In that issue, in the article titled ‘Apartment residents take on sport climbing’, the name of the company that set up the rock climbing wall has been wrongly printed as ‘Outdoor India’ while the correct name is ‘Outback India’. We regret the error.

It was a preventable fire that took nine lives and injured scores of others. On February 23rd, the Beyond Carlton trust, co-founded by a parent of one of nine who died in the Carlton Towers fire, conducted its memorial service at Manipal Hospital Auditorium.

Shankar Bidari should have attended this memorial service. Not just in honour of the people who lost their lives, but in honour of the high-minded notification he issued in March 2010, just a week after the tragedy.

Bidari in an exercise of police power unseen in Bangalore till then, had asked owners and leasers of all four-storeyed or taller buildings in the city to respond with their full status of compliance on fire safety and building plan rules. He even wrote in the notification that “disobeying these directions will be liable for prosecution and penalty”. He cited the Karnataka Police Act and the Indian

Penal Code to prove that he had the power to enforce the law.

Several times during the month of April 2010, Citizen Matters contacted Bidari. We asked him how many people had filed their responses and whether the police now had a better idea of how many buildings were fire unsafe. Bidari did not respond.

In effect, after issuing a notice at a time the coals were hot, and getting a lot of press for it, Bidari killed and buried the notification

too. Clearly he should not have issued an order he could not enforce, making a further mockery of affairs.

No one from the police department attended the memorial at Manipal

Hospital on February 23rd. They should have. It would have reminded them of their own notification. Ignored, dead, toothless and gone.

LOcAL MATTERsA Citizen Matters investigation finds that panchayat officials at CK Palya off Bannerghatta Road could have stopped Srinivas Reddy’s building and chose not to.

The collapse of a wall in a construction site in CK Palya off Bannerghatta road on February 2, which killed five labourers and injured four, has once again proved how easily government sanctions can be obtained for any poor-quality building.

A Citizen Matters investigation has shown that the lives of Parbhu Yadav, 40, Sanjith Sharma, 25, Raju Podar, 60, Jugesh Thathi, 40, and Raja, 60, all from Bihar could have been saved. Preliminary observations after the tragedy had already indicated flaws in construction including poor quality of cement mix, poor foundation and lack of cement pillars to support the nearly 30-feet-tall 120-feet-wide

brick wall.

The building plan itself seems to have been sanctioned off-handedly by the Grama Panchayat (GP) and was not subjected to any technical inspections. As the area is a revenue land outside BBMP limits, GP is supposed to sanction the plan for the building. But this can be done only after a report is submitted by the Taluk Panchayat (TP), as GP does not have the technical personnel to approve plans or check construction quality.

In this case, Anekal TP officials say that they were not even informed about the building. Meanwhile the

Anekal Tahsildar sent a notice to Reddy in September 2010, saying that there were 21 illegal sheds in agricultural plots and that if Reddy did not vacate these properties within 15 days of the notice, the buildings would be demolished at Reddy’s own expense. An action that was not actually taken.

S R Nayak, Chairman of State Commission for Human Rights (SHRC), says “this incident could have been prevented if the builder had followed norms, used good quality materials and if the authorities had controlled these violations”.

Seven years after BDA laid out the first plan of Phase I of PRR (Peripheral Ring Road), the project is nowhere close to taking off, due to land acquisition issues.

The plan for Phase II is supposed to connect Hosur Road to Tumkur Road, intersecting Bannerghatta road, Mysore road and Magadi road – but experts say that since NICE road runs close to the proposed Phase II alignment, Phase II would not be necessary.

rent rightAll about rental agreementsRental agreement is an agreement entered into by the lessor/landlord and the lessee, it is legally binding on both the parties. It creates rights and liabilities on both the parties. The term “lessor” is used to describe the owner and the term “lessee” is to mean the tenant, the agreement is to let the tenant use the premises of the landlord for specified period of time and sum of money to be paid by the tenant as security deposit and monthly rental.

A standard rent agreement should have the following:-

1) Description of the parties: This includes the name and address of both the owner and the tenant

2) Details of the premises:- The description of the property whether it is a flat, building, room with the house number, location etc.

3) Terms of the agreement:- includes the conditions agreed upon by both the parties and these conditions usually are :-

i) Security deposit clause:- the lumpsum amount that the tenant has to pay to the owner as a security against any damage that may cause/occur to the property during the period of the tenancy and the same is to be repaid back with no interest by landlord upon the end of the tenancy and peaceful repossession of the property.

ii) Monthly rent clause:- the amount of rent to be paid per month on or before, the date should be specified.

iii) Period of tenancy: - The a g r e e m e n t should state the period for which tenancy is given and may also include the term that the tenancy may be extended upon the agreement of both the parties and the percentage of the increase in the monthly rental every year.

iv) No sub let clause:- The tenant is prohibited from giving the premises on rent to the third party.

v) Maintenance:- the tenant has to maintain the premises with due care without any causing any damage to the property. In case of furnished premises, all the furniture

needs to maintained properly with no wear and tear, a clause may be inserted to allow the owner to have periodic inspection of the house with due notice to the tenant.

vi) No alterations, major repairs to be done without the consent of the owner.

vii) All the electricity and telephone and water charges need to be borne by the tenant till the end of the tenancy.

viii) Peaceful possession:- the tenant has to return back the

peaceful possession of the property to the owner on the end of the tenancy.

4) The agreement should be signed by both the parties which should be witnessed by 2 other individuals who should also sign the agreement as witness.

The rent agreements are usually entered into only for only 11 months; this is done with an intention to avoid registration of the rent agreement. As per Section 17

of the Indian Registration Act, all the lease agreements relating to immovable property, which is for a period of one year or beyond needs compulsory registration. The lease agreement can be on a non judicial stamp paper of Rs.20. It is the terms and conditions of the agreement that matter the most. You can get the stamp paper in State Bank of India or State Bank of Mysore.

The common issue that an owner usually faces is arrears of rent. However, with the security amount collected, s/he can be

secure atleast for a while. Due notice may not be given before ending the tenancy etc.

The issues that tenants face is at the end of the tenancy when the security deposit is to be returned, there is deduction in the security deposit in terms of painting charges which is usually not mentioned in the rent agreement, however this has become a norm.

Garbage, sewage and construction debris are eating up Bengaluru’s Chunchaghatta lake situated in the Konankunte ward.

Sujatha, 39, a domestic worker, living on the banks of the lake, says that she has tried telling her neighbours not to dump their garbage in the lake but to no avail. Another resident, Manjula says that BBMP does not collect garbage because there are no tar roads. The lake lacks any fencing and although the BBMP does not collect the waste door to door, garbage trucks use a part of the lakeside as a collection centre.

The lake has natural islands and wetland areas with hundreds of birds. But it is a sight of mixed spectacles as one cannot ignore the heaps of garbage and construction debris polluting the

lake.

Murli (name changed on request), who lives nearby , says that adding to the garbage woes, private contractors have been dumping construction debris for over a year. When residents confront the contractors dumping the debris, the answer is that it is being dumped with the consent of the ward councillor.

When Citizen Matters contacted Shashirekha Jayaram, Konankunte corporator, over the phone, her husband Jayaram insisted he speak for her. He says that the lake is now under BDA custody and they will call for tenders to undertake the development of the lake and the dumping of debris will be looked into. He denies giving any permission to dump debris.

Another cause of lake pollution is the residents on the south bank letting their sewage directly in to the lake as their houses have no sewerage connections. A BBMP official who was inspecting the lake at the same time as this reporter said that there is litigation against the residents on the south bank for encroachment and that might be the reason for lack of any drainage connections or pukka roads.

Chunchaghatta Lake, adjacent to Eshwar Layout in southern JP Nagar, home to hundreds of birds is slowly being encroached upon and polluted. A Citizen Matters inquiry has resulted in authorities waking up.

The residents nearby refer to rumours about a storm water drain be-ing built on the north of the lake that connects to Sarakki Lake to drain Chunchaghatta Lake and build a bus stand.” However, Surya Naraya-na, Bommanhalli Zone BBMP executive engi-neer in charge of storm water drains clarifies that the storm water drain is not being built to drain the lake, but only to channel excess water during monsoon to the Sarakki Lake downstream.

The state of the lake was alerted to us by arathi Manay yajaman from Brigade Millennium. as this enquiry started, this reporter contacted BBMP and BDa. BBMP then sent officials to inspect the lake. On 23rd February, BDa had sent surveyors to check and write a report to take further action.

Chief Minister B S Yeddyurappa’s ABIDe task force submitted its recommendations on rules for implementing RTE (Right To Education) in Karnataka on February 3rd. Contrary to the government’s own earlier draft, ABIDe has proposed loosening of the government’s RTE grip on unaided schools. It has recommended removing provisions that make RTE mandatory for all unaided (private) schools. Instead, ABIDe wants unaided schools to be selected for RTE only based on unmet demand in local areas. ABIDe has also recommended removing fee and admission restrictions for unaided schools, that the earlier draft wanted. ABIDe RTE group comprised 18 members. Representatives of unaided schools prepared part of the draft that pertains to unaided schools, and NGO members looked into the government/aided schools section. ABIDe’s recommendations run in contrast to a Karnataka

High Court order on January 10 in a case unrelated to RTE but school-control. On the petition filed by parents against fee hike in an unaided school, the court had said that state government should regulate fee structure, admission of students, service condition of employees etc., in private unaided schools affiliated to any board.Dr Abraham Ebenezer, Founder Chairman of Ebenezer International School and a member of the ABIDe working group, says that private schools would challenge this ruling in higher court. Ebenezer says that unaided schools are open to admitting children provided that government pays the fees well in advance and does not interfere in the school’s functioning.For parents of children in Bengaluru’s unaided schools, it is going to be an uncertain time ahead. It is not clear whether the state government will accept ABIDE’s recommendations wholesale. Also, the RTE Act is itself under challenge in the Supreme Court at New Delhi. A verdict may take time, and implementation in states is likely to be pushed back till a verdict is out.

At the meeting organised by Citizen Action Forum, on February 19, three issues were tabled for discussion – the move by BBMP to hike property tax by 15 per cent, water supply, and the garbage problem.

CAF presented detailed figures for the revenue that the BBMP

was collecting. Rental revenues have not been updated or rationalised; many hoardings are illegal, bring no revenue and are not being penalised either; and by spreading the net wider over property tax defaulters, the corporation could easily earn enough to cover its needs.

The replies from the dignitaries were eloquent in supporting the popular perception of lack

of political will in decision makers – there was not a word of explanation on why 60 per cent of property owners were being allowed to escape the tax net.

Many invited VIPs turned up late, after 4.30 pm , when the meeting was called for 3.30 pm – and most of them left early too, before

the end of the discussions. One of them during the discussions on water and garbage said that he had just returned from Singapore two days earlier. One of the attractions of becoming a civic administrator is the prospect of foreign tours to “study” garbage disposal or

storm water drains!

Somebody mentioned that the invitees were “not authorised” to take decisions and that they could only pass on the audience’s feelings to the “higher-ups”, which means even strongly interactive sessions like this one, make it difficult for us to get heard directly in the corridors of power.

If the BBMP has failed to zero in on property tax defaulters, why should property owners pay for the inefficiency of the corporation, by shelling out 15 per cent more? A question that got no answer at the meeting.

As L S Narayanan, Vice president of North Eastern Joint Action Front put it scathingly, “If the city administration is unable to collect tax efficiently, why should citizens who have paid, be made liable for a hike?”

On a lighter vein, Jayanagar MLA Vijaya kumar remarked how most people are preoccupied about their own daily worries: like am I getting water in my house? The RWA members may worry about their street’s supply. It is only a few oddballs like our N S Mukunda (CAF president) who worry about the city

Waste-wise in lIC ColonyLIC Colony, Jayanagar residents have started implementing solid waste management. They have converted an area behind their BBMP ward office into a segregation centre. The project which started last October, has a BBMP contract worker collect dry waste from about 100 houses.

The worker segregates further and earns money by selling dry waste. One kg of plastic fetches her `4, while a kg of mixed dry waste fetches `1.50. Weightwise, about 70-80% of waste from our homes is only plastic. Wet waste goes to BBMP’s landfill currently. E-waste is given to the NGO Samarthanam, which has a centre in Bannerghatta for segregation and disposal.
