1. Definitions

In these rules, unless the context otherwise indicate>, any word or expression towhich a meaning has been assigned in the Act shall bear that meaning, and -

11Constitution" means the Constitution of the Republic of South Africa, 1996, ActNo. 108 of 1996~

"department" means the Department responsible for traditional affairs in theProvince;

/I electoral college" means a group of candidates :>elected by various imbizoswithin a particular constituency;

"House of Traditional Leaders" or "House" mears the House of TraditionalLeaders established by section 2 of the Act;

"imbizo" means a community meeting;

"MEC" means member of Executive Council responsible for traditional affairs inthe Province;

"presiding officer" means a person designated by the head of department topreside over an imbizo or an electoral college;

"Province" means the Province of the Eastern Cape;

["region" means a tarrttorlal area referred to in the Annexure hereto;]

"regional authority" means a regional authority estabtished in terms of a lawcontemplated in item 2 of Schedule 6 to the Constitution

"Royal Family "means the Royal familv as defined in the Traditional Leadershipand Governance Act (Eastern Cape) I 2005 (Act No.4 of 2005);

Usecretary" means an officer of the department who is responsible for theadministration of a traditional council;

"the Act" means the House of Traditional Leaders Act (Eastern Cape), 1995(Act No. 1 of 1995);

"traditional communityll means a traditional community as defined in theTraditional Leadership and Governance Act (Eastern Cape), 2005 (Act NO.4 of2005);

"traditional council" means a traditional council as defined in the TraditionalLeadership and Governance Act (Eastern Cape), 2005 (Act NO.4 of 2005); and

Utraditionalleader" means a traditional leader as c!efined in the TraditionalLeadership and Governance Act (Eastern Cape), 2(105 (Act No.4 of 2005).

2. Selection of candidates for nomination

(1) (a) The MEG must by notice in the Provincial Gazette, determine the date onwhich a [community meeting] imbizo must be held by each traditional[authority] community within the constituencies se1 out in the Annexure hereto,[ in the Province] for purposes of selecting candidates from amongst whom themembers of the House of Traditional Leaders will be nominated in terms of rule3.

(b) A traditional leader who is a head of a tradltional community must, inrespect of his or her area of jurisdiction, convene the! [community meeting]imbizo which must be held on the date determined ill terms of paragraph (a).

(2) The meetings contemplated in sub rule (1) must be presided over by [thehead of the relevant traditional authority] the presiding officer.

(3) All the meetings referred to in sub rule (1) must, subject to rule 4(7) (k), beheld on the same day throughout the Province.

(4) The traditional leaders and members of the community present at eachmeeting must select three candidates who will, as provided in rule 3(2),participate in the nomination of the members of the House of Traditional Leadersand who will represent each constituency in the House in accordance with theAnnexure hereto.

(5) If one of the of candidates selected in terms of sub rule(4) does not acceptselection I the meeting must select another candidatl~ to replace the decliningcandidate.

[(5)] @LThe procedure to be followed in selecting the three candidates is asfollows: [must be determined by those attendins imbizo.]

(a) The presiding officer must explain the provisions of section 5 and 6 of theAct;

(b) The selection process must be by show of hand;(c) The presiding officer must call for selection of candidates who are not

disqualified from being members in terms of section 6 of the Act;(d) A candidate whose name has been proposed must be seconded by at

least one person;(e) A selected candidate must rise and indicate whether he or she accepts the

selection and must declare that he or she qUclifies in terms of the Act:(f) Th e selected members must be comprised of at least 1/3 of women per

traditional community.;(g) The presiding officer must in writing I submit the names of the selected

candidates to the head of department within 2 days from the date of thecommunity meeting:

(h) The head of department must publish the names of all the selectedcandidates in the Provincial Gazettewithin 7 days from the date of thecommunity meetings.

[(6)] ill The three persons selected in terms of this ·ule must be persons whoare traditional leaders.

3. Nomination by each constituency ofmembers of the house

[(1) The secretary of each traditional authority must in writing, notify therelevant magistrate referred to in rule 4(2) of the names of the threecandidates selected by each traditional authority in the Province in terms ifrule 2.]

(1) The head of department must in writing notify the presiding officer for eachelectoral college of the names of the candidates who will constitute the electoralcollege.

(2) (a) The traditional leaders selected in terms of rule 2 must, within aconstituency, constitute a single electoral college in respect of that constituencyand the electoral colleges so constituted must nominate the members of theHouse from amongst their number.

(b) The number of persons to be nominated in respe:t of each constituency mustbe equal to the number of representatives allocated 1:0 each particularconstituency in accordance with the Annexure hereto.


(4) (a) Subject to sub rule 2 (b) [paragraph (b)], no traditional leader must benominated [selected] as a candidate unless such a traditional leader is qualifiedto be a member of the House in terms of the Act.

4. Procedural matters relating to nomination at atectors! colleges [ofmembers of the house]

(1) (a) The electoral colleges cqnstituted in terms of rule 3(2) must meet on thesame day at the seats of the constituencies which have jurisdiction in eachconstituency referred to in the Annexure.

(b) The MEC must, by notice in the Provincial Gazette, determine the date onwhich the meetings contemplated in paragraph (a) must be held.

(2) The head of department must cause electoral cc,lIeges to be convened a1 theseat of the electoral college as provided for in the A 1nexure hereto. [Amagistrate of the district in which the seat of the constituency concerned issituate must convene and preside over the mee1ing at which members ofthe House of Traditional Leaders will be norninated.]

(3) The meeting at which nominations will take place must be open to the publicbut no member of the public must participate in the nomination process, or in anydiscussion relating thereto, whilst the meeting is in progress.

(4) The head of department [responsible for traditional affairs] must identifyofficers from the department who will assist the [mclgistrate] presiding officersamongst others, to take record of the proceedings.

(5) A candidate selected for nomination in terms of rule 2 must be entitled to voteat the meeting of the electoral college concerned and must have one vote.

(6) The [chairperson] presiding officer [presiding over] of each electoralcollege must cause the proceedings of such college to be recorded in such amanner as he or she may direct.

(7) (a) The [chairperson] presiding officer at a rneetinq of an electoral collegemust call for the nomination of candidates from amongst the persons selected interms of rule 2.

(b) A person so nominated must rise and indicate whether he or she accepts thenomination or not.

(c) The nomination of a candidate must be seconded by at least three personsentitled to vote at the meeting and who are from different traditional [authorities}communities.

(d) If the number of persons nominated at the meeting exceeds the number ofpersons who may be nominated for a particular constituency in terms of theAnnexure, the [Chairperson] presiding officer must call upon the members ofthe electoral college concerned to vote for the members of the House by secretballot.

(e) A traditional leader who has been nominated may decline his or hernomination at any time during the course of the meetinq.

(f) Should a ballot be necessary, the ballot paper must contain all the names ofthe nominees in alphabetical order in the same print with space next to eachname to allow for the exercise of choice by means of a mark on the said paper.

(9) Each voler must vote by placing a cross (X) on 1he ballot paper opposite thename of the nominee for whom he or she wishes to vote and each such ballotpaper must be folded inwards.

(h) The [chairperson] presiding officer must provide ballot boxes and suchballot boxes must be opened at the election before voting takes place todemonstrate to the voters that the boxes are empty.

(i) The [chairperson] presiding officer or any other person assisting him or her[the chairperson] in the election must maintain secrecy and must not attempt toascertain, or directly, or indirectly aid in ascertaining. for which nominee anyvoter has voted. The head of department must provide a code of conduct forthe presiding officers and the officers of the department which must be bindingon them.

(j) Each voter must put the ballot paper into a ballot box.

(k) The election process must continue until all voters present have voted:Provided that such election must not proceed beyond seventeen hours (17:00)on the day concerned: Provided further that the election may continue on thefollowing day if unforeseen circumstances necessitate this.

(1) The chairperson and the persons assisting him or her in terms of rule 4(4)must be responsible for the counting of votes.

(rn) The counting must commence immediately after voting.


(n) The procedure outlined above must be repeatec until the electoral collegeconcerned has nominated persons who, in number, are equal to the number ofrepresentatives each constituency is entitled to in accordance with the Annexure.

(0) The procedure set out above must be followed i1 case of further nominationbeing necessary for the filling of vacancies.

(8)[ Kings must designate their representatives to the House in writing, anda letter of designation must be submitted by the King concerned in respectof each representative to the MEC for publicatio n in terms of rule 5.] Wherea King or a Queen does not assume his or her seat in the house and decides toappoint a representative in terms of section 3 of the Act, the following proceduremust apply:

(1) The King or the Queen must advise the head of department in writing, ofthe name of his or her nominee within 2 days fr-om the date of the electoralcollege.

(2) Such representative must be a member of a Royal family who is recogn isedas a traditional leader.

(3) Such representative must serve for the period of the term of the houseunless he or she is disqualified in terms of section 6 of Act.

(4) The MEC must publish or cause to be published the Provincial Gazette,the names of the representatives together with the names of the memberswho have been nominated by the respective constituencies.

(5) A representative of a King must enjoy privilegHs, rights, functions, powersand shall have the same obligations as any other member of the House.

5. Results of elections

The results of the nomination processes must be p Jblished or caused to bepublished by the MEC by notice in the Provincial Gazette, immediately after theyall become available to him or her.

6. Vacation of seat by member of the house

A traditional leader who is a member of the House must on being elected to thenational House of Traditional Leaders, be deemed to have vacated his or herseat in the House, and the resultant vacancy must be filled in accordance withrules 2,3 and 4.


7. Transitional Provisions

Any act performed or decision taken in terms of the rules published in NoticeNo. 13 of 2005 in Provincial Gazette No.8 of 20mi is valid and must bedeemed to be performed or taken in terms of the these rules.
