NOTIFICATION S.R.O. (I)/ 2005 - In exercise of the powers conferred by sections 105 and 124 of the Merchant Shipping Ordinance, 2001(LII of 2001), the Federal Government is pleased to make the following rules, namely: - CHAPTER I. PRELIMINARY 1.     Federal Government is pleased to make the following rules, namely: -

    CHAPTER I. – PRELIMINARY

    1. Short title, commencement and application. - (1) These rules may be

    called the Pakistan Merchant Shipping (Examination and Certification of Marine

    Engineer Officers and Safe Manning) Rules, 2005.

    (2) They shall come into force at once.

    (3) These rules shall not apply to fishing vessels, Government fishery’s

    research vessels and pleasure crafts.

    2. Definitions. – (1) In these rules, unless there is anything repugnant in

    the subjects or context, -

    (a) “Appendix” means an Appendix to these rules;

    (b) “Chief Examiner of Engineers” means the Chief Engineer and

    Ship Surveyor, Directorate General Ports and Shipping;

    (c) “Engineer” means the Marine Engineer Officer;

    (d) “Examiner” means an Examiner specified in sub-rule (2) of rule

    49;

    (e) “prescribed shipboard service” means the service that has been

    performed in accordance with the International Maritime

    Organization Training Record Book; and

    (f) “valid certificate” means the certificate of competency specified

    in clause (a) or (b) of sub-rule (2) of rule 4.

    (2) The words and expressions used but not defined herein these rules shall

    have the meaning assigned to them in the Pakistan Merchant Shipping Ordinance,

    2001 (LII of 2001).

    3. Requirement to carry Engineer Officer. –(1) Any ship going to sea

    having registered power of seven hundred and fifty kilowatts or more, or any

    training ships of one hundred gross tonnage or more with a propulsion engine

    going to sea, shall carry Engineer Officer holding valid certificate of competency

    of the appropriate grade, of the following descriptions, namely: -

    (a) Ships registered in Pakistan; and

    (b) ships registered outside Pakistan which carry passengers, -

    (i) between ports in Pakistan or between Pakistan and Gulf

    ports; or

    (ii) on a voyage which begins and ends at the same ports in Pakistan and on which the ships call at no port outside

    Pakistan.

    (2) Subject to sub-rule (1), the number of duly certificated Engineer

    Officers to be carried in various descriptions of ships according to trading area, the

    grade of certificate of competency Engineer Officers should hold and the minimum

    safe manning of ship shall be as specified in Appendix A.

    4.Valid certificate. - (1) An Engineer Officer shall not be duly

    certificated unless he is holder of a valid certificate granted under the Pakistan

    Merchant Shipping Ordinance, 2001(LII of 2001), of a grade appropriate to his

    station in the ship or of a higher grade.

    (2) A valid certificate of competency means any of the following

    certificates of the appropriate grade or a higher grade for the capacity in which the

    holder is to be carried in a ship, namely: -

    (a) Certificates of competency with endorsement granted under

    these rules; or

    (b) certificate of competency granted by any other Maritime

    Administration of a country duly recognized by the Federal

    Government.

    5. Grades of certificates of competency. - There shall be the following

    grades of certificate of competency, which may be granted under these rules,

    namely: -

    (a) First class engineer or certificate of competency (Chief

    Engineer Officer) class I;

    (b) Second class engineer or certificate of competency

    (Second Engineer Officer) class II;

    (c) Certificate of competency (Marine Engineer Officer) class III;

    and

    (d) Certificate of competency (Marine Engineer Officer) class IV.

    6. Service endorsement. –(1) Second class engineer or certificate of

    competency (Second Engineer Officer) class II, class III and class IV Engineers

    may carry a service endorsement.

    (2) A service endorsement shall entitle the holder to serve as Chief

    Engineer Officer and Second Engineer Officer on a ship powered by main

    propulsion machinery of between seven hundred and fifty and three thousand

    kilowatts propulsion power, and shall be examined as per regulation III/3, of the

    International Convention on Standards of Training, Certification and Watch-

    keeping for Seafarers, 1978, as amended in 1995, whilst holding appropriate

    certificate for that capacity in the description of a ship to which it relates.

    7. Certificate of competency granted by other Maritime

    Administrations. – (1) Acceptance of certificates of competency granted by

    other Maritime Administrations as equivalent to those granted by the Federal

    Government, shall be subject to the condition that, the training education and

    certification system of administration of the country is compatible to the standards

    maintained in Pakistan in conformity with the International Convention on

    Standards of Training, Certification and Watch-keeping for Seafarers, 1978, as

    amended in 1995, and as per the provisions of section 100 of the Pakistan

    Merchant Shipping Ordinance, 2001(LII of 2001), shall be granted an equivalent

    certificate as set out in Appendix B.

    (2) Candidates applying for equivalent certificate must have the

    knowledge of the maritime laws as in force in Pakistan, and the maritime laws

    embodied in international agreements and conventions, and the implementation of

    such laws.

    CHAPTER II. – CONDITIONS FOR GRANT OF CERTIFICATE OF

    COMPETENCY AND ENDORSEMENT

    8. Certificate of competency. –(1) Certificates of competency shall be

    granted in the following three categories, except class III which shall be granted in

    motor only, namely: -

    (i) Motor certificate of competency;

    (ii) Steam certificate of competency; and

    (iii) Combine steam and motor certificate of competency.

    (2) Motor certificate of competency shall qualify the holder to serve as an

    Engineer Officer in motor ships, being ships propelled by internal combustion

    reciprocating engines and ships propelled by gas turbines.

    (3) Steam certificate of competency shall qualify the holder to serve as an

    Engineer Officer in steam ships, being ships propelled by steam turbines or by

    steam reciprocating engines.

    (4) Combined certificate of competency shall qualify the holder to serve

    as an Engineer Officer in both steam and motor ships, including ships propelled by

    gas turbines.

    9. Endorsement of certificate of competency. - A holder of a certificate

    of competency as specified in rule 5, either steam or motor shall, after serving the

    necessary period of qualifying sea service in any other type of ship as specified in

    Chapter IV, and passing the endorsement examination in the same grade as for the

    certificate of competency which he holds, shall be granted a combined steam and

    motor certificate of competency, entitling him to serve in either type of ship.

    10. Conditions for grant of certificate of competency. - (1) In order to

    qualify for the grant of a certificate of competency as specified in rule 5, a

    candidate must, -

    (a) carry out the initial training requirements as set out in Chapter

    III;

    (b) have completed the qualifying sea service as set out in Chapter IV;

    (c) hold an approved and valid medical fitness certificate for sea

    service, including eyesight and hearing, as per standard laid

    down in Appendix C;

    (d) have completed a course of instructions to cover the syllabus as

    specified in Appendix F for relevant grade, at an institution

    approve by the Federal Government;

    (e) for the grant of a first class engineer or certificate of

    competency class I, have served as Engineer Officer whilst

    holding a second class engineer certificate of competency class

    II; and

    (f) pass an examination as specified in Chapter VIII.

    (2) In order to qualify for the grant of certificate of competency of any

    grade under these rules, a candidate must have attended the following mandatory

    courses, namely: -

    (a) Advance training in fire fighting;

    (b) medical first aid at sea;

    (c) personal survival technique;

    (d) proficiency in survival craft and rescue boat;

    (e) personal safety and social responsibilities;

    (f) tanker familiarization;

    (g) engine plant simulator; and

    (h) any other course specified from time to time.

    (3) In order to qualify for the grant of service endorsement to a second

    class engineer or certificate of competency class II, class III or class IV under these

    rules, a candidate must, -

    (a) hold an approved valid medical fitness certificate, including eye sight and hearing, as per standard laid down in Appendix

    C;

    (b) hold the appropriate grade of certificate of competency to be

    endorsed;

    (c) has completed the qualifying sea service as set out in Chapter

    IV; and

    (d) pass an examination as set out in Chapter VIII.

    CHAPTER III. - INITIAL TRAINING

    11. Workshop service. – Workshop service or other industrial training

    completed before the age of sixteen years shall not be accepted for grant of a

    certificate of competency.

    12. Training. - Each candidate must have received training in accordance

    with any one of the following schemes, namely: -

    (i) Scheme No.1. - Pakistan Marine Academy Engineering Cadets.

    The candidate should, -

    (a) not be more than twenty-one years of age;

    (b) be minimum Intermediate Science (Pre–Engineering or

    equivalent) ;

    (c) be medically fit including eye sight and hearing as per

    standards laid down in Appendix C. The candidates shall

    also have to undergo Eye Sight and Color Vision Test

    conducted by the Mercantile Marine Department;

    (d) carry out two years marine engineering, theoretical and

    practical training at the Pakistan Marine Academy

    approved by the Ministry of Ports and Shipping

    (Directorate General Port and Shipping), Karachi. The

    duration of course shall be as specified below: -

    (i) Basic introduction: 01 month.

    (ii) Academic degree subjects: 03 months.

    (iii) Academic marine engineering

    subjects: 09 months.

    (iv) Professional marine engineering

    subjects: 04 months.

    (v) Workshop theory: 02 months.

    (vi) Workshop practice: 04 months.

    (vii) Engine plant simulator and

    safety coarse: 01 month.

    Total period: 24 months; and

    (e) carry out one year industrial training at a marine

    engineering workshop approved by the Ministry of Ports

    and Shipping (Directorate General Ports and Shipping),

    Karachi. The duration of industrial training should be as

    specified below: -

    (i) Machine shop: 02 months.

    (ii) Welding shop: 01 month.

    (iii) Electric shop: 01 month.

    (iv) Ship repair steam and motor: 06 months.

    (v) Boiler making and repair shop: 02 months.

    Total period: 12 months.

    (ii) Scheme No.2 – Marine Engineering Apprentices. The

    candidate should, -

    (a) be not more than twenty-one years of age;

    (b) be minimum Intermediate Science (Pre-Engineering or

    equivalent);

    (c) be medically fit including eye sight and hearing as per

    standard laid down in Appendix C. The candidates shall

    also have to undergo Eye-Sight and Color Vision Test

    conducted by the Mercantile Marine Department; and

    (d) carry out three years industrial training as an engineering

    apprentice in a marine engineering workshop approved

    by the Ministry of Ports and Shipping (Directorate

    General Ports and Shipping), Karachi. The duration of

    industrial training should be as specified below: -

    (i) Bench fitting: 03 months.

    (ii) Machine shop: 06 months.

    (iii) Welding and foundry shop: 03 months.

    (iv) Electrical shop: 03 months.

    (v) Ship repair steam and diesel: 10 months.

    (vi) Academic and professional,

    marine engineering theory: 10 months.

    (vi) Boiler making and repair: 02 months.

    (vii) Engine plant simulator

    and safety course: 01 month.

    Total period: 36 months.

    (iii) Scheme No.3 - Engineering Graduates. The candidate should, -

    (a) be not more than twenty-eight years of age;

    (b) be minimum Bachelor of Engineering Degree in

    Mechanical or Electrical or Electronic or equivalent from

    any university in Pakistan or abroad;

    (c) be medically fit including eye sight and hearing, as per

    standard laid down in Appendix C. The candidates shall

    also have to undergo Eyesight and Color Vision Test

    conducted by the Mercantile Marine Department; and

    (d) carry out one year industrial training as an engineer

    apprentice in an engineering workshop approved by the

    Ministry of Ports and Shipping (Directorate General

    Ports and Shipping),Karachi. The duration of industrial

    training shall be as specified below: -

    (i) Machine shop: 02 months.

    (ii) Welding shop: 01 month.

    (iii) Electrical shop: 01 month.

    (iv) Ship repair, steam and diesel: 06 months.

    (v) Boiler making and repair: 01 month.

    (vi) Engine plant simulator and

    safety course: 01 month.

    Total period: 12 months.

    13. Testimonial. –(1) All candidates shall be required to produce

    testimonials as to their workshop service in the form as set out in Appendix D.

    (2) The workshop service testimonials must be signed by the employer or

    his authorized representative and must testify to the candidate’s conduct and ability

    and state the kind of work, on which he was engaged and the period of time spent

    in each branch, for example, fitting, erecting, machine work, etc.

    (3) The workshop service testimonials shall be returned to the candidate

    upon completion of the examination.

    14. Deficiency in training. - Minor deficiencies from the requirements of

    rule 12, shall be assessed in each case by the Chief Examiner of Engineers and

    must be made good by “off the Job” training or by further workshop service in

    which the candidate found deficient or by compensatory shipboard service as an

    Engineer Officer or Trainee Engineer, as the case may be.

    15. Compensatory shipboard service. - Shipboard service must be

    performed in motor or steam ships of not less than seven hundred and fifty

    kilowatts registered power. Shipboard service may be performed on regular watch

    or on day work irrespective of whether a crew agreement is or is not in force.

    Compensatory shipboard service performed before the age of nineteen years shall

    not be accepted.

    16. Permission for industrial training. - Each candidate shall be required

    to obtain approval from the Chief Examiner of Engineers for commencement of

    industrial training in Pakistan or outside Pakistan. Any training undertaken without

    the prior approval of the Chief Examiner of Engineers in Pakistan or outside

    Pakistan shall not be accepted.

    CHAPTER IV. – QUALIFYING SEA SERVICE

    17. Certificate of competency class IV. - In order to qualify for the grant of

    certificate of competency class IV, each candidate must, in addition to meeting one

    of the initial training requirements as set out in Chapter III, have completed a

    period of qualifying sea service in ships of not less than seven hundred and fifty

    kilowatts registered power. The following shall be the grades of certificate of

    competency class IV, namely: -

    (a) Motor certificate. - Six months prescribed shipboard service or

    nine months, of which at least four months must have been

    spent in watch keeping on the main propelling machinery of

    motor ships;

    (b) Steam certificate. - Six months prescribed shipboard service or

    nine months of which at least four months must have been spent

    in watch keeping on the boilers and main propelling machinery

    of steam ships;

    (c) Combined certificate. - Eight months prescribed shipboard

    service or twelve months of which at least four months must

    have been spent in watch keeping on the main propelling

    machinery of motor ships and at least four months must have

    been spent in watch keeping on the boilers and main propelling

    machinery of steam ships; and

    (d) Service endorsement. - Six months, whilst in possession of a

    certificate of competency class IV. This service must be

    performed in motor ships for a service endorsement to a motor

    certificate and in steam ships for a service endorsement to a

    steam certificate.

    18. Certificate of competency class III. – In order to qualify for the grant

    of certificate of competency class III, each candidate must, in addition to meeting

    one of the initial training requirements as set out in Chapter III, have completed a

    period of qualifying sea service in ships of not less than seven hundred and fifty

    kilowatts registered power. The following shall be the grades of certificate of

    competency class III, namely: -

    (a) Motor certificate. - Nine months prescribed shipboard service

    or twelve months, of which at least eight months must have

    been spent in watch keeping on the main propelling machinery

    of motor ships; and

    (b) Service endorsement. -Twelve months, whilst in possession of

    a certificate of competency class III. This service must be

    performed in motor ships for a service endorsement to a motor

    certificate.

    19. Certificate of competency class II. – In order to qualify for the grant

    of certificate of competency class II, each candidate must, in addition to meeting

    the initial training requirement as set out in Chapter III, have completed a period of

    qualifying sea service in ships of not less than seven hundred and fifty kilowatts

    registered power. The following shall be the grades of certificate of competency

    class II, namely: -

    (a) Motor certificate. – Sea service requirements shall be as

    follows: -

    (i) Eighteen months including six months prescribed

    shipboard service of which at least nine months must

    have been spent in watch keeping on main propelling

    machinery of motor ship. The remaining period may have

    been spent in watch keeping on the main propelling or

    auxiliary of motor ships, or steam ships, or on day work;

    or

    (ii) twenty-one months of which nine months must have been

    spent in watch keeping on main propelling machinery of

    a motor ship. The remaining period may have been spent

    in watch keeping on the main propelling or auxiliary of

    motor ships, or steam ships, or on day work; or

    (iii) twelve months whilst holding certificate of competency

    class IV, of which at least nine months must have been

    spent in watch keeping on main propelling machinery of

    motor ships. The remaining period may have been spent

    in watch keeping on the main propelling or auxiliary of

    motor ships, or steam ships, or on day work;

    (b) Steam certificate. – Sea service requirements shall be as

    follows: -

    (i) Eighteen months including six months prescribed

    shipboard service of which at least nine months must

    have been spent in watch keeping on the boiler and main

    propelling machinery of steam ship. The remaining

    period may have been spent in watch keeping on the

    main propelling machinery or auxiliary machinery of

    steam ships, or motor ships, or on day work; or

    (ii) twenty-one months of which minimum nine months must

    have been spent in watch keeping on boilers and main

    propelling machinery of steam ships. The remaining

    period may have been spent in watch keeping on the

    main propelling or auxiliary of steam ships, or motor

    ships, or on day work; or

    (iii) twelve months whilst holding certificate of competency

    class IV, of which at least nine months must have been

    spent in watch keeping on the boilers and main

    propelling machinery of steam ships. The remaining

    period may have been spent in watch keeping on the

    main propelling machinery or auxiliary machinery of

    steam ships, or motor ships, or on day work;

    (c) Combined certificate. - Twenty-one months, of which at least

    nine months must have been spent in watch keeping on the

    main propelling machinery of motor ships and at least nine

    months must have been spent in watch keeping on the boiler

    and main propelling machinery of steam ships. The remaining

    period may have been spent in watch keeping on the main

    propelling machinery or auxiliary machinery of motor ship, or

    steam ship, or on day work; and

    (d) Service endorsement. - Twelve months, whilst in possession

    of second class engineer certificate or certificate of competency

    class II, provided that this period together with the period of

    qualifying sea service actually performed before obtaining a

    second class engineer certificate or certificate of competency

    class II, exclusive of remission, amounts to not less than thirty-

    six months. This additional service of not less than twelve

    months must be performed on motor ships for a service

    endorsement to a motor certificate and in steam ships for

    service endorsement to a steam certificate.

    20. Certificate of competency class I. –(1) In order to qualify for the grant

    of a certificate of competency class I, each candidate must hold a second class

    engineer or certificate of competency class II or equivalent, whilst holding it, must

    have completed a period of qualifying sea service in ships of not less than three

    thousand kilowatts registered power. The following shall be the grades of

    certificate of competency class I, namely: -

    (a) Motor certificate. - Eighteen months, of which at least nine

    months must have been spent in charge of a watch in motor

    ships of not less than three thousand kilowatts registered power

    whilst holding a second class engineer or certificate of

    competency class II, or as a Chief Engineer Officer in motor

    ships whilst holding second class engineer or certificate of

    competency class II motor with service endorsement. The

    remaining period may have been spent on watch keeping on the

    main propelling machinery or auxiliary machinery of motor

    ship, or steam ship, or on day work;

    (b) Steam certificate. – Eighteen months, of which at least nine

    months must have been spent in charge of a watch in steam

    ships of not less than three thousand kilowatts registered power

    whilst holding a second class engineer or certificate of

    competency class II, or as a Chief Engineer Officer in steam

    ships whilst holding a second class engineer or certificate of

    competency class II steam with service endorsement. The

    remaining period may have been spent in watch keeping on the

    main propelling machinery or auxiliary machinery of motor

    ship, or steam ship, or on day work; and

    (c) Combined certificate. – Twenty-one months, of which at least

    nine months must have been spent in watch keeping on the

    main propelling machinery of motor ships and at least nine

    months have been spent in watch keeping on the boiler and

    main propelling machinery of steam ships. The remaining

    period may have been spent in watch keeping on the main

    propelling machinery or auxiliary machinery of motor ship, or

    steam ship, or on day work.

    (2) Service on vessels of less than three thousand kilowatts registered

    power shall be considered at half rate.

    CHAPTER V. – SEA SERVICE (GENERAL PROVISIONS)

    21. Qualifying sea service. –(1) Except where particular limitations

    are placed upon it or where relaxation are specifically allowed, qualifying sea

    service shall mean service under crew agreement as an engineer officer on regular

    watch over main propelling machinery, or auxiliary machinery, or on day work.

    (2) General provisions as regards sea service shall be as follows, namely: -

    (a) Sporadic use of main propelling machinery. - Service

    performed in ships where for considerable period the main

    propelling machinery is not used, shall be reckoned as one and

    a half times the number of days actually spent under way, but in

    no case it shall exceed the time served under crew agreement.

    In such cases the testimonials produced in accordance with rule

    22 must carry a statement as to the number of days actually

    spent under way with the main propelling machinery in full use;

    (b) Certificate of competency class I service. - The minimum

    periods of watch keeping service specified in rule 20, for the

    purpose of grant of certificate of competency class I, should be

    performed as an Engineer Officer in charge of the watch. In

    case of each candidate who holds certificate of competency

    class I, either motor or steam, and who requires further service

    for the examination leading to the grant of a certificate of

    competency class I combined certificate, service performed in

    ships of more than three thousand kilowatts registered power,

    not in-charge of a watch, but on watch or otherwise

    substantially concerned with the main propelling machinery of

    the appropriate description, either steam or motor, shall be

    accepted at half rate;

    (c) Unattended machinery spaces. - Service performed in ships

    where the main propelling machinery operates regularly in the

    periodically unattended mode shall be accepted at full rate;

    (d) Auxiliary machinery. - Service in watch keeping on

    auxiliary machinery shall be accepted in full towards the

    qualifying period of sea service. Such service shall not be

    accepted as counting towards the minimum required to be spent

    in watch keeping on main propelling machinery;

    (e) Day work. - Engineering work carried out at sea, other than

    performed on regular watch, shall be accepted in full towards

    the qualifying period of sea service. Such service shall not be

    accepted as counting towards the minimum required to be

    spent in watch keeping on main propelling machinery;

    (f) Home trade ships. - Service in home trade ships shall be

    allowed to count at two-third rate, provided that the class of

    service and the horsepower of the ship render the service

    acceptable in all other respects, as specified in Chapter IV;

    (g) Service in tugs, dredgers, fishing vessels, or pilot vessels. -

    Service as engineer in sea going tugs, dredgers or fishing

    vessels, and in pilot vessels when on their station or when going

    to or returning from their station, shall be accepted towards the

    qualifying period of service at half rate, and the vessel shall

    have valid sea worthiness certificate of that period; and

    (h) Qualifying sea service for certificate of competency class IV.

    - Candidates for certificate of competency class IV may

    perform, under a qualified Marine Engineer Officer, all their

    qualifying sea service with or without crew agreement, on

    regular watch in sea-going tugs, dredgers, fishing vessels or

    pilot vessels, of not less than seven hundred and fifty kilowatts

    power.

    22. Sea service testimonials. –(1) Each candidate shall produce

    testimonials in respect of all sea service performed by him in the form as set out in

    Appendix E.

    (2) The sea service testimonials which should state the seniority on

    watch, the type of main propelling machinery and the nature of duties performed,

    shall be signed by the Chief Engineer Officer and endorsed by the Engineer

    Superintendent or some other responsible representative of the employer.

    (3) The sea service testimonials covering service as Chief Engineer

    Officer shall be signed by the Engineer Superintendent or a responsible person of

    the employer.

    23. Verification of sea service. - Entries in a seamen’s service book or

    certificate of discharge supported by testimonials shall be treated as evidence of

    sea service, where there are doubts about the sea service claimed, or it cannot be

    verified from the entries in seamen’s service book or certificate of discharge, it

    shall only be accepted upon written confirmation by a responsible person having

    personal knowledge of the facts to be established.

    24. Calculation of sea service. - Sea service as entered in seamen’s service

    book or certificate of discharge and testimonials shall be reckoned by the calendar

    months, that is the time included between any given day in any month and

    preceding day of the following month, both inclusive. The number of complete

    months from the commencement of the period, ascertained in this way, should be

    computed, after which the number of odd days should be counted. The day on

    which the crew agreement commences, as well as that on which it terminates,

    should both be included, and all odd days added together and reckoned at thirty

    days to the month, and all leave of absence shall be excluded.

    25. Confirmations or endorsement of testimonials. – (1) A candidate

    who has served on a foreign flag vessel as an engineer, and the length of sea

    service cannot be verified by the Shipping Master, the testimonial of the sea

    service must be confirmed, either, -

    (a) by the Consulate of the Country to which the ship is registered;

    or

    (b) by some other recognized official Authority of that country; or

    (c) by a responsible person having personal knowledge of the

    candidate’s sea service.

    (2) Where a Consulate cannot confirm the testimonial or other official

    Authority of the country referred to, Pakistan Consulate Office may endorse it.

    CHAPTER VI. - ELIGIBILITY REQUIREMENTS

    26. Certificate of competency (Marine Engineer Officer) class IV. - The

    syllabus for the certificate of competency class IV examination shall be as set out

    in Appendix F. A candidate for certificate of competency class IV shall, -

    (a) be not less than twenty years of age;

    (b) be medically fit including eye sight and hearing as

    specified in Appendix C;

    (c) have attended the mandatory courses as specified in sub-rule

    (2) of rule 10;

    (d) fulfills one of the requirements as specified in Chapter III or

    other approved education and training suitable for marine

    engineers or equivalent; and

    (e) have performed the requisite sea service as specified in rule 17,

    as an Assistant Engineer or Engineer Officer of an engineering

    watch of an engine room; or

    (f) have four years sea service as Diesel Mechanic on board ship

    including six months watch keeping service as an engine room

    assistant under the senior in full charge of an engineering watch

    of an engine room.

    27. Certificate of competency (Marine Engineer Officer) class III. - The

    syllabus for certificate of competency class III examination shall be as set out in

    Appendix G. A candidate for certificate of competency class III shall, -

    (a) be not less than twenty years of age;

    (b) be medically fit including eye sight and hearing as specified in

    Appendix C;

    (c) have attended the mandatory courses as specified in sub-rule

    (2) of rule 10;

    (d) fulfills one of the requirements as specified in Chapter III; and

    (e) have performed the requisite sea service as specified in rule 18,

    as an Assistant Engineer or Engineer Officer of an engineering

    watch of an engine room.

    28. Certificate of competency (Second Engineer Officer) class II. - The

    syllabus for certificate of competency class II examination shall be as set out in

    Appendix H. A candidate for certificate of competency class II shall, -

    (a) be not less than twenty-one years of age;

    (b) be medically fit including eye sight and hearing as specified in

    Appendix C;

    (c) have attended the mandatory courses as specified in sub-rule

    (2) of rule 10;

    (d) fulfills one of the requirements as specified in Chapter III; and

    (e) have performed the requisite sea service as specified in rule 19,

    as an Assistant Engineer or Engineer Officer of an engineering

    watch of an engine room.

    29. Certificate of competency (Chief Engineer Officer) class I. - The

    syllabus of certificate of competency class I examination shall be as set out in

    Appendix I. A candidate for certificate of competency class I shall, -

    (a) be not less than twenty-one years of age;

    (b) be medically fit including eye sight and hearing as specified

    in Appendix C;

    (c) have attended the mandatory courses as specified in sub-rule

    (2) of rule 10;

    (d) hold a Second Class Engineer Certificate or certificate of

    competency class II or equivalent; and

    (e) have performed the requisite sea service as specified in rule 20.

    30. Eligibility requirement for naval personnel. – (1) Naval personnel

    on active service or retired, who have attained the under mentioned ranks in the

    Engineering Branch of the Pakistan Navy and have the requisite requirement of

    watch keeping service at sea in engine room as full in charge of the engineering

    watch, having registered power of three thousand kilowatts or more, shall be

    eligible to appear for the certificate of competency examination as shown against

    the rank and qualifying sea service, namely: -

    (2) The commissioned engineer officer should furnish a statement of

    service together with testimonials in respect of all sea going appointments and the

    last active service.

    (3) Naval personnel must have attended the mandatory courses as

    specified in sub-rule (2) of rule 10.

    (4) Certificate of competency of any grade shall not be granted to naval

    personnel without examination.

    (5) Chief Engine Room Artificers, Engine Room Artficers, Chief

    Mechanicians and Mechanicians who have served or serving in the Engineering

    Branch of the Pakistan Navy, may be examined for the grant of certificate of

    competency class IV, provided the candidates have, -

    (a) an engineering apprenticeship equivalent to Diploma of

    Associate Engineers with four years sea going service as

    Chief Engine Room Artificers on the Pakistan Navy ships;

    (b) performed an engineering watch of an engine room of ship

    powered by propulsion machinery of three thousands kilowatts

    or more;

    (c) be medically fit including eye sight and hearing as specified in

    Appendix C; and

    (d) must have attended the mandatory courses as specified in sub-

    rule (2) of rule 10.

    CHAPTER VII. – EXAMINATIONS (GENERAL PROVISIONS)

    31.Application for examination. -(1) An application in the form as

    set out in Appendix J duly filled along with the prescribed fee as specified in

    Appendix K, for all grades of certificate of competency examination or

    endorsement should be sent to the Chief Examiner of Engineers through the

    Principal Officer, Mercantile Marine Department, Karachi.

    (2) The candidates for examination should apply at least two weeks

    before the date of first examination to be taken. The Ministry of Ports and

    Shipping, Technical Wing shall only accept an application if the candidate has

    satisfactorily completed the initial training and the qualifying sea service

    requirements as specified in Chapters III and IV, for the grade of certificate of

    competency applied for.

    (3) The Chief Examiner of Engineers shall issue to a candidate a notice

    of eligibility once his application is approved. This notice shall specify which

    written examination subjects have been exempted or previously passed, it shall

    also allow the candidate to appear in the Engineering Knowledge written and oral

    parts of the examination as may be appropriate.

    (4) Proof of age shall be either in the form of birth certificate or

    documentary evidence.

    32. Examination of foreigners. - A foreigner candidate may be examined

    for all grades of certificates of competency subject to such conditions as shall be

    applicable to other candidates under these rules.

    33. Knowledge of English language. - All candidates must prove to the

    satisfaction of the Examiner that they can speak and write in English language

    sufficiently well to perform the duties required of them onboard a ship.

    34. Examination fee. –(1) A candidate shall be required to pay the

    appropriate fee as specified in Appendix K, on each occasion on which he presents

    himself for an examination either for a certificate of competency or for the

    endorsement of a certificate of competency.

    (2) No part of the fee paid by a candidate shall be refundable or

    creditable in any case.

    35. Enquiry fee. - A person enquiring as to his eligibility for examination

    shall be required to pay the appropriate fee as specified in Appendix K before any

    step is taken to enquire into his sea service or to his qualifications, etc.

    36. Arrangements for examination. -(1) All written examination papers

    for the certificate of competency (Chief Engineer Officer) class I, (Second

    Engineer Officer) class II, (Marine Engineer Officer) class III and (Marine

    Engineer Officer) class IV shall be set and marked entirely by the Examiners

    specified in sub-rule (2) of rule 49.

    (2) The Engineering Knowledge (Chief Engineer Officer) class I,

    (Second Engineer Officer) class II, (Marine Engineer Officer) class III and (Marine

    Engineer Officer) class IV examinations shall be separated into written and oral

    parts to allow the oral examination to be taken independently of the written papers.

    (3) A candidates shall be able to take the oral examination, for a

    particular grade of certificate of competency once his application has been

    accepted, a pass in one or more the Engineering Knowledge papers shall not be a

    pre-requisite for admission to the oral examination.

    (4) The candidates must pass the written part of the Engineering

    Knowledge examination and the oral part of the Engineering Knowledge

    examination, for a particular grade of certificate of competency, within a three

    years period to retain validity of a pass in either part.

    (5) The Engineering Knowledge General paper together with the

    Engineering Knowledge Motor or Engineering Knowledge Steam paper must be

    passed at the same attempt.

    37. Issue of certificate of competency. –(1) When a candidate has

    successfully completed all parts of examination and met all other mandatory

    conditions governing the award, he shall receive Authority Slip Exn. 16 E (Pak) in

    the form as set out in Appendix L, authorizing the Principal Officer, Mercantile

    Marine Department, Karachi, or the Engineer and Ship Surveyor attached to the

    Directorate General Ports and Shipping, to issue a hard cover certificate.

    (2) A certificate of competency awarded by the Federal Government or a

    certificate of competency awarded by another country but declared to have the

    same force as that awarded in Pakistan, or a certificate of service, being a

    certificate of lower grade held by a candidate, must be surrendered before the

    superior certificate is awarded.

    (3) The candidates shall receive a record of their examination results on

    the prescribed form Exn. 17E (Pak) in the form as set out in Appendix M. This

    form must be produced to the Examiner when a candidate presents himself for the

    next examination of certificate of competency.

    38. Form of certificate of competency. - A certificate of competency and

    endorsement shall be issued in any of the appropriate form as set out in Appendix

    N1 to Appendix N10.

    39. Sea service found to be insufficient. - If it is discovered after a

    candidate has passed the examination that the candidate is deficient in qualifying

    period of sea service required for that grade of certificate of competency, the

    certificate shall not be granted until the candidate completes qualifying period of

    sea service in which the candidate was deficient, and the candidate shall be re-

    examined.

    40. Re-examination. - A candidate may present himself for re -

    examination at any time as per examination schedule on payment of the prescribed

    fee as specified in Appendix K.

    41. Copy of lost certificate of competency. –(1) An applicant for the lost

    certified copy of certificate of competency shall fill in an application in form Exn

    23 (Pak) as set out in Appendix O, giving the necessary particulars, and delivering

    it to the Principal Officer, Mercantile Marine Department, Karachi, along with the

    prescribed fee as specified in Appendix K.

    (2) Declaration as to the circumstances in which the certificate of

    competency was lost must be made by an applicant in front of the Principal

    Officer, Mercantile Marine Department, Karachi.

    42. Failure in Engineering Knowledge. – A candidate who shows

    ignorance of topics vital to an Engineer Officer’s duties and which, if neglected,

    could lead to conditions whereby the life or the ship is endangered or both, shall

    not be accepted for re-examination until he has performed a further twelve months

    of sea service or such lesser time as the Chief Examiner of Engineers may decide.

    43. Physical and mental disability. –(1) A candidate shall not be

    allowed to continue his examination, if in the course of the examination the

    Examiner finds that the candidate is afflicted with deafness, with an impediment in

    speech or with some other physical or mental infirmity, and upon further

    investigation is satisfied that the degree of infirmity is such as to render the

    candidate incapable of discharging adequately the ordinary seagoing duties of the

    holder of certificate of competency.

    (2) Every such case shall be reported and the candidate’s certificate of

    competency, if any, shall be forwarded with the report to the Chief Examiner of

    Engineers.

    (3) If the candidate subsequently produces a medical certificate to the specific effect

    that his hearing, speech, or physical or mental condition has improved or is normal, the Chief

    Examiner of Engineers shall consider the candidate for re-examination.

    CHAPTER VIII. – EXEMPTIONS, EXAMINATIONS AND EXAMINERS

    44. Exemptions. –(1) A candidate who has completed a course and

    passed the examination leading to the award of a nationally recognized technical

    qualification or equivalent may be granted exemption from the academic papers on

    a subject to subject basis, as follows, namely: -

    (a) In the case of First Class Engineer or certificate of competency

    class I, Second Class Engineer or certificate of competency

    class II and certificate of competency class III, the following

    qualifications may afford exemption from one or more subjects

    in the examinations, namely: -

    (i) Two years pre-sea training as marine engineering cadet

    from the Pakistan Marine Academy, leading to award of

    B.Sc. degree, shall be exempted from Mathematics

    paper;

    (ii) candidates who hold recognized degree in Marine or

    Mechanical Engineering awarded by a university in

    Pakistan or any other country, provided that their

    qualification have been accredited by recognized bodies

    or institutions, shall be exempted from Mathematics,

    Applied Mechanics and Applied Heat papers; and

    (iii) candidates who hold recognized degree in Electrical or

    Electronic Engineering awarded by a university in

    Pakistan or any other country, provided that their

    qualification have been accredited by recognized bodies

    or institutions, shall be exempted from Mathematics and

    Electrotecnology papers;

    (b) candidates who are not granted exemptions shall be required to

    pass all, or the remaining academic subjects. Partial passes or

    exemptions admissible by other administrations shall be

    accepted on case to case basis in academic subjects only; and

    (c) no exemption shall be granted from the Engineering

    Knowledge written or oral examinations.

    45. Examinations. -(1) For the grant of certificate of competency class IV,

    the examination shall be oral and written according to the syllabus as specified in

    Appendix F. The examination shall consist of the following subjects, namely: -

    (a) Engineering Knowledge (one paper of three hours). The paper

    shall be divided into the following four sections, and passing in

    each section shall be compulsory, namely: -

    (i) Section 1. Marine Engineering at operational level;

    (ii) Section 2. Electrical, Electronic and Control Engineering

    at operational level;

    (iii) Section 3. Maintenance and repair; and

    (iv) Section 4. Controlling the operation of ship and care

    for person on board at operational level.

    (b) Oral examination.

    (2) For the grant of certificate of competency (Marine Engineer Officer)

    class III, the examination shall consist of the following subjects according to the

    syllabus as set out in Appendix G, namely: -

    (a) Academic subjects:

    (i) General Engineering Science I (one paper of two hours);

    and

    (ii) General Engineering Science II (one paper of two hours).

    (b) Professional subject:

    (i) Engineering Knowledge (two papers, each of two hours).

    (c) Oral examination.

    (3) For the grant of certificate of competency (Second Engineer Officer)

    class II, the examination shall consist of the following subjects according to the

    syllabus as set out in Appendix H, namely: -

    (a) Academic subjects:

    (i) Applied Mechanics (one paper of three hours);

    (ii) Applied Heat (one paper of three hours);

    (iii) Mathematics (one paper of three hours);

    (iv) Engineering Drawing (one paper of four hours);

    (v) Electrotechnology (one paper of three hours); and

    (vi) Naval Architecture (one paper of three hours).

    (b) Professional subjects:

    (i) Engineering Knowledge General (one paper of three

    hours); and

    (ii) Engineering Knowledge Motor or Steam (One paper of

    three hours).

    (c) Oral Examination.

    (4) For service endorsement the examination shall be oral only and shall

    be based upon the responsibilities and duties of the Chief Engineer Officer or of

    the Second Engineer Officer at a level appropriate to the endorsed certificate at its

    range of application.

    (5) For the grant of certificate of competency (Chief Engineer Officer)

    class I, the examination shall consist of the following subjects according to the

    syllabus as set out in Appendix I, namely: -

    (a) Academic subjects:

    (i) Applied Mechanics (one paper of three hours);

    (ii) Applied Heat (one paper of three hours);

    (iii) Electrotechnology (one paper of three hours); and

    (iv) Naval Architecture (one paper of three hours);

    (b) Professional subjects:

    (i) Engineering Knowledge General (one paper of three

    hours); and

    (ii) Engineering Knowledge Motor or Steam (one paper of three

    hours).

    (c) Oral examinations.

    (6) For the grant of certificate of competency combined, the First Class

    Engineer or certificate of competency class I, Second Class Engineer or certificate

    of competency class II, the examination shall consist of the following subjects,

    namely: -

    (a) Additional paper in professional subjects of Engineering

    Knowledge Motor or Steam (one paper of three hours); and

    (b) Oral examination.

    (7) For the grant of certificate of competency combined (Chief Engineer

    Officer) class I, the examination shall consist of the following subjects, namely: -

    (a) Professional subjects:

    (i) Engineering Knowledge General (one paper of three

    hours);

    (ii) Engineering Knowledge Motor (one paper of three hours);

    and

    (iii) Engineering Knowledge Steam (one paper of three hours).

    (b) Oral examination.

    46. Permitted attempts. -(1) A candidate may appear for the examination

    of the First Class Engineer or certificate of competency class I, Second Class

    Engineer or certificate of competency class II, or certificate of competency class III

    in the academic subjects from which he has not been exempted, provided he has

    fulfilled the requirements as specified in Chapter IV.

    (2) A candidate may appear for the professional subjects of the First Class

    Engineer or certificate of competency class I, Second Class Engineer or certificate

    of competency class II, certificate of competency class III or certificate of

    competency class IV examination at any time after he has completed the necessary

    period of approved education and training and qualifying sea service as specified

    in Chapters III and IV, provided that in the case of the First Class Engineer or

    certificate of competency class I examination, he must also be in possession of a

    recognized Second Class Engineer or certificate of competency class II.

    (3) For a combined certificate of competency, certificate of competency

    class I, certificate of competency class II or certificate of competency class IV a

    candidate may appear for the remaining Engineering Knowledge examination,

    provided he already holds either a Motor or Steam certificate of competency of the

    same class. Alternatively a candidate may appear for the certificate of competency

    class I, certificate of competency class II or certificate of competency class IV

    combined examination attempting the Engineering Knowledge General, Motor and

    Steam examination at the same attempt.

    (4) A candidate who is successful in passing any of the academic subjects

    in the First Class Engineer or certificate of competency class I, Second Class

    Engineer or certificate of competency class II or certificate of competency class III

    Engineer examination shall not be required to reappear in that subject at

    subsequent attempts.

    (5) The Engineering Knowledge written papers form a single part of the

    examination must be passed at the same attempt.

    (6) A candidate must pass the written part of the Engineering Knowledge

    examination and the oral part of the examination for a particular grade of

    certificate within three years period to retain the validity of a pass in either part of

    Engineering Knowledge examination.

    47. Eligibility into professional subjects examination for the various

    grades of certificate of competency. A candidate wishing to appear for the

    professional subjects examination must have performed the required sea service as

    specified in rules 17, 18, 19 and 20.

    48. Pass marks. - A candidate shall be required to obtain not less than fifty

    per cent of the total number of marks in each subject attempted to secure a pass in

    either academic subjects or professional subjects. A higher standard shall be

    required in the oral examination.

    49. Board of Examiners. –(1) The Federal Government shall constitute a

    Board of Examiners which shall conduct all examinations of the Marine Engineer

    Officers. The Board of Examiners so constituted shall, in performance of its

    functions, be subject to the supervision of the Chief Examiner of Engineers.

    (2) The Board of Examiners shall be constituted amongst the following

    Examiners, namely: -

    (a) Engineer and Ship Surveyors in the Mercantile Marine

    Department including those promoted as Principal Officer;

    (b) Engineer and Ship Surveyors attached to the Directorate

    General Ports and Shipping; and

    (c) Chief Engineer and Ship Surveyor, Directorate General Ports

    and Shipping, who shall also be the Chief Examiner of

    Engineers.

    50. Result of examination. – The Chief Examiner of Engineers shall

    communicate results of the various examinations to the candidates.

    51. Appellate Board. –(1) The Director-General Ports and Shipping, in

    consultation with the Chief Examiner of Engineers, shall appoint an Appellate

    Board, consisting of at least two persons, who remained as ex-Chief Examiner of

    Engineers or ex-Examiner in the Directorate General Ports and Shipping.

    .

    (2) An aggrieved candidate may prefer an appeal personally before the

    Appellate Board within twenty days after the receipt of his result on payment of

    the prescribed fee as specified in Appendix K.

    (3) The following shall be the functions of the Appellate Board

    appointed under sub-rule (1), namely: -

    (a) To consider the appeals on the subject of examination;

    (b) to see that questions have been marked, and the totaling of the

    marks given is correct; and

    (c) to ensure that the standard of marking is balanced with all other

    candidates, who have either failed or passed and no injustice

    has been done to the aggrieved candidate.

    CHAPTER IX. – REVALIDATION OF CERTIFICATES OF COMPETECY

    52. Condition for revalidation of certificate of competency. –(1) Every

    Engineer Officer holding certificate of competency which is recognized under the

    International Convention on Standard of Training and Certification of Watch

    keeping for seafarers, 1978, as amended in 1995, who is serving at sea or intends

    to return to sea after a period ashore, shall be required to revalidate certificate of

    competency granted to him at intervals not exceeding five years, to establish

    continued professional competence in accordance with section A-I/11 of the said

    convention, read with regulation I/II thereof.

    (2) In the case of service endorsement as Chief Engineer or additional

    qualifications on Steam or Motor Certificate of the same class, the date from which

    the five years period of validity shall commence be the latest qualifying date

    shown in the certificate of competency.

    (3) There shall be no time limit on application under this rule for

    revalidation of a certificate of competency irrespective of the date on which it

    ceases to be valid for sea going service.

    53. Requirements for revalidation of certificate of competency. –(1)

    In order to fulfill the requirements for revalidation, a certificate of competency

    holder shall, -

    (a) have the medical fitness including eyesight and hearing

    requirements as specified in Appendix C;

    (b) have served as an Engineer Officer on sea-going ships of any

    flag for at least twelve months (which need not be continuous)

    during the preceding five years; and

    (c) possess the following valid mandatory courses, namely: -

    (i) Medical first aid;

    (ii) advance fire fighting; and

    (iii) proficiency in survival craft and rescue boat.

    (2) Where a certificate of competency holder has not served sufficient

    time to satisfy the requirements of clause (b) of sub-rule (1), for the eligibility of

    revalidation of certificate of competency, the candidate shall serve for three

    months on ships having a registered power of seven hundred and fifty kilowatt or

    more, other than fishing vessels, in a supernumerary capacity, or in ranks below

    that to which his certificate of competency is appropriate.

    (3) An Engineer Officer who is a certificate of competency holder and

    has served at sea, in a vessel for at least three months prior to the expiry of the full

    validity of certificate of competency granted to him, may also apply for

    revalidation.

    54. Acceptable occupations. -(1) An Engineer Officer who has

    performed functions relating to the duties appropriate to the grade of certificate of

    competency held which are considered to be at least equivalent to the sea service

    required for revalidation of certificate of competency, shall be considered

    favourably. In this regard, the following is the list of acceptable occupations,

    namely: -

    (a) Government Ship’s Surveyors;

    (b) Lecturers of approved Marine Colleges;

    (c) Technical Engineer and Marine Superintendents or ship repair

    managers; and

    (d) Classification Society Engineer Surveyors.

    (2) A certificate of competency holder must have been engaged in any of

    the occupations specified in sub-rule (1) for at least two and a half years in the

    proceeding five years.

    (3) An Engineer officer who does not meet the revalidation criteria given

    in rules 53 and 54 may submit his application for revalidation of certificate of

    competency granted to him at the Mercantile Marine Department along with

    medical fitness including eye sight and hearing standards as specified in Appendix

    C, and valid mandatory courses. In such a case the written examination shall be

    conducted accordingly as per the syllabus as set out in Appendix P.

    55.Application for revalidation of certificate of competency. –An

    application in the form as set out in Appendix J, together with supporting

    documents and the prescribed fee as specified in Appendix K should be submitted

    to the Principal Officer, Mercantile Marine Department, Karachi, for revalidation

    of certificate of competency.

    56. Revalidation of certificate of competency. - A candidate who fulfills

    the requirements of clauses (a), (b) and (c) of sub-rule (1) of rule 53 shall be

    granted revalidation of certificate of competency granted to him for further five

    years, and an endorsement certificate as set out in Appendix Q shall be attached to

    the certificate of competency.

    CHAPTER X. – DANGROUS CARGO ENDORSEMENT AND

    REVALIDATION

    57. Requirements for dangerous cargo endorsement. - Certificate of

    competency shall be endorsed for service on tankers carrying oil, chemical or

    liquefied gas for those candidates who meet the approved training and sea service

    requirements in accordance with regulation V/1 of the International Convention on

    Standards of Training and Certification of Watch-keeping for Seafarers, 1978, as

    amended in 1995.

    58. Qualifying conditions. - In each case within the five years period

    prior to the date of application for dangerous cargo endorsement, a candidate

    should have a specialized training course on the carriage of the relevant dangerous

    cargo, approved by the Federal Government, and either, -

    (i) six months accredited ship-board service; or

    (ii) twenty-eight days intensive shipboard training, approved

    by the Federal Government, if applicable.

    59. Application for dangerous cargo endorsement. –(1) An application

    in the from as set out in Appendix R for dangerous cargo endorsement along with

    the prescribed fee as specified in Appendix K, should be submitted to the Principal

    Officer, Mercantile Marine Department, Karachi. In addition the candidate shall be

    required to produce certificate of competency granted to him along with certificate

    of sea service, seamen’s service book or continues discharge certificate, and

    confirmatory evidence of training and sea service as specified in this rule and

    report of tanker sea service as set out in Appendix S.

    (2) A candidates who is suitably qualified may apply on one application

    form as set out in Appendix R for more than one endorsement. Separate fee as

    specified in Appendix K shall be charged for each endorsement granted in respect

    of each such application.

    60. Grant of dangerous cargo endorsement. - In order to qualify for the

    grant of a dangerous cargo endorsement, an Engineer Officers holding certificate

    of competency must have completed specialized training course approved by the

    Federal Government together with a period of shipboard training and appropriate

    sea service as specified in rule 58.

    61. Revalidation of dangerous cargo endorsements. –(1) Subject to

    sub-rule (3), an Engineer Officer holding certificate of competency carrying

    dangerous cargo endorsement shall, in order to qualify for grant of revalidation of

    dangerous cargo endorsement held by him, provide evidence of at least three

    months sea service (which need not be continuous) in any type of tanker during the

    preceding five years.

    (2) An Engineer Officer who has not served in a tanker during the

    preceding five years period shall have his dangerous cargo endorsements

    withdrawn.

    (3) Before dangerous cargo endorsement is revalidated an Engineer

    Officer shall be required to either, -

    (a) attend a shore-based Tanker Safety Course approved by the

    Federal Government; or

    (b) undertake fourteen days supervised shipboard training approved

    by the Federal Government in a supernumerary capacity in the

    type of tanker in which it is intended to serve.

    CHAPTER XI. - PENALITIES

    62. Penalty for misconduct. - Where in the opinion of the Chief Examiner

    of Engineers, a candidate has been found guilty of any misconduct in relation to an

    examination including insolence to any Examiner or disorderly or improper

    conduct in or outside the room where the examination is held, or a breach of any of

    these rules, the Chief Examiner of Engineers may take action in one or more of the

    following manners, namely: -

    (a) Where the examination has not commenced or has not

    been completed, the candidate shall not be permitted to appear

    in the examination or, as the case may be, to take further part

    therein;

    (b) where the candidate has been declared successful in the

    examination but has not been granted the necessary certificate

    of competency, the certificate of competency shall be withheld

    for such period as the Chief Examiner of Engineers may direct;

    and

    (c) the candidate may be debarred from appearing in any

    examination under these rules for such period as the Chief

    Examiner of Engineers may direct.

    63. Penalty for copying. - In the event of any candidate being discovered

    referring to any unauthorized book or copying from another candidate or affording

    any assistance or giving any information to another candidate or communicating in

    any way with anyone during the time of examination or copying any part of the

    problems for the purpose of taking them out of the examination room, he shall be

    regarded as fail in that subject and shall not be allowed to present himself for re-

    examination for a period of six months. A candidate guilty of a second offence of

    such nature shall not be allowed to present himself for re-examination until twelve

    months have elapsed since the date of the second offence.
