In relations to Main Modification 8, which introduces a new housing allocation at Land off Lantern Lanein East Leake to recognise the recent granted planning permission, in terms of Minerals, the CountyCouncil welcomes the inclusion within the development requirement text that a detailed geotechnicaland mining study should be undertaken to ensure an acceptable buffer between the gypsum miningoperations and the development. This acknowledges the nearby mineral extraction and addressesPolicy SP8 in the Draft Nottinghamshire Minerals Local Plan (July 2018).

The County Council has raised concerns in pervious consultation stages which do not appear to havebeen addressed within MM15.The allocated site for development is approximately, at its closest extent,650m North-East of the active composting facility off Stragglethorpe Road. Since the composting facilityis open air and being of a type that emits significant amounts of bioaerosols, even though the allocatedsite may be a considerable distance from the waste facility, our monitoring officers have highlightedthat, on occasion, odour may be detectable at the allocated site. The County Council therefore advised,and continues to, that in accordance with Nottinghamshire and Nottingham Waste Core StrategyPolicy WCS10 (safeguarding waste management sites), that it be noted in respect of this allocationthat the design of housing on this site (their orientation and placement within the allocation) be in amanner that provides as large a buffer as possible to the waste facility, as in doing so it may be possibleto accommodate non-waste development in these locations. In line with the accompanying text forWCS10 this could be possible through, for example, making changes to the proposed layout of anyhousing or mixed-use scheme and use of parking or landscaping areas to provide a buffer zone.

The amendments to Policy 5:1 do not take into consideration the above comments and the CountyCouncil would advise that Rushcliffe Borough Council do consider the waste management facility andconsider how any potential environmental impacts could be limited at the proposed residential sitethrough landscaping and layout and so prevent the sterilisation of a permitted waste managementfacility as per Policy WCS10 in the Nottinghamshire and Nottingham Waste Core Strategy, which formspart of Rushcliffe’s Local Development Framework.

Policy 39: Health impacts of development

PHE Healthy Places has highlighted in a recent Introduction to planning for health and Healthy Places support seminar stated thatHealth Impact Assessments (HIA’s) allow for a systematic and specific process for enhancing benefits of health and wellbeing in thedevelopment management process and have cited councils that have adopted this approach including Wakefield.. (see embeddedlink for further details).

In regards to the rationale for 50 dwellings, the first stage of the HIA is screening where a decision is made about whether to requesta HIA and this is where the statement to provide a number of dwellings is useful to provide as a benchmark¹. Evidence suggests`that planning policies needs to be clear as to when an HIA is required and a screening checklist/ process(such as the NottinghamshireHealth Impact Assessment Checklist) is used so that the decision is robust and also so that across an organisation a measure ofconsistency regarding HIA can be achieved ¹’ Therefore the statement to provide a number of dwellings in this instants 50 dwellingsis deemed as the required `measure of consistency’ supports the initial statements in Policy 39 within in Rushcliffe LDP.

Data from 2010-12 onwards have been revised to use IMD 2015 to define local deprivation quintiles (fifths), all prior time points use IMD 2010. In doing this, areas are grouped into deprivation quintiles usingthe Index of Multiple Deprivation which most closely aligns with the time period of the data. This provides a more accurate way of examining changes over time by deprivation.

In relation to Main Modification 52, which amends policy 42: Safeguarding minerals, the County Council,from a minerals perspective, welcomes the inclusion of encouraging prior extraction in Mineralsafeguarding areas where practical and feasible. This is in line with Local Policy, SP8 in the DraftNottinghamshire Minerals Local Plan (July 2018) and the National Policy Planning Framework(paragraph 204, part d). Also, the inclusion of Mineral Safeguarding Area Map in Figure 11 is one ofthe ways the Planning Practice Guidance (paragraph 005, 2014) recommends how District and BoroughCouncils can play a role in safeguarding minerals and so the County Council also welcomes this mapbeing within the Rushcliffe’s Local Plan Part Two.

1) Paragraph d) of MM25 below will be difficult to comply with as you do not define new or existing. Suggestthe following wording: “Sustainable drainage measures should be used to help ensure the development isnot at risk of surface water flooding and does not increase the risk of flooding to the surrounding areas”

2) The paragraph shown below is not specific enough and may not ensure protection of new properties.Suggest the second sentence reads: “Therefore development of this allocation should ensure all newproperties are not put at risk of surface water flooding and the development does not increase the risk offlooding to surrounding areas.
