Statement by the Commission (regarding all items above) The Commission considers the precise material legal basis of Article 43(2) TFEU as it had proposed in conjunction with the procedural legal basis of Article 218(9) of the TFEU to be the only appropriate one as Article 43(2) TFEU is also the material legal basis in conjunction with the procedural legal basis of Article 218(6)a TFEU for the Council's decisions on the conclusion of the international agreements setting up the respective RFMOs, in the context of which Article 218(9) TFEU may become relevant. The Commission therefore maintains its proposal and cannot support the Council's amendment replacing the legal basis of Article 43(2) in conjunction with Article 218 (9) with Article 43 (without mentioning the paragraph) in conjunction with Article 218(9). Statement by Italy and Romania "Italy and Romania welcome the Council Conclusions on Nutrition and Physical Activity in view of achieving an overall comprehension amongst citizens and consumers that healthy diets and physical activity significantly contribute to the health promotion and disease prevention. With reference to paragraph 50 concerning "nutrient profiles" (article 4.1 of Regulation (EC) No 1924/2006), Italy and Romania express their concern that "nutrient profiles" should not lead to categorization of foods, thus creating a false perception on how food should be considered within a nutritionally balanced and complete diet. A EU-approved list of "good and bad foods" could unduly discriminate many traditional European food products through, inter alia, the introduction at national level of "traffic light labels", "health warnings", increased taxes and advertising restrictions if such a nutrient thresholds are not met. The above-mentioned Delegations would like therefore to invite the Commission: a) to carefully evaluate that nutrient profiles may not help consumers to understand the contribution of individual foods and drinks to the overall diet, but will rather suggest a global judgement which may create a distinction between "bad" and "good" products, thus affecting the free and informed choice of EU consumers; b) to carefully assess the possible consequences that "nutrient profiles" could cause on the free circulation of food products within the EU internal market and on the safeguard of traditional regional food products bearing EU Quality schemes marks, such as PDO, PGI and TSG."

The Commission notes that it is proposed that a Decision of the Representatives of the Governments of the Member States meeting within the Council be adopted on this accession by common accord as regards the position of the Member States in the WTO. The Commission notes that it would have been possible to adopt an EU decision which would have rendered such a separate decision unnecessary." Unilateral statement by the Federal Republic of Germany on EU coordination for the 25th session of the OTIF Revision Committee from 25 to 27 June 2014: The Federal Republic of Germany takes the view that the EU is not competent as regards the amendments to Appendix B (CIM Uniform Rules), Appendix D (CUV Uniform Rules) and Appendix E (CUI Uniform Rules) to the Convention concerning International Carriage by Rail (COTIF 1999), and consequently that there is no need to coordinate an EU position for the 25th session of the OTIF Revision Committee from 25 to 27 June 2014. To date, the EU has not exercised its legislative competence in the areas of private transport law governed by those appendices. Member States may therefore continue to exercise their competence in accordance with the second sentence of Article 2(2) TFEU. Moreover, in cases where competence is shared, Article 6(2) of the Agreement between OTIF and the EU on the EU's accession to the COTIF of 9 May 1980, as amended by the Vilnius Protocol of 3 June 1999, explicitly provides that Member States may continue to vote independently in these areas. Germany hereby asserts, as a precaution, that it refuses any casting of Germany's vote by the European Commission.
