    AFFIDAVITThe undersigned affiant, being duly sworn, deposes and says:

    I, Sergeant Robert E. Ford Jr.,am a sworn member of the Hartford Police Department and haveapproximately twelve (12) years experience in law enforcement and criminal investigations. I amcurrentlyassigned to the Hartford Police Internal Affairs Division and have been so for the last two years. M y primaryresponsibilities are to investigate allegations of police misconduct and criminal activity.

    On November 2,2009, at approximately 1500 hours, I was at the Hartford Police Department located at 50Jennings Road. I entered the Officer's Report Room to talk with Officer Germaine Coachman and OfficerBryant Moore.While in conversation with Officer Coachman and Officer Moore; Officer Rhashim Campbell entered the

    room, approached us and stood to the left of me while we were talking. Officer Campbell was looking forLieutenant Kevin Ahlquist and inquired abouthis location. Officer Tuyen Bergenholtz entered the room andasked Officer Campbell about the condition of his injured finger. Officer Campbell reported to me and theadditional officers standing around that hereceived his injury from aprisoner biting him and hoped that theperson did not have HIV, hepatitis or any other communicable disease. At this time Officer Coachman,Officer Moore, Officer Bergenholtz, Officer Campbell and I were engaged in a mutual conversation regardingOfficer Campbell's injured finger and theprobabilities that hecould have been affected with a communicabledisease. I asked Officer Campbell, "How did you let someone bite you?" at which time he informed me thathe was wrestling with someone when he was bit. Officer Campbell reported that a prisoner punched him inthe face before he got bit. I asked Officer Campbellhow did he let a prisoner punch him in the face?(This is page of a 7 page Affidavit.)

    T he undersigned affiant, being duly sworn, deposes an d says:Officer Campbell informed me and all the officers present that the prisoner punched him in the face

    through the cell bars. Officer Campbell stated, "I opened up the door and whoopedhis ass." Officer Mooreasked for clarification and asked Officer Campbell if he meant to say that he was effecting an arrest and wasdefending himself? Officer Campbell answered "No" and repeated "I opened up the door and whooped hisass." Officer Campbell continued to boast how he beat up the prisoner for punching him in the face andstated, "I tried to kill him, I tried to fuck himup."

    Officer Coachman and Officer Moore physically grabbedOfficer Campbell and escorted him out of thereport room while advising me to ignore him and suggested that he was on medication and not fully aware ofwhathe had reported to the roomfull of officers and me.

    I initiated aninvestigation based uponOfficer Campbell's statements that he entered a locked cell andassaulted a prisoner. The investigation revealed the following facts:

    On November 1, 2009 at 0025 hours, Michael Stewart was arrested byOfficer Robert Fogg for a domesticrelated incident involving his wife Antoinette Stewart. The domestic arrest was documented under HartfordPoliceDepartment Incident/Prosecutor Report 09-46569. The following is a summary of Officer Fogg'sreport: Officer Fogg witnessed Michael Stewart struggling withhis wife over her pocketbook. Officer Foggobserved Michael Stewart snatch the pocketbook awayfrom his wife. Officer Fogg ordered Michael Stewartto drop a concealed item that he retrieved from the pocketbook and show his hands. Michael Stewart wasreportedly intoxicated from alcohol, refused to comply with the officers' directions andpolice issued oleoresincapsicum spray (OC spray) was used to control and arrest him. Stewart was reportedly angry and hostile withE M S staff who responded to decontaminate and offer him relief from the effects of the OC spray. Stewartwas secured in handcuffs and transported to the Hartford Police Booking Division by Officer Fogg. Therewas no additional force used on Stewart during the arrest. Michael Stewart was charged with violatingConnecticut General Statutes 53a-181 Breach of Peace and 53a-167a Interfering with an Officer.

    OnNovember4,2009,1reviewed video surveillance footagefrom the booking facility. The surveillancefootage shows the following: November 1,2009 at 0113 hours, Michael Stewart arrived atbooking withOfficer Fogg. At 0116 hours, Michael Stewart was escorted tocell D-7 where Officer Lee and OfficerCampbell searched and removed his sneakers and other personal property. Theofficers removed thehandcuffs and left him inside the cell alone. On several occasions, Michael Stewart was shaking the cell door

    The undersigned affiant, being duly sworn, deposes and says:and appeared to be agitated and shouting. M ichael S tewart removed his pants and shirt but kept on hisboxer underwear, socks and t-shirt.

    At 0211 hours, M ichael S tewart, reached his right arm through the cell bars, turn ed on the water spigot andwater spouted to the floor; flooding the area. M ichael S tewart then returned to a bench where he laid down.Officer Campbell and Officer Lee spent a pproximately twenty five (25) minutes cleaning water from the floor.

    At 0236 hours, Officer C ampbell and Officer Lee walked M ichael S tewart from cell D-7 to anotherunoccupied cell. Officer Lee and Officer C am pbell locked S tewart inside the cell but returned seconds laterand retrieved his pants and shirt which S tewart carried with him and placed on a bench. Immediately uponentering the cell, Officer C ampbell forcefully shoved S tewart and retrieved the pants and shirt. Officer L eeand Officer C ampbell exited the cell. Officer C ampbell closed and locked the cell door, turned his back to thecell and began to walk away. S tewart reached out through the bars and appeared to hit Campbell on the backof the head with his right hand. Officer C ampbell turned back towards the cell, unlocked the cell door,entered the cell and punched Stewart on the right side of his face with his left fist. Officer Campbellattempted another left handed punch and S tewart dodged it. Officer C ampbell grabbed S tewart and wrestledhim on to the bench. Officer L ee was present and w itnessed the entire incident a nd intervened when OfficerC ampbell was apparently having difficulties with S tewart. Officer Lee approached, kick ed S tewart's leg andhelped to gain control of him. While Stewart was seated andbent over on thebench, in the corner, OfficerC ampbell used his knee and hands to deliver several strikes to S tewart. L ieutenant Ahlquist approached thecell, looked in and quickly exited. Lieutenant Ahlquist went andretrieved handcuffs from an officer.L ieutenant Ahlquist subs equently returned to the cell and handed the handcuffs to Officer Lee. Officer L eeand Officer Campbell handcuffed S tewart behind his back and he remained seated on the bench. LieutenantAhlquist and Detective G ustavo Rodriguez w ere both present inside the cell when Stewart was handcuffed byOfficer Lee and Officer C ampbell. Lieutenant Ahlquist an d Detective Rodriguez left the cell after Stewartwas placed in handcuffs. Lieutenant Ahlquist remained standing outside the cell and watched as Officer Leeand Officer Campbell lifted S tewart from the bench by his handcuffed arms, but walked away before theypushed himto the floor face first. Officer C ampbell appeared tohave kicked Stewart on the head with hisright foot while S tewart was on the ground handcuffed. Officer C ampbell exited the cell and returned shortlywith a pair of leg shackles. While S tewart was handcuffed behind his back, Officer Lee and Officer C ampbelldragged S tewart approxima tely one foot and shackled his leg to the bench.

    T he undersigned affiant, being duly sworn, deposes an d says:At 0559 hours, Stewartwas transported to Saint Francis Hospital for treatment.I reviewed the case incident report regarding th e incident that occurred inside the booking division.Hartford Police Department Incident/Prosecutor Report 09-46610 was completed by Officer Campbell.Officer Campbell documented on HPD Prosecutor Report 09-46610 that on 11-1-09 at 0300 hours, MichaelStewart was arrested for violating Connecticut General Statutes 53a-167c Assault on a Public Safety Officer.Officer Campbell's police report to the prosecutor reads as follows:"On the above date and time I was assigned toHartford Police Booking. While working inbooking I was

    called to the rear single cells because (a) Michael Stewart DOB 7-14-68 turned on thewater and flooded thecells. Myself and another officer tried toclean it up the best wecould and then place (a) Michael to anothercell. While walking (a) Michael to the new cell, hebegan topush away from me stating "WhyI gotta go inthere" I told himthat hecould not flood the new cell andplaced himinside. As I was closing the cell door (a)Michael struck me in the head and moved back in the cell. Myself and another officer, then went inside torestrain the accused andplace him in handcuffs sothat he could not strike another officer, (a) Michaelbecame combative and was wrestled to thebench. While I was restraining the accused, he bit myright ringfinger and broke the skin. I finally got my finger out of his mouth and restrained himuntil he could be placedin handcuffs. At that time my right ring finger was bleeding and throbbing inpain from (a) Michael biting it.I then went to St. Francis Hospital Emergency room to be treated for my injuries."

    On November 5,2009 and November 9, 2009,1 interviewed Stewart. Stewart reported that he was initiallyarrested because he was involved in an incident with his wife. Stewart reported that during that incident hewas pepper sprayed several times by the arresting officers. Stewart complained that he was assaulted by thebooking officers inside the booking facility. Stewart reported that hedoes not remember many specific detailsof the incident since Stewart drank a six pack of beer and at least twoLong Island ice tea alcoholic beverages.Stewart reported that he turned on the water because he was pepper sprayed during his arrest and he wantedrelief from the burning. Stewart reported that he wasmoved to another cell and that iswhere he was assaultedbyboth of the officers.

    Stewart denied that he ever struck or assaulted anyofficer. Stewart reported that he reached outside the cellfor the officer when he was inside the cell because the officer took his pants and he wanted them back.Stewart reported that he received knee blows to the head and was choked by the officers.     T he undersigned affiant, being duly sworn, deposes an d says:that the officers bangedhis head against the wall. Stewart reported that he does no t know which one of theofficers hit him with any specific strike because he tried to maintain his body in the fetal position to protecthim from the blows. Stewart reported that he bit Officer Campbell in self defense becausehe was being

    choked by him. Stewart reported that his head was slammed on the ground while he was handcuffed behindhis back. Stewart complained that he has received headaches and dizzy spells since the incident occurred.Stewart complained of injuries to his neck, head, face, mouth, wrists and several body parts; in addition to thescrapes he received from when the officers dragged him on the floor. Stewart reported that he receivedmedical treatment and he does no t believe that the injuries are serious. Stewart reported that he wastransported toSaint Francis Hospital wherehereceived treatment for the injurieshe sustained. Stewartprovided me with a copy of his discharge instructions that he received from Saint Francis Hospital. Thedischarge instructions documents that Stewartwas diagnosed and treated for facial contusions and multipleabrasions.

    On November9,2009,1observed several bruises on Stewart's head, face and body. Stewart's bookingphotograph depicts injuries to his mouth, left side of his forehead and left side of his face. T he left side of hisface underneath his cheek appeared to be swollen.

    On November 9,2009, investigators interviewed Officer Bryant Moore. Officer Moore reported that onNovember 2,2009, in the presence of fellow officers, Officer Campbell stated that he was punched and bittenby a prisoner; thereafter, Campbell, "went in the cell and whoopedhis ass." Officer Campbell denied that itwas done in self defense.

    On November 9,2009, investigators interviewed Officer Tuyen Bergenholtz. Officer Bergenholtz heardOfficer Campbell boast that he "whooped his ass."On November 9, 2009, Officer Gemaine Coachman was interviewed by investigators. Officer Coachman

    reported that she can not recall the entire sequenceof events that occurred; but she recalled that OfficerCampbell reported that the prisoner punched him in the face through the cell bars and he opened up the doorand "whooped his ass."

    Investigators interviewed Officer Dowd on the same date. He did not recall who was inside the room orwhat the conversation was about.(This s page ofa page Affidavit)

    The undersigned affiant, being duly sworn, deposes and says:On November 10, 2009 investigators interviewed LieutenantAhlquist. Lieutenant Ahlquist, who was the

    booking supervisor on November 2, 2009, reported that he did not hear Michael Stewart make any threats tohimself or any other officer. He further reported that Officer L ee called for him when Officer Campbell andhe were engaged with Michael Stewart. Lieutenant Ahlquist reported that he responded and Officer Leeinformed him that they needed handcuffs. Lieutenant Ahlquist reported that he retrieved handcuffs from anofficer who was present inside booking and gave themto Officer Lee. Lieutenant Ahlquist reported thatOfficer Campbell said that Michael Stewart struck Officer Campbell in the head while Officer Campbellwaswalking Stewart into the cell.

    On November 10, 2009, investigators interviewed Detective Gus Rodriguez. Detective Rodriguez reportedthat he was inside booking on November 1,2009 and observed Officer Campbell and Officer Lee when theystruggled with the Stewart inside the cell. Detective Rodriguez reported that he walked in the cell withLieutenant Ahlquist and he was going to assist, but by the time he went to help, Stewart was handcuffed.Detective Rodriguez reported that he did not see Stewart receive any punches, strikes or kicks. DetectiveRodriguez reported that he did not see any officer choking Stewart and did not see anyofficer with their handsaround his neck. Detective Rodriguez reported that he did not see Stewart bite Officer Campbell. DetectiveRodriguez reported that he heard Stewart talking and he recalled him saying, "I'm a Grandfather." DetectiveRodriguez reported that he left the cell once Stewart was secured in handcuffs.

    On November 12,2009, investigators interviewed Officer Robert Fogg. He reported that Michael Stewart'sbehavior was belligerent and violent at the time of his arrest. Officer Fogg reported that Stewart appeared tobe intoxicated and behaved as if he did not understand his commands. Officer Fogg reported that MichaelStewart kicked at the back seat cruiser door and window whilebeing transported to booking. Officer Foggreported that he stopped his cruiser and told him to stop kicking at the windows. Officer Fogg reported thatMichael Stewart stopped his behavior. Officer Fogg reported that Stewart stated that he was going to sue andthat he was setting up the officers. Officer Fogg reported that Michael Stewart's behavior changed when heentered booking. Officer Fogg reported that Michael Stewart was cooperative and he did not make anythreatening comments inside booking. Officer Fogg reported that he escorted Stewart to the rear cell whereOfficer Lee and Officer Campbell removed his personal property. Officer Fogg reported that the only forceused on Stewart during his arrest was the application of OC spray.
