    Draft of the Constitution of Khalistan

    Victory be in the name of one God.

    1. a.

    The Government of Khalistan will function as an instrument of the Khalsa Punth and

    the Akal Takht will represent the Authority of the Khalsa Punth through the collective

    of the Khalsa Punth Trustees the FI! "!#$!% &Pun' Pyaras(.

     ).

    The Khalsa Punth is the e*tended +agnum ,oncillium or Grand ,ouncil of the -ikhs

    world wide to which all )aptied -ikhs &whatever their domicile( are eligi)le to

     )elong.

    c.

    The functions and activities of the Khalsa Punth are co/ordinated )y the Khalsa Punth

    ,a)inet through its own organiational structure0 its constitutional instruments andactivities throughout the world.

    d.

    The role of the Khalsa Punth through the Khalsa Punth ,a)inet is to act as the

    ideological0 integrative0 political0 religious and cultural caucus of the Khalsa0 the

    mem)ers of the Khalsa Punth.

    e.

    The Khalsa Punth ,a)inet will )e the forum for all matters pertaining to the -ikh

    spiritual0 social0 economic and political cultures and the preservation of the Khalsa.

    . a.

    The right to consensus2election of the mem)ers of the Khalsa Punth ,a)inet and the

    Khalsa Punth Trustees will )e only with the mem)ers of the Khalsa Punth.

    %ivinely inspired and2or learned and well/versed mem)ers of the Khalsa Punth may

     )e invited )y consensus to serve as Punthic Trustees or as mem)ers of the Khalsa

    Punth ,a)inet.

    3. a.

    The Khalistan 4ational ,a)inet will )e the forum for all policy e*ecution and

    government e*ecutive matters.

     ).

    The Khalistan 4ational ,a)inet will )e responsi)le to the Akal Takht.

    c.

    All the ,ongressmen0 ,ouncillors0 ,a)inet mem)ers will )e confirmed in $ffice )y

    the Akal Takht.

    5. a.

    The K6A#I-TA4 4ational ,ouncil will )e the forum of discussion and de)ate and

    enactment of laws and will have the elected representatives of all the citiens of

    Khalistan of whom two thirds of the num)er will )e mem)ers of the Khalsa Punth.

     ).

    The Khalistan 4ational ,ouncil will have nominated representatives of each minority

    citien group )y the Akal Takht.

    c.

    All the representatives forming mem)ers of the 4ational ,ouncil will )e at li)erty for

    the e*pression of their opinions and proposals and engage in de)ate and discussion in

    full freedom on any matter with the greatest emphasis upon the ideals of Khalistan.

    d.

    The Khalistan 4ational ,ouncil will have provision for the representatives of

    -pecialist Interest groups and for individuals representing their personal viewpoints

    and proposals.

    e.

    The K6A#I-TA4 4ational ,ouncil from amongst its elected representatives will )y

    consensus elect its ,hairman the -ecretary General of K6A#I-TA4 and a group of

    mem)ers from amongst its mem)ers to )ecome the K6A#I-TA4 4ational ,a)inet of 

    whom two/thirds will )e mem)ers of the Khalsa Punth.

    7. a.

    !very citien and the -pecialist Interest groups will )e encouraged to participate in

    the national policy formulation and the proposals of such Interest groups and the

    individuals will )e thoroughly de)ated in the forum of the Khalistan 4ational

    ,ongress which will )e presided over )y the ,ommissioner General appointed )y theGovernor General.

     ).

    The range of activity )y individuals and Interest groups will )e confined to the forum

    of the 4ational ,ongress and to the proposals for realiing o)'ectives in the national0

    economic0 environmental and social areas.

    8. a.

    The AKA# TAK6T will nominate to the elected )ody of the mem)ers of the ,a)inet

    a one/third num)er additional mem)ers of the ,a)inet0 three of whom will )emem)ers of the Khalsa Punth and all the rest will )e non/-ikhs including from

    minority groups.

     ).

    From amongst the mem)ers of the ,a)inet the mem)ers of the K6A#I-TA4 4ational

    ,ouncil together with the mem)ers of the K6A#I-TA4 ,a)inet will elect the

    ,hairman of the ,a)inet who will hold the title of Governor General of

    K6A#I-TA4.

    c.

    The K6A#I-TA4 4ational ,a)inet will )e the forum for all policy e*ecution and

    government e*ecutive matters.

    d.

    The independent Khalsa Punth ,a)inet ,ollege will )e the forum for all matters

     pertaining to the -ikh spiritual and political cultures and to the preservation of the

    Khalsa. It will also )e responsi)le to the AKA# TAK6T.

    9. a.

    The Government instrument and all its strategy units will )e guided in all its policies

    and deli)erations )y the spiritual and political philosophy and principles of the Khalsa

    Punth concerning the achievement of national goals and o)'ectives and these will at

    no time )e at variance with those of the Khalsa Punth in its commI tment at all costs

    leisure activities and the opportunity to separate work &which for the -ikhs is a form

    of worship( from private life.

    Free education will )e provided at all levels. All schools0 colleges and universities will

    operate as co/operative institutions.

    c.

    Free medical services at clinics0 hospitals and related institutions will )e provided at

    all levels and these will operate as co/operative institutions.

    d.

    Free veterinary services will )e provided at all levels for all animals and creatures and

    will operate as co/operative institutions.

    . a.

    -ocial welfare services0 education facilities and services0 leisure facilities0 essential

    services0 veterinary services will all operate on advanced co/operative commercial

     patterns co/related in all areas to compulsory contri)utions interlinked with insurance

    schemes. In essence every citien will )e a share/holding mem)er in every national

    co/operative institution of )asic and essential services. The contri)utions of the

    citiens will )e linked with insurance schemes covering every conceiva)le eventuality.

     ).

    Dhilst under the um)rella of the government instrument with its appointed

    representatives on the management "oards the national co/operative services will

    remain independent of and naffected )y political strategy or policies and treated as

    essential economic development o)'ectives and will )e e*pected to function as reward

    seeking corporate )odies.

    3. a.

    Appreciation and preservation of environment and desire for )etter living standards

    with the national policy for every citien to own his home and means of transport will

     )e encouraged.

     ).

    The reward to each citien for services rendered will )e co/related with the individual

    effort and input with the option for e*tra work input for yet higher financial reward

    and the satisfaction of the individual.

    1. a.

    The economic system will )e free enterprise and co/operative enterprise )ased on

     private or collectivist ownership in a free market and the development of corporate

     )enefits and material wealth.

     ).

    +onopolistic control )y either private or collectivist interests will not )e permitted.

    c.

    The economy will typically )e )ased on individual and2or collectivist entrepreneurial

    initiative )ut with centralied planning guidelines and o)'ectives only and these

    mostly in the social welfare and related economic sectors.

    d

    All social and essential services with the participation of all the citiens will )e )ased

    directly on the highest and most advanced technology and techni:ues0 and

    management will )e )ased on the most advanced economic considerations which0 in

    the final analysis0 will determine the procedures to )e adopted within essentially co/

    operative corporations to engender profit and its distri)ution to the citiens the

    shareholders.

    e.

    The reward for work in all spheres will )e determined proportionally )y formulae for

    each sector )ased on the standards of the First world countries0 so as to ena)le the

    release of purchasing power through each working individual into the national

    economy mainstream and ena)le each individual to make compulsory contri)utions to

    the essential and )asic national co/operative institutions and the national insurance

    schemes and additionally with the calculated surplus encourage industrial

    development and investment in the independent financial institutions and to take

    e:uity in industry geared for the production of all essential products and goods.

    f.

    In addition to the agricultural sector0 industrial production emphasis will )e on

    housing0 )uilding materials0 consumer goods and the provision of services.

    g.

    The domestic market will )e open to encourage ma*imum international integration )y

    the creation of financial and commodity markets with minimal regulation.

    -aving policies )y working individuals will )e compulsory and co/related to the

    graduated personal insurance cover schemesE the contri)ution to the national co/

    operative institutions a ta* relief system.

    i.

    Investment will )e private and2or collectivist and unrestricted.

    +utual favoura)le and satisfactory international trade and training agreements and

     'oint venture pro'ects will )e encouraged and esta)lished.

    k.

    !conomic growth rates will )e encouraged to )e ade:uately )alanced for the needs of

    an efficient mi*ed agricultural and industrial society.

    l.

    ltra/modern highways0 )y/ways0 link roads and communications systems and

    airports0 airfields0 and heliports will rank highest in priority.

    m.

    The agricultural sector will remain of top ranking priority and will )e co/related to

    international market re:uirements and competition. Industrial development and

    manufacturing will )e given the highest priority at par with the agricultural and

    communications sectors0 and competition will )e encouraged as a necessary stimulus

    for growth.

    n.

    #a)our representation will )e encouraged )ut will )e restricted to representation of

    issues of 'ustice in all human spheres including financial. It will not )e allowed to

    constitute itself as a union or as an economic force nor to threaten national or essential

    economic or social services and sectors.

    o.!nvironmental awareness and preservation will )e made the essential concern of

    every working citien who will )e re:uired to contri)ute to the environment ta*

    scheme.

    The Panth Khalsa0 founded )y -ahi) -ri Guru Go)ind -ingh ;1 on the "aisakhi of

    18>> A.%.0 once again as per the saying of %har Te' Krara &)e a )rave and glorious

    warrior( and as per Guru?s ordained dictum0 Karega Khalsa &the Khalsa shall rule(0

    through the Five mem)er Panthak ,ommittee nominated )y the -ar)at Khalsa on 8th

    ;anuary0 1>=80 fulfils the most cherished dream of the -ikhs &)y this declaration( of?Khalistan?.

    $n this auspicious day0 from the 6oly Akal Takht -ahi)0 it is &on )ehalf of the five

    mem)er Panthak ,ommittee( here)y declares )efore all the -tates2Governments and

    notifies to them that from today onwards0 the Khalsa Panth will have its own 6ome0

    the

    Khalistan 0 wherein will ever remain high in the air the flags0 towers and posts of the

    -ikhs and wherein the writ of the Khalsa will run supreme. 6erein the entire control

    of the government and. administration shall vest in those who pray for the welfare ofall and earn their livelihood )y the sweat of la)our.

    The slogan of 

    Khalistan 0 which has )een moving the hearts of the -ikhs and the -ikh youths for

    several years and the founding of which had )een mentioned )y -ant "a)a ;arnail

    -ingh ;i Khalsa "hindranwale0 on ;une 30 1>=5 at the time of the military attack on

    -ri %ar)ar -ahi) and -ri Akal Takht -ahi) )y the 6indu Government of India. The

    -ikh -angat had ratified this idea with great 'oy and thrill at the time of the -ar)at

    Khalsa convened on April 130 1>=8. The -ikh -angats repeat their commitment to thedictum

    Khalistan is )eing realised. The Five mem)er Panthak ,ommittee constituted )y the

    -ar)at Khalsa convened )y the %amdami Taksal0 today here)y declares &the formation

    of(

    Khalistan .

    This declaration of the Khalistan is made )efore the Khalsa Panth as well as the -ikh

    community &comprising of every -ikhE male0 female0 mother0 )rother etc.( so that all

    of us may0 in accordance with our individual capacity0 contri)ute to its cause

     physically0 mentally0 and financially and may thus prove worthy of our e*alted Guru?s

    saying of +aran +umsa0 -uria 6ak 6ai0 ;o 6oi +aran Farwano. Today the five

    mem)er Panthak ,ommittee calls upon the entire -ikh nation to )e ready for all types

    of sufferings and scarifies.

    The wish of the Khalsa is to achieve the declared o)'ective )y the Guru?s grace0 love

    and affection. $ur programme isC

     4a ko wairi nahi )egana0 -agal -ang hamko )an ai .

    &4o one is our enemy and no one is stranger to us0 all are our )rethren(.

    De are not interested in creating any upheaval or in shedding undue )lood and we

    e*pect the same from others too. De e*press our firm faith in resolving all the issues

    cordially and through a dialogue with the 6indu ma'ority and Government of India.

    De hope that the Government of India will not )e )linded )y an anti/-ikh attitude

    underlying "rahminism and will face the reality )y giving recognition to theformation of 

    Khalistan . This would )e the real -atyagraha of "harat.

    olitical -eco1nition

    The Khalsa Panth demands political recognition &of 

    Khalistan ( from all the powers of the world0 especially America &.-.A.(0 !ngland0

    Pakistan0 ,hina0 ,anada0 Dest Germany and from the Governments which aresignatory to the Darsaw Pact0 and Italy0 France0 ;apan0 -ri #anka0 4epal0 "urma0

    "hutan0 "angla %esh0 Iran0 Ira:0 -audi/Ara)ia0 Israel0 !:uador etc. De also appeal to

    the mem)er countries of .4.$. to grant us recognition0 help and assistance for the

    various political0 military and other issues0 which have arisen or may arise concerning

    the human rights in the

    Khalistan .

    De are hopeful that the new government of 

    Khalistan will )e formed soon )ut the Panth is seeking its political recognition to

    avoid the pro)lems that may )e caused )y the delay in its recognition. De havealready demanded recognition )y the Government of India which should come forth

    in order to keep good neigh)ourly relations &)etween India and

    Khalistan ( that will help in restoring peace and )rotherhood in Pun'a) as well as in

    India0 and encouraging toleration so as to end all )itterness of the day.

    -ince

    Khalistan has come into )eing0 the Government of India should &recognising its

    e*istence( take political0 military and administrative measures such as recalling itsarmy of occupation and para/military forces. It should also direct its administration to

    e*ecute the writ of 

    Khalistan .

    Khalistan 0 for the time )eing0 does not intend to )ring a)out any change in the present

    from of government2administration set up so that day/to/day work may not suffer.

    $nly the seals of Government of Pun'a) and India will )e replaced )y those of

    ?Khalistan .

    The -ikh community is especially commanded to )e patient and tolerant. The

    Government -ikh officials0 the -ikh soldiers and all kind of Government2semi/

    Government employees should0 without falling victim to any provocation0 continue to

    their duty honestly till some specific orders from the Panth. De are desirous of

    avoiding every kind of upheaval0 especially the destruction of -tate property and

    &natural( resources.

    The task of forming the Government of 

    Khalistan has )een left to its Prime +inister2President who will announce itsformation at the earliest. All -ikh political organisations are here)y directed to declare

    their concurrence and allegiance to

    Khalistan 0 and accord all possi)le help to make it a -uccess

    At this 'uncture0 every -ikh is duty/)ound to forege Panthak unity )y )rushing aside

    all kinds of differences.

    Social Structure

    The

    Khalistan will function on the lines of the Guru?s saying ;a) #ag Khalsa rahe niara0

    ta) lag te' doe main sara &so long as the Khalsa remains distinguisha)le0 I shall )estow

    full glory upon him(. 4o individual will )e allowed to e*ploit others &either

    economically or socially(0 particularly the )ackward village community. Profiteering0

     )lack/marketing0 adulteration0 and all such other offences and social ine:ualities will

    not )e tolerated )y the Khalsa0 which will also not allow mental retardation of any

    individual. 4o particular community or sect will )e allowed to impose selfish will

    ar)itrarily upon others through the medium of press0 writing0 education or other media

    of pu)licity.

    The constitutional arrangements will )e made for the religion to act as the custodian

    of -tate. The -ikh religion will )e the official creed of Khalistan. Further0 it will )e a

     paramount duty of the Government to see that -ikhism must flourish unhindered in

    Khalistan.

    The ,hief o)'ective )efore the political and administrative structure of the Khalistan

    will )e the welfare of humanity and social service0 as per the sayingC It is sinful to

    employ our hands and legs0 save in the service of others.

    !very -ikh0 male and female0 will )e guaranteed to develop and prosper to the )est of

    his or her a)ility. The lack of education or social )ackwardness will not )e allowed to

    stand in the way of progress. The monopoly of education with its feudalistic

    tendencies will also not )e allowed to )e used as a tool to deprive the uneducated of

    their rights 'ust as the way in which the children of the ur)an settlers and the rich0

    outmanoeuvre all the children of the poor village folk and en'oy the )ounties of nature

    much more than what is due0 while $n the other hand the children of the poor and the

    village people continue to remain )ackward from generation to generation due to

    illiteracy0 poverty and sickness. The Khalistan government would like to )ase the

    distri)ution of all natural resources upon the fulfilment of )asic necessities0 of life.

    Feudalism and capitalism will not )e allowed to influence the government machinery

    and the consciousness of the people. ,ontrary to it0 no limitation will )e imposed on

    any individual to prosper and flourish according to the )est of his wisdom0 la)our and

    a)ility.

    The people will )e associated fully with the administrative task and their participation

    will ensure that the red tapism will not re/emerge in Khalistan. At the village level0 the

    local men will )e associated with civil0 criminal0 development and 'udicial

    administration of various types so that the false witnesses and police touts may not kill

     'ustice )y concealing the truth. The association and involvement of the villagers will

     )e secured through more than one &it may )e two or three( tier systems to see thatopportunity for appeal and arguments may )e readily availa)le and at low cost.

    The policy of Khalistan will )e as per the Guru?s wish0

    -ar)at %a "hala &welfare of all( and a policy of encouraging a civilied life0 of

     promoting the sense of )rotherhood of mankind and a sense of involvement. The

    segregation of humanity )ased upon caste0 'ati0 )irth0 locality and colour will not )e

     permitted0 and such divisions will )e a)olished )y the use of political power.

    #ikewise0 such other cruel and distasteful practices ascri)ed to social/ine:uality0

    especially )etween -ikh males and females will )e removed through the use of political power.

    It will )e the first endeavour of 

    Khalistan to maintain cordial relations with its neigh)ouring countries.

    The

    Khalistan ,ommando Force is under the charge of General 6ari -ingh0 its

    ,ommander/in/chief. This force shall serve as the nucleus of future defenceorganisation of 

    Khalistan .

    The -ikhs living outside Pun'a) in India are here)y called upon to settle in Khalistan0

    so that they may not face any calamity such as the holocaust of 4ovem)er 1>=5. At

    the same time0 money/minded 6indus are here)y directed not to put hurdles in the

    way of Khalsa Panth.

    The -hahi Imam in %elhi0 -aiyyed +uhammad A)dulla "ukhari0 in his presidentialaddress at the -ikh -eminar on ?Dhy not Khalistan? held at ,handigarh on Fe)ruary0

    1>=10 while referring to the )loody massacre of -ikhs )y 4irankaris on 13 April0

    1>9=0 at Arnritsar0 had o)served that in the free India the +uslims had )een su)'ected

    to carnage )ut now the -ikhs too are )eing )utchered. This o)servation of the -hahi

    Imarn has proved to )e prophetic. The Indian Pun'a) Government has started the

    assassination of the Amritdhari &)aptised( -ikhs in Pun'a). The innocent -ikh youths0

    without )eing tried in the courts are )eing killed in fake police encounters organised

    regularly.

    The police chief of =50 the Government of India. under the

    cover of curfew0 )utchered the entire -angat gathered at %ar)ar -ahi) on the eve ofGurpur) cele)ration of -ri Guru Ar'un %ev ;i. Following this0 the armed forces

     )esieged all the Gurdwaras of Pun'a) and killed the -ikhs therein. -imilar curfew was

    imposed on more than 10@@@ villages of Pun'a) and Amritdhari &)aptised( -ikhs were

    hunted down and martyred. "efore starting this task of genocide of the )aptised -ikhs0

    the 6indu military officers and sepoys were mentally and emotionally e:uipped

    through their official +againe "at ,heet for the complete e*tinction of the -ikhs. It

    was clearly spelt out in the "at ,heet as to what were the distinctive marks of the

    Amritdhari -ikhs. It was mentioned that though outwardly they appear to )e innocent0

    yet in reality they &Amritdhari -ikhs( are murderous0 anti/national and e*tremists.

    Therefore0 it )ecomes the duty of every security personnel to inform their superiors of 

    the wherea)outs of any such Amritdhari0 -ikh they come across.

     4owhere in the history of the world0 such an action has )een taken )y any Army

    against the citiens of its own country.

    After this0 when Indira &Gandhi( was assassinated )y

    "eant )ullets 0 the 6indu Government of India0 the new Prime +inster0 in league with

    his political and other official associates2advisers0 e*ecuted the conspiracy of

    systematic killings of the -ikhs in %elhi for a num)er of days. This carnage has put to pale even the )loody carnage of 4adir -hah in %elhi.

    "hai A'it -ingh "ains0 e*/'udge0 Pun'a) and 6aryana 6igh court0 ,handigarh

    President of the !n:uiry ,ommittee constituted )y the "arnala Government0 while

    writing a)out the 1@@ false police encounters0 e*pressed surprise $ver the fact that in

    none of these encounters0 any police consta)le or an officer has )een shown as

    wounded0 nor any murder case has )een registered against police. It is )ecause in

    India0 the government functions as per the saying0 $ #alo0 falsehood is reigning all

    around. This shows the real meaning of "rahminical principles which proclaim that

    only

    Truth wins )ut practise falsehood. The singular aim of "rahminism is to e*terminate

    the -ikh religion root and )ranch )ecause the -ikh religion is inimical to the

    "rahminical principles of caste/system and )ipran ki reet &Karma system(.

    It is what was done )y -hankaracharya who secured the death of lakhs of "uddhist

    monks and destroyed their temples and other religious sym)ols )y the use of military

    forces. Although the "uddhist religion took its )irth in 6industan0 and it spread in far/

    flung countries like ,hina0 ;apan0 +alaya and "urma etc0 yet it was eliminated from

    its place of )irth i.e. India. This reflects the real meaning of the "rahminical motto of

    Ahimsa Paramo %harma. &4on violence is the supreme religion(.

    Presently0 Indian Government is following the policy of -hankaracharya0 determined

    to annihilate the -ikhs and -ikhism )y using all kinds of political0 cultural0 economic0

    administrative and military means. This is the real meaning of the &false( claims of

    "rahminism of preaching tolerance. In free India0 attempts are made to put cur)s on

    the minority communities2religions. The voices are raised in the Indian Parliament to

     put a )an on the conversion of the 6indus. A petition was made )efore Dest "engal

    6igh ,ourt to put a )an on the 6oly Huran of the +uslims.

    Attempts are made to secure a total annihilation of the -ikhs0 destruction of the -ikhreligious sym)ols through military force0 imprisonment of the Kirtani ;athas &signing

    groups(0 )y registering false cases against them and threatening the Granthis &readers

    of the religious scriptures( in every village and involving them in false cases too0 and

     putting then )ehind the )ars without trial. De have given details of already referred to

    the une:uivocal anti/-ikh policies of the Indian Government and the manner in which

    the Amritdhari -ikhs0 the products of hard la)our of the -ikhism propagation of are

     )eing made the targets for elimination through the methods as enunciated in the "at

    ,heet.

    The Government has already e*hi)ited its anti/-ikh attitude )y depriving the -ikhs ofthe fundamental rights through false propaganda of declaring the -ikhs as e*tremists0

    murderers and traitors. It has )een :uite successful in concealing the facts from the

    world through its use of political power. To achieve this aim0 there is censorship and

     )an on0 the entry of foreign correspondents and newspaper editors in Pun'a) since

    1>=5. If any organisation or individual reported anything concerning the misera)le

     plight and annihilation of the -ikhs0 it2he incurred the wrath of the government which

    stuck like a thunder)olt.

    As a result of the false propaganda of the government0 the -ikhs had to suffer several

    hardships even in the countries known as the champions of civil

    countries known for supporting the cause of human rights0 for every kind of desired

    help0 supply0 assistance and sympathy. De appeal for similar help to the .4.$. De

    shall0 ever feel grateful to the neigh)ouring countries which sympathise with our

    cause during our hours of )eing in crisis. De are also grateful to those -ikh ladies andgentlemen living a)road who have espoused our cause. If they so desire0 we are ready

    to offer the Khalistan citienship to the -ikhs living a)road.

    The five mem)er Panthak ,ommittee appeals to all the -ikhs not to loot arms and

    ammunition or other items from the -ikh houses. It also appeals to the -ikh -angats to

    help in every possi)le manner those -ikh ladies and gents who are engaged in fighting

    for the cause of the formation of Khalistan since the &real( forte of the -ikhs are the

    -ikh -angats.
