    CODE OF CONDUCT AND ETHICAL STANDARDS FOR PUBLIC OFFICIALS AND EMPLOYEES

  • STATES POLICY

    To promote high standard of ethics in public service

    Public officials and employees shall at all times be accountable to the people and shall discharge their duties with utmost responsibility, integrity, competence, and loyalty, act with patriotism and justice, lead modest lives, and uphold public interest over personal interest.

  • NORMS OF CONDUCT OF PUBLIC OFFICIALS AND EMPLOYEES

    Standard of personal conduct in the discharge

    and execution of official duties:

    o Commitment to public interest

    o Professionalism

    o Justness and sincerity

    o Political neutrality

    o Responsiveness to the public

    o Nationalism and patriotism

    o Commitment to democracy

    o Simple living

  • DUTIES OF PUBLIC OFFICIALS AND EMPLOYEES

    o Act promptly on letters and requests (within 15 working days)

    o Submit annual performance reports (all heads/responsible officers within 45 working days from end of year)

    o Process documents and papers expeditiously (completed within a reasonable time with not more than 3 signatories)

    o Act immediately on the publics personal transactions

    o Make documents accessible to the public

    o To motivate and inspire public servants to uphold the highest standards of ethics

    o Committee on Awards to Outstanding Public Officials and Employees

  • PROHIBITED ACTS AND TRANSACTIONS

    In addition to unlawful acts and omissions of public officials and employees prescribed in the Constitution and existing laws:

    Outside employment and other activities related thereto:

    Own, control, manage or accept employment in any private enterprise regulated, supervised or licensed by the Office unless expressly allowed by law

    Engage in unauthorized private practice of profession in conflict with official functions

    Recommend any person to a position in a private enterprise having regular or pending official transaction with the office (applicable for a period of 1 year after resignation, retirement or separation from public office)

  • STATEMENTS AND DISCLOSURES (DECLARATIONS UNDER OATH)

    o Statement of Assets and Liabilities and Financial Disclosure (including spouses and unmarried children under 18 years old living in thier households)

    1. Statement of Assets, Liabilities and Net Worth

    2. Disclosure of Business Interests and Financial Connections

    Filed within 30d upon assumption of office; on/before April 30 every year thereafter; 30d after separation from service

  • STATEMENTS AND DISCLOSURES (DECLARATIONS UNDER OATH)

    o Identification and disclosure of relatives

    o Accessibility of the documents

    o Prohibited acts unlawfully obtain or use any statement filed under RA 6713 for any purpose contrary to morals or public policy, or any commercial purpose other than by news and communications media for dissemination to the public

  • DIVESTMENT TO AVOID CONFLICTS OF INTEREST

    o If conflict arises, resign from position in any private business enterprise within 30 days from assumption of office; or

    o Divest himself of his shareholdings or interest in any private business enterprise within 60 days from such assumption

    o Applies to partnerships

  • PENALTIES

    o Any violation of RA 6713- punishable with a fine not exceeding 1 year, or removal depending on the gravity of the offense, after due notice and hearing

    o Commission of prohibited acts or transactions, violation of declarations under oath (SALN, DBIFC)- punishable by imprisonment not exceeding 5 years, or fine not exceeding P5,000.00, or both; and possibly disqualification to hold public office

    o Any violation proven in proper administrative proceedings shall be sufficient cause for removal or dismissal from public office, even if theres no criminal prosecution

  • PENALTIES

    o Private individuals participating in conspiracy as co-principals, accomplices or accessories, with public officials/employees, shall be subject to same penal liabilities and tried jointly

    o Any official or employee may bring an action against any person who unlawfully obtains or uses reports for any prohibited purpose, the latter to be penalized in any amount not exceeding P25,000.00 or heavier sanction under any other law if applicable
