O que for combinado entre a empresa e o trabalhador tem força de lei, desde que os contratos não contrariem a lei nacional. Podem ser negociados itens como os bancos de horas, plano de cargos e salários, compensação de horários, entre outros. Atenção: no caso de contratos de trabalho, não será possível negociar os direitos essenciais, ou seja, salário mínimo, férias, 13º salário e FGTS.

Os sindicatos e as empresas poderão negociar condições de trabalho diferentes das previstas em lei. Isso significa que convenções e acordos coletivos poderão prevalecer sobre a legislação. Atenção: no caso de negociações sobre redução de salários ou de jornada, será obrigatória cláusula que prevê a proteção dos empregados contra demissão durante o prazo de vigência do acordo. Os acordos individualizados de livre negociação para empregados com instrução de nível superior e salário mensal igual ou superior a duas vezes o limite máximo dos benefícios do INSS (R$ 5.531,31) irão prevalecer sobre o coletivo. O valor exposto é o teto máximo de benefícios do INSS. Para valer, os acordos com empregados de segundo grau, o valor do salário deve ser superior a R$11.062,62.

As cláusulas dos acordos e convenções coletivas não precisarão ser incorporadas aos contratos individuais de trabalho. Além disso, sindicatos e empresas poderão dispor livremente sobre os prazos de validade dos acordos e convenções coletivas, assim como sobre a manutenção ou não dos direitos previstos quando expirados os períodos de vigência. Se a validade expirar, será necessário fazer novas negociações.

Caso o funcionário concorde, a empresa poderá parcelar as férias em até três períodos. A exigência é que um dos períodos tenha pelo menos 14 dias e os demais tenham mais de cinco dias corridos. O empregado terá a possibilidade de trabalhar 12h. Será possível ajustar e compensar a jornada de trabalho, desde que isso ocorra no mesmo mês e que seja respeitado o limite de dez horas diárias. No entanto, a Reforma prevê a negociação de jornada diária de trabalho, abrindo a possibilidade do empregado trabalhar até 12h, desde que sejam respeitadas as 36 horas ininterruptas de descanso. Atenção: se o empregador não conceder intervalo mínimo de 30 minutos para almoço ou concedê-lo parcialmente, a indenização será de 50% do valor da hora normal de trabalho apenas sobre o tempo não concedido em vez de todo o tempo de intervalo devido.

Antes inexistente nas leis de trabalho, essa modalidade permite que a empresa contrate um funcionário para trabalhar esporadicamente, ou seja, em dias alternados ou por algumas horas da semana. O salário a ser pago será equivalente aos dias de trabalho. A Reforma não define a carga horária mínima, sendo que devem ser respeitados os limites máximos de jornadas de 44 horas semanais e 220 horas mensais, conforme está determinado na Constituição Federal. Atenção: embora o trabalhador fique à disposição, a empresa só poderá convocá-lo com, no mínimo, três dias de antecedência. Outro ponto importante é a manutenção dos benefícios inerentes a contratos de trabalho, ou seja, o trabalhador terá direito FGTS, férias, entre outros benefícios.

A Reforma prevê a demissão em comum acordo entre empresa e trabalhador. Se o contrato de trabalho for extinto nesse formato, está previsto o pagamento de metade do aviso prévio e metade da multa de 40% sobre o saldo do FGTS. O Governo Federal sancionou o projeto de lei que permite a terceirização para atividades-fim. No entanto, com a Reforma, a empresa só poderá recontratar o trabalhador efetivo como terceirizado 18 meses após a demissão. A lei prevê, ainda, que a empresa forneça ao terceirizado as mesmas condições de trabalho dos efetivos – como atendimento em ambulatório, alimentação, segurança, transporte, capacitação e qualidade de equipamentos.

A Reforma limita o valor a ser pleiteado pelo trabalhador, prevendo um teto para pedidos de indenização. No caso de ofensas graves cometidas por empregadores, os valores devem ser de no máximo 50 vezes o último salário contratual do ofendido.

Ações na justiça18A Reforma impõe o comparecimento do trabalhador às audiências na Justiça do Trabalho. Caso perca a ação, o funcionário terá que arcar com os custos do processo. Quem perder a causa terá de pagar entre 5% e 15% do valor da sentença aos advogados da parte vencedora. O trabalhador que tiver acesso à Justiça gratuita também fica sujeito ao pagamento de honorários de perícias se tiver obtido créditos em outros processos capazes de suportar a despesa. Caso contrário, a União assume os custos. Também terá de pagar os honorários da parte vencedora, no caso de perda da ação.Também estão previstas punições para quem agir com má-fé. A multa varia de 1% a 10% da causa. A parte contrária também será indenizada. Atenção: se assinar a rescisão contratual, o empregado fica impedido de questioná-la posteriormente na Justiça do Trabalho. Além disso, fica limitado a 8 anos o prazo para o andamento das ações. Passado esse período, se a ação não tiver sido julgada ou concluída, o processo será extinto.
