Copies of all forms, releases, standards, drawings, specifications, handbooks, orders, and codes referred to in this proposal are available in the offices of the Department of Public Works within the City of Richmond, Virginia. SPECIAL PROVISIONS      ‐ Rehabiltation Rte US1/301 over 2nd Street, CSXT, James River, NSRR & Riverside Dr,‐  A GENERAL ‐ The basic specifications for this project shall be the 2016 issue of the Virginia

   These special provisions are intended to add to and more fully describe the requirements not 

otherwise detailed or set forth on the plans and specifications.  In addition, when necessary, the provisions are to amplify or modify the character of workmanship and materials. 

   Copies of all forms, releases, standards, drawings, specifications, handbooks, orders, and codes 

referred to in this proposal are available in the offices of the Department of Public Works within the City of Richmond, Virginia. 

 B STANDARDS & REVISIONS TO THE GENERAL CONDITIONS OF THE CONTRACT ‐ In addition to the 

requirements stated in the Virginia Department of Transportation Road and Bridge Specifications, the following requirements supplement, add to or modify those Specifications and shall govern in all conflicting cases.

  C ADDITIONAL REQUIREMENTS – By submitting a bid for this project the contractor certifies that they 

are  familiar with the requirements of all the contract documents and that all their  subcontractors are familiar with the requirements of the contract documents as they may be additionally affected.  1) OWNER REPRESENTATION ‐ The work will be done under the general supervision of the 

Director of Public Works with direct supervision by the Capital Projects Manager, who will assign a Project Manager engineer and a Project Inspector at the pre‐construction meeting to the project.  The presence or absence of the Owner's representative shall in no way relieve the contractor of  their responsibility to complete the work in accordance with the Contract

Documents or lessen his obligation to correct unsatisfactory work.  All required submittals shall be submitted to the Project Manager through the Project Inspector. 

 2) PRE‐CONSTRUCTION MEETING ‐ After award of the contract and prior to commencement of 

the work, a meeting will be arranged between the contractor, Purchasing Officer, Project Manager, Project Inspector, Construction Manager and Railroad representatives (CSX and NSRR) to discuss all aspects of project, to include Public Works Department policies and regulations, administrative matters, safety and accident prevention, and access to railroad property. This meeting will also provide the contractor an opportunity to request clarification of any of the contract documents, Owner and Railroad requirements. 

 3) COORDINATION‐ The Contractor is required to attend regular progress meetings. The 

Contractor will provide the Owner with a projected schedule for Start and Completion of each phase as well as updates to the schedule should the provided dates change.  

4) SCHEDULING ‐ The Contractor  shall submit a written schedule as required by the contract and provide updates as required by the Project Manager or Inspector.  

5) TESTING‐  Notice for testing shall be given to the Project Inspector a minimum of 2 business days in advance prior to performing any activity that requires Quality Control Testing. The Contractor should avoid performing any activities that require Quality Control testing in the late afternoon. Should the Contractor choose to proceed in executing work without an Inspection, they do so at their own risk and may be required to remove such work without charge at the discretion of the Project Manager. 

 6) SEQUENCE OF WORK‐  The project shall be scheduled as to provide a continuous and 

uninterrupted flow of all work items in a logicaly. If, in the opinion of the Owner, the flow of all work items is not being followed in accordance with the approved schedule, the Owner may suspend work on all or portions thereof until such time as those items not being prosecuted sequentially are completed or on schedule.  Additional time will not be allowed for the remaining work for the time the suspension was in effect. 

 7) HOLIDAYS ‐ The Contractor shall not permit work, except that which is necessary to maintain 

traffic, on City observed holidays without written consent of the Owner.  

8) EXISTING INFRASTRUCTURE ‐ The location of existing sewer, water or gas lines, conduits, underground cables or other structures across or along the line of the proposed work may vary from the locations shown on the drawings and, where shown, the locations depth and dimensions of such structures are approximately correct and may vary.  The Contractor shall be responsible for determining the exact location of the lines or structures and will be liable for repairs in the event of damage. 

 a. It is the Contractor's responsibility to notify and coordinate with "Miss Utility"  at 811 

prior to the beginning of construction.  

b. The Contractor must notify the proper City agencies and coordinate with all private utilities at least 72 hours prior to the time set for work involving their facilities or equipment.  Furthermore, this responsibility shall extend to coordinating all contract

work with existing utility owners to avert or minimize any conflicts whether apparent or unforeseen.  The owner or their representative may allow a contract time extension, at their sole discretion, based on full documentation received from the contractor.  

 (1) Department of Public Utilities:  The Contractor shall arrange for adjustment of fire 

hydrants, gas, water or electrical lines and such work shall be performed by contractors prequalified by the Department of Public Utilities.  Documentation of pre‐qualification by DPU shall be provided to the Project Inspector at least 5 business days prior to commencement of utility work. If the actual adjustment of fire hydrants, gas, water or electrical lines are made by City personnel, the Contractor's responsibility will consist of uncovering and properly restoring the utility cut. 

 (2) Traffic Signal Equipment:  A representative from the Division of Traffic Engineering 

must be present before beginning any work involving their equipment and/or excavation in the vicinity of signalized intersections. Traffic loops damaged during excavation will be repaired at the contractor’s expense. Installation and relocation of this equipment will be by others unless included as a bid item.  The Contractor must cooperate with others for this work with no additional time allowed for it. 

 9) MATERIALS FURNISHED BY THE OWNER ‐ The Owner will furnish the Contractor from the 

Department of Public Works storage yards at Parker Field, Hopkins Road, East Richmond Road Landfill and Convenience Center and/or the Department of Public Utilities Warehouse at 400 Jefferson Davis Highway, hereafter defined as “city storage yards”, all required sewer and utility casting extension rings, durax block, granite spall, granite curb, and adapters unless noted elsewhere to the contrary. The Project Inspector will provide the contractor with the necessary charge number and assist in providing these items to the Contractor as needed. All materials furnished by owner shall be hauled to the project at the Contractor's expense. 

 10) OFF‐DUTY UNIFORMED POLICE ‐ During the course of the work it may be necessary to 

employ off‐duty uniformed police for traffic control.  They shall be employed only when approved by the Project Manager.  The Contractor shall pay police officers $28.00 (6/2009) per hour and Supervisors $30.00 (6/2009) per hour if they report for work.  Whenever three or more police officers are employed off‐duty, at least one must function as a Supervisor.  Off‐duty police will be paid at time‐and‐a‐half when working on City of Richmond holidays and New Year's Eve.  The contractor shall pay the Richmond Police Department $35 (6/2009) per day for usage of a marked police car.  The City will reimburse the Contractor at the hourly or overtime rate plus $.50 per hour, dependent on the rank of officer used, with a minimum payment of four hours for officers reporting for duty.  Reimbursement will not be made when officers report for work, the Contractor does not work and does not request cancellation of officers.  When requesting Police Officers, the contractor shall contact the Police Department (Sgt. Gary Borges, 646‐0445) a minimum of 5 business days prior to the anticipated reporting time for the required officers.  A copy of the request for use of uniformed police officers shall be sent to the City’s Project Manager. 

 11) PROTECTION OF TREES ‐ All trees on any street or public property are protected by the City 

Ordinance.  Any time work is done within proximity to city trees they shall be protected by a tree protection fence at least four (4) feet high.  The fence should extend at least 10 feet

from the trunk of the tree; or a distance in feet from the tree equal to the tree diameter (DBH) in inches; whichever is greater.  (For example a 24” diameter tree would have a 24 foot radius protection zone.)   Any deviation from this standard must first be approved, in writing, by a City Arborist. All building material, dirt, or other debris shall be kept outside the barrier.  Failure to comply with tree protection standards may result in the contractor being monetarily responsible for the value of the tree(s) as appraised by International Society of Arboriculture Standards.  In addition, the Contractor shall notify both Urban Forestry and the Project Inspector a minimum of 2 business days before excavating around trees.  The Contractor shall use extra care with his equipment when working on a street where there are trees.  Any tree limbs or roots that are cut in the course of work will not be coated with any type of paint.  Where equipment is working close to trees, the Contractor shall be required to protect the trees by acceptable methods at no additional cost to the Owner . Should there be a need for extensive pruning (1 Block or greater) of low hanging branches for paving or other operations, the pruning will be performed by the City of Richmond unless directed otherwise. A copy of the request for this work shall be sent to the  Project Manager 10 days, in advance.  

 12) USE OF CITY WATER ‐ Any connections to a city water source (i.e. hydrant, spigot) shall be 

made in accordance with Plan M‐646.  Connections made to fire hydrants without yellow caps shall be by special permission from the Department of Public Utilities, and shall be governed by all rules and requirements of that Department. 

 13) EROSION AND SEDIMENT CONTROL:  

a. The Contractor shall be required to obtain a Land Disturbing Activity Permit from the Department of Public Utilties, when applicable.  Policies, procedures, guidelines, etc. are contained in the Virginia Erosion and Sediment Control Handbook, which is available for a fee from the Virginia Soil and Water Conservation Commission.  The contractor must have a person certified as the “Responsible Land Disturber” assigned to the project.  Certifications shall be submitted to the Project Inspector prior to the commencement of work.  

b. On projects requiring a Stormwater Pollution Prevention Plan (SWPPP), the contractor shall conduct operations in accordance with the SWPPP.  The City will obtain the VSMP permit then transfer the permit to the contractor.  The contractor will be required to follow all aspects of the plan to include recording of land disturbance activities, E & S inspections, etc. as set forth in the permit. 

 c. The construction plans have been pre‐approved as conforming to the Erosion and 

Sediment Control Ordinance and the guaranty of the owner required by the ordinance will be included in the Contractor's Performance Bond.  The Land Disturbing Activity Permit, when applicable, will be issued upon payment of the necessary fees by the Contractor. 

 d. The Contractor shall not allow any area to remain unprotected from erosion and 

sedimentation control.  Methods most suitable to the site and soil conditions shall be employed to intercept sediment carrying runoff from the site and remove the maximum practical amount of sediment from the storm runoff.  These methods shall consist of diversion dikes, interceptor dikes, diversion channels, sediment traps, straw or hay bale barriers, or other methods suitable to the topography, soil conditions and nature of the

disturbance as outlined and conforming to the latest edition of Erosion & Sediment Control Handbook.  

e. Only the smallest practical area shall be exposed or disturbed at any one time for the shortest practical period of time.  Permanent vegetation shall be established at the earliest practical date.  No disturbed area to remain denuded for more than 7 calendar days.  

f. On occasions, unforeseen erosion or sedimentation situations or circumstances may arise and should some method of erosion and sediment control be ordered by the Project Manager or Inspector, the Contractor must commence making these corrections within two (2) working days after the request is given.  

g. Payment for any erosion and sediment control devices will be made at the contract price for items used.  When not a pay item, erosion and sediment control devices will be incidental to other pay items. 

 h. The disposal of excess excavation off site, the disposal of waste materials removed from 

erosion and sediment control facilities, and the disposal of erosion and sediment control facilities shall be in accordance with the Virginia Erosion and Sediment Control Handbook.  

i. All temporary Erosion & Sediment Control Measures shall be removed by Contractor at his expense within 30 days of achieving final stabilization as approved by the Project Manager or Inspector. 

 14) SITE MAINTENANCE ‐ Throughout all phases of construction, the Contractor shall keep the 

work site clean and free from rubbish, debris, and dust.  Dust nuisance shall be abated by cleaning, sweeping, sprinkling with water or calcium chloride at no additional cost to the City.  Care shall be taken to prevent spillage on haul routes.  Any such spillage shall be removed immediately and the route cleaned.  If the use of water results in mud tracking on adjacent streets or railroad property, the project will be shut down until street or site is cleaned by the Contractor at his expense and no extra time will be allowed for the time thus lost.  Materials and equipment shall be removed from the site as soon as they are no longer needed.  If the Contractor does not respond to the requests to clean the streets or site, the City may clean the required and the costs expended by the City will be deducted from the payment(s) due the Contractor. 

 15) CONSTRUCTION STAGING AREA ‐ The contractor shall be responsible for selecting the staging 

and laydown areas and any needed storage yard in the vicinity of the project. Areas used by the contractor within the public right‐of‐way require the prior approval of the Project Manager.  All costs associated with the use, maintenance, and final restoration of areas needed shall be at the sole expense of the contractor.  In addition, the Contractor shall do the following: 

 a. Arrange for and maintain the staging area at their expense. 

 b. Locate trailers and equipment as far as possible from nearby occupied dwellings.

 c. Keep the site neat and policed so that debris will not be transported to neighboring 

properties by wind or other means.  

d. Start construction equipment only when necessary in the mornings.  

e. Do not leave construction equipment running needlessly.  

f. Caution workmen to speak quietly and to use language that would not offend citizens in the area. 

 g. Locate portable sanitary facilities on a secluded or concealed portion of the site. 

 h. Where appropriate, provide lighting and/or fencing to make access to the site during 

non‐working hours more difficult.  

i. When storing construction materials insure that they do not have a tendency to become unstable. 

 j. Where dust may become a nuisance, provide means for dust control. 

 k. The Contractor shall maintain access to all properties and city services. 

  

l. Grass and weeds within the project limits shall be kept trimmed at all times by the contractor at no additional cost to the city. 

 16) SITE SAFETY‐ Safety is the contractor’s responsibility; all barricades, safety fencing, temporary 

signage, etc. are incidental to the contract. The Contractor shall also inspect the project area for unsafe conditions prior to mobilization. Should unsafe conditions be found the Contractor shall immediately contact the responsible party and will not mobilize until sufficient repairs are made to make the area safe. The contractor may request a contract time adjustment if in  their opinion, repairs created a significant delay to their critical path activities.  Provided prior notification was timely, the Project Manager, at their sole discretion, may grant such time extension based on written documentation duly furnished by the contractor.  No delay claim will be receivable if, in the opinion of the Project Manager, the responsible party has accomplished due diligence in adjusting its facilities within 10 (ten) working days of the above notification.     

 17) SUBGRADE STABILIZATION ‐ If #2 or #3 stone is listed as a bid item in this contract, even 

though not shown, contractor shall stabilize areas where poor bearing conditions exist. All undercuts require the prior approval of the Project Manager or Inspector.  

18) SALVAGE OF SIDEWALK BRICK, GRANITE SPALL, COBBLESTONE, GRANITE CURB, DURAX BLOCK, AND ANY OTHER BUILDING MATERIALS – All materials for sidewalk brick, granite spall, cobblestones, granite curb, durax block, or other building materials are the property of the City. Specific materials specified to be salvaged are to be removed to designated City storage.

 a) All salvaged materials are to be handled with due care to avoid damage. Granite curb is 

to be carefully stacked with wooden strips between layers.   

b) Removal of salvaged materials to designated storage areas and proper storage at those areas shall be paid for at the unit price indicated for salvaging that item. Where the item is not specifically indicated a price shall be agreed upon before the item is moved. 

   19) DISPOSAL OF EXCESS MATERIALS ‐ All inert materials not designated for salvage (concrete, 

brick, uncontaminated soils, cobblestone, etc.) from the project shall be disposed of at an approved landfill and the cost of loading and hauling to the landfill shall be incidental to the unit price of related items.   

20) MOBILIZATION – Mobilization will be paid 50% on the first payment and remaining 50% on the second payment. No additional payment will be made for demobilization and remobilization because of shutdowns, suspensions of work, work moratoriums, or other mobilization activities. 

 21) TRAFFIC CONTROL – Traffic Control will be in accordance with Maintenance of Traffic (MOT) 

plan.  Payment for Traffic Control will be paid on a unit cost basis provide traffic control on the project based on the latest Work Area Protection Manual.  MOT planning shall include pedestrian travelway and maintain accessibility for the impaired.  

 22) PROTECTION OF RAILROAD PROPERTY – the Contractor shall comply with the terms of any 

agreement between the City and Railroad Entity for access to or across Railroad property. In the case of CSXT, the contractor shall be party to the agreement by signing Construction Agreement, Schedule I (Contractor's Acceptance). The Contractor shall give appropiate notice (per the agreement with the Railroad) to the affected Railroad prior to beginning work requiring access across Railroad property.  The contractor shall follow the Railroad special provisions in addition to those of the City, while working on Railroad property. The Contractor shall be liable for any damages assessed by the Railroad Entity.  

 D COPIES FURNISHED TO CONTRACTOR ‐ After the contract has been executed, the Contractor will be 

furnished one (1) set of the Contract Drawings and Specifications in portable document format (PDF) and only one (1) full size set of drawings/sketches. It shall be the Contractor's responsibility to furnish each of their subcontractors, manufacturers and material suppliers such copies of the Contract Documents, as may be required for their respective work. 

 E LUMP SUM CONTRACT ITEMS – Measurement and Payment of Lump Sum items, such as Traffic 

Control and Construction Surveying, when pay items, will be made in installments based on work completed from the schedule of values.  The schedule of values shall not consider other lump sum contract items (Mobilization, Traffic Control, Surveying, etc.) for calculation of work progression.  Mobilization, when a pay item, will be paid on the first two payments in accordance with VDOT specifications.

  In the event of a conflict between the referenced VDOT Road and Bridge Specifications and the modifications thereto listed below, the below listed modifications shall govern. 

 1. SECTION 107.11 IS AMENDED TO INCLUDE THE FOLLOWING: 

 a. Blasting ‐ If rock excavation is encountered and blasting is necessary, the City will accept, 

subject to the conditions of the City Code and approval of the Director of Public Works and the City Attorney, coverage in the form of a Rider to Certificate of Insurance in the amount equal to the Personal Liability and Property Damage Insurance of this contract.  In addition, before any blasting operations may be performed, the Contractor must first obtain a blasting permit from Fire and Emergency Services of the City of Richmond.  

b. Blasting shall not be permitted on any job until the Contractor provides a written copy of the approved blasting permit to the Project Inspector.  

c. Blasting shall not be permitted until the Project Inspector is on‐site to monitor the blasting activities.  

d. The Contractors shall be responsibile for seismic monitoring.  2. SECTION 302 ‐ DRAINAGE STRUCTURES IS AMENDED AS FOLLOWS:   

 Installation of pipes shall be paid for:  a. Pipe shall include all fittings, connections, anti‐seepage collars, anchor and thrust blocks, 

materials, equipment, abd labor required for installation.    

b. Trench Excavation shall consist of the removal of all materials encountered as required for installing new pipe, complete in place, and restoration of existing surfaces per the City of Richmond “Right of Way Excavation & Restoration Manual”. 

 c. Excavation and trenching protection for all drainage/utility structures  shall be included in 

the contract unit price. No separate payment will be made. The contractor shall provide documentation (such as tabulated data or engineering calculations) that the trench protection is adequate for the field conditions 2 business days prior to commencement of work.  

d. Bedding material shall conform to requirements of section 302.  The contractor shall provide . Class “C” bedding material per sheet 23 of the City of Richmond, Departmental Standards Drawing N‐14000 (Sheets 1‐26).  Bedding material shall be included in the unit price for utility structure or pipe. 

 e. Casting frames and covers, not designated as being supplied by the City, shall conform to 

City standards, be provided new by the contractor, and be included in the structure cost.  No separate payment will be made. 

   3. SECTION 303 – EARTHWORK IS AMENDED AS FOLLOWS:

a. Excavation ‐ Unclassified excavation, shall consist of the removal of all materials encountered, not specifically provided for or included as a part of other bid items  or the approved drawings. Excavation shall include undercut excavation regardless of depth. Side slopes shall be trimmed to neat lines and even surfaces with tops hand raked to a rounded edge and 2:1 slopes where practical or as shown on the drawings. 

 b. Trench Excavation shall consist of the removal of all materials encountered as required 

for installing new and/or existing service pipe, complete in place., and restoration of existing surfaces per the City of Richmond “Right of Way Excavation & Restoration Manual.” 

 c. Where embankment or backfill is required, it shall be made with suitable material 

obtained from the project excavation if available or from suitable material as directed by the Project Manager. Should the Contractor dispose of suitable excavated material to the extent that sufficient material is unavailable for fill purposes, extra payment will not be made for furnishing the required borrow. All fill areas shall be compacted to the appropriate density per the latest Virginia Department of Transportation specifications or as specified by the Engineer. 

 d. All excess excavation shall be disposed of by the contractor.    

e. Rock Excavation shall be defined as excavation of material such as limestone, sandstone, granite, shale or similar material in solid beds or masses in its original or stratified position which can be removed only by blasting operations, drilling, wedging, or use of pneumatic tools, and boulders with a volume of greater than 1.0 cubic yard.   

     4. SECTION 517 – CONTRACTOR CONSTRUCTION SURVEYING IS SUPPLEMENTED AS FOLLOWS: 

 Measure and Payment for Construction Surveying, when a bid item, will be at the contract unit price in accordance with these special provisions.  When not a pay item, the costs of Construction Surveying shall be included in the price bid for other appropriate items. 

 5. SECTION 601 – SELECTIVE TREE REMOVAL AND TRIMMING IS AMENDED AS FOLLOWS: 

 Tree Removal ‐ This item shall include the removal and satisfactory disposal, in the area provided by the Contractor, of all trees over 6" in diameter, measured  36” above ground and designated on the approved drawings for removal. Removal of trees shall include the removal of their stumps to a minimum of two (2) feet below finished grade, unless otherwise noted.  Existing stumps shall also be removed to a minimum of two (2) feet below finished grade, unless otherwise noted The unit price for removal shall also include the restoration of the excavated area to normal grade with onsite borrow unless otherwise specified. The cost of removing trees smaller than 6" in diameter and brush shall be included in the price bid for clearing and grubbing.  Felled trees or felled portions shall be removed the same day.  The Contractor shall take all precautions to protect trees, shrubs or other vegetation scheduled to remain and shall repair or replace all trees, shrubs or seeded areas negligently destroyed at no cost to the City.  Payment for removal of trees and their stumps, or stumps only, will be made

as per the unit price in the bid sheet. Removal of all trees shall be approved by the city arborist. 

 6. SECTION 602 – TOPSOIL & SECTION 603 – SEEDING ARE AMENDED AS FOLLOWS: 

 a. Topsoil, Grass Seed and Fertilizer ‐ The area indicated by note on plans shall be graded to 

three (3") inches below finished grade and covered with a minimum of three (3") inches of topsoil, hand raked to a level finish.  The topsoil shall be free of subsoil, seeds, rocks, or any other foreign matter. Top soil shall be subject to the approval of the Department of Grounds Maintenance before being moved from the source of supply. 

 1) The seed applied to areas noted shall consist of 1/3 2nd Millennium turf type tall 

fescue, 1/3 Falcon IV turf type tall fescue and 1/3 Rebel Exeda tall fescue, unless otherwise directed by the Project Manager.  This mixture shall be applied at the rate of five (5) pounds per 1,000 sq. ft.  Agricultural lime shall be applied at the rate of 3,000 pounds per acre.  10‐20‐10 fertilizer shall be applied at the rate of 2,000 pounds per acre.   

 2) The lime and fertilizer shall be worked into the top soil prior to seeding. 

 3) The City reserves the right to delete the item top soil, fertilizing and seeding from this 

contract.  

4) Where seed and fertilizer only are to be used, the existing ground is to be broken up, rocks and unsuitable material raked out and the fertilizer and seed applied at the same rate and method as explained above. 

 5) Where there is a build up of unsuitable soil between the existing or proposed curb 

and the existing or proposed sidewalk, or where there is insufficient or unsightly grass cover, the area will be excavated to 3" below grade and filled with 3" of top soil, seeded and fertilized.  Any areas close to grade and well turfed should not be disturbed. 

 6) Permanent seeding shall take place only during the regular sowing period in the 

spring or fall. Temporary seeding will be in accordance with the Virginia Erosion & Sediment Control Handbook. If a suitable stand of grass is not obtained during the first seeding, the Contractor shall be required to return once and resow those areas in which a suitable stand of grass is not obtained. 

 b. Hydroseeding ‐ The areas outlined for seeding shall be properly shaped, all wash areas 

shall be filled to provide a smooth, uniform surface and shall be scratched to a depth of at least two (2") inches to provide a satisfactory seed bed. 

 1) Liming ‐ An approved limestone or approved equal shall be spread uniformly over the 

area to be seeded at the rate of 2 tons per acre.  

2) Fertilizing ‐ At the time of seeding, 10‐20‐10 fertilizer shall be applied uniformly at the rate of 1,500 pounds per acre.

 3) Mulching ‐ Mulch (wood cellulose fiber) shall be applied at the rate of 1,500 pounds 

per acre (dry weight) and in such a manner that uniform distribution is obtained.  Five pounds of annual rye grass seed shall be added to the seed mix for each acre. 

 4) Sowing Seed ‐ A seed mixture of 83 pounds Kentucky 31 Fescue and 2 pounds Red 

Top or approved equal shall be sown per acre.  Hydroseeding will be permitted provided equipment approved by the City is used and all mixtures are constantly agitated from the time they are mixed to the time they are applied to the seed bed.  All such mixtures shall be used within 8 hours of mixing.  Nozzles or sprays shall not be directed toward the ground in such a manner as to cause erosion or runoff. 

 5) Hydroseeding ‐ Unless specifically in the contract, hydroseeding may be done at the 

option of the contractor.  No separate payment will be made for hydroseeding when done at the option of the contractor.  Payment will be made at the contract price for “Grass Seed and Fertilizer, in place”. 

 c. Out‐of‐Season Seeding – Out of season seeding is seeding that occurs in Summer (June 1st 

and September 1st) of the calendar year and/or Winter (January 1st to March 1st).  The Contractor will be permitted to seed at times other than during the regular seeding season provided that he furnishes the Director of Public Works a letter that the contractor shall: 

 1) Re‐establish the original condition and grade prior to supplementary seeding.  2) The area shall have 85% vegetative cover to be deemed acceptable.  3) Bare areas over 5 square feet are not acceptable.  4) Acceptability will be determined by inspection approximately 60 days after the 

beginning of the following seeding season.  5) Supplemental seeding, if performed during a regular seeding season, will only be 

required once.  6) Supplemental seeding shall not entitle the Contractor to additional compensation. 

 d. Payment for Out‐of‐Season Seeding ‐ Payment for the work will be made as follows: 

 1) Fifty percent (50%) of the lump sum bid will be paid on completion of all work as 

outlined.  

2) An additional twenty‐five (25%) percent will be paid when seventy‐five (75%) percent cover is obtained over the entire area.

3) The balance will be paid when the Project Manager or Inspector is satisfied that the necessary vegetative cover is obtained over the entire area and the work is acceptable as complete and satisfactory.  

4)  Full payment may also be released at the discretion of the Project Manager should the Contractor provide in writing adequate guarantees and assurances that permanent seeding will be performed during the next planting season. 

 7. ADJUSTING UTILITIES AND CASTINGS 

 a. Resetting Castings ‐ The Contractor shall be required to adjust sewer manhole castings, 

gas, water valve and drip boxes to new grades.  For large valve and drip boxes the vertical adjustment shall be made with brick and concrete.  The entire base of the box shall be placed on brick when set to new grade.  For small valve boxes the vertical adjustment is made by screwing the top section and/or by installing a new mid‐section. 

 1) Sewer manhole castings shall be reset to grade on brick with high early concrete 

or precast concrete adjustment rings.  Virginia Power and telephone manhole castings will be reset by the respective utility.  Old pavement removed to adjust gas, water valve and drip boxes and sewer manhole castings shall be replaced with concrete on graded streets.  The contractor shall coordinate adjustment of private utility owned manholes with the respective owner.  

2) The Contractor shall properly place and fit the sewer rings and adapters.  Rings and adapters improperly placed shall be cut out and replaced at the Contractor's expense.  

3) The Contractor shall remove all materials which they cause to fall in the sewer manholes and basins and reset all castings the day the castings are disturbed.  Work shall not be resumed the next day on any new work until such time as previous day's work is complete (i.e.:  the Contractor has failed to clean out any sewer manhole or basin or reset the castings of previous day's work).  

4) Concrete collars around sewer manhole castings and valve boxes shall be Class "A3" Type I or II cement and shall be protected from traffic for three (3) days.  Backfill for valve boxes set to grade shall be compacted with a pneumatic tamp to a minimum of ninety‐five (95%) percent density (Standard Proctor).  

5) Sewer castings, gas, water valve and drip boxes where the final surface shall be concrete, shall be set to grade without concrete collar.  

6) All castings shall be adjusted via methods such that they do not settle from the adjusted elevation. 

 b. Adjusting Utilities ‐ In the event that any existing gas, water lines, fire hydrants or 

services have to be adjusted and not shown on the plan, the Contractor will be required to notify the Department of Public Utilities (DPU) seventy‐two (72) hours prior to the time set for uncovering the existing lines, adjusting hydrants, or adjusting service boxes.

Any adjustment to gas‐water lines or fire hydrants, unless included in the contract, will be done by the Department of Public Utilities' forces.  Uncovering lines shall be done by the Contractor.  The contractor may request a contract time adjustment if in his opinion, DPU in adjusting its facilities created a significant delay to his critical path activities.  Provided prior notification was timely, the Project Manager, at his sole discretion, may grant such time extension based on written documentation duly furnished by the contractor.  No delay claim will be receivable if, in the opinion of the Project Manager, DPU has accomplished due diligence in adjusting its facilities within 10 (ten) working days of the above notification.  The same process shall apply to other private and public utilities with facilities within the public right‐of‐way. 

 c. Payment ‐ Payment for manholes set to grade will be made at the unit price bid for this 

item and shall include the cost of excavation, backfill, brick, mortar, hauling and placing sewer rings and adapters, barricading, lighting, concrete collar, and all other costs in connection therewith.  Payment for adjusting gas, water valve, and drip boxes will be made at the unit price bid for "Adjust utility castings, large  (greater than 16 dia.)” or “Adjust Utility Casting, Small (6"‐16").”  Water meter boxes and gas curb cocks will be paid for at the unit price for “Adjust water meter or gas cock to grade " and shall include all connection costs including costs of excavation, backfill, concrete, barricading, lighting and asphalt padding and any other costs. 

 8. ADJUSTING OR CONSTRUCTING BASIN SLABS 

 a. Drop inlet throat sections where specified on the plans will be either cast in place or a 

pre‐cast unit. Before placement of the throat section, the barrel will be either cast in place, prefabricated or a modified existing structure. The throat section will either be mortared to the barrel or will be sealed with an asphaltic seal. Existing drop inlet barrels will be re‐mortared to repair weak mortar joints. The base for the pre‐cast throat units will be of concrete either dry or wet at a thickness of 3 inches minimum.  Specific detail references will be made in the plan or per VDOT Standards. 

 b. Payment will be made according to the specified design units identified in the plans.  

Cost of work in connection with the drop inlet construction will be made per each unit, specified in place. 

 c. When adjusting existing drop inlets the cost of extending the throats shall be paid per 

linear foot of length greater than 4‐foot minimum.  The cost of curb and gutter shall be separate unit costs. 

 9. SAW  CUTTING – Saw cutting is incidental to any asphalt or concrete tie‐in work.  All existing 

asphalt & concrete pavements will require saw cut in order to create a neat line, no other methods will be allowed. If the contractor uses an unacceptable method to create the pavement cut, the contractor shall establish a saw cut beyond the limits of work using acceptable methodology to create a neat joint at no additional cost to the City.   

10. MAINTENANCE OF TRAFFIC‐ The Contractor shall submit a Maintenance of Traffic plan to the as part of the Work in Street Permit process.  The following procedure shall be followed for all street and sidewalk construction projects which may create obstructions to traffic movements

in accordance with Traffic Order #2844, dated August 12, 1998 – Traffic Control Procedure for Street and Sidewalk Construction. 

 a. General 

 1) The Transportation Engineering Division shall be notified not less than 72 hours 

prior to beginning street, utility or sidewalk construction. If work requires changes in bus routes, bus stops or traffic detours, a longer advance notice shall be required.  Under no circumstances shall a roadway be closed for routine construction without the approval of the City Traffic Engineer or his agent, and prior notification to the Division of Emergency Communications, telephone 646‐5123. 

 2) In case of EMERGENCY WORK during normal business hours (8:00am to 5:00pm, 

Monday‐Friday), notify the Transportation Engineering Division, telephone 646‐0442, as soon as possible. At all other times notify the Division of Emergency Communications, telephone 646‐5123, who in turn will notify Fire and Emergency Services.  

 3) Except for emergencies, no work shall be performed in the Central Business 

District (an area bounded by and including: Jackson Street on the north, Byrd Street on the south, Belvidere Street on the west, and Fourteenth Street on the east), or on major arterial, minor arterial & collector streets between the hours of 7‐9am and 4‐6pm without specific consent of the Transportation Engineering Division.  

 4) Metal plates will be required over street openings to maintain adequate traffic 

movement in order to reopen travel lanes during peak traffic periods. Metal plates and the installation thereof shall conform to DPW Policy for Temporary Steel Plate Bridging for General Utility Street Work dated April 2004. 

 5) No vehicles shall be parked on the street or in alleys, at construction sites in 

violation of “No Parking” regulations unless the vehicle is essential to the completion of the job. Whenever a traffic lane is blocked by construction work, all vehicles, equipment and materials shall be parked or stored in the same lane.    

 6) No vehicles shall be parked neither on the streets nor on the sidewalks behind 

fences and barricades on construction and demolition projects. The area behind fences and barricades, whether in the street or on the sidewalk area, is for either loading and unloading, or storage of necessary materials. Materials shall not be stored where they may cause a safety hazard by obstructing the vision of drivers and pedestrians.  

 7) Any traffic signs, signals, or pavement markings removed as a result of the 

construction shall be replaced by the contractor. Before removing any traffic control device, the Transportation Engineering Division shall be notified in order that temporary safety arrangements can be made. Any signs removed shall be

delivered to the Sign Shop, 2800 Hermitage Road by the person removing same or his agent.  

 8) All flaggers shall be certified by VDOT, the American Traffic Institute, or other 

approved entity. The contractor shall provide copies of certifications of flaggers to be used to the Project Inspector prior to the commencement of work.  Further, the flagger shall have the certification card on their person at all times while engaged in flagging operations. 

 9) The Contractor shall plan and stage operations such as to maintain access to all 

properties, especially for emergency services, at all times.  

b. Traffic Control Devices  

1) All traffic control devices shall be in conformance with the Federal Highway Administration’s Manual on Uniform Traffic Control Devices for Streets and Highways and the Virginia Department of Transportation’s Work Area Protection Manual.  

 2) The contractor shall furnish, erect and maintain all signs; barricades shall be in 

place before any work is started by the contractor.   

3) In the event that a construction site in the opinion of the Department of Police, Right‐of‐Way Management, or the Transportation Engineering Division is improperly signed, barricaded, or lighted, the contractor will be so notified. If the contractor cannot be reached immediately or fails to take necessary corrective measures, a stop work order may be issued until such corrective action is taken.  Additional time for stop work order due to improper signage will not be granted. 

 4) On streets with unlimited parking, No Parking signs shall be erected a minimum of 

72 hours in advance of the beginning of any street construction, tree spraying, tree trimming or street cleaning. Such signs shall bear the effective day and time. Signs prohibiting parking shall be placed not more than 100 feet apart. All existing regulatory signs which do not apply during construction shall be covered.  Parking Meters shall be covered with bags or temporary “No Parking” Signs approved by the Transportation Engineering Division.  

 5) All construction signing, barricades and other traffic control devices shall be 

removed promptly when the construction is completed.   

6) The contractor shall maintain all signs and barricades in the roadway in the manner prescribed. All traffic control devices shall be kept in proper position, clean and legible at all times. Damaged traffic control devices shall be repaired or replaced immediately. Paper parking regulation signs shall be affixed so they will remain legible at all times, especially during inclement weather. In the event that work is halted, all unnecessary signs will be removed.

7) Traffic signs, signals, or pavement markings called out to be relocated and removed as a result of the construction shall be replaced by the contractor.  Before removing any traffic control device, the Transportation Engineering Division shall be notified in order that temporary safety arrangements can be made. Any signs removed shall be delivered to the Sign Shop, 2800 Hermitage Road by the person removing same or his agent.  

 c. Single Lane Traffic Control 

 1) Where traffic in both directions must use a single lane for a limited distance, 

provisions must be made for alternate one‐way movement to pass vehicles through the constructed section.  At a “spot” obstruction, such as isolated pavement patch, the movement may be self‐regulating.   However, where the one‐lane movement section is of sufficient length, there must be means of coordinating movements at each end so that vehicles are not simultaneously moving in opposite directions in the section and delays are not excessive at either end. Control points at each end of the route must be chosen to permit easy passing of opposing lines of vehicles.  

 2) The following minimum lane widths should be maintained at all times:

SPECIAL PROVISION – BIRD NETTING SYSTEM PART I – GENERAL 1.1 SYSTEM DESCRIPTION

A. Design Requirements: Select appropriate size net and fastening system as determined by site conditions and mounting surface.

1.2 SUMMARY

A. Provide labor, materials and supervision to install bird control netting to the bridge structure. The bird netting shall be heavy duty and stop sparrow, starlings and pigeons from roosting in box cavity the bridge structure, and not obstruct passage from box to box.

1.3 QUALITY ASSURANCE

A. Obtain all technical information on products and installation from the manufacturer.

B. Utilize labor that is knowledgeable in bird netting product installations. C. Installer shall visit the site to gather all information of existing site conditions.

1.4 SUBMITTALS

A. Submit all descriptive information on products and installation from the manufacturer.

B. Provide warranty on Material and Installation. C. Provide samples of each type of bird netting used, including proposed fastening

methods and hardware. D. Provide statement by official indicating that they are a certified installation

company.

1.5 PRODUCT HANDLING

A. Protect bird netting products from damage before, during and after the installation.

1.6 PROJECT CONDITIONS

A. Coordination: Furnish all anchorage devices required to fasten system to and around existing building structure. Coordinate installation with existing conditions and within on-site tolerances.

B. Visit site and field measure prior to fabrication and delivery of materials. C. Provide non-destructive means to locate reinforcement tin existing concrete prior

to drilling holes for epoxy anchors.

2.2 PRODUCT DESCRIPTION

A. Color: Black 2.3 MATERIAL

A. Material: U.V. stabilized knotted polyethylene net. Flame resistant (270 Deg. F. melting point). Rot-proof, non-conductive and stable in sub zero temperatures.

B. Construction: Strand shall be comprised of 6 monofilaments, each 12/1000” thick with U.V. stabilizers added. Monofilaments are twisted together to produce a strong twine with 160-200 twists per meter.

C. Breaking Strength: ISO 1806 Protocol Mesh Test in excess of 40 lbs. Proof of Test Certification Required.

D. Sizes: As required. E. Hardware: All anchors, bolts, nuts and washers shall be 316 Stainless Steel and

all nuts shall be self-locking as necessary to prevent loosening of attachments due to live load vibrations. All remaining metal hardware or products shall be hot-dip galvanized or 316 stainless steel.

2.4 MOUNTING SYSTEMS

A. Concrete: Mounting system shall utilize epoxy anchorages with batten strips or edge cable or similar. Method shall allow netting to remain sound and flexible across the joints in boxes which are subject to thermal movement. Method is subject to approval.

PART 3 – EXECUTION 3.1 SURFACE PREPARATION

A. Surface should be thoroughly cleaned and free of bird droppings, nesting materials, rust peeling paint or other debris.

B. Remove or repair articles that may damage bird netting after installation, including overhanging foliage, brush and loose parts on the structure.

3.2 INSTALLATION

A. Installation shall be performed by a contractor with experience with bird netting. Contractor shall have completed five (5) similar jobs in the past three (3) years.

B. Install Bird Netting as recommended by the manufacturer. Bird netting shall fit the area to be protected perfectly so pest birds cannot enter the protected area, and so the netting blends perfectly with the architecture.

C. Bird netting’s correct mesh size shall be specified to ensure exclusion to the correct pest bird.

D. Bird netting shall be installed tightly and securely to ensure a long lasting installation that is visually hard to see, but shall provide for thermal movement of bridge joints without damage to the netting or the bridge.

E. Only approved fasteners shall be used for installation. Contractor shall ensure that anchors do not damage existing reinforcing steel or concrete. Contractor shall locate existing reinforcing steel by non-destructive methods prior to drilling and shall stop drilling immediately if steel is encountered and relocate holes.

3.3 INSPECTION

A. Visually inspect bird netting for any signs of poor installation, including loose fasteners or un-removed debris.

B. Immediately correct and repair as necessary.

E. Norfolk Southern – Special Provisions for Protection of Railway Interests

1. AUTHORITY OF RAILROAD ENGINEER AND SPONSOR ENGINEER:

Norfolk Southern Railway Company, hereinafter referred to as “Railroad”, and their authorizedrepresentative shall have final authority in all matters affecting the safe maintenance of railroadtraffic including the adequacy of the foundations and structures supporting the railroad tracks. ForPublic Projects impacting the Railroad, the Railroad’s Public Projects Engineer, hereinafter referred to as“Railroad Engineer”, will serve as the authorized representative of the Railroad.

The authorized representative of the Project Sponsor (“Sponsor”), hereinafter referred to as the“Sponsor’s Engineer”, shall have authority over all other matters as prescribed herein and in theProject Specifications.

The Sponsor’s Prime Contractor, hereinafter referred to as “Contractor” shall be responsible forcompleting any and all work in accordance with the terms prescribed herein and in the ProjectSpecifications. These terms and conditions are subject to change without notice, from time to time in thesole discretion of the Railroad. Contractor must request from Railroad and follow the latest version ofthese provisions prior to commencing work.

2. NOTICE OF STARTING WORK:

A. The Contractor shall not commence any work on railroad rights-of-way until he has compliedwith the following conditions:

1. Signed and received a fully executed copy of the required Norfolk Southern ContractorRight of Entry Agreement.

2. Given the Railroad written notice in electronic format to the Railroad Engineer, withcopy to the Sponsor’s Engineer who has been designated to be in charge of the work, atleast ten days in advance of the date he proposes to begin work on Railroad rights-of-way.

3. Obtained written approval from the Railroad of Railroad Protective Liability Insurancecoverage as required by paragraph 14 herein. It should be noted that the Railroaddoes not accept notation of Railroad Protective insurance on a certificate ofliability insurance form or Binders as Railroad must have the full originalcountersigned policy. Further, please note that mere receipt of the policy is notthe only issue but review for compliance. Due to the number of projects system-wide, it typically takes a minimum of 30-45 days for the Railroad to review.

4. Obtained Railroad’s Flagging Services as required by paragraph 7 herein.

5. Obtained written authorization from the Railroad to begin work on Railroad’srights-of-way, such authorization to include an outline of specific conditions withwhich he must comply.

6. Furnished a schedule for all work within the Railroad’s rights-of-way as required byparagraph 7.B.1.

B. The Railroad’s written authorization to proceed with the work shall include the names,addresses, and telephone numbers of the Railroad’s representatives who are to benotified as hereinafter required. Where more than one representative is designated, the areaof responsibility of each representative shall be specified.

3. INTERFERENCE WITH RAILROAD OPERATIONS:

A. The Contractor shall so arrange and conduct his work that there will be no interference withRailroad’s operations, including train, signal, telephone and telegraphic services, or damage tothe property of the Railroad or to poles, wires, and other facilities of tenants on the rights-of-way of the Railroad. Whenever work is liable to affect the operations or safety oftrains, the method of doing such work shall first be submitted to the Railroad Engineer forapproval, but such approval shall not relieve the Contractor from liability. Any work to beperformed by the Contractor which requires flagging service or inspection service shall bedeferred by the Contractor until the flagging service or inspection service required by theRailroad is available at the job site.

B. Whenever work within Railroad’s rights-of-way is of such a nature that impediment toRailroad’s operations such as use of runaround tracks or necessity for reduced speed isunavoidable, the Contractor shall schedule and conduct his operations so that suchimpediment is reduced to the absolute minimum.

C. Should conditions arising from, or in connection with the work, require that immediate andunusual provisions be made to protect operations and property of the Railroad, theContractor shall make such provisions. If in the judgment of the Railroad Engineer, or inhis absence, the Railroad’s Division Engineer, such provisions is insufficient, either mayrequire or provide such provisions as he deems necessary. In any event, such unusual provisionsshall be at the Contractor’s expense and without cost to the Railroad or the Sponsor.

D. “One Call” Services do not locate buried Railroad utilities. The contractor shall contact theRailroad’s representative 2 days in advance of work at those places where excavation, piledriving, or heavy loads may damage the Railroad’s underground facilities. Upon request from theContractor or Sponsor, Railroad forces will locate and paint mark or flag the Railroad’sunderground facilities. The Contractor shall avoid excavation or other disturbances of thesefacilities. If disturbance or excavation is required near a buried Railroad facility, the contractorshall coordinate with the Railroad to have the facility potholed manually with careful handexcavation. The facility shall be protected by the Contractor during the course of the disturbanceunder the supervision and direction of the Railroad’s representative.

4. TRACK CLEARANCES:

A. The minimum track clearances to be maintained by the Contractor during construction areshown on the Project Plans. If temporary clearances are not shown on the project plans, thefollowing criteria shall govern the use of falsework and formwork above or adjacent to operatedtracks.

1. A minimum vertical clearance of 22’-0” above top of highest rail shall be maintained atall times.

2. A minimum horizontal clearance of 13’-0” from centerline of tangent track or 14’-0”from centerline of curved track shall be maintained at all times. Additional horizontal

clearance may be required in special cases to be safe for operating conditions. Thisadditional clearance will be as determined by the Railroad Engineer.

3. All proposed temporary clearances which are less than those listed above must besubmitted to Railroad Engineer for approval prior to construction and must also beauthorized by the regulatory body of the State if less than the legally prescribedclearances.

4. The temporary clearance requirements noted above shall also apply to all other physicalobstructions including, but not limited to: stockpiled materials, parked equipment,placement or driving of piles, and bracing or other construction supports.

B. Before undertaking any work within Railroad right-of-way, and before placing anyobstruction over any track, the Contractor shall:

1. Notify the Railroad’s representative at least 72 hours in advance of the work.

2. Receive assurance from the Railroad’s representative that arrangementshave been made for flagging service as may be necessary.

3. Receive permission from the Railroad’s representative to proceed with the work.

4. Ascertain that the Sponsor’s Engineer has received copies of notice to the Railroad andof the Railroad’s response thereto.

5. CONSTRUCTION PROCEDURES:

A. General:

1. Construction work and operations by the Contractor on Railroad property shall be:

a. Subject to the inspection and approval of the Railroad Engineer or theirdesignated Construction Engineering Representative.

b. In accordance with the Railroad’s written outline of specific conditions.

c. In accordance with the Railroad’s general rules, regulations andrequirements including those relating to safety, fall protection and personalprotective equipment.

d. In accordance with these Special Provisions.

2. Submittal Requirements

a. The Contractor shall submit all construction related correspondence andsubmittals electronically to the Railroad Engineer.

b. The Contractor shall allow for 30 days for the Railroad’s review and response.

c. All work in the vicinity of the Railroad’s property that has the potential to affectthe Railroad’s train operations or disturb the Railroad’s Property must besubmitted and approved by the Railroad prior to work being performed.

d. All submittals and calculations must be signed and sealed by a registeredengineer licensed in the state of the project work.

e. All submittals shall first be approved by the Sponsor’s Engineer and theRailroad Engineer, but such approval shall not relieve the Contractor fromliability.

f. For all construction projects, the following submittals, but not limited to thoselisted below, shall be provided for review and approval when applicable:

(1) General Means and Methods(2) Ballast Protection(3) Construction Excavation & Shoring(4) Pipe, Culvert, & Tunnel Installations(5) Demolition Procedure(6) Erection & Hoisting Procedure(7) Debris Shielding or Containment(8) Blasting(9) Formwork for the bridge deck, diaphragms, overhang brackets, and

protective platforms(10) Bent Cap Falsework. A lift plan will be required if the contractor want

to move the falsework over the tracks.

g. For Undergrade Bridges (Bridges carrying the Railroad) the following submittalsin addition to those listed above shall be provided for review and approval:

(1) Shop Drawings(2) Bearing Shop Drawings and Material Certifications(3) Concrete Mix Design(4) Structural Steel, Rebar, and/or Strand Certifications(5) 28 day Cylinder Test for Concrete Strength(6) Waterproofing Material Certification(7) Test Reports for Fracture Critical Members(8) Foundation Construction Reports

Fabrication may not begin until the Railroad has approved the required shopdrawings.

h. The Contractor shall include in all submissions a detailed narrative indicatingthe progression of work with the anticipated timeframe to complete each task.Work will not be permitted to commence until the Contractor has provided theRailroad with a satisfactory plan that the project will be undertaken withoutscheduling, performance or safety related issues. Submission shall also providea listing of the anticipated equipment to be used, the location of all equipmentto be used and insure a contingency plan of action is in place should a primarypiece of equipment malfunction.

B. Ballast Protection

1. The Contractor shall submit the proposed ballast protection system detailing the specificfilter fabric and anchorage system to be used during all construction activities.

2. The ballast protection is to extend 25’ beyond the proposed limit of work, be installed atthe start of the project and be continuously maintained to prevent all contaminantsfrom entering the ballast section of all tracks for the entire duration of the project.

C. Excavation:

1. The subgrade of an operated track shall be maintained with edge of berm at least 10’-0”from centerline of track and not more than 24-inches below top of rail. Contractor willnot be required to make existing section meet this specification if substandard,in which case existing section will be maintained.

2. Additionally, the Railroad will require the installation of an OSHA approved handrail andorange construction safety fencing for all excavations of the Railroad right-of-way.

D. Excavation for Structures and Shoring Protection:

1. The Contractor will be required to take special precaution and care in connectionwith excavating and shoring pits, and in driving piles or sheeting for footings adjacentto tracks to provide adequate lateral support for the tracks and the loads whichthey carry, without disturbance of track alignment and surface, and to avoidobstructing track clearances with working equipment, tools or other material.

2. All plans and calculations for shoring shall be prepared, signed, and sealed by aRegistered Professional Engineer licensed in the state of the proposed project, inaccordance with Norfolk Southern’s Overhead Grade Separation Design Criteria,subsection H.1.6.E-Construction Excavation (Refer to Norfolk Southern Public ProjectsManual Appendix H). The Registered Professional Engineer will be responsible for theaccuracy for all controlling dimensions as well as the selection of soil design valueswhich will accurately reflect the actual field conditions.

3. The Contractor shall provide a detailed installation and removal plan of the shoringcomponents. Any component that will be installed via the use of a crane or any otherlifting device shall be subject to the guidelines outlined in section 5.G of theseprovisions.

4. The Contractor shall be required to survey the track(s) and Railroad embankment andprovide a cross section of the proposed excavation in relation to the tracks.

5. Calculations for the proposed shoring should include deflection calculations. Themaximum deflection for excavations within 18’-0” of the centerline of the nearest trackshall be 3/8”. For all other cases, the max deflection shall not exceed ½”.

6. Additionally, the Railroad will require the installation of an OSHA approved handrail andorange construction safety fencing for all excavations of the Railroad right-of-way.

7. The front face of shoring located to the closest NS track for all shoring set-ups locatedin Zone 2 as shown on NS Typical Drawing No. 4 – Shoring Requirements (Appendix I)shall remain in place and be cut off 2’-0” below the final ground elevation. Theremaining shoring in Zone 2 and all shoring in Zone 1 may be removed and all voidsmust be backfilled with flowable fill.

E. Pipe, Culvert, & Tunnel Installations

1. Pipe, Culvert, & Tunnel Installations shall be in accordance with the appropriate NorfolkSouthern Design Specification as noted below:

a. For Open Cut Method refer to Norfolk Southern Public Projects ManualAppendix H.4.6.

b. For Jack and Bore Method refer to Norfolk Southern Public Projects ManualAppendix H.4.7.

c. For Tunneling Method refer to Norfolk Southern Public Projects ManualAppendix H.4.8.

2. The installation methods provided are for pipes carrying storm water or open flow run-off. All other closed pipeline systems shall be installed in accordance Norfolk Southern’sPipe and Wire Program and the NSCE-8

F. Demolition Procedures

1. General

a. Demolition plans are required for all spans over the track(s), for all spansadjacent to the track(s), if located on (or partially on) Railroad right-of-way; andin all situations where cranes will be situated on, over, or adjacent to Railroadright-of-way and within a distance of the boom length plus 15’-0” from thecenterline of track.

b. Railroad tracks and other Railroad property must be protected from damageduring the procedure.

c. A pre-demolition meeting shall be conducted with the Sponsor, the RailroadEngineer or their representative, and the key Contractor’s personnel prior tothe start of the demolition procedure.

d. The Railroad Engineer or his designated representative must be present atthe site during the entire demolition procedure period.

e. Existing, obsolete, bridge piers shall be removed to a sufficient depth belowgrade to enable restoration of the existing/proposed track ditch, but in no caseless than 2’-0” below final grade.

2. Submittal Requirements

a. In addition to the submittal requirements outlined in Section 5.A.2 of theseprovisions, the Contractor shall submit the following for approval by theRailroad Engineer:

(1) A plan showing the location of cranes, horizontally and vertically,operating radii, with delivery or disposal locations shown. Thelocation of all tracks and other Railroad facilities as well as allobstructions such as wire lines, poles, adjacent structures, etc. mustalso be shown.

(2) Rating sheets showing cranes or lifting devices to be adequate for150% of the actual weight of the pick, including all riggingcomponents. A complete set of crane charts, including crane,counterweight, and boom nomenclature is to be submitted. Safetyfactors that may have been “built-in” to the crane charts are not to beconsidered when determining the 150% factor of safety.

(3) Plans and computations showing the weight of the pick must besubmitted. Calculations shall be made from plans of the existingstructure showing complete and sufficient details with supportingdata for the demolition the structure. If plans do not exist, liftingweights must be calculated from field measurements. The fieldmeasurements are to be made under the supervision of theRegistered Professional Engineer submitting the procedure andcalculations.

(4) The Contractor shall provide a sketch of all rigging components fromthe crane’s hook block to the beam. Catalog cuts or informationsheets of all rigging components with their lifting capacities shall beprovided. All rigging must be adequate for 150% of the actual weightof the pick. Safety factors that may have been “built-in” to the ratingcharts are not to be considered when determining the 150% factor ofsafety. All rigging components shall be clearly identified and taggedwith their rated lifting capacities. The position of the rigging in thefield shall not differ from what is shown on the final plan without priorreview from the Sponsor and the Railroad.

(5) A complete demolition procedure, including the order of lifts, timerequired for each lift, and any repositioning or re-hitching of the craneor cranes.

(6) Design and supporting calculations for the temporary support ofcomponents, including but not limited to the stability of thesuperstructure during the temporary condition, temporary girder tie-downs and falsework.

3. Overhead Demolition Debris Shield

a. The demolition debris shield shall be installed prior to the demolition of thebridge deck or other relevant portions of the superstructure over the track areato catch all falling debris.

b. The demolition debris shield shall provide a minimum vertical clearance asspecified in Section 4.A.1 of these provisions or maintain the existing verticalclearance if the existing clearance is less than that specified in Section 4.A.1.

c. The Contractor shall include the demolition debris shield installation/removalmeans and methods as part of the proposed Demolition procedure submission.

d. The Contractor shall submit the demolition debris shield design and supportingcalculations for approval by the Railroad Engineer.

e. The demolition debris shield shall have a minimum design load of 50 poundsper square foot plus the weight of the equipment, debris, personnel, and otherloads to be carried.

f. The Contractor shall include the proposed bridge deck removal procedure inits demolition means and methods and shall verify that the size and quantity ofthe demolition debris generated by the procedure does not exceed the shielddesign loads.

g. The Contractor shall clean the demolition debris shield daily or morefrequently as dictated either by the approved design parameters or as directedby the Railroad Engineer.

4. Vertical Demolition Debris Shield

a. A vertical demolition debris shield may be required for substructure removalsin close proximity to the Railroad’s track and other facilities, as determined bythe Railroad Engineer.

G. Erection & Hoisting Procedures

1. General

a. Erection plans are required for all spans over the track(s), for all spans adjacentto the track(s), if located on (or partially on) Railroad right-of-way; and in allsituations where cranes will be situated on, over, or adjacent to Railroad right-of-way and within a distance of the boom length plus 15’-0” from thecenterline of track.

b. Railroad tracks and other Railroad property must be protected from damageduring the erection procedure.

c. A pre-erection meeting shall be conducted with the Sponsor, the RailroadEngineer or their representative, and the key Contractor’s personnel prior tothe start of the erection procedure.

d. The Railroad Engineer or his designated representative must be present atthe site during the entire erection procedure period.

e. For field splices located over Railroad property, a minimum of 50% of the holesfor each connection shall be filled with bolts or pins prior to releasing thecrane. A minimum of 50% of the holes filled shall be filled with bolts. All boltsmust be appropriately tightened. Any changes to previously approved fieldsplice locations must be submitted to the Railroad for review and approval.Refer to Norfolk Southern’s Overhead Grade Separation Design Criteria foradditional splice details (Norfolk Southern Public Projects Manual AppendixH.1, Section 4.A.3.).

2. Submittal Requirements

a. In addition the submittal requirements outlined in Section 5.A.2 of theseprovisions, the Contractor shall submit the following for approval by theRailroad Engineer:

(1) As-built beam seat elevations - All as-built bridge seats and top of railelevations shall be furnished to the Railroad Engineer for review andverification at least 30 days in advance of the erection, to ensure thatminimum vertical clearances as approved in the plans will be achieved.

(2) A plan showing the location of cranes, horizontally and vertically,operating radii, with delivery or staging locations shown. The locationof all tracks and other Railroad facilities as well as all obstructions suchas wire lines, poles, adjacent structures, etc. must also be shown.

(3) Rating sheets showing cranes or lifting devices to be adequate for150% of the actual weight of the pick, including all riggingcomponents. A complete set of crane charts, including crane,counterweight, and boom nomenclature is to be submitted. Safetyfactors that may have been “built-in” to the crane charts are not to beconsidered when determining the 150% factor of safety.

(4) Plans and computations showing the weight of the pick must besubmitted. Calculations shall be made from plans of theproposed structure showing complete and sufficient details withsupporting data for the erection of the structure. If plans do notexist, lifting weights must be calculated from field measurements.The field measurements are to be made under the supervision ofthe Registered Professional Engineer submitting the procedure andcalculations.

(5) The Contractor shall provide a sketch of all rigging components fromthe crane’s hook block to the beam. Catalog cuts or informationsheets of all rigging components with their lifting capacities shall beprovided. All rigging must be adequate for 150% of the actual weightof the pick. Safety factors that may have been “built-in” to the ratingcharts are not to be considered when determining the 150% factor ofsafety. All rigging components shall be clearly identified and taggedwith their rated lifting capacities. The position of the rigging in thefield shall not differ from what is shown on the final plan without priorreview from the Sponsor and the Railroad.

(6) A complete erection procedure, including the order of lifts, timerequired for each lift, and any repositioning or re-hitching of the craneor cranes.

(7) Design and supporting calculations for the temporary support ofcomponents, including but not limited to temporary girder tie-downsand falsework.

H. Blasting:

1. The Contractor shall obtain advance approval of the Railroad Engineer and theSponsor Engineer for use of explosives on or adjacent to Railroad property. Therequest for permission to use explosives shall include a detailed blasting plan. Ifpermission for use of explosives is granted, the Contractor will be required tocomply with the following:

a. Blasting shall be done with light charges under the direct supervision of aresponsible officer or employee of the Contractor and a licensed blaster.

b. Electric detonating fuses shall not be used because of the possibility ofpremature explosions resulting from operation of two-way radios.

c. No blasting shall be done without the presence of the Railroad Engineer or hisauthorized representative. At least 72 hours advance notice to the persondesignated in the Railroad’s notice of authorization to proceed (seeparagraph 2.B) will be required to arrange for the presence of an authorizedRailroad representative and such flagging as the Railroad may require.

d. Have at the job site adequate equipment, labor and materials and allowsufficient time to clean up debris resulting from the blasting without delay totrains, as well as correcting at his expense any track misalignment or otherdamage to Railroad property resulting from the blasting as directed bythe Railway’s authorized representative. If his actions result in delay oftrains, the Contractor shall bear the entire cost thereof.

e. The blasting Contractor shall have a copy of the approved blasting plan on handwhile on the site.

f. Explosive materials or loaded holes shall not be left unattended at the blastsite.

g. A seismograph shall be placed on the track shoulder adjacent to each blastwhich will govern the peak particle velocity of two inches per second.Measurement shall also be taken on the ground adjacent to structures asdesignated by a qualified and independent blasting consultant. The Railroadreserves the option to direct the placement of additional seismographs atstructures or other locations of concern, without regard to scaled distance.

h. After each blast, the blasting Contractor shall provide a copy of their drill logand blast report, which includes number of holes, depth of holes, number ofdecks, type and pounds of explosives used per deck.

i. The Railroad may require top of rail elevations and track centers taken before,during and after the blasting and excavation operation to check for any trackmisalignment resulting from the Contractor’s activities.

2. The Railroad representative will:

a. Determine approximate location of trains and advise the Contractor theappropriate amount of time available for the blasting operation and cleanup.

b. Have the authority to order discontinuance of blasting if, in his opinion, blastingis too hazardous or is not in accord with these special provisions.

3. The Contractor must hire, at no expense to the Railroad, a qualified and independentblasting consultant to oversee the use of explosives. The blasting consultant will:

a. Review the Contractor’s proposed drilling and loading patterns, and with theblasting consultant’s personnel and instruments, monitor the blastingoperations.

b. Confirm that the minimum amounts of explosives are used to remove the rock.

c. Be empowered to intercede if he concludes that the Contractor’s blastingoperations are endangering the Railway.

d. Submit a letter acknowledging that he has been engaged to oversee the entireblasting operation and that he approves of the blasting plan.

e. Furnish copies of all vibration readings to the Railroad representativeimmediately after each blast. The representative will sign and date theseismograph tapes after each shot to verify the readings are for that specificshot.

f. Advise the Railroad representative as to the safety of the operation and notifyhim of any modifications to the blasting operation as the work progresses.

4. The request for permission to use explosives on the Railroad’s Right-of-Way shallinclude a blasting proposal providing the following details:

a. A drawing which shows the proposed blasting area, location of nearest holeand distance to Railway structures, all with reference to the centerline of track.

b. Hole diameter.

c. Hole spacing and pattern.

d. Maximum depth of hole.

e. Maximum number of decks per hole.

f. Maximum pounds of explosives per hole.

g. Maximum pounds of explosives per delay.

h. Maximum number of holes per detonation.

i. Type of detonator and explosives to be used. (Electronic detonating deviceswill not be permitted). Diameter of explosives if different from hole diameter.

j. Approximate dates and time of day when the explosives are to be detonated.

k. Type of flyrock protection.

l. Type and patterns of audible warning and all clear signals to be used beforeand after each blast.

m. A copy of the blasting license and qualifications of the person directly in chargeof the blasting operation, including their name, address and telephone number.

n. A copy of the Authority’s permit granting permission to blast on the site.

o. A letter from the blasting consultant acknowledging that he has been engagedto oversee the entire blasting operation and that he approves of the blastingplan.

p. In addition to the insurance requirements outlined in Paragraph 14 of theseProvisions, A certificate of insurance from the Contractor’s insurer stating theamount of coverage for XCU (Explosive Collapse and Underground Hazard)insurance and that XCU Insurance is in force for this project.

q. A copy of the borings and Geotechnical information or report.

I. Track Monitoring

1. At the direction of the Railroad Engineer, any activity that has the potential to disturbthe Railroad track structure may require the Contractor to submit a detailed trackmonitoring program for approval by the Railroad Engineer.

2. The program shall specify the survey locations, the distance between the locationpoints, and frequency of monitoring before, during, and after construction. Railroadreserves the right to modify the survey locations and monitoring frequency as necessaryduring the project.

3. The survey data shall be collected in accordance with the approved frequency andimmediately furnished to the Railroad Engineer for analysis.

4. If any movement has occurred as determined by the Railroad Engineer, the Railroad willbe immediately notified. Railroad, at its sole discretion, shall have the right toimmediately require all Contractor operations to be ceased and determine whatcorrective action is required. Any corrective action required by the Railroad orperformed by the Railroad including the monitoring of corrective action of theContractor will be at project expense.

J. Maintenance of Railroad Facilities:

1. The Contractor will be required to maintain all ditches and drainage structures free ofsilt or other obstructions which may result from his operations and provide andmaintain any erosion control measures as required. The Contractor will promptly

repair eroded areas within Railroad rights-of-way and repair any other damage to theproperty of the Railroad or its tenants.

2. If, in the course of construction, it may be necessary to block a ditch, pipe or otherdrainage facility, temporary pipes, ditches or other drainage facilities shall be installedto maintain adequate drainage, as approved by the Railroad Engineer. Upon completionof the work, the temporary facilities shall be removed and the permanent facilitiesrestored.

3. All such maintenance and repair of damages due to the Contractor’s operations shall bedone at the Contractor’s expense.

K. Storage of Materials and Equipment:

1. Materials and equipment shall not be stored where they will interfere withRailroad operations, nor on the rights-of-way of the Railroad without first havingobtained permission from the Railroad Engineer, and such permission will be withthe understanding that the Railroad will not be liable for damage to such material andequipment from any cause and that the Railroad Engineer may move or require theContractor to move, at the Contractor’s expense, such material and equipment.

2. All grading or construction machinery that is left parked near the trackunattended by a watchman shall be effectively immobilized so that it cannot be movedby unauthorized persons. The Contractor shall protect, defend, indemnify andsave Railroad, and any associated, controlled or affiliated corporation, harmlessfrom and against all losses, costs, expenses, claim or liability for loss or damage toproperty or the loss of life or personal injury, arising out of or incident to theContractor’s failure to immobilize grading or construction machinery.

L. Cleanup:

1. Upon completion of the work, the Contractor shall remove from within the limits of theRailroad rights-of-way, all machinery, equipment, surplus materials, falsework, rubbishor temporary buildings of the Contractor, and leave said rights-of-way in a neatcondition satisfactory to the Railroad Engineer or his authorized representative.

6. DAMAGES:

A. The Contractor shall assume all liability for any and all damages to his work, employees, servants,equipment and materials caused by Railroad traffic.

B. Any cost incurred by the Railroad for repairing damages to its property or to property of itstenants, caused by or resulting from the operations of the Contractor, shall be paid directlyto the Railroad by the Contractor.

7. FLAGGING SERVICES:

A. Requirements:

1. Flagging services will not be provided until the Contractor’s insurance has beenreviewed & approved by the Railroad.

2. Under the terms of the agreement between the Sponsor and the Railroad, the Railroadhas sole authority to determine the need for flagging required to protect its operations.In general, the requirements of such services will be whenever the Contractor’spersonnel or equipment are or are likely to be, working on the Railroad’s right-of-way, or across, over, adjacent to, or under a track, or when such work hasdisturbed or is likely to disturb a Railroad structure or the Railroad roadbed orsurface and alignment of any track to such extent that the movement of trainsmust be controlled by flagging.

3. Normally, the Railroad will assign one flagman to a project; but in some cases,more than one may be necessary, such as yard limits where three (3) flagmen may berequired. However, if the Contractor works within distances that violateinstructions given by the Railroad’s authorized representative or performs workthat has not been scheduled with the Railroad’s authorized representative, aflagman or flagmen may be required full time until the project has been completed.

4. For Projects exceeding 30 days of construction, Contractor shall provide the flagmen asmall work area with a desk/counter and chair within the field/site trailer, including theuse of bathroom facilities, where the flagman can check in/out with the Project, as wellas to the flagman’s home terminal. The work area should provide access to two (2)electrical outlets for recharging radio(s), and a laptop computer; and have the ability toprint off needed documentation and orders as needed at the field/site trailer. Thisshould aid in maximizing the flagman’s time and efficiency on the Project.

B. Scheduling and Notification:

1. The Contractor’s work requiring Railroad flagging should be scheduled to limit thepresence of a flagman at the site to a maximum of 50 hours per week. TheContractor shall receive Railroad approval of work schedules requiring a flagman’spresence in excess of 40 hours per week.

2. Not later than the time that approval is initially requested to begin work onRailroad right-of-way, Contractor shall furnish to the Railroad and the Sponsor aschedule for all work required to complete the portion of the project within Railroadright-of-way and arrange for a job site meeting between the Contractor, theSponsor, and the Railroad’s authorized representative. Flagman or Flagmen may not beprovided until the job site meeting has been conducted and the Contractor’s workscheduled.

3. The Contractor will be required to give the Railroad representative at least 10 workingdays of advance written notice of intent to begin work within Railroad right-of-way in accordance with this special provision. Once begun, when such work isthen suspended at any time, or for any reason, the Contractor will be required togive the Railroad representative at least 3 working days of advance notice beforeresuming work on Railroad right-of-way. Such notices shall include sufficient detailsof the proposed work to enable the Railroad representative to determine if flagging willbe required. If such notice is in writing, the Contractor shall furnish the Engineer acopy; if notice is given verbally, it shall be confirmed in writing with copy to theEngineer. If flagging is required, no work shall be undertaken until the flagman, orflagmen are present at the job site. It may take up to 30 days to obtain flagginginitially from the Railroad. When flagging begins, the flagman is usually assignedby the Railroad to work at the project site on a continual basis until no longer

needed and cannot be called for on a spot basis. If flagging becomes unnecessaryand is suspended, it may take up to 30 days to again obtain from the Railroad.Due to Railroad labor agreements, it is necessary to give 5 working days notice beforeflagging service may be discontinued and responsibility for payment stopped.

4. If, after the flagman is assigned to the project site, an emergency arises thatrequires the flagman’s presence elsewhere, then the Contractor shall delay work onRailroad right-of-way until such time as the flagman is again available. Any additionalcosts resulting from such delay shall be borne by the Contractor and not the Sponsor orRailroad.

C. Payment:

1. The Sponsor will be responsible for paying the Railroad directly for any and all costs offlagging which may be required to accomplish the construction.

2. The estimated cost of flagging is the current rate per day based on a 10-hour work day.This cost includes the base pay for the flagman, overhead, and includes a per diemcharge for travel expenses, meals and lodging. The charge to the Sponsor by theRailroad will be the actual cost based on the rate of pay for the Railroad’s employeeswho are available for flagging service at the time the service is required.

3. Work by a flagman in excess of 8 hours per day or 40 hours per week, but not more than12 hours a day will result in overtime pay at 1 and 1/2 times the appropriate rate.Work by a flagman in excess of 12 hours per day will result in overtime at 2 timesthe appropriate rate. If work is performed on a holiday, the flagging rate is 2 and 1/2times the normal rate.

4. Railroad work involved in preparing and handling bills will also be charged to theSponsor. Charges to the Sponsor by the Railroad shall be in accordance withapplicable provisions of Subchapter B, Part 140, Subpart I and Subchapter G, Part646, Subpart B of the Federal-Aid Policy Guide issued by the Federal HighwayAdministration on December 9, 1991, including all current amendments. Flaggingcosts are subject to change. The above estimates of flagging costs are provided forinformation only and are not binding in any way.

D. Verification:

1. Railroad’s flagman will electronically enter flagging time via Railroad’s electronicbilling system. Any complaints concerning flagging must be resolved in a timelymanner. If the need for flagging is questioned, please contact the Railroad Engineer.All verbal complaints will be confirmed in writing by the Contractor within 5working days with a copy to the Sponsor’s Engineer. Address all writtencorrespondence electronically to Railroad Engineer.

2. The Railroad flagman assigned to the project will be responsible for notifying theSponsor Engineer upon arrival at the job site on the first day (or as soon thereafter aspossible) that flagging services begin and on the last day that he performs such servicesfor each separate period that services are provided. The Sponsor’s Engineer willdocument such notification in the project records. When requested, the Sponsor’sEngineer will also sign the flagman’s diary showing daily time spent and activity at theproject site.

8. HAUL ACROSS RAILROAD TRACK:

A. Where the plans show or imply that materials of any nature must be hauled across Railroad’strack, unless the plans clearly show that the Sponsor has included arrangements for suchhaul in its agreement with the Railroad, the Contractor will be required to make all necessaryarrangements with the Railroad regarding means of transporting such materials acrossthe Railroad’s track. The Contractor or Sponsor will be required to bear all costs incidental tosuch crossings whether services are performed by his own forces or by Railroad personnel.

B. No crossing may be established for use of the Contractor for transporting materials orequipment across the tracks of the Railroad unless specific authority for its installation,maintenance, necessary watching and flagging thereof and removal, until a temporary privatecrossing agreement has been executed between the Contractor and Railroad. The approvalprocess for an agreement normally takes 90 days.

9. WORK FOR THE BENEFIT OF THE CONTRACTOR:

A. All temporary or permanent changes in wire lines or other facilities which are considerednecessary to the project are shown on the plans; included in the force account agreementbetween the Sponsor and the Railroad or will be covered by appropriate revisions to samewhich will be initiated and approved by the Sponsor and/or the Railroad.

B. Should the Contractor desire any changes in addition to the above, then he shall make separatearrangements with the Railroad for same to be accomplished at the Contractor’s expense.

10. COOPERATION AND DELAYS:

A. It shall be the Contractor’s responsibility to arrange a schedule with the Railroad foraccomplishing stage construction involving work by the Railroad or tenants of theRailroad. In arranging his schedule he shall ascertain, from the Railroad, the lead timerequired for assembling crews and materials and shall make due allowance therefore.

B. No charge or claim of the Contractor against either the Sponsor or the Railroad will be allowedfor hindrance or delay on account of railroad traffic; any work done by the Railroad orother delay incident to or necessary for safe maintenance of railroad traffic or for anydelays due to compliance with these special provisions.

11. TRAINMAN’S WALKWAYS:

A. Along the outer side of each exterior track of multiple operated track, and on each side of singleoperated track, an unobstructed continuous space suitable for trainman’s use in walkingalong trains, extending to a line not less than 10 feet from centerline of track, shall bemaintained. Any temporary impediments to walkways and track drainage encroachments orobstructions allowed during work hours while Railroad’s protective service is provided shallbe removed before the close of each work day. If there is any excavation near thewalkway, a handrail, with 10’-0” minimum clearance from centerline of track, shall be placedand must conform to AREMA and/or FRA standards.

12. GUIDELINES FOR PERSONNEL ON RAILROAD RIGHT-OF-WAY:

A. The Contractor and/or the Sponsor’s personnel authorized to perform work on Railroad’sproperty as specified in Section 2 above are not required to complete Norfolk Southern Roadway

Worker Protection Training; However the Contractor and the Sponsor’s personnel must befamiliar with Norfolk Southern’s standard operating rules and guidelines, should conductthemselves accordingly, and may be removed from the property for failure to follow theseguidelines.

B. All persons shall wear hard hats. Appropriate eye and hearing protection must be used.Working in shorts is prohibited. Shirts must cover shoulders, back and abdomen. Working intennis or jogging shoes, sandals, boots with high heels, cowboy and other slip-on type boots isprohibited. Hard-sole, lace-up footwear, zippered boots or boots cinched up with strapswhich fit snugly about the ankle are adequate. Wearing of safety boots is stronglyrecommended. In the vicinity of at-grade crossings, it is strongly recommended thatreflective vests be worn.

C. No one is allowed within 25’ of the centerline of track without specific authorization fromthe flagman.

D. All persons working near track while train is passing are to lookout for dragging bands,chains and protruding or shifted cargo.

E. No one is allowed to cross tracks without specific authorization from the flagman.

F. All welders and cutting torches working within 25’ of track must stop when train is passing.

G. No steel tape or chain will be allowed to cross or touch rails without permission from theRailroad.

13. GUIDELINES FOR EQUIPMENT ON RAILROAD RIGHT-OF-WAY:

A. No crane or boom equipment will be allowed to set up to work or park within boom distanceplus 15’ of centerline of track without specific permission from Railroad official and flagman.

B. No crane or boom equipment will be allowed to foul track or lift a load over the track withoutflag protection and track time.

C. All employees will stay with their machines when crane or boom equipment is pointed towardtrack.

D. All cranes and boom equipment under load will stop work while train is passing (includingpile driving).

E. Swinging loads must be secured to prevent movement while train is passing.

F. No loads will be suspended above a moving train.

G. No equipment will be allowed within 25’ of centerline of track without specificauthorization of the flagman.

H. Trucks, tractors or any equipment will not touch ballast line without specific permission fromRailroad official and flagman. Orange construction fencing may be required as directed.

I. No equipment or load movement within 25’ or above a standing train or Railroadequipment without specific authorization of the flagman.

J. All operating equipment within 25’ of track must halt operations when a train is passing.All other operating equipment may be halted by the flagman if the flagman views theoperation to be dangerous to the passing train.

K. All equipment, loads and cables are prohibited from touching rails.

L. While clearing and grubbing, no vegetation will be removed from Railroad embankmentwith heavy equipment without specific permission from the Railroad Engineer and flagman.

M. No equipment or materials will be parked or stored on Railroad’s property unless specificauthorization is granted from the Railroad Engineer.

N. All unattended equipment that is left parked on Railroad property shall be effectivelyimmobilized so that it cannot be moved by unauthorized persons.

O. All cranes and boom equipment will be turned away from track after each work day or wheneverunattended by an operator.

P. Prior to performing any crane operations, the Contractor shall establish a single point of contactfor the Railroad flagman to remain in communication with at all times. Person must also be indirect contact with the individual(s) directing the crane operation(s).

14. INSURANCE:

A. In addition to any other forms of insurance or bonds required under the terms of the contractand specifications, the Prime Contractor will be required to carry insurance of the following kindsand amounts:

1. a. Commercial General Liability Insurance having a combined single limit of notless than $2,000,000 per occurrence for all loss, damage, cost and expense, includingattorneys' fees, arising out of bodily injury liability and property damage liability duringthe policy period. Said policy shall include explosion, collapse, and underground hazard(XCU) coverage, shall be endorsed to name Railroad specified in item A.2.c. below bothas the certificate holder and as an additional insured, and shall include a severability ofinterests provision.

b. Automobile Liability Insurance with a combined single limit of not lessthan $1,000,000 each occurrence for injury to or death of persons and damage to or lossor destruction of property. Said policy or policies shall be endorsed to name Railroadspecified in item A.2.c. below both as the certificate holder and as an additional insuredand shall include a severability of interests provision.

2. Railroad Protective Liability Insurance having a combined single limit of not less than$2,000,000 each occurrence and $6,000,000 in the aggregate applying separately toeach annual period. If the project involves track over which passenger trains operate,the insurance limits required are not less than a combined single limit of $5,000,000each occurrence and $10,000,000 in the aggregate applying separately to each annualperiod. Said policy shall provide coverage for all loss, damage or expense arising from

The standards for the Railroad Protective Liability Insurance are as follows:

a. The insurer must be rated A- or better by A.M. Best Company, Inc.NOTE: NS does not accept from insurers Chartis (AIG or Affiliated Companyincluding Lexington Insurance Company), Hudson Group or Liberty orAffiliated Company, American Contractors Insurance Company and ErieInsurance Company including Erie Insurance Exchange and Erie IndemnityCompany.

b. The policy must be written using one of the following combinations ofInsurance Services Office (“ISO”) Railroad Protective Liability Insurance FormNumbers:

(1) CG 00 35 01 96 and CG 28 31 10 93; or(2) CG 00 35 07 98 and CG 28 31 07 98; or(3) CG 00 35 10 01; or(4) CG 00 35 12 04; or(5) CG 00 35 12 07; or(6) CG 00 35 04 13.

c. The named insured shall read:

In addition, certificates of insurance evidencing the Prime Contractor’s and anysubcontractors’ Commercial General Liability Insurance shall be issued to the Railroad and theDepartment at the addresses below, and forwarded to the Department for its review andtransmittal to the Railroad. The certificates of insurance shall state that the insurance coveragewill not be suspended, voided, canceled, or reduced in coverage or limits without (30) daysadvance written notice to Railroad and the Department. No work will be permitted by Railroadon its right-of-way until it has reviewed and approved the evidence of insurance required herein.

1. Railroad will only accept initial insurance submissions via US Mail or Overnight carrier tothe address noted in C above. Railroad will NOT accept initial insurance submissions viaemail or faxes. Please provide point of contact information with the submissionincluding a phone number and email address.

2. Railroad requires the following two (2) forms of insurance in the initial insurancesubmission to be submitted under a cover letter providing details of the project andcontact information:

a. The full original or certified true countersigned copy of the railroad protectiveliability insurance policy in its entirely inclusive of all declarations, schedule offorms and endorsements along with the policy forms and endorsements.

b. The Contractor’s commercial general, automobile, and workers’compensation liability insurance certificate of liability insuranceevidencing a combined single limit of a minimum of $2M per occurrenceof general and $1M per occurrence of automobile liability insurancenaming Norfolk Southern Railway Company, Three Commercial Place,Norfolk, VA 23510 as the certificate holder and as an additional insuredon both the general and automobile liability insurance policy.

3. It should be noted that the Railroad does not accept notation of RailroadProtective insurance on a certificate of liability insurance form or Binders asRailroad must have the full original countersigned policy. Further, please note thatmere receipt of the policy is not the only issue but review for compliance. Due tothe number of projects system-wide, it typically takes a minimum of 30-45 days for theRailroad to review.

15. FAILURE TO COMPLY:

A. In the event the Contractor violates or fails to comply with any of the requirements of theseSpecial Provisions:

1. The Railroad Engineer may require that the Contractor vacate Railroad property.

2. The Sponsor’s Engineer may withhold all monies due the Contractor on monthlystatements.

B. Any such orders shall remain in effect until the Contractor has remedied the situation to thesatisfaction of the Railroad Engineer and the Sponsor’s Engineer.

16. PAYMENT FOR COST OF COMPLIANCE:

A. No separate payment will be made for any extra cost incurred on account of compliancewith these special provisions. All such costs shall be included in prices bid for other items of thework as specified in the payment items.

CONSTRUCTION REQUIREMENTS When performing work on, over or adjacent to CSX Transportation (“CSXT”) right-of-way or operations, the City of Richmond (“City”) selected contractor (“Contractor”) must abide by the current CSXT Special Provisions, CSXT Construction Submission Criteria and the following additional requirements.

1. All construction related correspondence will be directed to AECOM, acting as the Construction Monitoring Representative (“CMR”) on behalf of CSXT, with the following contact and address:

Upon receipt of notification, the CMR will direct the Contractor to the local CSXT construction contact for the project.

2. Prior to construction, City or its Contractor shall provide two (2) hard copy sets as well as one (1) digital/electronic copy (CD preferred) of the Final Approved-For-Construction Plans for the subject project to AECOM, at the address listed above. Any subsequent revisions to the Final Approved-For-Construction Plans shall also be provided.

3. Prior to any construction activities on or about CSXT, the Contractor shall have a pre-construction meeting with CSXT’s designated representative and the CMR to discuss potential On-Track Safety issues during project construction activities.

4. Construction procedures for all work in the vicinity of CSXT property, that has the

potential of affecting CSXT property or operations, shall be submitted to CSXT, and the CMR, prior to the work being performed. The Contractor shall obtain written acceptance of the submitted construction procedures from CSXT or their representative before proceeding with construction. All construction submittals shall be directed to Brian V. Harrison (contact information above) and:

Up to thirty (30) days will be required to review all construction submissions. Up to an additional thirty (30) days will be required to review any subsequent submissions returned not approved with requests for additional information. Work will not be permitted to commence until the Contractor has provided CSXT with a satisfactory plan for the associated work, detailing how the work will be undertaken without impacting scheduling, performance or safety related issues. NOTE: All construction work shall be performed in accordance with the construction procedure reviewed and accepted by CSXT or the CMR. Revisions to Contractor submissions may not be field approved. resubmission of the procedure for review and acceptance prior to performing any work. The Contractor shall submit, as separate submittals, the following construction procedures and documents, and any additional construction procedures determined to be necessary by the CSXT or the CMR.

a. Means and Methods – The Contractor shall develop separate detailed

submissions for each work items presenting the potential to impact CSXT property or operations. The work items requiring submissions should be coordinated with the CMR prior to their development and submission. Each submission shall:

i. Indicate the progression of work with specific times when tasks will be performed during the project.

ii. Provide a listing of the anticipated equipment to be used, a marked up plan with relevant dimensions detailing the location of all equipment to be used, and a contingency plan of action should a primary piece of equipment malfunction.

iii. Include a detailed narrative discussing the project level coordination of specific work operations and project safety issues between the sponsor, Contractor, CSXT and the CMR.

iv. If determined by CSXT or the CMR to be necessary, include a walkthrough at which time CSXT and/or the CMR will be present.

Anticipated means and methods submissions include, but are not limited to, site access plan, pipeline installation and temporary works.

b. Ballast Protection – A ballast protection system may be required at the sole

discretion of CSXT depending on the contractor’s proposed methods to perform the work. The system shall use filter fabric and indicate the anchorage system. The ballast protection is to extend a minimum of 25’ beyond the proposed limit of work or greater as determined by CSXT and be continuously maintained to prevent all contaminants from entering the ballast section of all tracks for the entire duration of the project.

c. Contractor shall perform all drainage work on and adjacent to CSXT property in

strict compliance with the approved project plans. The Contractor shall ensure that proper erosion control is implemented on and adjacent to CSXT right-of-way during construction. The Contractor must prevent silt and debris accumulation in the railroad roadbed, ditches and other railroad facilities. The Contractor may be required to submit a detailed erosion control plan for review and acceptance by CSXT or the CMR prior to performing any work. CSXT reserves the right to require additional drainage or grading modifications if as-built conditions do not address drainage and erosion in a manner satisfactory to CSXT.

d. Construction Schedule – Within 30 days of the pre-construction meeting,

Contractor shall submit a detailed construction schedule for the duration of the project clearly indicating the time periods while working on and around CSXT right-of-way. As the work progresses, this schedule shall be updated and resubmitted as necessary to reflect changes in work sequence, duration and method, etc.

e. Insurance – Submit all necessary insurance information in accordance with the

current CSXT Insurance Requirements for approval. The Certificate of Insurance shall be prepared in keeping with the sample included in Exhibit A of this document. The complete original policies should be submitted to:

with a copy to the CMR. The insurance policies will be required to be in place and approved prior to any work commencing on or that could potentially impact CSXT right-of-way. As information for use in obtaining the required CSXT insurance, please note that CSXT operates approximately 11 total freight trains per day at a maximum authorized speed of 30 mph at the project location.

f. Emergency Action Plan – Submit an emergency action plan indicating the

location of the site, contact numbers, access to the site, instructions for emergency response and location of the nearest hospitals. This plan should cover all items required in the event of an emergency at the site including fire suppression. Coordinate the Emergency Action Plan with the safety related discussion of the Means and Methods submission discussed above. The plan should also include a method to provide this information to each project worker for each day on site.

5. CSXT Emergency Number: The CSXT telephone number for emergencies is 800-232-

0144. Reference the CSXT Milepost and DOT # for the project, as shown in the subject project description above, when calling.

6. No stormwater from the project may discharge onto the CSXT right-of-way at any time during construction.

7. The Contractor must not use CSXT right-of-way for storage of materials or equipment during construction. The CSXT right-of-way must remain clear for railroad use at all times. Equipment may not be positioned to block the railroad access road, track area or any part of the CSXT right-of-way without prior CSXT approval.

8. No temporary or permanent reductions to the existing horizontal and vertical clearances shall be permitted without prior CSXT approval. All Contractor work shall be performed in strict compliance with CSXT clearance requirements.

9. The Contractor will be required to abide by the provisions of the City/CSXT Construction

Agreement. Periodically, throughout the project duration, the Contractor will be required to meet, discuss and, if necessary, take immediate action at the discretion of CSXT personnel and/or the CMR to comply with provisions of that agreement and these specifications.

10. This project will require use of CSXT Flagmen to protect train operations from project

activity in the area of the tracks. While CSXT cannot guarantee the availability of flagmen at all requested times, every accommodation will be extended to the Contractor when forces are available. Flagging requests should be made to CSXT Roadmaster Justin Hebert, at telephone (804)-307-3023 at least thirty (30) days in advance. Termination or cancellation of a flagman requires ten (10) days notice to avoid incurring costs.

11. All equipment operations that could potentially impact CSXT right-of-way must be

coordinated with the CSXT Flagman.

12. The Contractor shall execute Schedule I (Contractor’s Acceptance) prior to starting work on, over or adjacent to CSXT right of way, which is part of the Construction Agreement to be executed between the City and CSXT.

13. Contractor access will be limited to the immediate project area only. The CSXT right-of-

way may not be used for contractor access to the project site and no temporary at-grade crossings will be allowed.

INSURANCE REQUIREMENTS

I. Insurance Policies:

Agency and Contractor, if and to the extent that either is performing work on or about

CSXT’s property, shall procure and maintain the following insurance policies:

1. Commercial General Liability coverage at their sole cost and expense with limits of

not less than $5,000,000 in combined single limits for bodily injury and/or property

damage per occurrence, and such policies shall name CSXT as an additional named

insured. The policy shall not contain any exclusions for work completed within 50

feet of the railroad.

2. Statutory Worker’s Compensation and Employers Liability Insurance with limits of

not less than $1,000,000, which insurance must contain a waiver of subrogation

against CSXT and its affiliates (if permitted by state law).

3. Commercial automobile liability insurance with limits of not less than $1,000,000

combined single limit for bodily injury and/or property damage per occurrence, and

such policies shall name CSXT as an additional named insured. The policy shall not

contain any exclusions for work completed within 50 feet of the railroad

4. Railroad protective liability insurance with limits of not less than $5,000,000

combined single limit for bodily injury and/or property damage per occurrence and an

aggregate annual limit of $10,000,000, which insurance shall satisfy the following

additional requirements:

a. The Railroad Protective Insurance Policy must be on the ISO/RIMA Form of

Railroad Protective Insurance - Insurance Services Office (ISO) Form CG 00 35.

b. CSX Transportation must be the sole named insured on the Railroad Protective

Insurance Policy.

c. Name and Address of Contractor and Agency must be shown on the Declarations

page.

d. Description of operations must appear on the Declarations page and must match

the Project description, including project or contract identification numbers.

e. Authorized endorsements must include the Pollution Exclusion Amendment - CG

28 31, unless using form CG 00 35 version 96 and later.

f. Authorized endorsements may include:

(i). Broad Form Nuclear Exclusion - IL 00 21

(ii) 30-day Advance Notice of Non-renewal or cancellation

(iii) Required State Cancellation Endorsement

(iv) Quick Reference or Index - CL/IL 240

g. Authorized endorsements may not include:

(i) A Pollution Exclusion Endorsement except CG 28 31

(ii) A Punitive or Exemplary Damages Exclusion

(iii) A “Common Policy Conditions” Endorsement

(iv) Any endorsement that is not named in Section 4 (e) or (f) above.

(v) Policies that contain any type of deductible

5. All insurance companies must be A. M. Best rated A- and Class VII or better.

6. Such additional or different insurance as CSXT may require.

II. Additional Terms

1. Contractor must submit the original Railroad Protective Liability policy,

Certificates of Insurance and all notices and correspondence regarding the insurance

policies to:

2. Neither Agency nor Contractor may begin work on the Project until it has

received CSXT’s written approval of the required insurance.
