PREFACE

"Quis custodiet ipsos custodes?" -Juvenal

"Qui Custodiet Custodes"

The correct exercise of judicial authoritynecessarily requires self-discipline. Otherwise,authority becomes oppression. This is thefundamental reason for which the Code isoffered.

After much work by a number of judges, theCode was adopted by the Provincial JudgesAssociation of British Columbia at its AnnualGeneral Meeting September 18, 1976, andpursuant to the Provincial Court Act by theJudicial Council of the Court pursuant to Section13(e) of the Act December 3, 1976.

This Code was updated in language only inJune of 1993.

This Code of Judicial Ethics not only meetsprofessional needs but in a social sense goesdirectly to the judge's credibility.

In attempting to define the ideal of properjudicial conduct it serves both as a guide and astandard.

In this Code of Judicial Ethics, so far as thecontext does not indicate differently, the followingdefinitions shall apply:

a) "Act" Provincial Court Act R.S.B.C. 1979, C. 341

b) "Association" Provincial Court Judges' Association of British Columbia (formerly known as Provincial Judges Association of British Columbia)

c) "Council" Judicial Council pursuant to Section 12 of the Provincial Court Act

SECTION 1

PERSONAL COMPORTMENT

Rule 1.00- Judges must be trulyindependent and must avoid allconflict of interest.

CONSIDERATIONS:

1.01 Independence of judges requires bothmaterial and intellectual autonomy.

1.02 Judges are subject only to that authoritywhich emanates from the Provincial CourtAct.

1.03 Judges must always beware of a possibleconflict of interest where their financialaffairs are involved.

Rule 2.00- Judges must devotethemselves entirely to the exercise oftheir judicial function.

CONSIDERATIONS:

2.01 The rule conforms with Section 8 of theAct.

2.02 The essence of this rule is the assurancethat the impartiality of judges is neverplaced in doubt.

2.03 Upon accepting an appointment to thebench, judges consent voluntarily to theacceptance of certain advantages as wellas certain prohibitions.

2.04 Subject to any legislation to the contrary,and as long as judicial functions do notsuffer, judges may without remunerationor honorarium:

a)participate in legal activities. Withoutlimiting the generality of the foregoing,judges may teach law, attendconferences, write articles or treatises,work on committees;

b)participate in activities related to thecommunity, to charities, to the arts, andto sports, it being recognized that ajudge isolated from society is one whocannot keep in touch with its evolution.However, judges should not participatein fund-raising activities.

Rule 3.00-Judges should maintaintheir competence, both through theirown work, and by participation in allprograms of general education orupgrading.

CONSIDERATIONS:

3.01 All parties concerned have a right topresume that judges have the generallegal knowledge and the aptitudesrequired to be Provincial Courtjudges.

3.02 The Chief Judge should see to theswearing-in and orientation of anyjudge appointed.

3.03 Judges should endeavour to remain upto date on any changes in the law inthose areas where they will be calledupon to exercise their functions and toreflect upon the spirjt and the letter ofthe law which it is a judge's duty toapply.

3.04 In the field of permanent judicialeducation, judges have a duty tocooperate with the organizationdealing with refresher courses.

Rule 4.00- Everywhere and at alltimes, judges should behaveirreproachably.

CONSIDERATIONS:

4.01 Judges should always conduct themselvesproperly.

4.02 Judges should expect to be constantlyscrutinized by the public. Consequentlythey should also voluntarily impose uponthemselves certain restrictions on theirbehaviour, their associations and theirpublic appearances.

4.03 Judges should respect and comply with thelaw and should conduct themselves at alltimes in a manner that promotes publicconfidence in the integrity and impartialityof the judiciary.

Rule 5.00- Judges should be impartial,diligent and courageous.

CONSIDERATIONS:

5.01 Judges should not be influenced bypartisan interest, public opinion, or fear ofcriticism.

5.02 Judges should not lend their prestige to thepromotion of other interests.

5.03 In all matters of which they are seized or onwhich they expect to sit, judges have theduty not to hear or receive before judgmentany representations, verbal or written, inthe absence or without knowledge of theparties and their counsel.

Rule 6.00- Judges must be objective.

CONSIDERATIONS:

6.01 By being aware that judges are marked likeall of the world with human nature, theyshould be constantly on guard to maintaintheir objectivity.

6.02 In the course of hearings judges shouldrefrain from making any observationswhich might indicate their thinking or theirdecisions.

6.03 Judges should remain above the parties,their counsel, and the dispute itself.

Rule 7.00- The role of judges is torender justice within the framework ofthe law.

CONSIDERATIONS:

7.01 Although the two expressions can beviewed in the same light, a distinction is madehere between the administration of justice andthe rendering of justice.

7.02 By their oath of office judges have the dutyto apply the law.

7.03 In this era of multi-disciplinary approaches,judges may in certain circumstances haverecourse to advice from others in order to assistthem in rendering justice.

7.04 In conjunction with the previousconsiderations, judges should always beconscious of the responsibility which is theirsalone: that is, the final decision, the burden ofwhich they must carry.

Rule 8.00-Judges should refrain fromcriticizing openly or publicly thequality of the administration of justiceor the conduct of judges, other thanthrough the appropriate channels.

CONSIDERATIONS:

8.01 Maintaining the status quo is no morevirtuous than change for change's sake.With this in mind, judges' daily experiencesmay place them in a position to formulatesuggestions for the improvement of judicialinstitutions.

8.02 In such a case, judges may makerecommendations and representationsprovided that these are done through theintermediary of the Chief Judge (or theAssociation).

Rule 9.00- Reasons for judgment shouldbe given and if reserved should berendered within a reasonable time.

CONSIDERATIONS:

9.01 The parties before the court have everyright to know the outcome of any hearingas soon as possible.

9.02 A party has the right to be told in clearlanguage the reasons behind a particulardecision.

9.03 Explicit reasons should be given for alljudgments.

Rule 10.00- Judges should:

a) sit at those times and in thoseplaces to which they areassigned by their Chief Judgepursuant to the statutorypowers assigned to the latter,and,

b) conduct hearings and make theirdecisions with all due diligence,and,

c) make themselves available toassist their colleagues on thoseoccasions when their own workends prematurely.

CONSIDERATIONS:

10.01 Time is an aspect of justice, and justicemust at times move slowly. With this inmind, this rule emphasizes speed andefficiency.

10.02 Frequent adjournments during a particularcase may weaken the evidence and mayresult in the failure to properly emphasizecertain elements in the evidence to thedetriment of the parties and of the publicinterest.

10.03 Justice delayed can often be justice denied.

Rule 11.00- In the exercise of theirjudicial functions, judges shouldmaintain their serenity at all times.

CONSIDERATIONS:

11.01 Judges will always be the object ofcriticism since the aim of their work is tomake rulings between the opposing parties.

11.02 Judges should make every effort to becalm, patient, and to remain above criticismin order to guard against the loss of theirserenity.

11.03 The personal problems of judges shouldnever bear so heavily upon them that theylose the serenity necessary to the properperformance of their duties.

11.04 The atmosphere surrounding work ofjudges should promote peace of mind.

11.05 Serenity implies good sense and anevenness of attitude.

Rule 12.00- When presiding at ahearing, the conduct of judges shouldreflect the seriousness and gravity ofjudicial proceedings.

CONSIDERATIONS:

12.01 Judges on the bench should maintain animpassive attitude.

12.02 When it is necessary to remand a matter toanother date, judges should explain succinctly tothose present the reasons for such anadjournment.

12.03 Complaints regarding the conduct ofhearings should not be voiced by judges fromthe bench or in any other public forum, butrather should be discussed with the Chief Judgeor the Association.

Rule 13.00- In the light of their duty tomaintain order and decorum duringhearings, judges should display firmnesswith courtesy, and at all times bepatient, deliberate and dignified.

CONSIDERATIONS:

13.0l Within the bounds of decency, the law, andthe rules of practice, judges should alwaysallow counsel to fulfill their obligationswith all due vigour and persistence.

13.02 Should counsel lose control, fall into theuse of invective, or generally conductthemselves casually or with arrogance,judges should avoid meeting them on thislevel, and should instead work to return thehearing to that level of good sense anddecorum necessary to the soundadministration of justice.

13.03 Judges should always remind thoseappearing before them that they have a dutyto observe the rules of basic good manners.

Rule 14.00- Judges should treat allthose appearing before them withdeference and respect.

CONSIDERATIONS:

14.01 Many witnesses must make certainsacrifices to appear in court and may find thistask a very difficult one; judges shouldtherefore be patient and refrain from directingany comment which might be interpreted bysuch persons to be derogatory.

14.02 Many witnesses are appearing in courtfor the first time and are unaware of the basicrules of court. It therefore falls to the judgeto briefly instruct witnesses as to what isexpected of them in the performance oftheir duties.

Rule 15.00- Judges should attend inCourt at the time designated.

CONSIDERATlONS:

15.01 The role of punctuality in theadministration of justice cannot beoverestimated.

15.02 In the absence of any specific rules ofpractice, it is the duty of the Chief Judge toset hours of court sittings and to ensure thatall parties are well advised of such hours.

Rule 16.00- Judges who infringe thesejudicial guidelines offend the honour anddignity of the Provincial Court of BritishColumbia.
