Ke1ll1Yin Department 31 of the Sacramento4 County Superior Court, Gordon D. Schaber Courthouse, located at 720 Ninth Street, Sacramento,5. California, Respondents President Barack Obama and Obama for America, by their attorneys, will6 and hereby do demur to the entire First Amended Prerogative Writ of Mandate and Restraint of Fund7 Raising ("First Amended Petition") filed by Edward C. Noonan, Pamela Barnett, Sharon Chickering,8 George Miller, Tony Dolz, Neil Turner, and Gary Wilmott. The grounds for the demurrer are as9 follows:

10 (1) That the Court has no jurisdiction of the subject of the causes of action11 alleged in the First Amended Petition (Code Civ, Proc., 430.10, subd. (a); and

12 (2) That the First Amended Petition, and each and every cause of action therein,13 fails to state facts sufficient to constitute a cause of action (Code Civ. Proc.,14 430.10, subd. (e)).15 The Demurrer of Respondents President Obama and Obama for America is based on this16 Notice of Demurrer and Demurrer, the concurrently filed Memorandum of Points and Authorities17 in Support of the Demurrer of President Barack Obama and Obama for America, the Request for18 Judicial Notice of Respondents President Barack Obama and Obama for America, all pleadings and19 papers on file in this action, and any such other matters as may be presented to the Court at the time20 of the hearing.21 Pursuant to Local Rule 3.04, the Court will make a tentative ruling on the merits of this22 matter by 2:00 p.m., the court day before the hearing. You may access and download the court's23 ruling from the Court's website at . If you do not have online access,24 you may obtain the tentative ruling over the telephone by calling (916) 874-6353 and a deputy clerk25 will read the ruling to you.
