The 1978-79 Republication Budget Hearing was opened at 7:05. There were no comments from citizens.

It was moved by Mr. McFadden, seconded by Mrs. Marx, and carried unanimously that in accordance with Education Code 85210, the resolution to appropriate excess funds in the total amount of $564,000 be adopted and published.

It was moved by Mr. McFadden, seconded by Mrs. Marx, and carried, that Mr. John Outcault be authorized to proceed with High Desert Campus facilities planning and feasibil­ity study on an hourly basis, not to exceed $1,500, in­cluding initial $350.00 payment.

It was moved by Mr. McFadden, seconded by Mrs. Marx, and carried, that the Preliminary Budget for the 1979-80 fiscal year be approved in the total amount of $10,398,858.

.niEREAS, the legislature has not adopted a finance program to support Community College operation during 1979-80; and

.niEREAS, the District is required to adopt a balanced budget; and

~mEREAS, the California Supreme Court has ruled that school districts may not reduce certificated annual salaries subsequent to July 1;

NOW, THEREFORE BE IT RESOLVED that Coachella Valley Community College District Board of Trustees declares an emergency to exist in the District; and

BE IT FURTHER RESOLVED that Policies 114200, page 18, Items 3 and 4 and 114140, page 3, Items' 2, 3 and 6 be suspended; and

BE IT FURTHER RESOLVED that all' certificated and classified salaries shall be frozen at the 1977-78 level plus 6.8% equivalent increase in 1978-79, effective July 1, 1979 for the 1979;...80 year, and

BE IT FURTHER RESOLVED that this sction shall in no way be interpreted to preclude agreement to meet and discuss application of such actions.

Today, we received word that a finance bill has been signed by the Governor. As in last year's bill we have until August 14 to adopt, and September 7 for· hearing, the 1979~80 budget. Therefore there is a need to reschedule August.and September meetings. At this writing, we do not know our allocation, but should have some specifics

) by meeting-time.

Mr. Outcault will be present at your meeting with information you requested. He will have mOre elaborate site drawings, costs in greater detail and verifications of approval by various State agencies.

The ASCOD President, Noel Ramos will be present for the meeting. In conformity with your present policy, I assume you will want to seat him. I suggest this be done at "Oral Communication" time.

SUBJECT: Notice of Consolidation of Governing Board Elections and Order of Election for November 6, 1979

In accordance with Education Code Sections 5323 and 5340, you are hereby notified that "school district governing board member elections for two or more school districts of any type to be held in the same district or area on the same day shall be consolidated ... ". The purpose is to allow persons entitled to vote in two or more such elections to do so at the same time and place and with one ballot. Also, the cost of the election to each district is kept lower by consolidation.

To assist you in meeting the requirements of Education Code Sections 5304 and 5322, attached are three copies of the ORDER OF ELECTION, which also contains the Specifications of the Election Order. One copy is provided for your records; executed copies are to be submitted concurrently to the Riverside County Superintendent of Schools and the County Clerk (Election Department) at least 98 days prior to the election day of November 6, 1979, viz., July 31, 1979.

Further consolidation of elections is permitted by Education Code Section 5342 which states that any school district election scheduled to be held on the same day in the same territory as an election called by any city, county, or other political subdivision may be completely or partially consolidated with such election. Attached are three copies of a RESOLUTION REQUESTING CONSOLIDATION which may be used to authorize consolidation from the school district; the city or other political entity also must adopt a resolution requesting such consolidation. Copies of this resolution are to be submitted concurrently to the Riverside County Superintendent of Schools and the County Clerk (Election Department) at least 74 days prior to the election day of November 6, 1979, viz., August 24, 1979.

An election calendar for the governing board member election of November 6, 1979, has been prepared by the Riverside County Election Department, under the direction of Eldon D. Jones, Assistant Registrar of Voters. Selected dates from this calendar are as follows:

July 9: (120 days) Deadline for County Superintendent of Schools to notify in writing governing boards regarding mandating consoli­dation of governing board member elections.

July 19 to August 28: (110 days to 70 days) Earliest and latest dates for publication of notice to declare candidacy (once a week for 3 weeks) handled by the County Election Department. .

August 24: (74 days) Deadline for governing boards to submit requests to the County Clerk (Election Department) for either complete or partial consolidation of election with an election for the same date in city, county, or other political subdivision.

August 9 (89 days) and August 30 (68 days): Earliest and latest dates for filing declarations of candidacy for govern­ing board member.

November 6: Election Day.

November 30: Expiration of term of office for governing board members under 1979 consideration.

At the direction of the Board of Trustees at their last Board meeting, I am submitting to you a proposed plan for the election of the student member to the Board of Trustees for the Coachella Valley Community College District.

since we were unable to implement this procedure during the spring of 1978 and elect a student representative prior to July 1, I am proposing that the Associated Student Body President, Noel Ramos, serve in this capac­ity until a student trustee board member is elected in the fall. The proposal includes a time schedule, eligibility requirements, duties, declaration of intent to run for office, and a statement of qualifications form. Normally this election procedure will take place during the spring semester, so that the new student trustee could take his seat on the Board. after July 1.

REQUIREMENTS TO BE ELIGIBLE FOR THE POSITION

OF STUDENT TRUSTEE ON THE COACHELLA - ---- ---VALLEY COMMUNITY COLLEGE DISTRICT

Education Code 72023.5 Student Members

The governing board of each community college district shall order the inclusion within the membership of the govern­ing board, in addition to the number of members otherwise prescribed, one or more nonvoting students who are residents of the district. Such students shall have the right to attend each and all meetings of the governing board, except that student members shall not have the right, or be afforded the opportunity, to attend executive sessions of the governing board.

The students selected to serve on the governing board, in addition to being residents of the district, shall be en­rolled in a community college of the district and shall be

. chosen, and shall be recalled, by the students enrolled in the community colleges of the district in accordance with procedures prescribed by the goVerning board. The term of the student members shall be one year commencing on July 1 of each year.

The nonvoting student members appointed pursuant to this section shall be entitled to the mileage allowance prescribed by Section 72123 to the same extent as regular members, but

• are not entitled to the compensation prescribed by section 72425.

A nonvoting student member shall be seated with the members of the governing board and shall be recognized as a full member of the board at the meetings, including receiving all materials presented to the board members and participating in the ques­tioning of witnesses and the discussion of issues.

The nonvoting student member shall not be included in determining the vote required to carry any measure before the board.

The nonvoting student member shall not be liable for any acts of the governing board.

The Duties of the StUdent Member to the Board

of Trustees:

The duties of the Student Member shall not only in­

clude those rights afforded the Student Member by

section 72023.5, but shall include the following:

1. Be an active liason between the students and the Board.

2. Devise an informational program to communicate more effectively matters and policies concern­ing the students.

3. Devise a program by which the students can re­lay their problems and concerns back to the Board.

4. A student member may not serve as the president of the community college district governing board. A student member may serve as secretary of the community college district governing board provided that such student member may not attend executive sessions of said board.

5. Student members are authorized to attend special meetings of the community college district govern­ing board.

The Student Trustee Member, by law, is not permitted

to perform the following:

1. A student member is not entitled to make, amend and second motions to be voted upon by the com­munity college district governing board.

2. A student member is not entitled to all fringe benefits which are provided by a community col­lege district governing board to other members of the board.

3. Student members are not entitled to transportation costs for visits to schools or conferences autho­rized for other members of a community college district governing board which are not conducted in conjunction with as annual, regular or special meetings of the board.

I am pleased to report that 56 districts participated in support of the Hashington Office during the current year in spite of Proposition 13 and funding constraints.

The Hashington Office has a good record of accomplishment, and, consequently, the Federal Affairs Council voted at its last meeting to select a permanent director and bill the districts at the same rate as 1978-79, plus whatever percent increase the Legislature allocates to the community colleges when they pass finance legislation later this month or in July. This information will help you in anticipating an item in your budget supporting the Hashington Office.
