SUBJECT: Response letter regarding Merced County Civil Grand Jury Final Report2016-2017, Los Banos Police Department Jail, mandated inspection

Recommendation:

That the City Council authorize the City Manager to execute the attached letter to theHonorable Paul C. Lo, Presiding Judge, Superior Court of California, County of Merced,regarding the annual Los Banos Police Department mandated jail inspection.

Discussion:

In accordance with State law, the Los Banos Police Department Jail is one of three jailfacilities located within Merced County that are routinely inspected by the MercedCounty Civil Grand Jury; the purpose being to inquire into the conditions andmanagement of the jails located within Merced County. Our inspection occurred onSeptember 21,2016.

To accomplish the inspection, as noted in this year's Grand Jury report, the Grand Juryused an inspection form provided by the California Grand Jurors' Association thatallowed for precise documentation of the observations the Grand Jury made during itsvisit. Documentation of the inspection included, but was not limited to; facility staffing,condition of the grounds, and interior/exterior of the building. The kitchen facility wasinspected and meal planning procedures were reviewed for nutritional compliance.

The Grand Jury findings included the following (page #15 of the 2016-2017 Grand Juryreport):

FINDING(S)

F1. That the facility is functional and currently serves the purpose at this time.Notwithstanding, the Los Banos Police Department is located in a 46 year-oldbuilding and is not up to current standards for jail facilities in accordance withTitle 24 of the California Code of Regulations.

RECOMMENDATION(S)

R1. That the City of Los Banos continue to seek options to relocated the policedepartment to a facility that will meet the current jail standards.

I appreciate the Grand Jury's efforts; the Police Department works diligently to provide aprofessional, clean and healthy jail facility

MANDATED INSPECTIONS OF JAIL FACILITIES

SUMMARY

In accordance with requirements of California Penal Code (CPC) Section 919(b), the 2016-2017Merced County Civil Grand Jury (Grand Jury) conducted inspections of the detention facilities inMerced County. According to CPC Section 919(b), the purpose of these inspections is to inquireinto the conditions and management of the jails within the county. Under these provisions, theGrand Jury toured and inspected the following facilities:

• Merced County Sheriffs Deparll11ent Main Jail

• Merced County Sheriffs Department John Latorraca Correctional Center

• Los Banos Police Department Jail Facility

The Grand JUlY detelmined that all facilities met the minimwll standards of the CaliforniaCorrections Standards Authority (CSA), as specified in Titles 15 and 24 of the California Codeof Regulations.

INVESTIGATIVE M.ETHODS

The Grand Jury used an inspection form provided by the California CSA and the Califol11ia

Grand Jurors' Association (CGJA). The inspection form allowed precise documentation of theobservations the Jury made during its visit. Each facility manager was also provided the same

\clIm to be completed prior to the inspection. The Grand JUlY documented facility staffing,condition oftbe grounds, and the interior and exterior of the buildings. The medical facilities

were inspected for deficiencies and/or hazardous practices. The kitchen facility was inspectedand meal planning procedures were reviewed for nutritional compliance. Educational andvocational programs were reviewed, as well as iItIllate discipline and grievance procedures.

staff, and reviewed the most recent inspection repm1s prepared by the California CSA and thelocal fire and health authorities. Before and during inspections and the repmt process, Jurorscommunicated via email and telephone with the facility managers.

LOS BANOS POLICE DEPARTMENT JAIL FACILITY

The 2016-2017 Merced County Civil Grand Jury (Grand Jury) inspected the Los Banos PoliceDepaltment Jail Facility located at 945 5th Street in Los Banos on September 21, 2016.

Tbe Los Banos Police Depal1ment (LBPD) operates a Type lJ jail facility. Type IJ jail facilityallows LBPD to house no more than 20 inmates for up to and for no longer than 96 hours

(excluding weekends and holidays). There were three inmates in cells at the time of theinspection. The design of the cell area did not allow jurors to inspect individual cells safely.

By mutual agreement, the LBPD jail is lIsed by the California Highway Patrol, the Dos PalosPolice Department, the California Fish and Game, the Merced County Sheriffs Department, and

the Gustine Police Department for booking purposes. Tbe 911 dispatch is routed through thisfacility.

The jail was designed according to the standards in effect at the time of its construction in 1969.The jail has passed all required inspections, including those of the Merced County Health

Department and the Los Banos City Fire Department. There is one padded ceJl provided forinmates who may be bannful to tbemselves or to others. The facility is well maintained, clean,and free from clutter. The department is reviewing the possibility of relocating in the future tomeet current standards for jail facilities.

All detained individuals are interviewed at in-take to determine their medical history and/orspecial needs. This allows the department to place them, in a classification system to determine iftbey require segregation. There is no medical staff or medical area on-site; therefore, all medicalcases are immediately sent to John Latorraca Correctional Center for medical evaluation unless it

is an emergency, in whicb case the imnate is transported to a local hospital. The facility does nothouse any violent inmates or persons with physical or mental illness. These inmates areconsidered higb risk and are transported to the appropriate Merced County facility.

Inmates are provided three meals per day in accordance with Title 15, Article 4 of the CaliforniaCOlTections Standards Authority (CSA). The officers are responsible for shopping weekly forfood. The meals are kept in a small kitchen on-site. The officers are also responsible for

preparing and serving the meals. The inmates are allowed 30 minutes to finish their meals insidetheir cells.

At the time of this inspection there have been no escapes, attempted escapes, suicides, orattempted suicides.
