Appendix A Co-ordinated Admission Schemes for Maintained Schools and Academies in the Area of Cumbria Local Authority 2011/2012 1. Introduction (1) In line with the requirements of the 1998 School Standards and Framework Act as amended by the 2002 Education Act, this scheme has been drawn up by Cumbria Local Authority [LA] to co-ordinate admissions to all maintained schools and academies in Cumbria, except special and nursery schools, regardless of whether the LA or the Governing Body is the admission authority. (2) The scheme’s purpose is to ensure that, as far as reasonably practicable, every parent living in Cumbria who has applied for a place for their child for September entry to either a maintained primary school or a place in a maintained secondary school [or academy] in the normal admissions round, receives an offer of one, and only one, school place on: (a) 28 April 2011 for starting infant or primary school; (b) 28 April 2011 for transferring to a junior school; or (c) 1 March 2011 for transferring to secondary school or an academy. (d) For applications received after the re-allocation process for the main intakes, and at any time other than to the normal year of entry, will be treated as “in year admissions”. Form SA8 must be completed and a place will be allocated within 20 school days of receipt of Form SA8 by the Local Authority. (e) For all other applications a place will be allocated within 20 school days of receipt by the Local Authority of a completed SA8. Co-ordinated Admission Schemes for Maintained Schools and Academies in the Area of Cumbria Local Authority 2011/2012 1. Introduction

(1) In line with the requirements of the 1998 School Standards and Framework Act as amended by the 2002 Education Act, this scheme has been drawn up by Cumbria Local Authority [LA] to co-ordinate admissions to all maintained schools and academies in Cumbria, except special and nursery schools, regardless of whether the LA or the Governing Body is the admission authority.

(2) The scheme’s purpose is to ensure that, as far as reasonably practicable, every parent living in Cumbria who has applied for a place for their child for September entry to either a maintained primary school or a place in a maintained secondary school [or academy] in the normal admissions round, receives an offer of one, and only one, school place on: (a) 28 April 2011 for starting infant or primary school;

(b) 28 April 2011 for transferring to a junior school; or

(c) 1 March 2011 for transferring to secondary school or an academy.

(d) For applications received after the re-allocation process for the main intakes, and at any time other than to the normal year of entry, will be treated as “in year admissions”. Form SA8 must be completed and a place will be allocated within 20 school days of receipt of Form SA8 by the Local Authority.

(e) For all other applications a place will be allocated within 20 school days of receipt by the Local Authority of a completed SA8.

(3) At schools where boarding accommodation is provided, the scheme does not apply to those places set aside for boarders.

(4) The scheme does not apply to admissions to school 6th Forms [Year 12]. (5) The scheme will be implemented in accordance with the timetables set out in

Appendices 1 and 2. (6) Appendices 3 and 4 list the admission authorities to which the scheme applies. For the purposes of this document ‘school’ refers to schools and academies unless otherwise indicated.

2. The Common Application Forms

(1) There will be four standard forms known as the Common Application Forms. They are as follows: SA1 – Admission to Infant or Primary School – September 2011 SA2 – Transfer to Junior School – September 2011

SA3 – Transfer to Secondary School – September 2011 SA8 – Request for Admission to School [In year admissions – not main intake]

(2) The forms will be used for the purpose of admitting pupils into the Reception Year for infant/primary, Year 3 for junior and Year 7 for secondary intake groups in September 2011 and the SA8 for all admissions outside of the main intake. They will:

• invite parents to express three preferences for schools or academies in rank order of preference including, where relevant, any schools outside the LA’s area;

• explain that parents are entitled to give their reasons for their preferences;

• explain that the parent will receive no more than one offer of a school place from the LA.

• explain that if a place cannot be offered at one of the schools expressed as a preference, a place will be offered at an alternative school.

• specify the closing date [except SA8] and to whom the form must be returned;

• explain that parents must complete only one form for each child [except SA8].

(3) The LA will ensure that the SA1, SA2 and SA3 are available from the LA and all

maintained schools and academies in the LA area. They will be available with a parental information booklet six weeks before the closing date for applications. Parents of children in their last year at an infant school will receive a booklet and form SA2 from the school and those with a child in the last year of a primary or junior school will receive a pack and form SA3, also from their existing school. The booklet and application form will be made available on the Cumbria County Council website at

cumbria.gov.uk/childrensservices/admissions (4) The LA will also ensure that Form SA8 for in year [casual] admissions is

available in all maintained schools and academies in the LA area and that information for parents is available from the LA.

(5) The Governing Body of a VA/F school or academy can require parents who

wish to express a preference for their school on the common application form, to provide additional information on a supplementary form only where the information is required for the Governing Body to apply their oversubscription criteria. Where a supplementary form is required it must be returned to the LA, along with the common application form [SA1, SA2, SA3 or SA8].

(6) A supplementary form will not be regarded as a valid application unless the

parent has also completed a common application form and the school has been given as one of their preferences.

(7) Where common application forms and/or supplementary forms are sent directly to VA/F schools or academies, they must be passed to the LA within five school days.

3. The Closing Date for Application Forms [SA1 SA2 and SA3]

(1) Completed forms must be returned as follows:

SA1 by 15 January 2011 to the parent’s first preference school SA2 by 15 January 2011 to the child’s current infant school SA3 by 31 October 2010 to the child’s current junior or primary school

Parents of children not attending a maintained school or academy in Cumbria, or any parent preferring to return their form direct to the LA, should return the form to the School Admissions Team. The same closing dates apply. Completed Forms SA8 must also be returned to the Local Authority, School Admissions Team.

(2) Where a preference has been expressed for a VA/F school requiring a

supplementary form, this should be attached and returned at the same time as the SA1, SA2, SA3 or SA8. Any evidence specified in the admissions policies for any of the schools applied for also must be attached.

(3) All schools must forward completed application forms to the LA on a weekly

basis as and when they are received. The deadlines for the main intake forms to be sent by first class post are: SA1 – 17 January 2011 SA2 – 17 January 2011 SA3 – 2 November 2010 SA8 – To be forwarded on the first school day after receipt of the SA8 form

(4) In relation to oversubscribed schools, preferences for the main intake on Forms SA1, SA2 and SA3 which are submitted or changed after the closing date will only be considered in exceptional circumstances. This is only likely to be where a family were living outside of England and Wales and were, therefore, unable to submit an application by the closing date. Parents moving within England and Wales must have submitted an application by the closing date to have grounds for a late change of preference.

(5) The application form for the main intake years [SA1, SA2 and SA3], will ask

parents to provide the reasons for their late application if they feel there are exceptional circumstances and supporting evidence may be requested. If there are no exceptional circumstances, late or changed preferences will not be considered until after allocation decisions have been made.

(6) Even if there are exceptional circumstances, it will not be possible to consider

applications received or changed after:

until after the allocation decisions have been made. Any evidence requested to support the acceptance of a late application or change of preference will not be accepted after this date.

4. Completing the SA1, SA2, SA3 and SA8 application forms

(1) If a parent completes the application form in such a way that the ranking of two or more preferences is not clear, distance between home and school, measured by the nearest walking route by road, using the LA’s GIS mapping system, will be used to rank the preferences concerned. This system measures from the centre of the parental home to the nearest gate of the school. The nearest school will be regarded as the highest preference. The definition of “road” is that used by the LA’s GIS mapping system.

(2) If more than one form is received, and any earlier applications have not been

withdrawn in writing, the most recently dated application form [submitted by the closing date for SA1, SA2 and SA3] will be used. If forms are not dated or are dated on the same day, those schools where the order of preferences is not clear will be ranked as in 4(1) above.

5. Testing of Ability or Aptitude

(1) Where a selection test of any kind, ie for ability or aptitude, is part of the school’s admission arrangements, the admission authority for the school must make it clear to parents that, whilst they can be tested, they are required to express a preference for that school on the SA3 [Transfer to Secondary School application form] or SA8 [Request for admission to school] otherwise they will not have applied for a place.

6. Determining Offers in Response to the Common Application Forms, ie SA1,

SA2, SA3 and SA8

(1) All preferences will be considered equally. Where a parent is eligible for a place at more than one school, a place at the school given as the highest preference will be offered and the LA will refuse any outstanding lower preferences on behalf of the relevant admission authority.

(2) The LA will act as a clearing house for the allocation of places. The LA will only

make any decision with respect to the offer or refusal of a place in response to any preferences expressed on the application forms where:

• it is acting in its separate capacity as an admission authority, or • an applicant is eligible for a place at more than one school [see 6(1)

above]; or • an applicant is not eligible for a place at any school for which they have

expressed a preference. A place would only be offered at a VA/F school or academy if its admission number had not been reached in offering places to those parents who gave the school as one of their three preferences.

7. Parents Applying for a Place at a School Outside Cumbria

(1) Parents may express a preference for school[s] in another LA area (2) If a pupil would be eligible for a place at a Cumbrian school and a neighbouring

LA has also indicated that a place can be offered at one of its schools, the parents will be offered the place at the school which was ranked as their highest preference.

Note 1 The LA will notify VA/F schools and academies of all first preference applications which have been received for their school, together with any documentary evidence submitted by parents. If a school is oversubscribed, or close to being so, second and third preferences will also be notified in respect of those pupils whose parents may not be offered their first preference school. Where these preferences are passed on, the order of parents’ preferences will not be made known.

• During the liaison period with VA/F schools and academies, the Local Authority

will adjust the pupil lists to remove children who can be offered a higher preference school.

• If, as a result of adjusting allocation lists to accommodate those pupils who cannot be offered a higher preference, the cut-off point moves to a different category in a school’s admissions policy, further ranking of applications will be required. This information will be provided by the VA/F schools and academies within a week.

(2) In year admissions [casual]

A place will be offered within 20 school days of receipt of the completed SA8 by the Local Authority.

9. Where a Place is Not Available at the Parents’ Preferred Schools

(1) Where a child is not eligible for a place at any of their parents’ preferred schools,

they will be allocated a place at their catchment area school if a place is available or at the nearest Cumbrian school, measured by the nearest walking route by road using the LA’s GIS mapping system, with a place available. Unless a parent has expressed an interest in a Catholic education, a Catholic school would not be offered.

(2) If a school is identified as the alternative school for more pupils than there are

places available, the school’s oversubscription criteria will determine priority for a place.

10. Informing Parents of the Outcome of Their Application (1) The Local Authority will post a letter to all parents informing them of the outcome

of their application. This letter will be posted on: Main Intake: Reception Places [Infant/Primary] - 28 April 2011 Year 3 Places [Junior] - 28 April 2011 Year 7 Places [Secondary] - 1 March 2011 In year [casual] admissions: Within 20 school days of receipt of the application This letter will give the following information:

• the name of the school at which a place has been offered;

• in relation to VA/F schools and academies, that the offer is on behalf of the Governing Body;

• the reasons why the child has not been offered a place at the other schools which were given as a preference;

• contact details for the LA and any VA/F schools and academies where a place has not been offered;

• information about their statutory right of appeal against the decision to refuse a place at any school given as a higher preference;

• confirmation that the right of appeal is in relation to any school given as a preference and where a place has not been allocated, including those given as a lower preference than the school offered.

• confirmation that, in the re-allocation process [main intake], parents will be considered for any places that might become available in schools they ranked higher than the school they have been offered, and what to do if they wish to be considered for any vacancies beyond that point;

(2) The deadline for parents to accept the place offered is as follows:

Reception Places [Infant/Primary] 13 May 2011 Year 3 Places [Junior] 13 May 2011 Year 7 Places [Secondary] 15 March 2011 If parents do not respond by this date it will be deemed that they have accepted the place.

(3) For in year [casual] admissions the offer of a place will remain for a maximum of

6 school weeks [i.e., half a school term]. If the place has not been taken up within this time, it may be allocated to another child.

11. Re-allocating Places which are not Taken Up or Subsequently Become Vacant

(1) For the main intake the LA will re-allocate any places which have become vacant since allocation letters were sent out. This will take place on:

Reception Places [Infant/Primary] - 25 May 2011 Year 3 Places [Junior] - 25 May 2011 Year 7 Places [Secondary] - 24 March 2011

(2) Consideration will be given to all outstanding applicants, including any late ones. (3) Places will be re-allocated by applying the school’s oversubscription criteria.

Where the information is not already held, the LA will liaise with VA/F schools and academies regarding the ranking of outstanding applicants.

(4) During the course of the year as vacancies arise the LA will re-allocate the

places to those applicants on the school’s waiting list [if it holds one] in accordance with its oversubscription criteria.

12. Late Applications Submitted After the Main Intake Closing Dates

(1) Applications received by the LA after the main intake closing dates and where there are no exceptional circumstances, or after the dates specified at 3(6) even if there are exceptional circumstances, will only be considered after the allocation decisions have been made in paragraph 8.

(2) Where it is not possible to offer a place on the Offer Dates [Para 8] a place will

be offered as soon as possible thereafter. 13. Re-allocation Lists

(1) After the re-allocation dates at 11 above, the LA will continue to co-ordinate the allocation of places as in year admissions to all maintained schools and academies in its area.

(2) Waiting lists for schools will be kept by the relevant admission authority to the

end of the autumn term. 14. Applications Received After the Re-allocation Process and Other In Year

[Casual] Requests for Admission

(1) Applications received after the re-allocation process [see para 11] for the main intakes, and at any time for entry other than to the normal year of entry, will be treated as in year admissions. These applications should be made on Form SA8.

(2) Once any places have been re-allocated on the specified dates, all subsequent

applications must be made on Form SA8 “Request for admission to school” and

the completed form submitted to the LA. The LA will co-ordinate all admissions for all maintained schools and academies in its area.

(3) For all schools and academies which have been oversubscribed, the LA will

continue to re-allocate places up to the end of the autumn term in line with their published admission arrangements. Schools must, therefore, refer any parents who contact them to the LA.

(4) On an ongoing basis applicants with in year requests for places must complete

Form SA8. Parents may contact schools direct but it will not be possible to offer a place without the need for a formal application submitted to the LA.

(5) Upon receipt of Form SA8 the LA will

a. For community and voluntary controlled schools determine whether a place

can be offered or b. For voluntary aided schools, foundation schools and academies, after

consulting the respective admission authorities will either confirm the offer of a place or give notice to refuse. A copy of the refusal letter will be forwarded to the relevant school/academy.

(6) If any parent approaches a VA/F school or academy directly about an in year

admission, the Governing Body must advise the parent to complete a Form SA8 and submit this to the LA.

(7) Where the LA receives an SA8 direct from a parent giving a VA/F school or

academy as their first preference or in pursuing alternative preferences where higher preferences have been refused the Governing Body will make a determination regarding the application and advise the LA. The LA will formally notify the applicant of the decision.

(8) All parents who are refused admission will be offered a right of appeal.

Information about the appeals process will be provided by the LA in the refusal letter.

(9) The LA will keep track of any pupils who apply for in year admission, and

intervene as appropriate to ensure that they are placed in a school without undue delay.

These are the 2011/2012 admission arrangements for community and voluntary controlled primary and secondary schools, ie those schools where the Local Authority [LA] is the admission authority

2. Co-ordinated Admission Arrangements

In line with current legislation, the LA has drawn up a scheme to co-ordinate admissions to the September 2011 main intake groups of Cumbrian primary and secondary schools. These are in line with the co-ordinated admissions schemes.

3. Published Admission Numbers

The admission number the LA will publish for each community and voluntary controlled school is shown in Appendix 1(A).

4. The General Admissions Policy for 2011/2012

The General Admissions Policy will be used to allocate places at those schools which are oversubscribed. This is attached as Appendix 1(B).

5. Address to be Used in Determining Priority for Admission

If a school is oversubscribed, the address of the parent with whom the child normally lives will be used in the allocation process. Where a child’s address is difficult to determine, for example where shared living arrangements are in place, the address of the parent claiming child benefit will be used.

6. The Admissions Timetable The timetable for the September 2011 application and allocation processes will be in line with the co-ordinated admissions schemes.

7. Late Applications For oversubscribed schools, applications which are received or changed after the closing date will only be considered in exceptional circumstances. This is only likely to be where a family has moved into the area and was, therefore, unable to submit an application by the closing date. Even if there are exceptional circumstances, applications submitted after the date in the relevant co-ordinated admissions scheme to mark the final stages of the allocation process will not be considered until after allocations have been made. Any evidence submitted after this date to support a late application or change of preference will not be considered.

8. Waiting Lists In the main allocation process, once places have been allocated, children refused a place will continue to be considered for any vacancies which become available up until the end of the autumn term. The admissions policy will be applied to all outstanding applicants, including any late ones, to determine priority for the allocation of any vacancies. If parents wish their child to be considered for any vacancies after the autumn term, they should contact the School Admissions Team early in December to place their child’s name on a waiting list. The above is the process for the normal admissions round. Parents can at any time ask for their child’s name to be placed on the waiting list for other year groups. Vacancies will always be allocated by applying the admissions policy and length of time on the waiting list will not be a consideration.

9. Deferred Entry to Infant/Primary Schools

If a child who has not reached statutory school age has been allocated a Reception place and their parent wishes to delay their child’s entry to school, the place will be held open. The place must be taken up once the child reaches statutory school age, but by the start of the summer term 2012 at the latest. It would not be held open beyond the beginning of the summer term and would, at that point, be available for another applicant.

10. Admissions to Nursery Schools and Infant/Primary Schools Offering Nursery Education

These arrangements do not apply to the admission of nursery pupils. The nursery admission arrangements will be determined separately. Attendance at a school’s nursery does not guarantee admission to the school’s Reception group nor is it a factor in allocating places.

11. Admission to School Sixth Forms

These arrangements do not apply to the admission of students to school sixth forms. These arrangements are to be determined separately.

12. Catchment Areas

Cumbria County Council operates a ‘catchment area’ approach to school admissions. Each school has a defined catchment area. Details of the arrangements for each school can be made available on request.

Where there are more applications than places available at a community or voluntary controlled school, applications will be prioritised using the criteria below. They will be applied in conjunction with explanatory notes 1 - 6 which form part of the policy. 1. Children looked after, ie in public care, giving priority, if necessary, to the youngest

child(ren) - see note 1 overleaf. 2. Children living in the catchment area who have brothers or sisters in the school (or

associated infant or junior school) at the time of their admission - see notes 2 and 3 overleaf.

3. Children living outside the catchment area who, at the time of their admission, have

brothers or sisters in the school (or associated infant or junior school) who were directed to that school by the Local Authority either (a) in the absence of a place being available in the catchment area school due to oversubscription and the school was identified by the Local Authority as the next nearest with a place available or (b) in their Statement of Special Educational Need - see notes 2, 3 and 4 overleaf.

4. In relation to Church of England Voluntary Controlled Schools, children living in the

catchment area with a parent/carer who regularly worships at a C of E Church. - see note 5 overleaf.

5. Other children living in the catchment area giving priority to those living closest to the

school, measured by the shortest walking route by road - see notes 6 overleaf. 6. Children living outside the catchment area who have brothers or sisters in the school

(or associated infant or junior school) at the time of their admission - see notes 2 and 3 overleaf.

7. In relation to Church of England Voluntary Controlled schools, children living outside

the catchment area with a parent/carer who regularly worships at a C of E church. - see note 5 overleaf.

8. Children living outside the catchment area, giving priority to those who live closest to

An exception will be made under the Authority's policy for the education of children with special needs (i) where a child holds a Statement of Special Educational Needs, or (ii) is currently undergoing a statutory assessment, and in either case it is considered that attendance at a particular school is necessary to meet the identified needs of that child;

This will also be the case in relation to twins, etc. Note 3 Where reference is made to associated infant and junior schools this is to describe those situations where infant and junior schools share the same catchment area. Note 4 If parents/carers believe they qualify for consideration under criterion 3, they should indicate this on their preference form in the place provided for this purpose. In relation to a child with a Statement of Special Educational Need, the Statement must state that the child is directed by the Local Authority to attend a particular school which is necessary to meet his or her identified needs. Proposed co-ordinated admission arrangements 2011/2012 As I hope you are aware the Local Authority is required to consult on its proposals for the co-ordination of school admission arrangements. I have enclosed a copy of the proposed scheme for 2011/2012. This scheme was considered and agreed by the Cumbria School Admissions Forum for the purpose of consultation at its meeting held on 21 September 2009. The document is the scheme agreed for 2010/2011 with the following proposed amendments: a) The timetable for the required actions has been updated to reflect the new year and

the requirements of the School Admissions Code; b) Section 4(1) on page 4 has been amended to meet the requirements of the School

Admissions Code. This required that ‘…the points at the school and the child’s home from which distance is measured’ are made specific where the distance from home to school is used as a criterion for the allocation of school places, where a school is oversubscribed;

c) To meet the new requirements for local authorities to co-ordinate ‘in year’ applications for school places from the 2010/2011 academic year.

The School Admissions Code requires that consultation should last for a minimum period of 8 weeks between 1 November 2009 and 1 March 2010. I have chosen to start the process of consultation early because I also wish to consult with you on the ‘in year’ arrangements for 2010/2011 (see below). I would be pleased to receive your comments on the proposed co-ordinated admission arrangements for 2011/2012 by no later than 31 December 2009.

B. Amendments to the agreed co-ordinated admission arrangements 2010/2011 The School Admissions Code also requires local authorities to formulate a scheme for the co-ordination of all ‘in year’ admissions for the 2010/2011 academic year. You will be aware that the Admissions Scheme for 2010/2011 has been agreed. This now needs to be amended to provide for the co-ordination of ‘in year’ admissions. The attached proposed scheme for 2011/2012 is, apart from the changes to the timetable for actions, the scheme for 2010/2011, revised to provide for the co-ordination of ‘in year’ admissions. I would, therefore, like to use this document also as the basis for consultation on the proposed arrangements for the co-ordination of ‘in year’ admissions for 2010/2011. This document has also been considered and agreed by the Cumbria School Admissions Forum for consultation. Again, I would be pleased to receive any comments you wish to make on the proposals by 31 December 2009. C. Proposed admission arrangements for community and voluntary controlled

It is, therefore, responsible for determining the admission arrangements to these schools including admission limits and oversubscription criteria. The School Admissions Code (February 2009) recommends that trade unions representing staff employed at those schools where it proposed to increase the admissions number should be consulted. On this basis I have attached a copy of the proposed arrangements for 2011 – 2012. I have detailed below details of those schools where it is proposed to increase the admission limit from September 2011. I would be pleased to receive your comments on the proposed arrangements by no later than 1 March 2010. You may wish to note that information on the proposed co-ordinated admissions arrangements has been posted on the Children’s Services website. In addition a number of governing bodies for those schools that are their own admissions authority have also posted their proposals for the admission of pupils for 2011 – 2012 on the same website.
