This is to inform you that I have disapproved portions of House Local Bill No. 19-79, Sl,
which proposes to appropriate the sum of $330,293.13, for the needs of the municipality of
the First Senatorial District; and for other purposes.
Pursuant to my authority under 1 CMC § 1405(b), I have line-item vetoed the appropriation
of $30,000 to pay Dr. James Toskas and Dr. Francois Claassens $15,000 each. It is unclear
that the appropriations to these individuals serve a compelling public purpose for which
funds may be expended. Benefits that accrue to individuals may serve a public purpose if
the "community has an interest in having those individuals benefitted." 1 CMC § 121(e).
These payments are on top of their compensation terms in their written contracts for
"administrative leave" that was purportedly agreed to by a former Resident Director of the
Rota Health Center, who incidentally did not have any authority to enter into such an
agreement with the doctors.
This bill becomes Rota Local Law No. 19-14. Copies bearing my signature are forwarded for

A LOCAL APPROPRIATION BILL FOR AN ACT FOR THE FIRST SENATORIAL DISTRICT
To appropriate the amount of $330,293.13 for the needs of the municipality of the First Senatorial District; and for other purposes.
BE IT ENACTED BY THE FIRST SENATORIAL DISTRICT DELEGATION PURSUANT TO
CHAPTER 4, DIVISION 1, TITLE 1 OF THE COMMONWEALTH CODE:
Section 1. Findings and Purpose. The Rota Legislative Delegation acknowledges that
2 Rota Local Law 18-15 appropriated the $2,000,000.00 allotted to the First Senatorial District
3 under Public Law No. 18-56. RLL 18-15 specifically appropriated $ 1,619,706.87 for the
4 payment of the 25 percent retirement cut restoration for the retirees and surviving beneficiaries
5 of the First Senatorial District and $50,000.00 for the payment of the debt owed to the Saipan
6 and Northern Islands Legislative Delegation. In addition, it specifically "reserved for
7 prospective payments of the 25% retirement cut restoration for the retirees and surviving
8 beneficiaries of the First Senatorial District and shall be deposited into a special account,
9 separate from the general account of the First Senatorial District, to be appropriated at a later
10 time for disbursement."
lI The Rota Legislative Delegation finds that the 25 percent pension restoration has been
12 satisfied and that the reserved amount of $330,293.13 has not been appropriated. Therefore,

the purpose of this Act is to appropriate the reserved amount for other needs of the
2 municipality of the First Senatorial District.
3 Section 2. Appropriation. Notwithstanding Section I(c) of Rota Local Law 18-15,
4 the amount of $330,293.13 is appropriated for other needs of the First Senatorial District as
5 follows:
6 a. $33,500.00 for the medical subsistence of the Rota hemodialysis and terminally ill
7 patients as listed in Attachment "A". The expenditure authority of this appropriation shall be
8 the Secretary of Finance;
9 b. $ 10,000.00 to cover the costs of freight and handling of Rota patients' medical
10 specimens sent from Rota to the CHCC laboratory in Saipan. The expenditure authority shall
II be Resident Director of the Rota Health Center;
12 c. $20,000.00 for the Rota Casino Gaming Commission under the expenditure
13 authority of the Chairperson of the Commission;
14 d. $20,000.00 to pay the obligation owed to SEAS for the Paradise Hotel lodging
IS charges. The Secretary of Finance shall be the expenditure authority;

19 f. $40,000.00 for the Rota Municipal Scholarship for Spring semester 2017 grants
20 under the expenditure authority of the Chairperson of the Rota Municipal Scholarship;
21 g. $35,000.00 to purchase a vehicle for the Office of the Mayor of Rota. The
22 expenditure authority shall be the Mayor of Rota;
23 h. $6 1,000.00 to pay the outstanding obligation to Rota employees for the salary

adjustments pursuant to P.L. 7-31. The expenditure authority shall be the Secretary of
2 Finance;
3 1. $25,000.00 to purchase an automatic sliding door for the Rota Aging Center. The
4 expenditure authority shall be the Director of Rota Aging Program, Ms. Valerie Apatang;
5 j. $8,000 to update the Chamorro dictionary and fund other projects of the non-profit
6 organization lnelnul Arnot yan Kutfuran Natibo. The expenditure authority shall be
7 Chairperson Isidro Cabrera;
8 k. $3,009.63 to pay the balance owed to JAG for construction services rendered. The
9 expenditure authority shall be the Secretary of Finance; and
10 I. 44,783.50 for the operations of the Office of the Mayor of Rota under the
II expenditure authority of the Mayor of Rota.
12 Section 3. Severability. If any provision of this Act or the application of any such
13 provision to any person or circumstance should be held invalid by a court of competent
14 jurisdiction, the remainder of this Act or the application of its provisions to persons or
15 circumstances other than those to which it is held invalid shall not be affected thereby.
16 Section 4. Savings Clause. This Act and any repealer contained herein shall not be
17 construed as affecting any existing right acquired under contract or acquired under statutes
18 repealed or under any rule, regulation or order adopted under the statutes. Repealers contained
19 in this Act shall not affect any proceeding instituted under or pursuant to prior law. The
20 enactment of the Act shall not have the effect of terminating, or in any way modifying, any
2 1 liability, civil or criminal, which shall already b e in existence on the date this Act becomes
22 effective.
23 Section S. Effective Date. This Act shall take effect upon its approval by the
24 Governor or its becoming law without such approval.
