Re: Addenda to Bargaining Unit (BU) 6 - the California Correctional Peace Officers Association (CCPOA)

This is to inform you of several agreements reached between the state and BU 6. The first BU 6 agreement is an impact agreement bargained at a local meet and confer meeting. The agreement represents changes to the policy at the California Department of Corrections and Rehabilitation (CDCR) Calipatria State Prison (CSP):

o CSP- implementation of Sensitive Needs Yard Dayroom, Facility D, operational procedures are modified in this agreement to address program concerns and issues regarding the security of staff and inmates on Facility D.

Also attached are two agreements with CCPOA and the CDCR that will implement statewide policy and procedures:

o Correctional Health Care Services (CHCS) Statewide janitorial Service with the California Prison Authority (PIA) to insure implementation of a standardized facilities maintenance program for CDCR's health care facilities. This agreement is meant to achieve compliance with Plata v. Brown and meet the standards of the Court medical expert.

o Implementation of Strategic Offender Management System (SOMS) - SOMS is a CDCR computer system that is designed to streamline and automate offender management processes and provides reliable, up-to-date information to authorized staff, improving safety for staff, offenders and the public. The agreement will implement changes to SOMS policy and procedures.

AGREEMENT BETWEEN CALIFORNIA CORRECTIONAL PEACE OFFICERS ASSOCIATION

AND THE STATE OF CALIFORNIA,

DEPARTMENT OF CORRECTIONS AND REHABILITATION (CDCR), CALIPATRIA STATE PRISON (CAL), REGARDING THE IMPLEMENTATION OF

FACILITY "D" DA YROOM, SENSITIVE NEEDS YARD (SNY) (CDCR LOG #14-081-0)

This Agreement represents the full and complete understanding reached by and between the parties at the conclusion of Meet and Confer negotiations on February 2 7, 2015, regar·ding the implementation of Facility "D" Dayroom, Sensitive Needs Yard (SNY), at Calipatria State Prison (CAL).

1. CAL Management agrees to repaint necessary "Out of Bounds" lines located within each Facility "D" Housing Unit, prior to the implementation of dayroom program.

2. CAL Management agrees to inspect and adjust (if necessary) all overh~ad mirrors within each Facility "D" Housing Unit prior to dayroom implementation.

3. CAL Management agrees to tequire all inmates participating in dayroom activities to process through and clear the stand-up metal detectors located witltin each Facility "D" Housing Unit. ln the event, the stand-up metal detector is inoperable; the hand-held metal detector shall be utilized.

4. CAL Management agrees to limit inmate phone calls only to the tier currently out for dayroom.

5. CAL Management agrees to conduct one (I) lock-up at the conclusion ofDayroom Programming on Facility ~'D11 •

G. CAL Management agrees to limit inmate haircuts only to the tier currently out for dayroom.

7. CAL Management agrees to update Operational Procedure (OP) 4004 and all applicable Facility "D'' Post Orders, prior to implementation oft he dayroom program. Management fmther agrees to provide a draft copy to the local Chapter prior to its finalization.

8. CAL Management agrees to a monthly P !ant Operations Inspection which includes the inspection, cleaning and repairing of daymom lights, intercom system, "Out-of-Bounds" lines, mirrors, Control Booth windows and gun ports.

9. CCPOA and CAL Management agree to reopen this table at the request ofeitherparty within 90 days to address any unforeseen impact that may arise.

10. CAL Management agrees to issue an institutional radio to Floor Officer #1 in the event a housing unit intercom is not operating properly.

Operational Procedure 4004 dated February 27, 2015, will be the current OP for daily operations at Calipatria State Prison.

This agreement may be signed by facsimile and in pal'ts, which when aH necessary signatures are obtained, shall have the same force and effect as though all signatures were executed on one document.

II. PURPOSE AND OBJECTIVES:

A. The purpose of this procedure is to establish a uniform procedure for the daily operations of this institution.

B. The objective of this procedure is to establish a controlled environment that allows inmates to participate in program needs which support the mission of this institution.

V. RESPONSIBILITY:

A. The Warden has the overall managerial responsibility for the implementation of this procedure.

B. The Chief Deputy Warden has the overall functional responsibility for the implementation of this procedure.

C. All manll.gers and supervisors are responsible for ensuring compliance with the dictates of this procedure.

D. Each affected employee is responsible for the safety of persons, accountability of the inmate movement and the security of the institlltion in the daily operation of authorized programs and activities for inmates.

VI. METHODS:

A. Inmate Movement

1. A minimum of two Correctional Officers will be posted on the floor of Housing Units during any movement including yard release and yard recall. Staff assigned to monitor the dayroom floor will process all inmates exiting or entering the building through the metal detector.

2. Ducats or rosters will control all inmate movement not covered by a posted Facility or Program schedule (Attachment A). Note: Priority must be given to Medical ducats.

3. Inmates with Law Library, Medical, Mental Health or Dental and Classification appointments will be ducated for movement as documented in the institutional Daily Movement Sheet (DMS)/Stmtegic Offender Management System (SOMS).

4. All ducats will be honored at prescribed times, unless otherwise noted on a Program Status Report during modified programs as a result of an institutional emergency, or unscheduled medical appointments roster (i.e. Mental Health or Dental}.

5. Release for religious programs will be according to schedules for each facility or by roster for special activities.

6. Release for other inmate support groups such as Alcoholic Anonymous and Narcotics Anonymous will be in accordance with published program guidelines.

7. All scheduled activities and inmate movement will be under direct/passive supervision of institutional staff and designated volunteers.

8. Custody staff shall ensure the timely delivery of Priority Health Care Ducats to inmates prior to the scheduled appointment. The following procedure applies:

• All ducats will be passed out prior to 2000 hours or as soon as practical.

• Ducats will be hand-delivered by custody staff and a signature obtained from inmates who receive Medical ducats.

• Medical ducats that are to be re-routed within the facility will be delivered by 2030 hours or as soon as practical, but no later than 2100 hours.

• The completed Priority Health Care Ducat Distribution List and any undeliverable Medical ducats shall be delivered to the Facility Medical Clinic by 2100 hours, by supervisory designated staff.

9. Medical (including Mental Health and Dental) appointments are considered essential services. These ducats will be honored during any lockdown or modified program. Incidents and unusual disturbances may delay medical appointments, however, appointments should resume as soon as the incident/disturbance is controlled. Only the Chief Executive Officer/Chief Medical Executive or his/her designee can cancel medical appointments.

10. Bllilding staff is responsible for reviewing the OMS/Master Ducat Roster and/or SOMS Ducat System to ensure all ducated inmates are released in a timely manner.

11. During normal program, the escort ratio of inmates to staff will not exceed 1 0 to 1.

B. Housing Units

1. New Arrivals

a. Receiving & Release staff will ensure all new arrivals receive the following:

• Institutional Orientation Booklet • Medical Orientation Handbook (English/Spanish) • Spoon/fork and cup • Bedroll (two sheets, one towel, one pillowcase)

• Shower shoes (issued only if inmate does not possess authorized footwear)

• One toothbrush • One small container of tooth powder • One soap

Inmates will be required to sign their GA-160H, Property Card, as proof of receipt of the above noted items.

b. The Housing Unit Correctional Officer will conduct an orientation session per the Post Order Resource Manual. This orientation session should be conducted upon an inmate's arrival to the facility.

c. Within 14 days of arrival, the Unit Classification Committee will convene and address the inmate's housing issues and Inmate Work Training Incentive Program placement.

2. Telephone Calls

a. A log of assigned phone times shall be maintained by Housing Unit staff for 30 days (see Attachment B-1 and 8-2 [B-2, TTD Phone Sign-Up Log, for Inmates with severe hearing or speech impairment]). A copy of the unit's phone sign-up sheet will be sent to the Facility Sergeant and to the Investigative Services Unit on a daily basis by Third Watch staff.

b. Telephone calls will be scheduled according to the inmate's Work Group/Privilege Group (WGIPG) status.

c. A1/A assigned and unassigned inm<ltes will be allowed to sign up for any available time slot during their scheduled section time.

d. All new arrivals will be permitted to utilize the phone consistent with A2/B WG/PG.

e. Telephone calls for inmates on C status will be authorized on an emergency basis only.

f. Floor staff will direct the Control Booth Officer to allow the designated inmate in accordance with the phone sign-up sheet out of his cell to complete his phone call and return to his cell. The next inmate will not be allowed out of his cell until the prior inmate has returned to his assigned cell.

g. Sensitive Needs Yard (SNY) Facility D Dayroom - During the hours of dayroom, only inmate's afforded dayroorn will be allowed to sign up for phone calls during dayroom time. Floor staff and the Control Booth Officer will monitor and allow inmates to use the phone at their assigned time only.

3. Showers

a. Every effort will be made to ensure the general inmate population is provided at least three showers each week. Shower periods will not exceed five minutes in duration. The five minute duration is due to the Department's current requirement to comply with the February 27, 2014 Mandatory Drought Action Plan based on Governor Brown's January 17, 2014, Drought State of Emergency Proclamation and March 25, 2014, Executive Order to Redouble State Drought Actions.

b. Workers assigned to Central or Satellite Kitchens, plumbers or occupations which handle materials considered causti.Q.. will receive priority showers when they return from their work assignment.

c. A1/A unassigned, A2/B, and Privilege Group C inmates will normally shower on Second Watch. Inmates on C status will receive at least three showers per week and will be offered showers on Monday, Wednesday, and Friday.

(1) Upon completion of the morning yard release, the building Floor Officers will walk the tiers and create a shower list giving priority to A 1/A unassigned, A2/B, and C status inmates.

(2) If time permits, Second Watch will shower A1/A assigned Inmates that are on their regular days off (ROO).

(3) On Third Watch, A1/A assigned workers will have first priority for showers over A1/A unassigned, A2/B and Privilege Group C inmates.

d. All showers will be logged on the Daily Shower Log (Attachment C). All refusals are to be logged. The log will be maintained for a minimum of three months prior to disposal.

e. Inmates will not be allowed to clean personal clothing during shower periods.

f. During all mass movement (yard releases and in-lines) all shower doors will be secured with an appropriate locking device (padlock as applicable).

g. No more than two inmates will be secured in a shower.

h. Inmates will not be pennitted to segregate showers by race or any other manner of segregation.

i. SNY Facility D Dayroom - Inmates afforded dayroom will be logged on the Daily Shower Log (Attachment C) with the code "DR" indicating they were afforded the opportunity to shower.

4. Mass Movement

a. A minimum of two Correctional Officers will be posted on the floor of Housing Units during any movement including yard release and yard recall. Staff assigned to monitor the dayroom floor will process all inmates exiting or entering the building through the metal detector.

b. Inmates will walk in an orderly fashion no more than two abreast and are required to have their State issued identification card in their possession.

c. The yard door and inside entrance gate to all Housing Units may be open at the same time during periods of mass movement, i.e., meal release, yard recall, etc.

d. The release will be completed in a controlled manner, half of one section of one tier at a time (example: 101-1 09). Not until the last inmate exits the building will the following half section be released.

e. Upon entering or exiting a Housing Unit, inmates are required to pass through the walk-through metal detector. Inmates will be subject to a clothed body search prior to exiting and entering any building. Where walk-through metal detectors are not available or are inoperable, hand held metal detectors will be utilized. Any shoes or boots that will not clear the walk through metal detector will be removed and inspected.

f. During unlock/mass movement; supervisory staff will oversee the release. This supervision will include but not be limited to meal release, yard release, vocation/education release.

g. During any unlock/mass movement, shower gates will be secured. Men's Advisory Council representatives and porters will be off the dayroom floor. Porter equipment including mops, mop bucl<ets and brooms, will be secured; there will be no exceptions.

h. SNY Facility 0 Oayroom - A minimum of two correctional officers will be posted on the floor of housing unit during dayroom. All inmates participating in dayroom program will be required to walk-through the metal detector. Where the walk-through metal detectors are inoperable, hand held metal detectors will be utilized. Any shoes or boots that will not clear the metal detector will be removed and inspected.

C. Meal Release

1. Prior to each meal (morning and evening), the supervisor will assign staff to specific duties for meal release/coverage.

2. The release will be completed in a controlled manner, not to exceed half of one section of one tier at a time (example: 101-109). Not until the last inmate exits the building will the following half section be released.

3 One officer will be assigned to !he steam line and will be responsible for all trays issued through the food port. Seating officers will be utilized during the feeding process, requiring a minimum of two officers.

4. Inmates shall be released for the breakfast and dinner meals in a timely manner utilizing both dining rooms. All inmates will be required to pass through the walk-through metal detector prior to exiting and upon entering the building. No unauthorized clothing will be allowed in the Dining Halls (no shower or house shoes), as determined by supervisory staff.

5. Breakfast will commence after completion of Housing Unit(s) security check, but no later than 0615 hours. Breakfast is expected to be completed by 0800 hours. Any delay from this process shall be documented on the Daily Activity Report (DAR).

6. Staff will distribute a sack lunch to each inmate upon exiting the Dining Hall following the morning meal. All sack lunches must be con SLimed within a four hour period.

7. Release for the evening meal will commence upon completion of the standing count. Start and completion times shall be documented on the facility's DAR.

D. EducationaiNocationai/Work Release Procedure

Inmates will be processed through Work Change to the lndustriaiNocational area and into Education in the following manner:

1. Close Custody inmates assigned to the Culinary will report to work at 0600 hours.

2. Vocation Patrol and Education Officers will advise the Yard Sergeant, upon completion of their designated security check, but no later than 0810 hours, tl1ey are ready to process inmates into their area.

3. Beginning at 0810 hours, inmates assigned to the Vocational area or to a morning Academic assignment will be processed. Any delay in the process will be documented on the DAR.

4. Beginning at 1215 hours or upon completion of the Close A count, inmates assigned to an afternoon Academic assignment will be processed. Any delay in the process will be documented on the DAR

E. Food/Security Port Utilization

For staff safety:

1. Any time it becomes necessary to open a food/security port to handcuff an inmate, deliver food, medication, or other services, there must be correctional staff present and the inmate will be verbally ordered to turn on the cell light and remove any light or window coverings, if present. prior to opening the food/security port.

2. All cell windows and lights should be clear of any coverings.

3. Staff should be able to see the inmate's hands and determine that the food/security port can be safely opened.

4. If the inmate refuses to turn on the cell light or refuses to remove any coverings he has over the cell window or light, the food/security port will not be opened.

5. The inmate will be informed his refusal to remove the coverings constitutes his refusal of the service being offered, and appropriate disciplinary measures may be taken.

6. If during routine duties, correctional officers encounter an inmate who refuses to allow staff to close and lock the food/security port, the officer shall verbally order the inmate to relinquish control of the food port/security port and allow staff to secure it. If the inmate relinquishes control of the food/security port, it will be secured. In the event the inmate does not relinquish control of the food/security port, the officer shall back away from the cell and contact and advise the custody supervisor of the situation. Controlled force may be initiated while custody staff continues to monitor the inmate.

F. Yard

1. Prior to each yard release (morning and afternoon), the Yard Sergeant/Program Lieutenant will assign staff to specific duties for yard release/coverage, in addition to Housing Unit staff assigned to the building being released.

2. The release will be completed in a controlled manner, not to exceed half of one section of one tier at a time (example: 101-109). Not until the last inmate exits the building will the following half section be released.

3. The first yard session will begin at 0830 hours or at the conclusion of work release. The second yard session will begin at 1230 hours or when the Close A Custody count clears and work/academic release is completed. All inmates will be required to pass through the walk-through metal detector before exiting/entering the Housing Unit.

4. All yard releases, in-lines and recalls wilt be conducted one building at a time by section (A, B, C), based on each facility's yard release mtation.

5. Access to yard is limited to eligible inmates using the DMS/Unlock Report or SOMS. Inmates must be in possession of their State identification card prior to being released to the yard. All new arrivals may participate in yard program.

6. Inmates accessing the yard will wear clothing in the manner it was intended to be worn, no sagging of pants, or shorts. Bandanas will be worn as sweat bands of one inch in width and not to cover the face or hang from the waist band or pocket. Inmates will not be allowed to exercise on the yard wearing boxers only, Inmates utilizing the yard misters will not remove their boxers.

7. No appliances are allowed on the yard, i.e. trimmers, radios, compact disc players and headphones unless intended for trade in the package window.

8. No laundry bags onto the yard unless intended to assist in pick-up of canteen or packages. Once canteen or packages are picked up they will not remain on the yard. No canteen or packages will be brought out to the yard.

9. Inmates 011 the yard will only be allowed to have four inmates to a group. Exercising is not allowed on the roadway. If an inmate wishes to use the roadway curb for pushups, the feet must be extended into the yard, as not to block pedestrian traffic on the roadway. Inmates are not to use the roadway for congregating. Inmate utilizing the roadway must use it for walking or running.

10. Only CDCR authorized games or game boards will be allowed on the yard.

11. Inmates will be allowed to take leather mesh weight lifting gloves/leather palm (white only) to be used on the isometric yard. The gloves are only authorized to be worn and used inside the isometric exercise area. If inmates are observed wearing the gloves outside the isometric exercise area, the gloves will be considered contraband and are subject to confiscation. Inmates in violation of these procedures will be subject to progressive discipline.

12. Inmates wlll stand three feet away from the center fence as not to allow the passing of contraband from yard to yard.

13. Inmates will be restricted to their cells for the following reasons:

a. Disciplinary detention

b. Medicallay-ins

c. Emergency lockdown/modlfied pr-ograms

Yard for General Population Yards A, Band C

Monday- Friday

C status inmates will be provided yard from 1145 hours to 1230 hours with the exception of holidays

A1A assigned inmates with RDOs during the week will be allowed to attend all yards on their RDOs regardless of the building rotation.

Saturday, Sunday and Holidays

Weekend and Holiday yards will only be for A 1 A assigned inmates with these RDOs.

A1A assigned inmates with RDOs from all buildings will be allowed to attend yard on Saturday, Sunday and Holidays.

15. Yard Size

Normal program yard session will consist of one tier from two buildings, separated by a building on each side of the yard. The exception is for A1A assigned inmates. A1A assigned inmates will be able to attend yard at both the AM and PM sessions on their RDOs Monday through Friday regardless of their building rotation.

SNY Facility D

The SNY inmates from two housing units, per established yard schedule, will be released to participate in yard activities on a daily basis during normal program. Inmates on their RDOs, Monday -Friday only, will be allowed yard access during AM or PM yard regardless of what housing unit is scheduled for yard. RDO yard does not include W.1'lekends or holidays. Yard release and yard recall will be conducted one housing unit at a time. A yard schedule will be established to afford inmates varying access to morning and afternoon yard. If it is determined the increase creates any type of disorder or increased acts of violence, the revised yard schedule for Facility D (SNY) may be immediately discontinued.

Any changes in yard size either up or down requires approval from the Warden/designee.

G. SNY Facility D-Dayroom

1. Prior to each dayroom release, the Program Sergeant /Lieutenant will authorize dayroom program to start. The Program Sergeant/lieutenant will provide each Housing Unit with a SOMS/Unlock Report and curr-ent loss of privileges list each day.

2. The dayroom session will begin at 1900 hours or at the conclusion of the evening meal. Close A Custody inmates are approved to be allowed evening dayroom access until 2000 hours in accordance with CCR, Title 15, Section 337.1(a)(2)(8). All inmates will be required to pass through the walk-through metal detector before participating in dayroom activity. When available, an additional officer will be sent to each Housing Unit to assist with dayroom release and the processing of inmates through the metal detector. If the walk-through metal detector is inoperable, a hand held metal detector will be utilized.

3. Access to dayroom is limited to eligible inmates from one section of one tier (i.e. upper A, Lower B, etc.). Inmates must be in possession of their State Identification card prior to being released to the dayroom. All new arrivals may participate in dayroom program.

4. Inmates accessing the dayroom are required to wear shirts (no tank tops), pants or shorts, and shoes in the manner intended to be worn, no sagging of pants or shorts. Bandanas are not allo>Ved to be worn during dayroom program. Inmates will not be allowed to exercise in the dayroom. Inmates utilizing the showers will be allowed to bring their shower items (towel, shower shoes, soap, shampoo, etc.) to the dayroom and may wear their shower shoes and boxers while entering or exiting the shower in the immediate shower area only. No clothes will be allowed to be washed while in the shower and each inmate in limited to five minutes in the shower. The five rninute duration is due to CDCR's current requirement to comply with the February 27, 2014, Mandatory Drought Action Plan based on Governor Brown's January 17, 2014, Drought State of Emergency Proclamation and Marcil 26, 2014, Executive Order to Redouble State Drought Actions.

5. No appliances are allowed in the dayroom, i.e. trimmers, radios, compact disc players, headphones, etc.

6. Only CDCR authorized games or game boards are permitted in the dayroom.

7. Phone sign-up for evening phone call slots, occurring during dayroom hours, will only be authorized for inmates who will be afforded dayroom during the dayroom program for the following evening. No other inmates will be authorized phone calls or to sign up for phone calls, except as authorized by a supervisor.

8. Inmates who have work, educational or vocational assignments will not be allowed access to the dayroom during their regular scheduled work hours. Assigned inmates will be provided access to the dayroom during their non-scheduled work hours with their tier/section release.

H. Suspension of Participation in Scheduled Program Activities

1. All scheduled timelines, activities and programs are subject to the demands of the security of the institution and the safety of persons.

2. Inmate participation in these activities is a privilege and these privileges can be terminated if an inmate fails to follow the rules and regulations as published in the Inmate Orientation Handbook or other institutional and departmental policies, procedures and guidelines.

3. A modified program/lockdown exists when the Warden temporarily suspends any or all non-essential facility operations, procedures, services and/or functions in order to prevent, contain, or control a widespread facility or group disturbance.

AGREEMENT BETWEEN CALIFORNIA CORRECTIONAL PEACE OFFICER'S ASSOCIATION (CCPOA) AND THE STATE OF CALIFORNIA, CALIFORNIA

DEPARTMENT OF CORRECTIONS AND REHABILITATION (CDCR) REGARDING THE STRATGIC OFFENDER MANAGEMENT SYSTEM (SOMS)- CLASSIFICATION, STATEWIDE

This Agreement represents the full and complete understanding rear.hed by and between the parties at the conclusion of Meet and Confer negotiations on February 2.6, 2015, regarding the SOMS Classification, Statewide. This Agreement becomes an add~ndllm to the current State Bargaining Unit Six Memorandum of understanding, Article XXVII, Section 27.oJ., which expires on July 2., 2015.

• The State and CCPOA agree that prior to Implementing corrective or adverse action related to worklo~d and/or worl< product, the employee's immediate supervisor/manager will review the impact 50MS may have on the employee's workload and meet with the employee in a non-disciplinary and non-Investigatory "Shop Floor" discussion. The purpose of this meeting Is for the supervisor/manager anct employee to work together and explore the need for accommodation or overtime and/or additional training needed to address the impact SOMS has had on the employee'·s workload. Nothing In this agreement abridges the employee's rights tc th.e presence of a union representative under the MOU, PO BAR, etc. Thls will expire on January 1, 2016.

• The State and CCPOA agree that Correctional Counselors submitted worl< schedules will not be rejected solely due to lncrea>ed workload created by the SOMS dasslflcatlon and program expansion. Additionally, the opportunity for Correctional Counselors to use leave credits will not be red (.Iced or denied based on the reason list~d above. This agreement expires Jon,1ary 1, 20l6.

• The State and CCPOA agree Correctional Counselors are not required to prepare odvanced mash-ups except forOlson reviews. Utilizing these tools will remain an option.

• The State and CCPOA agree that when a Correctional Counselor r~quests accommodation/overtime pursuant tothe MOU for the purpose of SOMS related casework, the supervisor/rnanager shall determine the appropriatemeasure necessary to a1=compllsh the completion of Classification !nfom\atlon required to be inputted IntoSOMS. Any denial <lf the accommodation/overtime request shall not be bases solely u~on the Correctionalcounselor not having overdue casework. Tt1ls agreement will expire on January 1, Z016,

• The SOMS Classlflcatirln Chrono must accurately record the action taken by the. classification committ'<e. TheSOMS Classification Chrono must clearly and thoroughly articul~t~ the reasons for the actlon(s) taken,Therefore, the Committee Action Summary shall continue to record/summarize ~II of the actions taken by thecommittee, Including those represented within the body of the SOMS Chrono. This would include but Is notlimited to eotab\ishing or maintaining custody level, establishing, changing or molntaining worl< groups, the

effective dates of such changes, rr.ferr'al for retention or transfer, etc. The Committee Comments sP.ction shallaccurately and thorou~hly present the reasons for the action(s) taken by the comrnitt~e Including but notlimited to establlshrmmt of a given custody or work group. Case-by-case evaluation/reviews must clearlyarticulate the reasons for the action taken within the Committee Comments.

However, a Correctional Counselor shall not be required to reiterate lnformatlo.n that is accurately andcompletely represented within the remainder of the SOMS Classification Chrono that is not a part of the

Examples o'f this Include but are not limited to, Inmate name/number, CSRA Score, reiteration of the Information within the Special Program Screenings (If accurate), and the lnmote's comments and participation (unless not already addressed within the SOMS Classification Chrono.

Information required by dep~rtmentall'egulation or departmental policy, not olready Included within the SOMS Classification Chrono, <md/or noted within the Classification Action summary and Classification Comments must

be Included when necessary.

Case Factor Information that is acc~rately recorded within the SOMS Database, but cannot be refreshed Into the SOMS Classification Chrono, once the Committee has begun, or the Committee Decision has been recorded,

shall be ~ddressed within the Classification Comments to ensure the 'document accurately portrays the inmate's

r.ase factors.

• The State and CCPOA agree the local chapter and administration will meet within 30 days of the date of this agreement for a local meet and discuss for the purpose of coming to a mutual understanding regarding ways to address workload impact from SOMS. If these local discussions fail, the STAT!: table will be reconvened to

address their lssu~s. Prior to reconvening the State table, CDCR and CCPOA will discuss the outstanding Issues and determine the best way to attempt a resolution of the Issue.

If unable to be resolved through discussion.s with CCPOA and CDCR Headquarters, at CCPOA's request a eommittee of two CDCR management and two CCPOA representatives will meet In an attempt to mitigate the need for reconvenln~ the statewide table. Thi• meeting will occur within 3D days of CCPOA's request.

Three CCPOA representatives will be released from duty at no loss of ~:ompensatlon. The meeting will address

W<lYS to mitigate the ongoing worl<load Impact to all ccs caused by the SOMS Classification expansion. These discussions wm indude, bLit are not limited to:

o Overtime and/or other means to mitigate individwal workloads

o Scheduling additional Classification Committees

o Alternative work sp~ces for correctional counselors

o Flexibility In completing required block training, and

o Any other available Improvements or chanBes to processes or equipment

The locals will continue to meet as needed to review the adequacy of the ongoing mitigation efforts. These

follow up meetings can be scheduled as part of existing local labor/management meetings.

Every effort wlll be rna de to avoid mandating overtime of Correctional Co~nselors.

Copies of all reports generated by local management to monitor correctional counselor's workload from

September Z014 forw~rd will be provided to the CCPOA representatives at least 24 hours prior to the first meeting. Tills infc>rmation will continue to be provided for future meetings for the Intervening period (since the

last period).
