1 Comhairle Contae Chorcaí Treorlínte don foirm Iarratas Pleanála Úsáidfeá an cáipéis seo mar leabharán miniúcháin don foirm Iarratas Pleanála, an Comhairle Contae Chorcaí. Tugann sé sonraí faoi na liníochtaí agus cáipeisí atá á teastáil chun iarratas a dheanamh agus freisin tugann sé treoracha chun gur féidir leat fógraí suíomh, fógraí nuachtáin, agus taifead na structúr feirme a líonadh. Téann gach nóta ar an leabharán seo díreach leis an ceist leis an uimhir comh-freagrachas ar an foirm ó ceist 1 – 64. Tabhair san aird go mbeadh an comhairle ag foilsiú na h-iarratais pleanála ar an idirlíon www.corkcoco.ie ó 05/09/2011. I gcomhréir le na hAchtanna faoi Cosaint Sonraí 1988-2003 beidh sonraí teagmhála an iarratasóir agus an gniomhaire coimeadtha faoi rún ag an Comhairle. Tá sé curtha in iúl duinn le deanaí go bhfuil na liostaí sin á usáid ag roinnt daoine agus cuideachtaí i gcóir margaíochta díreacha. Anois, tar eis éileamh ón Coimisinéar Cosaintí Sonraí tá seans ag gach Iarratasóir taispeáint ar an foirm má bhfuil siad sásta margaíocht díreacha a fháil mar toradh an iarratas. Má ta tú sasta do sonraí teagmhála a fhágáil ar an foirm le feicáil ag aon tríú pairtí cuir tic sa bhosca ar leathnach a dó (2) ar an foirm. Treorlínte don foirm Iarratas Pleanála

Úsáidfeá an cáipéis seo mar leabharán miniúcháin don foirm Iarratas Pleanála, an Comhairle Contae Chorcaí. Tugann sé sonraí faoi na liníochtaí agus cáipeisí atá á teastáil chun iarratas a dheanamh agus freisin tugann sé treoracha chun gur féidir leat fógraí suíomh, fógraí nuachtáin, agus taifead na structúr feirme a líonadh. Téann gach nóta ar an leabharán seo díreach leis an ceist leis an uimhir comh-freagrachas ar an foirm ó ceist 1 – 64. Ní mór 6 chóip den foirm, a bheidh comhlánaithe go cuí, a lóisteáil san Oifig Pleanala atá cuí, agus iad seo a leanas a bheith isteach leo:- [1] Sceideal Ta sceideal dos na liníochtaí, pleananna, learscáileanna le na ainmneacha/uimhireacha san áireamh a teastáil [2] Learscáileanna don suíomh 6 chóip a bheidh priontáilte go soiléir de (a) Learscáil do scála 6’’ le 1 míle nó 1:10,560, an saghas is lú A4, agus (b) Learscáil do scála 25’’ nó 1:2500, an saghas is lú A3 Ba choir go mbeadh an stampa oifigiúl don Suirbhéireachta Ordnáis na hEireann iontu. Ba chóir go mbeidís seo bunaithe ar nó tógtha as Bunbhileog Suirbhéireachta Ordanáis agus go mbeadh léiriú iontu ar na nithe seo a leanas:- a) Uimhir Bhileog Ordanáis Cuí b) Baile Fearainn c) Sonraí ar ghnéithe sa chomharsanacht trína n-aithnítear an suíomh m.sh. foirgnimh, crosbhóithre,

teorainneacha páirceanna, sainchomharthaí tíre, fad ó bhailte agus sráidbhailte in aice láimhe rle. d) Feiceáil shoiléir, trí iad a bheith marcáilte nó daite le dath dearg, a bheith ar an talamh nó struchtúr lena

mbaineann an t-iarratas agus ar a dteorainneacha e) Aon talamh atá ceangailte, in aice nó ag síneadh leis an talamh atá le forbairt agus atá faoi smacht an

iarratasóra nó an duine atá in úinéireacht na talún faoi iarratas, a bheith imlínithe le dath gorm f) Na ceada slí le dath buí. g) Na Teorainneacha agus iad díreach mar a chéile leo siúd atá léirithe sa phlean den leagan amach h) An áit ina bhfuil an Fhógra Suíomh/na bhFógraí Suíomh crocadh marcáilte le “X” (Féach nótaí maidir le:

ballaí suntasacha crann agus gnéithe eile atá ar, in aice nó i gcomharsanacht na talún nó an struchtúir a léiriú. c) Ní mór leibhéil nó comhriain, nuair is cuí, den talamh agus de na struchtúir bheartaithe a bhaineann le Tagra

[4] Sonraí ar Chóireáil Eisilteach Nuair atá sé beartaithe fáil réidh le fuíolluisce ón bhforbairt bheartaithe ar bhealach eile seachas trí shéarach poiblí, tabhair faisnéis ar an gcóras cóireála ar an suíomh agus fianaise maidir lena oiriúnaí is a bheidh an suíomh don chóras atá beartaithe m.sh. Tógra speisialta ar an suíomh torthaí tástála síothlúcháin rle, de réir Chód Cleachtas an E.P.A. 2009, Ba cheart go mbeadh 2 chóip don foirm sin agus sonraí an córas cóireála a chur leis an iarratas. Ó 08/01/2010 Caithfidh an Údarás Pleanála a bheith cinnte go bhfuil gach teach atá ceadaithe in áit gan searach poiblí tar éis measúnú ar oiriúnacht an súiomh a dheanamh, ag úsáid an modheolaíocht atá leagtha amach ins an Chód Cleachtas an EPA (An gníomhaireacht Cosaint an Chomhshaoil). Caithfidh go mbeadh sé suas go dtí an caighdean is gá. Ní déanann an Comhairle na measúnú suíomh, is duine oilte & priobháideach a deanann é seo. Tabhair faoi deara gur conradh priobháideach é an conradh idir measúnóir agus an iarratasóir. I gcomhréir le Airteagal 22(2)(c) dos na Rialacháin Pleanáil agus Forbairt 2006 caithfear an measúnú agus an iarratas pleanála a thaisceadh ag an ám céanna. Caithfidh tú an Foirm a Thréithriú Suíomh a usáid chun na toradh/eolas a thaispeáint. Ba chóir a thabhairt faoi deara má baineann an iarratas le forbairt conaithe do níos mó ná teach amháin, áit a bhfuil sé beartaithe coras cóireáila aonar a cur ar fáil do gach teach, tá foirm ar leith á teastáil do gach aon suíomh teach [5] PLEANANNA, INGEARCHLÓNNA AGUS GEARRTHACHA Ní mór 6 chóip, a bheidh priontáilte go soiléir agus le toisí cuí, de phleananna, ingearchlónna agus gearrthacha na struchtúr atá beartaithe a sheoladh isteach, a thaispeánann iad seo a leanas: (a)Tarraingthe ar scála méadrach nach bhfuil níos lú 1/200 (léirithe) nó scála eile réamhaontaithe. Bí cinnte go bhfuil an scála thaispeánta ar gach liníocht/learscáil. (b)Ba cheart go léiríonn na liníochtaí príomhthréithe aon fhoirgneamh a bheadh in aice leis an struchtúr beartaithe dá mbeadh sé tógtha, bíodh sin ar an suíomh nó sa chomharsanacht (ar scála nach bhfuil níos lú ná 1/200 mar is cuí). (c) Sa chás gur obair atá i gceist ar Struchtúr faoi Chosaint nó Struchtúr atá Beartaithe a chur faoi Chosaint, ní mór léiriú a thabhairt sna hingearchlónna ar phríomhthréithe aon fhoirgneamh laistigh de chúirtealáiste an struchtúir, a mbeadh tionchar thábhachtach ag an bhforbairt atá beartaithe air. (d) Pleananna a bhaineann le hobair athchóirithe, le hathruithe nó le síneadh ar struchtúr, a bheith daite le deighilt a dhéanamh idir forbairt atá ann cheana agus forbairt atá beartaithe. (e) Tabharfar príomhthoisí pleananna urláir, ingearchlónna agus gearrthacha d’aon struchtúr atá beartaithe i bhfigiúir (ag áireamh an airde iomlán). (f) Ní mór an Pointe “T” a mharcáil ar na pleananna urláir.

[6] An Foirm Iarratas Bréise Tá an Foirm Iarratas Bréise ann le cabhrú le daoine atá ag iarradh cead a fháil do teach laistigh do limistéar ina bhfuil srianta pleanála dian ann. Is feidir leis an Údarás na srianta sin a maolú i roinnt cásanna i gcóir daoine áitiúl. Caithfidh éinne atá ag iarradh teach a thogáil laistigh do cheann dos na 6 limistéar faoin tuath atá luaite san Plean Forbartha an Chontae 2014 an foirm seo a líonadh. Is feidir leat na limistéar seo a fheicáil ins na learscáileanna san Plean Forbartha an Chontae, nó ar an Coras Fiosrúcháin Pleanála ar ár suíomh gréasán .Tá an foirm le fáil ag ár gcúntar poiblí agus ar an suíomh idirlíon.Tá treóirlintí ar an foirm le cabhrú conas a lionfeá é. Ba chóir duit 2 chóip don foirm a cur i dteannta leis an iarratas pleanála. [7] Fógra Suíomh 2 chóip d’fhógra(í) suíomh atá crochta nó socraithe ar an talamh nó ar struchtúr. Ba choir go mbeadh 2 chóip lionta isteach agus curtha isteach go dtí an údaras pleanála leis an foirm iarratas freisin Caithfidh an fógra:

(a)A bheith in áit fheiceálach ar nó in aice leis an bpríomhbhealach isteach (b) Má tá níos mó ná bealach isteach amháin ann, a bheith ar nó in aice gach bealach isteach den tsórt

seo nó ar aon chuid den talamh nó struchtúr atá sínte le bóthar poiblí. (c) Mura bhfuil suíomh/struchtúr sínte le bóthar poiblí, caithfear é a chur ar an talamh nó struchtúr,

ionas go mbeidh sé le feiceáil agus le léamh go soiléir ag daoine a bheidh taobh amuigh den talamh nó struchtúr.

(d) Uaireanta nuair nach leor é fógra amháin a úsáid, Mar shampla, níl an suiomh ar bother poiblí, nó tá nios mó ná bother amháin , bealach amhain go dti an suíomh 7rl, caithfear nios mó ná fógra amháin a crocadh.

(e) Caithfear dúch inscriosta ar chúlra Bán a úsáid do ghreanadh nó priontáil an fhógra/na bhfógraí suíomh

(f) Ba choir go mbeadh said greamaithe ar ábhar dolúbtha seasmhach agus slán i gcoinne damáiste ó dhrochaimsir agus damáistí eile

(g) Gan a bheith i bhfolach nó clúdaithe as radharc ag am ar bith (h) Ná croch an fógra ar geata.

Má raibh aon iarratas bailí ar cuid de nó iomlán an suíomh laistigh de 6 mhí roimh an iarratas nua seo, ní mór don fógra suíomh a bheith mar ata leagtha amach ag notaí (a)-(d)agus (f) do nóta uimhir a 7 thuas, ach é a bheith ar chúlra buí

Cinntigh le do thoil nach bhfuil an Fógra/na Fógraí socraithe ar an suíomh níos mó ná 14 lá roimh an dáta ar lóisteáileadh an t-iarratas leis an Údarás Pleanála agus gan a bheith dátaithe nios deanaí ná an lá ar a faigheann an t-Údarás an iarratas. Cinntigh go bhfágtar socraithe nó crochta ar an suíomh é de réir na riachtanas thuas ar feadh tréimhse na 5 seachtaine ón dáta ar lóisteáileadh an t-iarratas. Má thógtar anuas an Fógra Suíomh, má scriostar é nó má bhíonn sé doléite laistigh den tréimhse 5 seachtaine caithfear an fógra a dheisiú nó ceann nua a chur ina áit. Caithfear an data ar a raibh an fógra crochta suas a scriobh ar. Caithfear siniú an iarratasóir, nó siniú agus seoladh an gniomhaire a leiriú ar an bhfógra. Ní mór go n-áireofaí ar an bhFógra/na Fógraí Suíomh, an t-eolas uilig atá sonraithe sna sonraí míniúcháin atá iniata leis an bhFógra Suíomh. Cur Sios ar an forbairt

1. Más forbairt tithiocht é – Dean cur síos ar líon na tithe (Cé mhéid) san fógra. 2. Más iarratas do cead coinneála i gcóir structúr atá i gceist – Dean cur síos ar úsáid an structúr agus,

más cuí, treimhse an cead coinneála san fógra 3. Mas iarratas do obair ar struchtúr faoi chosaint nó ar struchtúr atá beartaithe a chur faoi chosaint -

caithfear é seo a rá san fogra

4. Má tá an forbairt atá beartaithe láistigh de Limistéar Forbairt Straitéiseach – Caithfear é seo a rá san fógra

5. Más é an forbairt atá i gceist ná ceann don cineál luaite i sceideal 5 dos na Rialachán Pleanáil agus Forbairt 2001 – i.e. Ráiteas Tionchar Timpeallachta (R.T.T.) á teastáil (Forbairt conaithe ar scála mór). Caithfidh tú é seo a rá son Fógra Suíomh

Nuair atá R.T.T. iniata leis an iarratas, ní mór an ráiteas seo a leanas maraon leis na gnéithe abhartha eile atá liostaithe anseo a áireamh sa bhFógra Suíomh

[i] “ Beidh an R.T.T. loisteáilte isteach go dtí an Údarás Pleanála leis an Iarratas Pleanála”

[ii] “Beidh fáil ar an R.T.T. le hiniúchadh nó le ceannach ar tháille nach mbeadh níos mó ná an costas réasúnta a bheadh ar chóip a dhéanamh le linn uaireanta oscailte poiblí ag oifigí an Údaráis Phleanála.”

6. Cinntigh, agus tú ag deanamh an cur síos ar an forbairt atá beartaithe go bhfuil an cur síos ar an cineál agus méid an tógra ceart agus soléir. Caithfear é a rá más iarratas é i gcóir ‘togáil, ‘athchóiriú’ nó ‘scartáil’ atá ann, agus caithfear é a rá cen saghas talamh/structúr ata i gceist freisin, mar shampla, más sineadh nó athchoiriú teach atá beartaithe caithfear a rá “sineadh teach”, nó “athchóiriú teach”

Nóta Tabhachtach: Ní mór go luafaí an méid seo a leanas sa bhFógra Suíomh maraon leis na nithe eile: “Is féidir an tIarratas Pleanála a iniúchadh nó a cheannach ar tháille nach mbeadh níos mó ná an costas réasúnta a bheadh ar chóip a dhéanamh ag oifigí an Údaráis Phleanála le linn a huaireanta oscailte poiblí agus gur féidir aighneacht nó barúlacht i ndáil leis an iarratas a dhéanamh i scríbhinn chuig an Údarás laistigh de thréimhse na 5 seachtaine dar thús an dáta a fhaigheann an tÚdarás an t-iarratas, ach an táille atá leagtha síos a íoc.Beidh aon aighneachtaí agus bharúlacha den sórt sin a chur san áireamh ag an údarás pleanála agus é ag déanamh cinneadh maidir leis an iarratas. Féadfaidh an t-údarás pleanála cead a dheonú faoi réir coinníollacha nó gan choinníollacha, nó is féidir diúltú cead a dheonú.”.

Tá treoracha do comhlanú an fógra le fáil freisin ar chúl an fógra suíomh.

[8] Fógra Nuachtáin 2 chóip den leathanach ábhartha de nuachtán faofa atá scaipeadh go h-áitiúil, agus fógra ag foilsiú intinne an iarratasóir chun an iarratas i gcóir cead a dheanamh, ní mór go n-áireofaí dáta agus teideal an nuachtáin (Tá liosta dos na nuachtáin faofa ag an Comhairle iniata leis an cáipéis seo. ) Caithfidh an t-eolas seo a leanas a bheith sa bhFógra:-

(a) Ceannteideal “COMHAIRLE CONTAE CHORCAÍ” (b) Ainm an Iarratasóra (c) Suíomh, Baile fearainn nó seoladh poist na talún nó an struchtúir lena mbaineann an t-iarratas. (d) Caithfear rá air cé acu seo atá i gceist:

(1)Cead (2)Cead Coinneála (3)Cead de thoradh Cead Imlíneach a Deonaíodh. (Ní mór an Uimh. Chláraithe den Chead Imlíneach cuí a áireamh anseo)

(e) Cineál agus méid na forbartha (1) Más tithíocht atá i gceist, líon na dtithe

(2) Sa chás gur coinneáil ar struchtúr atá i gceist, an cineál úsáide atá i gceist agus más cuí, tréimhse na coinneála

(3) I gcás oibreacha ar “Struchtúir faoi Chosaint” nó “Struchtúir atá beartaithe a chur faoi Chosaint”, an fhíric sin a thabhairt

(4) I gcás forbartha i “gCrios Forbartha Straitéiseach” an fhíric sin a thabhairt (5) Más é an forbairt atá i gceist ná ceann don cineál luaite i sceideal 5 dos na Rialachán

Pleanáil agus Forbairt 2001 – i.e. Ráiteas Tionchar Timpeallachta (R.T.T.) á teastáil (Forbairt conaithe ar scála mór). Caithfidh tú é seo a rá son Fógra Nuachtáin

Nuair atá R.T.T. iniata leis an iarratas, ní mór an ráiteas seo a leanas maraon leis na gnéithe abhartha eile atá liostaithe anseo a áireamh sa bhFógra Suíomh

[i] “ Beidh an R.T.T. loisteáilte isteach go dtí an Udarás Pleanála leis an Iarratas Pleanála” [ii] “Beidh fáil ar an R.T.T. le hiniúchadh nó le ceannach ar tháille nach mbeadh níos mó ná an costas réasúnta a bheadh ar chóip a dhéanamh le linn uaireanta oscailte poiblí ag oifigí an Údaráis Phleanála.”

Cinntigh, agus tú ag deanamh an cur síos ar an forbairt atá beartaithe go bhfuil an cur síos ar cineál agus méid an tógra ceart agus soléir. Téann na nótaí seo i leanas le na ceisteanna ar an foirm iarratas leis an uimhir comhfreagarach.

Tabhair freagair do gach cheist le do thoil, nó cur ‘neamh-oiriúnach’ muna baineann ceist nó mír eigin leis an iarratas. 1. Ainm/neacha an iarratasóir/na h-iarrataisóir amháin atá i gceist anseo. Ná líon isteach seoladh an iarratasóir anseo. 2. Suíomh an Fhorbairt Bheartaithe: Seoladh poist nó Baile Fearann nó suíomh a thugann an leiriú is fearr ar an talamh nó structiúr ata i gceist

Cuir isteach an uimhir thágarta an learscáil suirbhéireachta ordanáis (agus an tágairt eangaigh má tá sé le fáil) ag (b)

3. Aimn an Údaras Pleanála Mar shampla,- Comhairle Contae Chorcaí.

4.Cuir tic sa bosca cuí. 7. Cuir isteach ainm an duine atá freagrach as liníochtaí agus pleananna a ullmhú anseo. Tá seans ann gur é an duine céanna atá i gceist anseo agus do cheist 6, ná cuir seoladh an duine isteach anseo.

8. Más cuideachta é an iarratasóir (cláraithe faoi hAchtanna na gCuideachtaí 1963 go dtí 2009) Líon isteach Aimn/neacha an stiurthóir/na stiúrthóirí na cuideachta mar atá sé ag An Oifig um Chlarú Cuideachtaí, agus Uimhir Cláraithe na Cuideachta arna soláthar ag An Oifig um Chlárú Cuideachtaí

11. Ba choir don iarratasóir an leas dhlíthiúil atá acu ar an talamh nó structúr a taispeáint duinn. Más tusa an úinéir, leasaí, nó,

má tá conradh agat chun é a cheannach, cur tic san bhosca atá cuí, ach más ‘D’ – ‘Eile’ an freagra déan miniú ar an leas-dhlíthiúil atá agat san talamh/structúr. Is féidir leat litir a scriobh chun na sonraí a miniú más maith leat. Muna bhfuil tusa i do úinéir (má cur tú tic le b,c nó d) ba chóir duit litir ón úinéir a cur i gabhail leis an iarratas ag tabhairt cead duit an iarratas a dheanamh ar an talamh/structúr.

12 Ba cheart go mbeadh gach tomhas ar na léarscáil á thaispeáint ar scála méadrach. Sonraigh achar an suíomh i heicteár. Cinntigh go bhfuil an tomhas céanna tugtha ar achar an suíomh ar an léarscáil, na liníochtaí agus ag ceist 11 ar an foirm.

13. Ba cheart go mbeadh gach tomhas ar an liníochtaí ar scála méadrach. Sonraigh an achar ollspás i meadar cearnach (m2)

do gach chuid do ceist 13 a baineann le do iarratas. Ciallaíonn ollspás úrlár an t-achar atá cinntithe trí tomhas inmheánach an spas úrlár Tabhachtach – I gCásanna ina bhfuil sé beartaithe foirgneamh nó foirgnimh a scartáil laistigh do chúirtealáiste de teach, má tá achar an foirgneamh atá le scartáil níos mó ná 40m2 caithfear iarratas pleanála a dheanamh do, mar tá cead á teastáil agus caithfear táille a íoc freisin.

14 Sa chás gur forbairt mheascaithe atá i gceist (m.sh. áit cónaithe, tráchtála, agus/nó tionsclaíoch, rle), tabhair briseadh sios

ar na n-aicmí éagsúla forbartha san tábla foráilte, agus tabhair briseadh síos ar an ollspás úrláir do gach aicme forbartha sa bhosca comhfhreagrach sa tábla.

Sa chás gur Eastáit Tithíochta atá i gceist, tabhair briseadh sios ar na cineál eagsúla teach atá i gceist agus an ollspás úrláir do gach saghas teach ata ann. Is feidir leat bileóg bréise a úsáid má tá sé a teastáil.

15. (i)Sonraigh na n-ábhar agus na dathanna a úsáidtear ar na structúir inmheánach, mar shampla, adhmad, cóincréit nó

gloine.

(ii)Sonraigh na n-ábhar, dathanna agus an críochnú seachtrach a bheadh ar an structúr, mar shampla adhmad, cóincréit, agus gloine.

16. Más iarratas do sineadh teach é seo, an bhfuil sé i gceist agat an sineadh a úsáid mar aonad conaithe as féin/arasán seanóra

(granny flat). Más amhlaidh, caithfaidh tú táille �65 a ioc as. Cuir tic sa bhosca, agus caithfaidh tú é seo a rá san fógra suíomh, an fógra nuachtáin agus san cur síos ar an tógra ar an foirm.

17. Má thugtar cead don iarratas seo cad atá beartaithe agat deanamh leis? Cuir tic sa bhosca cuí

19. Má tá stáblaí i gceist mar chuid den fhorbairt atá beartaithe cuir tic sa bosca ‘is ea’ agus freagar ceist 45 ar an foirm: 20. Más iarratas do athrú abartha ar úsáid é, mar shampla, ó úsáid conaithe go úsáid trachtála, nó ó úsáid talmhaíochta go

úsáid conaithe 7rl tabhair sonraí sna boscaí cuí faoi an úsáid reatha atá ann, agus an úsáid nua atá beartaithe. Ní mor duit an ceist seo a fhreagairt freisin más iarratas do cead coinneál atá á lorg. 21. Baineann Cuid V don Acht um Pleanáil agus Forbairt 2000, mar a leasaíodh, le tithe a cur i soláthar don Comhairle faoin

scéim tithíocht shóisialta agus Inacmhainne. De gnath téann céatadán (%) áirithe dón lion iomlán dos na tithe go dtí an comhairle ar an scéim de réir Cuid V don Acht. Má tá níos mó ná 9 tithe beartaithe san iarratas caithfidh tú tic a cur le “Is

Ea” mar baineann an Cuid V don Acht leis an iarratas, mar sin, ní mór duit sonraí a chur ar fáil, mar chuid de d'iarratas, faoi cad atá beartaithe agat chun a bheith i gcloí le alt 96 de Chuid V den Acht lena n-áirítear, mar shampla, (i) sonraí maidir le cibé cuid nó codanna den talamh atá faoi réir an iarratas pleanála nó a bhfuil sonraithe ag an gcomhaontú Cuid V, nó tithe suite ar an talamh thuasluaite den sórt sin nó in áit eile i limistéar feidhme an údaráis pleanála a bheartaítear a bheidh le haistriú chuig an údarás pleanála, nó sonraí na dtithe atá suite ar an talamh thuasluaite den sórt sin nó in áit eile i limistéar feidhme an údaráis pleanála a bheartaítear a léas chuig an údarás pleanála, nó sonraí maidir le haon mheascán de sin, agus faoi (ii) sonraí faoi na ríomhanna agus modheolaíocht ar a ríomhadh do luachanna talún, costais láithreáin, costais forbartha agus gnáth tógála, agus brabús ar na costais sin agus na costais ghaolmhara eile a ríomh mar sciar iomchuí d'aon forbairt coitianta oibreacha mar is gá chun a bheith i cloí leis na forálacha i Cuid V den Acht.

Má gceapann tú go bhfuil do forbairt díolmhaithe ó Cuid V (mar go bhfuil 9 tithe nó níos lú i gceist, nó má tá an forbairt

beartaithe ar suíomh le achar níos lú ná 0.1 heictéar), is feidir leat iarratas do teastas diolúine a thaisceadh ag gabhail leis an iarratas pleanála . Ta na foirm iarratas do teastas diolúine le fáil ag an oifig pleanála, nó ar an suíomh gréasán – www.corkcoco.ie Más “Ní hEa” do freagar de bhua Alt 96 (14) - féach thíos- sonraigh cén cuid den Alt gur baineann sé leis.

Alt 96 (14) – “Ní bheidh feidhm ag an alt seo maidir le hiarratais ar chead—(a) le haghaidh forbartha arb é atá inti soláthar tithe ag comhlacht atá arna cheadú chun críocha alt 6 d’Acht na dTithe (Forálacha Ilghnéitheacha), 1992, chun tithíocht a sholáthar do dhaoine dá dtagraítear in alt 9(2) d’Acht na dTithe, 1988, i gcás nach gcuirfear na tithe sin ar fáil ach amháin lena ligean. (b) chun foirgneamh atá ann cheana féin a athchóiriú nó chun foirgneamh a athfhoirgniú d’fhonn teaghais amháin nó níos mó a chruthú, ar choinníoll go gcoimeádfar 50 faoin gcéad nó níos mó den chreatlach sheachtrach atá ar an bhfoirgneamh cheana féin, nó (c) chun oibreacha a dhéanamh ar theach atá ann cheana féin.” 22. Cuir tic sa bhosca cuí a rá “Sea” nó “Ní hEa” do na ceisteanna comhfreagrachas.

• Tá na structúr atá faoi cosaint go léir liostaithe i Imleabhar 2 do Plean Forbartha Chontae Chorcai 2014. Má bhfuil obair ar structúr faoi cosaint i gceist san bhforbairt atá beartaithe cinntigh go bhfuil sé seo ráite sna fógraí suíomh agus nuachtáin

• Déan taighde ar Imleabhar 4 (leirscáileanna) do Plean Forbartha Chontae Chorcaí 2014 nó ar an Coras Fiosrúcháin Pleanála ar www.corkcoco.ie chun fháil amach an bhfuil an suíomh suite láistigh de Limistéar Caomhnaithe Ailtireachta.

• Go gineralta tugtar na n-ainmneach seo freisin ar na suíomh caomhnaithe Eorpach - Suíomh‘Natura 2000’, ‘Limistéir Chosaint Speisialta’, ‘Limistéir Chaomhantais Speisialta’ nó ‘Limistéar Oidhreachta Nadúrtha’. De gnath comhfhreagraíonn na suíomh seo le na limistéir caomhantais speisialta atá leagtha amach sa Plean Forbartha Chontae Chorcaí, nó is feidir leat iad a fheicáil freisin ar an suíomh idirlíon an Seirbhís Páirceanna Náisiúnta agus Fiadhúlra - www.npws.ie . Déanann an tÚdarás Pleanála scrúdú ar gach iarratas agus a thionchar ar an suiomh.Ta seans ann, i roinnt gcásanna, go mbeadh measunú cuí á teastáil. Beadh an measunú seo deanta de réir Airteagal 6(3) agus 6(4) dos na Treor um Ghnathóga agus caithfaidh an measunú aon tionchar gur feidir a bheadh ann ar na cuspóirí caomhnú do aon suíomh ‘Natura 2000’ a thaispeáint.Má ta Ráiteas Tionchair Natura ag teastáil leis an iarratas pleanála caithfear é sin a leiriú i cur síos an forbairt san fógra suíomh agus an fógra nuachtáin. Moltar do iarratasóirí comhairle a fhail ón Údaras Pleanála sula ndéantar an iarratas.

• Tá na riachtanais i gcóir Ráiteas Tionchair Timpeallacht (RTT) leagtha amach i Cuid X don Acht um Pleanáil agus Forbairt 2000, mar a leasaíodh, agus Cuid 10 sna Rialacháin Pleanáil agus Forbairt 2001– Déan tagairt ar Sceideal 5 – Forbairt faoi Cuid 10- ag deireadh na Rialacháin chun gach saghas forbairt a éilíonn Ráiteas Tionchair Timpeallacht (RTT) a fheicáil. Más ‘Sea’ é an fhreagra don cheist seo caithfear é sin a leiriú san cur síos ar an forbairt ar an fógra suíomh agus an fógra nuachtáin.

• Tá an Ceadúnas um Rialú Comhtháite ar Thruailliú (CRCT is ea an iar-ainm a raibh air) agus an Ceadúnas um Treoir Astaíochtaí Tionsclaíocha (TAT) eisithe ag an Ghniomhaireacht Cosaint An Chomhshaoil (EPA) agus clúdaíonn siad astaíochtaí eagsúla. • Ceadaíonn ceadúnas Dramhaíola an sealbhóir fáil réidh le dramháil ó thaobh dlí. Tá na ceadúnais seo le fáil ón Ghniomhaireacht Cosaint An Chomhshaoil (EPA). Má tá aon cheist agat faoin ceist seo is feidir leat teagmháil leis an EPA. Má bhfuil ceadúnas dramhaíola a teastáil leis an iarratas caithfear é seo a thaispeáint sa cheist seo. Más ‘Sea’ é an fhreagra don cheist seo caithfear é sin a leiriú san cur síos ar an forbairt ar an fógra suíomh agus an fógra nuachtáin.

• Baineann na Rialacháin do Mhórthimpistí le forbairtí lena gcaithfear plean a cur in áit chun smacht a choimead ar guaise timpistí mhóra a bhfuil ag baint le substaintí contúirteacha. Más ‘Sea’ an freagar ar an cheist, caithfear ceithre (4) chóip don eolas ón triú sceideal dos na rialacháin do Mhórthimpistí a cuir i dteannta leis an iarratas agus caithfear é sin a leiriú san cur síos ar an forbairt ar an fógra suíomh agus an fógra nuachtáin.

• Deanann An Acht um Pleanáil agus Forbairt 2000, mar a leasaíodh, foráil do chruthú do Crios Forbartha Straitéiseach ar Ord an Rialtas má tá forbairt de saghas éigin lena bhfuil tabhactach eacnamaíocht no sóisialta ann don stáit. Cuireann Crios Forbartha Stráitéiseach suíomhanna ar fáil le haghaidh forbairt comhtaith agus comhordaithe láistigh de creatlach pleanála seasta. Níl ach Crios Forbartha Stráitéiseach amháin i Chontae Chorcaí faoi lathair. Tá sé beartaithe Baile Mór nua a cruthú i Móin Árd ar imeall na cathrach. Is suíomh 390 heictéar faoin tuath é, tá sé suite ar an line iarnród ó Corcaigh go Mala, 2km ó thuaidh don cathair agus 3km ó soir do Bhlarna. Chun eolas a fháil faoi séadchomharthaí náisiúnta agus cibe acu atá sé faoi úinéireacht, nó faoi chaomhnóireacht an t-Aire (An Roinn Ealaíonn, Oidhreachta agus Gaeltachta) nó Údaráis Aitiúil, nó má tá ordú buanchoimeádta in áit ar, téigh i dteagmháil leis an Rannóg na Séadchomhartha Náisiúnta, An Roinn Ealaíonn, Oidhreachta agus Gaeltachta. 23. Is feidir leat comhairliúchán réamhiarratais a shocrú le pleanálaí an ceantar sula gcuireann tú d’iarratas chuig an

Comhairle. Bíonn clinicí pleanála ar siúl sna h-Oifigí Comhairle Áitiúil go rialta. Is feidir leat teagmháil leis an rannóg pleanála chun gur feidir leat comhairliúchán réamhiarratais a shocrú. Uaireanta deanann na pleanalaí comhairliúchán réamhiarratais trí glaoch guthán. De réir Alt 247 don Acht um Pleanáil agus Forbairt 2000, mar a leasaíodh, caithfidh go bhfuil leas ag an iarratasoir san

talamh atá i gceist san iarratas .Má raibh comhairliúchán réamhiarratas agat faoin iarratas tabhair sonraí le do thoil. Tabhair sonraí faoin Uimhir Thagartha , dáta(í) an comhairliúcháin, na daoine a bhí rannpháirteach 7rl. Tabhair faoi deara , más comhairliúchán réamhiarratais oifigiúil faoi Alt 247 don Acht um Pleanáil agus Forbairt 2000, Mar a leasaíodh, a bhí i gceist beidh uimhir thagartha curtha ar an comhairliúchán, agus taifead i scribhinn coimeadtha ag an Údarás Pleanála, leis na sonraí faoi am, lathair agus na nótaí eagsúla an cruinniu. Beidh na nótaí sin curtha san áireamh ansin san iarratas pleanála nuair a dtagadh sé isteach.

24. Líon isteach an méid eolas is atá agat i ngach alt don cheist faoi stair an suíomh. Déanann an tÚdarás Pleanála scrúdú ar

gach iarratas ó thaobh an t-eolas ata foilsithe ar baol tuilte. Fhéadfadh go mbeadh gá ar iarratasóirí eolas sa bhreis a thabhairt duinn mas rud é go n-aithnítear baol tuilte i ndail leis an suíomh. Seans ann go mbeadh ort tagairt a dheanamh ar an Coras Fíosrúcháin Pleanála ar suíomh gréasán an Comhairle chun stair pleanála an suíomh a fheicáil chun fháil amach má raibh aon iarratas baillí ar an suíomh riamh. Tabhair faoi deara, má raibh iarratas bailí ar an suíomh (nó cuid don suíomh) níos lú ná 6 mhí roimh an ceann atá beartaithe agat anseo, ní mór don Fhógra Suíomh a bheith daite BUÍ, i gcomhréir le Airteagal 19(4) dos na Rialacháin Pleanáil agus Forbairt (mar a leasaiodh) 2001.

Tabhair faoi deara, má bhfuil an suíomh ar a bhfuil an forbairt beartaithe faoi reir achomhairc leis An Bórd Pleanala i ndáil le forbairt don chineál chéanna, caithfear cinneadh a fháil ar an achomhairc , nó caithfear an achomhairc a tharraingt siar sula bhfeadfá in ann an iarratas nua a loisteáil

25 Baineann an cheist faoi seirbhisí seo le foinse soláthar uisce, cóireáil fuíollusice agus diúscairt don uisce dromcla. Do gach ceist, sonraigh cad atá ann faoi lathair (má tá aon rud ann), agus ansin cur tic sa bhosca a rá cad atá beartaithe. Mar shampla, muna bhfuil cóireáil fuíolluisce ann cheana, agus má tá sé beartaithe agat aonad bith-timthriallach a cur isteach, scriobh ‘Faic’ san bhosca a baineann le cóireáil ar an suíomh cheana, ansin cur tic san bhosca ‘Nua’ agus sonraigh an ainm agus an cineál aonad bith-timthriallach atá beartaithe agat a insealbhú. Is feidir leat bileog ar breis a úsáid ag taispeáint sonraí na seirbhisí más maith leat (Feach ar nóta 4 ar leathnach 3 dos na treorlintí seo i gcóir nios mó eolas ar na cóireáil fuíolluisce Má tá sé beartaithe agat do solathar uisce a fháil ó ceangail le Grúpsceime Uisce, caithfear litir a fháil ag toiliú leis an ceangail agus é sin a cur ag gabhail leis an iarratas .Tabhair Faoi deara i gcásanna do pacáiste gléasra cóireáila ina bhfuil sé beartaithe é a scaoileadh go dtí uisce, uiscí dromchlá nó screamhuisce, tá ceadúnas a teastáil faoi reachtaíocht truailliú uisce (Caithfidh tú é seo a phlé le Rannóg Comhshaol an Comhairle)

26. Léirigh más túsa úinéir do aon chuid den talamh atá ceangailte, in aice nó ag síneadh leis an suíomh 27. Aon talamh atá ceangailte, in aice nó ag síneadh leis an talamh atá le forbairt agus atá faoi smacht an iarratasóra nó an

duine atá in úinéireacht na talún faoi iarratas, a bheith imlínithe le dath gorm. Mar shampla, má tá feirm agat, ach ní baineann ach píosa beag ar an talún leis an iarratas, cur imlíne le dath dearg ar an suíomh ata ag iarradh cead pleanála, agus ansin imlíne gorm timpeall an talún/feirm go léir.

28. Tá liosta ag an Comhairle Contae Chorcaí dos na nuachtáin ina bhfuil sé ceadaithe duit an fógra nuachtáin a fhoilsiú . Tá

an liosta seo le fáil ag deireadh na nótaí seo. Roghnaigh an ceann is oiriúnaí. Cuir an dáta ar a raibh an fógra foilsithe agus an dáta ar a raibh an fógra suíomh croctha suas sna boscaí cuí ar an foirm. Caithfidh an t-iarratas a bheith seolta isteach go dtí an Údarás Pleanála laistigh de 14 lá ó fhoilsítear an Fógra Preasa nó beidh an Fógra neamhbhailí agus cuirfear ar ais an t-iarratas mar neamhbhailí. dheanamh déan teagmhail leis an oifig chlárú nó an oifig liníochta san Rannóg Pleanála. Tá sceideal 9 ó na Rialacháin Pleanáil agus Forbairt 2001 iniata ag deireadh na notai seo. Tá liosta ann dos na saghas forbartha agus na táillí eagsúla a dtéann i gabhail leo (b) Léirigh, le do thoil, conas gur íoc tú ás, nó conas go íocfaidh tú ás an táille pleanála. Déan tagairt freisin ar leathnach 22 des na treoirlínte seo i gcóir an modh a leanfar má tá tú ag íoc le aistriú leictreonach airgead.

amh-ábhar a bheadh á úsáid ar suíomh. Déan cur síos ar an deantúsaíocht, agus liostaigh na táirgí nó earraí a bheadh deanta ann.

31. Má tá aon astaíocht táirgeadh ar suíomh , m.sh. deatach, boladh, torann, dusta, rle mar toradh ar an próiseas, tabhair

sonraí faoi, agus luaigh cad atá socraithe agat chun iad a rialú. Má tá ceadúnas Rialú Comhtháite ar Thruailliú agat chun na astaíochtaí seo a rialú, caithfear é seo a rá

32. Tabhair sonraí ar gach eisilteach leachta agus dramhaíl sholadach a bheith deanta mar toradh ar an proiseas atá i gceist san Forbairt seo. Dean cur síos ar na modhanna diúscartha atá in intinn agat do aon eisilteach nó dramhaíola soladach a tháirgtear ar an suíomh. Bí cinnte go bhfuil tú ag cur síos freisin ar conas a mbeadh an séarachas chóireáilte agus / nó a dhiúscairt ar an suíomh. 33. Tabhair sonraí faoi líon measta na bhFostaithe ar suíomh.

Tabhair sonraí faoin trácht measta a cheaptar a ghinfear ar suíomh, comh fada agus is eol duit. Tabhair tracht ó na fostóirí agus custaiméirí faoi deara agus tú ag deanamh meastacháin ar an méid tracht a bheith i gceist.

34. Tabhair sonraí faoi an soláthar uisce atá ann agus conas a bheith sé á úsáid san phróiseas agus fuarú agus tabhair sonraí

teochta an uisce. Inis duinn an méid uisce a bheadh á úsáid go laethúla agus an modh diúscartha . Luaigh é má tá ceadúnas diúscarta uisce agat.

35. Tabhair sonraí faoi Soláthar Fuinnimh/Cumhachta atá beartaithe don forbairt i.e. ola, gais, leictreachas 7rl 36. Tabhair sonraí maidir leis an stóráil oscailte agus clúdaithe atá beartaithe do aon abháir nó táirgí

ar suíomh. Luaigh an cineál abhair atá i gceist agus an áit ina bheadh said storálta, láistigh nó lásmuigh dos na foirgneamh. Bí cinnte go bhfuil sonraí storála luaite agat má tá aon ábhar contúirteach i gceist. Liostaigh aon nósanna imeachta sábháilteachta agus prótacail atá in áit agat dos na h-ábhair contúirteach sin.

Baineann ceisteanna 37-58 le iarratais do forbairtí Talmhaíochta. Muna baineann do iarratas le forbairt um talmhaíochta, nó muna bhfuil stábla beartaithe agat i do iarratas, téir díreach go dtí cheist 59. 37. Tá 21 Aonaid Báinisteoireachta d’Uisce abhainn/locha (iomlán nó chuid de) i Contae Chorcaí. Tá siad deanta suas as

Comhlachtaí Uisce a bhfuil ina fo-aonad comhtháithe sa cheantar abhantraí. Tá na h-Aonaid Báinisteoireachta Uisce ann chun báinistiú a dheanamh ar Comhlacht Uisce. Tá na Comhlachtaí uisce sainithe agus leagtha amach ag an nGníomhaireacht Cosanta Comhshaoil mar chuid den Chreat-Treoir Uisce. Is é an Comhlacht Uisce an t-aonad amháin atá intuairiscithe go dtí an Eoraip. Ní mór duit gach gníomhú nó bearta a glacadh faoin Creat-Treoir Uisce a thuarisciú ag leibhéal an Comhlacht uisce, mar Shampla, gniomhú cosúil le, scrúdú feirme, scrúdú ar umar séarachas, áth-bhreithniú ar cheadúnas úrscaoileadh, Iarratas Pleanála (ceadaithe nó diúltaithe), nó Clár Infheistíochta Seirbhísí Uisce (WSIP) ,7rl

38. Cad é an fad idir an clós feirme agus an teach cónaithe tríú páirtí is gaire. Taispeáin é seo ar an leagan amach don

suíomh no leagan amach an feirm. Cíallaíonn ‘Triú páirtí’ aon talamh nó structúr atá congarach le do talamh ach nach bhfuil i do úinéireacht.

39. Luaigh an fad idir an clós feirme agus an sruthchúrsa is gaire i.e. sruth nó abhainn. Ba cheart go mbeadh sé seo léirithe ar

an leagan amach an suíomh nó leagan amach an feirm freisin. 40. Sonraigh an úsáid atá beartaithe don fhoirgneamh. 41. Sonraigh fad an fhoirgnimh/na bhfoirgneamh ó fhoirgneamh/fhoirgnimh atá in aice leis an suíomh ach nach bhfuil I do

úinéireacht nó ar do talamh. Léirigh aon foirgnimh atá ar chaon taobh, chun tosaigh nó ar gcúl do forbairt. Ba cheart go mbeadh siad seo léirithe ar an leagan amach an suíomh nó leagan amach an feirm freisin.

42. Líon isteach na boscaí atá cuí ag taispeáint meánuimhir na h-ainmhithe atá le coinneáil ar an bhfeirm 43. Líon isteach na boscaí atá cuí ag taispeáint an méid ainmhí a bheith i gceist i dianfhiontair thalmhaíochta. 44. Líon isteach sna boscaí cuí an méid agus cineál ainmhithe atá le coinneáil sa bhfoirgneamh beartaithe.

Taispeáin ar an leagan amach don suíomh nó an leagan amach don feirm é. 48. Cé mhéad heicteár faoi do chúram nó faoi úinéireacht agat? Caithfidh go mbeadh se seo le feicáil ar na léirscáil suíomh.

Bí cinnte go bhfuil gach talamh faoi do úinéireacht léirithe le imlíne gorm timpeall ar. 49. Cén soláthar uisce atá ag an bhfeirm? 52. An bhfuil tástálacha anailíse ithreach déanta ar do chuid tailte? Má bhfuil, tabhair an dáta is deanaí má tá sé ar eolas agat. 53 – 58. Dos na cheisteanna seo, is feidir leat na sonraí a thaispeáint ar an Thaifead na Struchtúr Feirme (le fáil ag

deireadh an foirm iarratas), nó ar an leagan amach don suíomh/feirm, nó ar na learscáil suíomh. Tá na notaí seo thíos ann le cabhrú leat le do iarratas talmhaíochta. • Taispeáin an méid heictéar glán atá i do úinéireacht, agus an méid heictéar don talamh atá ann le aoileach orgánach a leathadh

• Luaigh an méid agus cineál ainmhí a bheidh lonnaithe i limistear leaba cochán . Léirigh an plean atá agat chun déileáil leis an aoileach san treimhse ina bheidh na h-ainmhí anseo.

• Má tá aoileach orgánach (sciodair, aoileach éanlaith chlóis, sloda) le iomportáil go dtí, nó�easportáil ón feirm, tabhair sonraí faoin saghas, méid, foinse/áit a bhfuil sé ag dul. Tabhair sonraí freisin faoin áit ina bhfuil sé storálta ar an ferim roimh é a leathadh, más cuí

• Ba cheart go mbeadh an méid sciodar, eisiltigh, nó uisce salach ghinte ar an feirm riomhadh ag cloí le I.R. Uimh. 31 de 2014, Rialacháin an Aontas Eorpach (Dea-chleachtas Talmhaíochta do chaomhnú na nUiscí) 2014 agus aon rialacháin eile a leanas ina dhiadh sin.

• Ba cheart go mbeadh an toilleadh stórála ar áiseanna stóráil do sciodar, eisiltigh agus uisce salach (atá ann

cheana, agus atá beartaithe) san chlós feirme riomhadh ag cloí le I.R. Uimh. 31 de 2014, Rialacháin an Aontas Eorpach (Dea-chleachtas Talmhaíochta do chaomhnú na nUiscí) 2014 agus aon rialacháin eile a leanas ina dhiadh sin.

• Má tá áiseanna leaba cochán beartaithe agat i gcóir beostoc, ba cheart go mbeadh laithrean beathú agus a

fheidhmiú/aclaíocht léirithe go soléir, agus an limistéir chun an sciodar, agus an uisce salach a bailiú agus a stóráil ar fáil

• Taispeáin go soléir an treo ina bheidh an iarratasóir ag dul ag cloí le I.R. Uimh. 31 de 2014, Rialacháin an Aontas Eorpach (Dea-chleachtas Talmhaíochta do chaomhnú na nUiscí) 2014, agus aon rialacháin eile a leanas ina dhiadh sin mar gheall le toilleadh stórála ar sciodar, eisiltigh agus uisce salach.

• Má tá umar concréit nó cruach thar-talamh beartaithe agat, tá seans ann go mbeadh bunda chré a teastáil chun aon sruthchursa lagchuidiú a cosaint ó úrscaoileadh timpisteach ón umar. Ní h Ea sláine na n-umar atá i gceist; áfach, d'fhéadfadh mar thoradh ar earráid dhaonna comhlaí a bheith fágtha ar oscailt as a doirteadh. Is leor bunda chré iarghúlta a úsáid chun cosaint ón baol seo.

• Ba cheart go mbeadh an Taifead Structúr na feirme agus na pleananna comhsinithe ag an iarratasóir roimh iad a chur isteach go dtí an oifig pleanála, chun a bheith cinnte go bhfuil an úinéir/iarratasóir ag togaint úinéireacht agus freagracht as an iarratas.

• Tabhair faoi deara sna plean aon umar díosail le bunda. • Caithfidh go mbeadh gach obair togáil ag dul ag cloí le sonraíochtaí an Roinn Talmhaíochta agus Bia. Déan

teagmháil leis an Roinn chun na sonraíochtaí sin a fheicáil, nó feach ar suíomh gréasán an Roinn. • Ba chóir go mbeadh aon dramhaíl tógála a dhiúscairt i gcomhréir leis na hAchtanna um bainistíochtaí

dramhaíola 1996-2006, agus má tá tú chun an dramhail seo a thogaint as an suíomh bí cinnte go bhfuil é tugtha go dtí ionad ceadaithe agus ceadúnaithe.

A: Structúr atá sa chlós Feirme cheana. Tabhair na buntomhais inmheánach ceart do gach foirgneamh agus structúr sa chlós feirme agus tabhair cur síos soléir ar an úsáid atá ar gach ceann (msh. Feach ar Nóta ‘D’ thíos más stór do sciodar nó uisce salach atá i gceist). Ba cheart go mbeadh gach foirgneamh etc. le feicáil go soléir agus sainaitheanta ar na liníochtaí cuí. . Má tá structúr le umar eisiltigh beartaithe caithfear an uimhir aitheantas a cur isteach san colún ar a dtugtar ‘úrscaoileadh go...’

C: Stóir sciodar agus uisce salach atá ann cheana Tabhair na buntomhais ar gach stór sciodar, eisilteach, uisce salach, ionad aoiligh, nó poll aoiligh. Ba cheart go mbeadh siad seo le feicáil go soléir agus sainaitheanta ar na liníochtaí cuí. Tabhair an toilleadh atá ar gach umar go dtí an meadar ciúbach is gaire. [ Tabhair faoi deara gur ceart duit tomhas doimhneacht aon umar a fháil ag úsáid báta nó slat. Luaigh anseo, le do thoil, an seoladh ar cheart duinn a úsáid do gach comhfhreagras. Cuir tic san bhosca cuí. Má tá tú ag iarradh an comhfhreagras a bheith curtha ar aghaidh go dtí an gniomhaire cur tic sa bhosca ‘SEA’, má gcuirfeá tic sa bhosca ‘Ni Hea’, seolfainn gach comhfhreagras ar aghaidh go dtí seoladh an iarratasóir.

63. Sa chás gur Cuideachta an tIarratasóir atá cláraithe faoi Achtanna na gCuideachtaí 1963 go dtí 2009, luaigh seoladh

teagmhail agus uimhir guthán an cuideachta. Cur aon uimhir guthán phóca, seoladh riomhphost, nó uimhir faics san áireamh freisin má tá siad agat. Baineann an cheist seo le ceist 8 ar an foirm.

64. Luaigh seoladh teagmhail agus uimhir guthán an úinéir don talamh/structúr atá faoi iarratas. Caithfear an eolas seo a cuir

ar fáil muna bhfuil an iarratasóir ina h-úinear ar an talamh/structúr. Cuir aon uimhir guthán phóca, seoladh riomhphost, nó uimhir faics san áireamh freisin má tá siad agat. Baineann an cheist seo le ceist 10 ar an foirm. Clinicí Réamh-Phleanála & Comhairliúcháin Réamh-Iarratas Faoi alt 247 don tAcht um Pleanáil agus Forbartha 2000, tá cead ag éinne le leas i dtalamh éigin, comhairliucháin réamh-iarratas a iarradh I ndáil le forbairt beartaithe. Clinicí Réamh-Pleanála Soláthraíonn an Rannóg Pleanála don Comhairle Contae Chorcaí cruinniú (duine le duine) ag na oifigi áitiúl faoi Alt 247 don 2000 Acht. Mar sin caithfidh go mbeadh na cruinniú clinicí ag gcloi le critéir dhiana an reachtaíocht. Seo a leanas na critéir:

� Beidh cúntas don ám, áit agus na sonraí go léir faoin cruinniú le feiceáil ag an pobal nuair a bheidh cinneadh déanta ar an iarratas pleanála.

� Caithfear 2 chóip iarratas i gcóir cruinniu a dhéanamh i scribhinn no iarratas leictreonach a seoladh chugainn le na rudaí seo a leanas san áireamh:-

CORK COUNTY COUNCIL

This document is to act as an explanatory leaflet for Cork County Council’s Planning Application Form. It provides details of which plans and documents need to be submitted for planning applications as well as instructions on completing site notices, press notices and farm structure records. Each note in the guidelines corresponds directly with questions 1 to 64 of the application form. Even though the guidelines are detailed, they are not exhaustive so if you have difficulty in answering any questions on the planning application form then you should contact the planning department for clarification.

All plans and drawings for one or two dwellings, domestic extensions, domestic garages or out-offices and for any other proposed developments of similar size should be submitted on A3 or A4 paper. This is in order to minimize the cost of copying to the council and to the public as well. When you have completed the application form and are confident that you have included all plans, particulars and the correct fee to make the application then please complete the checklist on page 1 of the form. It is important to note that from the 5th September 2011 all planning applications will be published on Cork County Council’s website www.corkcoco.ie. Under the requirements of the Data Protection Acts 1988 to 2003, contact details of applicants and their agents will be kept confidential. It has come to our attention that the publication of planning applications by planning authorities can lead to applicants being targeted by persons in the business sector engaged in direct marketing. In response to a request from the Data Protection Commissioner, you are hereby given an opportunity to indicate a preference with regard to the receipt of direct marketing arising from the lodging of a planning application. You may tick the box on page 2 of the application form if you are satisfied to receive direct marketing. Otherwise all contact details - Questions 60 to 64 - of the application form will be removed from the application and will not be made available to the public.

6 No. copies of the Planning Application form duly completed should be lodged in the relevant Planning Office and should be accompanied by the following: [1] SCHEDULE A Schedule of Plans, Drawings and Maps which includes drawing titles/numbers should be submitted with the application. [2] SITE LOCATION MAPS 6 no. clearly printed copies of (a) A 6’’ to 1 mile or 1:10,560 scale map minimum size A4 (b) A 25’’ or 1:2500 scale map, minimum size A3 All maps should bear the Ordnance Survey Ireland stamp to show that they are licenced by O.S.I. and have been reproduced with the permission of Ordnance Survey Ireland. These should be based on or taken from an original Ordnance Survey Sheet and should indicate the following: a) Relevant Ordnance Sheet Number b) Townland c) Details of features in the vicinity - to permit identification of the site e.g. buildings, crossroads, field

boundaries, landmarks, distances from nearby towns and villages etc. d) Boundaries marked or coloured in red so as to identify clearly the land or structure to which the

application relates. e) Any land which adjoins, abuts or is adjacent to the land to be developed and which is under the control of

the applicant, or the person who owns the land, outlined in blue. f) Wayleaves shown in yellow. g) Boundaries must correspond exactly with those shown on layout plan h) Location of Site Notice/Site Notices marked with an “X”(See notes re: position of Site Notice – page 3) A ‘Planning Pack’ may be purchased from National Map Services. This pack should contain 6 copies of the 6’’ & 25’’ maps which are required to be submitted with your planning application. National Map Services are located at Unit 7, South Ring Business Park, Kinsale Road, Cork (near Smyths toystore). Please contact National Map Services directly if you wish to receive any further information on their services (e.g. fees, opening hours, etc.). [3] SITE LAYOUT PLAN 6 no. clearly printed copies of site layout set to an indicated metric scale of not less than 1:500 showing all the proposed features on site and indicating the following: a) Site boundaries outlined in red b) Buildings, roads, boundaries, septic tank and percolation areas, bored wells, significant tree stands and

other features on, adjoining or in the vicinity of the land or structure must be shown c) Levels or contours, where applicable, of the land and the proposed structures relative to Ordnance Survey

Datum or a temporary local benchmark must be shown - whichever is more appropriate. d) North Point must be indicated. e) Indicate distances of structure from boundaries of site. f) Boundaries to correspond exactly with those shown on site location map.

[4] DETAILS OF EFFLUENT TREATMENT Where it is proposed to dispose of wastewater from the proposed development other than to a public sewer, then information regarding the on-site treatment system and evidence as to the suitability of the site for the system proposed - e.g. on-site specific proposal, percolation test results, etc. – in accordance with the E.P.A. Code of Practice 2009 must be submitted with your application. Please provide at least 2 copies of your proposed Treatment Unit details.

For all Planning Applications received on, or after the 8th January 2010, Planning Authorities must ensure that every individual dwelling that is granted planning permission in an unsewered area has first undergone site suitability assessment using the methodology set out in the EPA Code of Practice and the site assessment has fully met the required standards.

The site assessments are carried out by private operators not Cork County Council. Please note that when hiring private operators to carry out a site assessment test you are entering into a private contract between you, (the applicant), and the private assessor.

In accordance with article 22(2)(c) of the Planning and Development Regulations 2006, applicants are required to submit the site assessment at the time of making the application. The standard Site Characterisation Form must be used to record this information.

It should be noted that applications for multiple-house schemes, where it is proposed to provide an individual treatment system for each house, must be accompanied by an individual site assessment report for each individual site. The submission of a single assessment form in such circumstances will not be accepted.

Please also refer to the notes regarding Question 25 for information on water & wastewater connections to the public sewer.

[5] PLANS, ELEVATIONS AND SECTIONS 6 No. clearly printed copies of plans, elevations and sections of proposed structures shall be submitted: (a) All plans etc must be drawn to a metric scale of not less than 1:200 or other prior agreed scale. Please ensure that the scale is clearly indicated on all plans. (b) All plans etc must show the main features of any buildings which would be contiguous to the proposed structure if it were erected, whether on site or in vicinity (Scale not less than 1:200 as appropriate). (c) If the work is to a Protected Structure or a Proposed Protected Structure elevations should show the main features of any buildings within the curtilage of the structure which would be materially affected by the proposed development. (d) Plans relating to work for restoration, alteration or extension of a structure should contain different colours so as to distinguish between existing and proposed development. (e) Floor plans, elevations and sections shall indicate in figures the principle dimensions (including overall height) of any proposed structure. (f) North Point must be indicated on Floor plans.

[6] SUPPLEMENTARY APPLICATION FORM – SF1 The supplementary application form is intended only to assist people applying for permission for an individual house in an area where strict planning restrictions apply. The Planning Authority has powers to relax some of its normal planning restrictions in certain cases for local residents. Anyone proposing to build a dwelling located within one of the six rural area types as identified in the County Development Plan 2014 should complete this form. These restricted areas can be identified on the maps in the County Development Plan or on the Planning Enquiry System on the council’s website. The form is available at our public counter and on our website. Directions for completing the form are available on the form itself. Two copies of this form should be submitted with the planning application form.

[7] SITE NOTICE 2 No. copies of the Site Notice erected or fixed on the land/structure must also be submitted with your application. (a) Site Notices must be located in a conspicuous position on or near the main entrance of the land. (b) If there is more than one entrance on the site then notices must be erected on or near all such entrances or on any part of the land/ structure adjoining a public road (c) If site/structure does not adjoin a public road, the site notice must be positioned on the land/structure so as to be easily visible and legible by persons outside the land or structure. (d) More than one site notice may need to be erected near the site, if the erecting of a single site notice is not sufficient to comply with points a, b and c above or does not adequately inform the public of the location of the development. For Example: If the site does not adjoin a public road or is situated on a lane then a notice should be erected on the nearest public road. (e) Site Notice/Notices must be inscribed or printed in indelible ink on a White background. (f) They should be affixed on rigid durable material and secured against damage from bad weather or any other hazard which may affect the legibility of the site notice. (g) The Site Notice must not be obscured or concealed at any time. (h) The Site Notice should not be erected on a gate. If a second application is submitted on part or all of a site within 6 months of the date of submission of a previous valid application on that site then the Site Notice must be coloured yellow and erected under the same rules as points (a) – (d) and (f) - (h) of note [7] above. Please ensure that the Notice/Notices, has/have been fixed on site not more than 14 days before the date that the application is lodged with the Planning Authority and are not dated after the date of receipt of the application by the planning authority. The Site Notice should remain fixed or erected on site in line with the above requirements for a period of 5 weeks from the date the application is lodged. The Site Notice must be renewed or replaced if it is removed or becomes defaced or illegible within the 5 week period

The date that the notice is erected or fixed at the site must be stated. Either the signature of the applicant or the signature and contact address of the person acting on behalf of the applicant must be stated on the notice.

The Site Notice/Notices must contain all of the information specified in the explanatory details attached to the Site Notice.

Nature and extent of development: (1) If the development is for housing - the number of houses must be stated. (2) If the development is for retention of a structure – then the nature of the proposed use and where appropriate, the period for which it is proposed to retain the structure should be stated. (3) If the development is for works to a “Protected Structure” or a “Proposed Protected Structure” – this must be clearly stated on the Site Notice. (4) If the development is in a “Strategic Development Zone”-this must be stated on Site Notice. (5) If the development is of a class prescribed in Schedule 5 of the Planning and Development Regulations, 2001 – i.e. It requires a submission of an Environmental Impact Statement (large scale residential) – this must be stated in the Site Notice. Where an E.I.S. accompanies the application, the following statement in addition to the other relevant items listed here must be included in the Site Notice:

[i] “The E.I.S. will be submitted to the Planning Authority with the application”

[ii] “The E.I.S. will be available for inspection or purchase at a fee not exceeding the reasonable cost of making a copy during office hours at the offices of the Planning Authority”

(6) The development description must explain the nature of the proposed development. It must state ‘construction’, ‘alteration’, ‘demolition’, ‘development’, etc and must state the type of land/structure that is the subject of the application. If the development comprises of an extension or alterations to a dwelling then ‘extension to dwelling house’ or ‘alterations to dwelling house’ should be stated in the description. IMPORTANT NOTE: The Planning Notice must state the following in addition to the other items: The planning application may be inspected or purchased at a fee not exceeding the reasonable cost of making a copy at the offices of the Planning Authority, County Hall, Carrigrohane Road, Cork, during its public opening hours, i.e. 9.00a.m. to 4.00 p.m. Monday to Friday (excluding public holidays). A submission or observation in relation to the application may be made in writing to the Planning Authority on payment of the prescribed fee within the period of 5 weeks beginning on the date of receipt by the Authority of the application, and such submissions and observations will be considered by the planning authority in making a decision on the application. The planning authority may grant permission subject to or without conditions, or may refuse to grant permission.

Directions for completing the Site Notice are also printed on the reverse side of the Site Notice. [8] PRESS NOTICE 2 No. copies of the relevant page from an approved newspaper which is circulated in the area and which contains the published planning notice of the applicant’s intention to make the application for Planning permission must submitted with all Planning applications. The page should include the date and the title of the newspaper. (Cork County Council’s list of approved newspapers is attached to this document) The Notice must include the following: (a) Headed “CORK COUNTY COUNCIL” (b) Name of applicant

(c) Location, Townland or postal address of land or structure to which application relates. (d) The relevant type/s of permission that apply to the application. (1) Permission (2) Permission for Retention (3) Permission Consequent on the Grant of Outline Permission. (This must include the Register No. of the relevant Outline Permission) (e) Nature and extent of development: (1) If the development is for housing - the number of houses must be stated. (2) If the development is for retention of a structure – then the nature of proposed use and where appropriate the period for retention must be stated. (3) If the development is for works to a “Protected Structure” or a “Proposed Protected Structure” – this must be clearly stated. (4) If the development is in a “Strategic Development Zone”-this must be stated on Press Notice. (5) If the development is of a class prescribed in Schedule 5 of the Planning Regulations, 2001 requiring submission of an Environmental Impact Statement (large scale residential) – this must be stated in the Press Notice. Where an E.I.S. accompanies the application, the following statement in addition to the other relevant items listed here must be included in the Press Notice:

“the Planning Application may be inspected or purchased at a fee not exceeding the reasonable cost of making a copy at the offices of the Planning Authority during its public opening hours and a submission or observation in relation to the application may be made to the Authority in writing on payment of the prescribed fee within the period of 5 weeks beginning on the date of receipt by the Authority of the application”.

If the development comprises of an extension or alterations to a dwelling then ‘extension to dwelling house’ or ‘alterations to dwelling house’ should be stated in the description. Applications must be submitted to the Planning Authority within 14 days of publication of Press Notice otherwise the notice is invalid and the application will be returned as invalid. However, if the last day for submission falls on Saturday, Sunday, Public Holiday or any other day on which the Planning Offices are closed, the press notice will be valid on the next following working day. The date of publication is day 1 of the 14 days.

If the development comprises of an extension or alterations to a dwelling then ‘extension to dwelling house’ or ‘alterations to dwelling house’ should be stated in the description. The development description should match that on the Press Notice and Site notice. 10. Under Section 37A of the Planning and Development Act 2000, as amended, applications for Strategic Infrastructure Development shall be made directly to An Bord Pleanála. If you have any query regarding this issue please refer to An Bord Pleanála’s website www.pleanala.ie. 11. The applicant must indicate their Legal Interest in the Land/Structure. Gross floor space is always taken as being the internal floor area. It is important to note that demolition of a building or buildings over 40m² within the curtilage of a house incurs a fee for demolition and would in itself warrant the making of a planning application. The demolition of any industrial building, business premises or farmyard building over 100m² also incurs a fee for demolition and would warrant the making of a planning application. 14. If your application comprises of a mixed use development (i.e. residential, commercial and/or industrial) then please state the class/type of development in the table provided and state the gross floor area of that class of development in the corresponding box of the table. If the application is for a Housing Estate development then please provide details of the house types and a breakdown of the gross floor area for each individual house type. This information may be provided on a separate sheet if necessary. 15. (i) Please provide details of the materials and colours to be used in the internal structures of the development. Materials would include wood, concrete, glass etc. 16. Where an application is for an extension to a dwelling, yet consists of a ‘Granny Flat’ or separate dwelling unit then a fee of �65 is payable. Please tick the relevant box. It is also necessary to state ‘Granny Flat’ or separate dwelling unit in the development description in your Press Notice and Site Notice. 17. Please tick the relevant box to indicate what you intend to do with the development should you receive planning permission. 21. Part V of the Planning and Development Act 2000, as amended relates to Housing Supply and is primarily concerned with the provision of houses under the social and affordable housing schemes. In general a certain percentage of the total housing development would be allocated for the council’s housing schemes under Part V of the Act. If the proposed development is for more than 9 dwelling units then you should answer ‘Yes’ as Part V of the Act will apply and submit details of the manner in which it is proposed to comply with section 96 of Part V of the Act including, for example,

(i) details of such part or parts of the land which is subject to the application for permission or is or are specified by the Part V agreement, or houses situated on such aforementioned land or elsewhere in the planning authority’s functional area proposed to be transferred to the planning authority, or details of houses situated on such aforementioned land or elsewhere in the planning authority’s functional area proposed to be leased to the planning authority, or details of any combination of the foregoing, and

(ii) details of the calculations and methodology for calculating values of land, site costs, normal construction and development costs and profit on those costs and other related costs such as an appropriate share of any common development works as required to comply with the provisions in Part V of the Act.

If you consider that the development is exempt from Part V because it is for nine or fewer houses or for housing on a site less than 0.1 of a hectare then you may apply for an exemption certificate from Cork County Council. Application forms for exemption certificates are available in the public offices of the Planning Dept. and can be downloaded from our website. www.corkcoco.ie If the answer to question 20 is ‘no’ by virtue of Section 96 (14) – see below- of the Act then state which part of Section 96 (14) applies.

14) This section shall not apply to applications for permission for— (a) development consisting of the provision of houses by a body standing approved for the purposes of section 6 of the Housing (Miscellaneous Provisions) Act, 1992 , for the provision of housing for persons referred to in section 9 (2) of the Housing Act, 1988 , where such houses are to be made available for letting only, (b) the conversion of an existing building or the reconstruction of a building to create one or more dwellings, provided that 50 per cent or more of the existing external fabric of the building is retained, or (c) the carrying out of works to an existing house.

to see if the site of your development is located within an Architectural Conservation Area. � European sites of conservation are generally known as ‘Natura 2000’ sites, S.P.A.s (Special Protection

Areas), S.A.C.s (Special Areas of Conservation) or Natural Heritage Areas. Most of these sites correspond with special areas of conservation as outlined in the Cork County Development Plan or can be found on the National Parks and Wildlife Service website www.npws.ie. Each planning application will be screened by the Planning Authority for its impact on these sites. An ‘Appropriate Assessment’ may be required. This is an assessment carried out under Article 6(3) and 6(4) of the habitats directive and must document any potential impacts of a plan on the conservation objectives of any ‘Natura 2000’ site. � An Integrated Pollution Control Licence (IPC) {formally an IPPC Licence} & Industrial Emissions Directive Licence (IED) are licences issued by the E.P.A. to cover various types of emissions. Please refer to the Environmental Protection Agency (EPA) website for further information on these licences. If your development consists of any activity that requires an IPC or IED licence, then you must indicate this here. If you answer ‘yes’ to this question then this must be referred to in the development description in the Press Notice and Site Notice.

� A waste licence allows the holder to dispose of waste legally. These licences are issued by the E.P.A. and all queries regarding the application process etc should be directed toward the E.P.A. If your development consists of any activity that requires a Waste licence then you must indicate this here. If you answer ‘yes’ to this question then this must be referred to in the development description in the Press Notice and Site Notice.

� The Major Accident Regulations apply to developments which need to put plans in place for the control of major accident hazards involving dangerous substances. If you answer ‘Yes’ to this question then you must submit 4 no. copies of the information specified in the 3rd schedule of the Major Accident Regulations. If you answer ‘yes’ to this question then this must be referred to in the development description in the Press Notice and Site Notice.

� The Planning and Development Act 2000, as amended makes provision for the creation of Strategic Development Zones (SDZ) by Order of the Government where specified development is of economic or social importance to the state. S.D.Z.s provide for the integrated and coordinated development of sites within a fixed planning framework. At present there is only one SDZ in County Cork. Monard is envisaged as a new town on the edge of Cork City. It is a 390 hectare, predominately rural area, located on the Cork- Mallow rail line, 2 km north of the City and 3 km east of Blarney. Please refer to the maps on our Planning Enquiry System to see this SDZ. If you answer ‘yes’ to this question then this must be referred to in the development description in the Press Notice and Site Notice.

� Demolition of a house or any structure over 40 square metres on a domestic site or over 100 square metres on a non-domestic site (i.e. agricultural, commercial or industrial site) incurs a fee. Fees for demolition are calculated under Class 13 development. If you answer ‘yes’ to this question then this must be referred to in the development description in the Press Notice and Site Notice.

� The Record of Monuments and Places, under section 12 of the National Monuments Amendment Act 1994, is available, in the Local Authority offices and Public Libraries. For information on whether national monuments are in the ownership or guardianship of the Minister for the Arts, Heritage and the Gaeltacht or a local authority or are the subject of preservation orders, contact the National Monuments Section, Department of the Arts, Heritage and the Gaeltacht (01 888 2000)

23. It is possible to arrange a planning consultation with an area planner prior to submitting your application. Planning Clinics are held in the local area offices and can be arranged by contacting the planning department. Planners may also take phone calls on prospective planning applications. Section 247 of the Planning and Development Act 2000, as amended requires that the applicant has to have an interest in the land concerned and that he/she wishes to consult about a proposed development. If a pre-application consultation was conducted on your application then please provide details about the pre-planning consultation took place. You must state the reference no., dates and persons involved in the pre-planning consultation. It is important to note that an official Pre-Planning Consultation conducted under section 247 of the Planning and Development Act 2000, as amended, will have a specific reference number and a record of the time and place of the meeting will be kept by the Planning Authority and these details will be associated with the planning file, should an application be made subsequently.

24. Please fill in as much detail as is known to you for all sections of the Site History question. All planning applications are screened by the Planning Authority in relation to published information on flood risks. Applicants may need to submit supplementary information where a flood risk is identified in relation to the site. You may need to refer to the council’s website to view the Planning Enquiry System and confirm any valid planning applications that have been made on the site in question.

It is important to note that if a valid planning application has been made in respect of the subject site or structure in the 6 months prior to the submission of this application, then the site notice must be on a YELLOW BACKGROUND in accordance with Article 19(4) of the Planning and Development Regulations 2001 as amended. Please note that if the site of the proposal is subject to a current appeal to An Bord Pleanala in respect of a similar development, the appeal must be determined or withdrawn before another similar application can be made.

25. The Services question is concerned with water supply, wastewater treatment and surface water disposal. For each question please state the existing situation that is currently in place on the site if any and then proceed to tick the appropriate box regarding what is proposed. For example if there is no existing wastewater treatment unit on the site and you wish to put a biocycle unit in place; write‘none’ in the box next to Existing Wastewater Treatment then tick the box next to ‘New’ and give details of the name and type of biocycle unit that you intend to install. A separate sheet showing any of the service details may be submitted if needed. (Refer to note 4 on p3 of these guidelines for details on wastewater treatment). If you’re proposed source of water supply is by connecting to a Group Water Scheme, a letter of consent

for connection to same should be submitted with your planning application. Please note that where a Package Treatment Plant is proposed and will be discharging to waters, either surface or ground waters, a licence under the Water Pollution legislation will be required (discuss with Council’s Environmental Section). Irish Water is now your contact point for all water and wastewater connections to the Public Infrastructure. You are strongly advised to contact Irish Water with a pre-connection enquiry as early as possible in the project. Initial contact can be made before any application for planning permission has been made to the relevant Local Authority. The pre-connection enquiry process enables you to obtain upfront knowledge of whether a connection is technically feasible or not, as well as an explanation of the work needed in order to facilitate the connection. The outcome of the pre-connection enquiry may influence your planning permission application; for example, a connection may require an on-site pumping station which itself might need planning permission. To commence the pre-connection enquiry process, you must complete a pre-connection enquiry form. To get the form, please visit www.water.ie/connections to download the form. Alternatively you can call Irish Water on 1850 278 278 and a form can be sent to you. The pre-connection enquiry form will be accompanied by guidance notes for completing the form. 26. Please indicate if you own any land that surrounds, adjoins or is near to the site in question. 27. Your landholding should be outlined in blue on the site location maps that you have submitted. For example if you own a farm and this application is only concerned with one site on your land then the site boundaries should be outlined in red and the rest of your land outlined in blue.

28. Cork County Council has a list of approved newspapers for the publication of notice of intention to make a planning application; it is attached to the rear of these notes. Please refer to this list and choose which newspaper would best suit the publication of your press notice. Enter the date of publication and the date on which the site notice was erected in the relevant boxes. Applications must be submitted to the Planning Authority within 14 days of publication of the Press Notice otherwise the notice is invalid and the application will be returned as invalid. The date of publication is day 1 of the 14 days. 29. (A) Please enter the appropriate fee amount and show how you calculated it. If you need help in calculating

the fee then please contact either the registration section or the drawing office of the Planning Dept. Schedule 9 of the Planning and Development regulations 2001 is attached to the rear of these notes. It contains the classes of development and the fees that apply to them.

(B) Please indicate how you propose to pay or have paid your planning fee. Please also refer to page 22 of these guidelines for the procedure to follow when paying by an Electronic Fund Transfer (E.F.T.)

If your application is only for a domestic development or for Outline Planning Permission please proceed to question 59 of this form. P11 (Q.30 to Q.36) of the form must be completed if the application relates to Business, Enterprise, Industry, Retail or other Commercial Type Developments. You may use a separate sheet to answer some of the questions on the form. If you choose to do this, then be sure to reference the relevant sheets in the spaces provided on the form.

30. Please state the intended use of the development. Describe the nature of the business that will be conducted on the premises. List all raw materials that will be used on the site. Describe the industrial or manufacturing processes that will be carried out on the premises and list any manufactured goods produced. 31. If smoke, dust, noise, odours or any other emission is produced as a result of the processes on site then please give details of them and state how you will control these emissions. State if you have an IPPC licence for the control of any waste/emissions. 32. List all liquid effluents and solid wastes that are produced or would be produced as a result of the processes associated in the development. Describe the methods that you intend to use in order to dispose of any effluents or solid waste produced on site. Make sure that you also describe how any sewage is treated and/or disposed of on site.

Please note that if a connection for surface water and/or a foul sewer is required then the size, description and the gradient of drains must be shown on plans.

33. (a) Provide details as to how many people would be employed on the site. (b) Provide details, to the best of your knowledge as to how much traffic will be generated on the site. Remember to take employees and customer traffic into consideration. 34. Give details of how the development is supplied by water. Describe how the water is used in the manufacturing and cooling systems and give details of the temperatures of the water. State the amount of water used every day and how the water is disposed. State if you have a licence for the disposal of the water. 35. Please state how the development will be supplied by energy/power i.e. oil, gas, mains electricity etc. 36. If you need to store raw materials or finished products on site please give details of the nature of these materials and specify if these items are to be stored indoors, outdoors, in open or covered storage. Be sure to provide storage details for any hazardous materials. Please list any safety procedures and protocols that you have in place for these materials.

Questions 37 to 58 of the application form are concerned with Agricultural Development. If your application is not for agricultural development or does not have stables as part of the development then please proceed to question 59. 37. There are 21 River/Lake Water Management Units (WMU’s) (Whole or part) in Cork County. These are

made up of Water Bodies which are a coherent sub unit in the River Basin. W.M.U.’s are used to manage the Water Bodies. Water Bodies have been defined and delineated by the EPA as part of the Water Framework Directive. The Water Body is the only unit reportable to Europe. All action/measures under the Water Framework Directive must be reported at Water Body level, i.e. farm inspections, septic tank inspections, discharge license reviews, planning applications (granting and refusal), WSIP program, etc.

The Water Body code is an alphanumeric code (e.g. IE_SW_19_755) and can be obtained from the following website www.wfdireland.ie by clicking on water maps.

38. State the distance between the farmyard and the nearest third party dwelling. This should also be shown on a site layout or a farm layout. Third party here means any land or structure that is neighbouring your land and is not in your ownership. 39. State the distance between the farmyard and the nearest watercourse, i.e. stream or river. This should also be shown on a site layout or a farm layout. 40. State what the proposed building/development will be used for when it is completed.

41. State the distance of the proposed building from any dwelling that is neighbouring your site but is not in your ownership or on your land. Show buildings to the front, rear and on either side of your development. These buildings should also be shown on the site layout map or a farm layout map.

42. Please complete the relevant boxes in order to show the number and type of animals to be accommodated on the farm.

43. Please complete the relevant boxes in order to show the number and type of animals involved in intensive agricultural enterprises.

44. Please complete the relevant boxes in order to show the number and type of animals to be accommodated in the proposed building.

45. This question must be completed for any stables that are part of a residential, commercial and/or agricultural application. Please tick the boxes indicating the intended use of the stables in your development.

46. Please provide details of the quantities and types of silage that are produced on the farm each year.

47. Please provide details of the open feeding yards and the open soiled yards to which the farm animals have regular access. You should show this on a site layout map or farm layout map.

48. Please state the number of hectares in your ownership. (This must be stated here but should also be highlighted or outlined in blue on a site location map.)

49. Please state how the farm is supplied with water. Make sure that your answer corresponds with question 27 of this form. 50. Please answer Yes or No. (You should include the date of the most recent visit if you are aware of it.)

52. Please indicate if soil analysis tests have been carried out on your land. You may enter the most recent date if known.

53. - 58. For these questions you may show details on either your Farm Structures Record which is found to the rear of the Application Form or on your Site/farm layout and Site location maps.

The notes below should also help to complete your application for agricultural development. They are suggestions as to how your application/plans should be set out and were compiled with the cooperation of Council’s Environment section. This will assist the Planning Dept. in processing your application and help to avoid any unnecessary delays.

As a minimum the plan/proposal shall contain;

� A site layout drawing to scale 1:500 which shall clearly identify all existing & proposed structures, wells & watercourses, within the site boundary, cross referenced to a Farm Structures List or Record with each structure getting a unique reference number. The site layout drawing shall also indicate all structures adjoining or in the vicinity of the site, in particular any adjoining or nearby dwellings, wells & watercourses.

� A Farm Structures List or Record identifying all existing and proposed structures on site including; buildings, tanks, yards, silos, aprons etc., their respective floor areas (& gross capacities for tanks calculated from internal measurements of tank) and proposed and existing uses. A blank Farm Structures Record is attached which may be used.

� The site layout drawing shall identify the drainage systems for storm water from roofs & clean concrete areas in blue.

� The site layout drawing shall identify the drainage system for soiled water, silage effluent, etc., both existing & proposed, including diversion chambers, in red, & where these will discharge. Soiled yard areas shall be clearly identified on plans & specified on Farm Structures Record.

� The site layout drawing shall identify regular movement routes for livestock, particularly where dairy cows are moving on a twice-daily basis, & what provision is to be made for handling soiled water from these areas.

� The plans, elevations and sections submitted shall clearly show the detail of the development which is proposed & how this fits in with the existing structures on site.

� The plan /application shall indicate the number, type & age of all livestock to be accommodated on the farm, identify the number, type & age of animal accommodated in each structure in the farmyard and where the effluents generated are collected and stored. Please indicate whether the effluent storage tanks are open, covered, slatted, or within existing or proposed covered structures.

� Provide details of any other livestock housing, not on this site, used by the applicant during the winter period, including location map & details of facilities.

� The plan /application shall indicate the net or adjusted acreage [Hectares] in your control or ownership and the acreage available for the land spreading of organic fertilizers.

� The plan /application should identify the number & type of animals to be housed on straw bedded areas or on partially straw bedded areas. Also clarify how farmyard manure from these bedded areas will be managed during the housing period.

� If organic fertiliser, (slurry, poultry manure, sludge, etc), is imported or exported from the farm details shall be provided as to type, quantity, source/destination of such material & where such material is stored on farm, prior to land spreading, if relevant.

� The volume of slurry, effluent & soiled water generated in the farmyard shall be calculated in accordance with S.I. No. 31 of 2014, European Union (Good Agricultural Practice for Protection of Waters) Regulations 2014 or any subsequent regulations.

� The storage capacity of the slurry, effluent & soiled water storage facilities (existing or proposed) in the farmyard shall be calculated in accordance with S.I. No. 31 of 2014, European Union (Good Agricultural Practice for Protection of Waters) Regulations 2014 or any subsequent regulations.

� If straw bedded facilities are proposed for livestock then feeding & exercise areas shall be clearly identified & provision made for collection & storage of slurry & soiled water from these areas.

� The plan shall clearly show how the applicant will comply with S.I. No. 31 of 2014, European Union (Good Agricultural Practice for Protection of Waters) Regulations 2014 or any subsequent regulations in terms of slurry, effluent & soiled water storage capacity.

� If an overground steel or concrete tank is proposed an earthen bund may be required to protect any vulnerable watercourses from accidental discharges from the tank. The integrity of such tanks is not in question; however human error may lead to valves being left open leading to spillages. A simple remote earthen bund is sufficient for this purpose.

� All plans shall be countersigned by the client before submission to this office or to the Planning Department, this ensures that the client takes ownership & responsibility for the proposals submitted.

� Provision shall be made in plans for bunding of diesel tanks. � All proposed construction work shall comply with Department of Agriculture & Food specifications. These

specifications can be accessed on their website or by contacting the Department. � Construction waste shall be disposed of in accordance with the Waste Management Acts 1996 to 2006. If

construction waste is to be removed off site it shall be disposed of to a licenced or permitted facility. � Please ensure that all copies of documentation submitted are clear & legible. The regulations referred to can be found on the Department of Environment, Community & Local Government website (www.environ.ie) or a copy can be obtained from the Government Publications Office.

NOTES ON THE COMPLETION OF THE FARM STRUCTURES RECORD

Classification of buildings to be used in the preparation of this farm structures list is to be as per Planning & Development Regulations 2001 S.I. 600/2001, Agricultural Developments. The following is a brief description of the various classes used in the table, for complete descriptions see the above named regulations.

Class 6 Works consisting of a roofed structure for the housing of cattle, sheep, goats, donkeys, horses, deer or rabbits.

Class 7 Works consisting of a roofed structure for the housing of pigs, mink or poultry. Class 8 Works consisting of roofless cubicles, open loose yards, self-feed silo or silage areas, feeding aprons, assembly yards, milking parlours or structures for the making or storage of silage or any other structures of a similar character or description. Class 9 Works consisting of any store, barn, shed, glass-house or other structure, not being of a type specified in class 6, 7 or 8 as above.

A: EXISTING STRUCTURES IN FARMYARD

Provide accurate internal dimensions for all buildings and structures in the farmyard and clear descriptions of their use, (e.g. “Haybarn” “Cubicle House” “Walled Silo”). Dimensions should be given to the nearest single decimal point (e.g. 3.2 metres, not 3.185 metres). Likewise, all yards should be accurately measured, and recorded. A second form should be used if there is not adequate space. All buildings, structures and yards must be clearly identified and shown on the associated drawing. The column entitled “Discharge to” is to contain the identification number of the effluent tank to which the effluent created in that structure discharges to.

B: PROPOSED NEW STRUCTURES

Provide accurate dimensions and descriptions of all proposed new buildings, structures and yards. (N.B. for proposed slurry and soiled water stores, see Box “D” notes below). All proposed buildings, etc., must be clearly identified and shown on the associated drawing. The column entitled “Discharge to” is to contain the identification number of the effluent tank to which the effluent created in that structure is proposed to discharge.

The provision of additional contact information such as email addresses or phone numbers is voluntary and will only be used by the Planning Authority to contact you should it be deemed necessary for the purposes of administering the application. These details will not be made available to any third party with the exception of An Bord Pleanala for the purpose of administering an appeal.

An applicant will not be entitled solely by reason of a planning permission to carry out the development. The applicant may need other consents, depending on the type of development. Interpretation

1. For the purposes of this Schedule, where appropriate, the “provision” of a house, building or other structure means-

(a) the carrying out of works

(b) the making of a material change in the use of a structure, or

(c) the retention of an unauthorised development.

2. (a) Subject to paragraph (b), at references 6,7,11 and 12 of column 1 of Section 2 of this Schedule “use of land” shall include the retention of an unauthorised use of land, and the carrying out of works, or the

retention of structures, on, in or under the land which are incidental to the use.

(b) At reference 11 of column 1 of Section 2 of this Schedule, “use of land” shall not include the carrying out of works for the provision of a club house or related facilities for persons using the golf course or pitch

and putt course, or the retention of any such structures. Section 2

Maximum and minimum fees for planning applications 1. The maximum fee payable to a planning authority by an applicant in respect of an outline application shall be �28,500. 2. The maximum fee payable to a planning authority by an applicant in respect of an application to which article 161 applies shall be �9,500. 3. The maximum fee payable to a planning authority by an applicant in respect of an application for permission for retention of unauthorised development applies shall be �125,000. 4. The maximum fee payable to a planning authority by an applicant in respect of any planning application other than an application mentioned in paragraph 1, 2 or 3 shall be �38,000. 5. The minimum fee payable to a planning authority by an applicant in respect of a planning application shall be �34 and, in any case where the planning authority make a refund in respect of a planning application, the refund shall not be such as to reduce the balance of the fee to less than �34.

Pre-Planning Clinics and Pre-Application Consultation

Under Section 247 of the Planning and Development Act 2000 anyone who has an interest in land may request a pre-application consultation regarding a proposed development.

Pre-Planning Clinics Cork County Council provides face-to-face Pre-Planning Clinic Meetings in the Local Area Offices under Section 247 of the 2000 Act. These Pre-Planning Clinic meetings must therefore adhere to the following criteria in order to comply with the legislation:

� Official Pre-Planning Clinic Meetings will be given a specific reference number which can be linked with the Planning Application (Q23) should one be submitted as a result of that pre-planning meeting.

� A record of the time, place and all details of the meeting must be recorded at the pre-planning clinic and be made available to the public when the decision is made.

� All written (2 copies) and electronic requests for pre-planning appointments must be accompanied by: • A Cover letter which includes the name & address, telephone number of the owner/applicant,

detailed connections to the area, if working / born in the area, for how long etc. • Details of the nature of the proposed development. • A Site Location Map – showing clearly the location of the land. (If the site is part of a family farm,

submit a map outlining the full farm landholding and all current dwellinghouses on the land) • Draft Site Plans and House design plans (photographs may be accepted instead of drawings) • Confirmation of land ownership or written consent to the Planning Authority from the landowner to

provide pre-planning advice

Requests for Pre-Planning Clinics will not be accepted unless the above documents are included!

Each appointment will be acknowledged by letter/email giving a pre-planning number. A separate appointment is required for each proposed development/application.

Pre-Planning Phone Calls may be accepted by the planner if they are in the office. If they are not available then a message will be taken and the planner will return the call when they can. Pre-Planning topics which can be dealt with over the phone and which normally don’t require a meeting may include site selection within a family landholding and sites for sale. Zoning and settlement policy queries should initially be directed to the staff in the public offices where the applicant may be advised to contact the area planner.
