Items G 1 and G 2 were brought forward and dealt with at this time.

Brian Johnston, resident of Brampton, expressed his concerns and displeasure with the position of the Taxicab Advisory Committee (TAC) regarding the Threshold Policy, as outlined in Recommendation TC014-2013 (Item G 2). Mr. Johnston highlighted the following: Ensuring public safety is a priority Serious nature of Code 06 offences outlined in the Threshold Policy Actions of the TAC at the April 8, 2013 meeting and the impact of

its position (Recommendation TC014-2013), which would allow taxicab drivers to maintain their taxicab driver licences if they are convicted of a Code 06 offence

Request that Committee approve the staff recommendation that no change be made to the Threshold Policy

The need to maintain a higher standard for professional drivers The need to apply the Threshold Policy consistently for all mobile

licences

Karam Punian, resident of Brampton and taxicab industry member (Airport Taxicab Service), submitted the following concerns regarding the Threshold Policy: Inconsistency with provincial licensing standards Length of time taxicab drivers are on duty (12-14 hours daily) Convictions that can result in a licence refusal and the resulting

financial and personal impact (e.g. inability to support family) Language barrier in the industry and a lack of awareness /

understanding of the Threshold Policy GTAA expectations of airport taxicab services Average age of taxicab drivers (50+) and challenges in finding

alternate employment if a licence is refused Impact of a licence refusal on the ability to maintain a taxicab plate Opinion that a taxicab driver licence should not be refused,

provided the provincial driver licence is valid

Lynn Slade, Taxicab Advisory Committee Member (Driver Representative), submitted the following concerns regarding the Threshold Policy: An indication that careless driving convictions may result from

accidents that occur during poor weather conditions Higher rate of tickets issued to taxicab drivers over the average

driver due to the number of hours taxicab drivers are on duty Impact/hardship of a licence refusal on a taxicab driver/plate owner

Makhan Dhother, Taxicab Advisory Committee Member (Broker Representative), submitted the following concerns regarding the Threshold Policy: Lack of awareness / understanding of the Threshold Policy Broadness of a careless driving conviction and the varying severity

of incidents which may result in such a conviction (e.g. accidents which occur as a result of poor weather conditions)

Opinion that the Threshold Policy is too harsh as it relates to the careless driving conviction and a request that staff review this issue, which is a major concern for the taxi industry

Average number of hours taxicab drivers are on duty on a daily basis

Daljit Gill, resident of Brampton, submitted the following concerns regarding the Threshold Policy: Financial hardships of taxicab drivers Potential for wrongful careless driving convictions Timelines and process for filing an appeal to the Brampton Appeal

Tribunal (BAT) and concern that taxicab driver licences are suspended until such time a decision is issued by the BAT

Lack of awareness / understanding of the Threshold Policy

Sam Grewal, resident of Brampton and Taxicab Driver, submitted the following concerns regarding the Threshold Policy: Average number of hours taxicab drivers are on duty on a daily

basis Understanding of the responsibility of taxicab drivers for their safety

and that of their passengers High insurance rates and the impact of convictions on these rates Serious impact of convictions on taxicab drivers and an indication

that drivers make every effort to drive responsibly to avoid any incidents

Consideration of an applicant’s experience and history (driving and criminal records) in the review of licence applications

Question as to why Brampton’s standards for driving are higher than provincial standards

Amarjit Grewal, Taxicab Advisory Committee Member (Plate Owner Representative), submitted the following concerns regarding the Threshold Policy: Lack of awareness / understanding of the Threshold Policy An indication that drivers endeavour to drive responsibly to avoid

any incidents and that despite their best efforts, mistakes do occur

Zafar Tariq, Taxicab Advisory Committee Member, submitted the following concerns regarding the Threshold Policy: An indication that the taxicab industry was not consulted prior to the

approval of this policy An indication that the Cities of Mississauga and Vaughan do not

have a Threshold Policy Opinion that the consequences for careless driving convictions are

too harsh, noting that there is no intent to cause the incident (e.g. accidents during poor weather conditions)

Impact of a licence refusal on taxicab drivers and their ability to maintain a taxicab plate (e.g. inability to support family)

Consideration of an applicant’s experience and history (driving and criminal records) in the review of licence applications

Request that Committee support the position of the TAC outlined in Recommendation TC014-2013

BAT appeal process and concern that taxicab driver licences are suspended until such time a decision is issued by the BAT

Committee discussions took place with respect to the following: Discussion at the April 8, 2013 TAC meeting regarding the careless

driving conviction Broadness of a careless driving conviction and the varying severity

of incidents which may result in such a conviction Consideration of the circumstances that result in a careless driving

conviction Clarification from staff that the Threshold Policy is enforced based

on convictions only, and not on allegations or charges Court process and incidence of charges being downgraded Explanation of the process when a taxicab driver is charged with

careless driving Role of the BAT and clarification of the appeal process and

timelines Clarification that the Threshold Policy has been in place since 2008 Staff recommendation that the Threshold Policy not be changed

and clarification that this policy applies to all mobile licences in the Licensing By-law

Acknowledgement that the TAC has been successful in keeping an open dialogue regarding issues affecting the industry, while maintaining respect for all participants

Acknowledgement that in a careless driving conviction, there is no intent to cause the incident

o It was noted that all other Code 06 violations involve a deliberate act

Request that staff review the appeal process as it relates to the careless driving conviction only, and that the concerns raised by the industry be taken into consideration including, length of time drivers are on duty, years of experience, driving record, livelihood, appeal process timelines, etc.

Number of licensed taxicab drivers and the number of licences refused under the Threshold Policy between 2008 – 2010

The City’s priority to ensure public safety Clarification of the Threshold Policy as it relates to the suspension

of a taxicab licence resulting from an accumulation of nine (9) or more demerit points

Practice by staff to apply the Threshold Policy consistently without discretion in all circumstances, and that consideration of the events which result in a careless driving conviction are dealt with by the BAT

Concern regarding the practice to suspend a taxicab driver licence until such time a decision is issued by the BAT, and the impact this has on the driver

Request for information on the types of offences that result in careless driving convictions

Suggestion that leniency be granted to experienced drivers with good driving records

Impact of insurance rates on taxicab drivers Threshold policies in other municipalities and an indication that the

Cities of Mississauga and Vaughan are reviewing options for a threshold policy.

o The current process for reviewing licence applications in the City of Mississauga.

Standards for City employees that operate municipal vehicles o It was noted that the threshold for staff to lose a licence is six

(6) demerit points

A motion to “call the question” to end the debate was introduced. A vote was taken after each Member who wished to speak on the matter had spoken once. The motion was considered, voted on and carried on a majority vote.

4. That no change be made to the current Threshold Policy, Appendix G of Licensing By-law 1-2002, as amended; and,

5. That staff be requested to undertake a review of the appeal process for all mobile licensing provisions, under Licensing By-law 1-2002, as amended, and specifically the Threshold Policy, as it relates to careless driving convictions only, and report back to Committee of Council.

Bisson, Manager of Licensing Enforcement, Corporate Services, dated April 2, 2013, to the Taxicab Advisory Committee Meeting of April 8, 2013, re: Peel Regional Police Report – Taxicab Camera Downloads (File G25) be referred back to staff to review and provide information to a future Taxicab Advisory Committee Meeting regarding: options for a phased-in approach for the installation of an

upgraded taxicab camera system in all existing taxicab vehicles;

requirement/timeline for new taxicab vehicles to be equipped with an upgraded taxicab camera system;

advisability of requiring a liability waiver to be signed by taxicab drivers/owners who choose not to install an upgraded taxicab camera system their taxicabs.

TC013-2013 1. That the report from J. Bisson, Manager of Licensing Enforcement, Lost Corporate Services, dated April 2, 2013, to the Taxicab Advisory

Committee Meeting of April 8, 2013, re: Licensing By-law 1-2002, as amended – Concerns Relating to the Threshold Policy (Appendix G) (File G02) be received; and,

2. That no change be made to the current Threshold Policy, Appendix G of Licensing By-law 1-2002.

TC014-2013 That it is the position of the Taxicab Advisory Committee that the Threshold Policy (Appendix G of Licensing By-law 1-2002, as amended) be amended to provide that Code 06 violations not result in the refusal, revocation or suspension of a taxicab driver licence, provided the provincial driver licence remains valid.

TC015-2013 That the correspondence from Brampton Taxicab Drivers, to the Taxicab Advisory Committee Meeting of April 8, 2013, re: Brampton Taxicab Drivers Financial Crisis be received.

TC016-2013 That the Taxicab Advisory Committee do now adjourn to meet again on Monday, June 10, 2013 at 1:00 p.m., or at the call of the Chair.

SC042-2013 1. That the request from Beryl Ford, Trustee, Peel District School Board, re: Request for Site Inspection at Hilldale Public School – 100 Hilldale Crescent – ward 07 (File G25SA) be received; and,

2. That a site inspection be undertaken

SC043-2013 1. That the site inspection report dated March 20, 2013, to the Brampton Safety Council Meeting of April 4, 2013, re: Sir Wilfrid Laurier Public School – 364 Bartley Bull Parkway– Ward 3 (File G25SA), be received; and,

2. That Peel Regional Police be requested to monitor Bartley Bull Parkway in front of the school property for possible vehicles speeding during arrival and dismissal times.

3. That the Works and Transportation Department be requested to install corner restriction signage on Bartley Bull Parkway, both sides of the bus entrance driveway and at the North and South Parking lot driveways, and “No Stopping” restrictions at the crossing guard location.

4. That the Public District School Board be requested to either widen the bus lane to two driveways so buses can enter and exit with vehicles using the same driveway for a kiss and ride, extending bus lane from the south to the north side of the school in order to make a larger area for parents to use as a kiss and ride area.

SC044-2013 1. That the site inspection report dated March 21, 2013, to the Brampton Safety Council Meeting of April 4, 2013, re: Beryl Ford Public School – 45 Ironshield Drive – Ward 10 (File G25SA), be received with the addition of two recommendations to the site inspection; and,

2. That the party responsible for the missing fence along Natronia Trail be requested to install it as soon as possible.

3. That the Peel District School Board be requested to fix the broken speed bumps.

4. That Works and Transportation be requested to install corner restriction signage on both sides of the entrance and exit driveways.

5. That the Manager of Traffic Engineering Services, Works and Transportation, be requested to implement “No Stopping, Monday to Friday, 8 a.m. To 5 p.m.” on the west side of Ironshield Drive from Gentry Way to Idaho Road, and on the south side of Natronia Trail for the length of the school property.

6. That the Peel District School Board Planning Department and the Beryl Ford School Staff be requested to work together to provide a kiss and ride configuration that works well during the morning and evening dismissal times.

7. That Fire Prevention, be requested to conduct an inspection of the property to ensure it meets code, and or make recommendations as to what may be necessary for compliance.

8. That when the Peel District School Board, Planning Department and Beryl Ford School Staff determine whether or not and how they are going to do a kiss and ride, and a follow-up site inspection be undertaken.

SC045-2013 1. That the site inspection report dated March 28, 2013, to the Brampton Safety Council Meeting of April 4, 2013, re: Glendale Public School – 35 Sunset Boulevard – Ward 5 (File G25SA), be received; and,

2. That the principal be requested consider the idea of blocking off both the entrance and exit to the driveway on Sunset Boulevard while the bus is loading and unloading to reduce confusion and ensure the safety of the students in both the a.m. and p.m.; and,

3. That the principal be requested to use the school newsletter to notify parents/guardians that a new accessible parking spot has been approved and will be installed in May 2013, weather permitting.
