TO ALL DIVISION MANAGERS, HARBOR MASTER, HARBOR PILOTS,SHIPPING LINES, AND OTHERS CONCERNED

SUBJECT: PROVISIONAL PILOTAGE RATES FOR SERVICES RENDERED TOFOREIGN AND COASTWISE VESSELS IN ALL PORTS IN THEPROVINCE AND CITIES OF CEBU

Pursuant to R.A. 7621 (Charter of the Cebu Port Authority), CPAAdministrative Order No. 02-98 (Rules and Regulations Governing PilotageServices, Etc.), this Memorandum Circular is being issued providing forProvisionall interim rate for Pilotage fees or charges:

Section 1. Provisional Pilotaae Fees or CharCles. - Pilotage fees or charges shallbe based on tonnage for services rendered to both foreign and coastwisevessels, regardless of whether pilotage services are rendered during Sundays,Holidays, and nighttime (1800H-0600H), as follows:

Without affecting the other provisions herein, the above rates shall continue tobe effective only for a period of six (6) months from date of effectivity of thiscircular .

Section 2. Pilotaqe Service. - Pilotage Service is the act of a licensed oraccredited pilot in assisting a master of a vessel in docking or undocking thevessel.

Section 3. Special Services. - There shall be an additional charge of 500/0 forspecial services~ such as channeling in or channeling out~ shifting~ ship to shipdockingJ undocking, dead ship dockingJ undocking, mooring or unmooring~anchorage, and untwisting.

Section 4. Special CharQe. - A special charge of $20 per mile shall be chargedfor meeting vessel at a point other than the pilot's boardingstationJ quarantine.

Section 5. Payment By Foreign Vessels. - With respect to foreign vessels~payment of pilotage services shall be made in dollars or in pesos at theprevailing Bangko Sentral ng Pilipinas (BSP) reference rate on the day of theactivity.

Section 6. CPA Revenue. Remittance/Collection. - In consideration for theprivilege to render pilotage service and of the use of port facilities, a pilotorganization shall pay to the Authority a privilege fee of not less than tenpercent (10%) of their gross income derived from pilotage and other specialservices. Late payments shall be subject to the applicable interest andpenalties consistent with existing rules.

In the case of domestic vessels piloted by their own ship captains or masterswho are duly accredited by the Authority, the vessel shall remit to theAuthority ten percent (1001b)of the applicable pilotage rate.

The Authority may directly collect the privilege fee on a per vessel basis.

Section 7. Records and Audit and Billing Forms. - A pilot organization shallkeep records of its transactions and furnish the Authority with copies of itsbillings and receipts upon sending of the bill and issuance of the receipt. Itshall also make available for audit by the Authority all financial records and allother documents pertaining to its operations.

Upon effectivity of this Order, a pilot orga.tlization shall use only billing formsin a manner prescribed by the Authority.

Section 8. Exclusion of Other charaes. - Except for the rates provided herein, noother pilotage fees or charges shall be imposed.

Section 9. Separability Clause. - If any section of this Order or part thereof isdeclared unconstitutional or invalid by competent authority, the other sectionsto which such declaration does not relate shall not be affected.

Section 10. Repealina Clause. - All orders, rules, regulations and otherissuance of the Authority inconsistent with this Administrative Order arehereby repealed or amended accordingly.

Section 11. Effectivity. - This Memorandum Circular shall take effect after two(2) publications (once a week) in a newspaper of general circulation.
