MAYOR’S REPORT I have been writing these annual reports for the past 15 years and this is my last report, as I will be vacating the position of Mayor in September, I intend taking the indulgence of being a little reflective as well as undertaking the necessary reporting on the current activities of Cootamundra Shire Council. Cootamundra Shire Council is now in a strong financial position. However, demands will always exceed the money available. Over the last 15 years I have worked with a number of General Managers, the longest serving being Shane Godbee, to improve the financial position of Council and I am pleased to report that Council is in an enviably secure position. During a large part of my tenure as Mayor, the region has suffered from a major drought. This has been a major problem for many in the community, but a mixed blessing to Council as our roads in general have been able to withstand the wear during the dry seasons. Following the breaking of the drought and the increasing volumes of heavy traffic on our roads, especially associated with the Visy Mill in Tumut, we are finding it difficult to maintain our roads to a standard that I consider necessary. This is a problem across the whole road system within our Shire; State, Regional and Local roads. Council continues to undertake heavy patching and sealing on our urban, State and Regional roads and Council voted, mid budget term, an extra $100,000 to be spent on the Gundagai Road. We have an ongoing annual program of widening the shoulder on the Stockinbingal Road and then resealing the road and I hope to see this finished in the next few years. During the year we completed the roundabout at the Parker / Mackay Street intersection. We also continue to undertake, under contract, the resealing and heavy patching on MR 78 and 84. The airport runway and many of our roads required repairs following the storms in late 2010. The damage to our roads stretched from the Stockinbingal area to the Muttama Valley, with some of the roads being impassable after the water receded. Temporary repairs were undertaken soon afterwards to make these roads passable, but there are several projects to be completed as of June 30th 2011. I am glad to report we received grant funding to undertake many of these necessary repairs. We also experienced a large windstorm in February 2011 that blew over a number of trees across a wide area of the Shire. Council received Federal funding under RLCIP to undertake a variety of projects, such as the resealing of the netball courts and construction and sealing of the car park at the Country Club Oval. Council also used RLCIP funds to install solar panels on the Sports Stadium, the village halls in Stockinbingal and Wallendbeen and the recently constructed toilet block in Wallendoon Street. The concept is to generate enough electricity at the village halls to make them energy and cost neutral to the village community. Previous year we took part in the water loss program run through the LGSA and we identified issues and savings of approximately $70,000. We used these funds to employ extra staff in the water and sewer division. Many old and leaking hydrants and stop valves have been replaced around the township in order to minimise water losses and improve the efficiency of the water reticulation system.

Over the last few years we have been installing gross pollutant traps in the storm water drains which discharge into the Muttama Creek. This has been a commitment to the community based Muttama Creek Regeneration Group. Council has also assisted with the installation of signage and displays on the path along the creek edge. We worked with the Australian Lebanese Society to identify then renovate and provide information signage etc about very old Lebanese graves in the Cootamundra Cemetery. The Lebanese Ambassador opened the project and it was attended by a number of the descendents and their families. The rehabilitation of the former gasworks site in Hovell Street was commenced in June 2011. Preliminary investigations and rehabilitation works were funded by State grants. The indentified contamination areas are being excavated with contaminated material being stockpiled onsite and subsequently treated. This project will continue for some time with regular mixing of the material and will hopefully be completed sometime during early 2012. In the last few years, Council has made entry into the swimming pool free for the whole season. We have plans to begin staged major renovations to the pool amenities. The first stage is to demolish and rebuild the entrance area and changing rooms. It was hoped to start stage 1 this year, but it was decided to delay the start for a year. The hope is that future stages will include a covered and heated, separate 25m pool for all year round swimming. Council has a program of ongoing upgrades to our public toilet blocks and this year the program included a rebuilding of the toilet in Kingston Park. At the same time we completely upgraded the park and its amenities. It was decided that the best advertising for our town and district to visitors and potential residents alike was to continue the high level of maintenance of our parks and gardens. To make this more practical Council employed two parks and gardens horticultural trainees. For many years there has been very active recycling undertaken by the residents of Cootamundra. To date the recycling for the commercial district was largely undertaken by private contractors. Council is now providing this service and has issued the appropriate bins and a pickup service to commercial sites. The 2011 / 2012 fire season has the potential to be very serious after such a good growing season. Council has been pleased to assist the RFS in providing a fire fighting base at the airport which should be completed in 2012. The hope is that it will never be needed, but its presence is certainly a reassurance for this region. Council was involved in the preparation of a new Cootamundra brochure. It was decided to change the emphasis of the brochure from just tourism to a mixture of visitor and potential resident information. It included photographs taken by talented local people and has proved to be a success.

As I stated at the start of this annual report, this will be my last. Over the 15 years that I have been Mayor I have worked with some excellent staff and General Managers; Don Cooper, Max Whitteron, Shane Godbee and now Ken Trethewey. I am pleased to be able to report that the relationship with the General Managers has always been constructive and it has been a pleasure to work with them even when we did not agree on an issue. Likewise it has been a pleasure to work with a wide range of Shire Councillors, particularly to receive the support of the Deputy Mayors; Cr Frank Smith, Cr Len Jones, Cr Lynne Magee, Cr Bruce Smith and Cr Doug Phillips. I thank everyone for their support and dedication to Cootamundra Shire and in turn to myself as Mayor. STATE OF ENVIRONMENT REPORT

During 2004/2005 Council joined the Australian Capital Region State of Environment reporting group. A comprehensive State of the Environment report of that group was most recently completed on June 30, 2009, with an update occurring in November 2010. This report is available for download from Council’s web site http://www.cootamundra.local-e.nsw.gov.au/index.php?option=com_jentlacontent&view=enhanced&id=494432&Itemid=2616 or can be viewed in hardcopy at Council’s offices. The report details a snapshot of this environment up to 2010 covering areas of Atmosphere and Weather, Biodiversity, Catchment and Resource Use. Within these categories many issues are discussed such as outdoor air quality, ecological communities, native species, pest animals and plants, groundwater, land degradation, heritage and noise amongst others. This report is extensive and draws on the knowledge and experience of both local residents and experts within selected fields. The report also examines areas of air emissions, identifies contaminated sites and other hazards within the Shire, fire, water use, riparian conditions, surface water quality, drinking water quality, solid waste and a range of other matters that have an impact on the quality of the social, built and natural environment within the Shire. The Australian Capital Region State of the Environment Report is due for full review in 2013. Updates will be provided to the Australian Capital Region as they are requested.

STORMWATER MANAGEMENT SERVICES For the 2010/11 financial year Cootamundra Shire Council made a Stormwater Levy of $25 per residential assessment and $25 per non-residential assessment for every 350 square metres or part thereof up to a maximum of $100. During 2010/11 these funds were used to install four gross pollutant traps to stormwater outlets into the Muttama Creek which have significantly reduced the pollutants being released into the natural water course. Gabion structures were installed at each of the gross pollutant trap outlets in order to reduce erosion at these sites. In addition to this a 100 metre extension to an existing stormwater drain, plus gabion structures, were constructed in order to solve significant drainage and erosion issues in a central location of town. Examples of these stormwater works appear below.

COUNCILLORS’ FEES AND EXPENSES

The following amounts were spent on Mayoral and Councillors’ fees and expenses:-

Travel and other facilities provided to Councillors. In accordance with the Local Government Act and Regulations it is reported that none of the Councillors, Council staff or representatives of the Council were required to travel overseas at Council’s expense or on business directly related to Cootamundra Shire Council during the year ended 30th June 2011. Council provided a fax machine for use by the Mayor at his home and access to an office in the Council Chambers on an ad hoc basis when required for Council business. Council does not reimburse the Mayor for any phone charges associated with the fax machine and has provided toner and replacement consumables as required from Council’s supplies. The facilities provided are of minimal value. Telephone calls made by Councillors are not reimbursed by Council. Councillors were required to attend a small number of seminars and conferences of relevance to Local Government and the total amount spent during the financial year was $2,245, which this year includes the Shires Association Conference. There were no direct costs attributable to accompanying persons at any such seminars during the year. No expenses for the provision of care for a child or family member were incurred by a Councillor.

Revision of Council’s Expenses and Provision of Facilities for Councillors Policy Council’s policy on Expenses and Provision of Facilities for Councillors was revised in November 2009 in accordance with the Department of Local Government Circular 09-36. The policy was re-adopted by Council without change on November 15, 2010 and recorded at Minute Number 16/11/10. This policy is as follows:-

EXPENSES AND PROVISION OF FACILITIES FOR COUNCILLORS

PURPOSE: To determine the scope and extent of expenses that may be claimed by, and equipment and facilities provided to, Mayors and Councillors so that these may be reasonable and appropriate within the provisions of s.252 of the Local Government Act, 1993. The policy has been publicly advertised in accordance with s.253 of the Act. All Councillor expenses must be reasonable and fall within the limits set by Council. LEGAL REQUIREMENTS

• Compliance with guidelines issued by the Department of Local Government circular 09-36 concerning the payment of expenses and the provision of facilities to Mayors and Councillors

(e) Conferences, seminars or workshops where attendance is authorised by the Council, Mayor or General Manager. Council business does not apply to attendance by Councillors at political fund-raising functions.

2. EXPENSES

(i) Accommodation and Meal Expenses Where the business of Council requires the need for Councillors to obtain overnight accommodation and purchase meals, those expenses shall be

reimbursed on an actual cost basis. (ii) Travelling - Within Council’s Area Where Councillors are required to use their own vehicle to travel to meetings of the Council, Committees or other authorised meetings, then

reimbursement for travel expenses shall be based on the kilometre rate as prescribed in the Council’s industrial agreement.

(iii) Travelling - Outside Council’s Area The Mayor or the General Manager are authorised to determine the best mode of travel for authorised travel outside the Council area having regard to

economy, time and safety factors. (iv) Registration Costs Where the business of Council requires the payment of a registration or attendance fee, reimbursement shall be on an actual cost basis. (v) Incidental costs

Council will reimburse the reasonable out of pocket or incidental expenses associated with attending conferences, seminars or training courses that councillors incur upon the presentation of official receipts and the completion of any necessary claim forms.

Incidental expenses could reasonably include telephone and facsimile calls, refreshments (to a maximum of $30), internet charges, laundry and dry cleaning, newspapers, taxi fares, toll fees and parking fees. Also the reasonable cost of meals not included in the conference/seminar/meeting fees may also be reimbursed on production of tax receipts.

(vi) Legal Expenses

Reasonable legal expenses of a Councillor may only be met for legal proceedings being taken against a Councillor in defending an action arising from the performance in good faith of a function under the Local Government Act or defending an action in defamation, provided that the outcome of the legal proceedings is favourable to the Councillor. Subject to the above mentioned conditions, reasonable legal costs may also be available for an inquiry, investigation or hearing into a Councillor’s conduct by an appropriate investigative or review body including: (a) Local Government Pecuniary Interest and Disciplinary Tribunal (b) Independent Commission Against Corruption (c) Office of the NSW Ombudsman (d) Division of Local Government, Department of Premier and Cabinet (e) NSW Police Force (f) Director of Public Prosecutions (g) Council’s Conduct Review Committee/Reviewer. Such assistance will only be provided if the investigative body has progressed to a formal investigation or review and only if their findings are not substantially unfavourable to the Councillor.

(vii) Disputes

Disputes regarding the payment of expenses will be referred to the Director Corporate Services for independent review and if still not resolved to a full meeting of Council.

(viii) Training and Development

Council will pay the expenses incurred in Councillor training within the limits of the budget approved by Council. The budget allocation can be found in Section 3 of Council’s Budget Estimates.

(ix) General Expense Allowance Under clause 403 of the Local Government Regulation no general expense allowance is available to any Councillor. A general expense allowance is a sum of money paid by a council to a councillor to expend on an item or a service that is not required to be receipted and/or otherwise reconciled according to a set procedure and within a specific timeframe.

(x) Payment of Expenses

Councillors are required to complete a Request for Payment Form when applying for reimbursement of expenses. These can be obtained from Council’s Creditors Clerk. Councillor fees do not fall within the scope of Councillor expenses and the payment of Councillor fees is managed separately.

3. PAYMENT OF EXPENSES FOR SPOUSES, PARTNERS OR ACCOMPANYING PERSONS

i. There are limited instances where certain costs incurred by the councillor on behalf of their spouse, partner , or accompanying person are properly

those of the councillor in the performance of his or her functions (hence they are properly incurred by, and reimbursable to the councillor)

ii. Accordingly, Council will meet the reasonable costs of spouses and partners or an accompanying person for attendance at official Council functions either on behalf of the Councillor or Mayor or in the company of the Councillor or Mayor, that are of a formal and ceremonial nature within the Council area. Examples include, but are not limited to, Australia Day ceremonies, Civic receptions and charitable functions for charities formally supported by Council.

iii. Council will also reimburse registration fees and the cost of attendance at official dinners whilst accompanying the Councillor or officer at the Local

Government & Shires Association.

iv. Payment of expenses for spouses, partners or accompanying persons for attending appropriate functions as permitted above shall be confined to the ticket, meal and /or direct cost of attending the function. Council will not reimburse additional travel, accommodation, meal or incidental costs other than provided for in this clause.

4. PROVISION OF FACILITIES

Council shall provide and maintain a facsimile machine for the use of the Mayor at his/her place of residence. Council also provides meals and refreshments associated with Council and committee meetings, official dinners and working party meetings.

Council provides an office for use by the Mayor.

Council may decide to provide other facilities including:

• Use of telecommunications devices, dedicated computer equipment, internet access from home, business cards and the use of a Council vehicle for business.

5. PROVISION OF INSURANCE

(a) Council shall take out public liability and professional indemnity insurance cover which shall extend to actions taken against Councillors and/or Employees

in relation to the exercise of their duties as Councillors and/or Employees. (b) Council shall take out liability insurance cover on behalf of Councillors and Employees to provide indemnity in claims arising from wrongful acts whilst

performing their Council duties in circumstances where the claims are not covered under Council’s public liability and professional indemnity policies and as far as insurance can be legally obtained.

(c) Council shall provide insurance to cover personal injury whilst on Council business and travel insurance for approved interstate or overseas travel on

Council business.

6. CARE AND RELATED EXPENSES

In accordance with the principles of participation, access and equity Council will reimburse the reasonable cost of carer arrangements, including childcare expenses and the care of the elderly, disabled or sick immediate family members of councillors, to allow councillors to undertake their council business obligations.

RURAL FIRE SERVICE ACTIVITY Cootamundra is a member of the South West Rural Fire Zone. The following graph depicts the incidents which rural fire brigades in the South West Rural Fire Group attended during the fire season and also provides a comparison with the two previous years.

The most significant figure on the above graph comes from Grass/Bush Fires, which is a reflection of the activities of an unknown arsonist who was lighting fires at isolated locations within the Shire during both the 2009/10 and 2010/11 fire seasons. The culprit/s remains anonymous and a repetition of this activity during the coming fire season could prove significant considering the level of undergrowth in fire prone areas. It is pleasing to see Motor Vehicle Accidents on the downturn during this period.

Only one Hay shed/stack fires was recorded and farmers remain vigilant in this regard. During 2010/11 in Cootamundra Shire there were 27 fire permits issued covering a larger area than previously experienced due to a favourable growing season. This higher number is also reflected in the number of escaped burns. Thirty five bush fire hazard complaints were received by the South West Zone Rural Fire Service. No development applications were referred to the Rural Fire Service for consideration during the reporting period.

HAZARD REDUCTION WORKS Council conducted annual hazard reduction works on 64 kilometres of rural road reserves, 68 kilometres of village street road reserves in addition to hazard reduction works at the Cootamundra, Wallendbeen and Stockinbingal cemeteries. The Shire also completed hazard reduction works at Council’s two reservoirs and the Cootamundra Aerodrome plus a number of other reserves such as the showground and the village recreation reserves. Hazard reduction methods included slashing, graded firebreaks and chemical spraying. During 2010/11 hazard reduction works continued to be more intensive and conducted more often than in recent times due to the large amount of fuel being present after a second season of increased rainfall. Hazard reduction along the State roads, namely the Olympic Way and Burley Griffin Way, was conducted more often this year and involved mostly chemical spraying. Council conducted roadside and rubbish tip spraying. Any reports Council receives regarding fire hazards on blocks are reported directly to the South West Zone Rural Fire Service for investigation and resolution. Additional mitigation works were again conducted as part of a bushfire Asset Protection Zone (APZ) plan to upgrade designated fire trails that were identified as requiring attention in order to provide improved access to wooded areas.

PRIVACY & PERSONAL INFORMATION PROTECTION The Privacy and Personal Information Protection Act 1999 came into force in New South Wales on 1 July 1999 and required councils to implement a Privacy Management Plan by 30 June 2000. Council adopted the suggested draft plan produced by the Local Government & Shires Associations. In 2002 the Health Records and Information Privacy Act came into being. The principles of this Act were to be incorporated into Council’s Privacy Management Plan. A complete review of Council’s Privacy Management Plan was undertaken during June 2009, which included the addition of the principles of the Health Records and Information Privacy Act 2002. This plan was adopted by Council in July 2009 at Minute Number 15/7/09 and will then be reviewed on an ongoing basis to ensure its continuing relevance as further information and training becomes available on this subject. No information was received nor was an update required during 2010 / 2011.

CHILDREN’S SERVICES AND PROGRAMS Council provided and maintained a wide range of sporting and recreational facilities including: - − Sports Stadium − Swimming Pool − Sporting Fields − Skate Park Council also contributed to the Riverina Regional Library Service, which provides library services for children.

PROMOTION OF COUNCIL SERVICES Council publishes regular information advertisements which promote its services and activities. It also issued press releases on a wide range of matters to print, radio and television media organisations and has a weekly column in the local newspaper. Council conducted a community consultation program during 2008/09 and 2009/10 in order to identify and place in its Community Strategic Plan those issues raised by the community as being of significant importance to the Shire. In all twenty four public forums were conducted where a range of issues covering both current and future services provided by Council were discussed. At the end of the financial year Council also initiated an on-line survey form so that residents could provide feedback to Council on the conduct of their activities and also to raise issues of concern and ideas for future direction. In addition, open forums at Council meetings are held every three months at which residents may address the full Council on matters of concern. Two of these open forums are held in the Shires villages of Wallendbeen and Stockinbingal. The open forums are not well attended despite being advertised widely. At each of the open forums in 2010 / 2011 approximately three members of the public were in attendance.

RESPONSE TO SERVICE REQUESTS During the year ended 30th June, 2011 Council received 1,363 requests requiring follow up or further action. The majority of service requests were taken over the phone and 80% of all requests were attended to within seven days which is consistent with 2009/10. In fact response times for 2010/11 were the same as for the previous year, which is a consistently good result and should now be maintained. Once again the weather has been a factor in delaying response to some requests as it was a particularly wet year with flooding and the resultant works detracting from planned programs. The majority of contact with Council was for a request for service not a complaint about services provided. The graphs below show the type of service requests received by Council during the reporting year and the days to completion. The figures in the Service Request graph are the actual number of requests. This graph provides similar information to last year as Council has a new reporting system capable of greater distinction between service requests. A number of minor requests have not been included in this graph as they were either not significant or not relevant to Council business. The Days to Completion graph is shown as a percentage of the total requests received by Council.

There has been an increase in service requests for road related matters which can be directly attributed to the wetter conditions experienced throughout the year and the flood events of November/December 2010. Tree requests are down marginally which indicates the improved health of the trees due to wetter conditions. Water meter issues are also down due to a meter replacement program being initiated commencing with the older meters in town. This program will be continued. Complaints for overgrown land have increased significantly which is to be expected with the experienced weather conditions.

SERVICES FOR PEOPLE WITH DIVERSE CULTURAL AND LINGUISTIC BACKGROUNDS

Cootamundra Shire Council area has a total population of 7,315 according to the Australian Bureau of Statistics figures from the 2006 Census. Of that population 3.6% of persons identified themselves as being Aboriginal, Torres Strait Islander or both, which is somewhat higher than the Australian average of 2.3%. In the 2006 Census, English was stated as the only language spoken at home by 96.2% of persons usually resident in Cootamundra (A) (Local Government Area). The most common languages other than English spoken at home were: Cantonese 0.2%, Vietnamese 0.1%, Italian 0.1%, Afrikaans 0.1% and Dutch 0.1%. Despite what may on the surface appear to be large percentages in comparison to State averages, there is no substantial ethnic group that is represented in the Cootamundra Shire, except for the Bimbadeen Aboriginal Evangelical College. Council has enhanced its ties with the local indigenous community by assisting in the establishment of a Reconciliation Group and the release of a Statement of Commitment to Indigenous Australians. Council has also supported proposals for a remembering place for the children who where residents of Bimbadeen and has provided ongoing support for local indigenous art and crafts. Council is presently involved in the organisation of the 100 Year commemoration event to mark the establishment of the Cootamundra Girls Home at the Bimbadeen site in 1912.

DONATIONS & CONTRIBUTIONS Section 356 of the Local Government Act, 1993 permits Council to contribute money or otherwise grant financial assistance to persons for the purpose of exercising its functions. Those groups or persons that benefited from donations included Cancer Patients Assistance Scheme, Cootamundra Wattle Guides, Boy Scouts, Southern Sports Academy, Soroptomists International, Rotary Christmas Party and Circus for Special Children, Snowy Hydro SouthCare, TAFE Presentations, Immune Deficiency Foundation, Stockinbingal Fair and Bowling Club and sundry other charities. The total amount expended in accordance with section 356 was $6,375.46.

PRIVATE WORKS Section 67(2) of the Local Government Act, 1993 permits Council to subsidise the cost of works carried out on private lands subject to certain conditions. Council did not undertake any works under section 67(2) of the Local Government Act, 1993 during 2010/11. Council did however undertake private road works for the Cootamundra Nursing Home for which an approved fee was charged.

HUMAN RESOURCE ACTIVITIES

The following Human Resources activities were undertaken in the 2010/11 Financial Year: Recruitment – Thirteen vacant positions were successfully filled in the 2010/11 Financial Year. Seven of these positions were in the Works and Services Section, of which three were able to be advertised and filled internally with sufficient appropriately qualified staff showing interest in applying for the vacated roles. The Facilities and Services Section advertised a total of four positions. Two Parks and Gardens vacancies in the Facilities and Services section were offered as full-time traineeship opportunities, addressing the regional skills shortage of qualified Parks and Gardens tradespeople as identified in Council’s Workforce Management Plan. Council also recruited an Apprentice Mechanic, further demonstrating its commitment to skilling young people within the community. The remaining position vacant was in the Development Services section. Job Re-design in the Facilities and Services Section - Several positions within the Facilities and Services Section underwent review in order to address some work inefficiencies and to prepare for future staffing requirements for the proposed Swimming Pool Complex developments. Responsibilities and duties have been re-allocated to make two permanent full-time Recreation Officers positions in order to staff the Swimming Pool and Sports Stadium with these roles to support and complement each other. The duties of the Cemeteries Attendant, Cleaner/Ranger and Building Services Attendant (Town Hall Caretaker) have also been re-allocated to make the work of these positions more effective and efficient. These positions will be monitored carefully over the next 12-24 months to ensure desired outcomes are achieved. Workforce Management Planning – Documentation of a formal Workforce Management Plan as part of the Integrated Planning and Reporting framework. Consultative Committee – The committee has been very active in engaging participation and consultation with regard to the review of the Salary System, policies and job re-design.

Salary System Review – The review of the Salary System continued. The revision of Position Descriptions including identifying Position Responsibilities, Duties, Selection Criteria and Salary Progression criteria for six (6) Salary Steps was completed for all Outdoor positions (a total of 34 Position Descriptions). The Salary System Policy has been reviewed and re-written and a Policy and Procedures developed for the Assessment of Staff Competency and Performance. The review of Position Descriptions for all indoor staff positions was also commenced. Competency Reviews – In accordance with the reviewed Salary System Policy, Competency and Performance Assessments were conducted for all of the outdoor staff totalling 38. Individual training plans have been developed for consideration in future Training Budgets. Training – Learning opportunities have been provided for staff at various levels of the organisation to meet induction, health and safety, employee skill development and personal development requirements.

COMPANIES IN WHICH COUNCIL HELD A CONTROLLING INTEREST Council did not hold a controlling interest in any company.

RATES AND CHARGES WRITTEN-OFF Council has traditionally not reported small or insignificant write-offs, however at the 2008/09 annual audit, Council’s auditors suggested that staff document and report all write offs throughout the course of the year. Accordingly, it is hereby reported that during the course of 2010/11 Council wrote off a total of $5,257.17 in rates and charges, which have been summarised below:

The two write offs were completed by resolution of Council, both of which were for high water consumption, one being for $1022.95 the other for $970.54. The other write offs were of a much smaller value, and were written off by office staff in order to reduce small debts owing and interest payable. In addition, some rates and charges were written off as they were deemed unrecoverable due to the circumstances of the levying and the individual ratepayers involved.

EQUAL EMPLOYMENT OPPORTUNITY The objective of council’s Equal Employment Opportunity (EEO) Management Plan, which was adopted in May 1995, is to demonstrate management and organisational commitment to EEO in order to ensure that Council and its employees have an understanding of EEO principles and an awareness of issues relating to EEO management. This is intended to eliminate and ensure the absence of discrimination in employment on the grounds of race, sex, marital status and physical impairment, and to promote equal employment opportunity for women, members of racial minorities and physically handicapped persons. The General Manager is council’s EEO Co-ordinator. Responsibility for discussion and implementation of EEO issues is shared between the EEO Co-ordinator, the Workplace Consultative Committee and the Directors and staff of the Council. Specific tasks identified within the EEO Management Plan are:

• The creation of a Policy Statement with regard to EEO (adopted Feb 1997). • Identify the appropriate means of workplace communication (ongoing). • Review of all relevant Council literature to ensure conformity with EEO principles (ongoing). • Survey of Council staff regarding EEO statistics and evaluation of EEO understanding (ongoing). • Review advertising policy, procedures, selection criteria, testing and interview questions to ensure conformity with EEO principles (completed Jun 1998).

PARTNERSHIPS, CO-OPERATIVES, JOINT VENTURES

RIVERINA REGIONAL LIBRARY Cootamundra Shire Council is a foundation member of the Riverina Regional Library (RRL), together with Coolamon, Greater Hume, Gundagai, Junee, Lockhart, Temora, Tumut and the City of Wagga Wagga. The RRL consists of 13 stationary library branches and one mobile library/telecentre that serves 28 communities. The RRL was established in 1978, and has grown from its initial membership through the admission of four additional Councils. RRL has for some years been considered a leader amongst regional libraries. It has participated in a number of statewide projects, been represented on various State Library of New South Wales committees, contributed to the development of policy and other documentation at the State level, and introduced a range of service and technology innovations. RRL has also taken a lead role regionally, and has instigated a number of collaborative training initiatives with other libraries in the South-West Zone as well as acting as a “mentor” for smaller libraries in the Zone. The central resources and local libraries are designed to respond to individual citizens and organisations. Each library attempts to meet citizen’s information needs for daily life, work, learning, leisure and to provide access to published records of our culture. To these ends, the libraries collect relevant resources, organise them and promote their use in these communities. SOUTH EAST WEIGHT OF LOADS GROUP

Council is a member of the South East Weight of Loads Group which was formed to ensure that road pavements are protected against overloaded vehicles in the South Eastern Region of New South Wales. The Group enforces the weight of loads restrictions within the participating local government areas. Council administers the investment of this group, being their unexpended funding, at a fee of 0.25%.

SOUTH WEST REGIONAL WASTE MANAGEMENT GROUP In February 2002 Council resolved to join the South West Regional Waste Management Group (SWRWMG). SWRWMG’s objective was to procure a reliable and environmentally friendly landfill site that would service the member Councils into the future. The Member Councils include Boorowa, Cootamundra, Gundagai, Harden, Tumut, Tumbarumba, Yass and Young. SWRWMG was successful in its objective and signed long term contracts with the operator of the Bald Hill Quarry near Jugiong to use the previous quarry pit as a landfill site. The EPA has approved the site as a landfill site and all infrastructures relating to the site was been constructed by the SWRWMG. The Bald Hill Landfill site has approximately 25 years remaining life at current dumping rates. Cootamundra Shire Council transferred 4,111 tonnes of waste to this facility during 2010/11, which is slightly more than last year and is an unexpected and disappointing result considering that Council implemented its central business district recycling program at the commencement of this financial year. This problem was experienced by all councils in the SWRWMG and as a result the SWRWMG determined to appoint a contracted Waste Officer to undertake further education programs relating to waste management and minimization.

SOUTH WEST SLOPES ZONE RURAL FIRE SERVICE

This Council is a member of the South West Slopes Zone Rural Fire Service, which comprises the councils of Cootamundra, Harden, Boorowa and Young Shires. The Group controls the obligations of each of the Councils under the Rural Fires Act, 1997 and jointly employs a Fire Control Officer and four other personnel to co-ordinate the activities of the group. Both positions are based in the township of Harden and utilise the services of an extensive radio network to maintain contact with the volunteer Bushfire Brigades. RIVERINA EASTERN REGIONAL ORGANISATIONS OF COUNCILS Cootamundra Shire Council participates with fifteen (15) other councils in the Riverina Eastern Regional Organisation of Councils. The activities of this group fall into three main areas namely resource sharing initiatives, identifying regional solutions for local problems and lobbying activities. Council has benefited from this participation through resource sharing, group purchasing and by collective representation and various other activities. NATIONAL COMPETITION POLICY

Competitive neutrality is a principle that is part of the national competition policy which is being applied to government businesses at all levels throughout Australia. The framework for the application of national competition policy is found in the NSW State Government “Policy Statement on the Application of National Competition Policy to Local Government”. It was developed in co-operation with the Local Government and Shires Associations. The principle of competitive neutrality is based upon the concept of a ‘level playing field’ between persons competing in a market place, particularly between private and public sector competitors. Essentially, the principle is that Council should operate without net competitive advantages over other businesses as a result of its public ownership. Compliance with the principle is required unless it can be demonstrated that the costs of implementation outweigh any benefits for the community. In relation to Councils, it is accepted that some business activities will have a significant impact. A threshold of $2M annual sales turnover/ annual gross operating income has been chosen by the NSW State Government as a reasonable measure of economic significance for the purpose of applying a corporatisation model and pricing requirements. Businesses over this threshold are called Category 1 businesses. A council’s business activities may be significant in a local or regional context, regardless of the $2M threshold for adoption of specific requirements when council conducts a cost/benefit analysis of its activities when determining compliance with National Competition Policy. Business activities under the threshold are called Category 2 businesses. Council must have sound reasons for any decision it comes to. An actual or potential competitor of a council business may make a complaint if it believes that it is being adversely affected through a failure to adopt competitive neutrality. Councils are required to establish a complaints handling mechanism for competitive neutrality issues and the Department of Local Government will also have a role in receiving complaints.

Councils also are required to apply full cost attribution in relation to Category 1 businesses, but may determine not to apply them to Category 2 businesses. Full cost attribution includes taking into the financial reporting system tax equivalent payments, debt guarantee fees and return on capital. Tax equivalent payments arise from the fact that Council’s do not pay income tax, therefore the equivalent cost of such a tax should be taken into account when determining pricing for a business. Debt guarantee fees arise from the fact that Council’s tend to get a better rate of interest on borrowings than the private sector, therefore a market rate equivalent is to be applied and a subsidy recognised against the business activity. Return on capital investment should be taken into account when determining costs and setting pricing. Cootamundra Shire Council has conducted a cost/benefit analysis of all the business activities that it undertakes and has categorised the following activities as coming within the defined categories for National Competition Policy. Water Supply Category 2 business Sewerage Services Category 2 business Council has no Category 1 businesses. A complaint handling mechanism is in place with all complaints of any nature being recorded and competitive neutrality complaints being a category of complaint lodged. To date no complaints have been received that relate to competitive neutrality. Separate internal financial reporting has been established for the above two businesses and integrated into Council’s main financial reporting system. Council has determined not to adopt full cost attribution for its Category 2 businesses as it is not practical to do so. Subsidies made to the businesses, should they exist, are identified and included into the financial reporting system. The businesses identified comply with all the regulations that apply to the private sector for those categories of businesses. Council is required to report separately within its financial reports the businesses identified through National Competition Policy. This commenced in the 1999/2000 financial year.

COMMUNITY STRATEGIC PLAN As a Group 1 council, Cootamundra Shire Council adopted its Community Strategic Plan on June 15, 2010 to cover the period 2010 to 2020. The Community Strategic Plan below was developed through an extensive community consultation process involving 24 individual workshops and employing the principles of the Integrated Planning and Reporting system. As a result of this process Council adopted its Community Strategic Plan at Council Minute Number 08/06/10 after the mandatory public exhibition period. The Community Strategic Plan is due for review in the 2012/13 financial year after the Local Government General elections in September 2012.

During the first year of operation of the Community Strategic Plan (2010/11) Council had intended to initiate proceedings in the following areas but were unsuccessful. • Infrastructure – Indoor swimming facility and an upgrade to the Town Hall • Services – lack of water pressure in some parts of Cootamundra

The reason for the inability to initiate these projects is indicated in the table below.

COMPANION ANIMALS Council has lodged its pound data collection return with the Department on the 29th July, 2011. A copy of this return is on the following few pages. Council has no record of any dog attacks during the past twelve months. During 2010/11 Council spent $26,100 in the Companion Animal Control function. Public education programs continue to be conducted through the local paper with regard to Companion Animal control regulations and a ‘Pound Puppies’ segment in the paper finds new owners for disowned pets thereby reducing the number of euthanased animals each year. Council promotes Cootamundra as a dog friendly town and encourages the desexing of animals. Throughout National Desexing Month, Council assists both local Veterinary Hospitals. 73 animals were desexed during the month of July. Lifetime registration costs the owner $150 but if they have the animal desexed, lifetime registration will only cost the owner $40. Council has two designated off leash areas that cater for most dog owners within the town boundaries. These areas are serviced with dog tidy dispensers, providing owners with disposable tidy bags for animal cleanup.
