Australian Brick and Blocklaying Training Foundation (ABBTF) has announced a $2,000 Brickstart Bonus paid at the completion of Year 1. Brickstart Bonus is available to employers of new bricklaying apprentices of all ages, in New South Wales and the Australian Capital Territory.

This is in addition to the Federal Government Kickstart Extension available to employers of new bricklaying apprentices who are 19 years old and under.

ABBTF Brickstart Bonus is applicable from 1 March 2010 to 12 November 2010, and must be registered with ABBTF within 6 months from the date of indenture and the subsidy claimed within 3 months of completion of year 1.

The Federal Government Kickstart Extension is applicable from 12 May to 12 November 2010.

the weather wasn’t so good. When i arrived it was cold but fine. i later met a tardy guest who said it was now “raining cats and dogs”. He knew this because he had “just stepped in a poodle”. this ‘comedian’ said i could use his gag for my speech later in the night. i didn’t; corny jokes are not my style. Fortunately the humour improved as our compare Ahn do navigated us through the night.

i’m referring of course to our very successful 20th Master Builders & Boral Excellence in Building Awards night on 25 June. Lorraine Brooke knows these

things and says there were 1,472 of us there and she even had to disappoint a few more who also wanted to squash in, but we just didn’t have the space. When Canberra finally constructs a larger venue, i think we can reasonably expect a role up of close to 2,000 for our awards nights. i’m looking forward to that.

We were at the Convention Centre of course to celebrate the achievements of our industry over the previous 12 months. it was also a great opportunity for the members of our industry to have a night off and reflect on their achievements over the past year. it was another important evening for our industry, as we showcased what we as Master Builders do best. Something that we have done for over 120 years as an Association.

What we do best of course, is to plan, design and build things, whether it’s exceptional buildings or outstanding infrastructure works. And as the Chief Minister acknowledged, we also contribute strongly to the ACt and region

economy, we generate jobs and nurture the future workforce.

Unlike many other industry organisations, the Master Builder’s Awards aren’t restricted to our own members. they have always been open to all of the participants in our industry, whether they are Master Builders members or not . it is also important to remember that the Master Builders of the ACt represents all sectors of the building and construction industry. We have separate sector councils for the Commercial Builders, the Residential

Builders, the Civil Contractors, the Suppliers and Subcontractors and the industry’s Professionals and at our awards night we provide recognition opportunities for each of those sectors.

So the one downside of such a large event is the time it takes to complete the Award Presentations while we properly review the achievements of our entire industry. We again received a high number of great quality entries and if history is any guide, a significant percentage of the night’s winners will progress to be winners in the national Awards later this year. i never fail to be amazed at the quality and craftsmanship which is evident in our entries.

Awards play an important part in any industry by providing exposure for effort and recognition for excellence. i even applaud other construction industry awards because they too raise awareness of excellence and the need for continual improvement. Participation in awards benefits the entrant, the individuals involved and the team

responsible for the project.

Master Builders has always been fortunate in being able to attract the support of quality sponsors for our various functions, and this year’s Awards night was no exception. i would like to add my thanks to all of our sponsors for their support. it is also appropriate to specifically mention Boral who were our major sponsor for the seventeenth year straight after also being significant sponsors during the first three years of the Awards.

this 20 year relationship between Boral and Master Builders is very much appreciated by us. i am sure there can’t have been many longer enduring or better partnerships. Boral are magnificent supporters of the Master Builders ACt, and even more importantly, they also have a continuing commitment to our local industry and to our Region.

Looking ahead, we know the ACt economy remains robust, so i am anticipating continuing good conditions for our industry. While ever people live, work and play in our buildings and therefore need our infrastructure works there will be a great future for our industry. i’m already looking forward to next year’s Award night and anticipating another great collection of entries.

there has been some recent criticism around several aspects of ACt housing quality. However, anyone who was present at our 2010 Awards would see that Canberra people have plenty of reasons to be proud of their local building and construction industry.

how do we stop this attack?We have only just celebrated our annual awards for excellence in building. in recognising the outstanding achievements of our industry why is it that we find ourselves in the middle of a public debate on building quality? Some would say that’s an easy question to answer. it’s just greedy developers and builders looking for a quick buck from an unsuspecting public. of course, that’s largely an unsophisticated, ill-informed response from those not affected but prepared to debate this situation at

a superficial and mass hysteria level. there is no question that emotion for those without remedy could lead to similar views.

nobody, at least sensible and informed participants in the debate, is denying there is not an issue around building quality. there are problems but not on a scale some would have you believe. And it is certainly not all down to builders as it isn’t for designers, product suppliers and those involved in training the industry. this is a problem that can arise in any part of the chain from building concept to completion.

What the issue has highlighted is the need for far greater diligence and focus and importantly to pinpoint the problem areas to get an early fix. We have argued against imposing additional costs for things such as extended warranty periods and building defect

funds. that’s an admission of failure although perhaps an understandable response at a political level when looking for something to deal with the hysteria created.

it’s no secret that a number of those disenchanted with their building outcomes are faced with issues around waterproofing. Given that is part of the knowledge base we have to deal with then it stands to reason this is an initial target area for rectification. it could be design, it could be product application or it could be a lack of experience or

expertise. the bottom line is that it is better to target the problem areas and stop them from becoming downstream time-bombs. defect funds won’t be needed if potential issues are eliminated up front.

Master Builders Association has committed to working with the ACt Government in heading off this situation. Unfairly, all of our industry has been targeted in the debate, particularly the builders. there have been some spectacularly puerile offerings in print about building quality. one story cast serious aspersions about the character and ethics of every person in the industry since time immemorial. From that well known carpenter from biblical times, namely Jesus Christ, to our latest first year apprentice, nobody escaped. the article came from a cocktail of ego,

desperation and isolation but served to remind how quickly things can get out of hand.

it is important that all parts of the industry, government and government agencies come together to make sure this situation is addressed properly and with real outcomes. Consumers should be afforded all reasonable protection but then so too should the vast majority of good people in the industry who do the right thing. Bad behaviour and practices can’t be condoned especially where they are continually repeated. Conversely,

good practices and behaviour need to be repeated over and over again. our role is to make sure that the short term responses don’t punish everyone.

to finish up on a more positive note, and somewhat where this discussion started, the Excellence in Building Awards this year again produced an outstanding array of finalists and winners. Congratulations to everyone involved. More details and photographs are included inside this edition of Canberra Building news and the planning is now underway for 2011.

introductionit is now just on a year since many changes embraced within the Fair Work Act (2009) (Act) came into play. When measured against Workchoices those changes are both numerous and deep, as the Government has sought to eradicate all memory of the previous legislative regime, replacing it with, in their words, an Act that restores ‘fairness’.

Fairness in this context is a highly value laden term, the belief being that the strong focus on collective bargaining and the increased role of trade unions, has restored the ‘balance’ in the workplace. i will leave others to judge whether that is the case, what i do know is that the unions are definitely back in the game and one has to be a slave to process and procedure, when attempting to engage in collective bargaining at the workplace.

Many members are currently negotiating with the CFMEU; some have chosen to bargain directly with their employees. What follows is a brief step by step guide to the enterprise bargaining process as required under the Act.

the bargaining processonce the employer initiates bargaining with its employees there are a number of steps that need to be undertaken. these can be summarised in the following terms:

notice of employee representational rightsin accordance with the Act the company must take all reasonable steps to give notice of the right of all affected employees to be represented by a bargaining representative (Agent). this Agent can be a person or an employee organisation (Union). ideally the Agent is a person appointed from within the ranks

of those employees who will be covered by the Agreement.

the content of the notice must specify that the employee may appoint a bargaining agent to represent employees:

• in bargaining for the Agreement; • in a matter before the Fair Work

Australia (FWA) that relates to bargaining for the Agreement.

A bargaining agent must be appointed in writing and a copy of that notice given to the company.

Please note that in the absence of a bargaining agent being appointed, the Union is the default agent and may impose itself unilaterally upon the company for this purpose. Anecdotal evidence shows that the Union is doing just that in numerous workplaces regardless of there being no evidence of membership.

once bargaining is complete and a draft agreement has been made, further steps must be undertaken to ensure the validity of the Agreement. they include:

• the terms of the Agreement must be fully explained to all affected employees;

• all employees covered by the Agreement must be given a copy of the Agreement 7 days prior to the vote. the vote cannot occur until at least 21 days after the day on which employees were given notice of their representational rights;

• the company must also notify employees of the time and place at which the vote will occur and the voting method that will be used.

the employee voteonce all of the above have been done,

a vote can be taken on the Agreement. the purpose is to demonstrate to FWA that the Agreement has been approved by the employees, a prerequisite for FWA approval.

there is no limitation under the Act as to how the vote is to be conducted. once the Agreement has been approved by a majority of employees’ it will be taken to be made, though it does not have operational effect until 7 days after it has been approved by FWA.

the role of fair work australiaonce the Enterprise Bargaining Agreement has been approved by a majority of employees, the company or the bargaining agent must apply to FWA for approval within 14 days of the vote having been taken. the application must include a signed copy of the Agreement.

Agreements should be approved on the papers, therefore obviating the need for a formal hearing. Unfortunately anecdotal evidence suggests that this is not the case. that said, the issues to be considered by FWA in approving the Agreement are as follows:

• the employees have “genuinely agreed” to the Agreement;

• the terms of the Agreement do not contravene the national Employment Standards (nES);

• the Agreement passes the Better off overall test (Boot);

• the Agreement does not include any unlawful terms;

• the Agreement includes a nominal expiry date (maximum of 4 years);

• the Agreement includes a dispute settlement term that allows FWA or any other independent person to settle disputes about matters arising in the Agreement or the nES;

• the Agreement includes a flexibility term enabling the employer to agree to an individual flexibility arrangement with an employee which varies the effect of the Agreement in relation to that employee; and

• the Agreement includes a consultation term requiring the company to consult with its employees about any major workplace changes that are likely to have significant effect on its employees.

Finally, FWA will not approve an enterprise agreement unless it is satisfied that employees covered by the Agreement have genuinely agreed to it, the test being that the parties observed the Act’s pre-approval processes including the voting process.

does fair work offer a ‘fairer’ system?the above process is convoluted and sufficiently process driven to drive many participants to distraction. When

coupled with the ‘misconceived’ and ‘nitpicking’ approach of some members of FWA to the approval process, one has to ask the question whether the ‘balance’ so craved by the Commonwealth Government has been achieved. When the role of the Bench is to act in a manner that is both quick and informal, the lack of consistency demonstrated by it in some of its agreement making decisions leads us to question whether the ‘fairness’ so sought by Labor has been or is likely to be achieved.

the national Association of Women in Construction (nAWiC) ACt Chapter recently celebrated the contribution of women to the ACt Construction industry at its inaugural Awards for Excellence on thursday, 10 June 2010 at the national Portrait Gallery. the awards were officially opened by Senator Kate Lundy who spoke of the importance of organisations such as nAWiC for recognising and encouraging women in non traditional roles. Senator Lundy officially launched nAWiC in the ACt almost two years before and we are proud to be in a position to showcase ACt talent through our own awards.

these were the first awards of their kind in Canberra aimed at rewarding the contribution and accomplishment of women in the construction industry. the awards recognised those women who actively support and promote participation of women in construction, women who enter into and excel in non-traditional sectors of the industry, professional women and young achievers who have entered the industry and have started making a difference.

nAWiC’s core vision is to encourage and support women who pursue careers in this industry and in so doing, to raise their profile through events like the Awards for Excellence.

Under the original Resource Super Profits tax (RSPt) unveiled by the Government in May as part of its response to the Henry tax Review, extractive industry products such as gravel, sand quarrying and limestone, rock and clay mining were to be subject to the same tax regime as high value resources such as iron ore and coal.

this was contrary to the recommendations of the Henry Review which recommended that “low value” resources such as these products should be exempted from the tax.

the new tax regime – renamed the Mineral Resource Rent tax (MRRt)– announced by Prime Minister Julia Gillard on 2 July following the toppling of Kevin Rudd as Labor Leader and Prime Minister, confines the tax to iron ore and coal. on-shore gas including coal seam gas was included in the existing Petroleum Resource Rent tax arrangements.

still waiting for full detailsthe Government is yet to announce full details of the new MRRt, but in announcing the change Ms Gillard said, “the Government will focus the resource tax reforms on our biggest and most profitable commodities: iron ore, coal, oil and gas. these represent three-quarters of the value of our exports and resource operating profits and account for an even greater share of resource rents in the mining industry. they also represent the vast bulk of growth in the sector over the coming decades.

“Since the beginning of the mining boom, prices for iron ore have increased by over 400 per cent and prices for black coal have increased over 200 per cent.

“other commodities will not be included, which reduces the number of affected companies from 2,500 to around 320. these commodities were not expected to pay significant amounts of resource rent tax, and excluding them will allow many companies to remain in their existing taxation regimes.”

the government’s initial intention to treat all resources in much the same way for tax purposes has been scrapped.

original proposal would have increased housing costsCement Concrete & Aggregates Australia, the peak body for the heavy construction materials industry, had said the original proposal would “force up the cost of housing and major road and rail projects because of its impact on construction materials like sand, aggregate and concrete.”

the Government had proposed that the RSPt would apply to materials like limestone and gypsum, the raw materials used to make cement, as well as clay, sand, stone, rock and gravel, used to make concrete, bricks and other common building materials.

While details of the new tax regime are yet to be announced the Government established a Policy transition Group to be led by Resources Minister Martin Ferguson and former BHP Chairman don Argus to consult with industry and advise the Government on the implementation of the new MRRt and PRRt arrangements.

When the Government’s original response to the Henry tax Review was announced in May it was welcomed by Master Builders Australia because the Government response “categorically ruled out the taxing of the family home, changes to the current negative gearing provisions and the CGt concessions for rental property. “

Master Builders Australia CEo Wilhelm Harnisch had also welcomed the proposed reduction in the company tax rate from 30 per cent to 28 per cent, with an earlier reduction for small business.

As a result of the changes to the resources tax, the company tax rate is now planned to be cut to 29 per cent rather than 30 per cent.

the Federal Government has batted back to the states and territories responsibility for fixing the troubled Mandatory Last Resort Home Warranty insurance Scheme.

the Federal Government, in its response to a 2008 Senate Committee inquiry into the Home Warranty insurance Scheme said the issue was a responsibility of the states and territories.it called on the states and territories to work to harmonise the scheme across jurisdictions and ensure the cover remains available.

the Senate inquiry was established in response to concerns about warranty insurance in some states and the withdrawal of some insurers. the position in the ACt is different however, with the ACt Master Builders Fidelity Fund, which provides warranty insurance for members in the ACt, unaffected by the difficulties in some states. (details of the ACt position below.)

the Government’s response was well outside the unenforceable (and frequently ignored) requirement that it respond within three months of a Senate Committee reporting on a matter. the Senate Standing Committee on Economics reported on the Home Warranty insurance Scheme in november 2008.

in its response the Government said it noted “that a number of HBWi providers have either departed the market in recent months or signalled their intention to do so. Given that HBWi is mandatory in most States and territories, it is crucial that the insurance remains readily available.

“the Government calls on States and territories to explore options to harmonise and improve broader consumer protection measures in the building industry through the MCCA (Ministerial Council on Consumer Affairs) process.”

sent off to coagthe Ministerial Council on Consumer Affairs (part of the Council of Australian Governments) agreed to examine the Scheme in May 2009 but has yet to report any progress on national arrangements.

the Federal Government said regulatory responsibility for HBWi resides with state and territory governments, which determine whether, and in what form, to mandate HBWi. the Commonwealth’s role in this area is limited to the regulation of insurers under the insurance Act 1973, corporations regulation, including under the Corporations Act 2001, and generic consumer protection provisions under the trade Practices Act.

it said, “State and territory governments also have broader regulatory responsibilities for the building industry. importantly, this means that the form and scope of HBWi can be considered in conjunction with other aspects of the building industry, including licensing requirements and dispute resolution mechanisms. the Government considers it essential that HBWi be considered in this broader context.

“Evidence to the Committee from the hearings and submissions, from a variety of stakeholders, also indicated a strong view that HBWi should be considered as part of building industry regulation as a whole.”

the Federal Government rejected a minority Senate Committee report signed by the Greens which proposed Australia adopt a national system based on Queensland’s model, the design of

which would be overseen by the Australian Government.

the Government said it was concerned that HBWi had been a source of frustration for consumers and builders. in response to these concerns, and following the recommendations of this Senate inquiry, it had placed the issue of improving consumer protection in regards to home warranty insurance on the MCCA agenda for its May 2009 meeting. “the Government agrees with the Committee’s recommendation that MCCA is the most appropriate body to pursue the issue further,”

act scheme operating well While warrant insurance in some states, where cover is provided by external insurers, has been the cause of concern, the position in the ACt is different.the ACt Master Builders Fidelity Fund has safeguarded the ACt home building industry against the uncertainty over home warranty insurance, which has affected some other states.

in the ACt, home warranty insurance is unaffected by recent changes in nSW , with the ACt Master Builders Fidelity Fund continuing to provide coverage in the territory.

the ACt Master Builders Fidelity Fund provides the same level of consumer protection as provided by Home Warranty insurance providers. it was established in 2002, under the ACt Building Act following the collapse of HiH and the reluctance of other insurers to step into this gap.

the Fund operates under a prudential standard established by ACt Government regulation and reports to ACt treasury.

Under the ACt Building Act, Builders Warranty insurance must be provided for all residential construction and alterations with a contract price of $12,000 or more, against the insolvency, disappearance or death of the builder during construction and against latent defects. it must also be provided for multi-unit dwellings up to a maximum sum insured of $85,000 per unit. Warranty insurance is not provided for residential buildings of above three habitable storeys. nor is landscaping, swimming pools, driveways and similar works covered.

the warranty period is six years from completion for structural defects and two years for non-structural defects. Purchasers of properties covered by the Fund (Successors in title) inherit the remaining period of cover under the above provisions of the scheme.

the Master Builders Fidelity Fund was established to secure the future of the construction industry in the ACt when insurance companies were collapsing or withdrawing from the Housing indemnity market. Master Builders recognised that a long-term solution was required and the Fidelity Fund, administered by the Master Builders Association of the ACt, delivers warranty insurance to builders at the lowest possible premium rates. Master Builders believes consumers and builders can have confidence in the stability and the security of the Fidelity Fund.

there has been a lot of adverse publicity in recent times regarding the quality of construction work in the ACt and while we believe this publicity revolves around isolated incidents they are a matter of great concern because they go to the credibility of our industry.

that is why the Master Builders Association of the ACt is a willing participant in the Building Quality Forum initiated by the ACt Planning Minister. it is in the building industry’s own best interests to identify the problems and to address them.

But while tightening some of the regulation may represent a part of the answer, the longer-term remedy lies in improving training, product specification and project oversight particularly where larger multi-unit developments are concerned.

there is also a need to better educate consumers as to their expectations. Some consumers have high expectations of what is expected and delivered and do not understand the complexity of issues involved in the building process. You just can’t buy a building in a box.

there are a number of factors that affect the “buildability” and final outcome. Some of these are design factors and some are associated with the skills levels of the individuals delivering the final product. As a key industry representative body, we felt that it was important that the industry’s perspective and recommendations be put forward for consideration and future discussion.

skills shortages. this is a well-publicised issue in the construction industry, with no immediate short-term solution other than the fact that Master Builders, through its school-based programs, continues to promote the advantages of a career in the construction industry.

However, there is another issue that is associated directly with skills shortages – skills deficiency.

the construction industry is confronted with diminishing skills levels as technologies change and traditional best practices are being replaced by some short-term arrangements that do not deliver quality outcomes in all instances.

the common building defects that have been identified, primarily, in multi-unit construction, relate to waterproofing and facade finishes such as rendering.

We believe it is therefore critical, that a strategy is developed to deal with these two primary building defect issues, starting with the promotion of best practice. to achieve this, Master Builders has had discussions with waterproofing component manufacturers to deliver specific training in the application and detailing of waterproofing membranes. We will also hold “Build Quality’ workshops on 22/23 September that will specifically deal with waterproofing products and their application. Master Builders doesn’t believe that licensing of waterproofing applicators will address this issue; critical skills training is required in this area that will deliver a number of suitably

qualified and accredited individuals.

Rendering is one of the more traditional-type trades and in recent years there has been somewhat of a renaissance whereby render finishes are applied to facades, rather than traditional face-brick. this can be partially attributed to skills shortages associated with face-bricklaying. there currently is very limited training available for render applicators. this is an issue that industry needs to address if this form of construction finish is to continue.

onsite supervisionUnder the Building Act and the Construction occupations Licensing Act, the licensed builder or the nominee is responsible for providing adequate supervision of the sub-trades under his/her control. this key role must be emphasised by the industry and the regulator in communicating a clear message to the industry that proper supervision is critical.

Master Builders recommendationsMaster Builders believes there are a number of elements that will go towards addressing the building quality problems including;

• Better-specified documentation with respect to multi-unit construction and a more proactive approach on the part of building certifiers in ensuring the quality of that documentation.

• targeted training addressing the most common aspects in construction.

• inspections and certifications at key hold points during the construction process.

• tighter oversight of builders to ensure they have the skills and experience necessary to satisfactorily understand the complexities associated with the more complex multi-unit type construction.

• Moving beyond the building industry itself, manufacturers need to place greater focus on appropriate specification. in some instances products are specified for particular project and it is later discovered they were not appropriate for that purpose.

• Builders are usually given tight time-frames to complete projects due to the excess holding costs associated with large projects. it should therefore be incumbent on builders who take on complex project to ensure they have the resources and skills necessary to competently undertake the work.

there will be many who, reading this analysis, will say the answer is more legislation and tougher regulation. However, it is not that simple or easy. While some tighter regulatory oversight is justified, the real answer lies with the Government working with our industry to address the issues i have raised.

when requirements are demonstratedthe energy performance of a new building must be demonstrated when applying for building approval. the building certifier will require proof that a building will meet the mandatory minimum energy efficiency standards as part of determining whether to give building approval.

how requirements can be demonstratedEnergy efficiency requirements (EER) for building approval can be demonstrated a number of ways. Before you design and prepare plans you might like to discuss with your designer the most appropriate method of demonstrating your building has met the requirements.

Some appropriate ways to demonstrate EER include:• using a current accredited software model (this is done

by a suitably trained and competent accredited energy assessor)

• comparing your building with a reference building - this involves verifying the plans for the new building are the same as those for a reference building which complies with the EER

• the deemed-to-satisfy method - the Building Code of Australia (BCA) specifies design features which, when adopted in the design of a building, are sufficient to meet the EER

• accepting a nominated expert’s report.

For most residential buildings, certifiers are likely to accept using a current accredited software model. You will need to employ a trained energy assessor who will interpret the various energy efficiency factors specific to your design and will produce an Energy Efficiency Rating for the property.

software assessmentif you are demonstrating energy efficiency using thermal calculation by energy modelling or rating software, you should be aware ratings will be based on the thermal performance of the building fabric.

this software is performance-based rather than prescriptive, which means it doesn’t tell you the types of building elements (such as double glazing, insulation etc) required to achieve a certain rating. instead, it uses the building elements present in a building design and models the thermal performance based on those elements.

this means that in theory, where one building may require higher performance windows and a high level of insulation to achieve a high star rating, another design may be able to achieve a similar star rating without double-glazing by reducing the size of the windows and orienting the building to take advantage of passive solar heating. on the other hand, if large windows were oriented to the south or west for example, a house may struggle to achieve a high rating even with double-glazing and high levels of insulation.

new dwellingslegislation has been introduced that will help support more environmentally sustainable housing by licensing and regulating energy assessors.

Software also does not currently take into account hot water systems, photovoltaic systems, lighting or other energy-generating or consuming appliances. Separate new standards for water heaters installed in new homes have been in place since 31 January 2010.

the software predominantly used for undertaking energy efficiency ratings has been developed under the nationwide House Energy Rating Scheme.

Since 1 May 2009 only the 2006 Australian Building Codes Board Protocol for House Energy Rating Software has been referenced in the BCA. All ratings using a stated value must be produced on second generation software accredited under this protocol. Use of first generation software is no longer permitted to demonstrate compliance under this verification model.

use of eer for sale of new residential propertythe new ACt House Energy Rating Scheme Guidelines allow for rating and other energy efficiency information to be used for disclosure in some circumstances so that people who want to sell a property don’t have to both obtain an energy rating (as required under the Civil Law (Sale of Residential Property) Act 2003 and demonstrate compliance with the energy efficiency requirements of the BCA.

For example a seller might have had an energy efficiency rating done on second generation tools to demonstrate compliance with the BCA and can use this rating for the sale of the premises. these provisions only relate to incomplete premises being sold off the plan or newly completed premises that have not yet been occupied.

WorkSafe ACt is the new body responsible for regulation of health and safety in the ACt. WorkSafe combines both the former Workcover and the office of the Work Safety Commissioner. the Work Safety Commissioner, Mark McCabe, is the head of this new body, which still sits within the ACt’s office of Regulatory Services.

As well as receiving extra funding from Government to provide for more inspectors ‘on the beat’, WorkSafe ACt will be placing a stronger emphasis on education than has previously been the case and is looking to work with industry partners to improve health and safety outcomes across the ACt.

With this in mind, WorkSafe has identified residential housing as an area that requires more focus to ensure that workplaces in that sector are complying with the law and taking all reasonably practicable steps to protect construction workers from the risks associated with this work. WorkSafe ACt advises that we can expect to see more inspectors in the field in this sector in coming months.

Before that happens, however, and in line with the increased emphasis on education, WorkSafe ACt will be holding toolbox sessions for residential housing builders and contractors in late July to clarify inspectors’ expectations with regard to compliance with the ACt’s Work Safety Act 2008 and associated regulations and codes of practice.

the Work Safety Commissioner, Mark McCabe, has advised that WorkSafe ACt inspectors, while concerned about any instances of non-compliance, will be focusing in particular on five key aspects of health and safety compliance in the sector over coming months:

• fall protection• provision of amenities [e.g. toilets]• fencing of sites• site housekeeping• Construction induction cards.

the toolbox session will be an opportunity for builders and contractors to hear directly from WorkSafe ACt what their expectations are in relation to each of these items. WorkSafe inspectors will also be on hand to answer questions regarding any of these matters.

At the same time, WorkSafe ACt will add advisory material to its website setting out its expectations in this area. in August, WorkSafe ACt expects to launch a new website, bringing together the information previously provided through the Workcover site and the Work Safety Commissioner’s site, which will be redesigned to provide easier access to the information stakeholders are looking for to help them meet their safety obligations.

G E Shaw was founded in 1989 by Graeme Shaw, who has since moved onto other interests. the company was sold to the new owners in 2004, all long time employees.

the company’s first projects, were the Bio Chemistry Annex and Hancock Library for the Australian national University. twenty-one years later, the company’s strong relationship with the AnU continues.

in 2008 G E Shaw won a Master Builders Australia national Award for the rebuilding of the Commonwealth Solar observatory Building at Mount Stromlo for the AnU.

other major clients over the 21 years have included the ACt Government, Harvey norman Group, and a number of Federal Government departments including the department of innovation, industry, Science and Research, Australian Maritime Safety Authority, Customs and Air Services Australia.

the company has about 50 staff and has undertaken approximately $180 million worth of work over the past six years. it currently has projects valued at about $50 million under way.

Most of G E Shaw’s work is in the ACt but it has also undertaken projects in Sydney, Wollongong, Coonabarabran, Wagga Wagga, Bombala. it is just about to start two new projects in Batemans Bay and Hobart.

for twenty years Zvonko and ray have been g e shaw’s ‘go to’ guys! Zvonko Benac and Ray Hemsley are G E Shaw’s go to guys.

Zvonko celebrated 20 years with the company in december 2009 and Ray will celebrate 20 years in november 2010.

they are senior construction workers who carry out many functions for G E Shaw – support for the site managers, ensuring the sites are clean and overseeing general site safety. they coordinate the subcontractors, traffic management and material deliveries. they also take a keen interest in employed by the company, mentoring the young labourers and cadets.

Both men are an example of the long term loyalty and dedication shown to the company over the past 21 years. they are ‘hands on’ with concrete finishing, steel fixing, formwork and footings, plastering and rendering.

Zvonko has worked in the construction industry for nearly 40 years. He arrived in Australia from Croatia in 1972 and went to work at the iconic Cameron offices project in Belconnen. He has worked on numerous construction sites – including the neurosurgical suite at Canberra Hospital, several Early Learning Centres, domayne’s Fyshwick store, new security installations at Parliament House and the conversion of East Block in the Parliamentary triangle for the national Archives.

in the Parliament House security upgrade, the project required a low wall, about a metre high, complete with bollards to create a wall that would protect the building and its inhabitants from potential terrorist attacks, yet remain low enough so it would not appear obtrusive or impact on the appearance of one of Australia’s most iconic buildings.

in his own time, Zvonko enjoys his veggie garden and cooking.of his 20 years at G E Shaw, Ray says that he has enjoyed the challenges in the last 10 the most. He has also worked on many Canberra landmark sites since moving to Canberra with his family from Kyogle in northern nSW in 1975.

Ray’s impressive list of G E Shaw projects includes: Braddon Gardens, John James Hospital, Commonwealth Solar observatory at Mt. Stromlo, several years at the AnU and the north Building conversion to the Canberra Museum and Gallery. Ray enjoys travel and has toured Europe, including France, Austria, Germany and Switzerland.

it was a spectacular night of fine dining, premium entertainment and the golden opportunity to catch up with many old friends and colleagues at the 2010 Master Builders & Boral Excellence in Building Awards.

the evening began at 6.00pm on Friday 25 June with almost 1500 guests flowing in to the national Convention Centre, Canberra to attend the night-of-night’s for the building and construction industry throughout Canberra and the surrounding region and to celebrate yet another year of exceptional achievements.

the host of the evening was Anh do, as seen on thank God You’re Here, dancing with the Stars and the Matty Johns Show, to name a few. With his highly energetic nature and straight-forward comedy, Anh do entertained the crowd throughout the presentations with his own brand of observational humour and many stories from his childhood.

the entertainment for the evening was a blast from the past, Al James as neil diamond: the Ultimate tribute. Playing classics such as Sweet Caroline, Crunchy Granola Suite and Cracklin’ Rosie, the nostalgic neil diamond tribute certainly got guests on their feet dancing to their old favourites.

the construction of the Botswana High Commission showcases great quality of workmanship and meticulous attention to detail. this outstanding project boasts exceptional finishes, clean and precise joinery, and intricate glazed brickwork on the curved external wall.

Also taking out the award for Commercial Building $6m - $12m, this project features flawless joinery, extensive timber paneling and intricate design, all of which demonstrate great precision and expertise.

Michael Ensor from Kell & Rigby said that taking out the title of Project of the Year came as a very pleasant surprise.

their project at 3-5 national Circuit, Barton (pictured) received particularly great accolades on the night, highlighted as an incomparable project completed flawlessly and to exact specifications. the judges were in awe of the level of precision and expert knowledge of structural elements which were required in the construction of this building, due to the complicated nature of its impressive yet unusual interior. the finished product is an extremely impressive building of great proportions which generates a real ‘wow’ factor.

hewatt earthworks

Hewatt Earthworks have again been recognised with the Civil Subcontractor award for their outstanding work on the oak Flats to dunmore Realignment, HW1 Princess Highway, Shellharbour.

this project was overall an immensely challenging one. there were many technical complexities to be considered in its construction, all of which were swiftly overcome by Hewatt Earthworks using innovative solutions. However some challenges were more difficult to conquer than others, including weather dilemmas, the need for strict traffic management and tight time constraints.

However, the team at Hewatt Earthworks met all the above demands with professionalism and expertise, demonstrating exceptional project management and an overall well-executed construction process. Most recently, he won the Gold medal at the 2010 national Worldskills Competition.

taking out the award for Civil Project less than $1m was Hawkins Civil Engineering in conjunction with Baxter Engineering (ACt) for the replacement of Cohen Street Pedestrian Bridge in Belconnen. the level of precision involved in the manufacturing and engineering process was meticulous, and innovative solutions were employed to allow for the bulk of work to be done offsite.

Winning the award for Civil Project $5m - $20m was Woden Contractors for their work on the busy Pialligo Avenue Airport interchange. the judges commented that this project is one of the best looking road jobs in the whole of the ACt. the end result is a truly incomparable project which excels in its quality and precision.

urban contractors

Flawless workmanship and a great dedication to their work have earned Urban Contractors the award for Civil Project $1m - $5m.

these civil works at the national Gallery of Australia have been completed to the highest possible standard, due to scrupulous work and attention to detail on behalf of Urban Contractors. despite working on an extremely busy site, this project has certainly not been rushed, with masterful expertise and meticulous care employed to achieve a clean and flawless final product.

the judges were awed in particular by the straightness of the walls and the accuracy involved in the overall construction of this project.

the cooper review the Cooper reforms released on July 5th have the potential to provide working Australians with improved access to low-cost, user-friendly and secure super funds. the Panel made 177 recommendations to Government on all aspects of the Australian superannuation system.

the recommendations realise that working Australians – including those who are not engaged with their super – deserve the protection and benefits of commission-free, low-costs super, already provided to the estimated six million workers who belong to not-for-profit funds such as Cbus.

Requiring funds to offer low-cost financial advice for members, post-retirement products, and ensuring that consumers could easily compare their fund’s performance are particularly welcome. other recommendations include a broader use of tax File numbers and mandatory electronic data submission by employers.

Some of the recommendations contained within the 500-page document require further analysis and clarification which will be undertaken by the industry in the near future. Cbus will keep employers informed of outcomes from the Review, via the Cbus website the Cbus Employer Report and Cbus email news. taking out the award for Environmental Residential Green Living Project was Project north in conjunction with Environmental Building Solutions for this cleverly designed and built Carwoola Strawbale Home.

Project north and Environmental Building Solutions have combined with the owner to construct a home that blends perfectly with the surrounding bushland by using rendered strawbale walls on the east and south western walls. the result of this innovative approach is a reduction in heating loads of 50% and 85% in cooling loads which equals the elimination of over 2 tonnes of Co2 emissions per year.

the strawbales themselves provide thermal mass, along with the internal block walls and floors, and thus maintain heat for transmission at night. the north facing aspect maximizes and maintains heat gain in all seasons with excellent cross flow natural ventilation. the home features many clever environmental initiatives including photovoltaic grid feed system, solar hot water, three rain tanks, low energy lighting, black water recycling and recycled timber uses internally and externally.

the construction process itself was highly environmentally conscious, with waste recycled; flora and fauna protected and bore water used for construction. this home is a beautiful and environmentally sustainable one, which is self sufficient in energy, water and electricity.

Crace is adding “award-winning” to its long list of accomplishments after it was named a winner in the 2010 Master Builders & Boral Excellence in Building Awards in June for its fabulous and funky terraces.

CiC Australia and PBS Homes Pty Ltd took out this year’s award in the Medium density – townhouses & Villas category for the architecturally designed terraces in Crace’s urban precinct, which were hailed by judges as “distinctive”, “aesthetically pleasing” and “environmentally conscious”.

Crace is being developed as a joint venture between the ACt Government’s Land development Agency and Crace developments Pty Ltd, a consortium that includes CiC Australia, (as lead partner and project manager) defence Housing Australia, CHC Affordable Housing and tatebrook Pty Ltd. PBS Homes played an integral role in the design and construction of the terrace homes at Crace.

Crace Project director ian dawkins says the win is terrific validation for the suburb, which has purposely stepped away from mainstream style developments to pursue cutting edge and affordable architectural design, an innovative and clever masterplan, and an unapologetically prescriptive approach to establishing and maintaining the suburb’s overarching aesthetic.

“the awards judges were particularly pleased with the way each terrace was designed and built as an individual and unique home, while still creating a very neat, unified streetscape,” says ian. “We are thrilled with this because ensuring the design integrity of our streetscapes at Crace is an important goal and one that we have worked hard to achieve.”

A panel of seven renowned architects is behind the unique look and modern styling of all the terrace homes at Crace, including oztal and Collins Caddaye Architects whose designs were highlighted as part of the winning submission. the panel’s work has provided the diversity of designs for the urban precinct’s streetscapes, including a mix of styles for the front fencing and a modern mix of external colour schemes. Each terrace shares however, the signature stylish and modern look that Crace has come to be known for.

As well as the distinctive and aesthetically pleasing designs of each terrace, judges remarked on their top quality construction and fit-out standards, and highly functional formats.

“PBS was able to deliver the high quality of workmanship that is evident in the terraces, because the company was intimately involved in the project from the design and construction stages right through to delivery of the completed homes,” says ian.

“that included a full-time construction manager and an onsite manager to oversee every aspect of the building process and to ensure the highest quality workmanship was adhered to.”

ian says another facet of excellence that judges singled out related to Crace’s environmental credentials. “this feedback is particularly pleasing given that a fundamental premise of this development is its commitment to sustainability and environmental considerations,” he says.

during the construction of the demonstration village, innovative practices were adopted to minimise environmental impacts and enhance cost efficiency. “these practices will be mirrored across the development of the entire suburb and complement our other, major environmental initiatives,” ian says, “including measures which have been implemented to reduce emissions from all bulk earthworks, road construction and infrastructure servicing.

“We are also aiming to achieve a minimum of 90 per cent of homes at Crace with a six-star energy rating.”

the Crace Joint Venture took an innovative approach to designing its terrace homes by selecting a panel of renowned architects to create diversity and synergy all at the same time.

oztal Architects and Collins Caddaye Architects are the two firms responsible for designing the terraces highlighted in this year’s awards program. other architects responsible for the fresh and funky terrace designs at Crace are dKo Architecture, tt Architecture, Phillip Leeson Architects, dJAS Jackson Architecture, CEo and Heyward Lance Architects.

new High Risk Licensing requirements for the building and construction industry require that existing Certificates of Competency be changed over to new licences between June 2010 and 2014, depending on when existing licences were issued.

the Work Safety Regulation 2009 introduced High Risk Work Licensing to the ACt. the High Risk Work Licensing scheme replaced the former occupational Health and Safety Certificate of Competency scheme.

Anyone issued a Certificate of Competency will have to move across to a High Risk Licence between 2010 and 2014.

the date on which people must transfer to the new Licensing arrangements depends on when their Certificate of Competency was issued. Certificates expire according to the following table issued by the office of Regulatory Services:

• dragline (Ld)• Excavator (LE)• Front-End Loader (LL)• Front-End Loader/Backhoe (LB); and• Front-End Loader of the Skid-Steer type (LS).

the High Risk Work Licence is a national licence. People who hold the relevant class interstate High Risk Work Licence do not need to obtain an ACt licence. Similarly, an ACt licence is valid in all other states and territories.

People who hold an interstate Certificate of Competency can use it as evidence of competency to gain a High Risk Work Licence in the ACt.

how to applyApplications must be made in person at the office of Regulatory Services Shopfront, 255 Canberra Avenue, Fyshwick. (office hours are 9.00am - 4.30pm Monday to Friday.)

to obtain a licence people need to provide two forms of id, as well as a copy of their current Certificate or High Risk Work Licence as evidence of your competency. A fee is payable.

oRS said that if people provide all the required documents and are assessed as eligible for a licence, they will be issued a licence immediately. But for people using an interstate certificate or licence, it may take up to two weeks to complete the application as oRS will need to verify the currency of their certificate.

the licence will include the person’s photograph and a copy of your signature, licence number and expiry date. the back of the licence will show the classes of work included.

oRS said it is endeavouring to issue the licences a time convenient for employers and employees and urged organisations with a large number of employees requiring licences to contact oRS on 6207 3000 before sending their employees to the office.

We have recently received a number of complaints from builders regarding delays associated with the connection of temporary and permanent power, especially to houses in greenfields areas.

Following our most recent industry meeting last week with representatives from ActewAGL, this issue was discussed at great length once again. there was a joint conclusion between the parties that these delays can be equally attributed to resource

issues within ActewAGL to cope with the spike in demand for residential housing in the greenfields estates and, also, the issue of ActewAGL contractors being unable to gain access to install underground service conduits.

i have been provided data from ActewAGL which confirms that some of the sites have been inaccessible due to materials being stored at the front of the property. Some of these materials are immovable, such as pallets of bricks, etc.

So – how do we overcome this problem? the solution is the BUiLdERS’ PoLE. this solution is currently being adopted by one of Canberra’s leading builders – Blackett Homes. the photo shows a meter box installed on a Blackett Homes site in Canberra with builder’s pole and permanent power connected. this work and installation was completed at the placement of the footing stage in the construction process. no more issues on this site for access to connect power.

the Government says it hopes to have the new system in place by 1 January 2011, although this timing may be affected by the timing of the Federal election.

Under the proposed scheme, which has been discussed between state, territory and Federal Governments for many years, a private contractor registered in one state or territory would automatically have its qualifications recognised everywhere else in the country.

At present, each state and territory operates its their own separate prequalification regime, with each requiring contractors to prove their technical and financial bona fides as well as their ability to deliver value for money before being allowed to operate.

the consultations with industry started on 10 June and are being undertaken by the Australian Construction industry Forum, the Australian Procurement and Construction Council and Austroads.

Minister for infrastructure, transport, Regional development and Local Government, Anthony Albanese said, a national Prequalification System will cut red tape, boost competition within the construction sector and promote a more seamless national economy.

He said, “Without a doubt, one national system and one set of nationwide rules simply makes commonsense and is yet another long overdue micro economic reform being delivered by this Labor Government.”

At the conclusion of their consultations, Austroads and the Australian Procurement and Construction Council will prepare a detailed reform plan for consideration and endorsement by the Council of Australian Governments (CoAG) later this year, Mr Albanese said.
