Lawrence University Faculty Handbook III.1 Last revised: September 2017 Chapter III PERSONNEL POLICIES AND PRACTICES This section of the Handbook identifies the policies and procedures that govern a faculty member’s affiliation with the University. These policies and procedures are applied by the President, the Provost and Dean of the Faculty, the Dean of the Conservatory, department chairs, faculty committees, and faculty members as indicated below. In all personnel matters, as in all its operations, Lawrence University promotes equal employment opportunity for all. Academic Freedom Lawrence University, a liberal arts college and conservatory of music, is dedicated to the development of intellect and talent, the pursuit of knowledge and understanding, and the cultivation of critical literacy and sound judgment. To that end, members of the Lawrence community are free to engage in, speak on, and write about scholarly research and creative activity without fear of censorship or retaliation. In the classroom, laboratory, and studio, teachers must be free to teach and students free to learn; we must be free to challenge each other’s beliefs, to explore new ideas and critically examine old ones, and to listen to others without disruption. Knowledge, skill, understanding, and creative expression are acquired through interactions that are often complex and even controversial. Although these interactions may at times cause discomfort, they may not be obstructed. Intellectually honest and vibrant communities engage in complex interactions and the ability, hereby protected, to exchange ideas in a spirit of mutual respect is essential to our educational mission. Lawrence University faculty, as well as invited speakers and performers, may express their views publicly. However, the University may restrict speech that is defamatory of character, harassing, or infringes a protected right to privacy or confidentiality. Statement on Diversity As an institution of liberal learning dedicated to preparing our students for life in the 21 st century, Lawrence University is committed to creating a diverse university community that enriches teaching and learning as well as promotes respect and understanding. ThissectionoftheHandbookidentifiesthepoliciesandproceduresthatgovernafacultymember’saffiliationwiththeUniversity. ThesepoliciesandproceduresareappliedbythePresident,theProvostandDeanoftheFaculty,theDeanoftheConservatory,departmentchairs,facultycommittees,andfacultymembersasindicatedbelow.Inallpersonnelmatters,asinallitsoperations,LawrenceUniversitypromotesequalemploymentopportunityforall.AcademicFreedom

LawrenceUniversityfaculty,aswellasinvitedspeakersandperformers,mayexpresstheirviewspublicly.However,theUniversitymayrestrictspeechthatisdefamatoryofcharacter,harassing,orinfringesaprotectedrighttoprivacyorconfidentiality.

Theworldisincreasinglyinterconnected,andtheabilitytointeractintelligentlyandproductivelywithdiversegroupsandviewpointsisnowavitallifeskillandiscentraltoaccomplishingthemissionandpurposesofaliberalartscollege.Toachieveourgoalofcreatingamorediverseuniversitycommunity,werelyondiversityinthefaculty,thestaff,thestudentbody,andinthecurriculum.Wevaluediversityinareassuchasrace,color,nationalorethnicorigin,religion,sex,sexualorientation,genderidentity,parentalormaritalstatus,age,anddisability.Therefore,theuniversityplacesahighvalueonrecruitingandretainingindividualswhocancontributetotheUniversity’s

diversitygoalsinfacultyhiring.Anindividual’sabilitytoparticipateinestablishingamorediversecommunityisalsobaseduponthefacultymember’sareaofscholarlyinterest,communityengagementactivities,contributionstothecurriculum,andpedagogicalmethods.RecruitingTheApprovalProcess

1. Eachspring,departmentsseekingtofilltenure-trackpositionsinthefollowingyearshouldsubmitrequeststotheProvostandDeanoftheFaculty.Suchrequestsshouldincludeapositiondescriptionordraftofajobadvertisementandabriefrationalefortherequestthataddressestheimportanceofthepositiontoboththedepartmentandtheuniversitymorebroadly.Theyshouldalsoindicatewhetherdiscussionsofthepositionwithfacultyoutsidethedepartmenthavetakenplaceandwhetheralternativepositiondescriptionshavebeenconsideredandrejected.Requestsshouldbesubmittednolaterthantheendofthethirdweekofthespringterm.

2. TheProvostandDeanoftheFacultywillrevieweachrequestinconsultationwith

theCurriculumCommitteeandwillnotifythefacultyasawholeofallrequeststhroughthecommitteeminutes. MaterialsconsideredduringthesediscussionsmayincluderecentdepartmentalreviewsandothersupportingdocumentseithersubmittedbythedepartmentorrequestedbytheProvostandDeanoftheFacultyorthecommittee.TheProvostandDeanoftheFacultyorthecommitteemayalsoinitiateconversationswiththedepartmentchair,thedepartmentasawhole,orotherappropriatemembersorsegmentsofthefaculty.

3. TheProvostandDeanoftheFacultywillconsultwiththePresident,whomust

approvethefillingofanyvacancyortheestablishmentofanynewposition.

4. Afterappropriatedeliberations,theProvostandDeanoftheFacultywillrespondpromptlytoalldepartmentalrequestsandwillannounceallapprovedsearchestothefacultyasawhole,preferablyatthesecondfacultymeetingofthespringterm.

TheSearchProcess

1. Onceasearchhasbeenapproved,adepartmentwillbeexpectedtoassembleasearchcommitteepriortotheinitiationofthesearchitself. Thecommitteeshouldconsistofalltenuredandtenure-trackmembersofadepartmentplusatleasttwoadditionaltenuredortenure-trackmembersofthefaculty.Ordinarilythechairofthedepartmentservesasthechairofthesearchcommittee,thoughtheremaybeexceptionstothisrule,andordinarilyretiringfacultymembersdonotserveoncommitteessearchingfortheirreplacements. Whenthesearchcommitteeisassembled,oneofthemembersofthecommitteewillbedesignatedasthediversitypointperson. Whilediversityissuesmustbeconsideredbyallmembersofthe

committee,thediversitypointpersonwillmonitorandcoordinateeffortstoensurethatdiversityremainsoneofthegoalsofthesearchprocess. Non-tenure-trackandadjunctmembersofadepartmentmaynotserveasmembersofthesearchcommittee,thoughdepartmentsareencouragedtosolicittheirinputandinvolvementintheprocess,whereandasappropriate. Studentsmaynotserveasmembersofthesearchcommittee,thoughstudentparticipationinthesearchprocessiscrucial,anddepartmentsshouldensurethatmechanismsareinplacetoprovideathoroughandreliablerepresentationofstudentviews.

2. ThechairofthesearchcommitteeshouldcontacttheProvost’sofficetoreceiveacopyofthechecklistforsearchchairs,whichoutlinesthestepsinvolvedinthehiringprocess.

3. Earlyinthesummerprecedingthesearch(assumingthatthesearchproceedsona

normalschedule),thediversitypointpersonandthechairofthesearchcommitteewillarrangetomeetwithoneormoremembersofthePresident’sCommitteeonDiversityAffairs(PCDA). Inthismeeting,membersofthePCDAwillprovideassistanceandsupportingmaterialsforthedevelopmentandexecutionofaplanforidentifyingandattractingcandidateswhocancontributetotheUniversity’sdiversitygoals. ThediversitypointpersonwillsummarizethisplaninamemototheProvost,andthemembersofthecommitteeshouldexecuteduringthesummerthoseportionsoftheplanthatdonotdependuponeventsthattakeplaceduringtheacademicyear(e.g.conferences).Iftraveltospecificeventsorconferencesseemslikelytosignificantlyraisethevisibilityofthepositonwithcandidateswhocancontributetodiversity,thesearchchairshoulddiscusswiththeProvostaddingfundsforsuchtraveltothebudgetforthesearch.

4. Inappointingoutsidemembersofthesearchcommittee,thedepartmentshallmake

itsrecommendationstotheProvostandDeanoftheFaculty,whomayagainseekadvicefromtheCurriculumCommittee. Whilethereisnosinglestandardthatobtainsintheappointmentofoutsidecommitteemembers,departmentsshouldbearinmindsuchfactorsasdisciplinaryappropriateness,therequirementsofinterdisciplinaryprograms,genderbalance,diversity,andtheneedtobringaninstitutionalperspectivetobearonallhires.

5. OncetheProvostandDeanoftheFacultyhasapprovedtheappointmentofthe

outsidemembersofthesearchcommittee,thecommitteeasawholeshouldmeettodiscusstheconductofthenationalsearch.Amongtheissuesthatshouldbeconsideredatthismeetingarethestrategiesforattractingastronganddiverseapplicantpool,thenatureofthescreeningprocess,andthescheduleforreviewingcandidates.Particularstrategiesforattractingapplicationsfromdomesticminoritiesshouldbeconsidered,includingplacingannouncementsinappropriatepublicationsandcontactingparticulargraduateprograms.AlladvertisementsofthepositionwillincludetheURLforacentralwebpagethatincludes,amongotherthings:Lawrence’sMissionStatement,StatementofCommunityValues,andStatementonDiversity;informationalresourcesaboutLawrenceandtheAppleton

are;andresourcesforcandidateswhowishtolearnaboutspecificdiversityorotherissuesatLawrenceandintheFoxValley.Theadvertisementshouldincludetextsimilartothefollowing: “Lawrenceiscommittedtoenhancingthediversityofitsfacultyandtheviewpointsandapproachesthatadiversefacultyrepresents.CandidatesareencouragedtoreadmoreaboutLawrenceathttps://lawrencecareers.silkroad.com/lawrenceuniversity/About_Us.htmlandtoaddressintheirlettersofapplicationthewaysinwhichtheycouldcontributetoLawrence’sinstitutionalmissionandgoals. ThiswebsitealsoincludesinformationalresourcesabouttheUniversityandthesurroundingcommunity.”Havingidentifiedspecificpotentialapplicantswhocancontributetodiversity,thechairofthesearchcommitteewillcontactindividualswhoappeartohavepromiseaspotentialapplicants,makingthemawareofthesearch. Appropriateadministrativesupportwillbeprovidedfortheproductionofpersonallettersofinvitation.

6. Throughoutthesearchprocess,committeemembersshouldincludeintheir

considerationsthestatementsbycandidatesaboutwaysinwhichtheycouldadvanceLawrence’sinstitutionalgoals.IntermsofthegoalssetforthintheStatementonDiversity,candidatesmayenhanceLawrence’sdiversityinmanyways,includinginthefollowingareas: race,color,nationalorethnicorigin,religion,sex,sexualorientation,genderidentity,parentalormaritalstatus,age,anddisability.Hiringdiversefacultyisauniversitygoal.Committeesshouldmaintainanimportantdistinction: whileenhancementofdiversityisapositivevalue,itisnotanecessarycriterion. Thougheachcommitteewillofcourseneedtobalancecompetinggoodsusingtheirbestjudgment,themostobviousplacestoaccommodatetheaddedvaluegiventoenhancementofdiversityaretheareasofresearchandteaching.

7. MembersofthesearchcommitteemustfollowFederalguidelinesthatmakeitillegal

toaskdirectlyaboutpersonalinformationsuchasrace,gender,sexualorientation,healthanddisabilitiesifthisinformationisnotvolunteeredbythecandidate.

8. Itisappropriatethoughnotnecessaryforthefullsearchcommitteetodetermine

thatsomesub-setofthecommitteewillconducttheearlyscreeningofapplications.Allmembersofthecommittee,however,shouldhaveaccesstoallapplications.Asthepoolofapplicantsisnarrowed,itbecomesincreasinglyimportantthatallmembersofthecommitteeparticipatefullyinthesearchprocess,andbythetimecandidatesarebroughttocampus,fullparticipationbyallmembersisessential. Aspartoftheinitialreviewofapplications,searchcommitteememberswillconsiderstatementsbycandidatesaboutwaysinwhichtheycouldadvanceLawrence’sinstitutionalgoals.

9. Ordinarilythesearchcommittee,orsomeagreeduponsubsetofthecommittee,will

reviewlettersofapplicationandsupportingmaterialsandestablishalistofcandidatestobeinterviewedatanationalmeeting,wheneverpossibleandpractical.Atleastthreemembersofthesearchcommitteeshouldbeinvolvedintheestablishmentofthatlist,andallmembersofthecommitteeshouldbeconsulted

priortoitsfinalestablishment. TheSearchCommitteewillidentifyasmallpoolofcandidatestobeconsideredforpotentialcampusinterviews. Thispoolwillgenerallybelargerthanthegroupoffinaliststobeinvitedtothecampus. TheSearchChairwillmeetwiththeProvosttodiscussthisgroupofcandidatesandwillbringthedossiersofanyofthemostpromisingapplicantsfromcandidateswhocancontributetotheUniversity’sdiversity,butwhoarenotinthepoolofpotentialfinalists. Aspartoftheirconversation,thechairofthesearchcommitteeandtheProvostwilldiscusshoweachofthesecandidateswasevaluated. Whileitistheobjectiveofthesepolicestoincreasetherateofhiringcandidateswhocancontributetodiversity,nosearchcommitteeeverhasaspecificmandatetohireacandidatewhocanenhancediversity,norwillenhancementofdiversityeverleadtocandidatesreceivingquantitativeadvantagesintherankingofcandidates(e.g.extrapointsinarubric). TheProvostwillauthorizeasmallgroupoffinaliststobeinvitedtocampus.ThenumberofcandidatesinvitedforinterviewsmaybeexpandedbytheProvostinordertoassureagroupoffinaliststhatprovidesarichsetofchoicesforanofferofappointment. TheProvostandDeanoftheFacultymaysolicitadvicewhenappropriatefromtheCurriculumCommittee.

10. Onceoncampus,thecandidatesmeetwithallmembersofthesearchcommittee,the

ProvostandDeanoftheFaculty,thePresident,theDeanoftheConservatoryinthecaseofConservatoryhires,arepresentativegroupofstudents,andothermembersofthefaculty,staff,oradministrationasappropriate. Inarrangingsuchmeetings,thesearchcommitteeshouldbearinmindespeciallydepartments,offices,andinterdisciplinaryprogramswithwhichthecandidatemightnaturallyinteract.Candidatesalsomakepublicpresentationsand/orteachclassesappropriatetotheirdisciplines.

11. Afterfinalistsforapositionhavevisitedcampus,allmembersofthesearch

committeeshouldbeinvitedtoameetingatwhichthefinalistsarediscussedand,whendiscussionsareconcluded,avotetaken.Priortothismeeting,writtenresponsesshouldbesolicitedfromotherfacultymembers,staffmembers,andstudentswhometwiththefinalists.Allmembersofthecommittee,butnoothers,vote.TheresultsofthisvotearecommunicatedtotheProvostandDeanoftheFacultyasthecommittee’srecommendation. Thegoalinallsuchdiscussionsshouldbeconsensus.Incaseswherethevoteisnotunanimous,thespecificdetailsofthevote—thatis,howparticularmembersofthecommitteefrominsideandoutsidethedepartmentvoted,alongwithothergermaneinformation—shallalsobecommunicatedtotheProvostandDeanoftheFaculty,sothathisorherdecisionmaybeasfullyinformedaspossible. TheChairwillrecommendtotheProvostacandidatetobeofferedaposition. TheProvostmayaskforarankingofthefinalists.ThedecisiontomakeanofferwillbemadebytheProvost,inconsultationwiththesearchchair.

12. TheProvostandDeanoftheFaculty’sapprovalmustbesecuredbeforeanyofferof

employmentcanbemade,andtheProvostandDeanoftheFacultywillcommunicatetheofferofemploymenttothecandidate.IncasesofConservatory

hiring,theDeanoftheConservatorymaycommunicatetheofferofemployment.

13. AllappointmentsaresubjecttotheapprovalofthePresident.ReportingandRecord-Keeping

1. Onceanofferofemploymenthasbeenaccepted,thedepartmentchairshouldreporttotheProvostandDeanoftheFacultyinwritingonthesearch,includinginthatreportthefulltextoftheadvertisement(s)placed,alistofthepublicationsoron-lineservicesinwhichtheywereplaced,thenumberofapplicationsreceived,thenumberofcandidatesinterviewedateachstage,andthenumberofapplicantsandinterviewedcandidateswhowereidentifiablywomenandthenumberwhowereidentifiablymembersofdomesticminorityethnicgroups. Tofacilitatethecollectionofdataongenderandethnicdistribution,applicantswillhavetheopportunitytoreporttheirgenderandethnicityduringtheonlineapplicationprocess.

2. Attheconclusionofasearch,allapplicantfileswillbemaintainedintheelectronic

applicanttrackingsystem.AppointmentsRegularfull-timeappointmentstotheFacultyofLawrenceandDownerCollegesmaybemadeattheranksofLecturer,Instructor,AssistantProfessor,AssociateProfessor,orProfessor.PersonsappointedattherankofAssistantProfessororabovenormallybegintheirservicewithafour-yearappointment.NewfacultywhohavenotcompletedthePh.D.orotherappropriateterminaldegreereceiveappointmentsattherankofInstructorforatermofnomorethantwoyears.Apersonhiredwithoutsuchadegreewillnormallybeexpectedtocompleteitbytheendofthefirstacademicyearofemployment(i.e.,bythetimeofCommencementinthatyear);failuretodosowillnormallyresultintheterminationoftheappointmentattheendoftheinitialcontractperiod.PromotiontoAssistantProfessoroccursautomaticallyuponcompletionoftheterminaldegree,andtheinitialtwo-yearcontractisextendedtobeafour-yearcontract,originatingfromthedateofappointment.Lecturersreceiveone-yearappointments.Regularfull-timeappointmentstotheConservatorymaybemadeattherankofLecturer,Instructor,AssistantProfessor,AssociateProfessor,orProfessor.PersonsappointedattherankofInstructorwillbepromotedtotherankofAssistantProfessorfollowingasuccessfulreviewforreappointment.PersonsappointedattherankofInstructororabovenormallybegintheirservicewithafour-yearappointment.Full-timeappointmentstotheFacultymaybemadewithorwithoutthepossibilityoftenure. Theinitialletterofappointmentindicatesthetenurestatusofapositionandlettersofreappointmentalsoaddressthetenurabilityofaposition.TheUniversityreservestherighttodeclareapositionuntenurableforreasonsofprogramchangesorfinancialexigency.Allpart-timefacultyareappointedattherankofLecturer,withtwoexceptions:tenured

regularfacultywithpart-timeloads,whocontinuetocarrytheiracademicrank;andvisitingfaculty,whoserankisdeterminedaccordingtotheirprofessionalstatus.AllappointmentsattherankofLecturerareforspecifiedterms,nottoexceedoneyear.Part-timefacultymembersarenotexpectedtocarrythecollateralresponsibilitiesoffull-timefacultymembers,suchascommitteeassignmentsandadvisingresponsibilities.Part-timefacultymembersarenoteligiblefortenure.Normally,anofferofappointmentisfirsttenderedorallybytheProvostandDeanoftheFacultyortheDeanoftheConservatory.Onceacandidateacceptsanoffer,thePresidentorthePresident’sdelegatesendsaformalletterofappointmenttothecandidate. Thisletterdescribestheposition,includingitstenurability,statesthelengthoftheappointment,andindicatessalaryandfringebenefits. TheletteralsooutlinestheUniversity’sexpectations,bothspecificandgeneral,ofthenewfacultymember.Thetermsoftheinitialletterofappointmentaresubjecttoamendmentbyyearlyappointmentslips,lettersofreappointment,promotion,ortermination,orbyotherlettersfromthePresidentrelativetothetermsofthefacultymember’saffiliationwithLawrence.EvaluatingTeachingExcellenceinteachingistheparamountobjectiveofLawrencefacultymembers,andthedevelopmentofexcellenceinteachingistheresponsibilityofeverymemberofthefaculty.Membersofthefacultyareexpectedtobeattentivetothequalityoftheirownteachingandbeinterestedinandsupportiveoftheeffortsofcolleaguestomaintainthehighestpossiblelevelofachievementasteachers.Lawrence’sfacultyviewteachingexcellenceasacontinuouslyevolvinganddynamicprocess. Weencouragefacultytocollaborateontheenhancementofteachingexcellencethroughthesharingofideasandconstructivesuggestionsforcontinueddevelopment.TheUniversityencouragesallfacultymemberstorequestthattheirstudentsandappropriatemembersofthefacultyengageintheprocessofevaluatingcourses.Students’courseevaluationscanprovideusefulinformationaboutthequalityofteachingandtheorganizationofcourses. Thechiefpointoftheevaluationsistoassistfacultymembersindesigningandteachingtheircourses.Theseevaluationsarenotusedaspartofthetenurereview,thoughtheymaybeusedtoinformdiscussionsbetweenthefacultymemberandtheProvostandDeanoftheFacultyatthebeginningofthesecondyearofserviceandaspartofthereappointmentprocess. InstructorsandAssistantProfessorsinparticularmayfindtheresultsofsuchevaluationusefulwhenconsultingwithexperiencedcolleaguesforadviceaboutteachingtechniquesandskills.StandardcourseevaluationtemplatesfortheConservatoryofMusicmaydifferfromthoseusedforotherdepartmentsintheUniversity,andallstandardtemplatesmaybesupplementedbyquestionsdesignedforthespecificcourse,atthediscretionofthefacultymember,orforthedepartmentinvolved,atthediscretionofthedepartment. Theseformscanprovideusefulinformationaboutthequalityofteachingandtheorganizationofcourses.Beyondstudentevaluation,itisalsoimperativethatdepartmentalfacultyworktogethertoprovideoneanother(andespeciallyuntenuredfaculty)feedbackontheirteachinginorder

topromoteexcellenceandpersonalgrowthasinstructors. ReappointmentAllnewfacultymemberswillmeetwiththeProvostandDeanoftheFacultyatthebeginningoftheirsecondyearofservice. Thereviewmayoccurlaterifacandidatehastakenmedicalorfamilyleave,inaccordancewithUniversitypolicyandupontherequestofthecandidate.Thereviewmayalsobepostponedifsomepersonalorprofessionalcircumstancewouldplacethecandidateatanunfairdisadvantageinthetenurereviewprocess. PromotionAssistantProfessorNormally,personswiththehighestadvanceddegreeintheirfieldwillbeappointedinitiallyasAssistantProfessors.PersonshiredwithoutsuchadegreewillbeappointedattherankofInstructor;promotiontoAssistantProfessoroccursautomaticallywhenafacultymembercompletesthedegree.NewfacultymembersintheConservatoryarenormallyappointedasInstructorsorAssistantProfessors,dependingonexperienceandqualifications. ForthoseappointedasInstructors,promotiontoAssistantProfessoroccursautomaticallyafterasuccessfulreviewforreappointment.AssociateProfessorThecriteriaforpromotiontotherankofAssociateProfessorareidenticaltothosewhichgoverntenuredecisions. Terminationforreasonsofinabilitytoperformnormaldutieswillusuallyinvolveclearanddocumentedmedicalreasonsthatthefacultymembercannotcontinuetofulfillthetermsandconditionsofappointment.Intheeventthatprolongedorfrequentabsencesduetoillnesspreventafacultymemberwhoisonafixed-termcontractfromeffectivelyperforminghisorherresponsibilities,theUniversitymayterminatethatfacultymember’scontract. kindsofgroundsthatconstituteadequatecausefordismissal.Whenpersuadedthattherearegroundstodismissafacultymemberforadequatecause,thePresidentwilldiscussthematterwiththeindividualandseekamutuallyagreeablesettlement.Ifnosettlementisreached,thePresidentwillconveytothefacultymemberawrittenstatementpreparedinconsultationwiththeProvostandDeanoftheFaculty,andpossiblyothers,detailingthegroundsfortheproposeddismissalandthePresident’sintentiontobringthatmattertotheBoardofTrustees.ThefacultymembermayappealforaformalhearingbeforeanadhoccommitteeconsistingofthreemembersofthefacultywhohaveservedontheTenure,Promotion,Reappointment,andEqualEmploymentOpportunityCommittee,butnotincludinganymemberofthesamedepartmentasthepersonmakingtheappealoranymemberofthefacultywhohasbeenanofficialpartytoapreviousgrievanceorappealsprocedureorhearinginwhichtheappellantwasaprincipal.Onceinreceiptofawrittenappealforahearingfromthefacultymember,thePresidentshalldirecttheSecretaryoftheFacultytoselectahearingcommitteebylotfromamongeligiblemembersofthefaculty.Inthehearing,theindividualwillbeapprisedoftheevidenceagainsthimorherandwillhavetheopportunitytopresenthisorherowncase,toofferevidenceonhisorherownbehalf,andtoberepresentedbycounsel.UniversityCounselwillbepresentatthehearingtoadvisethecommittee.Iftheappellantisrepresentedbycounsel,UniversityCounselwillactivelyrepresenttheUniversityinthehearing.ThehearingcommitteemayinterviewthePresidentorthePresident’sdesigneeastothereasonsforthedismissal.Alltestimonywillberecorded.Afteraformalhearing,thecommitteewillreachajudgmentonthemeritsoftheappealonthebasisoftheevidence. ItwillcommunicateitsjudgmenttothePresidentandthefacultymember.ThePresident,inturn,willsubmitthefullreportofthecommitteetotheBoardofTrusteesforfinalaction.IftheBoarddoesnotsustainthecommittee'sjudgment,itwillprovidereasonstothecommittee,andthecommitteewillreconsideritsjudgment. OnlyaftersuchareconsiderationissubmittedtoitwilltheBoardrenderitsfinaldecision.Inthecaseofdismissalforadequatecause,theUniversitywillassumenoobligationfortheindividual’ssalaryandbenefitsbeyondtheendofthemonthinwhichthedismissalnoticeisgiven.IfthePresidentdeemsitnecessary,heorshemaysuspendtheindividualwithpaypendingtheoutcomeofthecase.

3. Terminationforreasonsofdiscontinuanceofaprogramordepartmentwillfollowtheappropriatereviewanddiscussionofthelong-rangeeducationalimplicationsofthediscontinuancefortheinstitution.SuchdecisionswillberenderedbythePresident,withtheapprovaloftheBoardofTrustees,afterconsultationwithindividualfacultymembersandtheFacultyGovernanceCommittee.TheUniversitywillmakeeveryefforttoplaceanindividualwhosepositionisthusterminatedinanothersuitablepositionintheinstitutionor,ifsuchplacementisnotpossibleand

theindividualistenuredorhasamulti-yearcontract,theUniversitywillprovideseverancepayofoneyear’ssalary.

4. FinancialexigencyoftheUniversityconstitutesgroundsforterminationofany

positionatanytime.ShouldthePresidentdetermine,withtheconsentoftheBoardofTrustees,thattheconditionsfordeclaringfinancialexigencyobtain,heorshewillreviewboththeconditionsandthedecisionwiththeFacultyGovernanceCommittee. ThePresidentmayseekadvicefromtheGovernanceCommitteeindevelopingcriteriafordeterminingwhereterminationsshouldbemade.Personsontenureormulti-yearappointmentsthusterminatedwillbegivenseverancepayofoneyear’ssalary.Nopersonthusterminatedwillbereplacedwithinthreeyearsunlessthatpersonisfirstofferedreinstatement.

SabbaticalsandLeavesofAbsenceSabbaticalsExpectationsandApplicationsTheLawrenceUniversityplanforsabbaticalleavesisdesignedtoencourageandsupportthescholarly,artistic,andpedagogicaldevelopmentoffacultymembersbyprovidingthemunencumberedtimeforscholarlystudy,research,writing,andartisticendeavor.Whilesabbaticalleavesarenormallyaccordedmembersofthefacultywhoapply,theyarenotautomatic.Toapplyforsabbaticalleave,facultymemberscompleteanapplicationform,explainingtheactivitiestheyintendtopursueduringthesabbaticalandprovidingsufficientinformationtoevaluatetheproposal. TheformisavailableinallacademicbuildingsandfromtheofficeoftheProvostandDeanoftheFaculty.Normally,completedapplicationsaredueintheOfficeoftheProvostandDeanoftheFacultybyDecember15intheacademicyearprecedingtheyearinwhichtheleaveistobetaken.Beforeapprovingapplications,theProvostandDeanoftheFacultyconsultsdepartmentchairs(ortheDeanoftheConservatoryforConservatoryfacultymembers)aboutthelikelyimpactofthetemporaryabsenceoftheapplicantsuponthecurriculum.Thesuccessofthesabbaticalprogramdependsontheflexibilityofbothattitudesandarrangementswithindepartmentsandamongindividuals. TheplanpresumesthattheUniversitywillnotnormallyreplacefacultymembersonsabbatical,andthatfacultymembersonsabbaticalforlessthanafullacademicyearwillbereplacedonlyinthemostextraordinarycircumstances.Departmentsshouldthereforemakemulti-yearplansforcurriculatoavoidbunchingofsabbaticals,andtheyshouldexaminecarefullytheneedfortheperennialofferingofsomecourses. exceptiontothispolicyrequestedaspartoftheapplicationforsabbaticalleave.EligibilityTenuredmembersofthefacultyearneligibilityforsabbaticalleavesofthreetermsaftersixyears(eighteenterms)offull-timeteaching.Facultymemberswhoreceivetenureintheirsixthyeartaketheirfirstsabbaticalleaveastenuredfacultymembersduringtheeighthyearofservice,thoughtheProvostandDeanoftheFacultymaygrantexceptionstothispolicyshouldinstitutionalconsiderationswarrantthem.Facultymemberswhoreceivetenurebeforetheirsixthyearofservicenormallybecomeeligiblefortheirfirstsabbaticalastenuredfacultymembersintheirseventhyear.Thethreetermsofsabbaticalleavemustbetakensometimeduringthesevenacademicyearsfollowingtheacquisitionofeligibility:facultymembersmaynotaccumulatesabbaticaleligibilitybeyondthisperiod.Ineffect,onceeligibilityisfirstestablished,afacultymemberwillbeexpectedtoteachatleasteighteentermsofeachblockoftwenty-onetermsuntilretirementorresignation;thatis,theteachingofasucceedingeighteentermscreateseligibilityforanothersabbaticalofthreeterms’duration,whichmaybetakenduringthesevenyearsfollowing,andsoon.Tenuredfacultymembersneednottakeasabbaticalimmediatelyuponbecomingeligibleinordertobeginacquiringeligibilityfortheirnext,thoughtheymust,atsometimeduringtheseven-yearperiodaftertheyhaveacquiredeligibility,takethethreetermsorforfeitthosenottaken,unlessthepostponementservestheconvenienceoftheUniversity.AssistantProfessorswhohavenotyetbeenreviewedforpromotiontoassociateprofessorwithtenureareeligibleforonetermofsabbaticalleaveiftheyhavebeensuccessfullyreviewedforreappointmenttoasecondcontract.Thisleavemaybetakenduringthefourthorfifthyearofserviceinatenure-lineposition.ApplicationsforthesabbaticalmaybesubmittedtotheProvostwhilethereappointmentreviewisinprocess,buteligibilityiscontingentuponapositivereappointmentdecision.Sabbaticalleavesforassistantprofessorswillnotdelaythetenurereview,norwilltheyaffecteligibilityforsabbaticalleaveastenuredfacultymembers.Applicationsforpre-tenuresabbaticalsmustbesubmittednolaterthantheendofthefirstweekoftheWinterTermoftheacademicyearprecedingthatinwhichtheleaveistobetaken.LevelofSupportFacultymembersreceive70percentoftheiracademicsalaryduringthetermortermsinwhichasabbaticalistaken. Thus,someonetakingafull-yearsabbaticalwillreceive70percentofannualacademicsalaryforthatyear(70%+70%+70%/3=70%);afacultymembertakingtwotermswillreceive80percentofsalary(70%+70%+100%/3=80%);afacultymembertakingonetermofsabbaticalinanacademicyearwillreceive90percentofannualsalaryfortheyear(70%+100%/3+100%/3=90%).SalaryadjustmentsforfacultymembersonsabbaticalbecomeeffectiveSeptember1.ThereducedlevelofcompensationwillfirstbereflectedinthefirstpaycheckafterSeptember1andwillremainineffectthroughtheSeptember1paycheckofthefollowingyear.

Facultymembersplanningsabbaticalsshouldseeksupplementarysupportfromexternalfoundationsandagencies. TheProvostandDeanoftheFacultywillassistfacultyinidentifyingappropriatefoundationandfellowshipsources. TheUniversityencouragesfacultytotrytoobtainreplacementsupportforLawrencefunds(thatis,toobtainoutsidedollarstosubstituteforLawrencedollars). TheUniversityrecognizes,however,thatsabbaticalleavesoftenentailaddedexpense.Accordingly,UniversitysalarysupportforasabbaticalleavemaybesupplementedbyexternalfellowshipsorgrantsuptothepointwherethecombinedUniversityandexternalsupportforsalaryequals120percentofafacultymember’sannualsalary.Externalfundingthatexceedstheamountneededtobringthefacultymember’ssalarytothatlevelwillbeusedtoreplaceLawrencesalarysupport.FacultymembersshouldconsultwiththeProvostandDeanoftheFacultyaboutsuchanarrangement.BenefitsforfacultymembersonsabbaticalleavearedescribedelsewhereinthisHandbook.TheUniversitywillmakenopaymentsforthefollowingbenefitsonthatportionofthefacultymember’stotalsabbaticalyearsalarythatexceedsthefacultymember’sannualfull-timesalary:theUniversity’sretirementprogram,lifeinsurance,anddisabilityinsurance.QuestionsaboutbenefitsshouldbedirectedtotheOfficeofHumanResources.IndividualizedLearningCreditsNote:TheIndividualizedLearningCredits(ILC’s)programwassuspendedinfallof2014.AlthoughnoadditionalILC’scanbeaccumulated,ILC’searnedbeforesuspensionoftheprogrammayberedeemed.Thedescriptionbelowincludescharacteristicsoftheprogrambeforeitssuspension.Credits:Eachfacultymembermayearncredits(individualizedlearningcreditsorILC’s)forexceedingtwotutorialsorequivalentactivitieseachyear,uptoalimitoffourcredits(6tutorialsortheequivalent).Conversion:EachILCwillresultintheequivalentof.83%ofthefacultymember’ssalarybeingaccruedinaspecialfacultydevelopmentfund.Withthecreditscheduleoutlinedabove,themaximumearningwillbe3.3%ofthefacultymember’ssalaryeachyear.Oversixyears,afacultymembercouldearntheequivalentofupto20%ofsalaryinthefund.TheconversionwillbesubjecttoaUniversitymaximum.Eligibility:ThefollowingactivitiescancounttowardsILC’s:tutorials,independentstudies,academicinternshipsupervision,orotherwithProvost’sapproval(maybeparticularlyapplicabletotheConservatory).Administration:Afacultymembermayusetheaccruedfundseithertosupplementsabbaticalsalaryorasafacultydevelopmentfundtobeusedforprofessionalpurposes.NotethatifafacultymemberearnsthemaximumnumberofILC’s,thefacultymembercouldtakeafull-yearsabbaticalat90%ofsalary,atwo-termsabbaticalatfullpay,oraone-termsabbaticalatfullpay.IfthecostoftheILC’sbeingredeemedinanyoneyearexceedstheamountssetaside(accrued)tothatpoint,somerestrictionswillbebasedonthetotal

amountthatcanberedeemed.Underthesecircumstances,prioritywillbegiventoenhancementsofscheduledsabbaticals.ILC’sthatcannotbefundedwillbedeferredandcanberedeemedinasubsequentyear.EarnedILC’swillberedeemableforuptosixyears.Implementation:Qualifiedindividualizedlearningactivitieswillbecountedstartingwiththe2008-2009academicyear.Creditscanbeused(redeemed)beginningwiththe2011-2012academicyears.[TheaccrualofadditionalILC’swassuspendedinfall2014,thoughaccruedILC’smaystillberedeemed.]LeavesofAbsenceWhenpossible,theUniversitygrantsleavesofabsencewithoutpay.RequestsforleavesofabsenceshouldbemadetotheProvostandDeanoftheFacultyafterconsultationwiththedepartmentchairandothermembersofone’sdepartment.TheUniversitypreferstoknowaboutsuchleavesasearlyaspossible,butinallcasesitseekstoaccommodatetheindividualfacultymember’swishesinsofarastheyareconsistentwiththeneedsoftheUniversity.Experienceinteachingorconductingpost-doctoralresearchinotherinstitutionsislookeduponasafavorablecontributiontoaLawrencefacultymember’scareer,andleavesforsuchpurposesarethusencouraged.Likewise,facultymembersinterestedinexperimentingwithalternativecareersmaypetitionforaleaveofabsence.Asageneralrule,leavesofabsencemaynotextendbeyondoneyearortotalmorethantwoyearsinanysix-yearperiod.StatementonDual-CareerCouplesTheUniversityrecognizesthatmanymembersofthefacultyhavespousalorpartnerrelationshipswithpersonswhohaveprofessionalcredentialsandareinterestedinemployment. Whileitisnotpossibletoguaranteeapositionforthespouseorpartnerofafacultymember,theopportunityforsuchapositioncanbeanimportantfactorintherecruitmentandretentionofhighqualityfaculty.Therefore,theUniversitystrivestoprovideinformationtofacultyspousesorpartnersaboutpotentialemploymentatLawrenceorintheFoxValleyarea.InterestedpersonsareencouragedtocontacteithertheOfficeoftheProvostortheDirectorofHumanResources.
