FY 2019 Agreement with the City of Harrington and the Harrington Fire Company

The City will include with the City’s payroll schedule two (2) EMT-B with a repayment

schedule as follows:

Full time regular hours, not to exceed a total of 2080 hours per year, at the rate of

$20.8330 and $16.4779, will be reimbursed to the City at 50%

All overtime shall be reimbursed to the City at 100%

FICA will be reimbursed to the City at 50%

Pension will be reimbursed to the City at 50%

Health Benefits will be reimbursed to the City at 50% based on the coverage that

all City employees are receiving

Any increase in wage requested by Fire Company will be reimbursed to the City

at 100% (July 1, 2018 through June 30, 2019 amount to be reimbursed by the Fire

Company at 100% shall be $1.58 and $.50 respectively)

Fire Company will reimburse the City on a monthly basis after receiving an invoice from

the City.

In addition the City agrees to give a total of $3,000 per year for fuel. To be paid in four

adjustments of $750 at the end of each quarter (September, December, March, and June).

This agreement shall be in effect from July 1, 2018 through June 30, 2019. It shall be

reviewed annually at budget review. It is requested that a representative from the Fire

Company shall be present.

AN ORDINANCE AMENDING CHAPTER 157, ECONOMIC DEVELOPMENT AND REDEVELOPMENT, OF THE CODE OF THE CITY OF HARRINGTON TO EXTEND THE WATER AND SEWER IMPACT FEE WAIVER FOR SINGLE FAMILY DETACHED DWELLINGS THROUGH FISCAL YEAR 2019 BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF HARRINGTON IN COUNCIL MET:

Section 1. That the title of § 157-13 shall be amended by deleting the existing title and substituting in lieu thereof the following: § 157-13. Water and sewer impact fee waiver for single family detached

dwellings constructed in fiscal years 2017, 2018, and 2019.

Section 2. That § 157-13 C shall be amended by deleting the existing subsection and substituting in lieu thereof the following:

C. The water and sewer impact fee waiver is valid for fiscal years 2017, 2018,

and 2019 only. The following limitations on time apply: Section 3. That § 157-13 C (1) shall be amended by deleting the existing

subsection and substituting in lieu thereof the following: (1) This section applies only to building permits applied for between July 1, 2016

and June 30, 2019. Repealer. All ordinances and parts of ordinances inconsistent with the provisions of this Ordinance are hereby repealed.

Effective Date. The Clerk of Council shall certify to the adoption of this Ordinance and cause the same to be published as required by law; and this Ordinance shall take effect and be in force from and after its approval by Council.

April 25, 2018 Connections Community Support Programs, Inc. c/o Alan Matas 801 N. West Street Wilmington, DE 19801 RE: Connections Impact Fees Mr. Matas, On April 12, 2018, the City of Harrington granted Final Category A Site Plan approval for the proposed fit-out of Tenant Space #3 (5,056 sq. ft.) and Tenant Space #4 (3,356 sq. ft.) for use as an out-patient and in-patient drug treatment facility respectively. The final reconfiguration and renovation of the multi-tenant Spartan Station shopping center will result in Tenant Spaces 1, 2 and 4 being dedicated to in-patient drug treatment while Tenant Space 3 towards out-patient drug treatment. The proposed reconfiguration of the in-patient treatment areas will result in an increase of beds from 10 to 28. In-patient treatment services is classified as a ‘Hospital’ use by the 2013 Kent Department of Public Works Commercial EDU Worksheet, and allocates one EDU per 2 beds. As shown on Sheet A1.1 of the building plans dated March 9, 2018, the reconfigured Tenant Space #3, dedicated to providing out-patient treatment services, has 11 fixture units based on the 2013 Kent Department of Public Works Commercial EDU Worksheet. For an out-patient ‘Healthcare Facility’ use, the before-mentioned worksheet calculates one EDU for every six fixture units. The proposed reconfigured and expanded Connections Community Support Systems facility is thus rated at 15.8 EDU’s for the purpose of calculating impact fees (14 in-patient and 1.8 out-patient EDUs). City utility records indicate a water usage of 667,804 gallons in the past 12 billable months for the combined in-patient and out-patient treatment facility at 9 East Street (Tenant Space 1 & 2). The Harrington City Code §330-4, an EDU is defined as 91,250 gallons in a 12 month period. Tenant Space 1 & 2 is thus allocated a credit of 7.3 EDUs for the calculation of City and County impact fees. Additionally, the applicant is allocated a 4 EDU credit based upon the previous retail uses in Tenant Spaces 3 & 4. The approved Category A Site Plan states that the proposed reconfigured Connections Community Support Systems facility will employee an estimated 15 full-time employees. In accordance with the Harrington City Code §157-22, businesses are eligible for one City Water and Sewer Impact Fee waiver for every five full-time jobs created.

With at least 15 full-time employees (under the City’s definition), the proposed Connections Community Support Systems renovation and expansion is awarded an impact fee waiver for 3 of the 4.5 EDU’s not covered by the before-mentioned credit (existing water usage and previous retail uses). The applicant is thus required to pay for 1.5 City Sewer and Water Impact Fees (1.5 EDUs), and 4.5 County Sewer Impact Fees (4.5 EDUs). The full breakdown is shown below as follows:

April 16, 2018 The Pettit Group c/o John M. Pettit, PE 497 Center Street Sewell, NJ 08080 RE: Taco Bell Impact Fee Waiver Mr. Pettit, As shown on Sheet P4.0 of the building plans dated February 21, 2018, the proposed Taco Bell has 21 fixture units based on the 2013 Kent Department of Public Works Commercial EDU Worksheet. For a restaurant with public restrooms, the before-mentioned worksheet calculates one EDU for every six fixture units. The proposed Taco Bell is thus rated at 3.5 EDU’s for the purpose of calculating impact fees. As per the April 16th letter from Joe DePascale representing Harrington Investors, LLC, the proposed 2,753 sq. ft. Taco Bell drive-thru restaurant will employee approximately 12-15 full-time employees (working a 40 hour work week), and an estimated 20 part-time employees, 10 of which will work at least 30 hours per week. For the purposes of calculating an impact fee waiver, a full-time employee is defined as someone who works an average of at least 30 hours per week or 130 hours per month as set forth in the Harrington City Code §157-2. In accordance with the Harrington City Code §157-22, businesses are eligible for one City Water and Sewer Impact Fee waiver for every five full-time jobs created. With at least 22 full-time employees (under the City’s definition), the proposed Taco Bell is awarded an impact fee waiver for 4.4 EDU’s. However, while the City Water and Sewer Impact Fees has been waived, the applicant is still required to pay 3.5 County Sewer Impact Fees (one for each EDU), because the City’s sewer lines are connected to the County Wastewater Treatment Plant. At $2,442 per EDU, the applicant will be required to pay $8,547 in County Sewer Impact Fees, which will be billed as part of the City Building Permit. Lastly, the applicant shall still be required $3,500 in City Community Impact Fees ($1,000 per EDU). Location: 12 Short Street, 6 Dorman Street & 8 Dorman Street, Harrington Parcel Number: TM 6-09-17020-02-3602-00001 TM 6-09-17020-02-2900-00001 TM 6-09-17020-02-2901-00001 Property Size: 0.14 acres, 0.19 acres, and 0.13 acres Zoning & Project History: Circa 1904 – The existing structure located at 6 Dorman Street,

known as the ‘Reese Mansion,’ is constructed. The first floor of the building operated as a funeral home for many decades from at least 1976 until around 2010. The second and third floors have functioned as an apartment for the owner of the funeral home.

July 21, 2000 – As per Permit No. 6039, the 1,016 sq. ft. two-story dwelling located at 12 Short Street is demolished by the previous owners, Robert and Betty Taylor.

January 19, 2004 – All three subject parcels were identified on the Future Land Use Map (Exhibit 9C) of the 2004 Harrington Comprehensive Plan for ‘Commercial/Residential Mix.’ All three parcels are shown on Exhibit 4A – Unofficial Zoning Map as being zoned ‘Single-Family Dwelling.’

December 16, 2013 – The subject parcel is identified on the Future Land Use Map of the 2013 Harrington Comprehensive Plan for ‘Central Commercial.’

July 20, 2015 – City Council adopted the 2015 Zoning Ordinance, which rezoned 1 Dorman Street/12 Short Street from R-1 Single Family Dwelling Residential to C-2 Central Commercial, and 6 Dorman Street from C-3 Service Commercial to C-2 Central Commercial.

May 5, 2018 – Pre-application meeting with the applicant, Darrin Simpson to discuss the process for

May 21, 2018 – The applicant applies for two minor subdivisions. The first subdivides a parcel located at 1 Dorman Street into three parcels (two vacant), including one vacant parcel fronting Short Street, which is apart of this application. The second subdivides a new vacant building lot off from the primary dwelling and parcel located at 6 Dorman Street.

June 5, 2018 – Both of the before-mentioned subdivisions are recorded in the Kent County Recorder of Deeds (134/53 and 134/54 respectively), which have been attached to this staff report.

Compliance with the Comprehensive Plan As highlighted on Exhibit 17 – Future Land Use of the 2013 Comprehensive Land Use Plan, the subject parcel has been identified and designated as Central Commercial. This designation recognizes that the downtown is the ‘heart and soul’ of the community which provides

opportunities for local shopping and services in a walkable atmosphere. As stated on Page 8-8, “While the majority of the empty structures are older and may not be up to current building code regulations, they still hold great development potential. Several of the buildings are large and the building footprint takes up the majority of the property; therefore, on-site parking requirements cannot be met.” While there is mention of promoting mixed use development, nothing specific is listed as it concerns residential uses. As per page 8-10 of Chapter 8 – Land Use and Growth Management, the needs and goals of the Downtown/Central Commercial District are as follows: Needs

• Railroad Tracks – Improvements to blend in with downtown character • Lack of character and maintenance • Structure and curb appeal improvements • Signage for downtown directory/map of merchants • New street lighting for remaining downtown area • Window displays and maintenance on vacant buildings • Community downtown organization with local business officers and oversight • Downtown merchant involvement within their business for community events and

seasonal decorations. Goals (not listed in any order)

• Conduct Feasibility Study for traffic flow, requirements, and public parking location • Update (Chapter 440 Zoning) Central Commercial Zoning District for downtown

flexibility • Encourage sit-down restaurants with outdoor seating areas • Encourage personal services (beauty, barber, copy/fax, etc.) • Enforce separate utilities for each use • Preserve character thru creating business friendly design standard regulations • Integrate the railroad station/tracks with the downtown character • Assist in marketing walkability and community events with local merchants • Continue the rotation of the street banners to promote community events • Permit downtown mixed permitted uses • Improve the relationship between the City and Norfolk Southern. Conduct master plan

and implementation improvements such as: bicycle racks, transit bus shelter, benches, planters, downtown director and common area outdoor sitting areas.

• Continue to support the infrastructure and events and events as Freedom Park. Compliance with C-2 Central Commercial §440-71 As set forth in the Harrington City Code §440-716B, the purpose of the C-2 zone is, “to provide for commercial uses that primarily provide local goods and services, as well as supporting residential uses within the Central Commercial Zone. This zone is located in the central areas of the City where moderate- and high-density mixed-use development patterns are generally

established and desired, and where building reuse and infill to create higher densities are encouraged. The zone is designed to create lively, safe, human-scaled gathering places for the community through building design and orientation and by encouraging a mix of uses. This zone is also intended to ensure an attractive, inviting pedestrian-oriented setting through supplementary appearance, parking, and sign regulations.” In accordance with the Harrington City Code §440-71C(2), second floor residential dwellings are permitted by right in the C-2 Central Commercial District. However, in accordance with the Harrington City Code §440-71D, “Residences” are permitted in the C-2 Zone, upon recommendation by the Planning Commission with final approval by the City Council. In essence, Planning Commission and City Council decide and approve the single-family detached dwelling use and the change of use from a funeral home to 1st floor residential apartment, while the City Planner (through authority of City Manager) administratively ensured compliance with all other bulk zoning and parking requirements as part of the Category B Site Plan review process. However, the before-mentioned section of the City Code does not provide guidance and warrants for the Planning Commission and City Council in their review and determination of the appropriateness of the proposed residential uses. Staff Analysis As shown on the attached photographs, all of the buildings (save for Trinity Methodist Church whose parish hall fronts Short Street) along Short Street are single-family detached dwellings. Furthermore, the proposed single-family dwelling would replace a previous single-family dwelling that was demolished on the property in 2000 by the previous property owners. Going north along Dorman Street, all of the buildings on the west side of the street are single-family detached dwellings past the office of Blue Hen Construction at 1 Dorman Street. While many of the buildings along the east side of Dorman Street have been converted from a residential use (Food Pantry, City Hall, etc.), all of buildings were likewise constructed as either a single-family dwelling or duplex. While it is not permitted as a by-right use, many of the former (mostly larger) single-family dwellings in the C-2 Central Commercial District have been converted to multi-unit apartments, including at 10 Dorman Street, adjacent to the proposed single-family dwelling at 8 Dorman Street. Lastly, while the applicant has proposed a 1st floor apartment as an interim measure, his long-term goal is to renovate the structure into a 4-bedroom bed and breakfast, which is a permitted by-right use. Staff Recommendation Staff recommends that the Planning Commission recommend approval to the City Council of the two proposed detached single-family dwellings and the conversion of the existing funeral home to a first floor residential apartment. Planning Commission Recommendation: At their meeting on June 28, 2018, the Harrington

Planning Commission unanimously voted to recommend that the City Council approve the

following proposed residential uses in the C-2 Central Commercial Zoning District as set forth in

the Harrington City Code §440-71D:

1.) The construction of a detached single-family dwelling located at 8 Dorman Street

(TM 6-09-17020-02-2901-00001).

2.) The construction of a detached single-family dwelling located at 1 Dorman Street

(TM 6-09-17020-02-3600-00001). Since the submission of the original Planning

Commission application, Kent County Levy Court has assigned a new parcel number

of the property to: TM 6-09-17020-02-3602-00001, and will have an address of 12

Short Street.

3.) The conversion of an existing funeral parlor to a 1st floor residential apartment in a

building located at 6 Dorman Street (6-09-17020-02-2900-00001).

Staff Recommendation: Staff recommends that the City Council approve the two proposed

detached single-family dwellings and the conversion of the existing funeral home to a first floor

residential apartment in the C-2 Central Commercial District.
