Welcome message by the Director General of the Civil Aviation Directorate of the Republic of Serbia It is my pleasure to acquaint you with the operating results of the Civil Aviation Directorate of the Republic of Serbia in 2009. The year behind us was very successful and an incentive for the time ahead. I will single out only the most important aspects. - We maintained the grounds for safe and secure air transport in accordance with regulatory requirements, while applying international standards in this domain. - Safety and security of air transport, on the ground and in the air, has been and remained our chief operating priority. In connection therewith, we have intensified oversight in respect of all air transport participants, insisting on stringent adherence to the adopted European standards that guarantee safety and security. - We have been actively adapting our national legislation vis-à-vis European aviation regulations. More than 50 regulations, decisions and orders necessary for the efficient regulation of air transport in Serbia were adopted. - We have actively participated in the work of the most important forums where the tasks for the enhancement of the European and world aviation authorities were formulated. - Accelerated development of air transport and the introduction of new global standards in this domain prompted in the past years, as well as in 2009, adaptation to changes and efficiency. That implied continual staff education and training as the prerequisite for a successful aviation authority of any state - and therefore the Republic of Serbia as well. We have systematically and methodically provided our staff with additional knowledge and skills which is one of the priorities of a modern transport policy. Qualified staff and dedicated professionals are the guarantee of success of a modern aviation authority. And that is also our motto. - By means of ratifying the ECAA Agreement (Multilateral Agreement on the Establishment of a European Common Aviation Area) in the National Assembly of the Republic of Serbia and its application that started in the second half of year 2009, we have opened our sky to new air carriers and catered for the introduction of new air transport routes. Thus we have enabled for Serbia an even better link to the world. - As a responsible aviation authority which takes care of the development of aviation market in its country, towards the end of the last year, the Civil Aviation Directorate invited the best low-cost airlines to come to Serbia. We have presented our potential, the conditions for obtaining licenses and, above all, our readiness to also develop this modality of cheaper air transport which nowadays, in times of global economic crisis, thrives as the most convenient for passengers. - We have been fervent in providing information of public interest to all interested parties both in the country and abroad. We have established excellent cooperation with media in Serbia which was one of our main communication patterns in the course of informing the users of the CAD services and general public on all the novelties in civil aviation.

It is with pleasure that I can say that some European analyses showed that, in the times of global economic crisis which affected also civil aviation, it is only in the Republic of Serbia and Turkey, out of the whole Europe, where the increase in air transport volume was identified. This data which is extremely important for our transport policy, tourism and economy on the whole represents also an obligation for us to, while developing air transport, enhance also safety and security measures which remain our chief operating priority. In this report, I would also like to point out some of numerous challenges that are on the agenda of the CAD for the upcoming period: - Resumption of European integrations – the prerequisite to this end is to fulfill the commitments arising from the ECAA Agreement (Multilateral Agreement on the Establishment of a European Common Aviation Area) i.e. harmonization of national legislation with the European aviation regulatory requirements - Standardization of the entire civil aviation system of the Republic of Serbia - Preservation of standards achieved and their continual enhancement - Active approach to the development of the new Air Transport Law of the Republic of Serbia - Our aim to remain a safe, secure and efficient aviation authority in the region, whole Europe and worldwide. I am confident that the future challenges will offer the opportunity to prove our commitment in the endeavor to maintain the highest European standards in civil aviation. In 2010, Serbian civil aviation celebrates its 100th anniversary. This important jubilee is what all employees in the Civil Aviation Directorate are particularly proud of but also a figure that implies even greater responsibility to persevere in our work and justify the respect that, on grounds of our values, we hold in the eyes of our colleagues from Europe and the whole world. Those are – knowledge, team work, efficiency, readiness to remedy deficiencies and introduce the highest standards that list us among the best aeronautical authorities in the world. They are at the same time parameters that contributed to our good results in the year 2009. Safety oversight The Civil Aviation Directorate of the Republic of Serbia was responsible for the safety oversight activities which included: drafting of regulations, adopting of programmes for aviation personnel training, establishing of requirements for training organizations, certifying competencies of aviation personnel, granting AOCs, certifying aeromedical centres, aerodrome, airfield and strip inspections for certification purposes, carrying out inspections of operators and air services provider, design, manufacture and maintenance, fuel supply and the state of aircraft.

As part of its responsibilities CAD RS performed its regulatory supervision over the application of laws, regulations and rules relating to inspection, certification of compliance with the requirements to be met in order to perform operations, and implementation of the Quality System. Safety assessment of foreign aircraft (SAFA) had been carried out under the international agreement (Agreement between the Republic of Serbia and EASA on transfer of SAFA information between JAA and EASA and provision of new data to EASA on SAFA inspections carried out in the Republic of Serbia) and accepted SAFA standards (Programme for Safety Assessment of Foreign Aircraft). CAD RS maintained a high level of safety and security applying European standards through regular and ad-hoc inspections in 2009.

A total of 53 additional reviews and evaluations of medical fitness for aviation personnel who had been suspended or found unfit by the AMES had also been performed. In November 2009 a team of experts was sent by the International Civil Aviation Organization (ICAO) to examine the civil aviation system of the Republic of Serbia. The team members made favourable findings. In their preliminary report, among other things, the organization and structure of CAD RS, qualifications of inspectors, licensing and certification activities and inspection procedures were found particularly commendable. The ICAO team of experts also mentioned in the preliminary report that around 68% of international aviation standards had been applied by CAD RS, which in their opinion was one of the better results in the world. What is most important is that the safety and security standards have been fully implemented.

Administrative and professional activities In the course of the last year, CAD RS team of experts performed inspections and audits upon which licenses, permits, approvals, and certificates were issued: Certificates Noise, simulator and aerodrome air traffic control, MTOWs, RVSM, TCAS, etc. - Certificate of airworthiness (initial, ad-hoc and annual checks; issuance of airworthiness certificates and certificates of registration; additional appropriate documentation at inspector’s request, the purpose of the flight, etc.)

International affairs and European integrations

The activities of the Civil Aviation Directorate of the Republic of Serbia in the domain of international relations and integrations are directed towards: - Cooperation with the European Union in the domain of air transport (European integrations); - Cooperation with international aviation organizations and other forms of multilateral cooperation; - Bilateral cooperation; - Flight permissions.

• Cooperation with the European Union in the domain of air transport (European integrations) ECAA Agreement The legal basis for the integration of the Republic of Serbia into the European Union in the domain of air transport is “Multilateral Agreement on the Establishment of a European Common Aviation Area” (the ECAA Agreement). The National Assembly adopted, at its session held on 13 May 2009, the Law on the Ratification of the ECAA Agreement which was published in “Official Gazette of the Republic of Serbia, No 38/09”.The agreement foresees full harmonization of national regulations with the regulatory requirements of the European Community in the areas of aviation safety, security, air traffic management, airport operations, consumer protection and liberalization of aviation market, state aid and environmental protection.With the aim of proper implementation of the ECAA Agreement, the Civil Aviation Directorate of the Republic of Serbia acts as the focal point in cooperation with the European Commission. The initial step towards European integrations in the domain of air transport was marked by the conclusion of the Agreement between the European Community and Serbia and Montenegro on certain aspects of air services (the Horizontal Agreement), signed in 2005. • Participation in the European Common Route Charges System (CRCO)

Since 1 July 2007, the Republic of Serbia has integrated into the European Common Route Charges System (in respect of overflights). In this way, being among 38 members of EUROCONTROL Common Route Charges System, the Republic of Serbia adopted the basic principles of the common regional charging system (Decision on Implementation of the Route Charges System) thus applying a common charge for overflying the territory of the Republic of Serbia (Decision on the amount of Route Charges Unit for the Republic of Serbia). By means of this charging system, the grounds for the developments of air traffic management are established in whole Europe in the safest and the most economical manner.

• Cooperation with international aviation organizations, multilateral agreements and other forms of multilateral cooperation A significant segment of international activities of the Civil Aviation Directorate is based on the membership in international organizations because the major part of the entire civil aviation system in the Republic of Serbia is regulated in accordance with international legal instruments (conventions, resolutions, standards and recommendations) of the following organizations: 1. International Civil Aviation Organization (ICAO); 2. European Civil Aviation Conference (ECAC); 3. European Organization for the Safety of Air Navigation (EUROCONTROL); 4. Joint Aviation Authorities (ЈАА) – organization ceased with operations on 30 June 2009; 5. European Aviation Safety Agency (ЕАЅА). The Republic of Serbia is the contracting party of more than 35 multilateral agreements in the domain of civil aviation, among which the most important is the Convention on International Civil Aviation (the 1944 Chicago Convention) and therewith related conventions that constitute Chicago aviation safety regulatory system– the 1929 Warsaw Convention and the 1999 Montreal Convention and therewith related conventions that constitute the Warsaw system of regulating liability in international civil aviation. Multilateral cooperation in 2009 was reflected, inter alia, in the participation at the 132nd and 133rd Meeting of Directors General of ECAC Member States Aviation Authorities, the 31st ECAC Plenary Session, DGINT - Integration Meeting, the meetings held in the International Civil Aviation Organization (ICAO), International Air Law Conference, Special Meeting of ECAC Directors General, Air Services Negotiations Conference, the subgroup meeting within the Adriatic-Ionian Initiative, the regional meeting for Southern Europe of EUROCONTROL subgroup for route network and many other very important gatherings. • Bilateral cooperation In 2009, the Civil Aviation Directorate established cooperation in the domain of civil aviation with aeronautical authorities of other states, airlines and other aviation entities. The conclusion of interstate bilateral agreements represents the most important aspect of bilateral cooperation in the domain of civil aviation, having in mind that, by means of these instruments, a regulatory framework for the operation of air services between two countries is being established. The Republic of Serbia is the contracting party of around 115 interstate bilateral agreements (agreements, memorandums, arrangements) in the domain of civil aviation. In the course of the last year, the initiatives for the negotiations and the conclusion of Air Services Agreements (ASAs) were launched with: The People’s Republic of China, Australia and Montenegro. Draft ASAs with these countries were developed and

submitted in accordance with the Rules of Procedure of the Government of the Republic of Serbia. Air Services Agreements with the the Russian Federation and the United Arab Emirates were initialled. The procedures for the conclusion of Air Services Agreement with Kuwait and the signing of the Memorandum of Understanding with Luxembourg have been launched. • Flight Permissions The Civil Aviation Directorate, within its activities regarding the application of international multilateral and bilateral agreements governing air transport as well as the application of Air Transport Law and other bylaws regulating air transport, issues permits for operating air services. The Civil Aviation Directorate applies provisionally the ECAA Agreement as of autumn 2009 (MULTILATERAL AGREEMENT BETWEEN THE EUROPEAN COMMUNITY AND ITS MEMBER STATES, THE REPUBLIC OF ALBANIA, BOSNIA AND HERZEGOVINA, THE REPUBLIC OF BULGARIA, THE REPUBLIC OF CROATIA, THE FORMER YUGOSLAV REPUBLIC OF MACEDONIA, THE REPUBLIC OF ICELAND, THE REPUBLIC OF MONTENEGRO, THE KINGDOM OF NORWAY, ROMANIA, THE REPUBLIC OF SERBIA AND THE UNITED NATIONS INTERIM ADMINISTRATION IN KOSOVO ON THE ESTABLISHMENT OF A EUROPEAN COMMON AVIATION AREA.) In this way, Serbia has opened the doors for numerous new foreign airlines coming from the European signatories of the ECAA Agreement. The National Assembly of the Republic of Serbia adopted, at its session held on 13 May 2009, laws on ratification of: • Multilateral Agreement between the European Community and its Member States, the Republic of Albania, Bosnia and Herzegovina, the Republic of Bulgaria, the Republic of Croatia, the Former Yugoslav Republic of Macedonia, the Republic of Iceland, the Republic of Montenegro, the Kingdom of Norway, Romania, the Republic of Serbia and the United Nations Interim Administration in Kosovo (pursuant to UN Security Council Resolution 1244 of 10 June 1999) on the establishment of a European Common Aviation Area; • Convention for the Unification of Certain Rules for International Carriage by Air • Agreement between the European Community and Serbia and Montenegro on certain aspects of air services. Regulations In 2009, CAD RS adopted a considerable number of regulations in the domain of civil aviation, the majority of which were aimed at harmonizing national regulations with the Acquis Communautaire:

4. Regulation amending the Regulation on the organization of the working time of the Crew Members (“Official Gazette of the Republic of Serbia”, No 16/09);

5. Regulation on Continuing Airworthiness of the Aircraft and Aeronautical Products (“Official Gazette of the Republic of Serbia”, No 16/09);

6. Regulation on the Development and Approval of the Master Minimal Equipment List and Minimal Equipment List (“Official Gazette of the Republic of Serbia”, No.16/09 and 20/09 - corrigendum);

7. Regulation on Certification and Safety Oversight in ANS (“Official Gazette of the Republic of Serbia”, No16/09 and 20/09 - corrigendum);

The CAD RS actively participates in the implementation of the National Programme of the Republic of Serbia for Integration with the European Union (NPI) and the Comprehensive Regulatory Review (SRP).

The National Programme of the Republic of Serbia for Integration with the European Union (NPI) is of fundamental importance in the process of obtaining the status of a candidate country and opening accession negotiations with the European Union. The Civil Aviation Directorate is the member of the Transport Subgroup of the Committee for the Coordination of the EU Accession Process (formed by the Government of the Republic of Serbia in 2007) and is entrusted with the monitoring of the segment of

Acquis Communautaire governing air transport and its transposition into national legislation.

The Comprehensive Regulatory Overview (SRP) has for its aim the repealing and the amendment of inefficient regulations so as to enhance economic environment, reduce legal uncertainty and increase the competitiveness of domestic economy vis-à-vis European and global markets. Search and Rescue In 2009, search and rescue activities were focused on the following: - Establishment of SAR coordination centre and participation in search for aircraft - Development of SAR coordination centre operations manual - Training programs for SAR operations - Quality control programme for SAR actions and measures Security Security activities undertaken in 2009 were mainly related to the following: - Harmonization of the National Civil Aviation Security Programme for the Republic of Serbia with the international standards and recommendations; - Performing security reviews of the Security Programme in order to ensure compliance with the new standards in ECAC Doc 30, ICAO Annex 17 and the National Civil Aviation Security Programme of the Republic of Serbia at airports "Konstantin Veliki" and "Nikola Tesla"; air operators: Air Pink, Prince Aviation, Pelican Airways and Aviogenex, regulated agents INTEROUP and DHL International, Belgrade; - Ensuring that emergency/contingency plans at "Nikola Tesla" airport were aligned with the international standards; - Compliance review of the security related parts of the operation manuals of Aviogenex and Air Traffic Control Agency- In-flight calibration; - Establishment of fulfilment of requirements by a commission for certification of JAT Airways Training Centre; - Meetings of the National Aviation Security Committee.

Every air accident or serious incident should be thoroughly examined and analyzed.

Investigation into causes of accidents and serious accidents is to be implemented by the Commission established by Director General of the Directorate.

The Commission is independent in its operations and has the responsibility to examine all the facts and circumstances under which the accident or a serious accident occurred and to propose measures for their prevention.

Infringement procedures in civil aviation The commission responsible for infringements in civil aviation conducts infringement procedures before in the first instance with a view to the infringements as foreseen in the Air Transport Law. In 2009 CAD RS inspectors filed a total of 19 applications for launching of infringement procedures, 17 of which were the rulings on launching of infringement procedure and one being in the first instance. Sixteen rulings were reached charging the persons suspected of committed an infringement with being liable and they were charged with a fine or released with a warning. Only one ruling was reached to dismiss the launching of infringement procedure. No appeals were brought in the second instance. Financing

The CAD RS costs are met from charges for the services rendered to those it regulates, which are aligned with those of the international aviation conventions, standards and recommendations. Charges for certification of aviation organizations, issue of licences, certificate, ratings, endorsements and authorizations, examinations for the issue of licences and ratings for aeronautical authorized personnel and charges for en-route services.

There is no direct funding of CAD RS`s work through the budget of the Republic of Serbia.Тhe Republic of Serbia was integrated into the common European route charges system, effectively on 1 July 2007, following the successfully completion on 14 June 2007 of technical negotiations between the representatives from CAD RS, the European organization for the safety of air navigation (EUROCONTROL) and the Air Transport Association (IATA) in Brussels, Belgium. As one of the 38 member states of the EUROCONTROL route charges system, the Republic of Serbia has adopted the basic principles of a consistent regional en-route charging system (Decision on the implementation of the requirements for the application of the route charges system of fees and terms of payment, Official Gazette of the RS , No 75/07).

It was decided for the first time that two independent states i.e. the Republic of Serbia and the Republic of Montenegro have a common price for the payment of route charges (EUROCONTROL Expanded Commission Decision No 97 of 25/06/2007).

In accordance with the CRCO EUROCONTROL principles all three institutions, whose costs for air navigation services represent total costs for route charges for the Republic of Serbia and the Republic of Montenegro (CAD RS, Administration of Civil Aviation of the Republic of Montenegro and the Serbia and Montenegro Air Traffic Control Agency), signed a joint agreement on 14 September 2007 in which they agreed on the percent of the allocation of route charges in 2007 in accordance with a previously adopted cost-base in technical negotiations.

Route charges payment mechanism implies that the Eurocontrol CRCO performs billing and collection of route charges from airlines and according to the pre-determined percentage of the distribution paid on the accounts of institutions, with the payment of membership contributions from the Republic of Serbia and the Republic of Montenegro to EUROCONTROL applies direct payment principle by the EUROCONTROL CRCO from the collected route charges (quarterly).

At the meeting of the enlarged Committee for Route Charges in 2009 the unit rate of EUR 39,21 was established for the air navigation services operated in the air space of the Republic of Serbia and the Republic of Montenegro - Belgrade Flight Information Region.

CAD Human Resources The most valuable asset of CAD RS is its employees. The Directorate derives quality from its human resources i.e. capable, competent and professional people. Directorate achieves its long-term objectives through human resources management, recruitment and hiring, improvement of organizational processes, regular training, promotion and evaluation of performance, safety and occupational health, social programs and international cooperation. There were 120 people employed with the Civil Aviation Directorate of the Republic of Serbia in 2009.

The structure of employees according to years of service CAD RS full-time employment comprised: - 17 employees up to 5 years of service, - 36 employees from 5 to 15 years of service, - 26 employees from 15 to 25 years of service,

- 25 employees from 25 to 35 years of service, and - 16 employees over 35 years of service.

Qualifications of employees The qualifications structure of the CAD RS employees working full-time was the following: Higher education degrees: - 55 male and 37 female employees, Post-secondary education degrees: - 11 male and 1 female employees Secondary education degrees: - 2 male and 13 female employees.

Age structure

Age structure of full-time employees was the following: - 2 female employees from 20 to 25 years of age, - 5 male and 7 female employees from 25 to 30 years of age, - 10 male and 4 female employees from 30 to 35 years of age, - 5 male and 9 female employees from 30 to 40 years of age, - 3 male and 9 female employees from 40 to 45 years of age, - 8 male and 10 female employees from 45 to 50 years of age, - 14 male and 2 female employees from 50 to 55 years of age, - 10 male and 6 female employees from 55 to 60 years of age, and -12 male and 3 female employees over 60 years of age.

Human resources development The civil aviation in Serbia is rapidly developing and improving. Such a development requires that people working in civil aviation should be at the very source of information helping them to develop their personal skills, knowledge and abilities, keeping up-to-date with the latest developments which could be applied to intrinsic tasks.

Human resources development is one of the top priorities of the CAD RS. In the course of 2009 the employees of the CAD RS underwent various training programmes. The most important are:

Library The CAD RS library is equipped with just about 3000 highly relevant civil aviation material coming from international civil aviation organizations. The basic library resources consist of ICAO publications including manuals, standards, procedures and conventions (Chicago Convention) with the appropriate annexes and circulars that extensively cover specialized technical field of research. The library contains the reports and records of ICAO sessions, assemblies and councils. One of its activities is the electronic distribution of information of State Letters as well as keeping informed on latest amendments, supplements addenda and corrigenda. The library is accessible exclusively to the CAD RS users. The archive consists of JAA documents, Administrative and Guidance Material и Joint Aviation Requirements. Public Relations

The last year was a year which marked CAD RS`s openness and efficiency in delivering information on its work both to the Serbian and international public.

We made efforts to timely inform on everything taking place in CAD RS to its users i.e. aviation personnel, airlines, airport employees, aircraft owners, etc. for the purpose of their having insight into changes taking place in Serbian civil aviation, especially in the standardization process. The public was informed timely and truthfully on all novelties mainly through our web site, electronic and press media, including personal contacts.

The following activities were undertaken in the preceding period:

- Presenting the work of CAD RS truthfully - Improvement of the CAD RS confidence established in Serbia and abroad - Continual communication with the users - Communication with journalists from electronic and press media - Web site development and updating - Communication with the relevant Ministry and the Government of Serbia - Communication with the Commissioner for the information of public importance and

personal data protection - Answering to questions by the public in accordance with the Law on Free Access to

Information of Public Interest - Communication with the international organizations - Development of CAD RS brochure on the activities within the period 2007-2009

Most frequently asked questions by domestic and foreign users were related to the manner of revalidation and recognition of all categories of licenses for license holders outside of Serbia; registration of certain categories of aircraft; requirements for acquiring airplane pilot licenses, flight permissions from Serbia, etc.

Information of public interest was published in the media and on CAD web site and not one issue was considered too irrelevant to be left unaddressed. The most interesting subjects to the media regarding CAD RS were charter operations, air taxi, financing, and low - cost airlines entering the Serbian market.

A good communication was established with the communication service of the European Aviation Safety Agency (EASA). Furthermore, regular contacts were made with information offices both in the European civil aviation authorities and those in the region.

Great interest in the Serbian civil aviation shown by the national and international media influenced a thorough, efficient and timely delivery of information. In the course of the last year the national press published around 288 texts on the work of CAD RS, while the electronic media broadcast well over 50 news, including the participation in TV programmes giving information on the activities in CAD RS. The CAD RS`s presence in the media is by 35% larger than in 2008 and 2009 respectively. The reason for this was the fact that CAD RS raised much interest of both Serbian and international public.

The next objective is to be available at all times and ready to deliver timely information to the users by helping, advising and enabling them to get acquainted with their rights and obligations, including the manner in which duties in CAD RS are performed.

Our endeavour will be to promote civil aviation through our activities and to further promote CAD RS as a modern, professional and responsible civil aviation authority of Serbia.
