SUBJECT: Proposed T mponty Salt Storage Shed

Background The Council declared itself Lead Agency (Novembet 2014 No.171) for the pwpose ofteviewing a proposed temporaty salt stor:age shed at the City Yard. Pursuant to the State Environmental Quality Review Act (SEQRA), the project ia an "unlisted" action. As required, a Short Environmental Assessment Form (SEAF) was prepared as it relates to the proposed project. The SEAF concludes that the proposed action will not result in any significant adverse environmental .impact.

Recommendation Staff recommends that Council adopt a resolution declaring a negative declaration for the proposed project, thus requiring no further environmental review.

The City of .New Rochelle and the Town of Mamaroneck have been approached by residents of the Pryor Manor area (Wildwood Road, Pryor Manor Road and Dogwood Lane) relative to services they receive. These streets have some homes located In the City of New Rochelle and some located In the Town of Mamaroneck After several meetings between City and Town officials· and 'residents of the area, the City and Town are proposing shared services for the area which will hopefully resolve confusion among the residents and standardize the services offered on these streets. We have determined that the best approach is for the City and Town to enter into an Inter Municipal Agreement for the Town to provide the following services to 16 homes in New Rochelle on Wildwood Road (6), Pryor Manor Road (1), and Dogwood Lane (9):

• Garbage Collection (Twice per week) • Recycling Collection (Once per week) • Bulk Trash Collection (once per week) • Organic Waste Collection {Once per week from April through October) • Snow Removal • Leaf Coltection

It should be noted the Larchmont/Mamaroneck Joint Garbage Disposal Commission will provide the garbage collection services, recycling collection services, bulk trash collection services and organic waste collection services while the Town of Mamaroneck will provide the snow removal and leaf collection services. The City shall pay the Commission for these services based upon the tax charged for sanitation services to a property owner in the Town. The City shall pay the Town for snow removal servlc~s based upon an agreed upon. rate per lane mile for the total lane miles of road plow~d and/or sanded. The City shall pay the Town for leaf collection services based upon an ag~:eed upon hourly rate for the number of hours spent on leaf collectJon. It should be noted that due to the small number of homes included in this agreement. the charges to the City will be minimal and can be absorbed in the Department of Public Works operating budget This agreement would take effect In January, 2015.

RECOMMENDATION: It Is recommended that the City Council adopt a resolution authorizing the City Manager to enter Into an Inter Municipal Agreement with the Town of Mamaroneck and the Larchmont/Mamaroneck Joint Garbage Disposal Commission for the provision of garbage collection services, recycling collection services, bulk trash collections servic~s, organic waste collection services, snow removal services and leaf collection services for properties in the City of New Rochelle on Wildwood Road {6), Pryor Manor Lane (1) and Dogwood Lane (1).

Th,e City administration has been undertaking discussions with the Police Association of New Rochelle (PBA) and the New Rochelle Police Superior Officers Association (SOA) relative to the City offer-ing New York State Retirement Plan 375-i(p) to members of each union. This retirement option would allow officers to retire between the age of 55 and 62 without penalty. Offering this plari will allow the option to our employees while providing a benefit to the City of creating vacancies in our department which wm result In the hiring officers at a significantly reduced cost

The City will have to make a .payment to the State Retirement System In order to opt Into this plan. To offset the cost of that payment, the Memorandum of Agreement Includes the following:

1. As a condition precedent to the City's election of this additional pension option, and In order to offset the Immediate cost of this plan to the City, a minimum of six ( 6) members of the PBA and/or SOA will have to agree to retire no later than December 31, 2015.

2. Additionally, both the PBA and the SOA have agreed that any bargaining unit member who retires under this retirement option will have their severance pay upon retirement reduced by one (1) month.

Both Unions are expected to undertake votes ofthelr membership prior to the December 9, 2014 Regular Legislative Meeting of City Council.

RECOMMENDATION Assuming both union memberships approve the Memorandum of Agreement. ca copy of which is attached, It is recommended that the City Council adopt a resolution ratifying the Memorandum of Agreement

MEMORANDUM OF AGREEMENT

This Memorandum of Agreement is by and among the City of New Rochelle (hereinafter "City"), the Police ~sociation of New Rochelle, N.Y., Inc. (hereinafter "PBA") and the New Rochelle Police Superior Officers Association, Inc. (hereinafter "SOA''} and is dated this day ofNovember, 2014. -

WHEREAS, the City and the PBA are parties to a collective bargaining agreement that is in effect until December 31, 20 19 (hereinafter "PBA CBA"); and

WHEREAS, the City and the SOA are parties to a collective bargaining agreement that is in effect and whose term has been extended until December 31, 20 19 pursuant to a Memorandum of Agreement between the parties dated January 17,2014 (hereinafter "SOA CBA"); and

WHEREAS, the PBA CBA and the SOA CBA contain Articles VIII, both. entitled "PENSIONS'', that relate to the provision of pension benefits to the respective members of their. bargaining units; and .

WHEREAS, the City, the PBA and. the SOA have engaged in good faith negotiatio.ns to add an additional retirement option to the respective eligible members of their bargaining units under the New York State Police and Fire Retirement Systems pursuant to the New York State Retirement and Social Security Law (hereinafter "RSSL");

NOW, THEREFORE, the City, the PBA and the SOA agree as follows:

1. The Presidents of the SOA and PBA or their designees will survey their respective members to determine how mlj.lly members will, if it becomes available, participate in Retirement Plan 375-i(p). As a condition precedent to the City's election of this additional pension option, and in order to offset the immediate cost of this plan to the City a minimum of six (6) members of the PBA and or SOA will have to agree to retire _no later than December 31, 2015 and certify in writing to the City that they will retire by December 31, 2015. Any SOA or PBA member who becomes ill or injured in the line of duty and is determined to be entit!ed to benefits in accordance with GML § 207-C, shall not, upon notice, be required to retire as stated herein.

2. The City agrees as soon as practicable after execution and approval of this memorandum and satisfactory proof of the irrevocable intention to retire by December 31, 2015 of at least six (6) PBA or SOA members, to provide eligible members of the PBA and SOA bargaining units with an additional 25 year retirement option in accordance with tlie terms and conditions set forth in RSSL Section 375-i(p). Any SOA or PBA member who becomes ill or injured in the line of duty and is

determined to be entitled to benefits in accordance with GML § 207.-C, shall not, upon notice, be required to retire as stated herein.

3. In further partial consideration for the provision of said additional retirement option, the PBA agrees that for any bargaining unit member who elects receipt of the pension benefits available under RSSL Section 375-i(p), the benefit available under the Special Severance Vacation Leave Pay provision, contained in Section 3 of ARTICLE VII of the PBA CBA, shall be reduced to change the payout in the 35th year of service from ''Three (3) month's pay" to "Two (2) month's pay", in the 30111

year of service from two month's pay to one month's pay. and in the 25th year of service or }?elow to no severance pay.

4. In partial consideration for the provision of said additional retirement plan option, the SOA agrees that for any bargaining unit member who elects receipt. of the pension benefits available under RSSL Section 37-5-i(p), the benefit available under the Special Severance Vacation Leave Pay provision contained in Section 3 of ARTICLE VII of the SOA CBA, shall be reduced to change the payout in the 35th year of service from "Three (3) month's pay" to "Two (2) month's pay", in the 30th year of service from two month's pay to one month's pay and in the 25111 year of service or below to no severance pay . .

5. The parties hereto agree that, except as provided. herein, all other tenns and conditions of the PBA CBA and the SOA CBA remain unchanged and in full fQrce and effect.

6. The parties hereto further acknowledge and agree that nothing contained herein shall constitute, be deemed or in any way cited as a precedent for any reoj,ening of negotiations in connection with the PBA CBA or the SOA PBA and/or in any future dealings among the City·, the PBA and/or the SOA. The parties hereto further acknowledge and agree that any such reopener requires the prior written ~nsent of the respective parties.

7. This Memorandum of Agreement constitutes the entire understanding and agreement among the City, the PBA and the SOA with respect to the matters which are the subject of this Memorandum of Agreement, and it supersedes and cancels all prior negotiations, agreements, commitments, communications and understandings, written or oral, among the City, the PBA and/or the SOA with respect to such matters.

8. This Memorandum of Agreement may not be amended, changed, or modified in any manner, orally or otherwise, except by an instruntent in writing of concurrent or subsequent date signed by a duly authorized representative or each of the parties thereto. ·

9. This Memorandum of Agreement may be executed in separa~e counterparts, each of which shall constitute an original.

WHEREAS, this retirement option would allow officers to retire between the age of SS and 62 without penalty, providing a benefit to the City of aeating vacancies in the Police Department wbicb will result in the hiring of officers at a significantly reduced cost; aud

WHEREAS, the City will make a payment to the State Retirement System in order to opt into this plan and to offset the cost of this payment, the Memoraodum of Agreement includes the followiug:

1. As a coodition precedent to the City's election of this additioual pension option, and in order t.O offset the immediate cost of this plan to the City, a minimum of six (6) members of the PBA 8Ddlor SOA will have to agree to retire no later than December 31,2015.

2. Additionally, both the PBA and the SOA bave agreed that any batgaining unit member who retires under this retirement option will have their scvetanee pay upon retirement reduced by one (I) month;

now, therefore

WHEREAS, the Project is located within the WR (Waterfront Related) zone where "Yacht, boat, rowing, beach, and other water dependent membership clubs as regulated by §331-450" are permitted by special pennit under the jurisdiction of City Council; and

WHEREAS, the Bureau of Buildings has recommended that the special pennit be granted as the application has been reviewed and it has been determined that it meets the salient features of the zoning ordinance; now, therefore ·

BE IT RESOLVED by the Council of the City of New Rochelle:

As a result of the discussions held at the City Council budget sessions, the following amendments are proposed to the Budget Estimate:

Police Overtime-As discussed at the December 2, 2014 budget session, an Increase to the Pollee Department overtime budget of $170,000 will provide approximately 1,700 hours of Increased patrol activity. This increase to appropriations is offset by an additional appropriation of fund balance.

Pollee Sr-tema Applications - The Budget Estimate included $36,491 of Police Department computer systems applications funded by the use of drug forfeiture funds. The Police Department subsequently determined that these applications were needed prior to the end of 2014 and an appropriation was approved by the City Council In November. It is therefore necessary to reduce the Budget Estimate for this duplicative item.

Leaf Removal Public Relationa- As explained by the Public Works Commissioner in his departmental presentation, there is a desire to continue leaf removal public relations efforts in 2015. An appropriation of $25,000, offset by leaf disposal fees, Is required for this activity.

BE IT ORDAINED by the City of New Rochelle:

Section 1. The following Budget Estimate for the Year 2015, consisting of the General Fund, Special Revenue Funds, Enterprise Fwtds, Internal Service Funds, the Debt Service Fund and the Capital Projects Fund, as submitted by the City Manager and, as amended, showing a tax levy of$55,453,434 is hereby adopted as and for the Annual Budget of the City ofNew Rochelle for the Year 2015 and the amowtts set forth in said Budget, as amended, as hereto annexed, are hereby appropdated for the pwpose stated therein.

Section 2. Where officers or employees are transferred in accordance with Civil Service Regulations from one account to another, the salary of such officer or employee shall be transferred upon direction of the City Manager to the account number to which such officer or employee is transferred.

Section 3. Errors in computation of salaries may be corrected upon certification of the City Manager and the sums necessary for such cotteetion shall be transferred from the Contingent Fund upon certification of the City Manager.

Section 4. The City Manager is hereby authorized to transfer appropriations from departmental salary and benefit accounts to the Vacancy Factor account for any positions that may become vacant during the year. ·

Section 5. The City Manager is hereby authorized to appoint additional temporary firefighters or police officers in advance of the start of police/fire academies to replace pending retiremet;tts.

Section 6. The City Manager is hereby authorized to transfer from the Contingent Fund the amount of money required in any specific instance to meet the cash payment in lieu of supplemental vacation authorized for a retiring employee insofar as there may be insufficient surplus funds available for such purpose in the subdivision of the account from which the
