Dear Ms. Link:

Part IX, Section R, of CBO's Class I UIC Permits states, "Iffor any reason, the permittee will be unable tocomply with permit requirements, the permittee shall give advanced notice to the NDEQ Part II, SectionC, requires the collection and chemical analysis of a monthly composite of the injection fluid entering thedisposal wells. Part II, Section B, states, "All monitoring reports are to be submitted to the NebraskaDepartment of Environmental Quality no later than 28 days after the last day of the month for which themonitoring data are being reported".

On July 5, 2017, CBO mailed to Energy Laboratories, by UPS Next Day Air, the monthly compositesamples for DDW #1 and #2. As indicated on the enclosed UPS tracking sheet, the samples did not arriveat Energy Laboratories until Saturday July 8, 2017. By email dated July 12, 2017, Energy Laboratoriesindicated that technically the samples were delivered to their buildings breezeway on the 8"', which was aSaturday, but were not received by the lab personnel unit Monday the 10'''. Due to the amount time requiredto analysis for Radium-226 (15 to 20 days) it is anticipated that the analysis of these samples will not becompleted in time to meet the reporting requirements of Part II, Section B.
