This office acknowledges receipt of your letter.dated January 24, 1977, in which you make two requests on behalf of your client, Boleslavs Maikovskis, for production of certain documents pur­suant to the Freedom of Information Act.

Your first request is a clarification of your prior request t~. 3 contained in your letter to this office dated. December 7,.

1976. This requa.st was answered by this office in a response . letter dated February 1,1, 1977.

Your second request seeks the sources of information allegedly provided by Immigration and Naturalization Service Commissioner Leonard F. Chapman to a Congressional Subcommittee on Immigration, on April 3 and June 2S, 1974, relative to a Service investigation involving your client. ·

In response to this request, which must be considered as a request under.the Privacy Act of 1974, under 8 CFR 103.22(a) there are no records which are available to you pursuant to the Privacy Act of 1974. Further, there are no records which are available to you under 28 CFR 16.57(b).

You may appeal my decision~ in thi's matter by \n·iting to the Office of the Deputy Attorney General, Ua S. This is a request for identifiable records pur­suant to the Freedom of Information Act, 5. U.S.C. §552. I am writing on behalf of my clients, the Society of Sur­vivors of the Riga Ghetto, Inc~. and Mrs. Lore Oppenheimer, its President. As survivors of the Nazi holocaust and American citizens, my ~lients have,a vital interest in the presence of Nazi war criminals within the United States and the apparent failure of the United States Government to take any action against these individuals.

Of particular interest are the actions or, more properly, inactions of the United States Government concern­ing Boleslav Maikovski, also known as Boleslavs Maikovskis, who presently lives at 232 Grant Street, Mineola, New York. Maikovski was born in Latvia in 1909 and entered the United States in 1949 from West Germany. He was sentenced to death in absentia by a Latvian court on October 31, 1965 for his role in the massacre of the citizens of Audrini, Latvia.

My clients request any and all documents which refer, in whole or in part, to Boleslav Haikovski. The documents sought include, but are not limited to, the following:

1. Letter from David G. Trager, United State.s Attorney for the Eastern District of New York, to Henry A. Kiss.inger, dated January 13, 1976, with regard to past and/or pendin~ deportation proceedings against Boleslav Maikovski or otherwise relating to Maikovsk i, the response to that letter on January 30, 1976 by the Administrator of the Bureau of Security and Consular Affairs of the Depart­ment of State, and any documents relating to those letters.

2. Visa papers or other documents relating to the entry of Ma~kovski into the United States.

3. Deportation proceedings and/or investiga­tions held in the past or currently pending with regard to Maikovksi or which reflect or refer to, in whole or in part, the advisability or legal basis of such proceedings . ..

4. The results of any internal investigations made by any officer of ~he Departme~t of State, the Depart­ment of Justice or the Immigration and Naturalization Ser­vice with regard to lost files of deportation proceedings and/or related investigations of Maikovski.

In addition, my clients are interested in obtain­ing any and all documents which refer in whole or in part to the following:

5. A list of forty witnesses supplied to the Department of Justice and/or the Immigration and Naturali­zation Service by the Israeli government in connection with forty-seven alleged Nazi war criminals currently under investigation. Attached as Exhibit A to this request is an article from the June 23, 1976 edition of Newsday descr~bing the transmittal of this list. Also desired are any and all documents which relate to current or possible investigations .. by any party of the presence of alleged Nazis within the \., .... , United States. ·

Any documents relating to a trip taken to Israel by an Immigration and Naturalization Service inves­tigatory team on or about August 31, 1976 to talk to poten­tial witnesses against alleged Nazi war criminals currently in the United States; any documents relating to plans to fly these witnesses to the United States; and any documents relating to hearings which were held or are planned as a result of this trip. Attached to this request as Exhibit B is an article from the August 3 1 , 19 76 edit ion of the Hew York Post referring to this investigatory team. ---

7. A request sent by the Immigration and Natu­ralization Service to the Department of State asking the Department of State for a list of names of witnesses in Russia against alleged Nazi war criminals in the United States ~nd for permission to interrogate these witnesses, as well as all related correspondence.

8. A request sent by the Immigration and Natu­ralization Service to the Department of State asking for names of witnesses in West Germany against alleged Nazi war criminals in the ·united Stateg, as well as all related correspondence.

' Since none of the statutory exceptions from the Freedom of Information Act's mandatory disclosure provi­sions apply to the above requests, I would expect access to the requested records to be granted within the mandated ten working. days. If, however, access is denied to any part of the requested records, please describe such material in detail and specify the statutory basis for the denial as well as your reasons for believing that the alleged statu­tory justification is applicable. Please separately state your reasons for not invoking your discretionary powers to release the requested documents in the public interest. Such statements will be helpful to my clients in deciding whether to appeal an adverse determination, and might also help to avoid unnecessary litigation. If you deem some parts of a file or document to be "reasonably segregable" from non-exempt parts, I request that you provide me with t,. copy of the remainder, regardless of your judgment as to its .~ intelligibility.
