Article 1 Purpose

Article 2 Recognition

201 The company recognizes the union as the sole bargaining agent for all its employees of Victorian Order of Nurses Renfrew County Branch working at the Pembroke Civic Complex and employed as kitchen workers ( cooks and bakers ) dietary aides personal support workers housekeepers health care aides and maintenance workers save and except supervisors persons above the rank of the Supervisor persons employed in a confidential capacity in matters relating to labour relations office c1ericaland sales staff companion sitters students employed during the school vacation period and persons in bargaining units for which any trade union held bargaining rights on April 6 1999

202a) Employees and persons not in the bargaining unit shaH not do work which is done by the workers in the bargaining unit which results in a layoff or prevents a recall except for the purpose ofemergencies when bargaining unit employees are not available

b) Management or excluded supervisory personnel shall not work on any jobs which are included in the bargaining unit except as part of their duties established through past practice provided that the performance of the aforementioned duties does notmiddot reduce the normal hours of work for any employee in the bargaining unit

c) The parties agree that the use of co-op students and volunteers is an integral part of VONs business The Employer acknowledges that its use ofco-op students and volunteers will not reduce the normal hours of work for any employee in the bargaining unit

ARTICLE 3 MANAGEMENT RIGHTS

301 The union recognizes the right of the Company to direct the working forces including the right to hire promote transfer any employee to demote discipline suspend or discharge any employee for cause to classify any new occupation or any employee and the right to relieve employees from duty because of lack of work or other just reasons subject to the provisions of the collective agreement

302 Tt shall be the exclusive function of the Company to determine the extent and location of its operations the scheduling of its workers and facilities to detennine the number of employees needed at anytime and to make and alter policies and mles of procedure and conduct for its employees subject to the provisions of this agreement

303 These rights shall be exercised in a fair and consistent manner

Article 4 lJnion Rights and Responsibilities

401 The union has the right and responsibility to represent and intervene on behalf of its members on any matter in relation to this agreement A representative of the Union can participate or intervene in any matter pertaining to this agreement

402 a) All employees must pay the equivalent of monthly union dues by payroll deductions

b) An amount equivalent to initiations fees will be deducted from the employees after they have completed their probationary period and these monies will be sent along with the union dues and the remittance statement

403 The Company will deduct union dues in the first pay period of each month and will remit the amount to the Financial Secretary ofLWA - Canada Local 1000 by the 15th of the following month with a list of names amounts deducted and total Any deduction missed will be picked up in the next pay period

404 The Company will contribute to the U~ions Education Fund on the basis of $002 cents per employee per monthly payroll hour Such monies will be sent monthly along with the dues remittance check

405 The Union will notify the Company in writing at least 30 days in advance as to the amollllts and schedule of deductions

406 The appropriate amounts will be entered on each employees T-4 slip

407 The union agrees to indemnify the company of any recourse in damages or otherwise against the Victorian Order of Nurses for making the above deductions and payments during the life of this collective agreement

Article 5 Strike Slowdown Lockout

501 No strike slowdown stoppage of work or lockout shall occur while this agreement is in effect

Article 6 Union Committee amp Representation

601 The Union will maintain a committee comprised of not more than two (2) employees one whom shall be the chairperson The Company will recognize the Union committee members upon receipt of written notice from the Union

602 Union committee members shall investigate and process grievances in accordance with the grievance procedure set out in this agreement

603 The Union committee and grievor shall meet with the Company at step 2 of the grievance procedure

604 The Union committee shall also be the Negotiating committee

605 No committee member shall leave his place of work to investigate or process any grievance complaint or conduct union business without prior consent from the Company Committee members will not absent themselves from their regular duties unreasonably and the consent from the company will not be unreasonably withheld unless it interferes with the efficient operations of the company

606 It is understood that the members of the negotiating committee shall suffer no loss of regular earnings during meetings in direct negotiation with management for the renewal of future collective agreements

607 Committee members will be paid regular straight time for reasonable time spent handling grievances during their regular shifts

Article 7 Grievance Procedure

701 A grievance is by definition a claim by either party arising out of any disagreement regarding the interpretation administration application or alleged violation of this agreement

702 It is understood that an employee has no grievance until he has first discussed the matter with the Supervisor and may be accompanied by a Union committee member within 5 days of the incident The Supervisor shall state his decision verbally within 5 days of receiving the grievance

Step 1 Failing settlement the grievance will be submitted in writing within five (5) days of receipt of the Supervisors answer The grievance will state where the problem area is The Supervisor will reply in writing within five (5) days of receiving the grievance

Step 2 Failing settlement the Union committee the Union representative and the grievor shall meet with representatives of Management to discuss the grievance within five (5) days of the Supervisors reply or at a time mutually agreed upon by the parties The Company shall reply within ten (10) days of the meeting

703 Failing a settlement of the grievance the grievance may be referred to arbitration within thirty (30) days from the receipt of the Company written reply by giving written notice to the Company of its choice of arbitrator( s) tailing agreement of the choice ofarbitrator the Minister of Labour will be requested to appoint one

704 A grievance on behalf of more than one employee will be presented listing the names of the grievors as a group

705 Either party may initiate a Policy grievance beginning at Step 2 of the grievance procedure Such grievances shall be filed within 10 days of the incident giving rise to the complaint

706 Time limits may be extended by mutual agreement of the parties

707 Each party shall pay its own expenses including those for its nominee and witnesses and the fees and expenses of the arbitrator shall be borne equally by the parties

Article 8 Seniority

801 The Company recognizes and will apply the principle of seniority That an employees job opportunities and security increase in proportion to his length of service

In any case of vacancy promotion transfer lay-off and recall from lay-oft the employee having the greater seniority will be entitled to the preference provided he has the skill and ability to be trained and familiarized within a five (5) shift period if required to do the normal requirements of the job

802 An employees seniority will be his length of employment -1th the Company dating back to his first date of hire In the event of layoff full time employees will have the preference to bump less senior full time employees tirst then less senior part time employees Part time employees will have the preference to bump less senior part time employees as per article 80 I

803 All seniority is cancelled by such action as

a) If he voluntarily quits or is discharged and is not reinstated through the grievance procedure

b) Overstaying a leave of absence which means failing to report on the first scheduled shift after expiration of the leave unless he has legitimate reason for doing so~

c) Absence from work for three (3) consecutive schedule shifts without notifying the company except where the employee has just and sufficient cause for his failure to report

804 A newly hired employee shaH be known as a probationary employee until he has worked and successfully completed a period of 500 working hours or 6 months whichever comes first

Notwithstanding anything contained herein it is hereby agreed that there is no right to recall for probationary employees who are laid off

805 a) Time off due to illness injury will be included in an employees continued accrual of

seniority

b) Time off due to pregnancy layoff or leave of absence to a maximum of twelve consecutive months will be included in an employees continued accrual of seniority

H06 A current seniority list will be maintained by the Company A copy vill be posted on the bulletin board and a copy given to the Union The seniority lists will be updated and made current every three (3) months

807 In cases of lay-off the Company will give each employee affected a minimum of 2 weeks advance notice

808 here the date of recall is known or anticipated at the time of lay-oft~ employees affected will be informed accordingly by the Company

809 In any event a recall notice will be sent by registered mail to each employee at his last give~ addres the notice may be supplemented by telephone or personal contact by the Company The Company will not be held responsible if the inability to contact an employee is due to his failure to provide the Company with his current address

810 The recalled employee must reply within three (3) days of his intentions and must report for work as soon as he can but no later than seven (7) days from the postmark date of the reistered letter Failure to do so will result in all seniority beinl lost and he will be--

deemed to have tenninated his service with the Company

811 Job Postings

When the Company decides to fill a current or new position in the bargaining unit notice of the position ~II be posted on the bulletin board for five (5) days so that all the employees will know about the position and be able to apply for the position in writing

Such job postings shall contain the following infonnation classification full time part time or casual duties qualifications date of posting and deadline for applications

The successful applicant will be awarded the job as per article 801 Within the five (5) shifts period the employee may elect to return their previous job and schedule or the Company may return the employee to their previous job and schedule if the employee does not meet the nonnal requirements of the job If no qualified employee has applied the Company may then hire from outside the Home

Article 9 Leave of Absence

901 The Company may grant leave ofabsence without pay to employees for legitimate personal reasons provided that such request is made in writing two (2) weeks in advance and the reasons for the leave ofabsence are stated Such request will not be arbitrarily denied

902 Leave of absence without pay will granted to employees who are required to attend union business upon a 2 week notice by the union in writing to the Company It is understood that no more than one employee may be off at anyone time except for special meetings for educational purposes and that granting leave is subject to the service needs and staffing requirements

Article 10 Bu lIetin Boards

1001 The Company will provide one (1) bulletin board in a mutually satisfactory location for the convenience of the union inposting notices of union activity All such notices must be signed by a member of the union committee or by the union representative Notices of a special nature must first be submitted to the company before posting

Article 11 Health and Safety

1101 The Company and the Union will cooperate fully in the development and maintenance of the highest possible standards of health and safety for all employees with emphasis on measures preventing accidents and industrial disease and ensuring adequate first-aid

1102 The parties hereto will establish and maintain ajoint health and safety committee and will ensure compliance with the health and safety legislation

1103 The committee will be comprised of Company and Union representatives and will hold regular meetings as required by the Occupation Health amp Safety Act The Company will supply the chairperson of the SubLocal with a copy of the investigation reports

Article 12 Reporting Allowance and Call-in Pay

1201 Any employee reporting for work at the start of his regular shift without having been previously notified not to report shall be given 4 hours work which he is capable of perfonning at his regular hourly rate or the rate of the job whichever is greater or he may elect to go home without pay Should no other work be available he shall receive 4 hours pay in lieu thereof

1202 a) Any maintenance employee called into work for emergencies after having left the

premises of the company following the end of his regular shift shall be paid a minimum of I hour at his regular straight rate in respect of each call in or paid time and one half for all hours worked whichever is greater

1202 b) Any employee other than maintenance who are called into work for emergencies after

having left the premises of the company following the end of his regular shift shall be paid a minimum of 3 hours at his regular straight rate in respect of each call in or paid time and one half for all hours worked whichever is greater

Article 13 Bereavement Pay

1301 In the event of a death in the immediate family of an employee who has successfully completed probation the employee will be entitled to a paid leave for 3 consecutive days at the time of death for the following spouse child stepshychildren son-in-law daughter-in-law parents step-parents brother sister pareQts-in-Iaw brother-in-law sister-in-law grandparents and grandchildren Up to an additional two (2) days for travelling if required to attend the funeral may be granted without loss of regular pay from regularly scheduled hours

Article 14 Hours of work and Overtime

1401 It is understood that this article is intended only to provide the basis of a work week for bargaining unit employees but shall not be interpreted as a guarantee of nonnal hours of work per day or nonnal hours of work per week

1402 Any hours in excess of eighty eight (88 ) in a 2 week period will be paid at the rate of time and one half the hourly rate for the job on which the overtime was worked

Staff working the midnight shift will be entitled to h hour paid lunch break During this paid break the employee is required to remain in the building with their phone on available to respond to any emergency that may occur ( Clarification under current staffing pattern staff working the midnight shift will be paid 8 hours instead of the current 75 hours )

Employees working an evening shift who are entitled to a lunch break will take their lunch break from 1830 - 1900 hours and not be required to be available to the building during this time based under current staffing patterns

1403 The term full time employee in this agreement shall mean a person who is regularly scheduled and actually works at least seventy five (75) hours in a two week period for the company exclusive of meal periods

1404 The term part- time employee in this agreement shall mean a person who is regularly scheduled and normally works less than seventy five (75) hours in a two (2) week period exclusive of meal periods

a)

Employees will be allowed rest periods at times approved by their immediate supervisor with pay as follows two (2)ten( 10) minute rest periods in each eight (8) hours ofwork OR

b) one (1) ten(lO) minute rest period in four (4) hours to and including five (5) hours of work

1406 Employees will be paid on a bi-weekly basis

1407(a) Request For Time Off (excluding Christmas New Years and the months of July and August)

Schedules will be posted at least 1 week in advance of the date of the schedule and will cover a 1 month period Master schedules are posted that repeat every 2 weeks or 3 weeks (housekeeping) Staffcan determine from the master the dates they are working for any time period and therefore are expected to submit their request for time off (including vacation) at least 2 weeks before the next posting of a schedule This is usually by the 15th of themiddot previous month (eg current schedule runs to May 30 by May 15 any requests for time off for June must be in to your supervisor)

b) Once the schedule is posted the employee must work the scheduled shifts If the employee wants a particular time off then he can exchange with another employee or part time and casual staff can give the shift away Full time staff may exchange a shift during the two week pay period however a shift cannot be given away It is the responsibility of the employee to find their own replacement Where such changes occur the provisions relating to overtime do not apply Exchanges are to be in writing and

submitted to the Supervisor for approval before the exchange or give away takes place (all exchanges must be signed by both parties and dated prior being submitted to the supervisor) This means that a weekend exchange must be submitted and approved by 400 pm Thursday for an exchange for Saturday Sunday or Monday Failure to submit exchanges alt above ~II result in disciplinary action (This is not in effect from the weekend prior Christmas up to and including January 51b of any given year)

(c) When an employee accepts or makes an exchange or accepts a give away that employee can not give that shift to someone else the employee must work that shift

(d) Replacement for illness leave of absence and vacation will be offered first to existing employees in that department ifhe is available If no one in that department is available part-time or casual employees from another department may be offered the work according to seniority and availability if that employee has the appropriate skills

(e) Part time and casual employees in all departments ~II be asked if they would like to work in another department following a probationary period The employee will then be oriented and will be offered work when no else from the department is available

Article 15 Paid Holidays

1501 The following holidays shall be paid at the employees nonnal scheduled hours and rate for all such hours

New Years Day Good Friday Victoria Day Canada Day Civic Day Labour Day Thanksgiving Day Christmas Day Boxing Day

1502 There will be two (2) floating holidays for each Full-Time employee to be taken at a time mutually agreed upon between the Company and the employee

1503 Any yvork perfonned on a Paid Holiday will be paid at time and one half the employees regular rate of pay for all hours worked for both full time and part time employees

Article 16 Vacation

1601 a) Employees who have less than one year of full-time continuous employment as of March

31 sl shall be entitled to a vacation pro-rated on the basis of 10 days vacation for each completed year ofservice If the employee leaves before the end of the first vacation year he will receive 4 of salary in lieu of vacation

b) Employees who have completed one or more years of full-time continuous service as of March 31 sl shall be entitled to a vacation of 10 days ( 4 of gross earnings for vacation entitlement year)

c) Employees who have completed 3 or more years of full time continuous service as of March 31 st shall be entitled to a vacation of 15 days ( 6 of gross earnings for vacation entitlement year)

d) Maintenance workers are as above with the exception of 15 days vacation ( 6 of gross earnings for vacation entitlement year) in as they perform emergency call back services

e) Maintenance workers who have completed 3 or more years of full time continuous service as of March 31 st shall he entitled to a vacation of20 days ( 8 of gross earnings for vacation entitlement year) as they perform emergency call back service

1602 If a statutory holiday falls within a vacation period an extra day shall be added to the vacation or taken at some other mutually agreed upon time

1603 The periods at which employees will be scheduled to take vacations will conform to the requirements of the Employers operations The Employer will post the vacation schedule for July and August by June 15th

Employees will submit their requests by May 15th

Where a conflict exists in vacation scheduling seniority shall be the governing factor Vacation time available after the allowed submission dates will be granted in accordance with the date of request and availability not seniority The employer will make every reasonable effort to grant an employee the first two (2) weeks of his annual vacation in consecutive weeks off It is understood that if employees are entitled to a third and consecutive five (5) day period provided there are no other employees who have not had their two week vacation alJotment the Employer wiJI make reasonable effort to grant the employee with the subsequent vacation allotment Employees shall be entitled to take vacations in single or more day allotment up to a maximum offive (5) single days

1604 Employees entitled to vacation with pay must take their vacation during the fiscal year April I to March 31 except for one week which may be carried over to the next year

1605 All vacation pay allowances shall be paid prior to the start of the employees scheduled vacation if requested on or before Monday of the payroll processing week

1606 Regular part-time employees shall be entitled to vacation pay as of March 31 S in the amount of 4 of their gross earnings After 3 years or more of continuous service as of March 31 ~ the vacation pay will be increased to 6 of their gross earnings

1607 Part-Time employees shall be entitled to vacation time off without pay based on years of service in the same amount as Full-Time employees

Article 17 Jury Duty and Crown Vitness

1701 The Company agrees to pay an employee who is summoned for Jury Duty or CrovvTI witness the difference between his pay received as a juror or witness and the pay he would have received had he worked his regular scheduled working hours at his regular straight time rate The employee must furnish proof of service and the amount received for Jury duty and Crovm witness and must notify the Company promptly of his selection for J lIry duty and Crown witnessmiddot

Article 18 Pay on day of Injury

1801 An employee who is injured at work and who requires medical attention and who on the advice of a doctor is unable to return to work shall be paid for the balance of his scheduled hours of the day upon which the inj ury occurred

Article 19 Duration

1901 The agreement will be in effect from October 12002 to September 302005 inclusively and from year to year thereafter unless notice to bargain is given by either party not more than 90 days and not less than 30 days prior to the date of expiration The working conditions of the agreement will continue to apply until the signing of the new agreement

Article 20 Full-Time Benefits

2001 ft is a condition ofemployment for full-time employees to enroll in the VON Flexible Benefit Plan including Long Tenn Disability Insurance After one year of continuous service full-time employees must join the VON Canada Pension Plan as a condition of employment

The Employer shall contribute toward premium coverage ofparticipatingeligible employees in the active employ of the Employer under the insurance plans set out below subject to their respective tenns and conditions including any enrolment requirements

4) VON agrees to contribute 100 of the hilled premium tmvards coverage of eligible employees in the active employ of VON under the Ontario Health Insurance Plan through the Employer Health Tax

8) VON agrees to contribute 50 of the billed premium towards coverage of eligible employees in the active employ of VON under the Health Care benefits up to a maximum of tier tO coverage for a couple as provided under the VON Flexible Benetit Plan

C) VON agrees to contribute 50 of the billed premium towards coverage ofeligible employees in the active employ of VON under the Dental Care benefits up to a maximum of tier two coverage for a couple as provided under the VON Flexible Benefit Plan

D) VON agrees to contribute 100 of the billed premium towards coverage of eligible employees in the active employ of VON for Life Insurance up to a maximum of 15 times salary (includes accidental dismembennent) as provided under the VON Flexible Benefit Plan

E) Active employ excludes absences without pay from VON in excess of thirty consecutive calendar days An employee on such leave of absence shall be responsible for full payment of the premiums set out above for any benefit plans in which she participates for the period of the absence and Vvill prepay to VON the premiums during the period of the leave to ensure her continuing coverage

F) The Employer shall provide eacmiddoth employee with information booklets outlining all the current provisions in the benefits plan defined in this article

G) VON will provide access for full-time employees to the national Long Tenn Disability insurance as provided under VON Flexible Benefit Plan subject to its tenns and conditions on the basis of 100 employee paid premiums

H) VON Pension Plan is maintained at a National level Enrollment participation and contributions by the employee and the Home will be in accordance with the tenns and conditions of the Plan

(i) All full time employees who are presently enrolled in the Homes pension plan shall maintain their enrollment in the Plan Full time employees employed but not yet eligible for membership in the Plan shall as a condition ofemployment enrol in the Plan when eligible

(ii) Part time employees are eligible to join the Pension Plan after twenty four months of continuous service lfthe employee decides not to join at this time he will not be eligible to join later unless he meets the provincial eligibility requirement or he becomes employed on a full time basis

The Company and the employee shall make contributions in accordance with the provisions of the Plan In cases of part time employees the amount of their benefits in lieu would be reduced from 65 (article 21 (d)) to 3

(For information purposes only) Current Provincial Eligible Requirements for the Province of Ontario are employee must have earned at least 35 ofYMPR ($3910000) or worked at least 700 hours in each of the 2 calendar years prior to enrolment

Article 21 Sick Leave

A) Sick leave is the granting of time off with pay for absences from regular scheduled hours due to legitimate illness There shall be a Sick Credit Accumulating Bank for each funshytime employee in the active employ ofVON Such employees shall accumulate sick leave credits at the rate of one and one half days (1125 hours per month) per completed month of full-time work to a maximum of 120 days (900 hours)

B) Where a full-time employee is absent from work due to legitimate illness she shall not lose her regular straight time earnings from her regular scheduled hours but shaH draw from her Sick Credit Accumulation Bank to the extent of her credits in the Banle

C) The company agrees to pay for the full cost of the physicians fee for any examination that is required by the company if the fee is not covered by the insurance plan

Part-Time Benefits

D) Part-time employees shall receive an amount of65 of their regular rate in lieu of fullshytime benefits ( full-time benefits sick leave paid holidays and pension plan) Such an amount shall not be paid on any overtime hours worked

New employees fill start at $050 an hour below the start rate of the job then move to the job rate at the end of their probationary period

A lump sum of $10000 for all full tiome amp part time employees and $5000 for all casuals on ratification

Letter of lInderstanding Re Lady Aberdeen Place

Whereas the Employer has closed the Lady Aberdeen Place the parties have agreed to remove references to the Place from the collective agreement

The parties agree that the removal of references to the Place in the current collective agreement does not signify an intention by the Union to abandon any bargaining rights that it might hold at the Place

This Letter of Understanding forms part of the current collective agreement as well as any renewals thereto unless specifically retracted in writing by the parties

Letter of Understanding dealing with Christmas amp New Years Time Frame

Time off at Christmas and New Years vill be scheduled as equitably as possible on an alternating basis

The Christmas schedule will be posted by November 20th and staff will be allowed to make shift changes for the Christmas period until December loth As of December II th the schedule will remain unchanged and no further shift exchanges will be allowed until after January 5th

Article 2 Recognition

201 The company recognizes the union as the sole bargaining agent for all its employees of Victorian Order of Nurses Renfrew County Branch working at the Pembroke Civic Complex and employed as kitchen workers ( cooks and bakers ) dietary aides personal support workers housekeepers health care aides and maintenance workers save and except supervisors persons above the rank of the Supervisor persons employed in a confidential capacity in matters relating to labour relations office c1ericaland sales staff companion sitters students employed during the school vacation period and persons in bargaining units for which any trade union held bargaining rights on April 6 1999

202a) Employees and persons not in the bargaining unit shaH not do work which is done by the workers in the bargaining unit which results in a layoff or prevents a recall except for the purpose ofemergencies when bargaining unit employees are not available

b) Management or excluded supervisory personnel shall not work on any jobs which are included in the bargaining unit except as part of their duties established through past practice provided that the performance of the aforementioned duties does notmiddot reduce the normal hours of work for any employee in the bargaining unit

c) The parties agree that the use of co-op students and volunteers is an integral part of VONs business The Employer acknowledges that its use ofco-op students and volunteers will not reduce the normal hours of work for any employee in the bargaining unit

ARTICLE 3 MANAGEMENT RIGHTS

301 The union recognizes the right of the Company to direct the working forces including the right to hire promote transfer any employee to demote discipline suspend or discharge any employee for cause to classify any new occupation or any employee and the right to relieve employees from duty because of lack of work or other just reasons subject to the provisions of the collective agreement

302 Tt shall be the exclusive function of the Company to determine the extent and location of its operations the scheduling of its workers and facilities to detennine the number of employees needed at anytime and to make and alter policies and mles of procedure and conduct for its employees subject to the provisions of this agreement

303 These rights shall be exercised in a fair and consistent manner

Article 4 lJnion Rights and Responsibilities

401 The union has the right and responsibility to represent and intervene on behalf of its members on any matter in relation to this agreement A representative of the Union can participate or intervene in any matter pertaining to this agreement

402 a) All employees must pay the equivalent of monthly union dues by payroll deductions

b) An amount equivalent to initiations fees will be deducted from the employees after they have completed their probationary period and these monies will be sent along with the union dues and the remittance statement

403 The Company will deduct union dues in the first pay period of each month and will remit the amount to the Financial Secretary ofLWA - Canada Local 1000 by the 15th of the following month with a list of names amounts deducted and total Any deduction missed will be picked up in the next pay period

404 The Company will contribute to the U~ions Education Fund on the basis of $002 cents per employee per monthly payroll hour Such monies will be sent monthly along with the dues remittance check

405 The Union will notify the Company in writing at least 30 days in advance as to the amollllts and schedule of deductions

406 The appropriate amounts will be entered on each employees T-4 slip

407 The union agrees to indemnify the company of any recourse in damages or otherwise against the Victorian Order of Nurses for making the above deductions and payments during the life of this collective agreement

Article 5 Strike Slowdown Lockout

501 No strike slowdown stoppage of work or lockout shall occur while this agreement is in effect

Article 6 Union Committee amp Representation

601 The Union will maintain a committee comprised of not more than two (2) employees one whom shall be the chairperson The Company will recognize the Union committee members upon receipt of written notice from the Union

602 Union committee members shall investigate and process grievances in accordance with the grievance procedure set out in this agreement

603 The Union committee and grievor shall meet with the Company at step 2 of the grievance procedure

604 The Union committee shall also be the Negotiating committee

605 No committee member shall leave his place of work to investigate or process any grievance complaint or conduct union business without prior consent from the Company Committee members will not absent themselves from their regular duties unreasonably and the consent from the company will not be unreasonably withheld unless it interferes with the efficient operations of the company

606 It is understood that the members of the negotiating committee shall suffer no loss of regular earnings during meetings in direct negotiation with management for the renewal of future collective agreements

607 Committee members will be paid regular straight time for reasonable time spent handling grievances during their regular shifts

Article 7 Grievance Procedure

701 A grievance is by definition a claim by either party arising out of any disagreement regarding the interpretation administration application or alleged violation of this agreement

702 It is understood that an employee has no grievance until he has first discussed the matter with the Supervisor and may be accompanied by a Union committee member within 5 days of the incident The Supervisor shall state his decision verbally within 5 days of receiving the grievance

Step 1 Failing settlement the grievance will be submitted in writing within five (5) days of receipt of the Supervisors answer The grievance will state where the problem area is The Supervisor will reply in writing within five (5) days of receiving the grievance

Step 2 Failing settlement the Union committee the Union representative and the grievor shall meet with representatives of Management to discuss the grievance within five (5) days of the Supervisors reply or at a time mutually agreed upon by the parties The Company shall reply within ten (10) days of the meeting

703 Failing a settlement of the grievance the grievance may be referred to arbitration within thirty (30) days from the receipt of the Company written reply by giving written notice to the Company of its choice of arbitrator( s) tailing agreement of the choice ofarbitrator the Minister of Labour will be requested to appoint one

704 A grievance on behalf of more than one employee will be presented listing the names of the grievors as a group

705 Either party may initiate a Policy grievance beginning at Step 2 of the grievance procedure Such grievances shall be filed within 10 days of the incident giving rise to the complaint

706 Time limits may be extended by mutual agreement of the parties

707 Each party shall pay its own expenses including those for its nominee and witnesses and the fees and expenses of the arbitrator shall be borne equally by the parties

Article 8 Seniority

801 The Company recognizes and will apply the principle of seniority That an employees job opportunities and security increase in proportion to his length of service

In any case of vacancy promotion transfer lay-off and recall from lay-oft the employee having the greater seniority will be entitled to the preference provided he has the skill and ability to be trained and familiarized within a five (5) shift period if required to do the normal requirements of the job

802 An employees seniority will be his length of employment -1th the Company dating back to his first date of hire In the event of layoff full time employees will have the preference to bump less senior full time employees tirst then less senior part time employees Part time employees will have the preference to bump less senior part time employees as per article 80 I

803 All seniority is cancelled by such action as

a) If he voluntarily quits or is discharged and is not reinstated through the grievance procedure

b) Overstaying a leave of absence which means failing to report on the first scheduled shift after expiration of the leave unless he has legitimate reason for doing so~

c) Absence from work for three (3) consecutive schedule shifts without notifying the company except where the employee has just and sufficient cause for his failure to report

804 A newly hired employee shaH be known as a probationary employee until he has worked and successfully completed a period of 500 working hours or 6 months whichever comes first

Notwithstanding anything contained herein it is hereby agreed that there is no right to recall for probationary employees who are laid off

805 a) Time off due to illness injury will be included in an employees continued accrual of

seniority

b) Time off due to pregnancy layoff or leave of absence to a maximum of twelve consecutive months will be included in an employees continued accrual of seniority

H06 A current seniority list will be maintained by the Company A copy vill be posted on the bulletin board and a copy given to the Union The seniority lists will be updated and made current every three (3) months

807 In cases of lay-off the Company will give each employee affected a minimum of 2 weeks advance notice

808 here the date of recall is known or anticipated at the time of lay-oft~ employees affected will be informed accordingly by the Company

809 In any event a recall notice will be sent by registered mail to each employee at his last give~ addres the notice may be supplemented by telephone or personal contact by the Company The Company will not be held responsible if the inability to contact an employee is due to his failure to provide the Company with his current address

810 The recalled employee must reply within three (3) days of his intentions and must report for work as soon as he can but no later than seven (7) days from the postmark date of the reistered letter Failure to do so will result in all seniority beinl lost and he will be--

deemed to have tenninated his service with the Company

811 Job Postings

When the Company decides to fill a current or new position in the bargaining unit notice of the position ~II be posted on the bulletin board for five (5) days so that all the employees will know about the position and be able to apply for the position in writing

Such job postings shall contain the following infonnation classification full time part time or casual duties qualifications date of posting and deadline for applications

The successful applicant will be awarded the job as per article 801 Within the five (5) shifts period the employee may elect to return their previous job and schedule or the Company may return the employee to their previous job and schedule if the employee does not meet the nonnal requirements of the job If no qualified employee has applied the Company may then hire from outside the Home

Article 9 Leave of Absence

901 The Company may grant leave ofabsence without pay to employees for legitimate personal reasons provided that such request is made in writing two (2) weeks in advance and the reasons for the leave ofabsence are stated Such request will not be arbitrarily denied

902 Leave of absence without pay will granted to employees who are required to attend union business upon a 2 week notice by the union in writing to the Company It is understood that no more than one employee may be off at anyone time except for special meetings for educational purposes and that granting leave is subject to the service needs and staffing requirements

Article 10 Bu lIetin Boards

1001 The Company will provide one (1) bulletin board in a mutually satisfactory location for the convenience of the union inposting notices of union activity All such notices must be signed by a member of the union committee or by the union representative Notices of a special nature must first be submitted to the company before posting

Article 11 Health and Safety

1101 The Company and the Union will cooperate fully in the development and maintenance of the highest possible standards of health and safety for all employees with emphasis on measures preventing accidents and industrial disease and ensuring adequate first-aid

1102 The parties hereto will establish and maintain ajoint health and safety committee and will ensure compliance with the health and safety legislation

1103 The committee will be comprised of Company and Union representatives and will hold regular meetings as required by the Occupation Health amp Safety Act The Company will supply the chairperson of the SubLocal with a copy of the investigation reports

Article 12 Reporting Allowance and Call-in Pay

1201 Any employee reporting for work at the start of his regular shift without having been previously notified not to report shall be given 4 hours work which he is capable of perfonning at his regular hourly rate or the rate of the job whichever is greater or he may elect to go home without pay Should no other work be available he shall receive 4 hours pay in lieu thereof

1202 a) Any maintenance employee called into work for emergencies after having left the

premises of the company following the end of his regular shift shall be paid a minimum of I hour at his regular straight rate in respect of each call in or paid time and one half for all hours worked whichever is greater

1202 b) Any employee other than maintenance who are called into work for emergencies after

having left the premises of the company following the end of his regular shift shall be paid a minimum of 3 hours at his regular straight rate in respect of each call in or paid time and one half for all hours worked whichever is greater

Article 13 Bereavement Pay

1301 In the event of a death in the immediate family of an employee who has successfully completed probation the employee will be entitled to a paid leave for 3 consecutive days at the time of death for the following spouse child stepshychildren son-in-law daughter-in-law parents step-parents brother sister pareQts-in-Iaw brother-in-law sister-in-law grandparents and grandchildren Up to an additional two (2) days for travelling if required to attend the funeral may be granted without loss of regular pay from regularly scheduled hours

Article 14 Hours of work and Overtime

1401 It is understood that this article is intended only to provide the basis of a work week for bargaining unit employees but shall not be interpreted as a guarantee of nonnal hours of work per day or nonnal hours of work per week

1402 Any hours in excess of eighty eight (88 ) in a 2 week period will be paid at the rate of time and one half the hourly rate for the job on which the overtime was worked

Staff working the midnight shift will be entitled to h hour paid lunch break During this paid break the employee is required to remain in the building with their phone on available to respond to any emergency that may occur ( Clarification under current staffing pattern staff working the midnight shift will be paid 8 hours instead of the current 75 hours )

Employees working an evening shift who are entitled to a lunch break will take their lunch break from 1830 - 1900 hours and not be required to be available to the building during this time based under current staffing patterns

1403 The term full time employee in this agreement shall mean a person who is regularly scheduled and actually works at least seventy five (75) hours in a two week period for the company exclusive of meal periods

1404 The term part- time employee in this agreement shall mean a person who is regularly scheduled and normally works less than seventy five (75) hours in a two (2) week period exclusive of meal periods

a)

Employees will be allowed rest periods at times approved by their immediate supervisor with pay as follows two (2)ten( 10) minute rest periods in each eight (8) hours ofwork OR

b) one (1) ten(lO) minute rest period in four (4) hours to and including five (5) hours of work

1406 Employees will be paid on a bi-weekly basis

1407(a) Request For Time Off (excluding Christmas New Years and the months of July and August)

Schedules will be posted at least 1 week in advance of the date of the schedule and will cover a 1 month period Master schedules are posted that repeat every 2 weeks or 3 weeks (housekeeping) Staffcan determine from the master the dates they are working for any time period and therefore are expected to submit their request for time off (including vacation) at least 2 weeks before the next posting of a schedule This is usually by the 15th of themiddot previous month (eg current schedule runs to May 30 by May 15 any requests for time off for June must be in to your supervisor)

b) Once the schedule is posted the employee must work the scheduled shifts If the employee wants a particular time off then he can exchange with another employee or part time and casual staff can give the shift away Full time staff may exchange a shift during the two week pay period however a shift cannot be given away It is the responsibility of the employee to find their own replacement Where such changes occur the provisions relating to overtime do not apply Exchanges are to be in writing and

submitted to the Supervisor for approval before the exchange or give away takes place (all exchanges must be signed by both parties and dated prior being submitted to the supervisor) This means that a weekend exchange must be submitted and approved by 400 pm Thursday for an exchange for Saturday Sunday or Monday Failure to submit exchanges alt above ~II result in disciplinary action (This is not in effect from the weekend prior Christmas up to and including January 51b of any given year)

(c) When an employee accepts or makes an exchange or accepts a give away that employee can not give that shift to someone else the employee must work that shift

(d) Replacement for illness leave of absence and vacation will be offered first to existing employees in that department ifhe is available If no one in that department is available part-time or casual employees from another department may be offered the work according to seniority and availability if that employee has the appropriate skills

(e) Part time and casual employees in all departments ~II be asked if they would like to work in another department following a probationary period The employee will then be oriented and will be offered work when no else from the department is available

Article 15 Paid Holidays

1501 The following holidays shall be paid at the employees nonnal scheduled hours and rate for all such hours

New Years Day Good Friday Victoria Day Canada Day Civic Day Labour Day Thanksgiving Day Christmas Day Boxing Day

1502 There will be two (2) floating holidays for each Full-Time employee to be taken at a time mutually agreed upon between the Company and the employee

1503 Any yvork perfonned on a Paid Holiday will be paid at time and one half the employees regular rate of pay for all hours worked for both full time and part time employees

Article 16 Vacation

1601 a) Employees who have less than one year of full-time continuous employment as of March

31 sl shall be entitled to a vacation pro-rated on the basis of 10 days vacation for each completed year ofservice If the employee leaves before the end of the first vacation year he will receive 4 of salary in lieu of vacation

b) Employees who have completed one or more years of full-time continuous service as of March 31 sl shall be entitled to a vacation of 10 days ( 4 of gross earnings for vacation entitlement year)

c) Employees who have completed 3 or more years of full time continuous service as of March 31 st shall be entitled to a vacation of 15 days ( 6 of gross earnings for vacation entitlement year)

d) Maintenance workers are as above with the exception of 15 days vacation ( 6 of gross earnings for vacation entitlement year) in as they perform emergency call back services

e) Maintenance workers who have completed 3 or more years of full time continuous service as of March 31 st shall he entitled to a vacation of20 days ( 8 of gross earnings for vacation entitlement year) as they perform emergency call back service

1602 If a statutory holiday falls within a vacation period an extra day shall be added to the vacation or taken at some other mutually agreed upon time

1603 The periods at which employees will be scheduled to take vacations will conform to the requirements of the Employers operations The Employer will post the vacation schedule for July and August by June 15th

Employees will submit their requests by May 15th

Where a conflict exists in vacation scheduling seniority shall be the governing factor Vacation time available after the allowed submission dates will be granted in accordance with the date of request and availability not seniority The employer will make every reasonable effort to grant an employee the first two (2) weeks of his annual vacation in consecutive weeks off It is understood that if employees are entitled to a third and consecutive five (5) day period provided there are no other employees who have not had their two week vacation alJotment the Employer wiJI make reasonable effort to grant the employee with the subsequent vacation allotment Employees shall be entitled to take vacations in single or more day allotment up to a maximum offive (5) single days

1604 Employees entitled to vacation with pay must take their vacation during the fiscal year April I to March 31 except for one week which may be carried over to the next year

1605 All vacation pay allowances shall be paid prior to the start of the employees scheduled vacation if requested on or before Monday of the payroll processing week

1606 Regular part-time employees shall be entitled to vacation pay as of March 31 S in the amount of 4 of their gross earnings After 3 years or more of continuous service as of March 31 ~ the vacation pay will be increased to 6 of their gross earnings

1607 Part-Time employees shall be entitled to vacation time off without pay based on years of service in the same amount as Full-Time employees

Article 17 Jury Duty and Crown Vitness

1701 The Company agrees to pay an employee who is summoned for Jury Duty or CrovvTI witness the difference between his pay received as a juror or witness and the pay he would have received had he worked his regular scheduled working hours at his regular straight time rate The employee must furnish proof of service and the amount received for Jury duty and Crovm witness and must notify the Company promptly of his selection for J lIry duty and Crown witnessmiddot

Article 18 Pay on day of Injury

1801 An employee who is injured at work and who requires medical attention and who on the advice of a doctor is unable to return to work shall be paid for the balance of his scheduled hours of the day upon which the inj ury occurred

Article 19 Duration

1901 The agreement will be in effect from October 12002 to September 302005 inclusively and from year to year thereafter unless notice to bargain is given by either party not more than 90 days and not less than 30 days prior to the date of expiration The working conditions of the agreement will continue to apply until the signing of the new agreement

Article 20 Full-Time Benefits

2001 ft is a condition ofemployment for full-time employees to enroll in the VON Flexible Benefit Plan including Long Tenn Disability Insurance After one year of continuous service full-time employees must join the VON Canada Pension Plan as a condition of employment

The Employer shall contribute toward premium coverage ofparticipatingeligible employees in the active employ of the Employer under the insurance plans set out below subject to their respective tenns and conditions including any enrolment requirements

4) VON agrees to contribute 100 of the hilled premium tmvards coverage of eligible employees in the active employ of VON under the Ontario Health Insurance Plan through the Employer Health Tax

8) VON agrees to contribute 50 of the billed premium towards coverage of eligible employees in the active employ of VON under the Health Care benefits up to a maximum of tier tO coverage for a couple as provided under the VON Flexible Benetit Plan

C) VON agrees to contribute 50 of the billed premium towards coverage ofeligible employees in the active employ of VON under the Dental Care benefits up to a maximum of tier two coverage for a couple as provided under the VON Flexible Benefit Plan

D) VON agrees to contribute 100 of the billed premium towards coverage of eligible employees in the active employ of VON for Life Insurance up to a maximum of 15 times salary (includes accidental dismembennent) as provided under the VON Flexible Benefit Plan

E) Active employ excludes absences without pay from VON in excess of thirty consecutive calendar days An employee on such leave of absence shall be responsible for full payment of the premiums set out above for any benefit plans in which she participates for the period of the absence and Vvill prepay to VON the premiums during the period of the leave to ensure her continuing coverage

F) The Employer shall provide eacmiddoth employee with information booklets outlining all the current provisions in the benefits plan defined in this article

G) VON will provide access for full-time employees to the national Long Tenn Disability insurance as provided under VON Flexible Benefit Plan subject to its tenns and conditions on the basis of 100 employee paid premiums

H) VON Pension Plan is maintained at a National level Enrollment participation and contributions by the employee and the Home will be in accordance with the tenns and conditions of the Plan

(i) All full time employees who are presently enrolled in the Homes pension plan shall maintain their enrollment in the Plan Full time employees employed but not yet eligible for membership in the Plan shall as a condition ofemployment enrol in the Plan when eligible

(ii) Part time employees are eligible to join the Pension Plan after twenty four months of continuous service lfthe employee decides not to join at this time he will not be eligible to join later unless he meets the provincial eligibility requirement or he becomes employed on a full time basis

The Company and the employee shall make contributions in accordance with the provisions of the Plan In cases of part time employees the amount of their benefits in lieu would be reduced from 65 (article 21 (d)) to 3

(For information purposes only) Current Provincial Eligible Requirements for the Province of Ontario are employee must have earned at least 35 ofYMPR ($3910000) or worked at least 700 hours in each of the 2 calendar years prior to enrolment

Article 21 Sick Leave

A) Sick leave is the granting of time off with pay for absences from regular scheduled hours due to legitimate illness There shall be a Sick Credit Accumulating Bank for each funshytime employee in the active employ ofVON Such employees shall accumulate sick leave credits at the rate of one and one half days (1125 hours per month) per completed month of full-time work to a maximum of 120 days (900 hours)

B) Where a full-time employee is absent from work due to legitimate illness she shall not lose her regular straight time earnings from her regular scheduled hours but shaH draw from her Sick Credit Accumulation Bank to the extent of her credits in the Banle

C) The company agrees to pay for the full cost of the physicians fee for any examination that is required by the company if the fee is not covered by the insurance plan

Part-Time Benefits

D) Part-time employees shall receive an amount of65 of their regular rate in lieu of fullshytime benefits ( full-time benefits sick leave paid holidays and pension plan) Such an amount shall not be paid on any overtime hours worked

Whereas the Employer has closed the Lady Aberdeen Place the parties have agreed to remove references to the Place from the collective agreement

The parties agree that the removal of references to the Place in the current collective agreement does not signify an intention by the Union to abandon any bargaining rights that it might hold at the Place

This Letter of Understanding forms part of the current collective agreement as well as any renewals thereto unless specifically retracted in writing by the parties

Letter of Understanding dealing with Christmas amp New Years Time Frame

Time off at Christmas and New Years vill be scheduled as equitably as possible on an alternating basis

The Christmas schedule will be posted by November 20th and staff will be allowed to make shift changes for the Christmas period until December loth As of December II th the schedule will remain unchanged and no further shift exchanges will be allowed until after January 5th

201 The company recognizes the union as the sole bargaining agent for all its employees of Victorian Order of Nurses Renfrew County Branch working at the Pembroke Civic Complex and employed as kitchen workers ( cooks and bakers ) dietary aides personal support workers housekeepers health care aides and maintenance workers save and except supervisors persons above the rank of the Supervisor persons employed in a confidential capacity in matters relating to labour relations office c1ericaland sales staff companion sitters students employed during the school vacation period and persons in bargaining units for which any trade union held bargaining rights on April 6 1999

202a) Employees and persons not in the bargaining unit shaH not do work which is done by the workers in the bargaining unit which results in a layoff or prevents a recall except for the purpose ofemergencies when bargaining unit employees are not available

b) Management or excluded supervisory personnel shall not work on any jobs which are included in the bargaining unit except as part of their duties established through past practice provided that the performance of the aforementioned duties does notmiddot reduce the normal hours of work for any employee in the bargaining unit

c) The parties agree that the use of co-op students and volunteers is an integral part of VONs business The Employer acknowledges that its use ofco-op students and volunteers will not reduce the normal hours of work for any employee in the bargaining unit

ARTICLE 3 MANAGEMENT RIGHTS

301 The union recognizes the right of the Company to direct the working forces including the right to hire promote transfer any employee to demote discipline suspend or discharge any employee for cause to classify any new occupation or any employee and the right to relieve employees from duty because of lack of work or other just reasons subject to the provisions of the collective agreement

302 Tt shall be the exclusive function of the Company to determine the extent and location of its operations the scheduling of its workers and facilities to detennine the number of employees needed at anytime and to make and alter policies and mles of procedure and conduct for its employees subject to the provisions of this agreement

303 These rights shall be exercised in a fair and consistent manner

Article 4 lJnion Rights and Responsibilities

401 The union has the right and responsibility to represent and intervene on behalf of its members on any matter in relation to this agreement A representative of the Union can participate or intervene in any matter pertaining to this agreement

402 a) All employees must pay the equivalent of monthly union dues by payroll deductions

b) An amount equivalent to initiations fees will be deducted from the employees after they have completed their probationary period and these monies will be sent along with the union dues and the remittance statement

403 The Company will deduct union dues in the first pay period of each month and will remit the amount to the Financial Secretary ofLWA - Canada Local 1000 by the 15th of the following month with a list of names amounts deducted and total Any deduction missed will be picked up in the next pay period

404 The Company will contribute to the U~ions Education Fund on the basis of $002 cents per employee per monthly payroll hour Such monies will be sent monthly along with the dues remittance check

405 The Union will notify the Company in writing at least 30 days in advance as to the amollllts and schedule of deductions

406 The appropriate amounts will be entered on each employees T-4 slip

407 The union agrees to indemnify the company of any recourse in damages or otherwise against the Victorian Order of Nurses for making the above deductions and payments during the life of this collective agreement

Article 5 Strike Slowdown Lockout

501 No strike slowdown stoppage of work or lockout shall occur while this agreement is in effect

Article 6 Union Committee amp Representation

601 The Union will maintain a committee comprised of not more than two (2) employees one whom shall be the chairperson The Company will recognize the Union committee members upon receipt of written notice from the Union

602 Union committee members shall investigate and process grievances in accordance with the grievance procedure set out in this agreement

603 The Union committee and grievor shall meet with the Company at step 2 of the grievance procedure

604 The Union committee shall also be the Negotiating committee

605 No committee member shall leave his place of work to investigate or process any grievance complaint or conduct union business without prior consent from the Company Committee members will not absent themselves from their regular duties unreasonably and the consent from the company will not be unreasonably withheld unless it interferes with the efficient operations of the company

606 It is understood that the members of the negotiating committee shall suffer no loss of regular earnings during meetings in direct negotiation with management for the renewal of future collective agreements

607 Committee members will be paid regular straight time for reasonable time spent handling grievances during their regular shifts

Article 7 Grievance Procedure

701 A grievance is by definition a claim by either party arising out of any disagreement regarding the interpretation administration application or alleged violation of this agreement

702 It is understood that an employee has no grievance until he has first discussed the matter with the Supervisor and may be accompanied by a Union committee member within 5 days of the incident The Supervisor shall state his decision verbally within 5 days of receiving the grievance

Step 1 Failing settlement the grievance will be submitted in writing within five (5) days of receipt of the Supervisors answer The grievance will state where the problem area is The Supervisor will reply in writing within five (5) days of receiving the grievance

Step 2 Failing settlement the Union committee the Union representative and the grievor shall meet with representatives of Management to discuss the grievance within five (5) days of the Supervisors reply or at a time mutually agreed upon by the parties The Company shall reply within ten (10) days of the meeting

703 Failing a settlement of the grievance the grievance may be referred to arbitration within thirty (30) days from the receipt of the Company written reply by giving written notice to the Company of its choice of arbitrator( s) tailing agreement of the choice ofarbitrator the Minister of Labour will be requested to appoint one

704 A grievance on behalf of more than one employee will be presented listing the names of the grievors as a group

705 Either party may initiate a Policy grievance beginning at Step 2 of the grievance procedure Such grievances shall be filed within 10 days of the incident giving rise to the complaint

706 Time limits may be extended by mutual agreement of the parties

707 Each party shall pay its own expenses including those for its nominee and witnesses and the fees and expenses of the arbitrator shall be borne equally by the parties

Article 8 Seniority

801 The Company recognizes and will apply the principle of seniority That an employees job opportunities and security increase in proportion to his length of service

In any case of vacancy promotion transfer lay-off and recall from lay-oft the employee having the greater seniority will be entitled to the preference provided he has the skill and ability to be trained and familiarized within a five (5) shift period if required to do the normal requirements of the job

802 An employees seniority will be his length of employment -1th the Company dating back to his first date of hire In the event of layoff full time employees will have the preference to bump less senior full time employees tirst then less senior part time employees Part time employees will have the preference to bump less senior part time employees as per article 80 I

803 All seniority is cancelled by such action as

a) If he voluntarily quits or is discharged and is not reinstated through the grievance procedure

b) Overstaying a leave of absence which means failing to report on the first scheduled shift after expiration of the leave unless he has legitimate reason for doing so~

c) Absence from work for three (3) consecutive schedule shifts without notifying the company except where the employee has just and sufficient cause for his failure to report

804 A newly hired employee shaH be known as a probationary employee until he has worked and successfully completed a period of 500 working hours or 6 months whichever comes first

Notwithstanding anything contained herein it is hereby agreed that there is no right to recall for probationary employees who are laid off

805 a) Time off due to illness injury will be included in an employees continued accrual of

seniority

b) Time off due to pregnancy layoff or leave of absence to a maximum of twelve consecutive months will be included in an employees continued accrual of seniority

H06 A current seniority list will be maintained by the Company A copy vill be posted on the bulletin board and a copy given to the Union The seniority lists will be updated and made current every three (3) months

807 In cases of lay-off the Company will give each employee affected a minimum of 2 weeks advance notice

808 here the date of recall is known or anticipated at the time of lay-oft~ employees affected will be informed accordingly by the Company

809 In any event a recall notice will be sent by registered mail to each employee at his last give~ addres the notice may be supplemented by telephone or personal contact by the Company The Company will not be held responsible if the inability to contact an employee is due to his failure to provide the Company with his current address

810 The recalled employee must reply within three (3) days of his intentions and must report for work as soon as he can but no later than seven (7) days from the postmark date of the reistered letter Failure to do so will result in all seniority beinl lost and he will be--

deemed to have tenninated his service with the Company

811 Job Postings

When the Company decides to fill a current or new position in the bargaining unit notice of the position ~II be posted on the bulletin board for five (5) days so that all the employees will know about the position and be able to apply for the position in writing

Such job postings shall contain the following infonnation classification full time part time or casual duties qualifications date of posting and deadline for applications

The successful applicant will be awarded the job as per article 801 Within the five (5) shifts period the employee may elect to return their previous job and schedule or the Company may return the employee to their previous job and schedule if the employee does not meet the nonnal requirements of the job If no qualified employee has applied the Company may then hire from outside the Home

Article 9 Leave of Absence

901 The Company may grant leave ofabsence without pay to employees for legitimate personal reasons provided that such request is made in writing two (2) weeks in advance and the reasons for the leave ofabsence are stated Such request will not be arbitrarily denied

902 Leave of absence without pay will granted to employees who are required to attend union business upon a 2 week notice by the union in writing to the Company It is understood that no more than one employee may be off at anyone time except for special meetings for educational purposes and that granting leave is subject to the service needs and staffing requirements

Article 10 Bu lIetin Boards

1001 The Company will provide one (1) bulletin board in a mutually satisfactory location for the convenience of the union inposting notices of union activity All such notices must be signed by a member of the union committee or by the union representative Notices of a special nature must first be submitted to the company before posting

Article 11 Health and Safety

1101 The Company and the Union will cooperate fully in the development and maintenance of the highest possible standards of health and safety for all employees with emphasis on measures preventing accidents and industrial disease and ensuring adequate first-aid

1102 The parties hereto will establish and maintain ajoint health and safety committee and will ensure compliance with the health and safety legislation

1103 The committee will be comprised of Company and Union representatives and will hold regular meetings as required by the Occupation Health amp Safety Act The Company will supply the chairperson of the SubLocal with a copy of the investigation reports

Article 12 Reporting Allowance and Call-in Pay

1201 Any employee reporting for work at the start of his regular shift without having been previously notified not to report shall be given 4 hours work which he is capable of perfonning at his regular hourly rate or the rate of the job whichever is greater or he may elect to go home without pay Should no other work be available he shall receive 4 hours pay in lieu thereof

1202 a) Any maintenance employee called into work for emergencies after having left the

premises of the company following the end of his regular shift shall be paid a minimum of I hour at his regular straight rate in respect of each call in or paid time and one half for all hours worked whichever is greater

1202 b) Any employee other than maintenance who are called into work for emergencies after

having left the premises of the company following the end of his regular shift shall be paid a minimum of 3 hours at his regular straight rate in respect of each call in or paid time and one half for all hours worked whichever is greater

Article 13 Bereavement Pay

1301 In the event of a death in the immediate family of an employee who has successfully completed probation the employee will be entitled to a paid leave for 3 consecutive days at the time of death for the following spouse child stepshychildren son-in-law daughter-in-law parents step-parents brother sister pareQts-in-Iaw brother-in-law sister-in-law grandparents and grandchildren Up to an additional two (2) days for travelling if required to attend the funeral may be granted without loss of regular pay from regularly scheduled hours

Article 14 Hours of work and Overtime

1401 It is understood that this article is intended only to provide the basis of a work week for bargaining unit employees but shall not be interpreted as a guarantee of nonnal hours of work per day or nonnal hours of work per week

1402 Any hours in excess of eighty eight (88 ) in a 2 week period will be paid at the rate of time and one half the hourly rate for the job on which the overtime was worked

Staff working the midnight shift will be entitled to h hour paid lunch break During this paid break the employee is required to remain in the building with their phone on available to respond to any emergency that may occur ( Clarification under current staffing pattern staff working the midnight shift will be paid 8 hours instead of the current 75 hours )

Employees working an evening shift who are entitled to a lunch break will take their lunch break from 1830 - 1900 hours and not be required to be available to the building during this time based under current staffing patterns

1403 The term full time employee in this agreement shall mean a person who is regularly scheduled and actually works at least seventy five (75) hours in a two week period for the company exclusive of meal periods

1404 The term part- time employee in this agreement shall mean a person who is regularly scheduled and normally works less than seventy five (75) hours in a two (2) week period exclusive of meal periods

1405

a)

Employees will be allowed rest periods at times approved by their immediate supervisor with pay as follows two (2)ten( 10) minute rest periods in each eight (8) hours ofwork OR

b) one (1) ten(lO) minute rest period in four (4) hours to and including five (5) hours of work

1406 Employees will be paid on a bi-weekly basis

1407(a) Request For Time Off (excluding Christmas New Years and the months of July and August)

Schedules will be posted at least 1 week in advance of the date of the schedule and will cover a 1 month period Master schedules are posted that repeat every 2 weeks or 3 weeks (housekeeping) Staffcan determine from the master the dates they are working for any time period and therefore are expected to submit their request for time off (including vacation) at least 2 weeks before the next posting of a schedule This is usually by the 15th of themiddot previous month (eg current schedule runs to May 30 by May 15 any requests for time off for June must be in to your supervisor)

b) Once the schedule is posted the employee must work the scheduled shifts If the employee wants a particular time off then he can exchange with another employee or part time and casual staff can give the shift away Full time staff may exchange a shift during the two week pay period however a shift cannot be given away It is the responsibility of the employee to find their own replacement Where such changes occur the provisions relating to overtime do not apply Exchanges are to be in writing and

submitted to the Supervisor for approval before the exchange or give away takes place (all exchanges must be signed by both parties and dated prior being submitted to the supervisor) This means that a weekend exchange must be submitted and approved by 400 pm Thursday for an exchange for Saturday Sunday or Monday Failure to submit exchanges alt above ~II result in disciplinary action (This is not in effect from the weekend prior Christmas up to and including January 51b of any given year)

(c) When an employee accepts or makes an exchange or accepts a give away that employee can not give that shift to someone else the employee must work that shift

(d) Replacement for illness leave of absence and vacation will be offered first to existing employees in that department ifhe is available If no one in that department is available part-time or casual employees from another department may be offered the work according to seniority and availability if that employee has the appropriate skills

(e) Part time and casual employees in all departments ~II be asked if they would like to work in another department following a probationary period The employee will then be oriented and will be offered work when no else from the department is available

Article 15 Paid Holidays

1501 The following holidays shall be paid at the employees nonnal scheduled hours and rate for all such hours

New Years Day Good Friday Victoria Day Canada Day Civic Day Labour Day Thanksgiving Day Christmas Day Boxing Day

1502 There will be two (2) floating holidays for each Full-Time employee to be taken at a time mutually agreed upon between the Company and the employee

1503 Any yvork perfonned on a Paid Holiday will be paid at time and one half the employees regular rate of pay for all hours worked for both full time and part time employees

Article 16 Vacation

1601 a) Employees who have less than one year of full-time continuous employment as of March

31 sl shall be entitled to a vacation pro-rated on the basis of 10 days vacation for each completed year ofservice If the employee leaves before the end of the first vacation year he will receive 4 of salary in lieu of vacation

b) Employees who have completed one or more years of full-time continuous service as of March 31 sl shall be entitled to a vacation of 10 days ( 4 of gross earnings for vacation entitlement year)

c) Employees who have completed 3 or more years of full time continuous service as of March 31 st shall be entitled to a vacation of 15 days ( 6 of gross earnings for vacation entitlement year)

d) Maintenance workers are as above with the exception of 15 days vacation ( 6 of gross earnings for vacation entitlement year) in as they perform emergency call back services

e) Maintenance workers who have completed 3 or more years of full time continuous service as of March 31 st shall he entitled to a vacation of20 days ( 8 of gross earnings for vacation entitlement year) as they perform emergency call back service

1602 If a statutory holiday falls within a vacation period an extra day shall be added to the vacation or taken at some other mutually agreed upon time

1603 The periods at which employees will be scheduled to take vacations will conform to the requirements of the Employers operations The Employer will post the vacation schedule for July and August by June 15th

Employees will submit their requests by May 15th

Where a conflict exists in vacation scheduling seniority shall be the governing factor Vacation time available after the allowed submission dates will be granted in accordance with the date of request and availability not seniority The employer will make every reasonable effort to grant an employee the first two (2) weeks of his annual vacation in consecutive weeks off It is understood that if employees are entitled to a third and consecutive five (5) day period provided there are no other employees who have not had their two week vacation alJotment the Employer wiJI make reasonable effort to grant the employee with the subsequent vacation allotment Employees shall be entitled to take vacations in single or more day allotment up to a maximum offive (5) single days

1604 Employees entitled to vacation with pay must take their vacation during the fiscal year April I to March 31 except for one week which may be carried over to the next year

1605 All vacation pay allowances shall be paid prior to the start of the employees scheduled vacation if requested on or before Monday of the payroll processing week

1606 Regular part-time employees shall be entitled to vacation pay as of March 31 S in the amount of 4 of their gross earnings After 3 years or more of continuous service as of March 31 ~ the vacation pay will be increased to 6 of their gross earnings

1607 Part-Time employees shall be entitled to vacation time off without pay based on years of service in the same amount as Full-Time employees

Article 17 Jury Duty and Crown Vitness

1701 The Company agrees to pay an employee who is summoned for Jury Duty or CrovvTI witness the difference between his pay received as a juror or witness and the pay he would have received had he worked his regular scheduled working hours at his regular straight time rate The employee must furnish proof of service and the amount received for Jury duty and Crovm witness and must notify the Company promptly of his selection for J lIry duty and Crown witnessmiddot

Article 18 Pay on day of Injury

1801 An employee who is injured at work and who requires medical attention and who on the advice of a doctor is unable to return to work shall be paid for the balance of his scheduled hours of the day upon which the inj ury occurred

Article 19 Duration

1901 The agreement will be in effect from October 12002 to September 302005 inclusively and from year to year thereafter unless notice to bargain is given by either party not more than 90 days and not less than 30 days prior to the date of expiration The working conditions of the agreement will continue to apply until the signing of the new agreement

Article 20 Full-Time Benefits

2001 ft is a condition ofemployment for full-time employees to enroll in the VON Flexible Benefit Plan including Long Tenn Disability Insurance After one year of continuous service full-time employees must join the VON Canada Pension Plan as a condition of employment

The Employer shall contribute toward premium coverage ofparticipatingeligible employees in the active employ of the Employer under the insurance plans set out below subject to their respective tenns and conditions including any enrolment requirements

4) VON agrees to contribute 100 of the hilled premium tmvards coverage of eligible employees in the active employ of VON under the Ontario Health Insurance Plan through the Employer Health Tax

8) VON agrees to contribute 50 of the billed premium towards coverage of eligible employees in the active employ of VON under the Health Care benefits up to a maximum of tier tO coverage for a couple as provided under the VON Flexible Benetit Plan

C) VON agrees to contribute 50 of the billed premium towards coverage ofeligible employees in the active employ of VON under the Dental Care benefits up to a maximum of tier two coverage for a couple as provided under the VON Flexible Benefit Plan

D) VON agrees to contribute 100 of the billed premium towards coverage of eligible employees in the active employ of VON for Life Insurance up to a maximum of 15 times salary (includes accidental dismembennent) as provided under the VON Flexible Benefit Plan

E) Active employ excludes absences without pay from VON in excess of thirty consecutive calendar days An employee on such leave of absence shall be responsible for full payment of the premiums set out above for any benefit plans in which she participates for the period of the absence and Vvill prepay to VON the premiums during the period of the leave to ensure her continuing coverage

F) The Employer shall provide eacmiddoth employee with information booklets outlining all the current provisions in the benefits plan defined in this article

G) VON will provide access for full-time employees to the national Long Tenn Disability insurance as provided under VON Flexible Benefit Plan subject to its tenns and conditions on the basis of 100 employee paid premiums

H) VON Pension Plan is maintained at a National level Enrollment participation and contributions by the employee and the Home will be in accordance with the tenns and conditions of the Plan

(i) All full time employees who are presently enrolled in the Homes pension plan shall maintain their enrollment in the Plan Full time employees employed but not yet eligible for membership in the Plan shall as a condition ofemployment enrol in the Plan when eligible

(ii) Part time employees are eligible to join the Pension Plan after twenty four months of continuous service lfthe employee decides not to join at this time he will not be eligible to join later unless he meets the provincial eligibility requirement or he becomes employed on a full time basis

The Company and the employee shall make contributions in accordance with the provisions of the Plan In cases of part time employees the amount of their benefits in lieu would be reduced from 65 (article 21 (d)) to 3

(For information purposes only) Current Provincial Eligible Requirements for the Province of Ontario are employee must have earned at least 35 ofYMPR ($3910000) or worked at least 700 hours in each of the 2 calendar years prior to enrolment

Article 21 Sick Leave

A) Sick leave is the granting of time off with pay for absences from regular scheduled hours due to legitimate illness There shall be a Sick Credit Accumulating Bank for each funshytime employee in the active employ ofVON Such employees shall accumulate sick leave credits at the rate of one and one half days (1125 hours per month) per completed month of full-time work to a maximum of 120 days (900 hours)

B) Where a full-time employee is absent from work due to legitimate illness she shall not lose her regular straight time earnings from her regular scheduled hours but shaH draw from her Sick Credit Accumulation Bank to the extent of her credits in the Banle

C) The company agrees to pay for the full cost of the physicians fee for any examination that is required by the company if the fee is not covered by the insurance plan

Part-Time Benefits

D) Part-time employees shall receive an amount of65 of their regular rate in lieu of fullshytime benefits ( full-time benefits sick leave paid holidays and pension plan) Such an amount shall not be paid on any overtime hours worked

Whereas the Employer has closed the Lady Aberdeen Place the parties have agreed to remove references to the Place from the collective agreement

The parties agree that the removal of references to the Place in the current collective agreement does not signify an intention by the Union to abandon any bargaining rights that it might hold at the Place

This Letter of Understanding forms part of the current collective agreement as well as any renewals thereto unless specifically retracted in writing by the parties

Letter of Understanding dealing with Christmas amp New Years Time Frame

Time off at Christmas and New Years vill be scheduled as equitably as possible on an alternating basis

The Christmas schedule will be posted by November 20th and staff will be allowed to make shift changes for the Christmas period until December loth As of December II th the schedule will remain unchanged and no further shift exchanges will be allowed until after January 5th

Article 1407 (bc) Shift Exchanges must be followed and incorporate the above requirements for the Christmas and New Years period

The Christmas period is defined as the weekend before Christmas lip to and including January 5th

605 No committee member shall leave his place of work to investigate or process any grievance complaint or conduct union business without prior consent from the Company Committee members will not absent themselves from their regular duties unreasonably and the consent from the company will not be unreasonably withheld unless it interferes with the efficient operations of the company

606 It is understood that the members of the negotiating committee shall suffer no loss of regular earnings during meetings in direct negotiation with management for the renewal of future collective agreements

607 Committee members will be paid regular straight time for reasonable time spent handling grievances during their regular shifts

Article 7 Grievance Procedure

701 A grievance is by definition a claim by either party arising out of any disagreement regarding the interpretation administration application or alleged violation of this agreement

702 It is understood that an employee has no grievance until he has first discussed the matter with the Supervisor and may be accompanied by a Union committee member within 5 days of the incident The Supervisor shall state his decision verbally within 5 days of receiving the grievance

Step 1 Failing settlement the grievance will be submitted in writing within five (5) days of receipt of the Supervisors answer The grievance will state where the problem area is The Supervisor will reply in writing within five (5) days of receiving the grievance

Step 2 Failing settlement the Union committee the Union representative and the grievor shall meet with representatives of Management to discuss the grievance within five (5) days of the Supervisors reply or at a time mutually agreed upon by the parties The Company shall reply within ten (10) days of the meeting

703 Failing a settlement of the grievance the grievance may be referred to arbitration within thirty (30) days from the receipt of the Company written reply by giving written notice to the Company of its choice of arbitrator( s) tailing agreement of the choice ofarbitrator the Minister of Labour will be requested to appoint one

704 A grievance on behalf of more than one employee will be presented listing the names of the grievors as a group

705 Either party may initiate a Policy grievance beginning at Step 2 of the grievance procedure Such grievances shall be filed within 10 days of the incident giving rise to the complaint

706 Time limits may be extended by mutual agreement of the parties

707 Each party shall pay its own expenses including those for its nominee and witnesses and the fees and expenses of the arbitrator shall be borne equally by the parties

Article 8 Seniority

801 The Company recognizes and will apply the principle of seniority That an employees job opportunities and security increase in proportion to his length of service

In any case of vacancy promotion transfer lay-off and recall from lay-oft the employee having the greater seniority will be entitled to the preference provided he has the skill and ability to be trained and familiarized within a five (5) shift period if required to do the normal requirements of the job

802 An employees seniority will be his length of employment -1th the Company dating back to his first date of hire In the event of layoff full time employees will have the preference to bump less senior full time employees tirst then less senior part time employees Part time employees will have the preference to bump less senior part time employees as per article 80 I

803 All seniority is cancelled by such action as

a) If he voluntarily quits or is discharged and is not reinstated through the grievance procedure

b) Overstaying a leave of absence which means failing to report on the first scheduled shift after expiration of the leave unless he has legitimate reason for doing so~

c) Absence from work for three (3) consecutive schedule shifts without notifying the company except where the employee has just and sufficient cause for his failure to report

804 A newly hired employee shaH be known as a probationary employee until he has worked and successfully completed a period of 500 working hours or 6 months whichever comes first

Notwithstanding anything contained herein it is hereby agreed that there is no right to recall for probationary employees who are laid off

805 a) Time off due to illness injury will be included in an employees continued accrual of

seniority

b) Time off due to pregnancy layoff or leave of absence to a maximum of twelve consecutive months will be included in an employees continued accrual of seniority

H06 A current seniority list will be maintained by the Company A copy vill be posted on the bulletin board and a copy given to the Union The seniority lists will be updated and made current every three (3) months

807 In cases of lay-off the Company will give each employee affected a minimum of 2 weeks advance notice

808 here the date of recall is known or anticipated at the time of lay-oft~ employees affected will be informed accordingly by the Company

809 In any event a recall notice will be sent by registered mail to each employee at his last give~ addres the notice may be supplemented by telephone or personal contact by the Company The Company will not be held responsible if the inability to contact an employee is due to his failure to provide the Company with his current address

810 The recalled employee must reply within three (3) days of his intentions and must report for work as soon as he can but no later than seven (7) days from the postmark date of the reistered letter Failure to do so will result in all seniority beinl lost and he will be--

deemed to have tenninated his service with the Company

811 Job Postings

When the Company decides to fill a current or new position in the bargaining unit notice of the position ~II be posted on the bulletin board for five (5) days so that all the employees will know about the position and be able to apply for the position in writing

Such job postings shall contain the following infonnation classification full time part time or casual duties qualifications date of posting and deadline for applications

The successful applicant will be awarded the job as per article 801 Within the five (5) shifts period the employee may elect to return their previous job and schedule or the Company may return the employee to their previous job and schedule if the employee does not meet the nonnal requirements of the job If no qualified employee has applied the Company may then hire from outside the Home

Article 9 Leave of Absence

901 The Company may grant leave ofabsence without pay to employees for legitimate personal reasons provided that such request is made in writing two (2) weeks in advance and the reasons for the leave ofabsence are stated Such request will not be arbitrarily denied

902 Leave of absence without pay will granted to employees who are required to attend union business upon a 2 week notice by the union in writing to the Company It is understood that no more than one employee may be off at anyone time except for special meetings for educational purposes and that granting leave is subject to the service needs and staffing requirements

Article 10 Bu lIetin Boards

1001 The Company will provide one (1) bulletin board in a mutually satisfactory location for the convenience of the union inposting notices of union activity All such notices must be signed by a member of the union committee or by the union representative Notices of a special nature must first be submitted to the company before posting

Article 11 Health and Safety

1101 The Company and the Union will cooperate fully in the development and maintenance of the highest possible standards of health and safety for all employees with emphasis on measures preventing accidents and industrial disease and ensuring adequate first-aid

1102 The parties hereto will establish and maintain ajoint health and safety committee and will ensure compliance with the health and safety legislation

1103 The committee will be comprised of Company and Union representatives and will hold regular meetings as required by the Occupation Health amp Safety Act The Company will supply the chairperson of the SubLocal with a copy of the investigation reports

Article 12 Reporting Allowance and Call-in Pay

1201 Any employee reporting for work at the start of his regular shift without having been previously notified not to report shall be given 4 hours work which he is capable of perfonning at his regular hourly rate or the rate of the job whichever is greater or he may elect to go home without pay Should no other work be available he shall receive 4 hours pay in lieu thereof

1202 a) Any maintenance employee called into work for emergencies after having left the

premises of the company following the end of his regular shift shall be paid a minimum of I hour at his regular straight rate in respect of each call in or paid time and one half for all hours worked whichever is greater

1202 b) Any employee other than maintenance who are called into work for emergencies after

having left the premises of the company following the end of his regular shift shall be paid a minimum of 3 hours at his regular straight rate in respect of each call in or paid time and one half for all hours worked whichever is greater

Article 13 Bereavement Pay

1301 In the event of a death in the immediate family of an employee who has successfully completed probation the employee will be entitled to a paid leave for 3 consecutive days at the time of death for the following spouse child stepshychildren son-in-law daughter-in-law parents step-parents brother sister pareQts-in-Iaw brother-in-law sister-in-law grandparents and grandchildren Up to an additional two (2) days for travelling if required to attend the funeral may be granted without loss of regular pay from regularly scheduled hours

Article 14 Hours of work and Overtime

1401 It is understood that this article is intended only to provide the basis of a work week for bargaining unit employees but shall not be interpreted as a guarantee of nonnal hours of work per day or nonnal hours of work per week

1402 Any hours in excess of eighty eight (88 ) in a 2 week period will be paid at the rate of time and one half the hourly rate for the job on which the overtime was worked

Staff working the midnight shift will be entitled to h hour paid lunch break During this paid break the employee is required to remain in the building with their phone on available to respond to any emergency that may occur ( Clarification under current staffing pattern staff working the midnight shift will be paid 8 hours instead of the current 75 hours )

Employees working an evening shift who are entitled to a lunch break will take their lunch break from 1830 - 1900 hours and not be required to be available to the building during this time based under current staffing patterns

1403 The term full time employee in this agreement shall mean a person who is regularly scheduled and actually works at least seventy five (75) hours in a two week period for the company exclusive of meal periods

1404 The term part- time employee in this agreement shall mean a person who is regularly scheduled and normally works less than seventy five (75) hours in a two (2) week period exclusive of meal periods

a)

Employees will be allowed rest periods at times approved by their immediate supervisor with pay as follows two (2)ten( 10) minute rest periods in each eight (8) hours ofwork OR

b) one (1) ten(lO) minute rest period in four (4) hours to and including five (5) hours of work

1406 Employees will be paid on a bi-weekly basis

1407(a) Request For Time Off (excluding Christmas New Years and the months of July and August)

Schedules will be posted at least 1 week in advance of the date of the schedule and will cover a 1 month period Master schedules are posted that repeat every 2 weeks or 3 weeks (housekeeping) Staffcan determine from the master the dates they are working for any time period and therefore are expected to submit their request for time off (including vacation) at least 2 weeks before the next posting of a schedule This is usually by the 15th of themiddot previous month (eg current schedule runs to May 30 by May 15 any requests for time off for June must be in to your supervisor)

b) Once the schedule is posted the employee must work the scheduled shifts If the employee wants a particular time off then he can exchange with another employee or part time and casual staff can give the shift away Full time staff may exchange a shift during the two week pay period however a shift cannot be given away It is the responsibility of the employee to find their own replacement Where such changes occur the provisions relating to overtime do not apply Exchanges are to be in writing and

submitted to the Supervisor for approval before the exchange or give away takes place (all exchanges must be signed by both parties and dated prior being submitted to the supervisor) This means that a weekend exchange must be submitted and approved by 400 pm Thursday for an exchange for Saturday Sunday or Monday Failure to submit exchanges alt above ~II result in disciplinary action (This is not in effect from the weekend prior Christmas up to and including January 51b of any given year)

(c) When an employee accepts or makes an exchange or accepts a give away that employee can not give that shift to someone else the employee must work that shift

(d) Replacement for illness leave of absence and vacation will be offered first to existing employees in that department ifhe is available If no one in that department is available part-time or casual employees from another department may be offered the work according to seniority and availability if that employee has the appropriate skills

(e) Part time and casual employees in all departments ~II be asked if they would like to work in another department following a probationary period The employee will then be oriented and will be offered work when no else from the department is available

Article 15 Paid Holidays

1501 The following holidays shall be paid at the employees nonnal scheduled hours and rate for all such hours

New Years Day Good Friday Victoria Day Canada Day Civic Day Labour Day Thanksgiving Day Christmas Day Boxing Day

1502 There will be two (2) floating holidays for each Full-Time employee to be taken at a time mutually agreed upon between the Company and the employee

1503 Any yvork perfonned on a Paid Holiday will be paid at time and one half the employees regular rate of pay for all hours worked for both full time and part time employees

Article 16 Vacation

1601 a) Employees who have less than one year of full-time continuous employment as of March

31 sl shall be entitled to a vacation pro-rated on the basis of 10 days vacation for each completed year ofservice If the employee leaves before the end of the first vacation year he will receive 4 of salary in lieu of vacation

b) Employees who have completed one or more years of full-time continuous service as of March 31 sl shall be entitled to a vacation of 10 days ( 4 of gross earnings for vacation entitlement year)

c) Employees who have completed 3 or more years of full time continuous service as of March 31 st shall be entitled to a vacation of 15 days ( 6 of gross earnings for vacation entitlement year)

d) Maintenance workers are as above with the exception of 15 days vacation ( 6 of gross earnings for vacation entitlement year) in as they perform emergency call back services

e) Maintenance workers who have completed 3 or more years of full time continuous service as of March 31 st shall he entitled to a vacation of20 days ( 8 of gross earnings for vacation entitlement year) as they perform emergency call back service

1602 If a statutory holiday falls within a vacation period an extra day shall be added to the vacation or taken at some other mutually agreed upon time

1603 The periods at which employees will be scheduled to take vacations will conform to the requirements of the Employers operations The Employer will post the vacation schedule for July and August by June 15th

Employees will submit their requests by May 15th

Where a conflict exists in vacation scheduling seniority shall be the governing factor Vacation time available after the allowed submission dates will be granted in accordance with the date of request and availability not seniority The employer will make every reasonable effort to grant an employee the first two (2) weeks of his annual vacation in consecutive weeks off It is understood that if employees are entitled to a third and consecutive five (5) day period provided there are no other employees who have not had their two week vacation alJotment the Employer wiJI make reasonable effort to grant the employee with the subsequent vacation allotment Employees shall be entitled to take vacations in single or more day allotment up to a maximum offive (5) single days

1604 Employees entitled to vacation with pay must take their vacation during the fiscal year April I to March 31 except for one week which may be carried over to the next year

1605 All vacation pay allowances shall be paid prior to the start of the employees scheduled vacation if requested on or before Monday of the payroll processing week

1606 Regular part-time employees shall be entitled to vacation pay as of March 31 S in the amount of 4 of their gross earnings After 3 years or more of continuous service as of March 31 ~ the vacation pay will be increased to 6 of their gross earnings

1607 Part-Time employees shall be entitled to vacation time off without pay based on years of service in the same amount as Full-Time employees

Article 17 Jury Duty and Crown Vitness

1701 The Company agrees to pay an employee who is summoned for Jury Duty or CrovvTI witness the difference between his pay received as a juror or witness and the pay he would have received had he worked his regular scheduled working hours at his regular straight time rate The employee must furnish proof of service and the amount received for Jury duty and Crovm witness and must notify the Company promptly of his selection for J lIry duty and Crown witnessmiddot

Article 18 Pay on day of Injury

1801 An employee who is injured at work and who requires medical attention and who on the advice of a doctor is unable to return to work shall be paid for the balance of his scheduled hours of the day upon which the inj ury occurred

Article 19 Duration

1901 The agreement will be in effect from October 12002 to September 302005 inclusively and from year to year thereafter unless notice to bargain is given by either party not more than 90 days and not less than 30 days prior to the date of expiration The working conditions of the agreement will continue to apply until the signing of the new agreement

Article 20 Full-Time Benefits

2001 ft is a condition ofemployment for full-time employees to enroll in the VON Flexible Benefit Plan including Long Tenn Disability Insurance After one year of continuous service full-time employees must join the VON Canada Pension Plan as a condition of employment

The Employer shall contribute toward premium coverage ofparticipatingeligible employees in the active employ of the Employer under the insurance plans set out below subject to their respective tenns and conditions including any enrolment requirements

4) VON agrees to contribute 100 of the hilled premium tmvards coverage of eligible employees in the active employ of VON under the Ontario Health Insurance Plan through the Employer Health Tax

8) VON agrees to contribute 50 of the billed premium towards coverage of eligible employees in the active employ of VON under the Health Care benefits up to a maximum of tier tO coverage for a couple as provided under the VON Flexible Benetit Plan

C) VON agrees to contribute 50 of the billed premium towards coverage ofeligible employees in the active employ of VON under the Dental Care benefits up to a maximum of tier two coverage for a couple as provided under the VON Flexible Benefit Plan

D) VON agrees to contribute 100 of the billed premium towards coverage of eligible employees in the active employ of VON for Life Insurance up to a maximum of 15 times salary (includes accidental dismembennent) as provided under the VON Flexible Benefit Plan

E) Active employ excludes absences without pay from VON in excess of thirty consecutive calendar days An employee on such leave of absence shall be responsible for full payment of the premiums set out above for any benefit plans in which she participates for the period of the absence and Vvill prepay to VON the premiums during the period of the leave to ensure her continuing coverage

F) The Employer shall provide eacmiddoth employee with information booklets outlining all the current provisions in the benefits plan defined in this article

G) VON will provide access for full-time employees to the national Long Tenn Disability insurance as provided under VON Flexible Benefit Plan subject to its tenns and conditions on the basis of 100 employee paid premiums

H) VON Pension Plan is maintained at a National level Enrollment participation and contributions by the employee and the Home will be in accordance with the tenns and conditions of the Plan

(i) All full time employees who are presently enrolled in the Homes pension plan shall maintain their enrollment in the Plan Full time employees employed but not yet eligible for membership in the Plan shall as a condition ofemployment enrol in the Plan when eligible

(ii) Part time employees are eligible to join the Pension Plan after twenty four months of continuous service lfthe employee decides not to join at this time he will not be eligible to join later unless he meets the provincial eligibility requirement or he becomes employed on a full time basis

The Company and the employee shall make contributions in accordance with the provisions of the Plan In cases of part time employees the amount of their benefits in lieu would be reduced from 65 (article 21 (d)) to 3

(For information purposes only) Current Provincial Eligible Requirements for the Province of Ontario are employee must have earned at least 35 ofYMPR ($3910000) or worked at least 700 hours in each of the 2 calendar years prior to enrolment

Article 21 Sick Leave

A) Sick leave is the granting of time off with pay for absences from regular scheduled hours due to legitimate illness There shall be a Sick Credit Accumulating Bank for each funshytime employee in the active employ ofVON Such employees shall accumulate sick leave credits at the rate of one and one half days (1125 hours per month) per completed month of full-time work to a maximum of 120 days (900 hours)

B) Where a full-time employee is absent from work due to legitimate illness she shall not lose her regular straight time earnings from her regular scheduled hours but shaH draw from her Sick Credit Accumulation Bank to the extent of her credits in the Banle

C) The company agrees to pay for the full cost of the physicians fee for any examination that is required by the company if the fee is not covered by the insurance plan

Part-Time Benefits

D) Part-time employees shall receive an amount of65 of their regular rate in lieu of fullshytime benefits ( full-time benefits sick leave paid holidays and pension plan) Such an amount shall not be paid on any overtime hours worked

Whereas the Employer has closed the Lady Aberdeen Place the parties have agreed to remove references to the Place from the collective agreement

The parties agree that the removal of references to the Place in the current collective agreement does not signify an intention by the Union to abandon any bargaining rights that it might hold at the Place

This Letter of Understanding forms part of the current collective agreement as well as any renewals thereto unless specifically retracted in writing by the parties

Letter of Understanding dealing with Christmas amp New Years Time Frame

Time off at Christmas and New Years vill be scheduled as equitably as possible on an alternating basis

The Christmas schedule will be posted by November 20th and staff will be allowed to make shift changes for the Christmas period until December loth As of December II th the schedule will remain unchanged and no further shift exchanges will be allowed until after January 5th

Article 1407 (bc) Shift Exchanges must be followed and incorporate the above requirements for the Christmas and New Years period

The Christmas period is defined as the weekend before Christmas lip to and including January 5th

902 Leave of absence without pay will granted to employees who are required to attend union business upon a 2 week notice by the union in writing to the Company It is understood that no more than one employee may be off at anyone time except for special meetings for educational purposes and that granting leave is subject to the service needs and staffing requirements

Article 10 Bu lIetin Boards

1001 The Company will provide one (1) bulletin board in a mutually satisfactory location for the convenience of the union inposting notices of union activity All such notices must be signed by a member of the union committee or by the union representative Notices of a special nature must first be submitted to the company before posting

Article 11 Health and Safety

1101 The Company and the Union will cooperate fully in the development and maintenance of the highest possible standards of health and safety for all employees with emphasis on measures preventing accidents and industrial disease and ensuring adequate first-aid

1102 The parties hereto will establish and maintain ajoint health and safety committee and will ensure compliance with the health and safety legislation

1103 The committee will be comprised of Company and Union representatives and will hold regular meetings as required by the Occupation Health amp Safety Act The Company will supply the chairperson of the SubLocal with a copy of the investigation reports

Article 12 Reporting Allowance and Call-in Pay

1201 Any employee reporting for work at the start of his regular shift without having been previously notified not to report shall be given 4 hours work which he is capable of perfonning at his regular hourly rate or the rate of the job whichever is greater or he may elect to go home without pay Should no other work be available he shall receive 4 hours pay in lieu thereof

1202 a) Any maintenance employee called into work for emergencies after having left the

premises of the company following the end of his regular shift shall be paid a minimum of I hour at his regular straight rate in respect of each call in or paid time and one half for all hours worked whichever is greater

1202 b) Any employee other than maintenance who are called into work for emergencies after

having left the premises of the company following the end of his regular shift shall be paid a minimum of 3 hours at his regular straight rate in respect of each call in or paid time and one half for all hours worked whichever is greater

Article 13 Bereavement Pay

1301 In the event of a death in the immediate family of an employee who has successfully completed probation the employee will be entitled to a paid leave for 3 consecutive days at the time of death for the following spouse child stepshychildren son-in-law daughter-in-law parents step-parents brother sister pareQts-in-Iaw brother-in-law sister-in-law grandparents and grandchildren Up to an additional two (2) days for travelling if required to attend the funeral may be granted without loss of regular pay from regularly scheduled hours

Article 14 Hours of work and Overtime

1401 It is understood that this article is intended only to provide the basis of a work week for bargaining unit employees but shall not be interpreted as a guarantee of nonnal hours of work per day or nonnal hours of work per week

1402 Any hours in excess of eighty eight (88 ) in a 2 week period will be paid at the rate of time and one half the hourly rate for the job on which the overtime was worked

Staff working the midnight shift will be entitled to h hour paid lunch break During this paid break the employee is required to remain in the building with their phone on available to respond to any emergency that may occur ( Clarification under current staffing pattern staff working the midnight shift will be paid 8 hours instead of the current 75 hours )

Employees working an evening shift who are entitled to a lunch break will take their lunch break from 1830 - 1900 hours and not be required to be available to the building during this time based under current staffing patterns

1403 The term full time employee in this agreement shall mean a person who is regularly scheduled and actually works at least seventy five (75) hours in a two week period for the company exclusive of meal periods

1404 The term part- time employee in this agreement shall mean a person who is regularly scheduled and normally works less than seventy five (75) hours in a two (2) week period exclusive of meal periods

a)

Employees will be allowed rest periods at times approved by their immediate supervisor with pay as follows two (2)ten( 10) minute rest periods in each eight (8) hours ofwork OR

b) one (1) ten(lO) minute rest period in four (4) hours to and including five (5) hours of work

1406 Employees will be paid on a bi-weekly basis

1407(a) Request For Time Off (excluding Christmas New Years and the months of July and August)

Schedules will be posted at least 1 week in advance of the date of the schedule and will cover a 1 month period Master schedules are posted that repeat every 2 weeks or 3 weeks (housekeeping) Staffcan determine from the master the dates they are working for any time period and therefore are expected to submit their request for time off (including vacation) at least 2 weeks before the next posting of a schedule This is usually by the 15th of themiddot previous month (eg current schedule runs to May 30 by May 15 any requests for time off for June must be in to your supervisor)

b) Once the schedule is posted the employee must work the scheduled shifts If the employee wants a particular time off then he can exchange with another employee or part time and casual staff can give the shift away Full time staff may exchange a shift during the two week pay period however a shift cannot be given away It is the responsibility of the employee to find their own replacement Where such changes occur the provisions relating to overtime do not apply Exchanges are to be in writing and

submitted to the Supervisor for approval before the exchange or give away takes place (all exchanges must be signed by both parties and dated prior being submitted to the supervisor) This means that a weekend exchange must be submitted and approved by 400 pm Thursday for an exchange for Saturday Sunday or Monday Failure to submit exchanges alt above ~II result in disciplinary action (This is not in effect from the weekend prior Christmas up to and including January 51b of any given year)

(c) When an employee accepts or makes an exchange or accepts a give away that employee can not give that shift to someone else the employee must work that shift

(d) Replacement for illness leave of absence and vacation will be offered first to existing employees in that department ifhe is available If no one in that department is available part-time or casual employees from another department may be offered the work according to seniority and availability if that employee has the appropriate skills

(e) Part time and casual employees in all departments ~II be asked if they would like to work in another department following a probationary period The employee will then be oriented and will be offered work when no else from the department is available

Article 15 Paid Holidays

1501 The following holidays shall be paid at the employees nonnal scheduled hours and rate for all such hours

New Years Day Good Friday Victoria Day Canada Day Civic Day Labour Day Thanksgiving Day Christmas Day Boxing Day

1502 There will be two (2) floating holidays for each Full-Time employee to be taken at a time mutually agreed upon between the Company and the employee

1503 Any yvork perfonned on a Paid Holiday will be paid at time and one half the employees regular rate of pay for all hours worked for both full time and part time employees

Article 16 Vacation

1601 a) Employees who have less than one year of full-time continuous employment as of March

31 sl shall be entitled to a vacation pro-rated on the basis of 10 days vacation for each completed year ofservice If the employee leaves before the end of the first vacation year he will receive 4 of salary in lieu of vacation

b) Employees who have completed one or more years of full-time continuous service as of March 31 sl shall be entitled to a vacation of 10 days ( 4 of gross earnings for vacation entitlement year)

c) Employees who have completed 3 or more years of full time continuous service as of March 31 st shall be entitled to a vacation of 15 days ( 6 of gross earnings for vacation entitlement year)

d) Maintenance workers are as above with the exception of 15 days vacation ( 6 of gross earnings for vacation entitlement year) in as they perform emergency call back services

e) Maintenance workers who have completed 3 or more years of full time continuous service as of March 31 st shall he entitled to a vacation of20 days ( 8 of gross earnings for vacation entitlement year) as they perform emergency call back service

1602 If a statutory holiday falls within a vacation period an extra day shall be added to the vacation or taken at some other mutually agreed upon time

1603 The periods at which employees will be scheduled to take vacations will conform to the requirements of the Employers operations The Employer will post the vacation schedule for July and August by June 15th

Employees will submit their requests by May 15th

Where a conflict exists in vacation scheduling seniority shall be the governing factor Vacation time available after the allowed submission dates will be granted in accordance with the date of request and availability not seniority The employer will make every reasonable effort to grant an employee the first two (2) weeks of his annual vacation in consecutive weeks off It is understood that if employees are entitled to a third and consecutive five (5) day period provided there are no other employees who have not had their two week vacation alJotment the Employer wiJI make reasonable effort to grant the employee with the subsequent vacation allotment Employees shall be entitled to take vacations in single or more day allotment up to a maximum offive (5) single days

1604 Employees entitled to vacation with pay must take their vacation during the fiscal year April I to March 31 except for one week which may be carried over to the next year

1605 All vacation pay allowances shall be paid prior to the start of the employees scheduled vacation if requested on or before Monday of the payroll processing week

1606 Regular part-time employees shall be entitled to vacation pay as of March 31 S in the amount of 4 of their gross earnings After 3 years or more of continuous service as of March 31 ~ the vacation pay will be increased to 6 of their gross earnings

1607 Part-Time employees shall be entitled to vacation time off without pay based on years of service in the same amount as Full-Time employees

Article 17 Jury Duty and Crown Vitness

1701 The Company agrees to pay an employee who is summoned for Jury Duty or CrovvTI witness the difference between his pay received as a juror or witness and the pay he would have received had he worked his regular scheduled working hours at his regular straight time rate The employee must furnish proof of service and the amount received for Jury duty and Crovm witness and must notify the Company promptly of his selection for J lIry duty and Crown witnessmiddot

Article 18 Pay on day of Injury

1801 An employee who is injured at work and who requires medical attention and who on the advice of a doctor is unable to return to work shall be paid for the balance of his scheduled hours of the day upon which the inj ury occurred

Article 19 Duration

1901 The agreement will be in effect from October 12002 to September 302005 inclusively and from year to year thereafter unless notice to bargain is given by either party not more than 90 days and not less than 30 days prior to the date of expiration The working conditions of the agreement will continue to apply until the signing of the new agreement

Article 20 Full-Time Benefits

2001 ft is a condition ofemployment for full-time employees to enroll in the VON Flexible Benefit Plan including Long Tenn Disability Insurance After one year of continuous service full-time employees must join the VON Canada Pension Plan as a condition of employment

The Employer shall contribute toward premium coverage ofparticipatingeligible employees in the active employ of the Employer under the insurance plans set out below subject to their respective tenns and conditions including any enrolment requirements

4) VON agrees to contribute 100 of the hilled premium tmvards coverage of eligible employees in the active employ of VON under the Ontario Health Insurance Plan through the Employer Health Tax

8) VON agrees to contribute 50 of the billed premium towards coverage of eligible employees in the active employ of VON under the Health Care benefits up to a maximum of tier tO coverage for a couple as provided under the VON Flexible Benetit Plan

C) VON agrees to contribute 50 of the billed premium towards coverage ofeligible employees in the active employ of VON under the Dental Care benefits up to a maximum of tier two coverage for a couple as provided under the VON Flexible Benefit Plan

D) VON agrees to contribute 100 of the billed premium towards coverage of eligible employees in the active employ of VON for Life Insurance up to a maximum of 15 times salary (includes accidental dismembennent) as provided under the VON Flexible Benefit Plan

E) Active employ excludes absences without pay from VON in excess of thirty consecutive calendar days An employee on such leave of absence shall be responsible for full payment of the premiums set out above for any benefit plans in which she participates for the period of the absence and Vvill prepay to VON the premiums during the period of the leave to ensure her continuing coverage

F) The Employer shall provide eacmiddoth employee with information booklets outlining all the current provisions in the benefits plan defined in this article

G) VON will provide access for full-time employees to the national Long Tenn Disability insurance as provided under VON Flexible Benefit Plan subject to its tenns and conditions on the basis of 100 employee paid premiums

H) VON Pension Plan is maintained at a National level Enrollment participation and contributions by the employee and the Home will be in accordance with the tenns and conditions of the Plan

(i) All full time employees who are presently enrolled in the Homes pension plan shall maintain their enrollment in the Plan Full time employees employed but not yet eligible for membership in the Plan shall as a condition ofemployment enrol in the Plan when eligible

(ii) Part time employees are eligible to join the Pension Plan after twenty four months of continuous service lfthe employee decides not to join at this time he will not be eligible to join later unless he meets the provincial eligibility requirement or he becomes employed on a full time basis

The Company and the employee shall make contributions in accordance with the provisions of the Plan In cases of part time employees the amount of their benefits in lieu would be reduced from 65 (article 21 (d)) to 3

(For information purposes only) Current Provincial Eligible Requirements for the Province of Ontario are employee must have earned at least 35 ofYMPR ($3910000) or worked at least 700 hours in each of the 2 calendar years prior to enrolment

Article 21 Sick Leave

A) Sick leave is the granting of time off with pay for absences from regular scheduled hours due to legitimate illness There shall be a Sick Credit Accumulating Bank for each funshytime employee in the active employ ofVON Such employees shall accumulate sick leave credits at the rate of one and one half days (1125 hours per month) per completed month of full-time work to a maximum of 120 days (900 hours)

B) Where a full-time employee is absent from work due to legitimate illness she shall not lose her regular straight time earnings from her regular scheduled hours but shaH draw from her Sick Credit Accumulation Bank to the extent of her credits in the Banle

C) The company agrees to pay for the full cost of the physicians fee for any examination that is required by the company if the fee is not covered by the insurance plan

Part-Time Benefits

D) Part-time employees shall receive an amount of65 of their regular rate in lieu of fullshytime benefits ( full-time benefits sick leave paid holidays and pension plan) Such an amount shall not be paid on any overtime hours worked

Whereas the Employer has closed the Lady Aberdeen Place the parties have agreed to remove references to the Place from the collective agreement

The parties agree that the removal of references to the Place in the current collective agreement does not signify an intention by the Union to abandon any bargaining rights that it might hold at the Place

This Letter of Understanding forms part of the current collective agreement as well as any renewals thereto unless specifically retracted in writing by the parties

Letter of Understanding dealing with Christmas amp New Years Time Frame

Time off at Christmas and New Years vill be scheduled as equitably as possible on an alternating basis

The Christmas schedule will be posted by November 20th and staff will be allowed to make shift changes for the Christmas period until December loth As of December II th the schedule will remain unchanged and no further shift exchanges will be allowed until after January 5th

Article 1407 (bc) Shift Exchanges must be followed and incorporate the above requirements for the Christmas and New Years period

The Christmas period is defined as the weekend before Christmas lip to and including January 5th

702 It is understood that an employee has no grievance until he has first discussed the matter with the Supervisor and may be accompanied by a Union committee member within 5 days of the incident The Supervisor shall state his decision verbally within 5 days of receiving the grievance

Step 1 Failing settlement the grievance will be submitted in writing within five (5) days of receipt of the Supervisors answer The grievance will state where the problem area is The Supervisor will reply in writing within five (5) days of receiving the grievance

Step 2 Failing settlement the Union committee the Union representative and the grievor shall meet with representatives of Management to discuss the grievance within five (5) days of the Supervisors reply or at a time mutually agreed upon by the parties The Company shall reply within ten (10) days of the meeting

703 Failing a settlement of the grievance the grievance may be referred to arbitration within thirty (30) days from the receipt of the Company written reply by giving written notice to the Company of its choice of arbitrator( s) tailing agreement of the choice ofarbitrator the Minister of Labour will be requested to appoint one

704 A grievance on behalf of more than one employee will be presented listing the names of the grievors as a group

705 Either party may initiate a Policy grievance beginning at Step 2 of the grievance procedure Such grievances shall be filed within 10 days of the incident giving rise to the complaint

706 Time limits may be extended by mutual agreement of the parties

707 Each party shall pay its own expenses including those for its nominee and witnesses and the fees and expenses of the arbitrator shall be borne equally by the parties

Article 8 Seniority

801 The Company recognizes and will apply the principle of seniority That an employees job opportunities and security increase in proportion to his length of service

In any case of vacancy promotion transfer lay-off and recall from lay-oft the employee having the greater seniority will be entitled to the preference provided he has the skill and ability to be trained and familiarized within a five (5) shift period if required to do the normal requirements of the job

802 An employees seniority will be his length of employment -1th the Company dating back to his first date of hire In the event of layoff full time employees will have the preference to bump less senior full time employees tirst then less senior part time employees Part time employees will have the preference to bump less senior part time employees as per article 80 I

803 All seniority is cancelled by such action as

a) If he voluntarily quits or is discharged and is not reinstated through the grievance procedure

b) Overstaying a leave of absence which means failing to report on the first scheduled shift after expiration of the leave unless he has legitimate reason for doing so~

c) Absence from work for three (3) consecutive schedule shifts without notifying the company except where the employee has just and sufficient cause for his failure to report

804 A newly hired employee shaH be known as a probationary employee until he has worked and successfully completed a period of 500 working hours or 6 months whichever comes first

Notwithstanding anything contained herein it is hereby agreed that there is no right to recall for probationary employees who are laid off

805 a) Time off due to illness injury will be included in an employees continued accrual of

seniority

b) Time off due to pregnancy layoff or leave of absence to a maximum of twelve consecutive months will be included in an employees continued accrual of seniority

H06 A current seniority list will be maintained by the Company A copy vill be posted on the bulletin board and a copy given to the Union The seniority lists will be updated and made current every three (3) months

807 In cases of lay-off the Company will give each employee affected a minimum of 2 weeks advance notice

808 here the date of recall is known or anticipated at the time of lay-oft~ employees affected will be informed accordingly by the Company

809 In any event a recall notice will be sent by registered mail to each employee at his last give~ addres the notice may be supplemented by telephone or personal contact by the Company The Company will not be held responsible if the inability to contact an employee is due to his failure to provide the Company with his current address

810 The recalled employee must reply within three (3) days of his intentions and must report for work as soon as he can but no later than seven (7) days from the postmark date of the reistered letter Failure to do so will result in all seniority beinl lost and he will be--

811 Job Postings

When the Company decides to fill a current or new position in the bargaining unit notice of the position ~II be posted on the bulletin board for five (5) days so that all the employees will know about the position and be able to apply for the position in writing

Such job postings shall contain the following infonnation classification full time part time or casual duties qualifications date of posting and deadline for applications

The successful applicant will be awarded the job as per article 801 Within the five (5) shifts period the employee may elect to return their previous job and schedule or the Company may return the employee to their previous job and schedule if the employee does not meet the nonnal requirements of the job If no qualified employee has applied the Company may then hire from outside the Home

Article 17 Jury Duty and Crown Vitness

1701 The Company agrees to pay an employee who is summoned for Jury Duty or CrovvTI witness the difference between his pay received as a juror or witness and the pay he would have received had he worked his regular scheduled working hours at his regular straight time rate The employee must furnish proof of service and the amount received for Jury duty and Crovm witness and must notify the Company promptly of his selection for J lIry duty and Crown witnessmiddot

Article 18 Pay on day of Injury

1801 An employee who is injured at work and who requires medical attention and who on the advice of a doctor is unable to return to work shall be paid for the balance of his scheduled hours of the day upon which the inj ury occurred

Article 19 Duration

1901 The agreement will be in effect from October 12002 to September 302005 inclusively and from year to year thereafter unless notice to bargain is given by either party not more than 90 days and not less than 30 days prior to the date of expiration The working conditions of the agreement will continue to apply until the signing of the new agreement

Article 20 Full-Time Benefits

2001 ft is a condition ofemployment for full-time employees to enroll in the VON Flexible Benefit Plan including Long Tenn Disability Insurance After one year of continuous service full-time employees must join the VON Canada Pension Plan as a condition of employment

The Employer shall contribute toward premium coverage ofparticipatingeligible employees in the active employ of the Employer under the insurance plans set out below subject to their respective tenns and conditions including any enrolment requirements

4) VON agrees to contribute 100 of the hilled premium tmvards coverage of eligible employees in the active employ of VON under the Ontario Health Insurance Plan through the Employer Health Tax

F) The Employer shall provide eacmiddoth employee with information booklets outlining all the current provisions in the benefits plan defined in this article

G) VON will provide access for full-time employees to the national Long Tenn Disability insurance as provided under VON Flexible Benefit Plan subject to its tenns and conditions on the basis of 100 employee paid premiums

H) VON Pension Plan is maintained at a National level Enrollment participation and contributions by the employee and the Home will be in accordance with the tenns and conditions of the Plan

(i) All full time employees who are presently enrolled in the Homes pension plan shall maintain their enrollment in the Plan Full time employees employed but not yet eligible for membership in the Plan shall as a condition ofemployment enrol in the Plan when eligible

(ii) Part time employees are eligible to join the Pension Plan after twenty four months of continuous service lfthe employee decides not to join at this time he will not be eligible to join later unless he meets the provincial eligibility requirement or he becomes employed on a full time basis

The Company and the employee shall make contributions in accordance with the provisions of the Plan In cases of part time employees the amount of their benefits in lieu would be reduced from 65 (article 21 (d)) to 3

Article 21 Sick Leave

A) Sick leave is the granting of time off with pay for absences from regular scheduled hours due to legitimate illness There shall be a Sick Credit Accumulating Bank for each funshytime employee in the active employ ofVON Such employees shall accumulate sick leave credits at the rate of one and one half days (1125 hours per month) per completed month of full-time work to a maximum of 120 days (900 hours)

B) Where a full-time employee is absent from work due to legitimate illness she shall not lose her regular straight time earnings from her regular scheduled hours but shaH draw from her Sick Credit Accumulation Bank to the extent of her credits in the Banle

C) The company agrees to pay for the full cost of the physicians fee for any examination that is required by the company if the fee is not covered by the insurance plan

Part-Time Benefits

802 An employees seniority will be his length of employment -1th the Company dating back to his first date of hire In the event of layoff full time employees will have the preference to bump less senior full time employees tirst then less senior part time employees Part time employees will have the preference to bump less senior part time employees as per article 80 I

803 All seniority is cancelled by such action as

a) If he voluntarily quits or is discharged and is not reinstated through the grievance procedure

b) Overstaying a leave of absence which means failing to report on the first scheduled shift after expiration of the leave unless he has legitimate reason for doing so~

c) Absence from work for three (3) consecutive schedule shifts without notifying the company except where the employee has just and sufficient cause for his failure to report

804 A newly hired employee shaH be known as a probationary employee until he has worked and successfully completed a period of 500 working hours or 6 months whichever comes first

Notwithstanding anything contained herein it is hereby agreed that there is no right to recall for probationary employees who are laid off

805 a) Time off due to illness injury will be included in an employees continued accrual of

b) Time off due to pregnancy layoff or leave of absence to a maximum of twelve consecutive months will be included in an employees continued accrual of seniority

811 Job Postings

When the Company decides to fill a current or new position in the bargaining unit notice of the position ~II be posted on the bulletin board for five (5) days so that all the employees will know about the position and be able to apply for the position in writing

Such job postings shall contain the following infonnation classification full time part time or casual duties qualifications date of posting and deadline for applications

The successful applicant will be awarded the job as per article 801 Within the five (5) shifts period the employee may elect to return their previous job and schedule or the Company may return the employee to their previous job and schedule if the employee does not meet the nonnal requirements of the job If no qualified employee has applied the Company may then hire from outside the Home

Article 9 Leave of Absence

901 The Company may grant leave ofabsence without pay to employees for legitimate personal reasons provided that such request is made in writing two (2) weeks in advance and the reasons for the leave ofabsence are stated Such request will not be arbitrarily denied

902 Leave of absence without pay will granted to employees who are required to attend union business upon a 2 week notice by the union in writing to the Company It is understood that no more than one employee may be off at anyone time except for special meetings for educational purposes and that granting leave is subject to the service needs and staffing requirements

Article 10 Bu lIetin Boards

1001 The Company will provide one (1) bulletin board in a mutually satisfactory location for the convenience of the union inposting notices of union activity All such notices must be signed by a member of the union committee or by the union representative Notices of a special nature must first be submitted to the company before posting

Article 11 Health and Safety

1101 The Company and the Union will cooperate fully in the development and maintenance of the highest possible standards of health and safety for all employees with emphasis on measures preventing accidents and industrial disease and ensuring adequate first-aid

1102 The parties hereto will establish and maintain ajoint health and safety committee and will ensure compliance with the health and safety legislation

1103 The committee will be comprised of Company and Union representatives and will hold regular meetings as required by the Occupation Health amp Safety Act The Company will supply the chairperson of the SubLocal with a copy of the investigation reports

Article 12 Reporting Allowance and Call-in Pay

1201 Any employee reporting for work at the start of his regular shift without having been previously notified not to report shall be given 4 hours work which he is capable of perfonning at his regular hourly rate or the rate of the job whichever is greater or he may elect to go home without pay Should no other work be available he shall receive 4 hours pay in lieu thereof

1202 a) Any maintenance employee called into work for emergencies after having left the

premises of the company following the end of his regular shift shall be paid a minimum of I hour at his regular straight rate in respect of each call in or paid time and one half for all hours worked whichever is greater

1202 b) Any employee other than maintenance who are called into work for emergencies after

having left the premises of the company following the end of his regular shift shall be paid a minimum of 3 hours at his regular straight rate in respect of each call in or paid time and one half for all hours worked whichever is greater

Article 13 Bereavement Pay

1301 In the event of a death in the immediate family of an employee who has successfully completed probation the employee will be entitled to a paid leave for 3 consecutive days at the time of death for the following spouse child stepshychildren son-in-law daughter-in-law parents step-parents brother sister pareQts-in-Iaw brother-in-law sister-in-law grandparents and grandchildren Up to an additional two (2) days for travelling if required to attend the funeral may be granted without loss of regular pay from regularly scheduled hours

Article 14 Hours of work and Overtime

1401 It is understood that this article is intended only to provide the basis of a work week for bargaining unit employees but shall not be interpreted as a guarantee of nonnal hours of work per day or nonnal hours of work per week

1402 Any hours in excess of eighty eight (88 ) in a 2 week period will be paid at the rate of time and one half the hourly rate for the job on which the overtime was worked

Staff working the midnight shift will be entitled to h hour paid lunch break During this paid break the employee is required to remain in the building with their phone on available to respond to any emergency that may occur ( Clarification under current staffing pattern staff working the midnight shift will be paid 8 hours instead of the current 75 hours )

Employees working an evening shift who are entitled to a lunch break will take their lunch break from 1830 - 1900 hours and not be required to be available to the building during this time based under current staffing patterns

1403 The term full time employee in this agreement shall mean a person who is regularly scheduled and actually works at least seventy five (75) hours in a two week period for the company exclusive of meal periods

1404 The term part- time employee in this agreement shall mean a person who is regularly scheduled and normally works less than seventy five (75) hours in a two (2) week period exclusive of meal periods

Employees will be allowed rest periods at times approved by their immediate supervisor with pay as follows two (2)ten( 10) minute rest periods in each eight (8) hours ofwork OR

b) one (1) ten(lO) minute rest period in four (4) hours to and including five (5) hours of work

1406 Employees will be paid on a bi-weekly basis

1407(a) Request For Time Off (excluding Christmas New Years and the months of July and August)

Schedules will be posted at least 1 week in advance of the date of the schedule and will cover a 1 month period Master schedules are posted that repeat every 2 weeks or 3 weeks (housekeeping) Staffcan determine from the master the dates they are working for any time period and therefore are expected to submit their request for time off (including vacation) at least 2 weeks before the next posting of a schedule This is usually by the 15th of themiddot previous month (eg current schedule runs to May 30 by May 15 any requests for time off for June must be in to your supervisor)

b) Once the schedule is posted the employee must work the scheduled shifts If the employee wants a particular time off then he can exchange with another employee or part time and casual staff can give the shift away Full time staff may exchange a shift during the two week pay period however a shift cannot be given away It is the responsibility of the employee to find their own replacement Where such changes occur the provisions relating to overtime do not apply Exchanges are to be in writing and

submitted to the Supervisor for approval before the exchange or give away takes place (all exchanges must be signed by both parties and dated prior being submitted to the supervisor) This means that a weekend exchange must be submitted and approved by 400 pm Thursday for an exchange for Saturday Sunday or Monday Failure to submit exchanges alt above ~II result in disciplinary action (This is not in effect from the weekend prior Christmas up to and including January 51b of any given year)

(c) When an employee accepts or makes an exchange or accepts a give away that employee can not give that shift to someone else the employee must work that shift

(d) Replacement for illness leave of absence and vacation will be offered first to existing employees in that department ifhe is available If no one in that department is available part-time or casual employees from another department may be offered the work according to seniority and availability if that employee has the appropriate skills

(e) Part time and casual employees in all departments ~II be asked if they would like to work in another department following a probationary period The employee will then be oriented and will be offered work when no else from the department is available

Article 15 Paid Holidays

1501 The following holidays shall be paid at the employees nonnal scheduled hours and rate for all such hours

811 Job Postings

When the Company decides to fill a current or new position in the bargaining unit notice of the position ~II be posted on the bulletin board for five (5) days so that all the employees will know about the position and be able to apply for the position in writing

Such job postings shall contain the following infonnation classification full time part time or casual duties qualifications date of posting and deadline for applications

The successful applicant will be awarded the job as per article 801 Within the five (5) shifts period the employee may elect to return their previous job and schedule or the Company may return the employee to their previous job and schedule if the employee does not meet the nonnal requirements of the job If no qualified employee has applied the Company may then hire from outside the Home

Article 9 Leave of Absence

901 The Company may grant leave ofabsence without pay to employees for legitimate personal reasons provided that such request is made in writing two (2) weeks in advance and the reasons for the leave ofabsence are stated Such request will not be arbitrarily denied

902 Leave of absence without pay will granted to employees who are required to attend union business upon a 2 week notice by the union in writing to the Company It is understood that no more than one employee may be off at anyone time except for special meetings for educational purposes and that granting leave is subject to the service needs and staffing requirements

Article 10 Bu lIetin Boards

1001 The Company will provide one (1) bulletin board in a mutually satisfactory location for the convenience of the union inposting notices of union activity All such notices must be signed by a member of the union committee or by the union representative Notices of a special nature must first be submitted to the company before posting

Article 11 Health and Safety

1101 The Company and the Union will cooperate fully in the development and maintenance of the highest possible standards of health and safety for all employees with emphasis on measures preventing accidents and industrial disease and ensuring adequate first-aid

1102 The parties hereto will establish and maintain ajoint health and safety committee and will ensure compliance with the health and safety legislation

1103 The committee will be comprised of Company and Union representatives and will hold regular meetings as required by the Occupation Health amp Safety Act The Company will supply the chairperson of the SubLocal with a copy of the investigation reports

Article 12 Reporting Allowance and Call-in Pay

1201 Any employee reporting for work at the start of his regular shift without having been previously notified not to report shall be given 4 hours work which he is capable of perfonning at his regular hourly rate or the rate of the job whichever is greater or he may elect to go home without pay Should no other work be available he shall receive 4 hours pay in lieu thereof

1202 a) Any maintenance employee called into work for emergencies after having left the

premises of the company following the end of his regular shift shall be paid a minimum of I hour at his regular straight rate in respect of each call in or paid time and one half for all hours worked whichever is greater

1202 b) Any employee other than maintenance who are called into work for emergencies after

having left the premises of the company following the end of his regular shift shall be paid a minimum of 3 hours at his regular straight rate in respect of each call in or paid time and one half for all hours worked whichever is greater

Article 13 Bereavement Pay

1301 In the event of a death in the immediate family of an employee who has successfully completed probation the employee will be entitled to a paid leave for 3 consecutive days at the time of death for the following spouse child stepshychildren son-in-law daughter-in-law parents step-parents brother sister pareQts-in-Iaw brother-in-law sister-in-law grandparents and grandchildren Up to an additional two (2) days for travelling if required to attend the funeral may be granted without loss of regular pay from regularly scheduled hours

Article 14 Hours of work and Overtime

1401 It is understood that this article is intended only to provide the basis of a work week for bargaining unit employees but shall not be interpreted as a guarantee of nonnal hours of work per day or nonnal hours of work per week

1402 Any hours in excess of eighty eight (88 ) in a 2 week period will be paid at the rate of time and one half the hourly rate for the job on which the overtime was worked

Staff working the midnight shift will be entitled to h hour paid lunch break During this paid break the employee is required to remain in the building with their phone on available to respond to any emergency that may occur ( Clarification under current staffing pattern staff working the midnight shift will be paid 8 hours instead of the current 75 hours )

Employees working an evening shift who are entitled to a lunch break will take their lunch break from 1830 - 1900 hours and not be required to be available to the building during this time based under current staffing patterns

1403 The term full time employee in this agreement shall mean a person who is regularly scheduled and actually works at least seventy five (75) hours in a two week period for the company exclusive of meal periods

1404 The term part- time employee in this agreement shall mean a person who is regularly scheduled and normally works less than seventy five (75) hours in a two (2) week period exclusive of meal periods

a)

Employees will be allowed rest periods at times approved by their immediate supervisor with pay as follows two (2)ten( 10) minute rest periods in each eight (8) hours ofwork OR

b) one (1) ten(lO) minute rest period in four (4) hours to and including five (5) hours of work

1406 Employees will be paid on a bi-weekly basis

1407(a) Request For Time Off (excluding Christmas New Years and the months of July and August)

Schedules will be posted at least 1 week in advance of the date of the schedule and will cover a 1 month period Master schedules are posted that repeat every 2 weeks or 3 weeks (housekeeping) Staffcan determine from the master the dates they are working for any time period and therefore are expected to submit their request for time off (including vacation) at least 2 weeks before the next posting of a schedule This is usually by the 15th of themiddot previous month (eg current schedule runs to May 30 by May 15 any requests for time off for June must be in to your supervisor)

b) Once the schedule is posted the employee must work the scheduled shifts If the employee wants a particular time off then he can exchange with another employee or part time and casual staff can give the shift away Full time staff may exchange a shift during the two week pay period however a shift cannot be given away It is the responsibility of the employee to find their own replacement Where such changes occur the provisions relating to overtime do not apply Exchanges are to be in writing and

submitted to the Supervisor for approval before the exchange or give away takes place (all exchanges must be signed by both parties and dated prior being submitted to the supervisor) This means that a weekend exchange must be submitted and approved by 400 pm Thursday for an exchange for Saturday Sunday or Monday Failure to submit exchanges alt above ~II result in disciplinary action (This is not in effect from the weekend prior Christmas up to and including January 51b of any given year)

(c) When an employee accepts or makes an exchange or accepts a give away that employee can not give that shift to someone else the employee must work that shift

(d) Replacement for illness leave of absence and vacation will be offered first to existing employees in that department ifhe is available If no one in that department is available part-time or casual employees from another department may be offered the work according to seniority and availability if that employee has the appropriate skills

(e) Part time and casual employees in all departments ~II be asked if they would like to work in another department following a probationary period The employee will then be oriented and will be offered work when no else from the department is available

Article 15 Paid Holidays

1501 The following holidays shall be paid at the employees nonnal scheduled hours and rate for all such hours

New Years Day Good Friday Victoria Day Canada Day Civic Day Labour Day Thanksgiving Day Christmas Day Boxing Day

1502 There will be two (2) floating holidays for each Full-Time employee to be taken at a time mutually agreed upon between the Company and the employee

1503 Any yvork perfonned on a Paid Holiday will be paid at time and one half the employees regular rate of pay for all hours worked for both full time and part time employees

Article 16 Vacation

1601 a) Employees who have less than one year of full-time continuous employment as of March

31 sl shall be entitled to a vacation pro-rated on the basis of 10 days vacation for each completed year ofservice If the employee leaves before the end of the first vacation year he will receive 4 of salary in lieu of vacation

b) Employees who have completed one or more years of full-time continuous service as of March 31 sl shall be entitled to a vacation of 10 days ( 4 of gross earnings for vacation entitlement year)

c) Employees who have completed 3 or more years of full time continuous service as of March 31 st shall be entitled to a vacation of 15 days ( 6 of gross earnings for vacation entitlement year)

d) Maintenance workers are as above with the exception of 15 days vacation ( 6 of gross earnings for vacation entitlement year) in as they perform emergency call back services

e) Maintenance workers who have completed 3 or more years of full time continuous service as of March 31 st shall he entitled to a vacation of20 days ( 8 of gross earnings for vacation entitlement year) as they perform emergency call back service

1602 If a statutory holiday falls within a vacation period an extra day shall be added to the vacation or taken at some other mutually agreed upon time

1603 The periods at which employees will be scheduled to take vacations will conform to the requirements of the Employers operations The Employer will post the vacation schedule for July and August by June 15th

Employees will submit their requests by May 15th

Where a conflict exists in vacation scheduling seniority shall be the governing factor Vacation time available after the allowed submission dates will be granted in accordance with the date of request and availability not seniority The employer will make every reasonable effort to grant an employee the first two (2) weeks of his annual vacation in consecutive weeks off It is understood that if employees are entitled to a third and consecutive five (5) day period provided there are no other employees who have not had their two week vacation alJotment the Employer wiJI make reasonable effort to grant the employee with the subsequent vacation allotment Employees shall be entitled to take vacations in single or more day allotment up to a maximum offive (5) single days

1604 Employees entitled to vacation with pay must take their vacation during the fiscal year April I to March 31 except for one week which may be carried over to the next year

1605 All vacation pay allowances shall be paid prior to the start of the employees scheduled vacation if requested on or before Monday of the payroll processing week

1606 Regular part-time employees shall be entitled to vacation pay as of March 31 S in the amount of 4 of their gross earnings After 3 years or more of continuous service as of March 31 ~ the vacation pay will be increased to 6 of their gross earnings

1607 Part-Time employees shall be entitled to vacation time off without pay based on years of service in the same amount as Full-Time employees

Article 17 Jury Duty and Crown Vitness

1701 The Company agrees to pay an employee who is summoned for Jury Duty or CrovvTI witness the difference between his pay received as a juror or witness and the pay he would have received had he worked his regular scheduled working hours at his regular straight time rate The employee must furnish proof of service and the amount received for Jury duty and Crovm witness and must notify the Company promptly of his selection for J lIry duty and Crown witnessmiddot

Article 18 Pay on day of Injury

1801 An employee who is injured at work and who requires medical attention and who on the advice of a doctor is unable to return to work shall be paid for the balance of his scheduled hours of the day upon which the inj ury occurred

Article 19 Duration

1901 The agreement will be in effect from October 12002 to September 302005 inclusively and from year to year thereafter unless notice to bargain is given by either party not more than 90 days and not less than 30 days prior to the date of expiration The working conditions of the agreement will continue to apply until the signing of the new agreement

Article 20 Full-Time Benefits

2001 ft is a condition ofemployment for full-time employees to enroll in the VON Flexible Benefit Plan including Long Tenn Disability Insurance After one year of continuous service full-time employees must join the VON Canada Pension Plan as a condition of employment

The Employer shall contribute toward premium coverage ofparticipatingeligible employees in the active employ of the Employer under the insurance plans set out below subject to their respective tenns and conditions including any enrolment requirements

4) VON agrees to contribute 100 of the hilled premium tmvards coverage of eligible employees in the active employ of VON under the Ontario Health Insurance Plan through the Employer Health Tax

8) VON agrees to contribute 50 of the billed premium towards coverage of eligible employees in the active employ of VON under the Health Care benefits up to a maximum of tier tO coverage for a couple as provided under the VON Flexible Benetit Plan

C) VON agrees to contribute 50 of the billed premium towards coverage ofeligible employees in the active employ of VON under the Dental Care benefits up to a maximum of tier two coverage for a couple as provided under the VON Flexible Benefit Plan

D) VON agrees to contribute 100 of the billed premium towards coverage of eligible employees in the active employ of VON for Life Insurance up to a maximum of 15 times salary (includes accidental dismembennent) as provided under the VON Flexible Benefit Plan

E) Active employ excludes absences without pay from VON in excess of thirty consecutive calendar days An employee on such leave of absence shall be responsible for full payment of the premiums set out above for any benefit plans in which she participates for the period of the absence and Vvill prepay to VON the premiums during the period of the leave to ensure her continuing coverage

F) The Employer shall provide eacmiddoth employee with information booklets outlining all the current provisions in the benefits plan defined in this article

G) VON will provide access for full-time employees to the national Long Tenn Disability insurance as provided under VON Flexible Benefit Plan subject to its tenns and conditions on the basis of 100 employee paid premiums

H) VON Pension Plan is maintained at a National level Enrollment participation and contributions by the employee and the Home will be in accordance with the tenns and conditions of the Plan

(i) All full time employees who are presently enrolled in the Homes pension plan shall maintain their enrollment in the Plan Full time employees employed but not yet eligible for membership in the Plan shall as a condition ofemployment enrol in the Plan when eligible

(ii) Part time employees are eligible to join the Pension Plan after twenty four months of continuous service lfthe employee decides not to join at this time he will not be eligible to join later unless he meets the provincial eligibility requirement or he becomes employed on a full time basis

The Company and the employee shall make contributions in accordance with the provisions of the Plan In cases of part time employees the amount of their benefits in lieu would be reduced from 65 (article 21 (d)) to 3

(For information purposes only) Current Provincial Eligible Requirements for the Province of Ontario are employee must have earned at least 35 ofYMPR ($3910000) or worked at least 700 hours in each of the 2 calendar years prior to enrolment

Article 21 Sick Leave

A) Sick leave is the granting of time off with pay for absences from regular scheduled hours due to legitimate illness There shall be a Sick Credit Accumulating Bank for each funshytime employee in the active employ ofVON Such employees shall accumulate sick leave credits at the rate of one and one half days (1125 hours per month) per completed month of full-time work to a maximum of 120 days (900 hours)

B) Where a full-time employee is absent from work due to legitimate illness she shall not lose her regular straight time earnings from her regular scheduled hours but shaH draw from her Sick Credit Accumulation Bank to the extent of her credits in the Banle

C) The company agrees to pay for the full cost of the physicians fee for any examination that is required by the company if the fee is not covered by the insurance plan

Part-Time Benefits

D) Part-time employees shall receive an amount of65 of their regular rate in lieu of fullshytime benefits ( full-time benefits sick leave paid holidays and pension plan) Such an amount shall not be paid on any overtime hours worked

Letter of lInderstanding Re Lady Aberdeen Place

Whereas the Employer has closed the Lady Aberdeen Place the parties have agreed to remove references to the Place from the collective agreement

The parties agree that the removal of references to the Place in the current collective agreement does not signify an intention by the Union to abandon any bargaining rights that it might hold at the Place

This Letter of Understanding forms part of the current collective agreement as well as any renewals thereto unless specifically retracted in writing by the parties

Letter of Understanding dealing with Christmas amp New Years Time Frame

Time off at Christmas and New Years vill be scheduled as equitably as possible on an alternating basis

The Christmas schedule will be posted by November 20th and staff will be allowed to make shift changes for the Christmas period until December loth As of December II th the schedule will remain unchanged and no further shift exchanges will be allowed until after January 5th

Article 1407 (bc) Shift Exchanges must be followed and incorporate the above requirements for the Christmas and New Years period

(i) All full time employees who are presently enrolled in the Homes pension plan shall maintain their enrollment in the Plan Full time employees employed but not yet eligible for membership in the Plan shall as a condition ofemployment enrol in the Plan when eligible

(ii) Part time employees are eligible to join the Pension Plan after twenty four months of continuous service lfthe employee decides not to join at this time he will not be eligible to join later unless he meets the provincial eligibility requirement or he becomes employed on a full time basis

Article 21 Sick Leave

B) Where a full-time employee is absent from work due to legitimate illness she shall not lose her regular straight time earnings from her regular scheduled hours but shaH draw from her Sick Credit Accumulation Bank to the extent of her credits in the Banle

C) The company agrees to pay for the full cost of the physicians fee for any examination that is required by the company if the fee is not covered by the insurance plan

Part-Time Benefits

D) Part-time employees shall receive an amount of65 of their regular rate in lieu of fullshytime benefits ( full-time benefits sick leave paid holidays and pension plan) Such an amount shall not be paid on any overtime hours worked

This Letter of Understanding forms part of the current collective agreement as well as any renewals thereto unless specifically retracted in writing by the parties

Letter of Understanding dealing with Christmas amp New Years Time Frame

Time off at Christmas and New Years vill be scheduled as equitably as possible on an alternating basis

The Christmas schedule will be posted by November 20th and staff will be allowed to make shift changes for the Christmas period until December loth As of December II th the schedule will remain unchanged and no further shift exchanges will be allowed until after January 5th

Article 14 Hours of work and Overtime

1401 It is understood that this article is intended only to provide the basis of a work week for bargaining unit employees but shall not be interpreted as a guarantee of nonnal hours of work per day or nonnal hours of work per week

1402 Any hours in excess of eighty eight (88 ) in a 2 week period will be paid at the rate of time and one half the hourly rate for the job on which the overtime was worked

Staff working the midnight shift will be entitled to h hour paid lunch break During this paid break the employee is required to remain in the building with their phone on available to respond to any emergency that may occur ( Clarification under current staffing pattern staff working the midnight shift will be paid 8 hours instead of the current 75 hours )

Employees working an evening shift who are entitled to a lunch break will take their lunch break from 1830 - 1900 hours and not be required to be available to the building during this time based under current staffing patterns

1403 The term full time employee in this agreement shall mean a person who is regularly scheduled and actually works at least seventy five (75) hours in a two week period for the company exclusive of meal periods

1404 The term part- time employee in this agreement shall mean a person who is regularly scheduled and normally works less than seventy five (75) hours in a two (2) week period exclusive of meal periods

Employees will be allowed rest periods at times approved by their immediate supervisor with pay as follows two (2)ten( 10) minute rest periods in each eight (8) hours ofwork OR

b) one (1) ten(lO) minute rest period in four (4) hours to and including five (5) hours of work

1406 Employees will be paid on a bi-weekly basis

1407(a) Request For Time Off (excluding Christmas New Years and the months of July and August)

Schedules will be posted at least 1 week in advance of the date of the schedule and will cover a 1 month period Master schedules are posted that repeat every 2 weeks or 3 weeks (housekeeping) Staffcan determine from the master the dates they are working for any time period and therefore are expected to submit their request for time off (including vacation) at least 2 weeks before the next posting of a schedule This is usually by the 15th of themiddot previous month (eg current schedule runs to May 30 by May 15 any requests for time off for June must be in to your supervisor)

b) Once the schedule is posted the employee must work the scheduled shifts If the employee wants a particular time off then he can exchange with another employee or part time and casual staff can give the shift away Full time staff may exchange a shift during the two week pay period however a shift cannot be given away It is the responsibility of the employee to find their own replacement Where such changes occur the provisions relating to overtime do not apply Exchanges are to be in writing and

submitted to the Supervisor for approval before the exchange or give away takes place (all exchanges must be signed by both parties and dated prior being submitted to the supervisor) This means that a weekend exchange must be submitted and approved by 400 pm Thursday for an exchange for Saturday Sunday or Monday Failure to submit exchanges alt above ~II result in disciplinary action (This is not in effect from the weekend prior Christmas up to and including January 51b of any given year)

(c) When an employee accepts or makes an exchange or accepts a give away that employee can not give that shift to someone else the employee must work that shift

(d) Replacement for illness leave of absence and vacation will be offered first to existing employees in that department ifhe is available If no one in that department is available part-time or casual employees from another department may be offered the work according to seniority and availability if that employee has the appropriate skills

(e) Part time and casual employees in all departments ~II be asked if they would like to work in another department following a probationary period The employee will then be oriented and will be offered work when no else from the department is available

Article 15 Paid Holidays

1501 The following holidays shall be paid at the employees nonnal scheduled hours and rate for all such hours

1601 a) Employees who have less than one year of full-time continuous employment as of March

b) Employees who have completed one or more years of full-time continuous service as of March 31 sl shall be entitled to a vacation of 10 days ( 4 of gross earnings for vacation entitlement year)

e) Maintenance workers who have completed 3 or more years of full time continuous service as of March 31 st shall he entitled to a vacation of20 days ( 8 of gross earnings for vacation entitlement year) as they perform emergency call back service

1602 If a statutory holiday falls within a vacation period an extra day shall be added to the vacation or taken at some other mutually agreed upon time

1603 The periods at which employees will be scheduled to take vacations will conform to the requirements of the Employers operations The Employer will post the vacation schedule for July and August by June 15th

Employees will submit their requests by May 15th

Where a conflict exists in vacation scheduling seniority shall be the governing factor Vacation time available after the allowed submission dates will be granted in accordance with the date of request and availability not seniority The employer will make every reasonable effort to grant an employee the first two (2) weeks of his annual vacation in consecutive weeks off It is understood that if employees are entitled to a third and consecutive five (5) day period provided there are no other employees who have not had their two week vacation alJotment the Employer wiJI make reasonable effort to grant the employee with the subsequent vacation allotment Employees shall be entitled to take vacations in single or more day allotment up to a maximum offive (5) single days

1604 Employees entitled to vacation with pay must take their vacation during the fiscal year April I to March 31 except for one week which may be carried over to the next year

1605 All vacation pay allowances shall be paid prior to the start of the employees scheduled vacation if requested on or before Monday of the payroll processing week

1606 Regular part-time employees shall be entitled to vacation pay as of March 31 S in the amount of 4 of their gross earnings After 3 years or more of continuous service as of March 31 ~ the vacation pay will be increased to 6 of their gross earnings

Article 17 Jury Duty and Crown Vitness

1701 The Company agrees to pay an employee who is summoned for Jury Duty or CrovvTI witness the difference between his pay received as a juror or witness and the pay he would have received had he worked his regular scheduled working hours at his regular straight time rate The employee must furnish proof of service and the amount received for Jury duty and Crovm witness and must notify the Company promptly of his selection for J lIry duty and Crown witnessmiddot

Article 18 Pay on day of Injury

1801 An employee who is injured at work and who requires medical attention and who on the advice of a doctor is unable to return to work shall be paid for the balance of his scheduled hours of the day upon which the inj ury occurred

Article 19 Duration

1901 The agreement will be in effect from October 12002 to September 302005 inclusively and from year to year thereafter unless notice to bargain is given by either party not more than 90 days and not less than 30 days prior to the date of expiration The working conditions of the agreement will continue to apply until the signing of the new agreement

Article 20 Full-Time Benefits

2001 ft is a condition ofemployment for full-time employees to enroll in the VON Flexible Benefit Plan including Long Tenn Disability Insurance After one year of continuous service full-time employees must join the VON Canada Pension Plan as a condition of employment

Article 16 Vacation

1601 a) Employees who have less than one year of full-time continuous employment as of March

31 sl shall be entitled to a vacation pro-rated on the basis of 10 days vacation for each completed year ofservice If the employee leaves before the end of the first vacation year he will receive 4 of salary in lieu of vacation

b) Employees who have completed one or more years of full-time continuous service as of March 31 sl shall be entitled to a vacation of 10 days ( 4 of gross earnings for vacation entitlement year)

c) Employees who have completed 3 or more years of full time continuous service as of March 31 st shall be entitled to a vacation of 15 days ( 6 of gross earnings for vacation entitlement year)

d) Maintenance workers are as above with the exception of 15 days vacation ( 6 of gross earnings for vacation entitlement year) in as they perform emergency call back services

Employees will submit their requests by May 15th

Where a conflict exists in vacation scheduling seniority shall be the governing factor Vacation time available after the allowed submission dates will be granted in accordance with the date of request and availability not seniority The employer will make every reasonable effort to grant an employee the first two (2) weeks of his annual vacation in consecutive weeks off It is understood that if employees are entitled to a third and consecutive five (5) day period provided there are no other employees who have not had their two week vacation alJotment the Employer wiJI make reasonable effort to grant the employee with the subsequent vacation allotment Employees shall be entitled to take vacations in single or more day allotment up to a maximum offive (5) single days

1604 Employees entitled to vacation with pay must take their vacation during the fiscal year April I to March 31 except for one week which may be carried over to the next year

1605 All vacation pay allowances shall be paid prior to the start of the employees scheduled vacation if requested on or before Monday of the payroll processing week

Article 18 Pay on day of Injury

1801 An employee who is injured at work and who requires medical attention and who on the advice of a doctor is unable to return to work shall be paid for the balance of his scheduled hours of the day upon which the inj ury occurred

Article 19 Duration

1901 The agreement will be in effect from October 12002 to September 302005 inclusively and from year to year thereafter unless notice to bargain is given by either party not more than 90 days and not less than 30 days prior to the date of expiration The working conditions of the agreement will continue to apply until the signing of the new agreement

Article 20 Full-Time Benefits

F) The Employer shall provide eacmiddoth employee with information booklets outlining all the current provisions in the benefits plan defined in this article

G) VON will provide access for full-time employees to the national Long Tenn Disability insurance as provided under VON Flexible Benefit Plan subject to its tenns and conditions on the basis of 100 employee paid premiums

H) VON Pension Plan is maintained at a National level Enrollment participation and contributions by the employee and the Home will be in accordance with the tenns and conditions of the Plan

(i) All full time employees who are presently enrolled in the Homes pension plan shall maintain their enrollment in the Plan Full time employees employed but not yet eligible for membership in the Plan shall as a condition ofemployment enrol in the Plan when eligible

(ii) Part time employees are eligible to join the Pension Plan after twenty four months of continuous service lfthe employee decides not to join at this time he will not be eligible to join later unless he meets the provincial eligibility requirement or he becomes employed on a full time basis

New employees fill start at $050 an hour below the start rate of the job then move to the job rate at the end of their probationary period

A lump sum of $10000 for all full tiome amp part time employees and $5000 for all casuals on ratification

Letter of lInderstanding Re Lady Aberdeen Place

Whereas the Employer has closed the Lady Aberdeen Place the parties have agreed to remove references to the Place from the collective agreement

The parties agree that the removal of references to the Place in the current collective agreement does not signify an intention by the Union to abandon any bargaining rights that it might hold at the Place

This Letter of Understanding forms part of the current collective agreement as well as any renewals thereto unless specifically retracted in writing by the parties

Letter of Understanding dealing with Christmas amp New Years Time Frame

Time off at Christmas and New Years vill be scheduled as equitably as possible on an alternating basis

The Christmas schedule will be posted by November 20th and staff will be allowed to make shift changes for the Christmas period until December loth As of December II th the schedule will remain unchanged and no further shift exchanges will be allowed until after January 5th

Article 1407 (bc) Shift Exchanges must be followed and incorporate the above requirements for the Christmas and New Years period

The Christmas period is defined as the weekend before Christmas lip to and including January 5th
