Subj: EXTRAJUDICIAL PUNISHMENT/KILLING

Dear Congressman Alan Lowenthal,

My name is Oliver B. Mitchell III, I’m a U.S. Veteran and former U.S. Department of Veterans Affairs employee turned whistleblower. I’m writing you today, regarding ongoing events surrounding my “prior” whistleblower activity.

On Monday, July 6, 2015, I received notice from Congresswoman Bass and Congressman Calvert regarding my recent contact with their office. Both members have instructed me to urgently contact you and have provided written notification that they have contacted your office on my behalf.

I write you today, not motivated by any political party, agenda or ideology but out of a genuine interest in finding a solution to our problem.

As previously stated before, my complaints were meant to address systemic employment, mismanagement and fraud, waste and abuse issues within the Greater Los Angeles VA Medical Center.

Page 2: Congressman Alan Lowenthal

It has come to my attention, that on October 24, 2011, your precedssor, Congresswoman Laura Richardson, along with 29 other House of Representative members signed and delivered a letter to the Government Accountability Office requesting an investigation into “the difficulty in scheduling healthcare appointments within the Greater Los Angeles Healthcare System.”

As you may be aware Congressman Lowenthal, those allegations to include the material evidence was derived and obtained from my legal and lawful complaints that were submitted to Chairman Miller on January 7, 2011. Additionally, their letter, page 2-3 request that the Government Accountability Office “include recommendations both administrative and/or legislative, to shorten the claims processing time and improve customer services (i.e. access to healthcare, status updates and other interactions with veterans who enlist VA services, etc.) at the VA Los Angeles Regional Office and within the Greater Los Angeles Healthcare System, as well as recommendations on best practices that could be administratively institutied in both instutions.”

Their letter “request a study into the issues plaguing America’s veterans while providing only administrative and/or legislative recommendations.” As you may be aware Congressman Lowenthal, their letter and study into my allegations and overwhelming evidence is what led to the current national scandal in todays headlines. Is it possible, that this letter, along with the 30 members of Congress who signed this letter, used this opportunity as a means to attack the President and his signature healthcare law known as The Affordable Care Act or Obamacare. As a result of the Legislative Branch attack against the President, I and my ex-partner have been and continue to be attacked by the government in response.

Congressman Lowenthal, my allegations, subsequent complaints and material evidence was not intended to be used as a “weapon of mass destruction” against President Obama and Obamacare, rather it was a legal and lawful complaint meant to address systemic issues within the nations largest VA medical center.

In response to my previous communications to you I have yet to hear back from you and have yet to receive any assistance from your office. On more than one occasion I have written to you regarding my allegations of systemic reprisal, retaliation, intimidation and vengeance due to my prior EEO and Whistleblowing activity.

Since, I have yet to hear from your office, there have been additional occurrences of retaliation and targeting.

I understand your time is valuable and I appreciate your time and assistance regarding this matter. However, in an effort to convey the gravity of the situation I have itemized several events and offer you an opportunity to examine any evidence upon request.

Before we begin I would like to take a moment and highlight the following:

The act(s) of Extrajudicial Punishment, Extrajudicial Killing and Extrajudicial Murder violates all International, Constitutional and all U.S. Statue laws.

Article 3 of the United Nations, Universal Declaration of Human Rights states:

Everyone has the right to life, liberty and security of person.

Article 6 of the International Covenant on Civil and Political Rights states:

Every human being has the inherent right to life. This right shall be protected by law. No one shall be arbitrarily deprived of his life.

Common Article 3 of the four Geneva Conventions states:

The passing of sentences and the carrying out of executions without previous judgment pronounced by a regularly constituted court, affording all the judicial guarantees which are recognized as indispensable by civilized peoples are prohibited at all times under all circumstances with no exceptions.

The Fifth Amendment under the U.S. Constitution states:

No person [shall] be deprived of life, liberty, or property, without due process of law.

18 USC 1111 – Murder states:

Murder is the unlawful killing of a human being with malice aforethought.

On June 4, 2008, Mary Moore, Chief, Employee and Labor Relations, Greater Los Angeles VA Healthcare System instructed myself to record, document and file as subsequent complaints all activity within the West Los Angeles VA Medical Center Radiology Department. EVIDENCE AVAILABLE

On March 24, 2009, I filed a whistleblower complaint with the VA Office of Inspector General. I reported that Interim Service Chief, Dr. Suzie El-Saden had instructed me to destroy medical requests for MRI and CT scans in an effort to reduce the VA’s ten year patient appointment backlog. My OIG complaint also alleged that VA Officials prevented patient access, falsified documents and cancelled patient MRI appointments without notifying the patient of the cancellation. EVIDENCE AVAILABLE

On March 7, 2010, per the OIG, I filed an additional complaint while providing documentation to substantiate alleged misuse of Official Time and Timecard fraud as evinced in Ms. Moore’s communication to me on June 4, 2008. EVIDENCE AVAILABLE

3

Page 4: Congressman Alan Lowenthal

On April 14, 2009, I filed an EEO complaint alleging discrimination and reprisal for whistleblowing on the basis of race, color, gender, sexual orientation and hostile work environment. EVIDENCE AVAILABLE

On June 4, 2009 I filed a whistleblower complaint with the U.S. Office of Special Counsel.

On November 24, 2009, I filed an “Unfair Labor Practice Charge” against Donna Beiter, Director, Greater Los Angeles VA Medical Center for violations of unfair labor practices, discipline and adverse actions, employee rights, investigations and official records. EVIDENCE AVAILABLE

On November 22, 2010, Lisa K. Holliday, VA Agency Counsel, Mary Moore, Chief, Employee and Labor Relations, Judge Dianne Gross, Administrative Law Judge, EEOC, Andrew Schwartz, Attorney at Law, for Oliver Mitchell and myself met during an Administrative Hearing to discuss the agency’s EEO complaint. During the hearing Ms. Moore stated “she would like to put me on Disability Retirement due to my illness.” Ms. Holliday stated “she would like to put me in jail for whistleblowing.” Judge Gross stated “Mitchell’s complaint was a waste of taxpayer money and time. She continued saying “She was moved to remove race from the complaint as she didn’t see any racism or discrimination.” Mr. Schwartz, private attorney, dropped me as a client saying “I was too smart to be black and he questioned how I learned to read and write.”

On January 7, 2011, I motioned the EEOC to re-amend my complaint to include race as originally stated. EVIDENCE AVAILABLE

Also, on January 7, 2011, I wrote to members of both the House and Senate Committee on Veterans Affairs. I provided a black, three ring binder that contained highly detailed information to substantiate my allegations of manipulated data, fraud, waste and abuse. I also provided documentation to support my allegations of “medical targeting” to include information to corroborate my allegations of “attempted murder” as retaliation for whistleblowing. EVIDENCE AVAILABLE

I have itemized those complaints for you:

1. Veterans Affairs EEO Case No. 200P-0691-2011-1019032. Veterans Affairs EEO Case No. 200P0691-2013-1026723. Equal Employment Opportunity Commission Case No. 480-2010-00106X4. Office of Special Counsel Case No. MA-09-26585. Office of Special Counsel Case No. MA-13-22796. Office of Special Counsel Case No. DI-13-22707. Office of Inspector General Case No. 2009-03767-HL-09818. Federal Labor Relations Authority Case No. SF-CA-10-0092

As a result of whistleblowing, EEO activity and Union Labor activity, the VA West Los Angeles Medical Center engaged in “medical targeting” from the period of March 31, 2009 to March 15, 2011.

Seven days after I filed my VA OIG complaint, Dr. Kevin Booker, Clinical Psychologists contacted me saying:

I must admit however, that I was very much looking forward to meeting you. I did re-arrange some things in my schedule to accommodate you this morning as I recognize how important this matter is to you. Maybe you could just stop by for a few moments and say hello? EVIDENCE AVAILABLE

On September 9, 2009, I emailed agency officials stating:

My Primary care provider has been changed without my advance written consent. Appointments have been made without my prior approval and consent. I have received several phone calls and voicemails stating I'm to contact the Mental Health Clinic for an appointment. EVIDENCE AVAILABLE

On December 17, 2009 after I refused the agency's request for a "mental health" evaluation, the agency retaliated against Mitchell by using his healthcare against him and ordering a surgery to "remove" his tonsils. EVIDENCE AVAILABLE

On September 1, 2010 VA Physicians entered a medical note within my VA medical record stating:

Mild Bronchial prominence. "Questionable small lymph nodes."

The medical note continued saying:

39 yo Black or African American male here for evaluation. Bronchiectasis seen on CT chest by Pulmonary review, differential diagnosis includes Alpha 1 Antitrypsin deficiency versus ABPA versus IgA Immunodeficiency versus Chronic Bronchitis versus Klinefelters Syndrome versus Cystic Fibrosis variant. EVIDENCE AVAILABLE

Congressman Lowenthal, there is no history of cancer or any of those diseases in my family.

As a result of the “medical targeting” I stopped my healthcare at the West Los Angeles VA Medical Center because of the medical mishaps and I started going to the Long Beach VA instead. However, things became progressively worse while being treated at the Long Beach VA.

While preparing this letter you for, I discovered that both the West Los Angeles and Long Beach VA Medical Centers have been investigated for performing non-consensual medical research and experiments on veterans.

5

Page 6: Congressman Alan Lowenthal

Additionally, Patient Rights, Responsibilities, and Denial of Rights, GLA Policy, 00-EI-12, Page #2, dated July 2004 states all patients will have “access to information regarding any human experimentation or research/education projects affecting his/her care.” EVIDENCE AVAILABLE

Congressman Lowenthal, I never gave the VA, NSA, FBI, CIA nor the Military Industrial Complex my consent whether written or oral, permission to perform any medical, experimental, or military grade experiments or research on my persons. It is my strong opinion that these acts have occurred and have been done so out of retaliation.

While preparing this letter for you, I came across an article titled “Blowing the Whistle: A Pharmacists Vexing Experience Unraveled: In the Beginning.” In that article the pharmacist’s recounts his experience and having read that article I see an emerging and continuing pattern.

In 1993, this pharmacists followed his chain of command to report “violations of cancer research. Some patients had been placed in research studies without informed consent.” The purpose of the “secret” studies were to “secretly collect outcomes data.” EVIDENCE AVAILABLE

Congressman Lowenthal, this story is important as it contains several key events that occurred to this whistleblower as it has happened to me some 10 years later. I employ you to take the time and read this article.

Also, The Government Accounting Office (GAO) published and released HRD 86-56 "Drug Company-Sponsored Research at VA Medical Facilities."

The report highlighted:

In response to a congressional request, GAO reviewed drug companies' medical research activities in Veterans Administration (VA) facilities. The review included:

1.  Examining VA research involvement with drug companies.

2.  Determining whether the VA practice of using drug company donations for medical research violates federal prohibitions against an agency supplementing its appropriations.

3.  Reviewing VA procedures concerning financial controls imposed on investigators conducting such research.

4.  Determining whether VA recovers all costs of performing drug company-sponsored studies.

5.  Reviewing VA investigations of allegations involving drug company funded research at the VA Medical Center in Long Beach, California.

6

Page 7: Congressman Alan Lowenthal

The VA plays a major role in the medical research.  The VA spends nearly $1 billion a year on about 15,000 studies involving 150,000 patients.

On April 13, 2003 the New York Times ran "Nationwide Inquiry at Veterans' Hospitals" and reported that the Long Beach, California VA Medical center was under investigation for "deaths of patients in research projects." EVIDENCE AVAILABLE

See story here:   http://www.nytimes.com/2003/04/13/national/13VETS.html

On March 25, 1999 the New York Times ran "V.A. Hospital Is Told to Halt All Research" and reported that the Department of Veterans Affairs had suspended research at the Los Angeles VA due to a "failure to meet ethical guidelines in human experiments."

Per the New York Times:

After six years of investigations and temporary suspensions, the hospitals and clinics of the Veterans Affairs of Greater Los Angeles Health Care System -- including the West Los Angeles Veterans Affairs Medical Center, one of the nation's largest research hospitals -- were ordered on Monday to halt all of their animal and human experiments. The order will go into effect on Friday. EVIDENCE AVAILABLE

See story here:  http://www.nytimes.com/1999/03/25/us/va-hospital-is-told-to-halt-all-research.html

Congressman Lowenthal, this is no coincidence that the same hospital I blew the whistle on would engage in performing experiments on me as a means of retaliation. This is a continued pattern of abuse and neglect for human life.

If they did this to me because I'm a whistleblower, than how many other veterans have they done this too also?

Dr. John H. Mather, (former) agency chief of the VA’s Research Compliance office said: "The rules are important. They reflect the ethical underpinnings for the conduct of research, the need to treat other human beings with dignity and respect."

On March 15, 2011, I informed Lisa K. Holliday, VA General Counsel that VA doctors had informed me I had “cancer” as a result of “medical targeting” and as a result I had decided to accept the agency’s settlement offer in protest. EVIDENCE AVAILABLE

From January 1, 2010 to March 18, 2011, as a result of sudden medical illness from an “uncertain etiology” I used 244 hours of Annual Leave, 104 hours of Sick Leave and 775 hours of Leave Without Pay. EVIDENCE AVAILABLE

7

Page 8: Congressman Alan Lowenthal

On March 18, 2011, I entered into a settlement agreement with the VA in exchange for my immediate resignation. Donna Beiter, Director, had demanded I resign in exchange for the $30,000 payment in which I deemed it to be a “constructive discharge.” EVIDENCE AVAILABLE

After my resignation, I relocated to Mobile, Alabama, where from the period of April 14, 2011 to January 2013 I was politically targeted for whistleblowing. I have highlighted some of the events below:

1. You don’t have to worry about him he’s crazy isn’t he?2. We need to get you out of here.3. Are you two the only ones that know?4. I bet you won’t do that again.5. When he kills you make sure you put it in your will.6. I can understand the family tie that’s why I’m in Arizona just don’t go back to

Alabama.7. You will die in a drone strike.8. Nobody knows you, no one knows who you are, who’s going to miss you?9. I know you love him but forget about him.10. Frightening to think Christopher Dorner could be you.11. I will fucking destroy. EVIDENCE AVAILABLE12. When you move out here don’t stand to close I don’t want to get caught in the

crosshairs when they shoot you.13. If I save him I will save myself too. EVIDENCE AVAILABLE14. My peoples down here are the law. We will lock your “nigga” ass up. EVIDENCE

AVAILABLE15. Where did a “nigga” like you learn to read and write?16. Who told you to do that?17. Nigga we are going to kill you.18. Nigga you better not say nothing.19. You know what I don’t know, I don’t see how it could because they keep dragging it

out, they keep pulling you in, I mean they’re not letting you go. We’ve talked about it before, they want to get rid of those other people that did it but they gotta use you to be the one that can justify, that can give them the evidence they need to get rid of those people I guess? Why pull you in unless they wanna pull you in to get rid of you because you knew it, but, if it’s all put out in public so what? Why hurt you? Why get rid of you? It’s gonna be known anyway. EVIDENCE AVAILABLE

20. I don’t know, I don’t know why you were picked. I sit in amazement I wish I could, actually I don’t wanna know. I don’t wanna be there when I’m gonna hear them tell me, here’s this person let me tell you what were doing to him, but then I wish I could hear it so I could go hey, hold up we gotta stop this. EVIDENCE AVAILABLE

8

Page 9: Congressman Alan Lowenthal

21. If I changed my name and ssn I would die as that person, so is that even something you would consider. EVIDENCE AVAILABLE

22. You’re a target just go ahead and paint a sign on yourself. EVIDENCE AVAILABLE23. Now it could just be two separate things but I don’t know it just seems too

coincidental. I can’t say the VA doesn’t have anything involved there are too many coincidences there. EVIDENCE AVAILABLE

24. The VA is getting away with murder. EVIDENCE AVAILABLE25. You should get a passport and try it out immediately. EVIDENCE AVAILABLE26. If it were me I would’ve paid you, let you go and hoped I never heard from you

again. EVIDENCE AVAILABLE27. Rest assured that was not me telling you to run and hide. Sorry about your recent

troubles and your health. EVIDENCE AVAILABLE28. We checked our records and have determined that his concerns have been

investigated and his allegations have not been substantiated. EVIDENCE AVAILABLE

29. Oliver just fuckin kill yourself and stop whining like a bitch. EVIDENCE AVAILABLE30. Booo hoo, I have no relationship because the VA is following me. EVIDENCE

AVAILABLE31. Paranoid fucktard. EVIDENCE AVAILABLE32. You aint no American. EVIDENCE AVAILABLE33. You’re an Anti American Leftist traitor that exposed bad things about the USA and

you must be jailed for life. EVIDENCE AVAILABLE

As a result of the continued targeting and retaliation, on August 30, 2013, I again wrote to the Committee on Veterans Affairs, Subcommittee on Oversight and Investigations requesting assistance for this matter. EVIDENCE AVAILABLE

As a result of financial hardship, agency blacklisting and unemployment, due to targeting, on October 29, 2013, I was “forced” to seek shelter with the SRO Housing Corporation, Veterans Transitional Program located in the Downtown Los Angeles, Skid Row area. To date, I have yet to secure permanent housing and despite the President’s initiative to offer all homeless veterans HUD/VASH Section 8 housing I have yet to secure that either. On more than one occasion I have reached out to the Greater Los Angeles VA Medical Center for assistance but have yet to receive an official response.

It is my opinion that the VA is using this nonprofit shelter as a means to secure my persons, which is against my constitutional right.

9

Page 10: Congressman Alan Lowenthal

As a result of medical targeting, I have experienced severe and sometimes debilitating health issues. For example:

1. I’m experiencing hair loss.2. I have experienced skin lesions. EVIDENCE AVAILABLE3. I have experienced blood loss/ defecation of blood. EVIDENCE AVAILABLE4. I require the assistance of a breathing machine better known as a CPAP machine.

EVIDENCE AVAILABLE5. I have experienced tooth decay and now require upper teeth known as dentures.

EVIDENCE AVAILABLE6. I have been informed I’m suffering from radiation poisoning.7. I’m experiencing severe headaches.8. I’m experiencing servere ringing in the ears.9. I’m experiencing severe dehydration.

Congressman Lowenthal, the medical targeting both I and my now ex-partner are experiencing, is similar and consistent to what government insiders have informed me to be the results of “unconsented/ non-consenual human subject research.” I have most recently received information from an anonymous source claiming to be a VA insider.

Based on their tip, I have been provided with information that suggest both I and my ex-partner have and continue to be a unconsented human research subjects for the VA and DoD.

As a result of this tip, I performed a cursory review of my VA health records and have found more than enough evidence to substantiate this new allegation.

If this allegation is proven to be true, than the U.S. Department of Veterans Affairs and the U.S. Department of Defense have violated the protocols put in place by VHA Handbook 1200.05, the Requirements For The Protection of Human Subjects in Research, dated November 12, 2014.

Per the handbook, Page 2, e., states “VHA does not conduct planned emergency research (see 21 CFR 50.24) or classified research involving human subjects.” However, it has come to my attention that the VA and DoD are engaging in research upon myself as a result of whistleblowing.

Additionally, I have been provided with evidence to suggest that we are being targeted by Directed Energy Weapons. I have been provided with a now unclassified document that outlines and details the “bioeffects of selected non-lethal weapons.” As conspiratorial as it may sound Congressman Lowenthal, I didn’t belive it at first myself, until I actually compared the report with the physical evidence contained within my VA medical records and subsequent complaints.

10

Page 11: Congressman Alan Lowenthal

Per the report, Page 5, Possible Influence of Subjects states “If the technology functions approximately as envisioned, the targeted individual could be incapacitated within 15 to 30 minutes. Because this technology is focused on a relatively slow onset, it should only be used in situations where speed is not important. The very uncomfortable  nature of a high body temperature may be useful in negotiations or possibly for controlling crowds.  It would be equally useful on single persons or crowds. Evidence also indicates a disruption of working memory thus  disorientation may occur because of all inability to consolidate memory of the recent (minutes) past.”

As you may be aware Congressman Lowenthal I have written extensively about the practice of “targeted individual” and I have discovered that many other veterans are providing in great length and detail stories and accounts of being targeted similar to this.

Per the report, Page 11, Possible Influence on Subjects states “If the technology functions approximately as envisioned, the targeted individual could be incapacitated very quickly.  Because there have been no reported studies using the conditions specified, experimental work is required to characterize onset time. Different types of technologies could be employed to influence wide areas or single individuals. Because this technology is considered to be tunable, the influence on subjects could vary from mild disruption of concentration  to muscle spasms and loss of consciousness. The subject(s) would have varying degrees of voluntary control depending on the chosen degree of incapacitation.”

As you may be aware Congressman Lowenthal I have written and documented the growing number of death threats associated with my whistleblower disclosure and I find that the information provided to me by insiders to be creditable and true.

Lastly, per the report, Page 1, states “The studies have suggested possible adverse effects on human  health (e.g., cancer, reproduction, etc.).” Both issues are clearly documented within my VA health record and correspond with my allegations of medical targeting after I blew the whistle. Additionally, my ex-partner has brain tumors that have been affected by these troublesome events.

Again, Congressman Lowenthal I have extensively written and provided an abundance of evidence to substantiate my allegations of research. However, in light of this new found report I'm in conclusion that the nations largest VA medical center is engaging in human subject research despite repeated sanctions, hearings and loss of funding.

Congressman Lowenthal, even though these acts did not occur on your watch, as the representative for the 47th district I employ you to investigate this matter and use the power of your office and your pen to remove these human rights abusers from within the agency.

As a result of targeting, in the last 4 years, I have dropped out of three different college universities.

11

Page 12: Congressman Alan Lowenthal

As a result of targeting, I have lost two minority and veteran owned businesses that supported my family.

Congressman Lowenthal, please understand this has been an eight year ordeal for myself and my family. When the record of events is viewed in its entirety, one can easily deduce these events to “extrajudicial punishment.”

An Extrajudicial Punishment is defined as punishment for an alleged crime or offense carried out without legal process or supervision from a court or tribunal through a legal proceeding.

Extrajudicial Punishment is often politically motivated and is often a feature of a politically repressive regime. In many cases individuals or groups deemed threatening or even simply undesired to the government may be targeted for punishment by a regime or its government representatives.

Another form of punishment is to punish a victim but under the circumstances that make it appear as self defense or suicide. In such cases, that can potentially cross the line into Extrajudicial Murder.

A “disappearance” occurs where someone who is believed to have been targeted for Extrajudicial Execution does not reappear alive. Their ultimate fate is thereafter unknown or never fully confirmed.

Extrajudicial Punishment may be planned and carried out by a particular branch of state without informing other branches, or even without having been ordered to commit such acts. Other branches sometimes tacitly approve of the punishment after the fact. They can also genuinely disagree with it, depending on the circumstances, especially when complex intragovernment or internal policy struggles also exist within a state's policymaking apparatus.

Congressman Lowenthal, when the record is viewed as whole, the record further suggest an extrajudicial killing.

An Extrajudicial Killing is defined as the killing of a person by governmental authorities without the sanction of any judicial proceeding or legal process.  Extrajudicial punishments are mostly seen by humanity to be unethical, since they bypass the due process of the legal jurisdiction in which they occur. Extrajudicial killings often target leading political, trade union, dissident, religious, and social figures and may be carried out by the state government or other state authorities like the armed forces or police. One of the most recent issues regarding extrajudicial killing has been the debate about the legal and moral status of targeted killings by the United States.

12

Page 13: Congressman Alan Lowenthal

Some define extrajudicial killings more broadly than U.S. government sanctioned actions. For example, some Americans feel that the number of high-profile cases of killings, especially of black and Latino males, by law enforcement and other armed individuals in the U.S. are extrajudicial and reflect an epidemic problem.

Congressman Lowenthal, I have broken no laws. My allegations were submitted through proper channels in accordance with U.S. laws. Therefore, I must ask. Why am I being punished and targeted?

When the record is viewed in its entirety it leaves one with an impression of extrajudicial killing. Therefore, I must ask, Congressman Lowenthal, am I to die for the United States of America? Is this because I’am a whistleblower or is this because I’am black or is this because at the time agency officials instructed me to blow the whistle I was a registered Republican?

As heinous and criminal as targeting may be. Did you know that the U.S. Department of Justice routinely collects data from victims of “Organized Stalking of Targeted Individuals?”

Reports indicate that there are five known aspects of organized stalking of targeted individuals:

1. High frequency of attacks and long term duration of attacks.2. Use of variety of known physical and psychological Cointelpro techniques, to include

electronic harassment and biological attacks with viruses and other agents.3. Professional unforced house entry.4. Law enforcement refusal to protect targets, investigate or prosecute.5. Covering up the crime with torture tactics created to appear so unbelievable that

bogus “mental illness” is used to discredit targets, or so well disguised that the induced “mysterious illnesses” neutralizes the target.

In September of 2012, the DOJ released an updated report titled “Stalking Victims in the United States.” However, the report was based on the results from the 2006 questionnaire “Supplemental Victimization Survey (SVS)” used for the DOJ’s 2009 report.

Most importantly, all of the DOJ’s reports have relied on information from the “National Crime Victimization Survey (NCVS)” data for which was collected from 1973-2011.

The Stalking Victimization Survey (SVS) measures the following stalking behavior:

1. Making unwanted phone calls.2. Sending unsolicited or unwanted letters or e-mails.3. Showing up at places without legitimate reason or act of stalking across state lines.4. Following or spying on the victim.

13

Page 14: Congressman Alan Lowenthal

5. Waiting at places for the victim.6. Leaving unwanted items, presents, or flowers.7. Posting information or spreading rumors about the victim on the internet, in a

public place, or by word of mouth.

Again, I say, I have broken no laws and unlike Edward Snowden, my complaints were submitted through proper channels in accordance with U.S. laws. Therefore, I ask, why has the nation’s largest VA Medical Center selected me for targeting and why am I being punished?

As one of the nation’s policy makers you cannot ignore the harm and counterproductive impacts of these actions. Someone is responsible for “developing, carrying out, advising and implementing” this lawless behavior towards me.

Living under these circumstances presents a constant worry that at any moment the United States may carry out an extrajudicial killing and having the knowledge that I may be powerless and without due process to protect myself. These fears have affected behaviors.

I’m not a national security threat, a traitor to democracy or a war criminal. Therefore, I ask, why am I being punished?

It’s ironic that we are discussing targeting and extrajudicial killing. On March 28, 2007, the United Nations condemned the United States “in response to reported incidents of extrajudicial killings.”

In its report, the United States was quoted as saying “The UN Human Rights Council and all other international human rights accountability mechanism have no legitimate role to play when individuals are “intentionally” killed, so long as it is claimed that the actions were part of the War on Terror.

In this instance, I’m no enemy combatant or war perpetrator. Therefore, why am I being punished as an enemy combatant on U.S. soil?

The statement of “nobody knows you, no one knows who you are, who’s going to miss you?” is an example and an alarming incidence of extrajudicial killings and unexplained disappearances/abductions of private citizens without anyone being held accountable.

As part of the judicial institution whose power is drawn from the pen, it is policymakers like you, who are here to ensure America’s constitution is followed.

14

Page 15: Congressman Alan Lowenthal

For the 112th Congress, 2nd Session, former Representative Kucinich introduced H.R. 6357, a Bill to “prohibit the extrajudicial killing of United States citizens, and for other purposes.” On February 3, 2010, Congress learned of the “policy of including United States citizens on lists of people to be “assassinated” maintained by the Central Intelligence Agency (CIA) and the Joint Special Operations Command (JSOC). EVIDENCE AVAILABLE

Executive Order 12333, relating to U.S. Intelligence activities states “No person employed by or acting on behalf of the United States Government shall engage in, or conspire to engage in, assassination.”

In H.R. 6357, Congress stated “Due process of law is a fundamental right of the United States Constitution, the United States has a commitment to uphold and defend the rights included in the Bill of Rights, and no United States citizen, regardless of location, should be “deprived of life, liberty, property, without due process of law as stated in article XIV of the Constitution... The participation in, or planning of activities, by the United States Government that result in the extrajudicial killing of a United States citizen undermines the rule of law and the moral standing of the United States in the world... The notion that the constitutional rights of one citizen can be revoked to protect the constitutional rights of other citizens should be rejected... It is in the best interest of the United States to respect the rule of law and set the example for upholding the principles of international and domestic law…

No one, including the President, may instruct a person acting within the scope of employment with the United States Government or an agent acting on behalf of the United States Government to engage in, the extrajudicial killing of a United States citizen.”

Again, I say, I’m not a national security threat, a traitor to democracy or a war criminal.

Why am I being punished?

In the U.S. it has been said that victims have an affiliation with lawful activist or leftist movements and political parties (including labor, journalism, women’s rights, and peasants, environmental and other sector/issues). This is evinced in the statement of “You’re an Anti American Leftist traitor that exposed bad things about the USA and you must be jailed for life.”

Again, I say, it is policy makers like yourself who are entrusted by the American people to ensure the laws of this land are followed and protected. Surely, we can say, in this instance the laws of the land have been broken.

Lastly, Congressman Lowenthal, I must ask, is all of this simply because I’am BLACK?

For your reference I have attached the VA GAO letter dated October 24, 2011 and the now unclassified Army Document for your review. Based on the foregoing, there is a clear and evident pattern that highly suggest extrajudicial punishment and/or killing.

Congressman Lowenthal, I, nor my ex-partner, nor our families should be paying the price for a political attack against President Obama by the Legislative Branch. As unfortunate as this situation may be, it has left me with no other option than to blow the whistle in the manner in which I have. I’m sure all things considering you would do the same if it meant protecting and keeping your famiy safe.

I thank you for your time and attention to this matter.

Sincerely,
