Location Cromwell Quarry is situated to the east of the village of Cromwell immediately east of the A1, approximately 7.5 kilometres to the north of Newark.

Access to the mineral site is gained off the A1, via an existing access road that serves the neighbouring former Lafarge quarry.

Description The Property is available in 2 lots.

Lot 1 (shown on Sale Plan 1):Approximately 68.65 hectares (169.64 acres) of agricultural land (surface interest only) in arable production. Please note, the underlying minerals form part of Lot 2.

Lot 2 (shown on Sale Plan 2):A greenfield mineral site with sand and gravel extraction yet to commence. The site contains an estimated total reserve of 2.1 million tonnes of sand and gravel with planning permission for extraction, confined to the areas shaded purple and edged red on Sale Plan 2.

In addition, Lot 2 includes the mineral rights within the area shaded green where up to 17.5 million tonnes (gross) of unpermitted sand and gravel is estimated to occur. This resource may offer potential for future extraction, subject to planning.

Please note, the mineral offered in Lot 2 is held under mineral leases that will require assignment to the purchaser.

Town & Country PlanningThe areas shaded purple and edged red within Lot 2 benefit from an extant planning permission ref: 3/03/2626-CMA granting mineral extraction operations for a period of 12 years from the date of commencement. The development is yet to commence and must be done so before 20th April 2014.

The site’s approved restoration scheme comprises water areas for nature conservation. All restoration and aftercare obligations will transfer to the purchaser.

Tenure & Possession Lot 1: The surface is offered freehold but subject to a Farm Business Tenancy with the ability to be terminated on 31st August 2014.

Lot 2: The Lot is held under split ownership comprising a number of freehold and leasehold titles.

The surface of the land edged red is offered freehold with vacant possession.

The land and minerals within the area shaded purple are held on a leasehold basis until 31st December 2024 subject to the payment of certain rent and royalties, although shortworkings have accrued under the lease. This mineral lease has provision for assignment to the purchaser.

The mineral rights within the area shaded green are held under a separate mineral lease that runs until 31st March 2045, which again is subject to the payment of certain rent and royalties. Assignment of this mineral lease will be subject to negotiation with the Landlord and completion of sale will be contingent on this occurring.

Please note, the surface of the areas shaded green lying immediately north and south of the permitted mineral site are owned by third party landowners. Accordingly, the purchaser will need to negotiate separate agreements with these surface owners and obtain planning permission in order to access and work underlying mineral.

AccessThe permitted access to the mineral site is via the neighbouring former Lafarge Quarry, shown in yellow on Sale Plan 2, which is granted by way of a Mineral Easement (and subject to a wayleave payment) that currently expires in 2018. Terms have been agreed to extend the Easement to 2033 which will pass to the purchaser of Lot 2.

Easements & Other RightsThe interest in the property is sold subject to and with the benefit of all public and private rights of way, wayleaves and easements whether or not specifically mentioned.

Method of SaleThe property is for sale by informal tender. Formal, written bids are to be received by Carter Jonas no later than 4:30 pm on 30th April 2013. The vendor has the right to accept an offer or remove the property from sale before this date.
