City of Folly Beach 21 Center Street

Folly Beach, SC 29439 Topic: Ordinance 12-20 Date: July 14th, 2020 Mayor/Council, In 2019, as part of our moratorium work to study development regulations for environmentally sensitive properties, the City passed an ordinance which amended the language in our code for lot mergers. Lot merger is a tool which treats adjacent, non-conforming properties as one in terms of development and zoning if they are owned by the same person. The 2019 amendment clarified that we apply this rule to substandard lots that share a property line. The additional amendments proposed in Ordinance 12-20 would further refine our rules to make clear our focus on environmentally sensitive lots as directed by our various long-term planning documents. The proposed new language would clarify that the merger ordinance applies to properties adjacent to either the OCRM critical line or baseline. It would also make it clear that interior lots, which aren’t adjacent to these jurisdictional lines, are not affected. This ordinance would also make it explicit that the merger ordinance applies to any two adjacent lots that are under the same ownership even if only one of the lots is substandard.

AN ORDINANCE AMENDING CHAPTER 168 (NON-CONFORMITIES) OF THE FOLLY BEACH CODE OF ORDINANCES, SECTION 168.04 (NON-CONFORMING LOTS OF RECORD) BY APPLYING THE MERGER DOCTRINE AND REQUIREMENTS FOR STREET ACCESS TO SUBSTANDARD LOTS ADJACENT TO THE MARSH AND OCEANFRONT STATE JURISDICTIONAL LINES.

WHEREAS, The City of Folly Beach has a goal of preserving and protecting environmentally sensitive lands through development regulations; and

WHEREAS, This goal is incorporated into the zoning ordinance which states in part that environmental standards are intended to protect and preserve the quality and quantity of the natural environment in the city, decrease the degradation and restore the health of the dunes, marshes, beaches and other environmentally- sensitive areas by preventing encroachments into adjacent areas, prevent damage to property from flooding and improper drainage, and to protect the quality of surrounding surface waters and resources; and

WHEREAS, The Marshfront Management Plan adopted by the City of Folly Beach anticipates a high level of sea level rise that will impact marshfront properties; and

WHEREAS, The Local Comprehensive Beach Management Plan adopted by the City of Folly

Beach recognizes super beachfront development as a management concern; and

WHEREAS, The City is charged by the Army Corps to regulate and monitor oceanfront

development in order to continue renourishment projects.

The City Council of Folly Beach, South Carolina, duly assembled, hereby ordains that the Folly Beach Code of Ordinance be amended as follows:

SECTION 168.04-01 LOTS RESIDENTIAL AND NONRESIDENTIAL DISTRICTS.

(A) General.

(1) Nonconforming lots of record lawfully established prior to March 1, 2019 that are not adjacent to either the OCRM Critical Line or the OCRM Baseline, may be developed with a single-family dwelling even though the lot of record fails to comply with the dimensional standards in Chapter 165: Dimensional Standards, provided it shall be in separate ownership and not of contiguous with other lots in the same ownership.

(2) Development of a single-family dwelling on the lot of record shall comply with the other standards in Chapter 165: Dimensional Standards, to the maximum extent practicable.

(B) Combination of lots. If two or more lots of record or combination of lots of record and portions of contiguous lots of record are in single ownership on or after March 23, 2010, June 9, 2020 or on the date they one or more become nonconforming and if all or part of one or more of these lots do not comply with the lot area standards in Chapter 165: Dimensional Standards; and if one or both of these lots are adjacent to either the OCRM Critical Line or the OCRM Baseline, the lots involved shall be considered to be an individual lot for the purposes of this ZDO, and no portion of these lots shall be used or sold which do not comply with the lot area standards in Chapter 165: Dimensional Standards, nor shall any division of the lots be made that leaves remaining any lot that fails to comply with the lot area standards.

(C) Lots in the DC and IC Districts. In addition to the ability to construct a single-family dwelling, lawfully established nonconforming lots of record in the DC and IC Districts may be developed with any use allowed in the district (Table 164.01, Table of Allowable Uses) following approval of a special exception permit (See 162.03-03) by the ZBA.

(D) Lots with no frontage on an open, public street. No lot which is adjacent to either the OCRM Critical Line or the OCRM Baseline and does not have frontage on an open, public street as of March 1, 2019 shall be developed without demonstration without the provision of at least 15’ of street frontage. The requirement for access may be satisfied by direct frontage or platted easement.

SECTION 168.04- 02 CHANGE OF NONCONFORMING LOT.

As a means of reducing the nonconformity, a nonconforming lot may be increased in area, width, or both, in accordance with the standards for a minor subdivision, 162.03-07(C).

Folly Beach, SC 29439 Topic: Non-Conforming Marsh Signs Date: July 14th, 2020 Mayor/Council, In 2018, the City passed a package of revisions to our sign ordinances. Ordinance 04-18 carried over language from past sign regulations to prohibit signs in the marsh and codified our policy that off premises commercial signs are not allowed. It also contained language that ordered all non-conforming signs outside of the commercial districts to come into compliance or be removed prior to January 1, 2019. Soon after, the signs in the marsh at Bowens Island Road were identified as non-conforming per the new ordinance (they are off premises and in the marsh*). The signage includes advertisements for Bowens Island, Charleston Outdoor Adventures, and Island Hoppers Boat Charters. There was a discussion at the time of either 1) exempting these signs because of their historic/unique character and the fact that the businesses are far from Folly Road, 2) having them removed with no accommodation, 3) offering the owners the option of relocating the signs to high ground owned by the City at the Bowens/Folly Road intersection. However, immediately after 04-18 passed the City kicked off the moratorium and the resulting yearlong work left this decision unmade. Staff would like to restart this conversation by hearing from Council on a preferred option. The picture below shows the current conditions.

*All of the clearly visible street views show vegetation that could indicate the Bowen’s Island Sign is outside of the critical area. This would need to be verified by a survey. We have contacted DHEC OCRM for an approximation of the critical area boundary. It would still be considered off premises.

After the last City Council work session staff refined the estimates for paid parking and created a new option for additional front beach spaces. For our next discussion we have labeled the various options as follows:

Option 1: This option includes expanding paid parking to the side streets going one block back from the beach.

Option 2: This option includes expanding paid parking to the side streets on the second block back from the beach.

Option 3: This option includes expanding paid parking along Ashley and Arctic Avenues on the shoulder of the road closest to the beach.

Option 4: This option includes all three options above.

The resolution sent out assumes approval of Option 4. However, City Council can choose to implement any combination of options.

RESOLUTION 22-20 A RESOLUTION BY THE FOLLY BEACH CITY COUNCIL AUTHORIZING ADMINISTRATION TO ENTER INTO AN AGREEMENT WITH PARK FOLLY TO EXPAND THE PAID PARKING PROGRAM AND TO MAKE AN APPLICATION TO SCDOT FOR AN ENCROACHMENT PERMIT TO INSTALL THE NECESSARY IMPROVEMENTS AND SIGNAGE FOR THE NEW PARKING AREAS.

WHEREAS, The 2015 Comprehensive Plan has separately stated goals of creating revenue

to the City through fees, including parking fees, and to expand the use of paid parking within the right of way; and

WHEREAS, The 2020 Update to the 2018 Strategic Plan identified the expansion of paid

parking as a goal; and WHEREAS, The COVID 19 Emergency has created an opportunity for the City to examine

all sources of income; and WHEREAS, The residents of Folly Beach will continue to be exempt from any additional

paid parking expansion; and WHEREAS, Staff and Park Folly have provided estimates of annual revenue along with

initial and ongoing costs to expand the paid parking area by approximately 450 spaces along Arctic and Ashley Avenue as well as certain side streets.

NOW, THEREFORE, BE IT RESOLVED, that the Administration of the City of Folly Beach is authorized to enter into an agreement with Park Folly to expand the paid parking and make necessary application to SCDOT for an encroachment permit for shoulder improvements and signage along certain side streets up to two blocks from the front beach and along the seaward side of portions of Arctic and Ashley Avenues. RATIFIED this 14th day of July 2020, at Folly Beach, South Carolina, in City Council duly assigned. Request to Stow Catamarans on the Beach Overnight

Attached is a request from Mr. Chuck Bargeron, Director of Research and Development for the WORRELL 1000 Race. Mr. Bargeron is requesting permission for the WORRELL 1000 race team to stow their fifteen catamarans ashore (beachfront at the Tides Hotel) overnight on the evening of Sunday, May 16, 2021 and leaving the morning of Monday, May 17, 2021 in route to Virginia Beach, VA where the race ends. Arrival/departure times are contingent on water and weather conditions.

This event meets all criteria in our special event ordinance except what is highlighted below. Mr. Bargeron has assured compliance with all City ordinances, including turtle season rules.

Chapter 153.06 (B) Permission from the City is Required for some Special Events on Public Property

(B) Criteria for approval of special events on public property.(1) Special events on public property must accomplish at least one of the

following objectives:(a) Have a positive impact on the quality of life for residents;(b) Enhance the image of the city;(c) Benefit the city financially; and(d) Promote tourism or benefit the business community between September

10 and April 30.(2) No special event on public property shall be approved if it will:

(a) Threaten the environment or endanger wildlife;(b) Interfere with the public's use of any street or the beach for more than

half a block of the beach between May 1 and September 9;(c) Involve a run or a race between May 1 and September 9; or(d) Require more city services, such as traffic control and litter cleanup,

than the city is willing to provide.

151.11 (C) Stowing Boats and Watercraft on Beach (C) No person owning, possessing, or controlling a boat or other watercraft shall

place or allow it to be placed on the public beach for any period in excess of 12 hours or at any time after sunset.

Chief Gilreath has approved this event based on Council approval and any special instructions. At this time, Mr. Bargeron is not sure if Public Safety services are needed to monitor safety of the vessels.

Dear Members of Folly Beach City Council, I am writing on behalf of the Folly Beach Community Yoga participants to request the permission to teach evening community yoga classes on the beach. The city grated me permission back in June to teach on the beach between 2nd -3rd block East, as the River Park where we usually have our classes is closed for construction and Lost Dog has taken over a Large Portion of the garden area behind our community center (Where we were also told we could practice) to Serve food. I appreciate the approval to use the beach but there are times it is too hot for yoga at 10-11 especially if participants will be required to wear masks. I would like to ask council for the permission to offer evening classes on the beach 6:30- 7:30 or 7-8 between 2nd -3rd block East. The evening sun is not as hot or direct and would be a healthier option than 10-11 am. Section 168.03-07 Substantial Improvement.

In the case of substantial improvement, a nonconforming structure must be brought in to compliance with all current applicable zoning regulations.

(A) Substantial improvement is defined as any combination of repairs, reconstruction, alteration or improvements to a building, taking place during a ten-year period, in which the cumulative cost equals or exceeds 50% of the market value of the building prior to the first instance of repairs, reconstruction, alteration or improvements.

(B) The market value of the building must be provided by an appraiser certified by the state prior to the start of the initial repair or improvement. For improvements being made after damage, the market value shall be the value of the building prior to the damage occurring.

(C) The value of minor repairs and normal maintenance as defined in § 168.01-04, Minor Repairs and Normal Maintenance, shall not be used in a determination of substantial improvement.

(D) The ten year period shall not be waived in the event repairs, reconstruction, alteration, or improvements to a building are required as an act of God, natural disaster or other actions beyond the control of the property owner.

WHEREAS, The City of Folly Beach has a goal of preserving and protecting environmentally sensitive lands through development regulations; and

WHEREAS, This goal is incorporated into the zoning ordinance which states in part that environmental standards are intended to protect and preserve the quality and quantity of the natural environment in the city, decrease the degradation and restore the health of the dunes, marshes, beaches and other environmentally- sensitive areas by preventing encroachments into adjacent areas, prevent damage to property from flooding and improper drainage, and to protect the quality of surrounding surface waters and resources; and

WHEREAS, The Marshfront Management Plan adopted by the City of Folly Beach anticipates a high level of sea level rise that will impact marshfront properties; and

WHEREAS, The Local Comprehensive Beach Management Plan adopted by the City of Folly

Beach recognizes super beachfront development as a management concern; and

WHEREAS, The City is charged by the Army Corps to regulate and monitor oceanfront

development in order to continue renourishment projects.

The City Council of Folly Beach, South Carolina, duly assembled, hereby ordains that the Folly Beach Code of Ordinance be amended as follows:

SECTION 168.04-01 LOTS RESIDENTIAL AND NONRESIDENTIAL DISTRICTS.

(A) General.

(1) Nonconforming lots of record lawfully established prior to March 1, 2019 that are not adjacent to either the OCRM Critical Line or the OCRM Baseline, may be developed with a single-family dwelling even though the lot of record fails to comply with the dimensional standards in Chapter 165: Dimensional Standards, provided it shall be in separate ownership and not of contiguous with other lots in the same ownership.

(2) Development of a single-family dwelling on the lot of record shall comply with the other standards in Chapter 165: Dimensional Standards, to the maximum extent practicable.

(B) Combination of lots. If two or more lots of record or combination of lots of record and portions of contiguous lots of record are in single ownership on or after March 23, 2010, June 9, 2020 or on the date they one or more become nonconforming and if all or part of one or more of these lots do not comply with the lot area standards in Chapter 165: Dimensional Standards; and if one or both of these lots are adjacent to either the OCRM Critical Line or the OCRM Baseline, the lots involved shall be considered to be an individual lot for the purposes of this ZDO, and no portion of these lots shall be used or sold which do not comply with the lot area standards in Chapter 165: Dimensional Standards, nor shall any division of the lots be made that leaves remaining any lot that fails to comply with the lot area standards.

(C) Lots in the DC and IC Districts. In addition to the ability to construct a single-family dwelling, lawfully established nonconforming lots of record in the DC and IC Districts may be developed with any use allowed in the district (Table 164.01, Table of Allowable Uses) following approval of a special exception permit (See 162.03-03) by the ZBA.

(D) Lots with no frontage on an open, public street. No lot which is adjacent to either the OCRM Critical Line or the OCRM Baseline and does not have frontage on an open, public street as of March 1, 2019 shall be developed without demonstration without the provision of at least 15’ of street frontage. The requirement for access may be satisfied by direct frontage or platted easement.

SECTION 168.04- 02 CHANGE OF NONCONFORMING LOT.

As a means of reducing the nonconformity, a nonconforming lot may be increased in area, width, or both, in accordance with the standards for a minor subdivision, 162.03-07(C).

Folly Beach, SC 29439 Topic: Ordinance 12-20 Date: July 14th, 2020 Mayor/Council, In 2019, as part of our moratorium work to study development regulations for environmentally sensitive properties, the City passed an ordinance which amended the language in our code for lot mergers. Lot merger is a tool which treats adjacent, non-conforming properties as one in terms of development and zoning if they are owned by the same person. The 2019 amendment clarified that we apply this rule to substandard lots that share a property line. The additional amendments proposed in Ordinance 12-20 would further refine our rules to make clear our focus on environmentally sensitive lots as directed by our various long-term planning documents. The proposed new language would clarify that the merger ordinance applies to properties adjacent to either the OCRM critical line or baseline. It would also make it clear that interior lots, which aren’t adjacent to these jurisdictional lines, are not affected. This ordinance would also make it explicit that the merger ordinance applies to any two adjacent lots that are under the same ownership even if only one of the lots is substandard.

WHEREAS, The 2015 Comprehensive Plan has separately stated goals of creating revenue

to the City through fees, including parking fees, and to expand the use of paid parking within the right of way; and

WHEREAS, The 2020 Update to the 2018 Strategic Plan identified the expansion of paid

parking as a goal; and WHEREAS, The COVID 19 Emergency has created an opportunity for the City to examine

all sources of income; and WHEREAS, The residents of Folly Beach will continue to be exempt from any additional

paid parking expansion; and WHEREAS, Staff and Park Folly have provided estimates of annual revenue along with

initial and ongoing costs to expand the paid parking area by approximately 450 spaces along Arctic and Ashley Avenue as well as certain side streets.

NOW, THEREFORE, BE IT RESOLVED, that the Administration of the City of Folly Beach is authorized to enter into an agreement with Park Folly to expand the paid parking and make necessary application to SCDOT for an encroachment permit for shoulder improvements and signage along certain side streets up to two blocks from the front beach and along the seaward side of portions of Arctic and Ashley Avenues. WHEREAS, The City desires to award a contract to supplier for temporary office spaces

while the City constructs City Hall; and WHEREAS, Pursuant to the City of Folly Beach Code of Ordinances, in the event there is a

need for services or items in excess of $20,000, formal bidding procedures must be followed with limited exceptions; and

WHEREAS, Formal bidding procedures were followed, and an ad was placed in the paper

at least five days prior to the opening of the proposals as required by our purchasing procedures: and

WHEREAS, One proposal was submitted by the following vendor:

• Willscot o Option One (2) temporary office trailers

Year $40,992.00 o Option Two (2) modular office spaces

CITY OF FOLLY BEACH Memo: RFP 02-20

The City advertised for temporary office space during the construction of City Hall. The only responsive bidder was Williams Scotsman “Willscot,” with two bid options:

1. Two trailer office spaces at $40,992 annually 2. Two “modular” office spaces at $65,216 annually

Staff recommends the trailers because, while they are less aesthetically appealing than the modular, the opportunity cost of $24,000 can be used towards City Hall construction instead of temporary office space. Regardless of which option we choose, the public facing temporary office space will be placed at the Community Center, restricting some of the current parking spaces available. The trailer will serve as the public “front counter” with water bills, business licenses, building permits, and other front counter business. The other trailer will be located at the 2nd East CCPRC lot. The trailers have restrooms that will be tied into the sewer line at these locations, and the public trailer will share on-site customer parking with the library/community center. The City will continue to encourage virtual operations as much as possible in recognition of the reducing parking.

RESOLUTION 24-20 A RESOLUTION BY THE FOLLY BEACH CITY COUNCIL AWARDING A CONTRACT TO CONSTRUCT GENERATOR PLATFORMS AT 55 CENTER STREET AND 510 EAST ERIE AVENUE.

WHEREAS, The City wishes to construct generator platforms at 55 Center Street and 510

East Erie Avenue to enhance the City’s readiness for emergency events; and WHEREAS, The City has applied for and received a FEMA grant to fund this project; and WHEREAS, The City properly advertised and received no bids for RFP 05-20 Folly Beach

Generator Platforms for 55 Center St & 510 E. Erie Ave; and WHEREAS, The City then consulted with three local companies who perform similar work

and received three proposals; and WHEREAS, The following proposals were as follows:

• American Shearing, LLC $39,500.00 structural aluminum • Ashley Steel, INC $48,866.00 galvanized steel • Division Five, INC $52,000.00 galvanized steel; and

WHEREAS, Staff and the consulting engineer recommend the bidder proposing structural

aluminum. NOW, THEREFORE, BE IT RESOLVED, that the Administration of the City of Folly Beach is authorized to award the bid for the construction of the generator platforms at 55 Center Street and 510 East Erie Avenue to American Shearing, LLC in the amount of $39,500 to be paid from Facilities Capital (10-6000-4000) with matching funds allocated from FEMA Reimbursements (10-4150-8200). CITY OF FOLLY BEACH Memo: Generator Platform Construction 2 locations

The City advertised for replacement generator platform construction at 55 Center Street and 510 East Erie to support installation of replacement generators as part of the FEMA Hazard mitigation grant awarded to the City in 2018. No bids were received. The City then consulted with our engineer and obtained 3 local companies that are known to provide this type of work. Proposals were requested and received. Results are as follows:

1. American Shearing, LLC $39,500.00 structural aluminum 2. Ashley Steel, INC $49,866.00 galvanized steel 3. Division Five, INC $52,000.00 galvanized steel

Staff recommends the low bidder. The low bidder has specified structural aluminum over galvanized steel for the platform construction. Though aluminum is typically more expensive it is the better product in our coastal environment and his bid is still a substantial savings over the other two bidders. Furthermore, the design professional in charge, Alan Campbell of Applied Building Sciences, has worked with this fabricator numerous times over the years and feels that he provides high quality work and is the best value for the City.

RESOLUTION 25-20

A RESOLUTION BY THE FOLLY BEACH CITY COUNCIL AUTHORIZING THE CITY OF FOLLY BEACH TO ENTER AND EXECUTE A SETTLEMENT AGREEMENT WITH FORMER EMPLOYEE JACK COOPER TO RESOLVE AN EMPLOYMENT DISPUTE.

WHEREAS, Mr. Jack Cooper was employed as a dispatcher for the City of Folly Beach. After his employment terminated, and through his attorney, Mr. Cooper made an employment claim; and

WHEREAS, The City believes the claims to unfounded but also that resolving the claim is in the best interest of the City.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of Folly Beach, South Carolina:

That the mayor of the City of Folly Beach is hereby authorized to enter and execute a settlement agreement with Jack Cooper with a payment amount of $5000 to be paid from the Claims and Judgments Reserve Account 10-5100-6905 thereby resolving all employment claims.
