Legal Framework
• Disability
– So-called “positive discrimination” is not unlawful under the DDA, whereas, generally, it is under other anti-discrimination legislation. The DDA does not make it unlawful to provide more favourable treatment to a disabled person than is provided to a non-disabled person
– The Act does make it unlawful to provide less favourable treatment to a disabled person for a reason related to that person’s disability. It also contains provisions that require the alleged discriminator to make reasonable adjustments
– Impact of the Local Government and Housing Act • Every appointment of a person to a paid office or
employment must be made on merit.
