Guidance Note for the CDM Notifiable Projects DCC’s Client Responsibilities Checklist

This form is to be used if the project: (a) Last longer than 30 working days and have more than 20 workers working simultaneously at any point in the project; or (b) Exceed 500 person days. This guide is to enable you, the Client, to use the attached check list. It is important to bear in mind that it is to be used by the Client of the Construction Project and it is the Client’s responsibility to ensure that it is completed. There is a misconception that a Client can entirely delegate their duties to others, e.g. their Architect / Principal Designer, Building Surveyor or other professional such as a Health and Safety Adviser. This is not the case and the CDM Regulations 2015 clearly place duties on the Client who instructs the work. In some circumstances it may not be clear who the ‘Client’ is under CDM 2015. In this case, any uncertainty should be resolved as early as possible by considering who: a) Ultimately decides what is to be constructed, where, when and by whom; b) Commissions the design and construction work (the employer in contract terminology); c) Initiates the work; d) Is at the head of the procurement chain; and e) Appoints contractors (including the Principal Contractor) and Designers (including the Principal Designer). The definition of ‘Construction Work’ has widened to include: (f) The construction, alteration, conversion, fitting out, commissioning, renovation, repair, upkeep, redecoration or other maintenance (including cleaning which involves the use of water or an abrasive at high pressure), decommissioning, demolition, or dismantling of a structure. (g) The preparation for an intended structure including site clearance, exploration, investigation (but not site survey) and excavation (but not archaeological investigations), and the clearance or preparation of the site. (h) The installation, commissioning, maintenance, repair or removal of mechanical, electrical, gas, compressed air, hydraulic, telecommunications, computer or similar services which are normally fixed within or to a structure. This checklist is designed to evidence that you are carrying out your duties as a Client. These are set out in the Construction (Design & Management) Regulations 2015. This checklist is your record that you have been sufficiently involved with the Construction Project to dispense your Client duties. While the co-operation of others will be required to complete the checklist it is the responsibility of Client to ensure that others assist with the completion of this form. This form should remain in the possession of the Client, both during and following the completion of the Construction Project. A completed version is to remain on C2 with the Project Files. This form is to remain an electronic version on the C2 System. All persons responsible for initialling and dating this form should do so by using the Project C2 version. On the C2 system you should check it out, amend the details, save it on your system (without changing the file name) and check it back into C2. A printed version can be used, but only when absolutely necessary. If a printed version is used, the Project Lead is to update the Master Copy on C2, at the earliest convenience. The Principal Contractor does not have access onto C2; therefore the Project Lead can get a verbal agreement, which is to be minuted as evidence, then update the C2 version at the earliest convenience.

A – Design Phase In the design phase of the project the Client will need to liaise with the Principal Designer to ensure that appropriate Dutyholders are appointed and adequate processes are in place to initiate the project. The Client will need to ensure that Dutyholders are asked the questions set out on the form and ensure they initial the questions to confirm they are in agreement that appropriate processes are being followed. Depending on the procurement method the PC may NOT be appointed until the B – Pre-Construction Phase, in which case note in column A – N/A. B – Pre-Construction Phase and Construction Phase The Client will during these phases of the project, need to liaise with the Principle Designer and Principal Contractor to ensure that the project is being properly initiated and executed. The Client will need to visit the site and obtain assurances from both the nominated CDM Adviser, Principal Contractor that appropriate processes are being followed and ensure they initial the checklist to confirm that this is the case. The Client may need to visit the site more than once if the project runs over an extended period of time. C – Post Construction Phase The main duty of the Client post construction is to ensure that a H&S file is issued by the Principal Contractor and passed to the future or current Building Manager. The client should initial the form to confirm that this activity has been completed. The client must ensure that this check list is retained for at least 3 years after the project is completed or longer if a H&S incident had occurred that may call in to question the role of the Client. NOTE 1 – ASBESTOS An employer must not undertake any work with asbestos without having prepared a suitable written plan of work detailing how that work is to be carried out. The employer shall keep a copy of the plan of work at those premises at which the work to which the plan relates is being carried out for such time as that work continues. In cases of final demolition or major refurbishment of premises, the plan of work must, so far as is reasonably practicable, specify that asbestos must be removed before any other major works begin, unless removal would cause a greater risk to employees than if the asbestos had been left in place. The employer must ensure, so far as is reasonably practicable, that the work to which the plan of work relates is carried out in accordance with that plan and any subsequent written changes to it.
