SEC. 6. Interference with Aidr to Navigation -It shall be unlawful for any person. association.orcorporation, 10remove, change the location of, obstruct. willfully damage. make faslla, or interfere WIthany aid 10 maritime navigation.

SEC. 7. 4. Damo PilO1a~eDmrict. - The Davao Pilotage District shall embrace the waters of the portand harborofDavao. D:lvaoGulfinciudingthe waters of the ports and harborsofMalalag. Tagabuli (Sta.Cruz). Davao Cit)". Pakiputan Strait. Pasa. Tamhongan. Lupon and the POftS and harbors of Matiincluding Manay (Mayo Hay).

5. Tac/ohan PjJ{/flI~eDiJtrict.- The Tacloban Pilotage District shall embrace the waters of theStrait of San Juanico between the San Pedro Bay and Canauay Island and the waters of San Pedro Northof Latitude II deg. min. North to the entrance of the strait. Vessels entering or leaving the Port ofTacloban through San Pedro Bay shall be boarded or unboarded by pilots off the huoy marking Eghert

Shoals.6. Bicol ReRi011fifO/age Dis/riCI. - The Bieol Region Pilotage District shall embrncc the

waters of the ports and harbors of Jose Panganiban. Mercedes. Tabaco. Legaspi and Masnate. It ~hallembrace the waters within the harbor limits of Jose Panganiban.the Port of Mercedes. the waters withinan imaginary line drawn from Groove Point on the mainland oflhe lighthouse northea"tern pan ofGaninoIsland and an imaginary line drawn from the southern point of Ganino Island to Pambuan Point on themainland. at the Port ofTabaco. the waters within the radius of the three Illiles from the sea.end of thepier and at the Port of Lega."pi and the WOlterswithin the harbor limits of MOlsb:lte.

Masin/oc.Santa Cruz Pi/maKeDLtrrict. - The Masinloc~Santa Cruz Pilotage District shallembrace the waters within a radius of three miles from the seaward and of the Benguet Consolidatedf\1ining Comp:my's wharf at the Pon of Masinloc and at the Port of Santa Cruz. the waters embracedwithin the following boundaries: along an imaginary line extending from the northern bank of the mouthof tile Mayon River (Q the Southern point of the Hennana Mayor Island. thence along an imaginary lineextending to Santa Cruz Point on the mainland.

10. Sail Fernando. LV. Pi/maRl' Di.~/rict. - The San Fernando. L.U. Pilotage Distric[ shallembmec the wmcrsofthe port and hamorofSnn Fernando La Union. wilhin a rndius of three miles fromthe lower light at San Fernando harbor and Dagupan.

II. ZllIlI/xHlnl!a PiiolaKe Districi. - The Z:u~boanga Pilotage District shall embrace the watersof the ports and harborsofZnmboanga City. Recede and from Caldera Bay to the Basilan Strait. TietuanChannel. Masinloc Anchorage to Talusangay harbor and Basilan Cit)' Port to Isabel a Channel.

12. Dumague/e Pi/mage Districl. - The DUlnaguele Pilotagc District shall embrace the watersof the pOIlSand harbors of Dumaguetc Cit)'. Dais and San Carlos including the waters of the Tunon Straitbetween Dumagucte and Dais and San Carlos and the Pan of Siquijor Island.

13. Aparri Pilmage District. - The Aparri Pilotage District shall embrace those commencingat the clear waters outside of the bar nnd extending to the Cagayan Rivcr to Lal-Ioc and the ports and

harbors of Apam. San Vicenle. Kasamhalangan. Alllunision. Mission. Ahulog. Pamplona. Claveriaandothers outlying pons at the mouth of the Cagayan River.

14. Mmao Pilota~e Disrric/. - The Ma."ao Pilotage Districtshall embrace the waters of the ponsand harbors of Nasipit. Masao. Butuan City and Cabadbaran. including Agusan River.

PAR. V. - No persall other than duly appointed pilots of a panicular pilotage district shall bepermitted to act as pilot on any foreign or coastwise vC.~selswithin the limits of said pilotage district.

PAR. VII. - Applicants for examination as Harbor Pilots in :my panicular pilotage district shnlJbe given wrillen and practical examinations by a Board of Examiners appoimed as hereinafter provided.which board shall give loench applicant a full and impanial rating to becellified upon each examinationpaper and trans mined to the Commissioner of Cusloms for approval and release.

PAR. VIII. - Any person who ha.<;pa.••sed the examinntions as district pilot a."provided in the nextpreceding paragraph shall. when a vacancy in the pilotage district concerned exists. be appointed nsharbor pilot for Ihe said districi who shall undergo training a.~:m appre1llia or "robalitlll(/r)' pilot for atleast l/rree mOlllh~except in Manila where the period of such training shall not be less than/our 1IlrJllths.

All examinations for harbor pilots in all ports or pi lotage districts shall be held in 1\.1anila.The pilots'association concerned shall defray the trunspoltution expenses of the members of the association whoare appointed ao;;members of Ihe Board of Exnminers for hnrbor pilol.

PAR. XI. - All pilots shall be appoimed by Ihe Secretary orFinunct: upon recommendation of theCommissioner of Customs which recommendmion shall only be made nfl(.'r Ihc pi lois' as<;,ociationconcerned has been duly advised of the proposed appointment. The appoimee shall be selected fromamong those who have passed the required examination for the pon for which he is appointed. the onewho oblained the highest rnting and who is cenified by Ihe physici~lI1 01 the HurC,lU of Cusloms asphysically and mentaliy fit for the work shull be preferred. He shall undergo truinin,!! as apprentice orprobationary pilot wilh regular pilots for a period of at leao;;tthree (3) months exccpt in r-.1anila.•••.here theperiod of such training shall not be less than four (4) months. During the period of trailling, he shallaccompany regular pilots and make a careful study of the different mnneuvcrs while the vessels entersthe pon to dock nlongside the pierorto undock unlil the vessel departs free from shoal orthe vessel enter.;the port to an assigned anchorJge and from the anchorage umilthe vessel departs free from shoal. shiftingberths. and all other maneuvers. the peculiarities oflhe different kinds of engines especially the backingpower, either single or twin screws. and all duties penaining 10 his position. including the rules of theroad, Customs and Quarantine Laws. the pilotage rcgulalion,~ nnd panicuJar h:lrhor regulntions for theport for which he is appolllted. and the regular pilot whom the probationary pilot accompanies shallimpart his knowledge to the probationary pilol. If at the expiration of the period of his training he iscertified by the Chief Pilot ns being qualified to assume thcdulies of a regular pilot. he shall be appointedas a regular pilot, otherwise. his appointmem as probationary pilot shall be cancellcd. provided, thai thecertification of the Chief Pilot shall be subJeclto review by the Collector of Customs having supervi.<;,ionover the pilotage district except that in Manila such certification shall be subject 10 review hy theCommissioner of Cusloms After completion of the probationary period designated. Ihe Chief PilO!concerned shall. through the Collector of CU.'1;fomsconcemed. submit his cenification to the Comrnis+sioner of Customs immediately. whether or not the probatiol':lIry pilot is qualified and entitled to beappointed a<;,regular Harbor Pilot.

XII. - TheChicfPilot in the pilot<.1gedislnct ortr.~ Chief Pilot of the Pilots' association shallbe appointed by the Secretary of Finance upon recommendauon of the Commissioner of Customs fromnmong the regular pilots: Provided. A general average of seventy-five percent (75%) shnll be the pa~sing grnde for this examination:Provided. That the exnmiOt:e shnllnot have obt~ined a gmde of less than fifty percent (50%) In any of

the examination subjects. .. .The Board shall submit within ninety (90) days after the date of the exammatlon the raungs

obtained by each examinee to the Commissioner of Customs for approval and release.

PAR. IX. _ The Board of Exnminers .for Pil?ts shall consist of fi:e (5) members. the Ch~inn::of the Board of Marine Inquiry ao;;ex-officIO Chalrman. two harbor ~llots of the port for V:~lch t.examination is given and two captains who nre pilol eligibles for the sa.ld port or who.are familiar ~Ilhthe waters and vicinity of the said port. or in the absence of such Harbor PIlots ~nd CnptaJns: fou,r(4) ~llotsof other pilotage districts who are familiar with the wmefS of the port for whIch the examllla~lOn WIll begiven. and who shnll all be appointed by the Commissioner of Customs. They shall be entItled to perdiems as provided in the next succeeding paragraph.

PAR. X. - To be admined to a pilot examination 10 qualify for appointment ao;;pilot. an applicantmust, at Ihe lime of filing his application, establish to the satisfaction of the Board that he possess thefollowing qualificmions:

PAR. PAR. XVII. - Members of pilots' association shall, under the immediate direction .of Ihe ChiefPilot perform such duties relative to shipping as may from lime to time be prescnbed by theCommissioner of Customs.

PAR. XVIII. - Pilots shall report to the Collector of Customs, copy furnished the Commission~rof Customs. illegal acts or unusual occurrences that may have come to their knowl~dge ~nd shall. Ifrequesled, in ca~.s of emergency. assist any cusloms officer in the perfonnance of hiS dunes.

PAR. XIX. - Pilots shall be provided with a carry blank form. in duplieate. numberedconsecutively. (Q be used as certificates of service rendered including overtime and slat~ment of fees ~uethe association to be signed by mastef5 of vel>sels, the original to be aUached to the bills for collectIOnand lhe duplicate 10be retained by the pilots' association and kept in its files.

PAR. XX. - In case of temporary abscnce of a Chief Pilot. the Commissioner of Customs shallde.signate one of the regular pilOls of the a-ssociation to aCI in his place.

PAR. XXI. - Chief Pilots shall have general charge and control of the pilotage service in theirrespective districts subject to the provisions of these regulations, 10 the by. laws of their respectiveassociations and to such funher regulations :IS may be promulg:i1ed from time to time by theCommissioner of Customs.

PAR. XXII. - A service roster shall be kept by each pilots' association and the Chief shall see ((l

it that every pilot perfonns his duty efficiently and well.

PAR. XXIII. - The following records shall be accuralely kept by pilots' a-~sociation and shall besubject to inspection by any member thereof. hy thc Collector of Customs having supervision over thepilotage district and by the Commissioner of Customs or his duly authorized representatives:

(a) A record of pilots in which shall be entered the name of each pilot togcther with the date ofappointment. age. place ofhirth. citi7.cnship. statement of sea service prior to date of appoint ment u.~pilo!.notations of specially meritorious services rendered and commendations received therefor, nol:;i1ions ofcomplaints made against him wilh the result of invest igati 011 of same. memorandum of vessels strandedor damaged while in his charge, together with the circumstances eonnected with each cu.~e.and any othcrinformation thaI may seem proper to the Chief Pilol. the Collector of Customs or Ihe Commissioner ofCustoms. All the above notations shall be signed by the Chief Pilot.

(b) Complete financial records of the association showing all receipts from every sourcewhalever,and the disposition of the same: amount ofca-sh on hand at the end of each month, and by whomheld: the alllount of indebtedness of the association. if any. and to whom due. In these records shall alsobe entered each separate pilOlage or other fees received or collected by or for the association. includingovertime.

(c) Records of permanent property. equipment and of such member's share thereof. During thefirst month of each calendar year, the Chief Pilot shall cause all property of the association to beappraised. allowances being made for depreciation, and shall enter the same in the property record.

(d) Records of obstructions, tides. changes of channel dredging. etc., due notice of which shnllhe fo•••.•..arded to the Collector of Customs or Commissioner of Custont~ as the ca.se maybe.

PAR. XXIV. - All absences and leaves of pilots shall be governed by the rules of their respectiveassociations which hnve been duly approved by the Commissioner of Customs.

PAR. XXV. - Should a member of a pilots' a~sociation absent himself from his regular dutieswithout permission. he shall not be entitled to any compensalion or dividend forthe period ofhi,~ absence.but in case of absence with leave. he shall be entitled to compensation ordividcnd for not more than thinydays per annum. Whenever a member of an association becomes physically disabled by injuries ordisease cOIHracted in line of duty. he shall for the first two months from date of disability, receive onehalf (1(2) of the monthly share of eamings allowed to each active member during the same period andthereafter one fifth (1/5) of such monthly share provided the period of disability during which he receivedcompensation shall nOl exceed lwelve months.

PAR. XXVI, - Upon separation of a pilot from a pilots' association through death or any othercause not prejudicial to his rights thereto. the remaining members shall payor guarantee to him or hisestate an amount equal to his share ill the property of the association in accordance with the latestvaluation provided fori;] clause (c) of Par. XXIII afthis Order. If a new pilot is appoiOlcd to fill a vacancythus crealed. he shall reimbuf5e the association in the amount paid to his predecessor by ttee associationbefore being allowed to assume duty. provided. that a new member may give a bond to insure paymentwith the securities approved by the Commissioner of Customs and the Chief Pilot.

PAR. XXVII. -In all pilotage districts where pilotage is compulsory, there slmll be created andmaintained by the pilots or pilots' association. in the manner hereinafter prescribed. a reserve fund equal101'1,000.00 for each pilot thereof for the purpose of paying claims for damages to vessels or propenycaused through aclS or omissions of its members while rendered in compulsory pilOlage service. InManila, the reserve fund shall be P2.000.00 for each pilot.

PAR. XXVIII. _ A pilots' association shall not be liable under these regulations for damage to anyvessel, or other property, resulting from acts of a member of an association in the actual performance ofhis duty for a greater amount than the amount abovc.stated. the excess shall be paid by Ole personal funds

PAR, XXXI, _ If a payment is made from the reserve fund of an ae;sociation on account of damagescaused by a member thereof. and he shall have been found at fault. such member shall reimburse theassociation in the amount so paid ae;soon as practicable: and for this purpose. not less than twenty.fiveper centum of his dividends shall be retained each month until the full amount has been returned to the

reserve fund.PAR. XXXII, _ When the reimbursement has been completed as prescribed in the next preceding

paragraph, the ten per centum and the interest withheld from the shares of the other pilots in accordancewith the provisions of Par. XXX hereof shall be returned to them,

PAR. XXXIII. _ Upon the retirement or death of a member of an association. the amount he hascontributed to the reserve fund shall be paid to him or his e.c;tate:Provided. that there shall not be paidany portion of amount paid by him into that fund for the purpose of meeting claims for which he was

responsible,PAR, XXXIV, _ Nothing in these regulations shall relieve any pilots' association or members

Ihereof, individually or collectively, from civil responsibility for damages to life or property resultingfrom the acts of members in the perfonnance of Iheir duties.

PAR. XXXV. _ All pilot boats shall be painted white above the waterline and black below. withthe teller "P" in black. not less than 12-112 centimeteni in length. on both bows above the waterline.

PAR. XXXVI.- During the day, pilot boats in use shall carry at the stem ablue Oag. not less than(; decimeters wide and 9 decimeters long. having thereon a while letter "p". 12.1/2 centimeters in length.

PAR. XXXVIII. _ The lawful orders of a pilot in charge of a vessel shall be promptly obeyed bythe Officer-in-Charge of any other vessel that the pilot may consider an impediment to the safe handling

of the vessel under his control.

PAR. XXXIX. _ A pilot shall be held responsible for the direction of a vessel from the time heassumes control thereof until he leaves it anchored free from shoal: Provided. That his responsibility shallcease at the moment the master neglects or refuse to carry out his instructions,

PARAGRAPH l. - Pilotage for entering a harbor and anchoring thereat, a.<;well as docking andundocking in any pier or shifting from one benh to another shall be compulsory. except Governmentvessels and vessels of foreign governments enlitled to courtesy. and other vessels engaged solely in riveror harbor work, or in a daily ferry service between ports which shall be exempt from the compulsorypilOlage provisions of these regulations: provided. however. that compulsory piiOlage shall nOIapply inpilotage districts whose optional pilotage is allowed under these regulations.

PAR. II. - Theemploymentofpilots for coastwise service in Philippine waters outside of pilotagedistricts or between piiOlage dislricls shall be optional. In the absence of a coa~t pilot or when none isavailable, the Collector of Customs may designate any experienced harbor pilot of the pilotage districtwithin his jurisdiction to act as pilot upon written request by the ship's master or agent concerned withinat least twenty-four (24) hours in advance.

PAR. III. - Any vessel employing a harbor pilot or coa.~t pilot shall pay the prescribed pilotagefees as provided in these regulations.

PAR. IV. - If the services of a pilot ha~ been refused without any justifiable rea~on. thecorresponding pilotage fees shall nevertheless be paid in cases where pilotage is compulsory undertheseregulations.

PAR. V. - When a pilot is kept on board a vessel through quarantine or other causes beyond hiscontrol. he shall be entitled to subsistence and to pay at the rate of fifty pesos (P50.OO) per day: Provided.That all time less Ihan twenty-four hours and over six hours shall be counted as one day.

PAR. VI. - A pilot who. after reporting or board a ve.••sel. shall be dismissed forthwith withoutrendering any pilotage service shall be entitled to twenry pesos (P20.cX»)as comPensating for the timeconsumed travelling to and from the vessel.

~ PAR. VII. - When pilotage service is rendered at any pon betwt.'en suns~t and sunrise. anadditional charge of one hundred percentum (100%) over the regular pilotage fees shall be paid forvessels engaged in foreign trade and fifty (50%) pcrcentum forcoa~twise vessels. This additional chargeor premium fee for nighttime pilotage service shall likewise be paid when the piiOlage service iscommenced before and finished after sunset or commenced before and finished after sunrisc.

PAR. VIII. - The pilotage fe~s hereinafter collected in the manner and at the rates prescribed shallbe known as "Entrance and Clearance Fees"; "Docking or Mooring Fee.~". "Undocking or UnmooringFecs". "Coastwise Fee" and "Swifting Fees' ..

PAR. IX. - No clearance shaH he grnnted (Q any vessel on account to which pilotage fees arepayable unless payment has been made or guaranteed to be paid in the manner satisfactory to the PilotsAssociation of the district.

Chapter II

PILOTAGE SERVICE; COLLECTION OF FEES: DISBURSEMENT OF FUNDS; AND REPORTSTO THE COMMISSIONER OF CUSTOMS.

PAR. X. -In case of marine accidents. causing damage to the piers and other property. privateor government. involving vessels whether or not under a pilot. no clearance for said vessel shall beallowed by the ColleclOr of Customs unless the cost of the damage has been paid or guaranteed to be paidby a ca~h bond in an amount sufficient to cover the cost of the damage.

PAR. XI. _ Subject to the provisions and in the manner hereinafter prescribed. all fees for allpilolage dislricts shall be collected by, and paid to and on account of the respective pilots' a~sociation.through its Secretary-Trea~urer. if any. not later than the last day of the month during which the pilotageservices were rendered.

PAR. XII, - The expenses of the pilots' association including the current expenses of remunera-tion of the Chief Pilot and the pilot acting a.~Secretary-Treasurer which are provided in the.~eregulations
