INTRODUCTION
Freedom of Information
The Freedom of Information Amendment 1993 Act took effect in Local Government from 1 January 1994.
The Freedom of Information Act gives members of the public a legal right of access to documents in the possession of the Council and its officers, which were created or received after 1 January 1989 or are documents relating to their (the public’s) own personal affairs regardless of the age of the documents. The protection of the public interest and private and business affairs may cause some documents to be exempt from access.
Purpose
The purpose of Part II of the Act (sections 7 to 12) is to ensure that individuals and organisations can effectively exercise their right to obtain access to government information, which may affect them. To this end they must be made aware of what government does, how it acts and what information it holds. The legislation does not require Councils to comply with section 11 of the Act, which is the requirement for a full list of all publications.
Responsibility
Each agency prescribed separately under the legislation must prepare statements under Part II and responsibility for ensuring that these statements are published rests with either the Minister concerned (section 7) or the Agency’s principal officer (section 8). Statements will be considered published if they are available for sale or distribution to the public on request.
Publication
There are five statements that together will constitute publication under Part II.
Statement 1: Organisation and Functions
The agency must summarise its structures and functions. In addition it must list what powers it has to make decisions directly affecting the public and what mechanisms it has for advice and consultation with the public in developing agency policy and practice (sections 7(1) (a) (i), (vii) and (viii)).
Statement 2: Categories of Documents
The agency must summarise its record-keeping system. It should include a description of the key record series found within that system and where possible should relate the component parts of the system to the agency’s structure and functions (section 7(1)(a) (ii)).
Statement 3: FOI Arrangements
A summary must be made of the way in which agencies will handle FOI requests. In particular, agencies must provide a statement of the materials published under Part II, a statement of the procedures to be followed in making a request for access to documents and the names of officers responsible for acting on requests (sections 7 (1) (a) (iii), (v), (vi)).

Statement 4: Publicity Material
All publicity material must be listed (section 7 (1) (a) (iv)).
Statement 5: Rules, Policies and Procedures (section 8)
As far as possible, the “hidden law” of an agency must be made explicit. Thus, manuals of procedure, interpretations of governing statutes, statements of policy and documents concerning methods of enforcing acts or schemes must be made available for inspection or purchase. However, the “hidden law” need only be made available to the extent that it bears directly on the public. An indexed list of relevant documents must therefore be prepared and published.
Exemption
In preparing statements, agencies are not required to make available documents containing exempt matters or to list such documents where listing itself cannot be done without disclosing what is exempt (sections 7(3) and 8(3)) or if these documents can be made available in a comprehensive form with exempt matters having been excluded, then this must be done (sections 8 (3), (4), (5)).
Not Listing Documents
No person shall suffer a detriment by virtue of not having complied with any rules, policies, guidelines or practice if those rules etc were not listed or made available and the person did not know of them (section 9).

STATEMENT 1: ORGANISATION AND FUNCTIONS - SECTION 7(1)(a)(i)
A statement setting out the particulars of the organization and functions of the agency, indicating, as far as practicable, the decision making powers and other powers affecting members of the public that are involved in those functions and particulars of any arrangements for consultation with, or representation by, bodies and persons outside the government administration in relation to the formulation of policy in, or the administration of, the agency.
Structure
The Moreland City Council (“the Council”) is a body corporate and the local government body for the municipality of Moreland.
Council has the following structure:-
The Purposes, Objectives and Powers and Functions of the Council are set out as follows in sections 5, 6, 7 and 8 of the Local Government Act 1989.
Purposes
The purposes of a Council are:
To provide for the peace, order and good government of its municipal district;
To facilitate and encourage appropriate development of its municipal district in the best interests of the community;
To provide equitable and appropriate services and facilities for the community and to ensure that those services and facilities are managed efficiently and effectively; and
To manage, improve and develop the resources of its district efficiently and effectively.
In seeking to achieve its purposes, Council has the following objectives:
To facilitate the involvement of members of the community, users of facilities and services and Council staff in the development, improvement and co-ordination of local government;
To co-ordinate with other public bodies to ensure that services and facilities are provided and resources are used effectively and efficiently;

To ensure adequate planning for the future of its municipal district;
To represent and promote the interests of the community and to be responsive to the needs of the community;
To formulate comprehensive policies and set performance targets;
To develop, implement and monitor its corporate and financial management control techniques;
To raise funds for local purposes by the equitable imposition of rates and charges and by obtaining borrowings and grants;
To delegate decision making to appropriate levels within the organisation;
To develop and implement co-ordinated personnel and industrial relations policies;
To facilitate accountability at all levels within the organisation by maintaining suitable information and reporting systems; and
To promote and undertake research into any matter relating to the council’s objectives, functions or powers.
Functions
A Council may perform its functions inside and outside its municipal district and a Council has the power to do all things necessary or convenient to be done for, or in connection with, the performance of its functions and to enable it to achieve its purposes and objectives. A Council has the following functions:
1. General public services including:
Fire Prevention and protection;
Local emergency and safety services;
Animal control, protection and conservation;
Animal impounding;
Plant control;
Tip establishment and operation;
Litter control; and
Collection and disposal of refuse.
2. Health, education, welfare and other community services including:
Services for children and families;
Health inspection services;
Public conveniences;
Prevention and abatement of nuisances;
Childcare and development services and youth services;
Aged, disabled and disadvantaged persons services;
Migrants services; and
Cemeteries.

3. Planning and land use including:
Building control; and
Housing and other accommodation.
4. Property services including:
Water, drainage, sewerage, gas and electricity;
Land development schemes; and
Street maintenance and cleaning.
5. Recreation and cultural services including:
Halls and public buildings;
Sport, recreation, leisure and arts;
Parks, gardens and reserves;
Libraries and museums;
Historic buildings and places; and
Public entertainment.
6. Roads including:
Bridges;
Footpaths, bicycle paths and nature strips;
Traffic controls and signs; and
Lighting and drainage of roads.
7. Any other functions relating to the peace, order and good government of the municipal district including:
Parking;
Transport;
Aerodromes;
Tourism;
Information;
Encouragement of employment opportunities;
Encouragement of commerce, industry and agriculture;
Environment control, protection and conservation;

Description of Record Keeping System
The Council maintains Electronic Data Processing systems, which store information on Properties, Streets, Reserves, Planning, Buildings, Subdivisions and Financial information. ___________________________________________________________________________________________

This system is backed up by hard copy files and hard copy files are utilised for other non-computerised documents.
Files are generally maintained in chronological order. The exemptions being Personal, Property and Street files which are maintained in alphabetical order.
All files are supported by Registers and in some cases indexes to aid identification.
The disposal of Council records is governed by the Public Records Act 1973. Section 13 of the Act requires Councils to undertake programs of records management in accordance with standards established by the Keeper of Public Record. No public records are destroyed or otherwise disposed of except in accordance with these standards.
The Council also maintains administration and policy manuals, together with other instructions to staff.
Principal Record Series – Records Management
Subject Files
Covering policy, instructions, case material etc, dealing with the operations of the Council. For example:

Rates;
Engineering;
Human Resources;
Land Reserves; and
Contract documents.
Property Files
Covering matters relating to that property. For example:

Covering matters common to that particular street.

STATEMENT 3: FOI ARRANGEMENTS - SECTION 7(1)(a)(iii)(iv)(v)(vi)
FOI Material
Material that has been prepared by Council under this part of the Act for publication or for inspection by members of the public and the places at which a person may inspect or obtain that material
This Part II Statement meets all the legislated requirements for publication by Council. Council has a Freedom of Information Procedures Policy available for inspection.
The Part II Statement is available from the Citizens Service Centres at:

FOI Procedure
A statement of the procedure to be followed by a person when a request for access to a document is made to the agency including a statement designating by name the officer or officers responsible within each agency for the initial receipt of, and action upon, requests for access to a document.
Applications must be in writing and addressed to:

who will initially receive and take action on a FOI request.
The request for access should be on the attached form and clearly describe the documents sought. An access fee of $26.50 applies to all requests, but may be discounted or waived on account of hardship. The application should include the form in which access is required, being:
a) view original under supervision;
b) view copies; or
c) copies to be sent.
On receipt of a request for access, a decision must be made within 45 days. Where a decision is made to refuse or defer access, the applicant will be notified in writing of the reasons for denial / deferral. If the applicant is not satisfied with the reasons, he / she can appeal to the FOI Commissioner.
Charges for access will be in accordance with the Freedom of Information (Access Charges) Regulations and the Freedom of Information Act 1982. No fees are charged for copies of this Part II Statement.

STATEMENT 5: RULES, POLICIES AND PROCEDURES (Section 8)
(1) This section applies, in respect of an agency, to documents that are provided by the agency for the use or guidance of, or are used or may be used by, the agency or its officer -(a) in making decisions or recommendations, or in providing advice to persons
outside the agency, with respect to rights, privileges or benefits, or to obligations, penalties or other detriments, to or for which persons are or may be entitled, eligible or subject, being -(i) documents containing interpretations or particulars of Acts or schemes
administered by the agency, not being particulars contained in another Act; or
(ii) manuals, rules of procedures, statements of policy, records of decisions, letters of advice to persons outside the agency, or similar documents containing rules, policies, guidelines, practices or precedents; and
(b) in enforcing Acts or schemes administered by the agency where a member of the public might be directly affected by that enforcement, being documents containing information on the procedures to be employed or the objectives to be pursued in the enforcement of the Acts or schemes.
These are listed as follows by Council Department. These documents are available at 90 Bell Street, Coburg and may be inspected or purchased, unless considered exempt, at the Council Offices through the FOI Officer, 9240 2454. Arrangements for inspection must be made prior to visiting the offices.
