MITIGATED NEGATIVE DECLARATION and PLANNING AND LAND USE MANAGEMENTCOMMITTEE REPORT relative to an appeal on Tentative Tract Map No. 62964 for property at10763-10777 Wilshire Boulevard.

Recommendations for Council action:

1. FIND that this project will not have a significant effect on the environment, pursuant to theCity's Environmental Guidelines and is in compliance with the California EnvironmentalQuality Act; that the Mitigated Negative Declaration reflects the independent judgment ofthe lead agency in the City of Los Angeles; that the documents constituting the record ofproceedings in this matter are located in Council fie No. 07-0080 in the custody of the CityClerk and in the files of the Department of City Planning in the custody of the EnvironmentalReview Section; and ADOPT the Mitigated Negative Declaration ¡ENV 2005-4238 MNDJ.

2. ADOPT the FINDINGS of the City Planning Commission (CPC), as the Findings of the CityCouncil.

3. RESOLVE TO GRANT IN PART the appeal filed by Lorraine Gray/La Salle ApartmentsTenants Group and Daniel Kavanaugh (Richard D. Agay, Esq., Representative), from theentire decision of the CPC in sustaining the decision of the Deputy Advisory Agency in part,and THEREBY APPROVE Tentative Tract No. 62964 composed of one lot, for a maximum60-unit residential condominium subdivision, for property at 10763-10777 WilshireBoulevard, subject to Conditions of Approval, as modified by the CPC, and further modifiedby the Planning and Land Use Management Committee, as attached to the Committeereport. The modified Conditions of Approval address the following:

- Delete conditions 16, MM-28, C3, C6, C7 and C8.

- Add to Condition No. 16, MM-28, C1.

- Modification to Condition No. 18, as volunteered by the applicant.

Summarv:

On February 6, 2007, the Planning and Land Use Management (PLUM) Committee conducted apUblic hearing regarding an appeal filed by Lorraine Gray/La Salle Apartments Tenants Group andDaniel Kavanaugh (Richard D. Agay, Esq., Representative), from the entire decision of the CPCin sustaining the decision of the Deputy Advisory Agency in part, in approving Tentative Tract No.62964 composed of one lot, for a maximum 60-unit residential condominium subdivision, forproperty at 10763-10777 Wilshire Boulevard, subject to Conditions of Approval, as modified by theCPC.

The Planning Department, Deputy Advisory Agency (staff), provided an overview of the appeaL.Staff addressed the adequacy of the Environmental Impact Report (EIR) and stated that there wereno significant unavoidable impacts identified by the Mitigated Negative Declaration (MND) that wasprocessed for the project. The project conforms to the General Plan and existing zone. Staff alsostated that the project did not meet the threshold which wouid require the Department ofTransportation to conduct a traffic study, which typically consists of 75 units or more.

The appellants stated that the reasons for the appeal' are reiated to the erroneous CPCdetermination letter, the need for a full EIR, and the impact from simultaneous constructionprojects. The appellants stated that the determination letter was inconsistent with the motion madeby the CPC and the more significant error was the omission of wording which requires finalapprovai by a Design Review Board before a demolition permit could be issued and before tenantscouid be given notice of eviction. The appellants also contended that a full EIR should be preparedbecause not all of the project impacts were addressed or mitigated. The appellants also argued thatthe major impact of the large project directly across the street was not addressed by the MND, ashealth and safety are impacted by having simultaneous construction projects on both sides ofWilshire Boulevard. The appellants requested that a condition be added that no demolition permitshall be issued for the subject property, until a Certificate of Occupancy is issued for the buildingacross the street.

The PLUM Committee asked the City Attorney to opine relative to the City's ability to imposeConditions of Approval that require a Certificate of Occupancy before a demolition permit may beissued. The City Attorney stated that the condition, as requested by the appellants, appears toviolate the Ellis Act.

Representatives speaking on behalf of the applicant stated that the applicant would agree tovoluntary Conditions of Approval which would make the start date of construction 16 months fromthe date of Council approval of the Tentative Tract (February 7, 2007). The applicant also agreedto coordinate construction efforts with the building across the street so as not tû have simültaneûüsconstruction along Wilshire Boulevard and also comply with Ellis Act notice requirements andrelocation plan.

Councilmember Weiss asked the City Attorney what could be done regarding the suggested cures.The City Attorney stated that the only things a demolition permit could be conditioned on are

relative to health, safety, or building code requirements. The City Attorney advised that theapplicant could not be forced to mitigate all of the negative impacts because the project is notcreating all of the impacts in the area. Councilmember Weiss expressed his disappointment in theCPC's action, and stated that the Council could not propose a course of action that the CityAttorney does not approve as lawfuL. Councilmember Weiss asked that the record reflect theapplicant's agreement to the voiuntary Conditions of ApprovaL.

After careful consideration of the documents on the fie and of the testimony provided at thehearing, the PLUM Committee recommended that Council grant in part the appeal filed by LorraineGray/La Salle Apartments Tenants Group and Daniel Kavanaugh (Richard D. Agay, Esq.,Representative), from the entire decision of the City Planning Commission in sustaining thedecision of the Deputy Advisory Agency in part and thereby approve Tentative Tract No. 62964 forproperty at 10763-10777 Wilshire Boulevard, subject to Conditions of Approval, as modified by theCommission, and further modified by the PLUM Committee.

CONDITIONS AND FINDINGS

BUREAU OF ENGINEERING - SPECIFIC CONDITIONS

1. That a fee of $5,450.00 be paid for tentative tract engineering report prior torecordation of the final map, satisfactory to the City Engineer.

DEPARTMENT OF BUILDING AND SAFETY, GRADING DIVISION

2. Comply with any requirements with the Department of Building and Safety, GradingDivision for recordation of the final map and issuance of any permit.

3. That a grading plan be prepared and be submitted to the Grading Division of the

Department of Building and Safety for review and approval showing any existingprivate drainage easements and/or drainage facilities within this tract propertycurrently being used for benefit of any other adjoining properties (specificallyproperty known as 10770 Lindbrook Drive, Ownership No. 95 on the radius

map). Any changes to these existing drainage easements and/orfacilitiesshall beto the satisfaction of the dept. of B&S Grading Division.

DEPARTMENT OF BUILDING AND SAFETY, ZONING DIVISION

4. That prior to recordation of the final map, the Department of Building and Safety,

Zoning Division shall certify that no Building or Zoning Code violations exist on thesubject site. In addition, the following items shall be satisfied:

a. The legai description on the submitted map should also include "Block 9".

b. Obtain permits for the demolition or removal of all existing structures on the

site. Accessory structures and uses are not permitted to remain on lotswithout a main structure. Provide copies of the demolition permits and

signed inspection cards to show completion of the demolition work.

c. Clarify if 25 feet Building Line setback is going to remain.

d. Provide a copy of (OJ conditions. Show compliance with the above conditions

as applicable or Department of City Planning approval is required.

e. Show all street dedication as required by Bureau of Engineering. DEPARTMENT OF TRANSPORTATION

5. That prior to the recordation of the final map, a suitable arrangement shall be made

satisfactory to the Department of Transportation, binding the subdivider and allsuccessors to the following:

a. A minimum of 40-foot reservoir space be provided between any securitygate(s) and the property line.

b. Parking stalls shall be designed so that a vehicle is not required to back into

or out of any public street or sidewalk.

c. This project is subject to the West Los Angeles Transportation Improvement

and Mitigation Specific Plan requirements. A parking area and driveway planbe submitted to the Citywide Planning Coordination Section of the

Department of Transportation for approval prior to submittal of buildingpermit plans for plan check by the Department of Building and Safety. FinalDOT approval should be accomplished by submitting detailed site/drivewayplans at a scale of 1 "=40' to DOT's West LA/Coastal Development ReviewSection located at 7166 W. Manchester Ave., Los Angeles Ca, 90045.

FIRE DEPARTMENT

6. That prior to the recordation of the final map, a suitable arrangement shall be made

satisfactory to the Fire Department, binding the subdivider and all successors to thefollowing:

a. Submittal of plot plans for Fire Department review and approval prior to

recordation of Tract Map Action.

b. Access for Fire Department Apparatus and personnel to and into all

structures shall be required.

c. No proposed development utilizing cluster, group, or condominium design ofone or two family dwellings shall be more than 150 feet from the edge of theroadway of an improved street, access road, or designated fire lane.

DEPARTMENT OF WATER AND POWER

7. Satisfactory arrangements shall be made with the Los Angeles Department of

Water and Power (LADWP) for compliance with LADWP's Water System Rules andrequirements. Upon compliance with these conditions and requirements, LADWP'sWater Services Organization will forward the necessary clearances to the Bureau ofEngineering. (This condition shall be deemed cleared at the time the City Engineerclears Condition No. S-1.(c).)

BUREAU OF STREET LIGHTING

8. Street light improvements shall be made to the satisfaction of the Bureau of Street

Lighting and/or the following street lighting improvements shall be required. (Thiscondition shall be deemed cleared at the time the City Engineer clears Condition S-3. (c).)

a. If street widening is required, two (2) existing lights on Wilshire Blvd. to be

relocated and upgraded.

BUREAU OF SANITATION

9. Satisfactory arrangements shall be made with the Bureau of Sanitation, Wastewater

Collection Systems Division for compliance with its sewer system review andrequirements. Upon compliance with its conditions and requirements, the Bureau ofSanitation, Wastewater Collection Systems Division will forward the necessaryclearances to the Bureau of Engineering. (This condition shall be deemed clearedat the time the City Engineer clears Condition NO.8-i. (d).)

INFORMATION TECHNOLOGY AGENCY

10. That satisfactory arrangements be made in accordance with the requirements of the

Information Technology Agency to assure that cable television facilities wil beinstalled in the same manner as other required improvements. Refer to the Los

Angeles Municipal Code Section 17.05N. Written evidence of such arrangementsmust be submitted to the Information Technology Agency, 120 S. San Pedro Street,Room 600, Los Angeles, CA 90012, (213) 485-7969.

DEPARTMENT OF RECREATION AND PARKS

11. That the Quimby fee be based on the (QJR5-3 Zone.

DEPARTMENT OF CITY PLANNING-SITE SPECIFIC CONDITONS

12. Prior to the recordation of the final map. the subdivider shall prepare and execute a

Covenant and Agreement (Planning Department General Form CP-6770) in amanner satisfactory to the Planning Department, binding the subdivider and allsuccessors to the following:

a. Limit the proposed development to a maximum of 60-unit dwelling units.

b. Provide a minimum of 2 covered off-street parking spaces per dwelling unit,plus 60 guest parking spaces. All guest spaces shall be readily accessible,

conveniently located, specifically reserved for guest parking, posted andmaintained satisfactory to the Department of Building and Safety.

If guest parking spaces are gated, a voice response system shall be installedat the gate. Directions to guest parking spaces shall be clearly posted.

Tandem parking spaces shall not be used for guest parking.

In addition, prior to issuance of a building permit, a parking plan showing off-street parking spaces, as required by the Advisory Agency, be submitted forreview and approval by the Department of City Planning (200 No. SpringStreet, Room 750).

c. Note to City Zoning Engineer and Plan Check. The Advisory Agency has

approved the following variations from the Los Angeles Municipal Code as itapplies to this subdivision and the proposed development on the site.

Not Applicable.

d. That prior to issuance of a certificate of occupancy. a minimum 6-foot-high

slumpstone or decorative masonry wall shall be constructed adjacent to

neighboring residences, if no such wall already exists, except in requiredfront yard.

e. The applicant shall install an air filtration system(s) to reduce the effects ofdiminished air quality on occupants of the project.

f. That a solar access report shall be submitted to the satisfaction of the

Advisory Agency prior to obtaining a grading permit.

g. That the subdivider consider the use of natural gas and/or solar energy and

consult with the Department of Water and Power and Southern CaliforniaGas Company regarding feasible energy conservation measures.

h. Recycling bins shall be provided at appropriate locations to promote

recycling of paper, metal, glass, and other recyclable materiaL.

13. That the subdivider shall record and execute a Covenant and Aareement to

complv with fai Condition's) per Ordinance No.163,194' Westwood DesianReview Board) prior to obtainina a buildina permit.

14. That the subdivider shall record and execute a Covenant and Agreement to comply

with the West Los Angeles Transportation Improvement and Mitigation Specific Planand Wilshire/Westwood Scenic Corridor Specific Plan prior to the issuance of abuildinq permit, qradinq permit and the recordation of the final tract map.

DEPARTMENT OF CITY PLANNING-ENVIRONMENTAL MITIGATION MEASURES

15. That prior to recordation of the final map the subdivider shall prepare and execute aCovenant and Agreement (Planning Department General Form CP-6770 andExhibit CP-6770. M) in a manner satisfactory to the Planning Department requiringthe subdivider to identify (a) mitigation monitor(s) who shall provide periodic statusreports on the implementation of mitigation items required by Mitigation ConditionNo(s). 16, 17 and C-4 of the Tract's approval satisfactory to the Advisory Agency.The mitigation monitor(s) shall be identified as to their areas of responsibility, andphase of intervention (pre-construction, construction, postconstruction/maintenance)to ensure continued implementation of tiie above mentioned mitigation items.

16. Prior to the recordation of the final map, the subdivider will prepare and execute a

Covenant and Agreement (Planning Department General Form CP-6770) in amanner satisfactory to the Planning Department, binding the subdivider and allsuccessors to the following:

MM-1 All open areas not used for buildings, driveways, parking areas, recreationalfacilities or walks shall be attractively landscaped and maintained inaccordance with a landscape plan, including an automatic irrigation plan,prepared by a licensed landscape architect to the satisfaction ofthe PlanningDepartment.

MM-2 Outdoor lighting shall be designed and installed with shielding, so that thelight source cannot be seen from adjacent residential properties.

MM-3 The design and construction of the project shall conform to the UniformBuilding Code seismic standards as approved by the Department of Buildingand Safety.

MM-4 Projects involving the importexport of 1 ,000 cubic yards or more of dirt shallobtain haul route approval by the Department of Building and Safety

MM-5 The developer shall install appropriate traffic signs around the site to ensurepedestrian and vehicle safety.

MM-6 Fences shall be constructed around the site to minimize trespassing,vandalism, short-cut attractions and attractive nuisances.

MM-7 All multiple residential buildings shall have adequate ventilation as defined inSection 91.7102 and the Municipal Code of a gas-detection system installedin the basement or on the lowest floor level on grade, and within theunderfloor space in buildings with raised foundations.

MM-8 Prior to the issuance of the demolition permit, the applicant shall provide aletter to the Department of Building and Safety from a qualified asbestosabatement consultant that no ACM are present in the building. If ACM arefound to be present, it will need to be abated in compliance with the SouthCoast Air Quality Management District's Rule 1403 as well as all other stateand federal rules and regulations.

MM-9 Project appiicants are required to implement stormwater BMPs to retain ortreat the runoff from a storm event producing 3/4 inch of rainfall in a 24 hourperiod. The design of structural BMPs shall be in accordance with theDevelopment Best Management Practices Handbook Part B PlanningActivities. A signed certificate from a California licensed civil engineer orlicensed architect that the proposed BMPs meet this numerical thresholdstandard is required.

MM-1 0 Post development peak stormwater runoff discharge rates shall not exceedthe estimated pre-development rate for developments where theincrease peak stormwater discharge rate will result in increasedpotential for downstream erosion.

MM-11 Maximize trees and other vegetation at each site by planting additionalvegetation, clustering tree areas, and promoting the use of nativeand/or drought tolerant plants.

MM-12Any connection to the sanitary sewer must have authorization from theBureau of Sanitation.

MM-13 Reduce impervious surface area by using permeable pavement materialswhere appropriate, including: pervious concrete/asphalt; unit pavers,i.e. turf block; and granular materials, i.e. crushed aggregates,cobbles.

MM-14lnstall Roof runoff systems where site is suitable for installation. Runofffromrooftops is relatively clean, can provide groundwater recharge andreduce excess runoff into storm drains.

MM-15 Promote natural vegetation by using parking lot islands and other

landscaped areas.

MM-16Paint messages that prohibits the dumping of improper materials into thestorm drain system adjacent to storm drain inlets. Prefabricatedstencils can be obtained from the Dept. of Public Works, StormwaterManagement Division.

MM-17 Promote natural vegetation by using parking islands and other landscapedareas.

MM-18AII storm drain inlets and catch basins within the project area must bestenciled with prohibitive language (such as "NO DUMPING - DRAINSTO OCEAN") and/or graphicai icons to discourage ilegai dumping.

MM-19Signs and prohibitive language and/or graphical icons, which prohibit illegaldumping, must be posted at public access points along channels andcreeks within the project area.

MM-20Legibility of stencils and signs must be maintained.

MM-21 Materials with the potential to contaminate stormwater must be: (1) placed inan enclosure such as, but not limited to, a cabinet, shed, or similarstormwater conveyance system; or (2) protected by secondary

containment structures such as berms, dikes, or curbs.

MM-22 The storage area must be paved and sufficiently impervious to contain leaksand spills.

MM-23The storage area must have a roof or awning to minimize collection ofstormwater within the secondary containment area.

Construction and demolition activities shall be scheduled so as toavoid operating several pieces of equipment simultaneousiy, whichcauses high noise levels.

The project contractor shall use power construction equipment withstate-of-the-art noise shielding and muffling devices.

The project sponsor must comply with the Noise Insulation Standardsof Title 24 of the California Code Regulations, which insure anacceptable interior noise environment.

Excavation and grading activities shall be scheduled during dryweather periods. If grading occurs during the rainy season (October15 through April 1 ), construct diversion dikes to channel runoff aroundthe site. Line channels 'lJith grass or roughened pavement to ísdücerunoff velocity.

Wilshire Boulevard shall remain clear of construction eciuipmentand no lanes shall be closed before 9 a.m. and after 3:30p.m.

DEPARTMENT OF CITY PLANNING-STANDARD CONDOMINIUM CONDITIONS

C-1. That approval of this tract constitutes approval of model home uses, including asales office and off-street parking. Where the existing zoning is (T) or (Q) formultiple residential use, no construction or use shall be permitted until the final maphas recorded or the proper zone has been effectuated. If models are constructedunder this tract approval, the following conditions shall apply:

1. Prior to recordation of the final map. the subdivider shall submit a plot plan

for approval by the Division of Land Section of the Department of CityPlanning showing the location of the model dwellings, sales office and off-street parking. The sales office must be within one of the model buildings.

2. All other conditions applying to Model Dwellings under Section 12.22A, 10

and 11 and Section 17.05 0 of the Code shall be fully complied withsatisfactory to the Department of Building and Safety.

C-2. That prior to recordation of the final map, the subdivider shall record an "Agreementfor Development of Units for Lease or Sale ("15% Ordinance")" covenant, to benefitthe Housing Authority, for certification of the development in accordance withSection 12.39A. Arrangements shall be made with the Department of Building andSafety, Zoning Section - Subdivisions (213.482.0000) to approve the covenantformat, prior to recording the covenant.

C-3. Prior to the recordation of the final map, the subdivider shall payor guarantee thepayment of a park and recreation fee based on the latest fee rate scheduleapplicable. The amount of said fee to be established by the Advisory Agency inaccordance with Section 17.12 of the Los Angeles Municipal Code and to be paidand deposited in the trust accounts of the Park and Recreation Fund.

C-4. That a landscape plan, prepared by a licensed landscape architect, be submitted toand approved by the Advisory Agency in accordance with CP-6730 prior toobtaininG any permit. The Landscape Plan shall identify tree replacement on a 1: 1

In the event the subdivider decides not to request a permit before the recordationof the final map, the following statement shall appear on the plan and be recordedas a covenant and agreement satisfactory to the Advisory Agency guaranteeingthat:

a. The planting and irrigation system shall be completed by thedeveloper/builder prior to the close of escrow of 50 percent of the units of theproject or phase.

b. Sixty days after landscape and irrigation installation, the landscapeprofessional shall submit to the homeowners/property owners association aCertificate of Substantial Completion (Sec. 12.40 G LAMC.)

c. The developer/builder shall maintain the landscaping and irrigation for 60days after completion of the landscape and irrigation installation.

d. The developer/builder shall guarantee all trees and irrigation for a period ofsix months and all other plants for a period of 60 days after landscape andirrigation installation.

C-5. In order to expedite the development, the applicant may apply for a

building permit for an apartment building. However, prior to issuance of a buildinqpermit for apartments, the registered civil engineer, architect or licensed landsurveyor shall certify in a letter to the Advisory Agency that all applicable tractconditions affecting the physical design of the building and/or site, have beenincluded into the building plans. Such letter is sufficient to clear this condition. lDaddition, all of the applicable tract conditions shall be stated in full on the buildinqplans and a COpy of the plans shall be reviewed and approved by the AdvisorvAqency prior to submittal to the Department of Buildinq and Safety for a buildinqpermit.

OR

If a building permit for apartments will not be requested, the projectcivil engineer, architect or licensed land surveyor must certify in aletter to the Advisory Agency that the applicant will not request apermit for apartments and intends to acquire a building permit for a

BUREAU OF ENGINEERING. STANDARD CONDITONS

S-1. (a) That the sewerage facilities charge be deposited prior to recordationof the final map over all of the tract in conformance with Section64.11.2 of the Municipal Code.

(b) That survey boundary monuments be established in the field in amanner satisfactory to the City Engineer and located within theCalifornia Coordinate System prior to recordation of the final map.Any alternative measure approved by the City Engineerwould requireprior submission of complete field notes in support of the boundarysurvey.

(c) That satisfactory arrangements be made with both the Water Systemand the Power System of the Department of Water and Power withrespect to water mains, fire hydrants, service connections and publicutility easements.

(d) That any necessary sewer, street, drainage and street lightingeasements be dedicated. In the event it is necessary to obtain off-siteeasements by separate instruments, records of the Bureau of Right-of-Way and Land shall verify that such easements have beenobtained. The above requirements do not apply to easements of off-site sewers to be provided by the City.

(e) That drainage matters be taken care of satisfactory to the CityEngineer.

(f) That satisfactory street, sewer and drainage plans and profiles asrequired, together with a lot grading plan of the tract and anynecessary topography of adjoining areas be submitted to the CityEngineer.

(g) That any required slope easements be dedicated by the final map.

S-2. That the following provisions be accomplished in conformity with the improvementsconstructed herein:

(a) Survey monuments shall be placed and permanently referenced to thesatisfaction of the City Engineer. A set of approved field notes shall befurnished, or such work shall be suitably guaranteed, except where thesetting of boundary monuments requires that other procedures be followed.

(b) Make satisfactory arrangements with the Department of Traffic with respectto street name, warning, regulatory and guide signs.

(c) All grading done on private property outside the tract boundaries inconnection with public improvements shall be performed within dedicatedslope easements or by grants of satisfactory rights of entry by the affectedproperty owners.

(d) All improvements within public streets, private street, alleys and easementsshall be constructed under permit in conformity with plans and specificationsapproved by the Bureau of Engineering.

(e) Any required bonded sewer fees shall be paid prior to recordation of the finalmap.

S-3. That the following improvements be either constructed prior to recordation of the

final map or that the construction be suitably guaranteed:

(a) Construct on-site sewers to serve the tract as determined by the CityEngineer.

(b) Construct any necessary drainage facilities.

(e) Repair or replace any off-grade or broken curb, gutter and sidewalksatisfactory to the City Engineer.

(f) Construct access ramps for the handicapped as required by the CityEngineer.

(g) Close any unused driveways satisfactory to the City Engineer.

(h) Construct any necessary additional street improvements to comply with theAmericans with Disabilities Act (ADA) of 1990.

(i) That the following improvements be either constructed priorto recordation ofthe final map or that the construction be suitably guaranteed:

1. Improve Wilshire Boulevard being dedicated and adjoining the

subdivision by the construction of the following:

(a) A concrete curb, a concrete gutter, and a 5-foot concretesidewalk adjacent to the property line and landscaping of theparkway.

(b) Suitable surfacing to join the existing pavement and tocomplete a 52.5-foot half roadway.

(c) Any necessary removal and reconstruction of the existingimpiûvements.

The Advisory Agency approval is the maximum number of units permitted under the tractaction. However the existing or proposed zoning may not permit this number of units.

Any removal of the existing street trees shall require Board of Public Works approval.

Satisfactory arrangements shall be made with the Los Angeles Department of Water andPower, Power System, to pay for removal, relocation, replacement or adjustment of powerfacilities due to this development. The subdivider must make arrangements for theunderground installation of all new utility lines in conformance with Section 17.05N of theLos Angeles Municipal Code.

The final map must record within 36 months of this approval, unless a time extension isgranted before the end of such period.

The Advisory Agency hereby finds that this tract conforms to the California Water Code, asrequired by the Subdivision Map Act.

No building permit will be issued until the subdivider has secured a certification from theHousing Authority that the development complies with the requirements for low-and

moderate-income housing, per Section 12.39-A of the LAMC.

The subdivider should consult the Department of Water and Power to obtain energy savingdesign features which can be incorporated into the final building plans for the subjectdevelopment. As part of the Total Energy Management Program of the Department ofWater and Power, this no-cost consultation service will be provided to the subdivider uponhis request.

FINDINGS OF FACT (CEQA)

The Deputy Advisory Agency, certifies that Mitigated Negative Declaration No. ENV-2005-4238-MND reflects the independent judgement of the lead agency and determined thatthis project would not have a significant effect upon the environment provided the potentialimpacts identified above are mitigated to a less than significant level throughimplementation of Condition No(s). 16, 17 and C-4 of the Tract's approvaL. Other identifiedpotential impacts not mitigated by these conditions are mandatorily subject to existing Cityordinances, (Sewer Ordinance, Grading Ordinance, Flood Plain Management SpecificPlan, Xeriscape Ordinance, Stormwater Ordinance, etc.) which are specifically intended tomitigate such potential impacts on all projects.

The Initial Study prepared for the project identifies potential adverse impacts on fish orwildlife resources as far as earth, air, water, plant life, risk of upset are concerned.However, measures are required as part of this approval which will mitigate the abovementioned impacts to a less than significant leveL. Furthermore, the project site, as well asthe surrounding area is presently developed with structures and does not provide a naturalhabitat for either fish or wildlife. In light of the above, the project qualifies for the DeMinimis Exemption for Fish and Game fees (AB 3158)

In accordance with Section 21081.6 of the Public Resources Code (AB3180), the PLUMCommittee has assured that the above identified mitigation measures will be implementedby requiring reporting and monitoring as specified in Condition No. 15.

Furthermore, the PLUM Committee hereby finds that modification(s) to and/or correction(s)of specific mitigation measures have been required in order to assure appropriate andadequate mitigation of potential environmental impacts of the proposed use of thissubdivision. Mitigation measures related to tenant relocation was modified inasmuch asthree of the measures are inconsistent with the Ellis Act as it is implemented. Thesemeasures were deleted as noted under MM-28.

FINDINGS OF FACT (SUBDIVISION MAP ACT)

I n connection with the approval of Tentative Tract No. 62964, the PLUM Commitee of theCity of Los Angeles, pursuant to Sections 66473.1,66474.60, .61 and .63 of the State ofCalifornia Government Code (the Subdivision Map Act), makes the prescribed findings asfollows:

(a) THE PROPOSED MAP IS CONSISTENT WITH APPLICABLE GENERAL ANDSPECIFIC PLANS.

The adopted Westwood Community Plan designates the subject property for VeryHigh Residential land use with the corresponding zone of R5. The propertycontains approximately 0.51 net acres (25,425 net square feet after requireddedication) and is presently zoned (QJR5-3. The proposed development of 50-unitresidential condominium is allowable under the current adopted zone and the landuse designation.

The site is not subject to the Specific Plan for the Management of Flood Hazards(floodways, floodplains, mud prone areas, coastal high-hazard and flood-relatederosion hazard areas).

Therefore, as conditioned, the proposed tract map is consistent with the intent andpurpose of the applicable General and Specific Plans.

(c) THE SITE IS PHYSICALLY SUITABLE FOR THE PROPOSED TYPE OFDEVELOPMENT.

(d) THE SITE IS PHYSICALLY SUITABLE FOR THE PROPOSED DENSITY OFDEVELOPMENT.

The site is one of the few underimproved properties in the vicinity. Thedevelopment of this tract is an infill of an othervise mix-density residential

neighborhood.

The site is level and is not located in a slope stability study area, high erosionhazard area, or a fault-rupture study zone.

The Department of Building and Safety, Grading Division, has conditionallyapproved the tract map. Condition No. 3 was added by the Advisory Agency toassure that grading and drainage was addressed in the final grading plan to thesatisfaction of the Department of Building and Safety Grading Division.

The soils and geology reports for the proposed subdivision were found to beadequate by the Grading Division of the Department of Building and Safety.

(e) THE DESIGN OF THE SUBDIVISION AND THE PROPOSED IMPROVEMENTSARE NOT LIKELY TO CAUSE SUBSTANTIAL ENVIRONMENTAL DAMAGE ORSUBSTANTIALLY AND AVOIDABLY INJURE FISH OR WILDLIFE OR THEIRHABITAT.

There appear to be no potential public health problems caused by the design orimprovement of the proposed subdivision.

The development is required to be connected to the City's sanitary sewer system,where the sewage will be directed to the LA Hyperion Treatment Plant, which iscurrently being upgraded to meet Statewide ocean discharge standards. TheBureau of Engineering has reported that the proposed subdivision does not violatethe existing California Water Code because the subdivision will be connected to thepublic sewer system and will have only a minor incremental impact on the quality ofthe effluent from the Hyperion Treatment Plant.

(g) THE DESIGN OF THE SUBDIVISION AND THE PROPOSED IMPROVEMENTSWILL NOT CONFLICT WITH EASEMENTS ACQUIRED BY THE PUBLIC ATLARGE FOR ACCESS THROUGH OR USE OF PROPERTY WITHIN THEPROPOSED SUBDIVISION.

No such easements are known to exist. Needed public access for roads andutilities wil be acquired by the City prior to recordation of the proposed tract.

1). In assessing the feasibility of passive or natural heating or cooling

opportunities in the proposed subdivision design, the applicant has prepared

TENTATIVE TRACT NO. 62964

and submitted materials which consider the local climate, contours,configuration of the parcel(s) to be subdivided and other design andimprovement requirements.

2). Providing for passive or natural heating or cooling opportunities will not result

in reducing allowable densities or the percentage of a lot which may beoccupied by a building or structure under applicable planning and zoning ineffect at the time the tentative map was filed.

3). The lot layout of the subdivision has taken into consideration the maximizing

of the north/south orientation.

4). The topography of the site has been considered in the maximization of

passive or natural heating and cooling opportunities.

5). In addition, prior to obtaining a building permit, the subdivider shall consider

building construction techniques, such as overhanging eaves, location ofwindows, insulation, exhaust fans; planting of trees for shade purposes andthe height of the buildings on the site in relation to adjacent development.

These findings shall apply to both the tentative and final maps for Tract No. 62964.
