9.1. Motion to Close the Meeting to the Public

A Special Meeting of Council In-Camera is scheduled at 5:00 p.m. on October 28, 2019. This meeting starts as an open meeting (public may attend); however, Council will pass a motion to exclude the public from the In-Camera discussions under the authority of the Community Charter Sections (90(1)(k) and 91 (1) and (2):

90(1) (k) negotiations and related discussions respecting the proposed provision of a municipal service that are at their preliminary stages and that, in the view of the council, could reasonably be expected to harm the interests of the municipality if they were held in public; and

91(1) If all or part of a meeting is closed to the public, the council may allow one or more municipal officers and employees to attend or exclude them from attending, as it considers appropriate.

91(2) If all or part of a meeting is closed to the public, the council may allow a person other than municipal officers and employees to attend,

(b)in other cases, if the council considers this necessary.

If Council cannot conclude the business of the In-Camera Meeting prior to the start of the Regular Meeting of Council scheduled for 7:00 p.m., they will recess the In-Camera Meeting and resume following the Bylaw Section of the Regular Meeting of Council agenda.

• Colwood Council was presented with a plaque in recognition of support for Cops for Cancer - Tour de Rock.

• Mayor Martin took part in a podcast with Westshore Business that is available on the City website.

• The Mayor and Manager of Communications went on a tour of the Royal Bay Development Site. He provided highlights of the tour.

• Recognition of Community Leaders through Leadership Victoria are currently on display in the foyer at Colwood City Hall.

• the costs associated with installation and maintenance of any new waste stations on trails, bus stops and benches;

AND THAT, in anticipation of future trails being completed as part of new development, the report include a draft policy for Council’s consideration to address how and where trash receptacles and dog waste stations are to be installed and identifying all City requirements to be in place prior to receiving the trail from the developer.

Helen Lockhart, Technical Supervisor – Engineer, provided a brief overview of the Lookout Brook Dam Upgrade Design Options report presented to Committee on August 19, 2019 and introduced Chris Lucas, B.Eng., P.Eng., Senior Project Engineer, McElhanney Consulting Services Ltd. and Jay McIntyre, M.A.Sc., P.Eng., Senior Geotechnical Engineer, Thurber Engineering Ltd. to answer questions from Committee.

PUBLIC PARTICIPATION

Resident, 3338 Acemink Road, addressed the Committee regarding a compliment received from a homeowner concerning the establishment of the Colwood Tree Protection Bylaw and the retention of trees and natural green space on Cuaulta Crescent.

Resident, 3457 Curlew Street, addressed the Committee regarding:

• The entrance from 360 Latoria Road onto Ryder Hesjedal Way

• Parking concerns and traffic volume at peak times in the Royal Bay area.

• Consideration for the size of Royal Bay Secondary School.

Colwood taxpayer/Langford resident, 739 Willing Drive, addressed the Committee regarding personal knowledge and history of the Lookout Brook Dam construction, and provided recommendations for upgrading the dam.

• Concerns around the density and parking allocation for 360 Latoria Road.

• Current lack of parking in the Royal Bay area.

Resident, 372 Kestrel Street, addressed the Committee regarding:

• 360 Latoria Road being marketed as neighbourhood centre area.

• Traffic concerns at Latoria Road and Ryder Hesjedal Way.

• Parking issues in the Royal Bay area.

Resident, 3527 Sparrowhawk and 350 Latoria, addressed the Committee regarding:

• Lack of infrastructure and egress in Royal Bay.

• Increase in the number of young families in the Royal Bay area and lack of play space for children and community gathering areas.

Resident, 350 Latoria Boulevard, addressed the Committee regarding:

• Current traffic issues in the Latoria area after school.

• Parking issues in the area and insufficient parking proposed for 360 Latoria Road.

Grant in Aid Policy and Process Review


THAT it be recommended to Council:

THAT the revised Grant in Aid Policy GRA001 be adopted as presented;

AND THAT the 2020 Grant in Aid budget be set at $40,800 with an additional $2,500 included in the ongoing operating budget for off-cycle Grant in Aid requests, also starting in 2020;

AND FURTHER THAT Staff facilitate a weighted-averaging Council adjudication process for 2020 Grant in Aid applications.

A. Relaxing section 2.1.20 of the Colwood Land Use Bylaw (No. 151) to increase the maximum height of a retaining wall from 1.2m (4ft) to 3.07m (10ft 1 inch).

SUBJECT TO the following condition to the satisfaction of the City of Colwood:

A) The payment of the application fees for DVP-19-008.

THAT a select committee on waterfront coastal processes be established and endorse a revised terms of reference to include coastal processes beyond erosion.

Permissive Tax Exemption Policy and Process Review

Committee asked that staff bring back a list of property owners who are currently receiving the tax exemption and provide terminology different from permanent or perpetual.

AND FURTHER THAT staff draft a bylaw granting a perpetual term, for places of worship recipients currently receiving a ten-year exemption under Bylaw No 1359, 2010 for Council's consideration.

SUMMARY AND PURPOSE

The Lookout Brook dam project is currently in the 2019 - 2023 Financial Plan, but the construction

amount is listed as unknown. At the August 26, 2019 Regular Meeting of Council, Council passed thefollowing resolution, "That Staff apply for a grant from the UBCM Community Emergency

Preparedness Fund, Structural Mitigation stream for safety upgrades to Lookout Brook Dam." Theapplication package must include a Council resolution that indicates support for the capital project

and clearly identifies the applicant's contribution. The class D cost estimate of the Rock Buttressing

option is$1.3M. The maximum grant award is $750,000. Work to refine the cost estimate Is currentlyunderway.

The decision on whether to proceed with the project will return to Council once the outcomes of the

refined cost estimates grant application are known.

Council of the City of Colwood, in open meeting assembled, enacts as follows:

1. CITATION

This Bylaw may be cited for all purposes as the "Purchasing Power Delegation Amendment

Bylaw No. 1748-01, 2019".

2. AMENDMENTS

2.1 “Purchasing Power Delegation Bylaw No. 1748, 2019” is hereby amended as follows:

2.1.1 Clause 3 is deleted in its entirety and replaced with the following clause:

A BYLAW TO EXEMPT CERTAIN LAND AND IMPROVEMENTS FROM TAXATION FOR A FOUR-YEAR PERIOD

BEGINNING FISCAL 2020

WHEREAS section 224 of the Community Charter provides that land and improvements which are owned

or held by a charitable, philanthropic, or other not for profit corporation and the Council considers are

used for a purpose that is directly related to the purposes of the corporation, may be exempt from

taxation.

NOW THEREFORE the Municipal Council of the City of Colwood in open meeting assembled enacts as

follows:

1. Each parcel of land described in Columns B, C, and E of the Schedule to this Bylaw and any

improvements on such parcel shall be exempt from taxation under section 197(l)(a) of the Community

Charter for the term specified in Column D, on the condition that such parcel is used, owned, or

occupied by the organization named in the corresponding row of Column A of the Schedule.

SUMMARY AND PURPOSE

Council has directed staff to activate the Heritage Commission and focus the work of the Commission

on preparing and drafting a Heritage Conservation Strategy. To facilitate this work, updates to

Heritage Commission, Pioneer Cemetery and St. John the Baptist Cemetery bylaws are required. Staff

is seeking support for the proposed amendments which Includes the merger of the current cemetery

bylaws (Bylaw No. 1100 and 1265) Into a single modernized bylaw. Staff are also seeking Councilresolution for termination of a purchase agreement clause removing a Heritage Advisory Commission

appointment by the Church.

BACKGROUND

At the Council meeting of June 10, 2019, Council directed that staff prepare an updated terms of

reference for the Colwood Heritage Commission Including removal of references to the Commission's

role In the administration of the Pioneer Cemetery and St. John the Baptist Heritage Church.Consequently, amendments to bylaws for St. John the Baptist and Pioneer cemeteries must occur, as

well termination of an obligation stemming from a 1996 purchase agreement.

Heritage Commission Bylaw Update - Proposed Bylaw No. 1789

Currently the Heritage Commission acts as the Board of Trustees for St. John the Baptist Cemetery

and oversees Issues related to maintenance, operations and management of the St. John the BaptistChurch and Emery Hall. The Commission also appoints a member as a Trustee on the PioneerCemetery Board. To focus the work of the commission on the preparation and drafting of a heritage

conservation strategy, the proposed new bylaw removes these refences. The proposed update also

streamlines and modernizes the document.

The proposed Heritage Commission Bylaw No.l789, 2019 Is attached for Council's consideration.

A BYLAW TO PROVIDE FOR THE REGULATION, MANAGEMENT, OPERATIONS AND

MAINTENANCE OF CEMETERIES OWNED BY THE CITY OF COLWOOD

The Council of the City of Colwood, in open meeting assembled, hereby enacts as follows:

1. INTERPRETATION

TITLE

1.1 This bylaw may be cited for all purposes as "Cemetery Management Bylaw No. 1790, 2019".

DEFINITIONS

1.2 In this bylaw:

"Administrative Authority" means the Business Practices and Consumer Protection

Authority established under the Business Practices and Consumer Protection Authority Act,

S.B.C. 2004, C.3;

"Administrator" means the person or persons duly appointed by the Council as the

Administrator(s) of the Cemetery or Cemeteries;

"Burial Container" means a container to enclose Human Remains for interment that:

a) has a rigid base and is of sufficient strength to contain and move Human Remains;

b) is capable of being closed so that the public is not able to see the Human Remains;

and

c) is constructed so that it does not leak or otherwise cause a hazard to any person's

health

but does not include a grave liner Vault or an Urn;

"Caretaker" means the person or persons duly appointed by the Administrator as the

Caretaker{s) of the Cemetery or Cemeteries;

"Cemetery" or "Cemeteries" includes any parcel or tract of land set aside, used, maintained

or operated as a cemetery by the City, Including the St. John the Baptist Cemetery and the

Pioneer Cemetery;

"CIFSA" means the Cremation, interment and Funeral Services Act, S.B.C. 2004, c.35 and its

associated regulations as amended or replaced from time to time;

"City" means the City of Colwood;

"Control of Disposition" means the right under CIFSA to control the disposition of the Human

Remains or Cremated Remains of a deceased person;

A BYLAW TO ESTABLISH A HERITAGE COMMISSION

The Council of the City of Colwood hereby enacts as follows:

1. TITLE

1.1 This bylaw may be cited for all purposes as "Heritage Commission Bylaw No. 1789; 2019".

2. ESTABLISHMENT

2.1 The Colwood Heritage Commission (the "Commission") is hereby established.

3. DUTIES

3.1 It shall be the duty of the Commission to:

advise Council on heritage matters;

advise Council on matters referred to it by Council;

undertake and support activities of a heritage nature, including education activities,

heritage research, and participating In heritage events;

iv. ensure the development of a management plan for Colwood heritage properties;

V. fundraising for Colwood heritage projects;

vl. undertake or provide support for such activities as directed by Council.

4. MEMBERSHIP, MEETINGS, MINUTES, PROCEDURES, AND QUORUM

4.1 The Commission shall consist of not more than nine (9) members, all of whom shall be appointed by

resolution of Council, and shall be selected as follows:

4.1.1 one member of Council and an alternate Council representative; and

4.1.2 Up to eight (8) persons selected from the community at large.

4.2 Each member appointed under this bylaw shall hold office for a term of one year or until a successor

is appointed. A member may be reappointed for a further term or terms.

4.3 In the event of a vacancy occurring among the appointed members of the Commission, Council may

appoint a new member to fill such vacancy for the unexpired portion of the term.

4.4 The Commission shall be presided over by the Chair, who shall be elected by the Commission at its

first meeting in each year.

4.5 The Commission shall appoint a member of the Commission as Vice Chair to preside in the Chair's

absence.
