

LSBA Sections schedule CLEs

Two Louisiana State Bar Association (LSBA) Sections have scheduled CLE programs during November and December.► Government and Public Law Section

The LSBA’s Government and Public Law Section has scheduled a CLE program, “Practice in the Public Sector XII,” for Thursday and Friday, Nov. 7-8, at the Holiday Inn South Conference Center, 9940 Airline Highway, Baton Rouge. The CLE is 8 a.m. to 4:30 p.m. both days; lunch will be provided on Nov. 8. Organizers have applied for 12.5 hours of CLE credit, including ethics and professionalism.

Cost is $50 for section members and $150 for others. Section membership costs $15.

The LSBA’s Animal Law Section has scheduled its fifth annual Animal Law CLE for Friday, Dec. 13, at the St. Christopher Hotel, 114 Magazine St., New Orleans. The Louisiana Board of Legal Specialization (LBLS) is accepting applications for 2014 certification in business bankruptcy law and consumer bankruptcy law through September 2013.

In accordance with the Plan of Legal Specialization, any Louisiana State Bar Association member who has been engaged in the practice of law on a full-time basis for a minimum of five years may apply for certification. The five-year practice requirement must be met for the period ending Dec. 31, 2013. A further requirement is that each year a minimum of 35 percent of the attorney’s practice must be devoted to the area of certification sought.

Regarding applications for business

bankruptcy law and consumer bankruptcy law certification, although the written test(s) is administered by the American Board of Certification, attorneys should apply for approval of the Louisiana Board of Legal Specialization simultaneously with the testing agency in order to avoid delay of board certification by the LBLS. Information concerning the American Board of Certification will be provided with the application form(s).

CLE compliance requirements listed for board-certified specialists

In accordance with the requirements of the Louisiana Board of Legal Specialization (LBLS), as set forth in the individual standards for each field of legal specialization, board-certified attorneys in a specific field of law must meet a minimum CLE requirement for the calendar year ending Dec. 31, 2013. The requirement for each area of specialty is:

► Estate Planning and Administration Law — 18 hours of estate planning law.

► Family Law — 18 hours of family law.

► Tax Law — 20 hours of tax law.► Bankruptcy Law — CLE is regulated

by the American Board of Certification. CLE credits will be computed on a

calendar year basis and all attendance information shall be delivered to the Mandatory Continuing Legal Education (MCLE) Department. Deadline for filing annual CLE is Jan. 31 of the following year. Failure to timely report specialization CLE hours will result in a penalty assessment.

Schemes targeting lawyers are continuing: remain aware and vigilant

The Louisiana State Bar Association (LSBA) believes it is extremely important to remind Bar members about criminals targeting lawyers. Despite the Bar’s efforts to warn its members, it is apparent that various schemes involving counterfeit checks or phishing emails to gain account information continue to occur. Luckily, most efforts are unsuccessful but some members have been harmed. The LSBA has recently received information from several targeted lawyers.

Although the fraudulent efforts may take different forms, many involve “fake” clients and counterfeit checks.

One version has a lawyer receiving an overpayment on an initial advance deposit for fees. The “fake” client asks for a refund of the overpayment.

In another instance, the lawyer receives a check from a “third party” after minimal collection efforts on behalf of the “fake” client. The “fake” client typically wants the funds immediately and asks for money to be wired. The funds are disbursed before the check is found to be counterfeit.

Sometimes the “fake client” is foreign and seeking to collect child support or another judgment from a U.S. citizen.

In other instances, the legal work could seem more local such as a collection effort for architectural or remodeling work done on property in your area. While the names or property may exist, people’s

information may have been lifted and used without their permission by the scammers.

Do not accept facts as face value without more research and due diligence as to the people and matters involved.

The risk for the lawyer is that if a suspect check is deposited into trust, the local bank may provide the lawyer “provisional credit.” If a lawyer disburses funds to the “client,” the lawyer, most likely, would have been later advised that the original check was invalid or determined to be counterfeit, and the lawyer would have had a large sum of money stolen.

Be very careful. If suspicious, ask the bank how long it needs to determine whether a check is counterfeit. Check with your insurer to see if these fraudulent or criminal transactions are covered by your insurance.

Beware of clients you have never personally met or clients who need immediate transfer of funds. Don’t be tempted by receipt of an overpayment of an advance deposit or a fee that appears “too good to be true.”

The LSBA, the Office of Disciplinary Counsel and law enforcement agencies encourage LSBA members to exercise caution and perform due diligence before accepting new cases and performing financial transactions involving the lawyer’s trust account.

LSBA Francophone Section schedules

Civil Law Symposium for Nov. 21

The Louisiana State Bar Association’s (LSBA) Francophone Section has sched-uled the next Judge Allen M. Babineaux International Civil Law Symposium for Thursday, Nov. 21, at The Historic New Orleans Collection, 410 Chartres St., New Orleans.

Organizers have applied for 3 hours of CLE credits, including professionalism and ethics. The registration fee is $175, which in-cludes the reception. Registration opens at 1 p.m. and the program will begin at 1:30 p.m.

The symposium will focus on the Bi-centennial of the Louisiana Supreme Court. The program will include tributes to four former Supreme Court Justices — Justice Francois-Xavier Martin, Justice Albert Tate, Justice James L. Dennis and Chief Justice Pascal F. Calogero, Jr. These four justices played essential roles in applying the doctrines and methodology of the civil law to produce the rich Louisiana legal tradition of today. Louis R. Koerner, Jr. will moderate the symposium. Following the event, a reception will be held featur-ing Louisiana musicians performing songs from the 20th century — in French and English.

October is Month of Legal Service

Louisiana State Bar Association (LSBA) President Richard K. Leefe has designated October as Louisiana’s “Month of Legal

Service” for LSBA members. The Month of Service coincides with, and will culminate in, the National Pro Bono Celebration from Oct. 20-26 (see additional article on this page). The goal of the Month of Legal Service is for attorneys to make a difference in their communities by providing legal assistance to those in need.

The LSBA has worked with the Louisiana Supreme Court, district judges, legal aid organizations, local bar associations and pro bono programs to address challenges created by the increasing number of self-represented litigants (SRLs) in the courts. Regularly staffed help desks exist in Alexandria, Baton Rouge, New Orleans and Shreveport.

Recognizing the significant impact the desks have had in these locations, President Leefe is asking local bars and other legal organizations to work with local judges to conduct a help desk or Ask-A-Lawyer event in the courthouse during October’s Month of Legal Service.

Attorneys who participate in these events almost always find them to be a tremendous pro bono opportunity. Volunteering generally requires a minimal time investment, does not carry the responsibilities of representation, and facilitates assistance to some of the most vulnerable citizens.

State’s pro bono organizations schedule activities for

National Pro Bono Celebration

Planning is underway for Louisiana’s participation in the National Pro Bono Celebration from Oct. 20-26. Sponsored

by the American Bar Association, National Pro Bono Celebration Week is part of a coordinated effort to showcase the legal community’s commitment to public service and the positive impact that pro bono lawyers make to the justice system.

Louisiana’s legal community has an inspiring tradition of public service. In 2012 alone, Louisiana’s attorneys provided more than 130,000 hours of pro bono service.

The week offers opportunities both to make a difference for clients by providing special programming and to acknowledge the selfless acts of attorney volunteers from every part of Louisiana who, on a regular basis, make the lives of many much better. Whether it is the volunteer who helps represent the spouse and family in a drawn-out domestic violence case or whether it is the volunteer who takes five minutes to notarize a document to help keep a child in school, pro bono volunteers are making a difference in Louisiana. While helping others, many volunteers speak of the personal benefit they receive from volunteering.

Across Louisiana, local organizations are planning events ranging from awards ceremonies and networking receptions to CLEs and volunteer opportunities. For updates on all Pro Bono Week activities, go to: www .lsba .org/celebrateprobono. Members are encouraged to check back

► The Central Louisiana Pro Bono Project is hosting a Self-Help Resource Center from noon-3 p.m. on Friday, Oct. 11, at the 9th Judicial District Court, 701 Murray St., Fifth Floor, Alexandria. The project also will host a free Wills and Power of Attorney Clinic on Thursday, Oct. 24, at the Rapides Parish Main Library, 411 Washington St., Alexandria.

► The Baton Rouge Bar Association is hosting a Pro Bono CLE-Palooza and award ceremony at the East Baton Rouge Family Court on Friday, Oct. 18, for attorneys who volunteer to take pro bono cases with the Baton Rouge Bar Association, followed by a reception and award ceremony for pro bono panel volunteers. The association is promoting a “Go Casual for Pro Bono Jeans Day” fundraiser, also on Friday, Oct. 18. An “Ask-a-Lawyer Day” will be held at East Baton Rouge Parish Public Library Main Branch (7711 Goodwood Blvd.) from 9:30-11:30 a.m. on Saturday, Oct. 19. The association is organizing a Pro-Se Help Desk specifically for family matters at the East Baton Rouge Parish Family Court from 10 a.m. to 2 p.m. on Tuesday, Oct. 22 and on Thursday, Oct. 24. There will also be free walk-in legal advice clinics (Thirst for Justice) from 3-5 p.m. on Wednesday, Oct. 23, and Thursday, Oct. 24, at St. Vincent de Paul in Baton Rouge.

► The Pro Bono Project in New Orleans, along with volunteer attorneys from the Capital One Legal team, will conduct a divorce workshop for clients. The location and time are to be announced.

LSBA director to chair National Association of Bar Executives Diversity Committee

Louisiana State Bar Association (LSBA) Member Outreach and Diversity Director Kelly McNeil Legier was named chair of the National Associa-tion of Bar Executives (NABE) Diversity De-velopment Committee during the NABE An-nual Meeting in San Francisco, Calif., in August. The committee assists local and state bar leaders in gathering information, resources and skills needed to address and manage a broad range of minor-ity involvement issues.

Legier received her BA degree, magna cum laude, in 1989 from Loyola University in New Orleans and her JD degree, cum laude, in 1993, from Loyola University College of Law.

Before accepting the LSBA position, she worked in the Staff Attorney’s Office of the United States 5th Circuit Court of Appeals. She also practiced law with Stone, Pigman,

Walther, Wittmann & Hutchinson, L.L.C.; Shook Hardy & Bacon, L.L.P. (a Kansas City-based firm); and Proskauer Rose, L.L.P. (a New York-based firm).

Legier is a member of the board of directors of the New Orleans Chapter of the Federal Bar Association and the Bureau of Governmental Research. She is a Fellow of the Louisiana Bar Foundation. She served on the LSBA’s Board of Governors and on the American Bar Associ-ation Presidential Diversity Report Next Steps Subcommittee in 2010. She is an instructor for the National Institute of Trial Advocacy and the Louisiana State University Trial Advocacy Program and is a volunteer for the Pro Bono Project and Teen Court Program.

She has been recognized for her service and achievements by various organizations, most recently receiving the 2013 National Diversity Council’s Multicultural Leadership Award, the 2012 Greater New Orleans Louis A. The Human Rights Award recognizes outstanding efforts made by a bar associa-tion, a law firm or law department, an indi-vidual attorney or judge, a court or a commu-nity organization or individual in promoting diversity in the legal profession, in particular, to recognize efforts ensuring the full and equal opportunity of all persons for entry and advancement in Louisiana’s legal profession.

The Trailblazer Award will recognize a person from a group underrepresented with-in the Louisiana legal profession who has demonstrated excellence or accomplished greatness in the face of great adversity.

One individual and one organization will

receive the Human Rights Award and one person will receive the Trailblazer Award dur-ing the LSBA Annual Meeting in June 2014.

Practice-Ready Attorneys a phenomenal success

The LSBA’s Minority Involvement Sec-tion celebrated its 25th annual Job Fair by renewing the event’s purpose and making it more meaningful for employers and law students within today’s economic reality. The Section’s re-designed event – “Profes-sional Development Symposium: Preparing Practice-Ready Attorneys” – was Sept. 14, at Loyola University College of Law and at-tracted nearly 70 employers, 65 students and 50 judges and attorneys.

The program, which increased its focus on professional development of the students, rather than job placement, featured informa-tion panels, tables, mock interviews and a networking breakfast (including a speed net-working activity). Barrasso Usdin has been a strong sup-porter of the public education reform ef-forts in New Orleans, having partnered with Edna Karr High School, the New Orleans Charter Science and Mathematics High School, Langston Hughes Academy Char-ter School, the International High School of New Orleans, Joseph S. Clark Preparatory High School and Teach for America in vari-ous programs and sponsorships.

The firm recently partnered with All-state Insurance Co. for the second time in the Street Law Legal Diversity Pipeline Program benefiting students of Edna Karr High School. The Street Law Program encourages law firms to partner with high schools comprised of diverse, underprivi-leged students. The program’s goal is to make students feel empowered to use their knowledge of the law to become active par-ticipants in the community and to shatter

the misperception that a career in the legal field is off limits to students from diverse backgrounds. The 2013 program included three classroom visits and a half-day event at Barrasso Usdin’s offices with 10th and 11th graders. Through lectures and interac-tive workshops, the students were taught about social host liability and legal prin-ciples surrounding distracted driving. In the workshops, the students learned to de-velop arguments based on the legal prin-ciples they learned in the classroom, and then later joined in oral arguments before a mock judge and jury. At the close of the event, Judge Tiffany G. Chase of Orleans Parish Civil District Court and Kim M. Boyle, a partner in the New Orleans office of Phelps Dunbar, L.L.P., and former presi-dent of the Louisiana State Bar Association (LSBA) and the New Orleans Bar Asso-ciation, spoke to the students. Both Judge Chase and Boyle encouraged the students to realize the limitless possibilities in store for their futures. The program was a huge success.

The firm also recently formed a partner-ship with Joseph S. Clark Preparatory High School, creating opportunities for the firm’s employees to participate in activities with the Clark students. The activities will in-clude mentoring, attendance at career days,

guest lectures and assisting the debate team. In its efforts to promote diversity in the

legal profession, Barrasso Udsin has spon-sored or participated in various LSBA pro-grams, including the Minority Job Fair, the Conclave on Diversity and the “Suit Up for the Future” High School Summer Legal In-stitute and Internship Program.

The firm strongly supports the work of the Anti-Defamation League, a social justice and human relations organization dedicated to combating anti-Semitism and bigotry among diverse groups. Many of the firm’s partners and associates have served on the South-Central Regional Board. Part-ner Stephen H. Kupperman has served as chair and vice chair on the board and was honored with the ADL Torch of Liberty Award in 2011. Partner Jamie L. Berger and associate Sarah L. Rubin were honored with the new leadership award in 2012 and 2013.

Barrasso Usdin partners also have led the growth of women in the legal commu-nity. Partner Andrea M. Price serves on the board of the Association of Women Attor-neys (AWA) and is president of the New Orleans Chapter. Partner Judy Y. Barrasso was recognized by the AWA as a recipient of the Michaelle Pitard Wynne Profession-alism Award.

Disabilities Summit set for Oct. 24 in New OrleansThe Louisiana State Bar Association’s

Committee on Diversity and the Legal Ser-vices for Persons with Disabilities Com-mittee are partnering with the United States Attorney’s Office to host a Disabilities Sum-mit on Thursday, Oct. 24, in New Orleans. The summit, “Building An Enabled Era,”

is 8 a.m. to 3:30 p.m. in the U.S. Attorney’s Office, Eastern District of Louisiana, Ste. 1600, 650 Poydras St., New Orleans.

During the event, challenges and solu-tions for attorneys with disabilities will be discussed. The program has been approved for 5.83 hours of CLE credit, including pro-

fessionalism. Early-bird registration for $65 is available by Sept. 27.
