1. INTRODUCTION AND BACKGROUND
1.1 The circular is issued as a result of consultation with unions and is underpinned by
the principle of balancing the need for maintaining efficiency, allowing for minimum
disruptions in the system.
1.2 This circular is intended to address processes pertaining to the implementation of
the new Post Establishment.
2. PURPOSE OF THE CIRCULAR The purpose of this circular is to: 2.1 set out the approved processes of rationalisation and redeployment, absorption and
the advertisement of posts to be followed for the implementation of a new post
establishment for Public Service (PS) personnel in Public Ordinary as well as
Special Schools with effect from 1 September 2019; and
2.2 provide employment extension for the period up to and including 31 October 2019
to all temporary (contract) employed PS staff.
3. LEGISLATIVE FRAMEWORK
3.1 Constitution of South Africa, 1996 (Act No. 108 of 1996 Section 197, Chapter 10)
3.2 Labour Relations Act, 1995 (Act No. 66 of 1995), as amended
3.3 Employment Equity Act, 1998 (Act No. 55 of 1998), as amended
3.4 Public Service Act, 1994 (Proclamation No. 103 of 1994), as amended
3.5 South African Schools Act, 1996 (Act No. 84 of 1996), as amended
3.6 Public Service Regulations 2016, as amended
3.7 GDE Recruitment and Selection policy, 2015
4. IMPORTANT CONSIDERATIONS FOR THE FILLING OF VACANCIES
4.1 The Department prohibits the use of any form of unfair discrimination.
4.2 The Department emphasises that “in the making of appointments as well as the
filling of posts in the public service, due regard shall be taken in equality, other
democratic values and principles enshrined in the Constitution”.

4.3 All School Governing Body members are reminded that they will recommend
candidates for appointment to vacant posts subject to approval by the HOD /
delegated authority in terms of Section (20) (j) of the South African Schools Act.
5. FILLING OF PS - VACANCIES AT INSTITUTIONS
5.1 The District Director must ensure that all employees additional to the current Post
Establishment are placed prior to filling of vacancies and before advertising.
5.2 The filling of vacancies is in line with the Public Service Regulation, 2016 as
amended in Part VII (C).
5.3 The process to fill vacancies is as per the following priority order:
5.3.1 placement of additional permanent employees;
5.3.2 the absorption of qualifying temporary personnel. Qualifying personnel will
be those in the employment of the Department of Education for a period of
three (3) months, still employed by 31 October 2019 and based on the
availability of the same post in the 2019 Post Establishment in line with
Circular 1 of 2016;
5.3.3 after the absorption process all resultant vacancies will be advertised to be
filled temporarily after the 01 September 2019 and those that are remaining
after absorption will then be advertised in the Vacancy Circular in 2020,
which is to be made available to potential applicants including in and around
the school community and on the GDE website; and
5.3.4 temporary employees must be appointed once re-deployment of additional
permanent personnel and absorption has been completed. Such a vacant
post will have to be advertised and the recruitment processes should be
done accordingly.
6. 2019 POST ESTABLISHMENT
6.1 Gauteng Department of Education (GDE) will issue new Post Establishments for
Public Ordinary Schools and Public Special Schools on 01 September 2019 to
become effective on 01 November 2019. The Post Establishment is based on the
Snap shot survey as at 31 July 2018.
6.2 Principals must not appoint a General Assistant(GA) on an Administrative
Assistant(AA) post and vice versa.

7. PROCESS TO DEAL WITH PUBLIC SERVICE PERSONNEL WHO ARE
ADDITIONAL TO THE POST ESTABLISHMENT.
7.1 Public Service personnel additional to the Post Establishment are staff members
appointed in a permanent capacity who have been identified to be in
oversupply/additional to the 2019 Post Establishment at their present institutions
resulting from operational requirements, and such employees should not have
volunteered to be additional to the Post Establishment e.g. merging of institutions,
decline in learner numbers, etc.
7.2 Public Service personnel additional to the 2019 Post Establishment may be re-
deployed permanently to vacant substantive concomitant posts in the Department,
in line with this circular and the existing legislative framework.
7.3 Principals must assist the Department in securing the continuous employment of
permanently appointed employees who have been declared additional to the 2019
Post Establishment as a result of operational requirements.
7.4 The implementation of the new Post Establishment issued on 01 September 2019
may in some cases result in an increase or decrease in the number of posts as
compared to the Post Establishment currently in use. Such new posts, as well as
any other posts that are not currently filled, will be reserved for the re-deployment
of personnel additional to the 2019 Post Establishment as a first step, in line with
the outlined procedures.
NB: All resultant vacancies on the 2019 Post Establishment, where there
were no placements and absorptions of temporary PS staff, will be filled
temporarily and later the remaining will be published on a vacancy list.
7.5 All staff members should be treated fairly in the process of identifying Public
Service Personnel additional to the Post Establishment. The relevant District
Official (Circuit manager / IDSO/ Cluster Leader), in co-operation with the
Principal shall identify in writing (using Annexure E – Form EXOP 1), the staff
additional to the 2019 Post Establishment, who are in oversupply at the
institution.

7.6 Operational requirements for schools are based on, but not limited to the
following:
a) change in learner enrolment;
b) implementation of new Post Establishments;
c) closure or merging of education institutions/sectors;
d) change in type of school; and
e) redress as well as equity.
The following criterion will apply, in order of priority, in the identifying staff
additional to the Post Establishment:
7.6.1 The Principle of Last-In-First-out (LIFO) in Ordinary and Special
schools will apply. The period of continuous service shall include ALL
continuous service rendered at any school/office.
7.6.2 Functional Areas may be applied to PS staff in special schools –
Institutions are expected to rationalise their functional responsibilities
in line with the new Post Establishment, e.g. the number of posts for
Housekeeper(s) allocated on the new Post Establishment for 2019 to
a school, compared to the present Post Establishment.
7.6.3 Where there is a deviation from or inability to implement LIFO in Public
Ordinary and Special schools, permission to deviate must be sought
from the HOD or delegated authority.
7.7 Procedure that will apply:
7.7.1 trade Union representative party Council (GPSSBC) will be invited by
the District Director to a meeting on the process of declaration and
placement. All information used at this meeting will be made available
in writing to all stakeholders on request;
7.7.2 all Principals must inform their respective staff of the new Post
Establishment and the procedures for declaring officials additional to
the Post Establishment due to operational requirements if the school is
affected by such a process, as well as the effect it will have on their
respective establishments. Public Service personnel who has been
identified as in addition shall be informed, in writing. (use Annexure E:

Form EXOP 1) by the delegated authority. Minutes of such a meeting
must be recorded and accessible to all members of staff;
7.7.3 prior to making a determination, the relevant District Official (Cluster
Leader/IDSO/Circuit Manager) must obtain all relevant information
from the schools that fall within his/her jurisdiction; and
7.7.4 The relevant District Official (Cluster Leader/IDSO/Circuit Manager),
together with Principals within the District, shall determine the
person(s) that is/are additional to the approved 2019 Post
Establishment, as well as the vacant posts.
7.8 Principals are to submit the names of the Public Service personnel additional to
the Post Establishment, to the HR Provisioning Unit in line with the attached
Management Plan (Annexure A). Identified personnel additional to the Post
Establishment will complete the profile form attached as (Annexure G).
7.9 Principals and SGBs are to submit vacancies for their schools to the HR
Provisioning Unit in line with the 2019 Post Establishment on the GDE 79
(Annexure C). These posts will be advertised in a Provincial Closed Vacancy List
for PS posts to be utilised at the Districts for placement.
7.10 HRP should analyse the submitted names of personnel who are additional to the
Post Establishment and match the choices to the needs of the vacant
concomitant posts, looking at the proximity of the additional staff from where
he/she lives.
7.11 After a successful District re-deployment process, a permanent placement letter
will be issued by the District Director.
7.12 Districts will notify Head Office if the unplaced personnel wish for placement
across the Districts.
7.13 Where a staff member has selected a post that is requesting movement across
District for placement, a profile will be submitted to the Directorate HO:
Recruitment & Selection indicating the District name and the area of interest,
subsequently HO, Recruitment & Selection will then facilitate suitable placement
and engage the relevant District to communicate with the School Governing Body
and make an offer to the official, where the consultation process would have been
concluded successfully.

7.14 The respective District Director must manage the continuous placement of
additional employees in his/her District and to ensure that these Public Service
personnel are appointed into vacancies on the 2019 Post Establishment by way
of matching as well as placing them in his/her District.
7.15 District Directors must refrain from advertising newly created post if they have
additional personnel in their Districts. District Directors must consider office-
based vacant General and Administrative Assistants posts to place the
additional school based employees.
7.16 Where it is not possible for placement to occur, staff member(s) declared
additional to the Post Establishment may be temporarily redeployed or held
additional to the current Post Establishment until such time as a suitable
placement has been identified.
7.17 Districts with unplaced additional personnel should not encourage schools to
advertise vacancies until the placement process is resolved.
7.18 Schools are to request the advertisement of posts from the District Director by
submitting a completed GDE 79 (Annexure C).
7.19 Head Office will compile a vacancy circular to advertise vacant posts which will
also be published on the GDE website. Advertisement of vacancies will be
guided by the PSR of 2016, part 4, Section 65 for filling either on permanent or
temporary basis.
7.20 The District Director, as the delegated authority will guide Principals and SGB's
on the procedures to follow in filling PS-posts at institutions in line with the
Management Plan (Annexure A).
7.21 The District - HRP Unit will manage response handling of received applications
and forward them to schools for selection process thereafter.
7.22 Shortlisting as well as interviews will be guided by the applicable legislative
frameworks and guidelines.
7.23 The prescribed grievance procedure for the recruitment and filling of posts will
apply.

7.24 Schools and SGBs are referred to paragraph 6.1.2 of the “GDE Recruitment
and Selection Policy and Implementation Guidelines for appointment of Public
Service (Permanent & Temporary) (salary levels 2-12)” when filling school
based PS posts on temporary basis
8. MANAGEMENT PLAN
8.1 The Management Plan for the implementation of the 2019 Post Establishments
and placement/matching of Public Service personnel additional to the Post
Establishment, absorptions as well as the advertising of resultant vacancies are
attached here as Annexure A.
8.2 All stakeholders are kindly requested to plan accordingly in keeping with the
identified dates as per the Management Plan.

ANNEXURE D: POST ESTABLISHMENT 2019- PUBLIC SERVICE PERSONNEL
PUBLIC SERVICE - GRIEVANCE PROCEDURE FOR THE PERMANENT RECRUITMENT PROCESS
1. Should there be any grievance on the placement, absorption and recruitment
processes through a vacancy list , the following grievance procedure, read together with PSCBC Resolution 14 of 2002 shall apply for all Districts Offices and Head Office:
1.1 All the grievances should be lodged with the Designated Office identified to
facilitate the resolution of grievance. Dispute Management Unit at both the District and Head Office shall serve as Designated Office.
1.2 The grievance may be lodged by the following category:
1.2.1 Union, acting on behalf of its member(s); and 1.2.2 The employee.
1.3 The following category is excluded from lodging a grievance:
1.3.1 Any member of the selection committee; and 1.3.2 The SGB.
1.4 The aggrieved party shall have ninety (90) working days from the date on
which he/she became aware of the official act or omission that adversely
affect him or her, in which to lodge a grievance with the Designated Office.
The latter shall see to it that the lodging of the grievance is acknowledged
within three (3) working days of receipt thereof. The Designated Office may
advise the District Director to waive the ninety (90) days limit under
exceptional.
1.5 In lodging the grievance, the grievant must use the prescribed form to lodge
the grievance, as contained in the PSCBC Resolution 14 of 2002.
1.6 The grievant is encouraged to lodge the grievance immediately, as soon as
he/she becomes aware of the official act or omission in order to get an appropriate relief. The grievant is encouraged to lodge the grievances before the placement, absorption and recruitment process could be finalised. Failure to lodge the grievance immediately, before the conclusion of the aforementioned processes will not invalidate the grievance, provided it is lodged within ninety (90) days.

1.7 The Designated Office will investigate the grievance by collecting any
relevant documents, objects and interviewing any person that might be having relevant information to assist with the investigation. Upon the conclusion of the investigation, the Designated Office (DM) will make recommendations to the District Director for a decision.
1.8 The Designated Office, including the office of the District Director shall have
fifteen (15) days to resolve the matter. Should the grievant remain unsatisfied, the Designated Office should forward all the documentations relating to the grievance to the Directorate: Dispute Management at Head Office for a decision. The Directorate: Dispute Management at Head Office will have fifteen (15) days to have the matter finalised. In the case of Head Office, the grievant will lodge the grievance directly with Dispute Management at Head Office who will facilitate the resolution within thirty (30) days from the date of lodgement.
1.9 Should the grievant remain unsatisfied with the outcome from Head Office;
he/she will have the right to declare a dispute to the relevant bargaining council (e.g. GPSSBC).
