Commissioner Sanders updated the Board on the progress regarding a County auction for the sale of surplus equipment. Sanders will explore the possibility of having an online company handle the auction.

County Attorney Paul Schaub discussed with the Board the determination of the fair market value and recommendation to sell the property described as Lots 9 and 10, Block “I”, Nelson’s Second Addition to Gurley, Cheyenne County, Nebraska. Bernice Russell was present for this discussion. At the April 2, 2018 meeting, the Board set the fair market value of the subject prop-erty at $3,000.00. County Attorney Schaub reported that there was an issue with the publication of the notice so it is necessary to set the fair market value at this time. A motion was made by Miller, seconded by Sanders to set the fair market value of Lots 9 and 10, Block “I”, Nelson’s Second Addition to Gurley, Cheyenne County, Nebraska at $3,000 and direct County Attorney Schaub to proceed with the sale. Roll Call: Aye: Johnson, Miller, Sanders. Nay: None.

ounty Treasurer Diane Scott reported on the pledged securities of the County. A motion was made by Sanders, second-ed by Miller to approve the pledged securities report as presented. Roll Call: Aye: Miller, Sanders, Johnson. Nay: None.

At 8:10 A.M., a motion was made by Sanders, seconded by Miller to recess the Board of Commissioners and reconvene as the Board of Equalization. Roll Call: Aye: Sanders, Johnson, Miller. Nay: None.

Sybil Prosser, County Assessor, presented a tax list correction for the tax year 2018 for Antelope Energy Company LLC. This correction pertains to an improvement on leased land royalty interest locat-ed on Federal land. In the past, this property has been exempt; however, a tax statement was issued. A motion was made by Miller, seconded by Sanders to approve the tax list correc-tion to change the royalty interest to tax exempt. Roll Call: Aye: Johnson, Miller, Sanders. Nay: None.

The Board next con-sidered settlement pro-posals in pending cases before the Tax Equalization and Review Commission (TERC). County Attorney Schaub stated that there are currently several cases scheduled to be heard before TERC in early June. He went on to state that there was a procedure in place to allow the parties to reach a settlement of the cases.

The first case is TERC Case No. 17R 0016 Cheema Investments, LLC. After meeting with the County Assessor, the County Attorney recommended no change in value.

The next case involved TERC Case No. 17A 0049 Ronald D. Studnicka. The County Attorney again met with the Assessor and it was the recommendation of the County Attorney and Assessor to adopt the tax-payers proposed valuation of $34,826.00. A motion was made by Miller, sec-onded by Sanders to adopt the taxpayers proposed valuation of 34,826.00 in TERC Case No. 17A 0049 Ronald D. Studnicka. Roll Call: Aye: Miller, Sanders, Johnson. Nay: None.

The Board then reviewed TERC Case No. 17A 0054

and Case No. 17A 0055 both involving Cabelas, Inc. County Attorney Schaub explained that the County hired Stanard Appraisals to assist in appraisals of the properties. After meet-ing with the Assessor, it was the recommendation of the County Attorney and Assessor in Case No. 17A 0055 to value the property at $561,506.00. A motion was made by Sanders, sec-onded by Johnson to accept the recommendation of the County Attorney and County Assessor to value the property described in TERC Case No. 17A 0055 at $561,506.00. Roll Call: Aye: Sanders, Johnson. Nay: None. Abstain Miller.

After meeting with the Assessor, it was the recom-mendation of the County Attorney and County Assessor in Case No. 17A 0054 to value the prop-erty at $538,486.00. A motion was then made by Sanders, seconded by Johnson to accept the recommendation of the County Attorney and County Assessor to value the property described in TERC 17A 0054 at $538,486.00. Roll Call: Aye: Johnson, Sanders. Nay: None. Abstain: Miller.

The next two cases to be reviewed were TERC Case Nos. 17C 0092 and 17C 0093. The properties again were inspected by Stanard Appraisals. After a discussion, a motion was made by Sanders, second-ed by Johnson to accept the recommendation of the County Attorney and County Assessor in TERC Case No. 17C 0093 and value the subject property at $3,825,800.00. Roll Call: Aye: Sanders, Johnson. Nay: None. Abstain: Miller.

Finally, TERC Case No. 17C 0092 was reviewed. After comments from County Attorney Schaub and County Assessor Prosser, a motion was made by Sanders, sec-onded by Johnson to accept the recommenda-tion of the County Attorney and County Assessor in Case No. 17C 0092 and value the property at $2,550,000.00. Roll Call: Aye: Johnson, Sanders. Nay: None. Abstain: Miller.

At 8:45 A.M., a motion was made by Miller, sec-onded by Sanders to adjourn the Board of Equalization and recon-vene as the Board of Commissioners. Roll Call: Aye: Miller, Sanders, Johnson. Nay: None.

Cris Burks, County Weed Superintendent, updated the Board on weed spraying activities in the County. The fairgrounds and county shop proper-ties have been sprayed. The possibility of spraying the weed building, Visitors Center, Probation Office and County Annex building was discussed. It was the decision of the Board to spray the entire lot at the weed building and to spray the back alley and along the fence at the County Annex building. It was not necessary to spray the Probation Office property or at the Visitors Center.

The next item to be discussed was the partici-pation in the High Plains Weed Management asso-ciation. It was the decision of the Board to no longer participate in the associa-tion.

The Board addressed the possibility of pur-chasing common mullein moths to assist in the con-trol of common mullein. A

motion was made by Miller, seconded by Sanders to appropriate $1,000.00 for the purchase of common mullein moths. Roll Call: Aye: Sanders, Johnson, Miller. Nay: None.

At 9:05 A.M., Chairman Johnson declared the pub-lic hearing open to review and consider approval of an application from Paul Schadegg to replat a part of Schadegg Subdivision located in part of the East Half of the Northwest Quarter of Section 35, Township 13 North, Range 50 West of the 6th P.M., Cheyenne County, Nebraska. The subdivi-sion known as Replat of Schadegg Subdivision will contain 7.27 acres, more or less. Also considered was an application to change zoning from Agricultural to Residential Estate. Colleen Terman, Planning and Zoning Administrator, was present. Ms. Terman informed the Board that all documents were in order. On March 26, 2018, the Planning and Zoning Commission met and approved the applications and recommended they be forwarded to the County Commissioners for approv-al. A motion was made by Sanders, seconded by Miller to adopt Resolution 2018-13 approving the subdivision and rezoning applications as presented. Roll Call: Aye: Johnson, Miller, Sanders. Nay: None. A complete copy of the Resolution as adopted is on file at the Office of the County Clerk.

At 9:14 A.M., Chairman Johnson declared the pub-lic hearing closed.

The discussion regard-ing the proposed rates for continued coverage through Blue Cross Blue Shield for the employee health insurance program was tabled until later in the meeting.

At 9:15 A.M., Chairman Johnson declared the pub-lic hearing open to review and consider approval of the One and Six Year Road Improvement Plan.

Highway Superintendent Hart explained the One and Six Year Road Improvement Plan. There was a discus-sion. There were no mem-bers of the public present and no objections were heard. A motion was made by Sanders, seconded by Miller to adopt Resolution

2018-14 approving the One and Six Year Road Improvement Plan as reviewed. Roll Call: Aye: Miller, Sanders, Johnson. Nay: None. A complete copy of the Resolution as adopted is on file at the Office of the County Clerk.

Superintendent Hart then updated the Board on road activities.

The Board considered approval of a proposed Agreement with the State of Nebraska Department of Roads regarding the Gurley East Defense Access Road Program. Heather Hausmann, Tourism Director, updat-ed the Board on tourism activities. Hal Enevoldsen, Judy Harris, Steve Wolfe and Brooke DeNovellis were present.

Jade Boyles represent-ing Husker Steel, appeared before the Board to explain the business program for Husker Steel.

Paul Schaub, County Attorney, addressed the Board regarding the approval of proposed changes to the Cheyenne County Emergency Communications Center Interlocal Agreement (Consolidation of services with Deuel County). The purpose of the changes to the Interlocal Agreement was to include Deuel County in a consolidated communications center with Cheyenne County and the City of Sidney. The Communications Authority Board, the Deuel County Commissioners and the City of Sidney Council have approved the revisions as proposed. According to the Agreement, the financial participation of the City of Sidney will be 61.75%, Cheyenne County will be 33.25% and Deuel County will contribute the remain-ing 5%. The participation fees will be figured on the monthly expenses after application of incomes from other sources. These percentages will remain in effect for the first 2 budget years of this Agreement. Thereafter, the parties to this Agreement may adjust that obligation amount and consider adding a Deuel County resident as a voting member of the Authority Board. Communications Center Director Heidi Gillespie informed the Board that there would be no need for added per-sonnel or equipment. A motion was made by Miller, seconded by Sanders to approve the Cheyenne County Emergency Communications Center Interlocal Cooperation Agreement as proposed. Roll Call: Aye: Sanders, Johnson, Miller. Nay: None.

The Board then con-sidered the approval of a proposed Addendum to the Ambulance Agreement with Regional West Medical Center to extend the annual effective date. The effective date of the cur-rent Agreement is July 1, 2018 and the proposed Addendum will extend the date to August 1, 2018 to allow for the study of different options. Paul Hofmeister was present for this discussion. A motion was made by Sanders, seconded by Miller to approve the Addendum to the Ambulance Agreement with Regional West Medical Center to extend the effec-tive date of the Agreement from July 1, 2018 to August 1, 2018 as proposed. The Sidney Housing Authority in Sidney, NE has determined that the project will have no signifi-cant impact on the human environment. PUBLIC COMMENTS Any individual, group

or agency may submit written comments on the ERR to the Chief Executive Officer, Sidney Housing Authority. RELEASE OF FUNDSThe Sidney Housing

Authority certifies to the Department that Nancy Bentley, in her capacity as Chief Executive Officer con-sents to accept the juris-diction of the federal courts if an action is brought to enforce responsibilities in relation to the environmen-tal review process and that these responsibilities have been satisfied. The State of Nebraska’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Sidney Housing Authority to use HUD program funds.

OBJECTIONS TO RELEASE OF FUNDS

The State of Nebraska will accept objections to its release of funds and the Sidney Housing Authority certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichev-er is later) only if it is on one of the following basis: (a) the certification was not executed by the Certifying Officer of the Sidney Housing Authority; or (b) the Sidney Housing Authority has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; or (c) the grant recipient or other participants in the devel-opment process have com-mitted funds, incurred costs or undertaken activi-ties not authorized by 24 CFR Part 58 before approv-al of a release of funds by the DED; or (d) another Federal agency acting pur-suant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmen-tal quality. Objections must be prepared and submit-ted in accordance with the required procedure (24 CFR Part 58, Sec.58.76) and shall be addressed to the Department of Economic Development administration office at Nebraska Department of
