Terms of Reference:

(a) A Standing Committee on Administration and Procedure is established at the commencement of each Assembly to:

(i) undertake self-referred inquiries or inquiries referred by the Assembly and, in addition, in the third year of an Assembly term the committee shall inquire into and report on the operation of the standing orders and continuing resolutions of the Assembly with a view to ensuring that the practices and procedures of the Assembly remain relevant and reflect best practice;

(ii) advise the Speaker on:

(A) Members' entitlements including facilities and services:

(B) the operation of the transcription service (Hansard);

(C) the availability to the public of Assembly documents;

(D) the operation of the Assembly library;

(iii) arrange the order of private Members' business, Assembly business and Crossbench Executive members' business;

(b) the Committee shall consist of:

(i) the Speaker;

(ii) the Government whip;

(iii) the Opposition whip; and

(iv) a representative of the crossbench (or if a single party, the whip of that party);

(ba) Should a whip be unable to attend a meeting, the Party nominated deputy whip may attend in their place.

(c) the Speaker shall be the Chair of the Committee; and

(d) the Committee shall have the power to consider and make use of the evidence and records of the Standing Committee on Administration and Procedure appointed during the previous Assemblies. (Amended 9 March 1995 and 4 May 1995; further amended 28 May 1998, 6 March 2008, 8 December 2011, 13 December 2016 and 29 November 2018.).

(1) a Standing Committee on the Integrity Commission be established to:

(a) examine matters related to corruption and integrity in public administration;

(b) inquire into and report on matters referred to it by the Assembly or matters that are considered by the Committee to be of concern to the community;

(c) perform all functions required of it pursuant to the Integrity Commission Act 2018; and

(d) monitor, review and report on the performance of the Integrity Commission and the Inspector of the Integrity Commission or the exercise of the powers and functions of the Integrity Commission and the Inspector of the Integrity Commission, including examining the annual reports of the Integrity Commission and the Inspector of the Integrity Commission and any other reports made by the Commission;

(2) nothing in this resolution authorises the Committee to investigate a matter relating to particular conduct or to reconsider a decision to investigate, not to investigate or to discontinue an investigation of a particular complaint made to the Commission, or to reconsider the findings, recommendations, determinations or other decisions of the Commission or the Inspector in relation to a particular investigation or complaint;

(3) the Committee shall be composed of a Member nominated by the Government, a Member nominated by the Opposition and a Member to be nominated by the Crossbench;

(4) the Chair shall be an Opposition Member;

(5) the Committee be provided with the necessary staff, facilities and resources; and

(6) nominations for membership of this Committee be notified in writing to the Speaker within two hours following the passage of this resolution.

(d) the applicability of voluntary assisted dying schemes operating in other jurisdictions to the ACT, particularly the Victorian scheme;

(e) the impact of Federal legislation on the ACT determining its own policy on voluntary assisted dying and the process for achieving change; and

(d) reasons for significant pricing discrepancies within the ACT and when compared to other Australian communities and capital cities;

(e) consideration of best practice approaches and initiatives in other jurisdictions which have a meaningful impact on reducing fuel prices; and

(f) regulatory and legislative solutions and barriers, particularly around competition and retail margin;

(2) the select committee shall consist of the following:

(a) one Member to be nominated by the Government;

(b) two Members to be nominated by the Opposition; and

(c) the Chair shall be the Government Member;

(3) the select committee is to report by the last sitting day in June 2019;

(4) the foregoing provisions of this resolution, so far as they are inconsistent with the standing orders, have effect notwithstanding anything contained in the standing orders; and

(5) nominations for membership of the committee be notified in writing to the Speaker within two hours following conclusion of the debate on the matter.

On 16 May 2019—at its meeting, the Assembly agreed to amend by omitting the words "last sitting week in June 2019" and substituting "17 September 2019".

Resolution of appointment and terms of reference:

(1) a select committee be established to inquire into the most effective and efficient model of an independent integrity commission for the ACT and that the committee make recommendations on the appropriateness of adapting models operating in other similarly-sized jurisdictions, as well as:

(a) the personnel structure of the commission to ensure the appropriate carriage of workload; governance and funding that delivers independence;

(b) the powers available to a commission;

(c) the educative functions of a commission;

(d) issues regarding retrospectivity, including human rights, and the timeframes around which former actions can be assessed;

(e) the relationship between any commission and existing accountability and transparency mechanisms and bodies in the ACT; and

(f) any other relevant matter;

(2) the select committee shall consist of the following number of members, composed of:

(a) two Members to be nominated by the Government;

(b) two Members to be nominated by the Opposition;

(c) one Member to be nominated by the Crossbench; and

(d) the Chair shall be a Crossbench member;

(3) the select committee be provided with necessary staff, facilities and resources;

(4) the select committee to report by the end of August 2017;

(5) if the Assembly is not sitting when the committee has completed its inquiry, the committee may send its report to the Speaker or, in the absence of the Speaker, to the Deputy Speaker, who is authorised to give directions for its printing, publishing and circulation;

(6) the foregoing provisions of this resolution, so far as they are inconsistent with the standing orders, have effect notwithstanding anything contained in the standing orders; and

(7) nominations for membership of the committee be notified in writing to the Speaker within two hours following conclusion of the debate on the matter.

On 6 June 2017—at its meeting, the Assembly agreed to amend the resolution at paragraph (4) by omitting “August” and substituting “October”.

(1) a select committee be established to further inquire into the establishment of an integrity commission for the ACT, through examination of a draft Government bill and the Anti-corruption and Integrity Commission Bill 2018, and other related matters, with consideration of:

(a) the Select Committee on an Independent Integrity Commission’s report released in October 2017; and

(b) human rights requirements under the Human Rights Act 2004;

(2) the select committee shall consist of the same Members of the previous select committee inquiring into an Independent Integrity Commission, unless a Member is unavailable, consisting of:

(a) two Members to be nominated by the Government;

(b) two Members to be nominated by the Opposition;

(c) one Member to be nominated by the Crossbench; and

(d) the chair shall be a Crossbench Member;

(3) the select committee be provided with necessary staff, facilities and resources;

(4) the select committee is to report by 31 October 2018;

(5) if the Assembly is not sitting when the committee has completed its inquiry, the committee may send its report to the Speaker or, in the absence of the Speaker, to the Deputy Speaker, who is authorised to give directions for its printing, publishing and circulation;

(1) this Assembly notes:

(a) the letter distributed to Canberra residents in the names of Miss C. Burch and Ms Lee titled Inquiry into the methodology for determining rates and land tax for apartments;

(b) the letter calls upon residents of the Australian Capital Territory to make submissions to an inquiry of an Assembly committee via the haveyoursay.net.au website;

(c) the ‘haveyoursay’ website is not operated by the committee secretariat, but by the Liberal Party of Australia ACT Division, with a registrant contact name of Alistair Coe;

(d) the letter and the ‘haveyoursay’ website may combine to create a false impression that they are proceedings of the Assembly or its committees;

(e) as political parties are not subject to the Privacy Act 1988 (section 6C), there is no law governing how any information collected by the website will be used, or that all submissions made were accurately forwarded to the committee;

(f) there is a possibility that submissions to the ‘haveyoursay’ website were not all submitted to the Standing Committee on Public Accounts, and hence the course of the inquiry has been corrupted; and

(g) a number of other non-Legislative Assembly websites have been established to generate submissions to Assembly committee inquiries, including Unions ACT for the insecure work inquiry and Australian Christian Lobby for the Select Committee on End of Life Choices in the ACT;

(2) pursuant to standing order 277, a Select Committee on Privileges be established to examine whether there has been a breach of the standing orders by contempt of the committee by Ms Lee, Miss C. Burch or Mr Coe, in relation to matters noted and any other relevant matters, including whether the conduct constitutes:

(a) interference with the Assembly;

(b) obstruction of orders;

(c) interference with witnesses;

(d) refusal or failure to produce documents, or to allow the inspection of documents; or

(e) destruction, damage, forging or falsification of any documents;

(3) the Committee should also examine whether the third-party websites raised in (1)(g) have raised any issues of breaches of privilege or standing orders, and whether guidelines should be developed for promotion of, and generation of, submissions to committee inquiries;

(6) the membership of the Committee is to be Ms Cheyne (Government), Mr Rattenbury (Crossbench), Mr Wall (Opposition).

On 10 May 2018—at its meeting, the Assembly agreed to amend by inserting a new paragraph.

“(4A) if the Assembly is not sitting when the report is completed, the Speaker, or, in the absence of the Speaker, the Deputy Speaker, is authorised to give directions for its printing, publication and circulation;”
