What happened?OnMarch2,20**theKetkluanehighSchooltigersplayedinthebasketballleaguechampionshipgameagainsttheBjorkbellhighSchoolBulldogs.thegamewasplayedintheKetkluanehighgymnasium,andmanyoftheschool’sstudentsturnedouttosupporttheirteam.

afteraslowstart,theKetkluanetigerscamefrombehindandtiedthegameatthefinalbuzzer.Withthecrowdcheeringthemon,theKetkluanetigerstri-umphed–forthethirdyearinarow-asMarcusFadeysunkthewinningthreepointshotinthelastfewsecondsofovertime.

afterthisspectacularwin,thecrowdstreamedontocourttocongratulatetheplayers.ashadbecomeatraditionoverthelastcoupleofyears,theplayers(in-cludingMarcus)andsomeenthusiasticcrowdmembershelpedemptythewatercoolerovertheircoach’shead.

eventhoughhehadbeendistractedbytherecentbreakupwithhisex-girlfriend,Lakiarami,Marcuswasthrilledwiththiswin.therehadbeenscoutsfromatleasttwoamericanuniversitiesinthestands,andhehadplayedthebestgameofhiscareer.plus,hewashappytohavebeatentheBjorkbellhighteam,becausetheteamcaptainwashisoldfriendYasirpatelwhohadrecentlystartedseeingMar-cus’sex-girlfriend,Lakia.

afterthegame,inthechangeroom,theteamdecidedtogooutfordinner.Mar-cusdecidedtocatchupwiththemabitlaterbecausehewantedtospeakwithLakia.heheardfromoneofherfriendsthatshewasinthestandsduringthegame,andwashavingsecondthoughtsaboutbreakingupwithhim.

Shortlyafter8pm,Marcuswalkedfromthechangeroomintothenowemptygym.hecalledLakiaonhisnewiphone,andpacedaroundthegymasthecon-versationbecamequiteintense.heglancedoverwhenheheardanoiseatthechangeroomdoor,andsawYasirpatelenterthegym.Yasirwaslookingforajerseyhehadleftbehind,butsoonrealisedthatMarcuswasonthephonewithLakia.

“hey!areyoutalkingtoLakia?!”Yasiryelledfromacrossthegym.“Yeah,doyouhaveaproblemwiththat?!”Marcusyelledinresponse.Stillonthephone,eyesfixedonYasir,MarcusstartedwalkingacrossthegymtowhereYasirwasstand-ing.Marcusdidn’tnoticethewaterpuddleleftoverfromemptyingthewatercooleronthecoach.BeforehereachedYasir,heslippedandfell.

• $20,000forlossofopportunityofabasketballscholarship;

• $10,000forlostwagesduetoinabilitytoperformtherequireddutiesofhisemployment;

• $400forthedamagetohisiphone;

• Generaldamagesforpainandsufferingandlossofenjoymentofliferesultingfromtheinjuryitselfandthesideeffectsofthemedicationprescribedforthesameinjury.

the laWwhaT is NegligeNce?“Negligence”isconductthatfallsshortofwhatareasonablepersonwoulddotoprotectanotherpersonfromharm.ifaninjuredpersonprovesthatanotherper-sonactednegligentlytocausehisinjury,hecanrecoverdamagesforhislosses.theinjuredplaintiffmaybecompensatedforharmtohisbody,property,mentalwell-being,financialstatus,orintimaterelationships.

Negligencesuitsareanalyzedinstages,calledelements.theelementsthatmustbeestablishedineverynegligencecaseare:dutyofcare,standardofcare,causa-tion,anddamages.eachelementisdefinedandexplainedbelow.

(1) duty of cAreadutyiswhenapersonisunderalegalobligationtoexercisecareforanotherperson.thecourtmustdetermineifthedefendanthadalegalobligationtoshowcaretowardtheplaintiff.

thereisatwo-parttesttoanswerthisquestion:

1. couldthedefendanthavepredictedthatthisparticularpersonwouldbeinjured;and

2. wasthereariskthatthedefendantshouldhavebeenawareof?

(2) stAndArd of cArethecourtmustdetermineifthedefendantactedasareasonablepersonwouldinsimilarcircumstances.

(3) ProximAte cAuseproximatecausereferstothefactthatthewrongdoer’sfailuretomeetthestan-dardofcaremustbetheactualcauseoftheplaintiff’sloss.Foradefendanttobeheldliable,itmustbeshownthattheactsoromissions(failuretoact)ofthedefendantwerethecauseofthelossordamagesuffered.therefore,ifthewrong-doerdidnotmeetthestandardofcare,butthelosswascausedbysomethingotherthanthewrongdoer’sactions,thenegligenceclaimwillbeunsuccessful.

haveactuallyexperiencedsomesortofloss.ifthewrongdoerfailedtoliveuptothestandardofcarethatwasowed,butnolossresultedfromthoseactions,thennodamageswillbeawarded.

exaMple:

Aneela was in charge of her daughter’s carpool on Tuesdays. Aneela drove her daughter, plus two other children to school, including their neighbour Inna’s son, Felix.

One Tuesday, Aneela was extremely tired from staying up all night working the night before, but she decided that she was still fine to carpool the children to school. While driving with the three children, Aneela dozed off and hit the car in front of her. The accident was very minor and none of the passengers in either car were injured. Aneela pulled over and safely parked on the side of the road to wait for the other parents to pick up their children.

While Aneela and the kids were seated in their parked car, another driver, David, was driving down the street. David had spent most of the night at a local pub where he consumed a large amount of alcohol. David saw Aneela’s parked car, but he could not react fast enough to change lanes and he hit Aneela’s car. All of the passengers suffered minor injuries, except Inna’s son, Felix, who suffered a broken arm.

Inna wants to bring a negligence claim against Aneela, on behalf of Felix. She wants compensation from Aneela for Felix’s broken arm.

Duty of Care:asthedriverofthecarpool,aneelaowedthechildreninthecaradutytodrivesafely.

A Failure to Meet the Standard of Care:areasonablepersonwhohadstayedawaketheentirenightbeforethecarpoolandwas“extremelytired”wouldnothavedriventhechildrentoschool.thereasonablestandardofcareinthiscircum-stanceisforthedrivertobeadequatelyalertwhendrivingthecarpool.Some-onewhostaysawakeallnightisnotsufficientlyalerttodrivechildrentoschool.therefore,aneelafailedtomeetthestandardofcareowedtothechildren.

Proximate Cause:althoughaneelafailedtomeetthestandardofcare,theac-cidentthatshecauseddidnotcauseFelix’sinjuries.aneela’saccidentwasminorandallofthechildrenweresafeinthecaraftertheaccident.therefore,aneela’sactionswerenotaproximatecauseofFelix’sinjuries.

Conclusion:inna’snegligenceclaimagainstaneelaforFelix’sbrokenarmisun-likelytobesuccessfulbecauseFelix’sinjurieswerearesultofDavid’sactions,notaneela’sactions.innawouldprobablybemoresuccessfulifsheadvancedanegli-genceclaimagainstDavidforcausingFelix’sbrokenarm.

DefeNces To NegligeNce

contributory negligence • Onepossibledefenceavailabletoadefendantistoarguethattheplaintiff

wascontributorilynegligent.thatis,thattheplaintiffispartiallyresponsibleforwhathappened.

• canadianlawallowsthecourttodivideresponsibilityfordamages,mak-ingeachpersonwhocontributedtotheharmresponsibleforonlyhisorhershare.

• Basically,thismeansthatthedefendantcanarguethattheplaintiffmighthavedonesomethinghimselftocontributetotheinjury,whichmadeitworsethanitwouldhavebeenotherwise.

Whenthisoccurs,theplaintiffcannotsuefordamagesfortheportionofthein-jurythathecaused.

3.theDefendant,KetkluanehighSchool,isapublichighschoolintheOntarioBoardofeducation.itislocatedat123MainStreetinthecityofanytownintheprovinceofOntario.

The Slip and Fall4.OnMarch2nd,20XX,atapproximately7:30pm,theplaintiffandhisteam-matesfromKetkluanehighSchool,wonabasketballchampionshipgameinthelastsecondsofovertime.

5.therewerescoutspresentatthischampionshipgame,atleasttwoofwhomhadalreadybeenincontactwiththeplaintiffaboutapotentialuniversityschol-arship.

10. WhilehewasspeakingtoMs.rami,Marcuswasconfrontedinthegymna-siumbyarivalplayerfromtheSouthValleyBulldogsteam,Yasirpatel.Yasirpatelisaformerfriendoftheplaintiff’swhowasdatingMs.ramiatthetime.

11. uponrealizingthattheplaintiffwastalkingtoMs.rami,Mr.patelbecamequiteupset.theplaintiffandMr.patelexchangedwordsandwhentheplaintiffapproachedMr.patel,heunexpectedlyslippedandfellonapuddleofwateronthegymnasiumfloor.

12. ashewasfalling,theplaintiffputouthishandtobreakhisfall,landingawkwardlyonhiswrist,andshatteringit.

13. theplaintiffwasunabletofullycushiontheblowofthisunexpectedfalland,asaresult,hithisheadonthegymnasiumfloor.helostconsciousnesstemporarilyandhadtobetakentothehospitalbyhisparents,whowerewait-ingoutsideoftheschool.asaresultofthefall,hesufferedabrokenwristandrequiredemergencysurgery.hewaslaterdiagnosedwithamildconcussionandprescribedafewdaysofbedrest.

14. inaddition,theiphoneintowhichtheplaintiffwasspeakingatthetimeofhisfalllandedinthepuddlebeneathhimandwascrushedanddestroyedirrepa-rably.

15. theplaintiffdoesnotrecallanywarningsofthehazardouspuddle.

Cause of Action16. asan“occupier”undertheOccupier’s Liability Act,Ketkluanehadadutytotakereasonablestepstoensurethatpersonsonitspremisesweresafe.

f. failingtoerectsignsorprovidetheplaintiffswithsufficientwarningwithrespecttotheconditionsofthepremises;

g. failingtoprovideadequatetrainingtoemployeesregardingcleanlinessandsafety.

19. theDefendantanditsemployeeskneworoughttohaveknownthatwa-terleftonthefloorofthegymnasiumaislewasdangerousforcustomers.

25. atthetimeoftheaccident,theplaintiffwasalsoanemployeeoftherealcanadaconstructioncompanynearKetkluanehighSchool.Followingtheextensiveinjurytohiswrist,Marcuswasunabletoengageintheheavyliftingre-quired,norcouldheoperatethesitemachinery.assuch,hewasreleasedfromhisposition.

26. Duetothepainfromhisinjury,hisextensivephysicaltherapyandtheemotionalsetbacksresultingfromthewithdrawalofhisscholarshipoffers,theplaintiffhasonlyrecentlybeenabletofindthetimeorenergytopursuealter-nateemployment.

27. Oneyearafterthefall,Marcuscontinuestoexhibitsymptomsincludingpainintheinjuredwrist,numbness,headaches,andwithdrawnaffect.
