of its member in seamanship. To fulfill this purpose for all members, the Club provides: (a) facilities—clubhouse, slips, launching ramps, boat parking, dry racks, marine railway, boat lift, picnic areas, swimming area, and lockers; (b) racing equipment— race committee boat, mark setting and safety boats, course markers, and other needed race materials; (c) sailing instruction—sail camp, instructional seminars, courses in water safety, practice sessions and orientation sessions; (d) social events include an annual banquet, dinners and parties to celebrate holidays and club Regattas; (e) racing activities including fleet races, Club regattas, and invitational regattas; (f) cruising events ranging from moonlight sails or overnight trips to Tellico Lake, to a week-long cruise to Watts Bar Lake. The Concord Yacht Club (CYC) holds membership in the United States Sailing Association (USSA), the Dixie Inland Yacht Racing Association (DIYRA), and Yachting Club of America. Races are conducted in accordance with USSA and DIYRA rules. To assist in the enjoyment of sailing and the promotion of sailboat racing, members are organized into racing fleets according to the classification of the boat. CYC was incorporated on October 24, 1951, under the laws of the State of Tennessee and is governed by a Board of Directors elected by the members at an annual meeting. Activities of the Club are administered through delegating responsibility to individual members and appointed committees. The Club leases its site from Knox County. All Club facilities have been built and maintained by Club members. Use of Club facilities is limited to members or guests of members, except in the case of invitational regattas or small groups who have received approval from the Commodore or Board of Directors consistent with Club policies. Club facilities are strictly limited to use by sailboats only. CYC is operated through its officers, directors, and committees. The Board of CYC will make every effort to keep the membership informed about the activities of the Club. The “Luff Letter,” the monthly newsletter, is the official communication, excepting the Annual Meeting. It is your obligation as a member to keep yourself informed of the problems and projects of the club, to attend the Annual Meeting at which the officers and Board are elected and annual plans are communicated, to attend work parties, and to carry out committee duties which may be assigned to you. Do not hesitate to volunteer your assistance on any additional projects or jobs around the club. The joint effort and cooperation of everyone is essential to the successful operation of our club. Do your part.

Membership is open to persons who meet CYC membership requirements stated in the By-Laws. Membership involves a number of responsibilities, including financial obligations, service on race committees, minimum work requirements, and participation in other Club activities. Club membership also provides a number of privileges related to the use of Club facilities and participation in all Club social, racing, and instructional activities. Articles for The “Luff Letter” must be received by the 25th of the month preceding anticipated publication month. CYC maintains a Website at www.concordyachtclub.org. This site is a source of information regarding the club’s activities, racing results, mooring and docking applications, current and past Luff Letters, Board Meeting minutes, and membership application. Some sections can only be accessed by members, such as the Forum, in this section members can follow and participate in various topics of interest to other club members. Members may choose to join the club’s mailing list to post and receive information relevant to the club and sailing. See the website to join.

E. History “In the infant town of Knoxville the houses are irregular and interspersed. It was a country court day when I came. I saw men jesting, singing, swearing, and women yelling from the doorways. Whiskey and brandy were cheap. The town was confused with a promiscuous throng of every denomination, blanket-clad Indians, leather-clad woodsmen, gamblers hard-eyed and vigilant. I stood aghast. My soul shrank back to hear the horrid oaths and dreadful indignities offered to the supreme governor of the universe. There was what I never did see before on Sunday, dancing, singing, and playing of cards. It was said by a gentlemen of the neighborhood that the devil has grown so old that it renders him incapable of traveling and that he has taken up in Knoxville and there hopes to spend the remaining part of his days…as he believes he is among friends. Among the sailing community, more than two hundred years later, jesting, dancing, laughing, singing, joyful yelling, and lightheartedness remains active on the Tennessee at Fort Loudon Lake. Organized sailing began on Fort Loudon Lake about 1947 under the auspices of the Oak Ridge Power Squadron with a fleet of four or five Sunray sailboats skippered by Oak Ridge’s Lockhart, Stevens, McDonald, Nicholson, and Stewart. They launched at Concord Boat Dock, lowering masts to clear the Northshore

Drive Bridge. Several years, later moorings were set “outside” of Concord Park. The first race was recorded as taken place on June 19, 1948. The fleet was enlarged by addition of an aluminum boat, a Snipe, and Gus Angele’s Seagull. The first Annual Awards Banquet took place at the historic Park Hotel in Clinton with Charles Asmanes winning the cup for overall high score for the season and Lockhart the Sunray trophy. In 1949 the first woman skipper joined the fleet, followed by Girl Scout Mariners with a Comet under the leadership of Frances Gilliam. Three more fleet members added a Lightning, a scow, and another aluminum craft. In 1950, Reg Gwin purchased a Thistle sailboat kit and was followed immediately in the purchase of Thistle kits by Bill Johnson and Jones Smellage with co-owners Don Hansket and Alfred Sanford. These five people chartered Thistle fleet #45 in 1951. The Concord Yacht Club was incorporated in October 1951 as a non-profit Tennessee Corporation located on property acquired by TVA in association with the Loudon Dam Construction Program and these same five people signed its charter. The club continues on the same site today. Prior to that time the site was used as a seaplane school, which included a Quonset hut that was used for a clubhouse, and a seaplane ramp. TVA later donated the property to Knox County for recreational use from which CYC now leases the property. The year of the Club’s 50th anniversary a new clubhouse was constructed. Thistle sailors remain active in the club, providing 13 of the first 25 Club Commodores. The first Thistle Regatta was held in 1952 and named the Admiral Farragut Regatta in 1957. The famous Admiral, born in the Knoxville area, achieved fame in the Civil War for his words, “Damn the Torpedoes, Full Speed Ahead.” The Thistle fleet now includes several restored Thistles sailed by youth sailors of Sea Scout Ship 300, which began March 18, 2002 under the initiative of George Hubbell, a Thistle sailor of many years. Volunteer efforts of the founders and generations of subsequent members have since added docks, moorings and other facilities. In 1964 indoor restrooms were constructed and a porch connecting the restrooms to the Quonset hut was covered. The front porch was extended, and the porch with the grill was added in 1969. The restroom building was replaced in 1992. In 1972, the “Bob Brown Memorial Mast” was erected in memory of Bob, who served as Commodore from 1962 to 1964. Replacement of the Quonset hut and porches began in the fall of 2000. Members commissioned the new clubhouse with its

expansive veranda on April 21, 2001. Each year new facilities and improvements to the clubhouse, docks, and grounds are made by the club’s membership working together. As much as possible of the club’s maintenance and construction is produced by members volunteering their skills. In addition, these projects have contributed greatly to the camaraderie among its members. In June 1975, Coast Guard Auxiliary Flotilla 12-9 was chartered with 28 Concord Yacht Club members. It was the second sailing flotilla to be formed in the United States. In 1952 a club burgee was designed by Jones Smellage and approved by the charter members. In 1974, a contest was held to create a new burgee to fly from the Bob Brown Memorial Mast. Five or six entries were displayed for selection by membership vote. Mary Carpenter’s design of three red sails on a blue and white field was the winner. Hal Frincke subsequently produced a line drawing of the winning design and the burgee was registered in the American Registry of Yachts. The Thistle fleet was chartered in 1951, followed by the Windmill fleet in 1962, Flying Junior fleet in 1963, Flying Dutchman fleet in 1964, Sunfish fleet in 1969, Laser fleet in 1972, Force 5 fleet in 1976, Catalina 22 fleet in 1982, and Lightning fleet in 1986. Peder Johansen began the cruising class with his handcrafted Gypsy double-ender sloop in 1948. The cruising class started active racing as the Auxiliary fleet in 1970. Rapid growth of the Auxiliary fleet led to the construction of floating slips in 1977, and a marine railway in 1978. More floating slips were added in 1983 that provided accommodation for keelboats of various sizes. Regatta history began with the Annual Admiral Farragut Regatta first held in 1952. The Dutch Treat Regatta for Windmills, Flying Juniors and Flying Dutchman began in 1964. The Flying Dutchman Fleet has since disbanded. Lasers scheduled their first regatta in 1973, and Sunfish in 1974. Force 5’s were added to the Laser Regatta in 1977. Lightning's had their first regatta in 1987. The Concord 300 Invitational Sea Scout Regatta held every two years began in June 2002. CYC has several outreach programs to promote sailing in the Greater Knoxville Community. This effort includes a family sailing program, a sailing day-camp with 3-4 sessions through the summertime, several adult learn to sail programs, adult keelboat classes, University of Tennessee sailing team, Sea Scout Ship 300 (part of the Boy Scouts of America) and a high

school sailing program. CYC recognizes two ‘Special Programs’: Sea Scout Ship 300, and the not-for-profit (501c3) Concord Sailing Center (CSC). The latter oversees sailing education and youth racing for members and non-members, and oversees the UT Sailing Club’s activities at the club. The CSC manages several fleets for these activities, including Catalina 22 keelboats and several fleets of dinghies, including, Optimist, OpenBic, Sunfish and 420, as well as motorized RIBs used as safety and coaching boats. The CYC also maintains other motorized boats in support of its racing programs.

F. General Policies 1. Applications for membership will be considered in the order of receipt; however, former members who have left CYC in good standing, inactive members, and members’ adult children shall be placed at the head of the waiting list in the order of their applications’ receipt. Member families, including children under age 24, are entitled to use club facilities, subject to the rules of the club. 2. The maintenance of Club grounds, clubhouse, docks, moorings, slips, dry racks, parking areas, seawalls, oar house, picnic shelters, storage building, marine railway, boat lift, and equipment is an important responsibility of Club members. To ensure proper Club maintenance, members are asked to assume responsibility for participating in general work parties, clean-up days, repair and replacement activities, and other maintenance assignments. Each Active and Young Active member is obligated to provide a minimum of fifteen (15) hours of work each year toward the maintenance and operation of the Club. It is each member’s responsibility to record work hours that they or family members over the age of fourteen (14) have performed on a file card that will be provided, and to have the work hours validated through the signature of the committee chairperson supervising the event or work party. Work hours should be completed and recorded by November 15. Work credit will be given for the following: a) maintenance of Club property and facilities; b) any additional race committee duty after completion of the mandatory race committee assignment; c) all types of committee work; and d) pro bono sailing instruction offered through the educational programs of the Club and/or its special membership organizations such as the Concord Sailing Center and the UT Sailing Club; e) sailing activities at the Club. One member may not transfer work hours to another member. Work hours for members joining or resigning during the year will be prorated based upon the time of the year the members joined or resigned (See Section G, Item 9). Payment in lieu of

work is possible for members in accordance with the policy established by the Board of Directors (Section G. Item 9). Members are, however, urged to take advantage of the work requirement as a means of maintaining interest in all aspects of the Club and becoming acquainted with other members in an informal, but important, Club function. One year’s work requirement cannot be completed in a subsequent calendar year. 3. All members and their guests are expected to conduct themselves as ladies and gentlemen, to discipline their own children, to be responsible for their guests, and to respect the property and privileges of each member and the Club property. 4. Member’s pets are permitted on Club grounds. Pets are not permitted in any building, on the patio and breeze way, or in club boats. The pet must be under control and on a leash at all times. The member is responsible for cleaning up after their pet and disposing of the waste in a green trash container at the Club gate entrance. Guests or non-members are not permitted to have pets on Club grounds. 5. The first officer or member to arrive on a weekend should fly appropriate flags from the flagpole. The last to leave should make sure that the flags are taken down and properly stored in the flag locker in the galley. 6. Flags are flown between 0800 and sundown. The U.S. flag is flown from the gaff. The Club burgee is flown at the masthead (top of the mast). The Commodore (or senior officer present) raises his flag on the outermost hoist of the starboard yardarm. The Race Committee flag (if races are to be held) is raised on inner hoists with the fleet flags in this order: Thistle, Windmill, Keelboat, Catalina 22. 7. Guests are welcome at the Club only when accompanied by a member.

a) Guests at Club-subsidized functions should be limited to out-of-town houseguests only.

b) A member must accompany non-members who are camping. 8. The last member to leave must make certain that all doors are locked, all lights and all fires are out, the stove is turned off, all chairs and other Club property and loose items are properly stored, and the gate properly closes. Curfew is 1:00 a.m. 9. A CYC member (Active, Young Active, Senior, Associate, Honorary) must accompany minors (under 18 years old) staying

at the Club, on boats or camping. 10. Club members should always have the Club keys with them to avoid being accidentally locked in or to open the gate in the event of a power failure. 11. Members and their families should respect other members’ boats and other property.

a) Stay off other boats unless invited aboard. b) Never use another member’s equipment without the owner’s

permission. c) Never move another member’s boat/s without prior permission.

12. Members’ motor boats may not be launched or stored at Club facilities except when used for safety purposes during Club events. Motor boats are to be tied up at the winter launching dock or the windward side of docks and out of the way of sailboats. 13. Docks cannot be used for mooring boats overnight or longer without special permission from Harbormaster.

RENTAL OF CLUB FACILITIES 1. The CYC Commodore’s Room is available for rent by a CYC member in good standing for family and casual group activities. 2. A CYC member must make the rental reservation, be on the premises for the duration of the group function and be responsible for any damage and clean-up. 3. No rental will be allowed during Club scheduled functions, not including Series Races. 4. There is no exclusive use of the clubhouse kitchen, Club Room (foyer area w/ fireplace), and grounds. These areas are always available for use by all CYC club members. Exclusive rental applies only to the Commodore’s Room and Beach Shelter. 5. Two weeks advance request is required, and submitted on the prescribed form. 6. Rental reservation requests must be made with the Clubhouse Rental Coordinator which is an appointed position by the CYC Commodore. Please refer to Section C. Committees for current Coordinator. 7. A reservation is not required for a casual gathering of CYC

family members and friends for groups of twenty (20) or less. However, consulting with the Clubhouse Rental Coordinator is recommended to avoid conflict with other activities that may have reserved the club. Refer to Section G, Item 19 for rental schedule.

ASSIGNMENT OF BOAT STORAGE 1. The Club provides trailer spaces for large and small boats; dry -racks and A-frame racks for small boats such as Lasers, Sunfish, etc; moorings (self-bailing cockpit required); summer slips; year-round floating slips (self-bailing cockpit required); and racks for sailboards. Boats and equipment should not be stored in sunshade shelters. If available, individual member families can rent multiple moorings, trailer spaces and Dry rack/A-frame spaces, and combinations of these resources, at the same time. However, members cannot hold assignments of more than one summer slip or year-round slip at the same time. 2. All assignments of boat facilities are made for the Board by the Harbormaster in accordance with current Board policy under the general supervision of the First Vice Commodore. Appeals relating to the Assignment of Boat Facilities policy or Property Identification requirements should go directly to the Board through the First Vice Commodore. 3. Vacant facilities are generally assigned on the basis of club seniority. The Board reserves the right to alter assignments in special cases (e.g., boat size or draft). A few slips may be available for rent in the low-water season. All requests for boat and trailer spaces, on the water or on-shore, must be made to the Harbormaster via the club’s webpage. 4. Members must maintain liability insurance on all personal property stored on Club grounds. 5. Mooring buoys and year-round slips are assigned to members on a 12-month basis. Summer slips, Dry Dock racks and A-frame racks are assigned for the six (6) months of high water. A member assigned a summer slip must occupy the slip within two (2) months; otherwise the slip will be reassigned. The member is responsible for the mooring or slip after its assignment. The Club does not represent in any way the suitability, strength, or condition of the slip or mooring and its attachments. Before occupying, and all times, the member shall inspect the slip or mooring and its attachments. If it is unsuitable, the member will either repair it or refrain from its use and notify the Harbormaster immediately. All boats assigned to mooring buoys and slips must be identifiable by their TN number, boat name or owner’s name on the hull.

6. Before any boat and trailer is assigned a mooring, permanent slip, summer slip, trailer space or rack, the owner must sign a Liability Waiver and a Boat and Trailer Storage Agreement, supplied by the Harbormaster. The Club shall retain copies of these documents. Members may wish to prepare copies for their own records before submitting them to the Harbormaster. 7. Dry sailing racks are numbered and are assigned as needed. Assignments are made upon written request to the Harbormaster. The racks are not re-assigned, as each person adapts the rack to fit his boat. Any boat on a dry rack or A-frame must have the owner’s name indicated on the bow of the boat. Current assignment lists are available from the Harbormaster. 8. A fine of $10 per day may be levied on any member who:

a) stores a boat or trailer on CYC property without prior assignment by the Harbormaster,

b) parks a boat or trailer in an unauthorized space, or c) stores a boat or trailer on CYC property without proper

identification.

A fine of $25 per day may be levied for unauthorized mooring or dockage of a boat.

9. Floating and Summer Slip Storage: All sailboats must be secured to the dock or pilings with appropriately sized line. All lines and attachments shall be maintained in good repair and replaced as is necessary for the security and safety of all sailboats. Owners are responsible for adjusting dock lines as necessary resulting from lake level fluctuations. In the event of a failure of the lines or attachments, the member shall be solely responsible for any resulting damage to the member’s sailboat, other sailboat(s), and/or Club property. Sailboats shall be secured with minimum of two (2) bow lines, two (2) stern lines, and one (1) spring line. The size (diameter) of the lines depends on the size and weight of the boat. Nylon or other suitable line of the following minimum diameter shall be used: 3/8 inch diameter for boats under 20 feet, 1/2 inch diameter for boats 20 to 30 feet; and 5/8 inch diameter for boats longer than 30 feet. If the boat is heavy for its size or has unusual windage, minimum line diameter may need to be increased. Boats in Floating Slips must be tied to main the dock walkway and piling/s whenever possible. Finger pier cleats are for spring lines only. You are required to check your lines as the lake level fluctuates; this may involve a complete re-tie at season’s end. Shore power on the docks may be used when the boat is attended.

An unattended boat may only be connected to shore power with a 30amp #10 AWG cable using a waterproof adapter, if necessary, and only to power equipment permanently installed on the boat that has a total load not exceeding 15 amps. Portable electrical equipment (such as fans, air conditioners, dehumidifiers) shall not be operated on an unattended boat. Attachments (e.g., dock boxes, antennas, flag poles, carpeting, ramps, tables, seating and steps) shall not be added to the docks or pilings without the approval of the Rear Commodore. Also, prior approval from of the Rear Commodore is required before making modifications to the docks, pilings, electrical and water systems (e.g., affixing fender material, installing or changing cleats). Modifications and attachments must be removed by the member when the slip assignment ends, if so directed by the Rear Commodore. 10. Mooring Storage: two lines of at least 1/2 inch diameter with a braided eye, each fitted with a thimble, shall be separately shackled to the mooring buoy. Do not remove the Club shackle which is attached to the chain at the mooring buoy. A primary pennant length 2-1/2 times the distance from the bow chock to the water and a secondary pennant 3-1/4 times that distance is recommended. 11. Trailer Parking: no boat or trailer may be stored on CYC property without proper owner identification and prior space assignment by the Harbormaster. Trailers must have the owner’s name on the tongue of the trailer. The assignment of boat and trailer storage spaces is made to individual members only. In the case of joint ownership, the assignment shall be in the name of the member originally requesting the facility. Transfer of an assignment to another joint owner shall be treated as a new assignment. Lists of current permanent slip assignments and other boat and trailer space assignments (and any associated waiting lists) are available by request from the Harbormaster. Assigned trailer spaces may be adapted to the needs of the boat and trailer. It is advisable to anchor trailers/boats to the ground, to avoid windstorm damage, or becoming a high water hazard. Members are responsible for keeping their assigned trailer space(s) in good order: weeds and brush must be cleared by May 15th and again by July 15th. A $25.00 charge may be applied for each non-compliance. The Harbormaster may also require additional space maintenance if necessary.

WORK AREA CYC member-owned boats are permitted in the designated work area for up to thirty (30) days, but owners must coordinate work area usage with the Harbormaster in advance. If additional days are required, the owner must make prior arrangements with the Harbormaster. A fine of $10/day may be assessed for unapproved work area use.

PUMP-OUT STATION To support Clean Marina Practices, Concord Yacht Club has installed a dock mounted Peristaltic Pump-Out Station for boat sewage waste disposal. The Station is located on the East Dock approach ramp and is available for use, free of charge to both Club members and non-members who are boating on Lake Loudon. Additionally, a Use Log has been provided, for all users of this facility, to record their waste disposal activity. Boats equipped with a y-valve permitting sewage discharge overboard are to be secured in the ‘closed’ position preventing sewage release into the water.

MARINE RAILWAY AND BOAT LIFT

RESERVATIONS 1. The marine railway and Boat Lift are reserved for the exclusive use of members who have been trained and certified on this equipment. The equipment, if improperly used, could cause serious personal and/or property damage. All members who use either equipment must be trained and certified in its proper operation. Contact the Harbormaster to schedule a time to be trained and certified on the lift or the railway. Contact the Harbormaster or CYC Website to make a reservation on the lift or railway. If you are not on the list of trained users you may not reserve the equipment. You must have a reservation three (3) days in advance of using the equipment. There is a fourteen (14) day limit on reservations for railway (except for Low Water railroad occupancy) and boat lift. Refer to Section G, Item 11 for rental and fines schedule. 2. The facilities are in great demand, so please do not exceed your scheduled time. Tell the Harbormaster if you finish early or are unable to use them to allow use by others. 3. In the event of a no-show, the member reserving time on the railway or boat lift will normally be charged for the time reserved unless the Harbormaster is advised at least three (3) days in advance. 4. If a boat spends any part of a day on the marine railway or the boat lift, the owner shall be charged for the entire day. If one member vacates the railway or lift on the same day as the next user occupies the facility, both users will be charged for a half-day. 5. Use of the railway or the Boat Lift is at the boat owner’s risk. 6. Only members in good standing that have been trained,

certified, and have signed the appropriate release will be allowed to schedule and operate the Marine Railway or Boat Lift. 7. If a trained and certified member wishes to use the Railway or Boat Lift equipment to help another member who has not met the requirements for its use, the certified member will request/schedule its use via the website, will personally operate the equipment, and will assume all liability for its safe and proper use.

TRAINING FLEET RULES 1. The current training fleet boats are: 420, Sunfish, Optimist and Catalina 22. 2. Qualified Training Fleet members may utilize the boats for recreational, club races, and other special events for the promotion and cultivation of sailing. 3. The Training Fleet Committee will comprise the CSC President, UT Sailing Club President, individual Fleet Captains, CYC Commodore, and Training Fleet Coordinator if one has been assigned. 4. The Training Fleet Committee will establish, and revise as necessary, appropriate policies and rules for the safe and proper use of Training Fleet boats. Current Training Fleet use requirements will be posted on the website, or available from the CSC President or the Training Fleet Coordinator. 5. Participation in a checkout session, or other approved form of boat operation competence, will be required for use of any Training Fleet boat type. Upon completion of the checkout, users will be assigned a competency level as defined by the Training Fleet Committee (see subsection 6 below). Users may only check out boats under prevailing conditions equal to or less than their assigned competency level. 6. The sailing competency level will be determined by completion of the US Sailing “Red Book” certifications as follows:

0 user cannot skipper a boat, but may crew for an eligible skipper. 1 user is eligible to skipper in winds lighter than 5 mph. 2 user is eligible to skipper in winds less than 10 mph. 3 user is eligible to skipper in winds less than 15 mph. 4 user is eligible to skipper in winds less than 25 mph. 5 user is a USSA certified instructor and may skipper in

all reasonable wind strengths, including above 25 mph (e.g., in order to bring a boat safely back to the docks).

Wind strength is determined as the strength in puffs registered by the weather station in the Clubhouse or other performed measurement.

7. The base user fee of $100.00 per calendar year entitles a family member to check out one (1) 420, Sunfish, Optimist or Catalina 22 at a time. For an additional $50.00 per family (i.e., $150/year), two (2) boats may be checked out at the same time. The Catalina 22 fleet membership requires five (5) work hours. These five (5) work hours are in addition to the required annual fifteen (15) CYC work hours and must be applied directly to work done for the Catalina 22 fleet. 8. Boats can be checked out only when the above requirements have been met, and in accord with all other applicable CYC policies. 9. CYC members are eligible for Training Fleet “Key Holder” status after attaining competence at Level 2 or higher. A “Key Holder” is restricted to personal use of the Fleet in which all certifications and fee requirements have been fulfilled. A “Key Holder” may not check out boats for other members. 10. Boat use is limited to daylight hours only. Boats may not leave the dock thirty (30) minutes before sunrise and must be back at the dock before sunset. (Boats are not equipped with navigation lights and/or batteries.) 11. Boat usage will be limited to the following occupant maxima:

Optimist 2 Sunfish 2 420 3 Catalina 4

12. Life jackets must be worn at all times in the boats. Shoes should have non-marking soles. 13. The sailing area for the Fleet will be confined to within sight of the CYC Clubhouse except when participating in CYC- or CSC-sponsored events. 14. Members will be able to reserve the boats for personal use on a first-served basis except when the Fleet is being utilized for a scheduled event. Reservations can be recorded on a calendar or other suitable record in the Training Fleet Barn. Both CYC and UT will have access to the entire 420 fleet when using them for a scheduled event. UTSC members will have access to the boats only during scheduled events or as guests of CYC members. 15. Unsafe operation of boats or failure to comply with the rules of conduct set by the Training Fleet Committee will result in

loss of “Key Holder” status and/or will disqualify the user from further participation in the Fleet for the balance of the year. 16. Any damage or maintenance needs shall be reported immediately by the user to a Training Fleet Committee member. Repair costs for any damages resulting from negligence of the user will be charged to that user. Any damages not paid promptly will result in suspension of privileges. Unpaid costs for damages will be billed by the CYC Board and will be due and payable upon receipt, and late fees will apply. Costs for damages deemed by the Training Fleet Committee to be normal wear and tear will be waived. 17. All Training Fleet users are encouraged to increase their sailing skills and certification ranking through participation in the training programs. 18. Training Fleet dinghys shall not leave the dock when winds are in excess of 25 mph. Regatta Race Committee decisions may supercede Training Fleet use rules. Catalina 22 boats shall not leave the dock if wind speed is forecast to be above 15 kts (17 mph) and air temperature is below 40 degrees F. For easy reference, “white caps” appear on the water above ~12-14 kts. 19. Compliance with Training Fleet Rules and following general safety practices are the ultimate responsibility of the skipper. 20. Skippers of the Training Fleet’s keelboats must hold the U.S. Sailing Association ‘Basic Keelboat’ certification and must demonstrate acceptable proficiency in the handling and sailing of the keelboat in use. Others must be checked out by a U.S. Sailing Keelboat instructor. 21. Catalina 22 Fleet

Note: Alcohol is not permitted on training fleet boats. Please be aware that there are severe penalties including jail time and fines for boating while intoxicated.

Catalina 22 use will be recorded on a Reservation & Check Out log maintained by the Fleet Captain. The log will also include maintenance performed by members or which is needed before the boat can be used again. Boats will be available for racing if reserved at least two days prior to race day. If boats are not otherwise reserved (e.g., for scheduled keelboat education classes, or approved private lessons), they can be used within the rules for use. Reservations for classes and lessons can be scheduled via the Reservation & Check Out log. Minor maintenance items that can be done by the member should be performed and noted on the log, indicating any spare parts used, etc. If repairs cannot be made, they should be noted on

the Log and the Fleet Captain should be notified so that boat can be taken out of service until the needed maintenance is completed. 22. After returning C22s to the dock:

a. Tie boat in slip, using proper cleat hitches, a spring line, and fenders in place where there is any potential for the boats to touch the dock.

b. Tidy cabin and remove personal items. c. Replace any gas that you used. d. Stow all equipment properly.

Wash boat deck for the next person, each boat has a bucket of cleaning supplies.G. Financial 1. Application Fee: $25 with application; non-returnable. 2. Initiation Fee: $300 plus applicable sales tax; due upon joining. 3. Bond: $230; due upon joining. 4. Dues: $396 per year plus applicable sales tax; billed in November and due before January 1st (unless Board approves an alternative payment plan). 5. Late Fees: Payments are due by the due date posted on the invoice. A late fee of five percent (5%) will be added to unpaid amounts after the due date. One (1) month after the due date, an additional late fee of ten percent (10%) will be added to unpaid amounts (including prior charged late fees). One (1) month after the due date members in arrears are not in good standing, and may not use the club until all amounts are paid in full. The member in arrears will be notified in writing that membership will be considered for suspension or termination at the next scheduled Board meeting, as set forth in Concord Yacht Club By-Laws Article VII. Partial payments are applied to the earliest obligation. 6. Returned Check Charge: A $25.00 returned-check charge will be levied whenever checks returned for insufficient funds. 7. Locker Rental: $6/year + sales tax; $3 + sales tax if occupancy is after July 1st. The member desiring the locker should occupy an empty one and notify the Harbormaster of the locker number, who will advice the Treasurer for billing purposes. 8. Training Fleet User Fee: CYC families pay $100/year, which entitles a family member to check out one (1) 420, Sunfish, Optimist or Catalina 22 at a time. For an additional

$50 per family ($150/year), two (2) boats may be checked out at the same time. The Catalina 22 fleet membership requires five (5) work hours in addition to the yearly fee. These five (5) work hours are in addition to the required annual fifteen (15) CYC work hours and must be applied directly to the Catalina 22 fleet. The use of all training fleet boats requires a one-time evaluation by an authorized CSC evaluator of the sailing skills of all family members wishing to use the boats. A separate evaluation competency evaluation will be necessary for the Catalina 22s and for each dinghy (420, Sunfish, Optimist). 9. In Lieu of Work: A $30/hr charge is applicable when a member does not complete all of their work hour requirements. This charge is calculated and billed in November of each year from data recorded on the Work-Hour Cards as of November 15th of the previous year. Work hours for members holding Senior or Associate Status are optional. New members joining and members resigning have work hour requirements prorated by month as follows (Joining / Resigning):

January 15 / 0 February 14 / 0 March 13 / 4 April 12 / 6 May 11 / 8 June 10 / 9 July 9 / 10 August 8 / 11 September 6 / 12 October 4 / 13 November 0 / 14 December 0 / 15

10. Race Committee: The Principal Race Official (PRO) will record Race Committee duty performed. Prior to November 15th, individual members must verify their duty has been recorded on their cards. RC duty No-shows will be charged a $50 fine. 11. Railway/Lift Rental: Must be reserved with the Harbormaster by members who have been trained and certified. $15/day + sales tax for days reserved unless adjusted by the Harbormaster. The Harbormaster furnishes the list to the Treasurer for billing. There is a $100 fine for “unauthorized use” of the equipment. No-shows: Members reserving the Railway/Lift and not cancelling three (3) days in advance are billed unless they appeal to the Board due to extenuating circumstances. Low Water Railway Rental: The railway may be occupied continuously during the Low Water period beginning about

November 1st and ending about April 15th (or when the river level exceeds 811 for one (1) week, whichever comes second). Cost is $300 for the season. Selection of the occupant will be decided by a random drawing approximately 2 weeks before water levels begin to go down. Requests to participate in the drawing must be submitted the Harbormaster by October 15th. After the Low Water period ends, the daily occupancy rate of $15/day + sales tax will apply. However, if the railroad is reserved by another member for the day after the end of the Low Water period, and the Low Water user does not make reasonable efforts to vacate the railway by that date, the “unauthorized use” rate $100/day + tax may be charged to the Low Water user. Members are eligible to use the railroad in consecutive winters if they are the only member submitting a request in either year. 12. Floating Slips Occupancy Fee: $100 will be charged for a member family’s first slip assignment at CYC. Subsequent assignment of another slip(s) will not incur this fee. 13. Slip Rental: $50/month in advance for the remainder of the year from the date of occupancy, due within thirty (30) days of the invoice date. Requests must be made to the Harbormaster via the CYC web page. 14. Mooring Rental: $15/month billed in advance, due within thirty (30) days of the invoice date. Requests must be made to the Harbormaster via the CYC web page. 15. Summer Slip Rental: $35/month billed in advance, due within thirty (30) days of the invoice date. Requests must be made to the Harbormaster via the CYC web page. 16. Dry Rack and A-Frame Rental: $60/year billed in advance, due within thirty (30) days of the invoice date. Requests must be made to the Harbormaster via the CYC web page. 17. Trailer Parking Spaces: The first assigned trailer/boat parking space will be charged at $30 per year. Each additional trailer space shall be charged at the rate of $60 per year. The full amount will be billed in advance, due within thirty (30) days of the invoice date. Requests must be made to the Harbormaster via the CYC web page. $25/occurrence will be charged for each trailer assignment/s not cleared of weeds and brush by May 15th and July 15th. 18. Unauthorized Storage Fine: $10/day will be charged for storing a boat or trailer on CYC property without prior assignment

by the Harbormaster, parking a boat or trailer in an unauthorized space, or storing a boat or trailer on CYC property without proper identification. $25/day will be charged for mooring or docking a boat without authorization from the Harbormaster. 19. Work Area: Members occupying work spaces for more than thirty (30) days will be fined $10/day. 20. Clubhouse Rental: For casual gatherings of member ’s families or friends of twenty (20) or less, there is no charge. Rental of clubhouse by a member will be charged as follows.

� Reservations of Clubhouse or Beach Shelter for groups: � 21 to 50 = $75/day � 51 to 100 = $150/day � 101 to 200 = $300/day � Beach Shelter = $25/day

Early Set-Up: You may set-up the Commodore’s Room before your scheduled event provided it has not been reserved by another member. Early set-up fee is the same rental rate, per day, as the event. Use Deposit: For rental of the Commodore’s Room or Beach Shelter a $250 deposit is required when a rental reservation is made. Payment: Submit two (2) checks with the reservation request form, one (1) for the rental amount and a second check for the use deposit. Date the use deposit check with the same date as the reservation date requested. The use deposit check will be un-cashed and will be destroyed or returned if the facility is left clean, without damage, and in good order. 21. Lost Key: A charge of $5 payable to the Secretary for a replacement – or deducted from the bond when resigning and not turned in to the Secretary. 22. Gate Access Card/s: Are the property of CYC and shall not be given to or shared with non-CYC members. First card assignment is included with membership. Additional cards can be purchased for member or immediate family only for a non-refundable fee of $10 each. Lost or stolen cards must be reported immediately to the Secretary. Replacement cost for a lost, stolen, or damaged card is $30. 23. Resignations: All fees/charges collected by CYC in advance are prorated by the month, and any unused balance will be returned to the member. Letters of resignation, with bond, key and gate card/s included, should be addressed to the Secretary; postmarked date is the effective date of resignation. Outstanding

obligations are deducted from bond refunds. See By-Laws, Article V, §4. A member’s boat and equipment must be removed from club facilities before the club accepts a resignation. 24. Resale: The sale of burgees, license plates, logo shirts or hats, etc., must be paid for upon order or delivery at the discretion of the individual coordinating the sale of the items.

H. Types of Membership There are eight (8) types of membership: Active, Young Active, Senior, Student, Associate, Honorary, Inactive, and Special. NOTE: the Board must vote to approve all optional membership status changes (e.g., from Active to Senior). ACTIVE, purchase membership bonds, pay initiation fees and annual dues, acquire seniority, hold office, and vote at club meetings; active members must be over twenty-one (21) years of age. YOUNG ACTIVE, purchase membership bonds, and pay 50% annual dues, acquire seniority, hold office, and vote at club meetings; young active members must be over twenty -one (21) years of age and less than thirty-three (33) years of age as of their initial joining date, and as of the 1st of January for each subsequent annual membership renewal (i.e., YA members will be converted automatically to ACTIVE members on 01-January of the year following that in which they turn 33). SENIOR, those members who have been in good standing for not less than ten (10) years and who have attained the age of sixty-five (65), observe the same membership requirements as Actives except for work hours, which become optional for the calendar year following the year in which they reach 65 years of age and have completed 10 years of membership. STUDENT, who are enrolled full-time at a recognized educational institution and are eighteen (18) years of age or older may join for a period of no more than five (5) years and pay 50% of active members annual dues; however, students purchase no bond, pay no initiation fee, hold no office, have no vote, and limit their guests to three (3). Students must provide verification of full-time enrollment annually to retain the student member status. ASSOCIATE, See Article V §1 ¶f of By-Laws. Those who have been an Active or Senior member in good standing at least ten (10) years, is at least sixty-five (65) years of age. They hold no office, have no vote; work hours and race committee

duty are optional. HONORARY, See Article V §1 ¶g of By-Laws. Those who have given up active sailing and whom the Board acknowledges to have provided outstanding service, have full use of available club facilities, enjoy exemption from all financial or service obligations, but relinquish their voting and office-holding rights. INACTIVE, those members who are out of town and unable to use club facilities for a period of one (1) year or more, do not pay dues, do not store boats at the club, are not obligated for race committee and work hour requirements, do not accrue seniority, and do not count in the membership total. SPECIAL, memberships are available to sailing organizations such as state chartered corporations established for sailing instruction or official sailing organizations sponsored and regulated by a recognized educational institution.

I. General Information

PROPERTY IDENTIFICATION CYC requires that all members’ boats and trailers be identified with member last name on trailer tongue. The Harbormaster requires

names on boats, on dry racks and trailers in addition to current TN numbers on boats in water and boats on trailers.

PUBLIC LAUNCHING Only sailboats may be launched at CYC ramps, and a launch or dock fee of $5 per day is charged for those who are not members or guests of club members.

SAIL CAMP Sail Camp is a week-long children’s day camp (ages 8-15) that occurs for three (3) or four (4) consecutive weeks in June. The camp includes sailing instruction, water safety, swimming and shore activities provided by camp staff and club volunteers. The camp is open to the public and often offers scholarships for tuition. All children must pass a swimming test to attend. Sailing instruction is conducted by US Sailing certified instructors.

CLUBHOUSE, GALLEY, RESTROOMS 1. Please help keep restrooms clean and neat at all times. 2. Clean up your table and area when you finish eating. Leave the table and area around it as you would like to find it before you eat. 3. Clean up the kitchen, utensils, sink, stove, counter, floor, shelves, grill, and all areas that are used. 4. When using the Club during the week, dispose of all garbage by placing it in the green containers near the entrance gate. 5. The coolers and refrigerators are for your use, but please label and use only the drinks and food which belong to you. Take home leftovers! The locked pantry and freezer room hold supplies for special Club functions only. 6. The Ice Machine is available for member’s use. Club events have priority. Members may not use the ice machine on the entire day of a Club sponsored event. Please refer to Section Q. Annual Social Dinners & Sponsored Events. Please observe these rules when using ice machine:

a. Only the ice scoop is to be used to retrieve ice. b. NEVER put or use glass in the ice machine. c. NEVER leave the scoop in the ice machine. d. It is recommended the ice be used for coolers only. e. Do not place anything on top of ice machine, this is a

Health Department Code violation. 7. The First Aid Kit is available to all members and is located in the kitchen on top of the refrigerator. Please keep it out of the reach of children. 8. The bulletin boards are reserved for sailing notices, boat assignments, or other official Club schedules and announcements. They may not be used for advertising purposes. CYC members may announce their own boat or equipment for sale

on the bulletin boards on the clubhouse port deck. All notices must be dated and will be removed after six (6) months.

DOCKS, WATERFRONT, SWIMMING AREA 1. Children up to eight (8) years of age, and older if non-swimmers, must wear life jackets when on the docks or in CYC and CSC boats. 2. Please follow all Coast Guard guidelines when using the Club dinghy. 3. The CYC dinghy should be left at the floating dock when not in use to be available for emergencies, to assist the Race Committee, and to get to and from moorings. 4. The last person on the dock should remove the dinghy from the water, lock and replace the oars and life preservers in the oar house (Jack’s Shack), and lock the oar house. 5. The committee boat and CYC rescue boats are for the use of the Race Committee, official CYC work parties and other authorized purposes only. 6. When not in use, rescue boats shall be tied securely in their slip, but left in a condition to be used immediately; that is, all safety equipment and the fuel tank shall always be kept on board. Ignition keys shall be kept in the oar house (Jack’s Shack). The boats shall only be used for rescue purposes and by the Race Committee. 7. The oar house (Jack’s Shack) is used for storing race committee gear; the sail loft (Betty’s Barn) houses Training Fleet equipment. 8. Swimming is permitted only in designated areas and is subject to the special rules posted there.

a. Swimming from the marina docks is not permitted. NOTE: all three CYC marina docks are posted ‘No Swimming Within 100 Yards’.

b. Children must be under the supervision of an adult. c. All swimming is at your own risk.

9. No glassware is permitted on the docks, waterfront, or swimming beach area. Remember . . . SAFETY FIRST!

DRIVEWAYS, PARKING, LAUNCHING AREAS 1. General use dollies are stored near the base of each marina dock. Please return them to their original storage area after use. 2. Dry-sailed trailered boats shall be rigged sufficiently before launching so that the car and trailer can be moved promptly from the launching area to your assigned trailer parking space. Use your assigned parking space ONLY.

a. If you have no assigned trailer parking space, park your car in the areas designated for “cars only.”

b. Guests should park at the main entrance to the clubhouse. c. NO PARKING ON THE GRASS – except as allowed in

designated areas beside driveways for large CYC functions. d. NO PARKING WITHIN 30 YARDS of the top of any launching

ramp (except in designated car parking spaces beside the west dock ramp area).

3. Drive slowly through the club grounds and be particularly careful in backing. Sailors (adult and juvenile) are not always looking when on foot. 4. Children will be prevented by guardians from playing on ramps and driveways, boat trailers, or among parked cars. 5. Raising/lowering masts on trailered boats can be dangerous for anyone nearby – always get help if needed . . . just ask. Be careful about power lines when trailering a boat with it’s mast up. – Always lower the mast before towing a boat out of the CYC gate. 6. Use the driveways - do not drive across the lawn areas. Grease gets on the grass and then on sails and clothes; and the septic tank could be crushed.

MAIN GATE 1. The main entrance gate is to be kept closed at all times during Low Water season, and on weekdays during High Water. It is a deterrent to unauthorized persons and eliminates unnecessary through traffic. The gate will be programmed to remain open in daylight hours during the High Water season to encourage community sailing. Members are encouraged to welcome visiting non-members who wish to launch a sailboat at our ramps. 2. Operation of the electric gate: to open the gate on arrival, hold your gate access card within three (3) or four (4) inches of the key pad. A light in the upper left hand corner of key pad will flash from red to green. Warning beeps will be heard from the gate opener and the gate will open. To depart, pull within four (4) feet of gate and it will beep and open. The gate should be left in automatic mode unless there is a regatta or a function that requires heavy traffic through the gate. To lock the gate open, use your CYC key to unlock the motor box on the west side of the driveway. Open the gate and, when it is STOPPED (10 second delay), lift the box cover and flip the black power switch down to the off position. Close the box cover.

Never operate the gate with the cover open. To reactivate the automatic mode, lift the cover, flip the power switch back on and close the cover immediately. After a 10 second delay the gate will close and resume auto mode. Relock the motor box cover. To exit if the gate has suffered a power failure: Unlock the motor box with your CYC key. Flip the black power switch down to the off position. Locate the clutch lever in the lower right area of the box (4 inch long loop of silver metal). Push it back, parallel to the gate. This will disengage the chain And allow you to push the gate open. Replace the box cover.

Be sure to push the gate closed after you leave. So that it will Return to auto mode after power has been restored, reengage the clutch and flip the power back on. Close and lock the motor box immediately. Notify the Rear Commodore if there is a problem not covered by these instructions. If the gate malfunctions, press the red reset button located outside and under the motor box and then continue.

LAWN AREAS 1. The lawn area is for folding sails, games and general play, and camping. Keep it clean and be careful not to drop sharp objects or messy liquids that may cause injury or damage sails. 2. Be sure to immediately and thoroughly ‘pick up’ after your dog. 3. Tents may be pitched overnight on the lawn in front of the clubhouse, and beside the swimming beach shelter. 4. All tools and lawn equipment should be stored in “Smith’s Shed” (located in the East Trailer Parking Area - just across driveway from clubhouse).

TRAILERED-BOAT WORK AREA The level gravel area immediately west of the boat lift is for work projects and cannot be reserved or used for boat/trailer storage. Members must coordinate work area usage in writing with the Harbormaster. Members are permitted to remain in the work area for up to thirty (30) days, but are encouraged to move their projects along efficiently and to vacate as soon as their work is completed. If additional days will be required, the member must get prior approval from the Harbormaster (others may be waiting to use the Work area). NO PARKING of unattended cars in the work area is permitted at any time. A fine of $10/day will be assessed for work area violations.

J. Racing Program

MISSION STATEMENT The mission of the Concord Yacht Club racing program is to foster excellence in sailing through a quality racing and race management program. The racing program must provide a competitive and enjoyable format that encourages those members who are non-racers to race and encourages current racers to remain active.

MANAGEMENT

Management of the CYC racing program shall be the responsibility of the 1st Vice Commodore or designee, subject to oversight by the Board of Directors.

PROGRAM EVENTS A variety of racing activities are planned each year according to Members’ current interests. These events may include the following types of racing: a Spring, Fall and Winter series for keelboats; a Spring and Fall series for dinghies; CYC Regattas; a Club Championship Regatta

HANDICAPS Handicaps for all official Concord Yacht Club racing activities and events, for mixed (non one-design) dinghy and keelboats fleets, will be based on PHRF or Portsmouth scoring, with wind speed adjustments. Boats and crews are assumed to have no modifications from their class equipment or crew weight standards. Ratings must be adjusted for boats and crews that are not in compliance with their class rules. Decisions regarding an individual member’s boat’s handicap will be made by a committee formed by the 1st and 2nd Vice Commodores for this purpose, and in accordance with US Sailing recommendations. Typically keelboats will utilize PHRF scoring and Portsmouth scoring is more appropriate for dinghies. The handicapping method used for each fleet, series, or regatta will ultimately be made by the 1st Vice Commodore with consideration given to competitors’ inputs. If sailing in a handicap racing fleet (i.e., not one-design), it is the responsibility of each competitor to apply for, and maintain a CYC PHRF or Portsmouth rating for their boat(s) and maintain compliance with their class rules.

CYC may sponsor up to three keelboat series each year in accordance with the wishes of the competitors and club resources: a Spring Series which will run from approximately April through June; a Fall Series which will run from approximately September through November; and a Winter Series that will run from approximately November through March. Scoring shall be divided into spinnaker and non-spinnaker classes. Less frequent racing is usually scheduled during the summer months of July and August. Racing format, schedule and scoring are detailed in the Notice of Race and Sailing Instructions as posted on the web site.

DINGHY SERIES

CYC may sponsor up to two dinghy series each year in accordance with the wishes of the competitors and club resources: a Spring Series which will run from approximately April through June and a Fall Series which will run from approximately September through October. Consideration will be given to water temperatures. Races scheduled on weekdays should be run while daylight savings time is in effect. Examples of typical dinghies are Lasers, Sunfish, Thistles, Lightnings and Hobie Cats. Windsurfers will not be allowed to compete in the CYC dinghy series.

CYC REGATTAS Unless determined otherwise, on a case-by-case basis, all weekend regattas, previously referred to as Invitational or Club regattas, will be referred to simply as CYC Regattas and will be open to all competitors regardless of yacht club membership, subject to any reasonable fees that the CYC may deem appropriate. CYC Regattas will include the Rocky Top Regatta, the Admiral Farragut Regatta for Thistles, the Memorial Day, Independence Day, Labor Day and the Fall Regatta one-design regattas for fleets such as Holders, Thistles, Lasers, Optis, etc; collegiate regattas sponsored by CSC; or any other such competition. Unless intended for a specific one-design class, all CYC Regattas will include classes for dinghies and keelboats. A member wishing to conduct a regatta that uses CYC equipment or facilities shall obtain approval by submitting a written application to the First Vice Commodore not later than three months before the regatta. Notice of approval or denial of the application with any conditions or comments shall be made within two (2) weeks after receipt of the application. The decision of the First Vice Commodore is final. The Notice of Race and Sailing Instructions will be posted on the club web site two (2) months prior to the regatta and Sailing Instructions will be available at registration. Special circumstances may prevent regatta organizers for providing the above-required amount of advance notice. In such cases, the organizer should apply to the First Vice Commodore

to permit a shorter interval. The application shall be available on the website and will contain the following information: 1. Name of group organizing the regatta. 2. Description of the fleet(s) invited. 3. Estimated number of participants. 4. Dates, times and details of regatta activities. 5. Attached copy of the Notice of Race. 6. Attached copy of the Sailing Instructions. 7. Attached copy of the approved TWRA permit. 8. Name of sponsoring CYC member. 9. Name, address and phone number of the primary regatta contact. 10. Name, address and phone numbers of the Principal Race Official. 11. List of CYC equipment requested for use. 12. List of CYC facilities requested for use.

FLEET & CLUB CHAMPIONSHIP The combined results of the Keelboat and Dinghy Series and CYC Regattas will be used to determine a Club Dinghy Fleet Champion and a Club Keelboat Fleet Champion. The top two “willing” finishers in each Fleet will be eligible to compete in the overall Club Championship Race, to determine the overall Club Champion. In alternate years the Club Championship Race will be held in a suitable CYC owned dinghy or CYC owned Catalina 22’s. If a qualifying fleet competitor chooses not to compete in the Club Championship Race, the next place competitor in his/her fleet, will be invited to compete in the Club Championship Race. The Notice of Race and Sailing Instructions will be posted on the web site. If possible, the course will be close to shore and easily visible to spectators.

K. Race Management

RACE COMMITTEE DUTY Each Active, Young Active, Senior and Student member is required to serve on a race committee at least once per year, as assigned by the First Vice Commodore. Failure to fulfill this obligation will result in a fee of $50.00. Members who do not intend to perform RC Duty should inform the First Vice Commodore as soon as possible to facilitate scheduling. If you have a conflict with your RC Duty assignment, you are permitted to exchange with another member. Exchanges of dates may be made freely, but both members must notify the two Principal Race Officers (PRO) involved and the First Vice Commodore.

A PRO may only exchange with another PRO. Once an exchange is made, each member is responsible for the new race date only, including any fee for no-shows. Assigned RC Duty does not count towards work hour credits. Additional RC Duty will be credited as work hours for actual hours served, as determined by the PRO. Performance of additional RC Duty hours (credited or otherwise) does not relieve the member of the responsibility for any fees resulting from no-shows on their assigned or exchanged dates. In order to maintain a high level of racing excellence, PROs are requested to attend an annual refresher seminar in race management. All Club members, who perform RC Duty, are invited and welcome to attend race management seminars. Seminars will be announced and conducted prior to the beginning of the CYC racing season. PROs and Club members will receive two (2) work hour credits for completing the seminar, after they complete their initial assigned RC duty.

WEATHER REQUIREMENTS A sustained wind speed of 3 mph and air temperatures above forty degrees Fahrenheit at the starting signal are required to constitute a race. The PRO must use his/her best judgment to ascertain that there is only a minimal risk of thunderstorms in the vicinity. For Winter Series racing, no precipitation can be present. These are the minimum weather requirements for any race conducted by CYC. However, it is the responsibility of every skipper who participates in any race or other event to ascertain whether or not the weather conditions are too challenging for his/her skill level and if so, to remain on-shore. See Rule 4 of the Racing Rules of Sailing. Racing in dinghy series races should not proceed without a mark boat on duty. The Winter Keelboat Series racing generally proceeds without a mark boat, and sometimes even without a primary RC boat (signals made ashore). Accordingly, additional safety precautions apply to the Winter Series: e.g., sailing self-righting boats only, air and water temperature limits and no precipitation

RACE COMMITTEE INSTRUCTIONS The following checklist should be observed by the RC while conducting CYC Regattas. Regattas that require registration and a separate competitor’s meeting will have additional requirements. An abbreviated version of this checklist is maintained on the Committee Boat. This checklist is a good guide for Series race committees. Week Prior: 1. The PRO should contact all RC members and remind them

of the upcoming race event and the time they should arrive at the Club to begin preparations. 2. Review the Notice of Race and Sailing Instructions for any special instructions, including courses and time limits. On Land: 3. The PRO will ensure that someone is on-site to conduct registration at least two (2) hours prior to the first gun. Competitors will be required to submit proof that their boat is insured at registration, or delivered to the 2nd Vice Commodore prior to registration. 4. The PRO should arrive no later than two (2) hours prior to the first gun to conduct the skippers’ meeting and begin checking equipment. NOTE: All discrepancies found will be reported to the 2nd Vice Commodore 5. RC members should arrive and report to the PRO approximately two hours prior to the first gun or per the PRO’s instructions. 6. Equipment checklist:

� Gas � Life jackets � Radios � Sailing Instructions � Timer � Anemometer and wind vane � Finish sheets and pencils � Mark boat � Marks and anchors � Flags and sound signals � Copy of the RRS

7. Check forecast and current wind directions. 8. Communicate the location of the starting area and all marks with mark boat crew prior to departure. These should be in accordance with the fleet guidelines listed below. 9. Verify radio communications between committee boat and mark boat. 10. The PRO has the discretion not to start a race or to continue a race if, in their judgment, the RC present does not have enough members or if those members present do not have the ability to conduct a race in a safe and fair manner, or if there is inadequate RC equipment. The decision of the PRO is final.

In the event that races are not held, the PRO is expected to note the reasons in his race report, and to conduct training in race management or equipment usage for members of the RC members present. Committee members present, when no races are conducted, have fulfilled their obligation to perform RC Duty and/or, have earned work hour credits, where appropriate. Those members who are not present, even when no races are conducted have not fulfilled their required RC Duty and/or have not earned work hour credits as applicable, unless notified by the PRO in advance that racing has been canceled. On the water: 11. Proceed to race course approximately one hour prior to the first gun. 12. Make one long sound signal as the committee boat leaves the dock. 13. Verify wind direction and placement of marks on the water, and modify as necessary. 14. The course should be posted on the side of the committee boat. Government markers are designated A-G as shown in the SI. Inflatable marks are designated W (windward), L (leeward), O (offset), Δ (triangle) and X (finish). For example, a course set for twice around a windward-leeward with an offset mark would be signed as W-O-L-2-X. A triangle-windward- leeward using a mixture of government marks and inflatable bouys could be signed as A-E-L-A-L-X. 15. Note that keelboats prefer longer legs rather than multiple short legs with a race duration of approximately 1 hour. Dinghies prefer shorter legs with multiple rounds and a race duration of approximately 30 minutes. See the Course Map for preferred race areas. Actual courses used are at the discretion of the PRO. Note: it is possible to shorten a course during a race but not to lengthen it. 16. Marks should be set and the starting line established approximately 15 minutes prior to the first gun. 17. Note that the role of the mark boat is to place marks and monitor the safety of the fleet. During start sequences it should monitor the pin end of the starting line and communicate OCS boats to the PRO. After a race has started, the mark boat should move to a location where it will have a good view of the fleet and be ready to respond quickly in the event of an emergency. It should not be

moored to the committee boat as this impacts the rules regarding obstructions. If necessary, tie up along the side of the RC boat opposite the pin. 18. If winds are light or boats are very late for the start, signal a postponement with the AP flag. 19. Starting sequences will be in accordance with the RRS Rule 26 as modified by the SI. Generally, this includes the following:

� 5 minutes – Warning Signal – hoist CLASS flag, one sound signal.

� 4 minutes – Preparatory Signal– hoist PREPARATORY flag, one sound signal.

� 1 minute – One Minute Signal – lower PREPARATORY flag, one sound signal.

� 0 minute – Start – Lower CLASS flag, one long sound signal. 20. If separate starts have been planned for different classes, the Start signal for the first class shall be the Warning Signal for the second class. The second CLASS flag should be raised at the same time as the first CLASS flag is lowered. 21. Visual signals are the official signals. Failure of a sound signal does not affect the starting sequence. 22. Note the start time of each sequence on the finishing sheet along with the wind speed. 23. Additional wind speed readings will be noted at the middle and end of each race. 24. Note the finishing time of each boat, even if they were OCS at the start. 25. Note any protest flags being flown by competitors at the finish line. 26. Additional flags may be used as prescribed in the RRS and modified in the SI. These cover all of the common “what if” scenarios and are not required if everything runs smoothly. Common flags and their application are summarized here:

� Answering Pennant (AP) – racing postponed. Fly this flag with two sound signals to announce delays in the starting sequence due to weather or race preparation. Lower the flag with an extended sound signal one minute prior to the next start sequence. See RRS 27.3.

� Code X flag – Individual recall. Fly this with a single sound signal if a boat or boats are on the course side of

the starting line at the starting signal. Note the sail number of all offending boats on the finishing sheet; note when they have started correctly. Lower the flag without sound signal when all early boats have returned to the starting side of the line or after 4 minutes (whichever comes first). See RRS 29.1.

� First Substitute flag – General recall. Fly this with two sound signals if so many boats are on the course side of the starting line at the starting signal that they cannot be individually identified, or if there has been a significant error in the starting procedure. Lower the flag with a single sound signal one minute before restarting the sequence. See RRS 29.2.

� Second Substitute flag – More races to follow. Fly this flag without sound signal as boats finish to indicate that additional races will be run that day. Lower the flag with an extended sound signal one minute prior to the next start sequence. See USSP Appendix L.

� Code N flag – Racing abandoned. Fly this flag with three sound signals to announce that a race underway has been abandoned (e.g. weather, barge traffic, time limits) but more races will follow. Lower the flag 1 minute before the next start with a extended sound signal. Fly N+A with three sound signals if all racing has been abandoned for the day. See RRS 27 and 32.

� Code I, Z or Black flags – Starting Penalties. See the RRS 30 for instructions on proper use. Note any use of these flags on the finishing sheet. Use of these flags is discouraged for CYC Club racing.

� Code S flag – Shorten Course. Use this flag with two sound signals to shorten a race at a rounding mark that has already been set. Finish the race between the mark and the S flag. This can be used by an anchored mark boat if necessary. This must be announced before the first boat finishes. See RRS 32. This is very useful if running multiple fleets on the same course. Consider starting a second race for one fleet while finishing the other fleet at the leeward mark so that they don’t conflict. In this case you should also fly the Class flag beside the S flag to show who is finishing.

� Code C flag – Change Course. Use this flag with repeated sound signals to announce that a previously set mark or finish line has been moved. This must be announced at the rounding mark before the new mark (usually by the mark boat), but the new mark does not have to be in place at that time. See RRS 33.

� Code M flag – Missing Mark. Use this flag with repeated sound signals on an anchored boat to indicate that it

is being used in place of a regular mark (the one specified in the SI) that has gone missing. See RRS 34.

On return to shore: 27. Make one extended sound signal as the committee boat arrives at the dock after the day’s racing activities are concluded. Note the time on the finishing sheet. The PRO must be available for one hour after this time to receive protests. Consult RRS Part 5, Rules 61 – 62.3, regarding the handling of protests. 28. All equipment should be properly stowed and secured. 29. Finishing sheets should be deposited in the RC mailbox. Failure to deposit results (or documentation of lack of racing) will result in a no-show fine for the PRO. 30. Sign appropriate work cards for committee members. Mark “no show for RC duty” on absent member(s) work card(s). Use of Radios Radio communications between the RC and the mark boat and competitors will use public airwaves. The RC may use channel 69, or another pre-arranged channel, for all racing communications. The RC should exercise caution so that radio communications do not give competitors an unfair advantage. However, radio communications in the interest of safety or to signal the completion of the day’s racing are expected.

L. Overview of Racing Instructions, NOR & SI Instructions to competitors are provided in the Notice of Race (NOR) and Sailing Instructions (SI) for each event as posted on the Club web site. This overview covers most of the basics without the necessary legal language. Note that competitors participate in Club racing activities entirely at their own risk. The Keelboat and Dinghy Series and CYC Regattas are open to all members in good standing. See the section above, “Handicaps” if sailing in a handicap racing fleet (i.e., not one-design). All races are held in accordance with the Racing Rules of Sailing. The purpose of these rules is not to make things complicated, but, to promote safe and fair competition. It is the responsibility of each

race competitor to understand and comply with the Racing Rules of Sailing. Please take time to familiarize yourself with these important rules. Scheduling for Dinghy and Keelboat Series races should be deconflicted so that sailors who wish to participate in both the Dinghy and Keelboat Series may do so. During the Winter Keelboat Series the keelboat fleet designee shall notify keelboat competitors on Thursdays, based on the weather forecast, whether racing will be conducted on Saturday or Sunday. The Spring Dinghy Series shall be conducted on weekday afternoons, typically on Thursdays, as determined by the 1st Vice Commodore. The Fall Dinghy Series will be conducted on weekday afternoons as long as sufficient daylight is available. Later in the Fall Series, the Dinghy Series may shift to Sunday racing due to reduced hours of daylight. Spring and Fall Keelboat Series races will be conducted on Saturdays. Typically, weekday afternoon races will begin at 6:00. CYC regattas have their own scheduled dates and start times, which may be found in the NOR and SI for each event. A minimum of three (3) boats, regardless of fleet (dinghy or keelboat, spinnaker or non-spinnaker) are required to constitute a race. Actual course locations and shapes are set at the discretion of the PRO to take advantage of the current conditions, but should try to meet the examples shown in the SI below. Government marks are labeled ABC (green cans) and DEFG (red nuns). Inflatable marks may also be used. Awards will be given for the Series, CYC Regatta and Fleet Champion. The 1st Vice Commodore shall determine which scoring method shall be used for scoring CYC Regattas and the Keelboat and Dinghy Series, giving great deference to inputs from the competitors. CYC Regattas will use the Low Point scoring system. If at least four races are completed, each competitor’s worst score will be discarded.

NOTICE OF RACE (NOR) CYC Dinghy and Keelboat Series / CYC Fleet Champions The Notice of Race (NOR) contains both general and specific information concerning a race event. A NOR, as well as any updated versions of the NOR, will be posted on the CYC web-site for each club racing event (series and regattas). It is the responsibility of each race competitor to read and comply with the information presented in the NOR, which governs the race he/she will compete in. The following is brief outline of the type of information to be found in a NOR.

1. General information would include such items as the event name, place and dates for the event, and the name of the organizing authority for the event. 2. Rules. Racing will be conducted in accordance with the Racing Rules of Sailing (RRS), latest edition, and the US Sailing Prescriptions (USSP), as modified by the Sailing Instructions (SI). Full details of rules changes will be provided in the SI. This will include RRS 77, 78, 87 and 90.3, covering sail numbers, one-design equipment and scoring systems. The SI may also change other racing rules. 3. Eligibility. All Dinghy and Keelboat Series races are open to members in good standing of the Concord Yacht Club. CYC Regattas will typically be open regattas. Before any boat is allowed to compete in any CYC event, the skipper shall sign a disclaimer of liability and provide proof of 3rd party liability insurance, to either the 1st or 2nd Vice Commodore or their designee. Parents or legal guardians must sign disclaimers for sailors under 18 years of age. Windsurfers are not eligible for any of the CYC race events. Eligibility for Series and Fleet prizes may have participation and other requirements, as detailed in the event NOR and/or SI. 4. Registration. All competitors must register for CYC Regattas as per the NOR. Participants in the Dinghy or Keelboat Series will notify the 1st or 2nd Vice Commodore or their designee of their intent to compete and provide them with their PHRF or Portsmouth Handicap rating as applicable. Registration dates and times for CYC Regattas are detailed in the event NOR. All competitors should check in with the RC at the starting line before the first starting sequence is begun. All handicap fleet racing requires the assignment of a Portsmouth handicap rating, by the CYC Handicap Committee, and is a perquisite for competition. By entering any of these races, the owner agrees to be bound by the RRS and any other rules that govern the event. 5. Sailing Instructions. Sailing Instructions (SI) will be made available on the Club web site. Any modifications made less than one (1) day prior to the race to which they apply will be posted on the Club bulletin board. Cumulatively updated SI will be posted on the Club website as required. 6. Schedule. A detailed schedule of race dates, with start times and time limits, will be included in the race event Notice of Race and Sailing Instructions. Starting times are as follows: Series races on Saturdays: First gun - 12:00pm

Series races on Sundays: First gun – 1:30 Series races on weekdays: First gun - 6:00pm 7. Courses. Races will be sailed on Fort Loudoun Lake outside CYC between mile markers 615.7 and 617.7. Courses will be windward/leeward or triangular courses at the discretion of the RC with all buoys left to port. Courses will be posted on the side of the RC boat prior to the start of each race. 8. Scoring. The method for scoring the Dinghy and Keelboat Series will be determined by the 1st Vice Commodore, giving great deference to inputs from the competitors. CYC Club Champions will be determined by combining the Series results with CYC Regatta results. The number of race drops for Dinghy and Keelboat Series and the Fleet Championships are detailed in the respective NOR and SI. CYC Regattas will be scored using a low-point scoring system. If at least four races are completed, competitors will discard their worst score. 9. Awards. Awards will be given for the following race events: Winter, Spring and Fall Keelboat Series; Spring and Fall Dinghy Series; Fleet Championship for Dinghy and Keelboat; CYC Regattas for Dinghy and Keelboat fleets; the Club Championship. The number of awards for each event will depend on race participation, and will be detailed in the respective event NOR and SI. 10. Mark boat. A mark boat shall be on duty for moving marks and monitoring fleet safety during all CYC Regattas.

SAILING INSTRUCTIONS (SI) For CYC Dinghy and Keelboat Series, CYC Regattas and CYC Fleet Championships, the Sailing Instructions (SI) contain more specific information with regard to the conduct of a race event, with some information overlapping with that presented in the NOR. For some race events, CYC may combine the NOR and SI into a single document for purpose of brevity. The SI, as well as any updated versions of the SI, will be posted on the CYC web-site for each club racing event (series and regattas). It is the responsibility of each race competitor to read and comply with the information presented in the SI, which governs the race he/she will compete in. The following is a brief outline of the type of information to be found in a SI. 1. General information. This section provides general information and guidelines on the preparation of Sailing Instructions for CYC race events. Specific race event information will be found in the SI developed and published for a specific race event. 2. Rules. The regatta will be conducted in accordance with

This modifies RRS 77, Appendix G and USSP Appendix G1. 4. Rules Change. Boats that do not conform to class rules for equipment may not qualify for one-design fleet awards. The RC should give deference to the judgment of experienced members in their respective one-design class when interpreting class rules. Non-compliant boats or crews may compete for Handicap Fleet awards, provided the modifications have been accounted for in their Portsmouth handicap rating by the Handicap Committee. This modifies RRS 78 and 87. 5. Rules Change. Scoring will depend on the race series or regatta. See notes on scoring below. This modifies RRS 90.3. 6. Notices and Changes. Notices to competitors and changes to the SI will be posted on the Club bulletin board if changes are made less than one (1) day prior to the start of the race in which they will apply. Cumulative changes will be updated on the Club Website site. 7. Schedule of Races. The schedule of CYC race events can be found on the CYC web site, under the tab “Racing.” 8. Check in. All competitors are expected to check in with the RC, prior to the start of racing, and announce their sail number. A boat that retires from the race shall notify the RC as soon as possible. 9. Class Flags. The class flag for keelboats will be Auxiliary Fleet flag. The class flag for dinghies will be the Thistle Fleet flag. 10. Racing Areas. Race areas are at the discretion of the PRO. Generalized racing areas are shown in the drawing at the end of Section L. The Keelboat race area is in the widest part of the lake to facilitate longer legs. The Dinghy race area is immediately in front of the Club. Race areas with mixed fleets of Keelboats and Dinghies will be set with a preference

for the majority of boats present at the discretion of the PRO. 11. Safe Harbor Area. An area west of a line from the green navigational light in front of CYC to the No Wake buoys southwest of CYC shall be designated a “Safe Harbor Area”. Boats operating within this area shall operate with caution and are not bound by the RRS propulsion rules (RRS 42). Courses shall not be set so as to include this area, and competitors will avoid it while racing. 12. Courses. All courses will be at the discretion of the PRO and will be posted on the side of the committee boat. Race courses will be set with an initial windward leg and will be triangles or windward/leeward (with or without offset) or some other configuration as described at the Competitors’ Meeting. Marks will preferably be left to port. The course may be more than once around. 13. Marks. Marks will be a combination of inflatables and government markers. Government markers are designated A-G as shown in the Club Handbook, and/or an attachment to the SI. Inflatable marks are designated W (windward), L (leeward), O (offset), Δ (triangle) and X (finish). 14. Start/Finish. Races will be started using Rule 26. Start and finish will be between the X mark and the main mast of the RC boat. 15. Time Limits. If no boat has passed the first mark within 45 minutes, the race will be abandoned. If no boat finishes the course within two (2) hours, the race will be abandoned. Boats failing to finish a race within thirty (30) minutes after the first boat sails and properly finishes the course will be scored TLE (Time Limit Expired). Boats scored as TLE will receive a placing one place worse than the last boat to properly finish. In order to be scored TLE a boat must be attempting to finish the race, i.e. proceeding with sails properly hoisted toward its next proper mark on the course. Boats which started properly, but have doused sails and/or are no longer attempting to complete the course will be scored DNF (Did Not Finish). Boats scored as DNF will receive a placing one place worse than the number of boats staring the race. The 30-minute signal to halt a race will be three audible horn blasts (the signal for abandonment) or three similar sounds (whistle, etc.). This changes rules 35, A4 and A5. Time limit requirements, for any race event (series and regatta), may be changed by including such changes in the race event SI.

16. Commercial Traffic. Large commercial traffic on the water (barges) will be treated according to the International Regulations for Preventing Collisions at Sea. In the event that commercial traffic passes through the race course during a race, that race may be abandoned at the discretion of the PRO. 17. Protests. A boat wishing to protest will inform the other boat(s), and will fly a red flag as required by RRS Rule 61.1. The RC will sound a single extended sound upon the RC returning to the dock. The PRO will be available to receive protests for sixty (60) minutes after the sounding of the signal. Protests must be communicated to the PRO during this time. 18. Scoring. Scoring for each race event will be described in the NOR and/or the SI. See Handbook Section J, the “Handicap” section for general information on event scoring. A minimum of one (1) race constitutes a series or a regatta race event. 19. Awards. Awards will be given in accordance with the schedule of awards detailed in the NOR and/or the SI. 20. Disclaimer. Competitors participate in the racing entirely at their own risk. See RRS 4, Decision to Race. CYC will not accept any liability for material damage or personal injury or death sustained in conjunction with or prior to, during or after the racing. 21. General CYC Race Areas for dinghies (red) and keelboats (blue). Government marks are labeled B,C (green cans) and D,E,F,G (red nuns). Inflatable marks may also be used.

N. Concord Yacht Club By-Laws [As amended through 13-Nov-2016]

Article I § 1. The name the Club shall be CONCORD YACHT CLUB. § 2. The object shall be the promotion and cultivation of recreation through sailing, yachting, and the training of club members in seamanship.

Article II § 1. The government of the Club shall be vested in a Board of Directors consisting of nine (9) members [7 officers and 2 at-large members] elected as hereinafter provided, plus the retiring Commodore (if not re-elected). § 2. The Board of Directors shall have the power to receive and redress complaints; to receive, care for and spend the funds of the Club; and to adopt rules and regulations necessary for the proper and orderly administration of the Club and its affairs. § 3. The Board shall have the power, through its properly constituted officers, to make such leases and other contracts as they may deem necessary for the welfare of the Club. § 4. The Board shall have the power to fix penalties for violation of the By-Laws and rules adopted by the Board and to remit any penalties so fixed. § 5. The Board shall receive applications for membership from persons permitted to be on public park property and expressing interest in sailing. § 6. Any member of the Board of Directors who shall absent himself from two consecutive regular meetings, unless he shall have previously obtained permission to do so from the Board of Directors, or shall present at the next regular meeting an excuse for his absence satisfactory to every member of the Board present, shall be deemed to have resigned his office. § 7. Regular meetings of the Board shall be held at such times and places as may be designated by the Board. § 8. Special meetings of the Board may be called by the Commodore, Secretary or Treasurer. Special meetings of the Board shall be called by the Commodore on written request of two or more members thereof. Notice shall be given to each member of the Board at least twenty-four (24) hours in advance of the holding of any regular or special meeting. § 9. The Board shall appoint delegates to the Dixie Inland Yacht Racing Association (DIYRA) in accordance with DIYRA general rules of operation.

§ 10. The Board shall annually appoint an audit committee to examine the financial records of the Club. § 11. The Board shall annually appoint a New Member Committee to inform and integrate new members into the Club.

Article III § 1. The officers of the Club shall consist of a Commodore, two Vice Commodores, a Rear Commodore, a Secretary, a Treasurer, and an Assistant Treasurer. § 2. The Commodore, or in his absence the Vice Commodore first elected, or in his absence the Vice Commodore elected next, shall preside at all meetings of the Club or Board and shall exercise general supervision and control over all affairs of the Club. § 3. The first-elected Vice Commodore shall arrange all invitational regattas; the second-elected Vice Commodore shall manage all Club regattas; and the Rear Commodore shall oversee the maintenance and construction of Club facilities. § 4. The Secretary shall keep minutes of Club meetings, receive membership applications and resignations, issue membership certificates, communicate official correspondence, and maintain membership records. § 5. The Treasurer shall keep the Club’s financial books; collect all dues; pay all bills; maintain a sinking fund; furnish an annual report of the condition of the Club’s finances at the annual meeting; enter said annual report into the official minutes; and pay dues to the U.S. Sailing Association, the Yachting Club of America, and the Dixie Inland Yacht Racing Association. Whenever a majority of the board requests it, the Treasurer shall furnish the Board a financial statement. § 6. The Assistant Treasurer shall bill members for their dues and shall provide the Treasurer such assistance as may be requested by the Board. § 7. The officers shall, by virtue of their election as such, be members of the Board of Directors.

Article IV § 1. The Commodore shall appoint committees necessary to carry out the activities of the Club. § 2. The Commodore, and in his absence the first-elected Vice Commodore, shall serve ex-officio on all committees. § 3. Meetings of the committees shall be held on call of the respective Chairman thereof, or by the Commodore.

Article V § 1. ¶ a. Membership shall consist of the original

incorporators and such other persons as have been or may hereafter be elected and remain members in good standing in the manner prescribed herein. Sailboat ownership is not a requirement for membership. However, only sailboats shall be launched and/or stored on Club facilities. Non-boat -owners' dues, fees, and assessments will be determined by the CYC Board; and the number of non-boat owners will be based on available Club facilities. ¶ b. There shall be eight (8) categories of membership: Young Active, Active, Senior, Student, Associate, Honorary, Inactive, and Special. ¶ c. A Young Active Membership is available to those over the age of 21 and less than 33 years of age. The age of the eldest member of a joint couple shall determine eligibility. The annual dues for Young Active members shall be fifty percent (50%) of the Active member dues. All other membership requirements are identical to those of an Active member except the initiation fee, which is waived. ¶ d. An Active member must be over 21 years of age. In the case of a member who is married, his or her spouse shall also be a member, provided they are over 21 years of age. ¶ e. A Senior Membership is available to an active member who has been in good standing for not less than ten (10) years and is at least 65 years of age. Work hours are optional. All other membership requirements are identical to those of an active CYC member. ¶ f. A Student member shall be a full-time student at a recognized educational institution. The annual dues for Student Members shall be fifty percent (50%) of the Active member dues. Student members have no voting rights, can hold no office, and must limit their guests to three (3). Their membership is limited to five (5) years and may be reviewed at any time at the pleasure of the Board. ¶ g. An Associate member is available to an Active or Senior member who has been in good standing for at least ten (10) years and is at least 65 years of age. The annual dues for Associate members shall be fifty percent (50%) of the Active member dues. Work hours and Race duty are optional. An Associate member has no vote and may not hold office. Full use of the club facilities, as available, are permitted except no boat or other personal property shall be

stored at the club. ¶ h. An Honorary member is a member who has been in good standing for not less than ten (10) years, who has provided outstanding service to the Club, and who is leaving the area, or is not actively sailing. Honorary membership shall be awarded by the Board of Directors. It shall not require payment of any fees, dues, or assessments, and will carry neither voting privileges nor the right to hold office. Honorary members shall have full use of the Club facilities as available. ¶ i. An Inactive member is a member who is out of town and unable to use Club facilities for one (1) year or more. He may not be required to pay dues for the period of his absence, with the ultimate decision in individual cases being left to the discretion of the Board of Directors. ¶ j. Special Memberships are available to qualifying sailing organizations. These organizations will include but will not be limited to: (1) state-chartered corporations established for education and sailing training and (2) official sailing organizations sponsored and regulated by a recognized educational institution. Acceptance of any organization into membership will be determined by the CYC Board. The CYC Board may restrict the number of members in any Special membership. Special memberships will be regulated by the CYC Board and may require a representative from the organization to serve on the Board. The use of club facilities, access to the property, work hour requirements, and dues and assessments will be determined and regulated by Board policy. Special memberships will not count in the total membership limit. ¶ k. Each Young Active, Active and Senior member in good standing shall be entitled to one vote on each matter submitted to a vote of members: in the case of married members, either husband or wife may cast the vote, but not both on the same matter. Either husband or wife may hold office, but not at the same time. ¶ l. The Directors may increase or decrease the membership limit based upon the carrying capacity of the club facilities. [As of December 31, 2022, the membership limit is 230.] § 2. Any person desiring membership in the Club shall make application in writing. When a duly executed application has been received by the Board, along with an application fee, the Board shall accept the application within the limits

of memberships available of applications agreeing to pay the membership fees and abide by the Club rules. § 3. ¶ a. The initiation fee for Active members shall be $300.00, but may be waived by the Board for past members rejoining CYC. ¶ b. Young Active, Active, Senior, Associate, and Inactive members shall be required to purchase and hold a membership certificate. The certificate shall be issued by the Club for the sum of $230.00. All certificates shall be issued through the Secretary. In case of married persons, a certificate must be issued in both names in order that either may vote or hold office as provided in the By-Laws. § 4. ¶ a. Should a member desire to terminate his membership, his certificate shall be surrendered to the Treasurer. The value of the certificate shall be refunded, deducting from there any dues, penalties, or other sums the surrendering holder owes to the Club. ¶ b. The Club shall not be required to repurchase or repay the value of the certificate of any resigning member, except as provided above or in the event of dissolution of the Club. In the event of dissolution of the Club, the Club shall be obligated to repay the value (not to exceed $230.00) of all certificates outstanding. The outstanding membership certificates shall constitute a liability of the Club at all times. ¶ c . The annual dues for Active and Senior members shall be $396.00 plus tax to be paid annually unless changed by vote of a majority of a quorum of the members at an annual meeting or a special called meeting of the membership. § 5. The Board shall have the power to assess the membership for operating expenses. Assessments shall be limited to only that amount necessary to maintain solvency during the Board's term of office.

Article VI § 1. The Officers and Directors shall be elected at the annual meeting of the Club for one year to begin on January 1 of the following year. The annual meeting shall be held not earlier than October 15 nor later than December 15 in each year, at such hour and place as may be designated by the Board. § 2. The election of officers and directors of the Club shall be by ballot except as hereinafter provided, and a majority of votes cast shall be required to elect. A ballot shall not be required when there is only one nominee for an office. § 3. The Ex-Commodore shall automatically serve on the Board

of Directors for the year following that in which he held office as Commodore. § 4. A member may be represented at any meeting by proxy. Such proxy must be in writing and shall be filed with the secretary of the meeting. § 5. Members of the Board of Directors and Officers shall hold office for approximately one year or until their successors have been elected. The members may at any time meet and elect officers and directors, provided four-fifths (4/5) of the membership is present at said meeting. Upon the election of such new officers and directors, the officers and directors then serving shall be automatically removed from office; and their successors shall hold office; until the next annual election. § 6. In case of vacancy in the Board of Directors, the Board shall elect a successor to fill the unexpired term. § 7. The Board of Directors may upon their own motion call a special meeting of the Club by giving ten (10) days notice by mail to the members. Notice of every special meeting shall state the object or objects for which it is called, and no other business shall come before the meeting. § 8. Two-fifths (2/5) of the members of the Club in good standing, present in person or by proxy, shall constitute a quorum at any regular or special meeting except as herein otherwise provided. § 9. These By-Laws may be amended by the membership of the Club by affirmative vote of two-thirds (2/3) of the members present and voting, provided a quorum is present, at any annual or special meeting, provided that the proposed By-Law or amendment is submitted in writing to the membership not less than ten (10) days prior to the annual or special meeting. § 10. The Board is empowered to approve capital and related expenditures for a single project up to a maximum of $20,000. Above this amount, an expenditure must be approved by an affirmative vote of a majority of a legal meeting. § 11. The Standing Committees for Nominations and Planning shall report to the Board of Directors. ¶ a The Standing Committee for Nominations shall be composed of three (3) members to be appointed by the Commodore for three-year terms, excepting initial appointments which will be for one, two, or three years and excepting vacancy appointments. The member whose term next expires shall serve as chairman. The Committee will present a full slate of nominees, who are willing to serve, to the membership no less than ten (10) days prior to the annual meeting. ¶ b The Standing Committee for Planning shall be

composed of three (3) members to be appointed by the Commodore, prior to the annual meeting, for three-year terms, excepting initial appointments which will be for one, two, or three years and excepting vacancy appointments. The Rear Commodore will serve ex officio on the Committee.

Article VII § 1. ¶ a. In the event of a member failing to timely pay dues, fees, and/or assessments; or violating any By-Law or rule of the Club; or in the event of any conduct by a member which may tend to endanger the good order, welfare, or character of the Club, the Board may suspend and/or terminate the membership of said member. ¶ b. Any member under consideration for termination or suspension will be mailed written notice of the proposed action at his/her address as it appears on Club records not less than ten (10) days prior to the time the Board meets to consider the action. Such notice will specify the time and place of the meeting and invite the member to explain why his/her membership should not be suspended or terminated. The member may also present a case in writing to the Board by the meeting date. Failure to appear or provide written response to the proposed action will constitute wavier of the opportunity to be heard prior to the Board’s decision. ¶ c. Any member thus terminated or suspended shall immediately be notified in writing of this action. Such member may appeal the decision by serving written notice of such appeal upon the Board within seven (7) days after receiving said decision; and on receipt of the notice of appeal, the Board shall call a special meeting of the Club to be held within twenty (20) days thereafter to consider such appeal. A quorum for such appeal shall consist of one-fifth (1/5) of the total membership. Failure to have present this reduced quorum will result in a rescheduling of said meeting during the pendency of which the Board's action will remain in effect. § 2. For misconduct or neglect of duty, any member of the Board of Directors may be expelled from office by a majority vote of a quorum of the members of the Club.

Article VIII The Club shall maintain membership in the United States Sailing Association, the Dixie Inland Yacht Racing Association, and the

Yachting Club of America. Financial support of such membership shall be limited to the payment of annual dues unless such additional expenditures that may be of benefit to the Club are approved by a majority vote of a quorum of the members of the Club.

Article IX The Club flag or emblem, which may be displayed by members in good standing, shall be a pennant of the design approved by the Board of Directors.

Article XI § 1. A sinking fund shall be established and maintained by the Treasurer in an interest-bearing account insured by an agency created by the U.S. Government and as approved by the Board. The purpose of the sinking fund is to provide for the redemption of Club membership certificates in the event of dissolution of the Club. Additions to the sinking fund shall be made by adding to the sinking fund an amount equal to 10 percent of annual dues received from members, and by adding interest earned on savings to the sinking fund.

Article XII Parliamentary Authority The rules contained in the current edition of Robert’s Rule of Order Newly Revised shall govern the Concord Yacht Club in all cases to which they are applicable and in which they are not inconsistent with these By-Laws and any special rules of order CYC may adopt. § 2. The General Fund of the Club may borrow from the Sinking Fund for capital improvements, upon the approval of the Board of Directors, provided that not more than 50 percent of the Sinking Fund balance (cash in bank plus loan receivable as of that date) is borrowed, and provided that the Board makes provision for the orderly payback of the loan or loans with interest at the current rate per year, over a period not to exceed five (5) years from the date of the loan or loans. § 3. The sinking fund shall not be used for any purpose except that specified above. The annual additions to the sinking fund may be waived when the total accumulated in the sinking fund bank account is sufficient to redeem all of the outstanding Club membership certificates.

R. Clean Marina Practice Concord Yacht Club promotes environmentally responsible marina and boating practices. The below practices are established to maintain clean water and are designed to reduce water pollution in the Tennessee River. Practices are divided into seven areas (or sections) in line with the Tennessee Valley Clean Marina Guidebook. Clarification of practices and additional information is contained in this guidebook. The guidebook is part of CYC’s “Clean Marina Policy and Log Book” maintained in the CYC library. Members are required to follow the practices outlined below.

SECTION 1 - SEWAGE MANAGEMENT All members are to comply with federal, state and local wastewater outfall and septic system regulations. Concord Yacht Club is designated a “No Discharge” marina. Sewage discharge within the marina basin/harbor limits is prohibited. No improperly treated sewage is to be discharge overboard into the Tennessee River outside of the CYC marina limits. To support Clean Marina Practices, Concord Yacht Club has installed a dock mounted Peristaltic Pump-Out Station for boat sewage waste disposal. The Station is located on the East Dock Approach and is available for use, free of charge, to both Club members and non-Club members, boating on Lake Loudon. Additionally, a Use Log has been provided, for all users of this facility, to record their waste disposal activity. Boats equipped with a y-valve permitting sewage discharge overboard are to be tied down so no sewage can be released into the water.

SECTION 2 - FUEL MANAGEMENT Members are to practice “fuel spilling prevention.” Petroleum absorption pads are to be on hand while fueling in the event of a spill. Bilge socks are to be placed in boats with in-board motors.

SECTION 3 - SOLID WASTE & PETROLEUM RECYCLING DISPOSAL Members are encouraged to store materials such as fuels, oils, Solvents and paints off-site. Members are encouraged to utilize the recycle bins located at the clubhouse for aluminum, glass, and plastic.

Spill-proof Oil Changes A non-spill pump system is to be used to draw crankcase oils out through the dipstick. Slip a plastic bag over used oil filters prior to their removal to capture any drips. Hot drain the filter by punching a hole in the dome end and draining for 24 hours. Recycle collected oil. Oil can be recycled at the Dutchtown Convenience Center and the Solid Waste Management Facility.

SECTION 4 - VESSEL OPERATIONS, MAINTENANCE & REPAIR Members are encouraged to use nontoxic, high-bonding, low volatile organic compound (VOC) content, easily cleaned boat bot- Avoid pumping any bilge water that is oily or has a sheen on it. Use of bilge socks, bioremediation pads or biosocks with natural oileating bacteria is encouraged. When antifreeze is required to winterize plumbing, use propylene glycol (pink) antifreeze instead of toxic ethylene glycol antifreeze. Additives to pressure washing for cleaning are discouraged. Use “nontoxic” and “phosphate-free” cleaners. Use a vacuum sander to capture and filter pollutants. Alternatively, tarps, screens and filter cloths may be used. Clean hull maintenance areas immediately after any maintenance activity.

SECTION 5 - MARINA SITING, DESIGN & MAINTENANCE Emergency numbers are posted next to the phone in the clubhouse.

SECTION 6 - STORMWATER MANAGEMENT & EROSION CONTROL Practices are implemented in the club design.

SECTION 7 - PUBLIC EDUCATION Cleaning of fish within club limits is discouraged.
