CHIEF STEWARD REPORT Ottawa, ON

December 4-6, 2019 Grievances Settled or Withdrawn since May -August 2019 Report • 2016-NOC-16 The arbitration award for the grievance, Vehicle qualifying period, has come

down and we were not successful in defending our grievance. Keller • 2018-09-NOC The arbitration award for grievance (job posting competition) has come down

and we were not successful in defending our grievance. The issue for us was that the posting was determined to be a circularization which weakened our argument that seniority should have been weighted higher.

Sept-Dec 2019 • 2017-MAR-11/2018-01-MAR (termination/benefits issue) As a reminder for everyone, we

successfully defended at arbitration for termination of a member in New Brunswick. The Arbitrator ordered the Employer to return member to work, with no substitution of penalty and with compensation for the full period of lost employment. The Employer did not agree with the award and filed for a Judicial Review of the award in New Brunswick. The grievor resigned his employment without talking to us. The hearing for the Judicial Review was scheduled and delayed twice, eventually scheduled for Nov 29. A good settlement was reached to the satisfaction of the Union and Employer but against the wishes of the grievor. We accepted, the Employer has paid the settlement amount and we have not heard from the grievor.

• Grievance 2019-04-ON Discipline. SETTLED • Grievance 2019-09-ATL is a grievance filed on behalf of 2 members who claimed extended

hours and were denied. SETTLED WITHOUT P&P • Grievance 2019-13-Sask Senior candidate not awarded position. WITHDRAWN As of the time of the writing of this report, we have filed the following grievances:

Equity Committee Report

Ottawa, ON December 2019

Updates from September to October 2019: Continued planning for CSU’s Equity Forum took place from September to October. Great learning experience as a result of taking the time to connect with panelists, brainstorming questions and building relationships through the process. Convention: Transitioning from Ignorance to Understanding was the equity committee’s theme for the forum. Kristine Barr was the moderator and did a fabulous job. All committee members (including alternates) took part in making the environment comfortable and welcoming to all. The panelists were quite diverse and intersectional. They were welcomed and well received by members in attendance – thank you! Leanne MacMillan was the winner of the painting that was created by Allan Andree, gender pronouns he/him, Black local Ottawa artist.

Equity Committee members: 2019-2020 committee has some changes as some members have stepped aside to open the door for others. We welcome new and returning committee members and look forward to the new term.

Atlantic Regional VP Report Ottawa, ON

December 4-6, 2019

1. Staffing In Region

• Currently we have 2 staff off on Long Term Disability. • All active staff are in their assignments. • We had one member who was on medical leave for a sudden but brief period in October

but has since returned to full duties. • An internal circularization was distributed in October regarding a temporary vacancy for

the research representative position which is anticipated to be for a 6-month period. Submission deadline was November 1, 2019 and no word has yet been provided as to who (or if) the successful applicant was.

• We have one member who has provided notice of their retirement which will take effect March 31, 2020. The position A servicing position at the Sydney regional office, was posted on November 20 and the closing date for applications is December 11.

2. Grievance Synopsis

• To my knowledge there is a least one active grievance with respect to extended hours.

That said I have yet to receive documents and records from the previous RVP. 3. Ongoing/Pending Issues

• Workload issues continue. I’ve discussion with some staff in the region with respect to

re-activating the workload assessment committee in the region. • There are been some issues arising with respect to the RD’s treatment of “performance

related” concerns regarding a member. There may be some mitigating circumstances in light of communicated health issues. The steward and I have continued to work with the member and support them to access resources as needed to address these issues.

Staffing in Region

• Total 24 filled regular assignments (no vacancies). • Aneen Albus is still assisting with WestJet bargaining in addition to her Medicine Hat

assignment. • James Yang (temp) is also assisting with airline bargaining for Encore and Swoop for any

technical aviation support such as scheduling. • The temporary Organizing position has been extended, still performed by Colette Singh

– to December 31, 2019. • Dustin Withers (Temp) is backfilling Colette Singh’s permanent assignment in Calgary

while she completes the organizing term. • James Yang is backfilling for Member who is on Leave until Feb 2020. • Alejandro Pachon has returned from Leave. There was an issue with his top-up pay

while he was away. • Jackie Roe posted into Calgary and begins this new assignment on January 2, 2020.

Garry Lehmann is backfilling her assignment in Calgary and extended to January 10, 2020.

• Sandra Walker from Ontario posted into the Lethbridge position that was vacated by Jackie Roe. She will begin her new assignment on January 2, 2020.

• There are two people shadowing as part of their CUPE Internship Program – Jorge Illanes in Edmonton and Bukula Abiona in Calgary.

Grievance Synopsis:

Regional Staff Development Committee Report:

• Our next staff training is in Jasper and will only be 3.5 days in May 2020. The topics are going to be centered around psychological health and safety in the workplace; understanding accommodations and bargaining benefits.

• Many of our members have been joining rallies and picket lines. There is one every

other day. Our Alberta members would like to see our Union provide ‘rally kits’ to all CSU members as sharing 1 CSU flag on a pole across the province is just not cutting it. With the massive cuts and layoffs announced by Premier Kenney – rallies, protests and pickets are going to be a regular occurrence throughout 2020 and maybe longer.

• We would like the ‘rally kit’ to contain within a backpack style bag (with our logo) for

keys, phones, etc. to keep hands free to hold flags: 1 CSU flag with the new logo) on a preferable black background to stand out and be easily identified from the several other union’s white flags); a collapsible pole for the flag; a one size fits most pinnie stating CSU SUPPORTS THIS PICKET; hat & mittens with CSU logo; a noisemaker or battery operated mini-megaphone. I believe that this would be fabulous for mobilizing our members to participate in labour-organized initiatives.

Maritime Regional VP Report Ottawa, ON

December 4 - 6, 2019 1. Staffing In Region

• Since the last report we have a few changes in staffing. Sister Adrienne Paradis was the

successful applicant on the vacant Servicing Representative (Heather Corkum) position at the St. John Area Office. The vacant posting for Human Rights Representative (Wendy Johnson) at the Maritime Regional Office was awarded to Brother Aditya Rao. He will be joining us sometime in the new year (February possibly). The vacant Servicing Representative (Celine Poitras) at the Dieppe Area Office was awarded to Samuel LeBlanc and he has already started in his new role. His former position of Servicing Representative at the Maritime Regional Office has been posted at this time.

Currently we have three temporary staff in the Region. • Keith LeBlanc (St. John Area Office) is backfilling Lori MacKay who continues to replace

Stacy Delaney who is temporarily doing Organizing until December 20, 2019. • Danika Dupuis Parker (Dieppe Area Office) will be backfilling Monique DesRoches who is

on vacation from November 18, 2019 to January 17, 2020. • Jeannik Gallant (Maritime Regional Office) is backfilling the vacant Servicing

Representative (Sam LeBlanc) position at the Maritime Regional from November 18, 2019 to January 24, 2020

• Carol Proulx (National Office) will be replacing Aditya Rao Human Rights Representative until further notice.

2. Grievance Synopsis

• The Luc LeBlanc Judicial Review was adjourned after a settlement was reached between CSU and CUPE. With this settlement all outstanding grievances and issues with Luc have been resolved. At this time we have no other grievances in the region.

3. Ongoing/Pending Issues • Since my last report we have seen improvement on the replacement issue. The two

bilingual members who were part of the shadowing program have now started their first temp assignments. The member we had in the Rep Training program is still in the process of finishing up the program but did get a chance to work this past summer. This now gives us a bit of breathing room on replacements. We still need to find more replacements as we will be seeing more changes in staff in the very near future and also for vacation replacement.

• The joint committee for the Maritime and Atlantic Regions still hasn’t met to begin planning for next June’s combined staff training. We will be starting the process shortly.

2. Ongoing/Pending Issues:

• The Biggest issue in the region continues to be staffing and the workload that is being

created as a result. We have yet to be informed of the number of extra staff we will be receiving as a result of the amalgamation votes. It seems to be the best kept secret in CUPE, we have heard rumors of various additional numbers (some good, some bad). Apparently, the decision is based on the NEB accepting the recommendation at the December NEB mtg. If only we knew what the recommendation is, we could begin to prepare. We will be welcoming the 9000 new members on December 8th, 2019 when the temporary certs are issued. We consistently express our concerns regarding the health of our staff and the effect of “kicking things down the road” for over a year has had on workload. There seem to be a rise in “discussions” between the regional director and some staff. There are complaints coming in from locals because some balls have

2. Grievance Synopsis • There is an issue with denial of out-of-town per diem for one-day travel. Six

individual grievances and one policy grievance have been submitted. More individual grievances will be submitted.

3. Ongoing/Pending Issues

• Contracting-out of some of our work is an issue everywhere and specifically at the

national office we are addressing escalating contracting-out in IT. CSU members at NOC led the formation of a committee to campaign and research on this question; we organized a resolution at CSU 2019 Convention to raise the profile of this issue.

4. Special Events/ Activities • NOC has participated in many solidarity events, such as strike support for the CLC

staff, participating in the climate strike, and supporting the “Communities Not Cuts” campaigns in Ontario.

• We are expanding the topics of our popular Lunch & Learn events, and have begun co-sponsoring events with COPE at the NOC.

5. Health & Safety

• Since the last CSU meeting, the National Office JOHSC has not met in an official

capacity. The Committee has been without an Employee Co-Chair since June 2019 and the Employer Co-Chair (Laura-Lee Lefebvre, Director HR) was derelict in her duties to move the work of the Committee forward or keep scheduled meetings despite Isabelle Dault’s insistence on behalf of the Employees Representatives.

• Sister Isabelle took the initiative to meet with the newly elected Employee Representatives in September 2019 to establish an action plan to move the work forward, including staying on schedule with monthly inspections.

• Following Convention, the Employer Co-Chair never returned to work therefore the Committee had no Chairperson and could do no official business. Some members of the Committee (ER and EE) met in October 2019 but Isabelle could not be in attendance and only received “notes” afterwards.

• In November 2019, Isabelle received Part 1 of the provincially mandated Health and Safety Certification training. She must complete Part 2 within 6 months to be considered a “certified member” for the employees. Unfortunately, since the retirement of COPE Sister Ann Duprey, the Committee is without a single “certified member”.

• Frustrated by the lack of direction from the Employer, Sister Isabelle organized a training for the Committee on how to use the program SiteDocs to produce and revise Reports such as Incident Reports, Hazardous Spill Reports and Monthly Inspection Reports. Robert Loenhart, CUPE’s Health and Safety officer gave the training at Isabelle’s request and the group was able to use what was learned by

performing an inspection. He also informed us that his last day with CUPE would be December 12, 2019 as he has found employment elsewhere.

• Following an urging by Brother Troy Winters (H&S Specialist, NOC), the Employer also organized in-house CPR/First Aid and AED training. A total of 12 National Office employees were certified in October-November 2019 but the Employer has not yet established a protocol on how to alert First Aiders to medical emergencies in the building. Sister Isabelle is working on this for the first meeting of 2020.

• Sister Isabelle also discovered a Hazardous Spill Report in SiteDocs about a spill that occurred on November 22, 2019, promptly shared it with the Committee and asked the Employer to make sure Reports of this nature are brought to the attention of the Committee members in a timely fashion. It has also been flagged as an agenda item for the first meeting of 2020.

• Finally, following the notification that the Employer Co-Chair was no longer employed by CUPE, Sister Isabelle once again met with Employee Representatives to advocate for nomination of an Employee Co-Chair ASAP as the situation was untenable as it was. The members agreed to close nominations on December 6, 2019 and a Co-Chair should be named shortly after. With the agreement of the other Employee Representatives, Sister Isabelle also met with Employer Representative Pascale Caron, HR, to get a commitment on training and meeting dates for 2020.

• As of December 3rd, 2019, the Employer has scheduled a meeting in January 2020 and has committed to review the Terms of Reference to avoid the situations that have held the Committee back and to training all Committee members by May 2020.

• A promotional campaign is being planned at NOC to raise the profile of the CSU

Solidarity Fund in 2020.

• Discussion topics included the Union sending a formal disclosure letter referencing Articles 28 (Workload) & Appendix “T” requesting staffing details from the Employer, such as # of permanent staff in the Region, N19’s, # of Temporary Staff and subsequent backfills etc. Unions position for requesting this information was to align with being able to effectively process the workload language in the C.A.

Saskatchewan Regional VP Report

Ottawa, ON December 4-6, 2019.

1. Staffing in Region

Prince Albert:

In the Prince Albert area office, there are three staff (permanent), Janice Janzen, Mira Lewis, and Tony Head. Currently Tony Head is acting in the capacity of organizer for the province. Temporary reps in Prince Albert: Jan Goy is replacing Tony head while he is organizing. Saskatoon: In the Saskatoon area office, Sharleen Rayner, Rhonda Heisler, Ann Iwanchuk, Justin Mercier, and Will Bauer are permanent reps. Justin Mercier took a permanent position replacing Gary Day (at least during his trial period). Temporary reps in Saskatoon: Val Harvey is replacing Will Bauer during his parental leave.

Regina/Yorkton: Currently the Regina Staff Complement is as follows: Permanent staff include: Lori Sutherland (Shop Steward), Debbie Mihial, Bill Cronin, Alex Lenko, Andrew Loewen (on leave), Aimee Nadon, Tria Donaldson (Communications), Sachia Longo (Legal and Legislative), Gary Day (Education and CSU RVP), Dave Stevenson, Don Moran and Guy Marsden (Research). Two new permanent CSU member are also seconded to the Regional Office in Regina as a result of long delays in the completion and opening of the Yorkton Area Office. These new permanent CSU members are Wanda Edwards and Mike Rodrigues.

Temporary reps in the SKRO are Jamie Mellor and Natalie Laing.

2. Grievance Synopsis

• There are three outstanding grievances, including last year’s vacation coverage

grievance. The latter two may no longer have wings, considering the changes that came about after they were filed, though one is around work of the bargaining unit, and while written up and provided to the director, no discussion has been had with her. A recent grievance around selection for the education representative position has been recently withdrawn at the request of the grievor.

3. Ongoing/Pending Issues

• There are indications that a short pause in the negative actions of the director has come to an end. Pressure seems to be building again among staff, since the pause was not long enough to build any level of trust at all. People speak of “waiting for the shoe to drop.” The director has indicated to temporary staff that they must not leave the office on a Friday afternoon before a certain time, despite there being no language that supports such office hours as being mandatory. Our temporary reps often work 14-hour days, and live up to five hours away from their temporary posting. The director is frightening them into staying in the office, when they truly deserve to get a head start on winter highways, and she empowered to do so because they are temps.

• No written or verbal notice for application to carry over vacation was sent by the director

in autumn, which goes against past practice. One member has been told that the deadline for this passed some time ago, so there is no chance to carry over any days. To be clear, this CUPE-imposed deadline passed because the director did not notify staff of the need to apply for carry over.

• The director, whether intentioned or not, is causing discomfort and anger among

members once again.

• The recent opening of the Prince Albert Area Office, following the “collaborative workspace model,” brought beautiful facilities for facilitation and meetings, but sorely inadequate and sardine-canny workspace for the CSU staff in the building. This standard is, by all reports from staff, terrible for work and morale. Staff are already seeking other ways of working, rather than coming into the office.

4. Special Events/Activities

• There have been no special events or activities for Saskatchewan CSU members since the

last report.

5. Staff Conference • Elections were held in September, the results of which were already communicated in

September to the executive. Our next CSU meeting will be after a staff meeting in Saskatoon on the 11th of December.

6. Regional Staff Development Committee

• Staff training now seems solely in the control of the regional director. While the

committee recommends certain workshops and training, the director has been known to cancel or change them without notification to the committee members. Locations are also altered with little (if any) justification, inadequate notice (i.e. just a change on the electronic calendar), and little to no communication. Some such changes are ostensibly from the director’s superiors, or due to reasons of availability of facilitators, however, the issues make staff development processes a bit unstable. In the end, while cancellations of workshops, and their locations, are understandable, there is no reasonable measure of communication from the director.

7. Health & Safety

• Clearly CUPE is still not providing a healthy workplace in Saskatchewan. People are still

on leave, people are still hiding in their offices, and a new set of people are feeling ill before going to work. The only positive change has been that we now have a number of

temporary reps who can replace us on leaves. Treatment of those temporary staff still requires great improvement, I believe.

8. Solidarity Fund • Our fund is healthy. Signing authority sits with Ann Iwanchuk, Rhonda Heisler and Gary

Day. Several donations to striking unions were made in the recent reporting period.

C.S.U. Retiree Representative Report Ottawa, ON

December 2019 Following Convention, a Retiree Update was sent out by email to C.S.U. retirees. Thanks to Patrick Lenathen for circulating that. After recent elections, the CUPE Retirees’ Association (CRA) has a new Executive Committee and Executive Board. The new President of the CRA is Pat Daley of Ontario. The new Vice-President is Shelly Gordon, also from Ontario. Returning as Treasurer is Barry Thorsteinson and the returning Recording Secretary is Carole Lefebvre. Many thanks to outgoing President Susan Attenborough for her dedication to retirees, particularly around the indexation campaign and health benefit issues. The outgoing and incoming CRA table officers held a transition meeting in November and the new Table Officers will meet again in January to map out a workplan and budget for the next year. Recently retired Research Rep. Cheryl Stadnichuk has been engaged by the CRA to do a comprehensive report on the range of health benefit issues facing CUPE retirees. Cheryl joined the November CRA meeting to discuss and scope out the project. Unifor has organised a meeting in Montréal on December 4th to strategize and confirm funding arrangements for a legal opinion regarding insurance, taxation, and benefit issues impacting CUPE retirees in Québec. Carole Lefebvre will be attending on behalf of CRA. Sylvia Soufi participated in an earlier meeting on this and all involved are looking for cost-sharing. The CRA began to establish a good relationship around health benefit issues with Laura-Lee Lefebvre, Managing Director of Human Resources and had sent follow up letters to her but it now appears she may no longer be in the position. We have now been referred to John Lepine and are hoping for replies from him.

The CRA has put a notice on its website recommending to retirees that they not take part in the health benefit survey/contest that Greenshield has been promoting. The CSU may want to consider similar advice for active members. Greenshield recently emailed a bulletin regarding protocols for our out of country travel insurance. The bulletin may have been sparked by CUPE/CSU/CRA concerns over the dreadful treatment of retiree Eugene Kostyra by Allianz earlier this year. The CRA will be trying to get the note to retirees who may not be registered to receive Greenshield emails. Active members should pay close attention to the bulletin as well. The CRA continues to advocate to replace Allianz as the out of country travel insurance administrator. The election process for a new Retiree Representative is now underway. Patrick Lenathen has sent out the call for nominations with a mid-December deadline. Elections will be held after that and a new Retiree Representative should be in place by the end of January 2020. After five years as Retiree Representative this is my last CSU Executive meetng. It has been an honour to take part in the work of this union.
