■ Important NotesOrdering procedure—quantity changes during the trade fairThe above order, in the name and for account of the exhibitor quoted on page 1 / cover sheet, becomes valid only upon the order being confirmed by Stürzer Catering GmbH. Any contract agreed is concluded between the exhibitor and Messe München GmbH’s service partner. Kindly note that your signature and company stamp are required on this page for its legal validity.You are kindly asked to send this order form back to us no later than 12 working days prior to the start of the trade show.Quantity changes / adjustments can be made by no later than 14:00 of the previous day by phone at +49 8095-906670. For its part, Stürzer Catering GmbH will endea-vor to contact the customer at the phone number stated on a daily basis by no later than 14:00 to discuss any changes that may be required. Should Stürzer GmbHs attempt to contact the customer be unsuccessful, the quantities specified in the order placed with us will be delivered on the next show day and invoiced accordingly.
Rental equipment and beveragesThe rental equipment will be delivered during the day prior to the start of the trade fair and will remain on the stand for entire duration of the event. The customer him-self is responsible for washing and cleaning. For all rental equipment provided, the customer or his authorized representatives are required to exercise due diligence in full from the time of acceptance to the time of return. Maintenance visits caused by incorrect use or faulty operation as well as by soiling / insufficient cleaning of the rental equipment by the customer or his authorized repre-sentatives will be subject to charges at the current rates. If any rental items are lost, missing or damaged, the cost of their replacement will be charged to the customer.
Beverages will be delivered during the day prior to the start of the trade fair. Kindly note that we can only accept the return of full crates per beverage type and / or full, intact barrels / PREMIX cartridges. Per full crate, we raise a net handling charge of EUR 5.00, per barrel EUR 12.00, per PREMIX cartridge EUR 22.00 plus statutory value added tax.Empties and rental equipment will be collected at the end of the last day of the trade show, pursuant to Messe München GmbH’s applicable terms of access for vehicles.
Delivery times and costsOne delivery per exhibition day is made free of charge within the scope of our re-gular tours (early tour between 08:00 and 09:00, midday tour between 11:00 and 12:00). EUR 25.00 plus VAT will be charged for any additional delivery during regular tours. Special trips outside the regular tours will be charged at EUR 50.00 plus VAT. Deliveries prior to the start of the trade fair (catering for setup period) or after the fair has ended (catering for dismantling period) are subject to a charge amounting to EUR 25.00 per journey plus statutory VAT. Conference room catering for up to 50 persons can only be booked in conjunction with general stand catering. For any orders placed falling short of our minimum order value of EUR 1,000.00 net per trade fair, we raise a handling charge of EUR 29.00 net.

■ Method of Payment– Invoices are issued after the trade show has ended. The billing amount is due for
payment without deduction ten days after the invoice date.
– The correct invoice address and all other details relevant to invoicing are to be notified bindingly in writing to Stürzer Catering GmbH upon order placement. For any corrections to the invoice, for which the contractor is not responsible, a handling charge of EUR 30.00 net will be raised.
– For orders with a billing address outside Germany, advance payment amounting to 100% of the estimated total order value is due. The advance payment amount must be received in Stürzer Catering GmbH’s account by no later than ten wor-king days prior to the start of the trade fair. For payments from non-EU countries, we charge a fee of 1.5% of the total invoice amount, but minimum EUR 35.00 net.
– For any orders placed falling short of our minimum order value of EUR 1,000.00 net per trade fair, we raise a handling charge of EUR 29.00 net.

■ General Terms and Conditions of Business, Trade Fair CateringPrices / Order acceptanceThe quoted prices are net prices plus statutory value added tax. If the time period between order acceptance and the beginning of the event exceeds 120 days, Stür-zer Catering GmbH reserves the right to make price changes. All quotations will remain non-binding until order acceptance.
Selection of itemsStürzer Catering GmbH will make every effort to make all items available as offered or listed, but reserves the right to make changes. Acceptance of procurement risk or guarantees, of any kind whatsoever, is not possible. Deviations from order specifica-tions do not entitle the customer to price reductions.
Minimum order valueFor any orders placed falling short of our minimum order value of EUR 1,000 net per exhibition, we charge a processing fee of EUR 29 net.
Changes / adjustments of quantity during the trade fairDaily delivery will be made on the basis of the order placed in writing. Changes / ad-justments of quantity or additional orders for the following trade-fair day, can be made by phone until 14:00 on the previous day. For its part, Stürzer Catering GmbH will endeavor to contact the customer daily by no later than 14:00 at the phone num-ber which has to be provided under the contract in order to discuss any changes. Should Stürzer Catering GmbH’s attempt to contact the customer be unsuccessful, the quantity specified in the order will be delivered on the next day of the trade fair and invoiced accordingly. Requests for changes received later cannot be conside-red or only conditionally. For special events (press conferences, booth parties, etc.) the customer will under-take to officially inform Stürzer Catering GmbH of the exact number of participants and the final selection of food and beverages no later than seven working days before the event. These details are deemed to be guaranteed contract terms and shall be taken into account accordingly in the final invoice.
Deficiencies / Exchange Obvious deficiencies can only be considered if reported immediately after receiving the goods. Complaints filed at a later stage can no longer be considered. Exchange of incorrectly ordered goods is possible only conditionally and not at all for food-stuffs and other perishable goods. Hidden deficiencies in goods delivered must be reported immediately to Stürzer Catering GmbH, but no later than 24 hours after discovery. Stürzer Catering GmbH will not be liable for any inappropriate storage on the part of the customer.
Return of soiled tablewareFor reasons of hygiene, leftovers, napkins, etc. should be removed from rented ta-bleware. In case of non-compliance, a surcharge of 30% will be added to the rental fee.
Delivery / collection of emptiesIf no delivery or only delayed delivery can take place due to interruptions in the ope-rations or at the warehouse of Stürzer Catering GmbH, or its raw materials suppliers caused by strike, war, water, machinery breakdown, energy shortage, a lock-out or other unforeseen events or due to traffic obstruction, adverse weather conditions or in the case of measures taken by the authorities which obstruct delivery, orders from higher authorities or other cases of Force Majeure, this shall not automatically result in cancellation of the contract. Under no circumstances shall the ordering party be authorized to make any deductions from the agreed purchase price or to refuse payment. Stürzer Catering GmbH shall be released from the obligation to deliver if it is prevented from fulfilling its obligation as a result of the occurrence of aforementio-ned unforeseeable circumstances. One delivery per exhibition day is made free of charge within the scope of our re-gular tours (early tour between 08:00 and 09:00, midday tour between 11:00 and 12:00. Every additional delivery during regulars tours will be charged at EUR 25 plus statutory value added tax. Special trips outside the regular tours will be charged at EUR 50.00 plus VAT. Deliveries prior to the start of the trade fair (catering for set-up period) or after the fair has ended (catering for dismantling period) are subject to a charge amounting to EUR 25 per journey plus statutory value added tax. Collection of empties on the last day of the trade fair will be made after the end of the trade pursuant to Messe München GmbH’s applicable terms of access for vehicles.
Loss or damage to (rented) itemsFor rented equipment or items provided, the customer is required to exercise due diligence from the time of acceptance to the time of return. If damages or losses occur due to negligence on the part of the ordering party or any fault attributable to him, in particular on the part of his employees or guests, the cost of replacement or repair will be charged to the customer. The renter is obligated to adequately insure the rental items at his own expense against fire and theft. Stürzer Catering GmbH will be entitled to any future rights arising from the insurance agreement as well as any claims for compensation. The customer shall transfer these to Stürzer Catering GmbH as security.
Incorrect operation of loaned equipmentMaintenance visits by staff of Stürzer Catering GmbH or by service partners com-missioned by the former, which have been caused by incorrect use or faulty opera-tion as well as soiling / insufficient cleaning of the rented equipment by the renter, in particular by his employees or guests, will be charged at the current rate. CancellationIf the customer cancels the contract for personnel services, we will charge the full amount as cancellation fee. Also for cancellations of food and beverage services or rental equipment as of 12 days or less before the beginning of the event, a cancellation fee in the full amount (100 %) will apply. In addition, we reserve the right to charge the costs incurred up to that point in full in the event of an earlier cancellation. The customer shall have the right of providing evidence that Stürzer Catering GmbH has suffered less damage. In the event of cancellation after the order has been placed—regardless of the period of time until the event—due to measures that hinder our ability to deliver, decrees from higher authorities, other cases of force majeure, epidemics or pandemics, we charge a processing fee amounting to 25 % of the order sum and 100 % for commis-sioned personnel services.
PaymentBilling occurs after the event to the address specified. The correct invoice address as well as all relevant invoicing details must be communicated to Stürzer Catering GmbH in writing at order placement. A processing fee of EUR 30 net will be charged for any subsequent invoice corrections for which the contractor is not responsible. The invoice amount is due ten days after the date of invoice without any deductions. In case of late payment, Stürzer Catering GmbH is entitled by law to charge interest from the due date. Assertion of any further claims for damages remains unaffected by this. If the invoice address is outside of Germany, we demand prepayment of 100% of the estimated order volume. The prepayment must be received in our bank account ten working days before the exhibition starts. For payments from non-EU countries, we charge a fee of 1.5% of the total invoice amount, but minimum 35.00 EUR net.For all orders, Stürzer Catering GmbH retains ownership of goods delivered until the purchase price has been paid in full.
Written formAmendments or additions as well as annulment, even of individual provisions of the-se terms and conditions, must be made in writing to be binding. This shall likewise apply to the waiver of this requirement for the written form.
Severability clauseShould a provision set out in this contract be or become invalid or unenforceable, the validity of the other contractual provisions remains unaffected.
Place of jurisdiction and place of performanceThe contractual relationship is subject to German law. If the contractual partner is a registered trader and the agreement is part of his commercial business, then the place of jurisdiction and place of performance is Munich for both parties. By placing an order, our General Terms and Conditions of Business are deemed to have been accepted as a constituent part of the contract.
